19. Uredba o ratifikaciji Sporazuma med Svetom ministrov Republike Albanije, Svetom ministrov Bosne in Hercegovine, Vlado Republike Makedonije, Vlado Črne gore, Vlado Republike Srbije in Vlado Republike Slovenije o ustanovitvi Balkanskih zdravstvenih namenskih sil, stran 225.

  
Na podlagi šestega odstavka 75. člena Zakona o zunanjih zadevah (Uradni list RS, št. 113/03 – uradno prečiščeno besedilo, 20/06 – ZNOMCMO, 76/08, 108/09, 80/10 – ZUTD in 31/15) izdaja Vlada Republike Slovenije
U R E D B O 
o ratifikaciji Sporazuma med Svetom ministrov Republike Albanije, Svetom ministrov Bosne in Hercegovine, Vlado Republike Makedonije, Vlado Črne gore, Vlado Republike Srbije in Vlado Republike Slovenije o ustanovitvi Balkanskih zdravstvenih namenskih sil
1. člen 
Ratificira se Sporazum med Vlado Republike Slovenije in Svetom ministrov Republike Albanije, Svetom ministrov Bosne in Hercegovine, Vlado Republike Makedonije, Vlado Črne gore, Vlado Republike Srbije o ustanovitvi Balkanskih zdravstvenih namenskih sil, sklenjen 14. januarja 2016 v Beogradu.
2. člen 
Besedilo sporazuma se v izvirniku v angleškem jeziku in v prevodu v slovenskem jeziku glasi:

AMONG THE COUNCIL OF MINISTERS OF THE REPUBLIC OF ALBANIA, THE COUNCIL OF MINISTERS OF BOSNIA AND HERCEGOVINA, THE GOVERNMENT OF THE REPUBLIC OF MACEDONIA, THE GOVERNMENT OF MONTENEGRO, THE GOVERNMENT OF THE REPUBLIC OF SERBIA AND THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA ON THE ESTABLISHMENT OF THE BALKAN MEDICAL TASK FORCE 
The Council of Ministers of the Republic of Albania, the Council of Ministers of Bosnia and Herzegovina, the Government of the Republic of Macedonia, the Government of Montenegro, the Government of the Republic of Serbia and the Government of the Republic of Slovenia hereinafter referred to as “the Parties”;
Identifying medical operational regional capabilities and recognizing the need for enhanced utilization of existing military medical capabilities in the West-Balkan region and noting that being part of a multinational co-operation initiative allows nations to use their medical assets more efficiently, without duplication and the loss of effectiveness,
Referring to the aim of developing a concept that has been approved by the signature of the Balkan Medical Task Force Assessment Group Declaration of Intent dated on 19 May 2015.
Have agreed on the following:
Article 1 
Definitions 
1. Balkan Medical Task Force (BMTF): Multinational Medical Military Unit composed of medical modules formed by contributions of the Parties.
2. Framework Nation (FN): a Party that provides, on a rotational basis, the core infrastructure, personnel and equipment necessary for ROLE 2 capability, in addition to its obligation as a Party, as defined herein and in the implementing arrangements.
3. Sponsor: any nation, organization or entity, other than BMTF Participants, that provides financial and/or other support to the BMTF as defined in an appropriate arrangement.
4. Host Nation (HN): The Republic of Macedonia hosting the BMTF Standing Organization.
5. BMTF Standing Organization: a permanent peacetime body of the BMTF responsible for organizing and planning the training activities and peacetime and/or contingency operations of the BMTF.
Article 2 
Purpose of the Agreement 
The purpose of this Agreement is to regulate the procedures and responsibilities among the Parties on the establishment and operation of the BMTF.
Article 3 
Mission of the BMTF 
1. In order to identify, enhance and facilitate the medical operational capabilities of the West Balkan region the purpose of the BMTF is to provide medical support at the Role 2 level on Crisis Response Operations (CRO) in a sustainable manner and rapidly respond to a broad spectrum of regional disaster relief situations. The goal is to enable the participating nations to provide vital capabilities to international operations, enhance national medical service capacities, and to achieve national, NATO and Partnership for Peace (PfP) force / partnership goals (capability targets).
2. In order to fulfill the above mentioned goals, the BMTF shall be able to:
a) plan, conduct and participate in multinational training activities aimed at reaching and maintaining appropriate readiness, capabilities and operational effectiveness, as well as contributing to the improvement of interoperability;
b) participate in UN mandated missions within the agreed area of responsibility;
c) conduct other commonly agreed activities by the Parties.
Article 4 
Activation of the BMTF 
1. BMTF shall be available for possible activation:
a) upon the request of one or more Parties or
b) upon the request of the respective international organization or
c) upon the request of any other nation.
2. Upon prior consent of each Parties’ national authorities the activation of the BMTF shall be subject to SB decision.
Article 5 
BMTF Structure, command relations and decision making 
1. BMTF will function in peacetime and in crises, as detailed in this Article.
2. BMTF shall be a multinational medical unit as a deployable modular military capability built upon the existing national medical capabilities.
3. BMTF Standing Organization (BMTF SO) is a permanent peacetime body of the BMTF responsible for organizing and planning the training activities, as well as peacetime and/or contingency operations of the BMTF. It is also responsible for unit preparation, training and certification.
4. The Steering Board (SB) is the highest decision making body, consisting of authorized political and military representatives from each Party. The SB makes its decisions unanimously.
5. The BMTF detailed structure and command relations shall be settled in the Memorandum of Understanding or other relevant documents to be signed by the appropriate authorities of the Parties.
6. The organizational structure of the activated BMTF becomes effective in crises and shall be settled in the Memorandum of Understanding or other relevant documents to be signed by the appropriate authorities of the Parties.
Article 6 
Official and Working Languages 
The official languages of the BMTF are the national languages of the Parties. English will be the working language and all operational documents are to be issued in this language.
Article 7 
Financial Aspects 
1. The costs related to the establishment, administration and operation of the BMTF shall be financed by the Parties and/or Sponsors.
2. The common expenditures for the BMTF SO will be borne by a multinational budget funded by the Parties in accordance with the cost-share formula to be determined in the Memorandum of Understanding.
3. Equipment purchased from common funds and equipment provided by Sponsors shall be property of the BMTF. The title of ownership of the national equipment provided by the HN shall remain with the HN.
4. Detailed principles and the methods for financing the BMTF shall be covered by the Memorandum of Understanding.
Article 8 
Host Nation and Framework Nation Support 
1. The HN will provide logistic support for the BMTF SO, as defined in the Memorandum of Understanding.
2. One of the Parties shall, on a rotational basis, assume the role of the Framework Nation (FN). As such it shall, in addition to its obligation as a Party, provide the core infrastructure, personnel and equipment necessary for ROLE 2 capability. The detailed obligations of a FN shall be regulated in the Memorandum of Understanding.
Article 9 
Legal Considerations 
The provisions of the ‘Agreement between the Parties of the North Atlantic Treaty regarding the Status of their Forces’ (NATO SOFA, dated 19 June 1951), Agreement among the States Parties to the North Atlantic Treaty and the other States participating in the Partnership for Peace regarding the Status of their Forces (PfP SOFA, dated 19 June 1995) and UN Convention on Privileges and Immunities of the United Nations (dated 13 February 1946) shall regulate the status of BMTF personnel, as applicable.
Article 10 
Accession to the BMTF and participation at the BMTF activities 
1. Any state may accede to this Agreement upon obtaining prior written consent of all Parties and signature of a Note of Accession to this Agreement.
2. Any international organization, entity, or any nation / nation’s force can participate in BMTF training activities or operations upon prior consent of all Parties and upon signing a relevant agreement.
Article 11 
Security Clauses 
1. All information exchanged or generated in connection with this Agreement shall be used, transmitted, stored, handled and/or safeguarded in accordance with the Parties’ applicable national and international laws and regulations.
2. Information shall be transferred only through allowed channels.
3. The Parties shall ensure that all information exchange shall be used only for the intended purposes within the objectives and the scope of this Agreement.
Article 12 
Settlement of Disputes 
Any disputes regarding the interpretation or application of this Agreement shall solely be resolved by the mutual consensus between the Parties and shall not be referred to any national or international tribunal or Third Party for settlement.
Article 13 
Implementation Arrangements 
Detailed questions concerning the BMTF shall be settled in a separate Memorandum of Understanding or other relevant documents signed by the appropriate authorities of the Parties.
Article 14 
Final Provisions 
1. This Agreement shall be concluded for an indefinite period of time.
2. This Agreement will come into effect on the 30th day upon last notification by the Parties to the HN that all internal procedures to set in on force have been concluded.
3. This Agreement shall be amended by the mutual consent of the Parties. The amendment shall be proposed in writing, through diplomatic channels, and shall enter into force according to paragraph 2 of this Article.
4. This Agreement shall be terminated by unanimous consent of the Parties at any time. Any Party may withdraw from the Agreement by given six (6) month’s written notice to the HN, who will inform the other Parties by diplomatic ways.
5. If this Agreement is terminated, or if any of the Parties withdraw from the Agreement, the Parties shall settle all outstanding issues and other possible areas of interested related to the termination or withdrawal from the Agreement.
6. Termination of the Agreement terminates all implementing Agreements/MOUs.
7. Host Nation will be the depositor of this Agreement.
In witness thereof, the undersigned Representatives, duly authorized by their respective Governments, have signed this agreement.

S P O R A Z U M 
MED SVETOM MINISTROV REPUBLIKE ALBANIJE, SVETOM MINISTROV BOSNE IN HERCEGOVINE, VLADO REPUBLIKE MAKEDONIJE, VLADO ČRNE GORE, VLADO REPUBLIKE SRBIJE IN VLADO REPUBLIKE SLOVENIJE O USTANOVITVI BALKANSKIH ZDRAVSTVENIH NAMENSKIH SIL 
Svet ministrov Republike Albanije, Svet ministrov Bosne in Hercegovine, Vlada Republike Makedonije, Vlada Črne gore, Vlada Republike Srbije in Vlada Republike Slovenije, v nadaljevanju ''pogodbeniki'', so se
ob opredelitvi zdravstvenih operativnih regijskih zmogljivosti in priznavanju potrebe po boljši izrabi vojaških zdravstvenih zmogljivosti na Zahodnem Balkanu ter ob ugotovitvi, da udeležba v večnacionalni pobudi za sodelovanje omogoča državam učinkovitejšo uporabo lastnih zdravstvenih sredstev brez podvajanja in izgube učinkovitosti;
ob sklicevanju na cilj oblikovati zasnovo, ki je bil potrjen s podpisom Deklaracije o nameri Ocenjevalne skupine za balkanske zdravstvene namenske sile 19. maja 2015,
dogovorili:
1. člen 
Opredelitev pojmov 
1. Balkanske zdravstvene namenske sile (BZNS): večnacionalna zdravstvena vojaška enota, sestavljena iz zdravstvenih modulov, ki jih prispevajo pogodbeniki.
2. Nosilna država (ND): pogodbenica, ki poleg svojih pogodbenih obveznosti, opredeljenih v tem sporazumu in izvedbenih dogovorih, na temelju rotacije zagotavlja osnovno infrastrukturo, osebje in opremo, potrebno za zmogljivost ROLE 2.
3. Sponzor: država, organizacija ali subjekt, ki ni udeleženec BZNS ter priskrbi finančno in/ali drugo podporo BZNS, kot je opredeljeno v ustreznem dogovoru.
4. Država gostiteljica (DG): Republika Makedonija, v kateri je stalni sedež BZNS.
5. Stalni sedež BZNS (SS BZNS): stalen mirnodobni organ BZNS, ki je odgovoren za organizacijo in načrtovanje usposabljanja ter mirnodobnega delovanja in/ali delovanja BZNS v nepredvidljivih razmerah.
2. člen 
Namen sporazuma 
Namen tega sporazuma je urediti postopke in obveznosti med pogodbeniki glede ustanovitve in delovanja BZNS.
3. člen 
Poslanstvo BZNS 
1. Da se opredelijo, okrepijo in spodbujajo zdravstvene operativne zmogljivosti Zahodnega Balkana, je namen BZNS zagotavljati zdravstveno podporo v mednarodnih operacijah in misijah (MOM) na ravni ROLE 2 na trajnostni način in s hitrim odzivom na različne situacije pri regijskem zagotavljanju pomoči ob nesrečah. Cilj je omogočiti sodelujočim državam, da zagotovijo ključne zmogljivosti za mednarodno delovanje, okrepijo sposobnost nacionalnih zdravstvenih služb ter uresničijo nacionalne cilje, cilje Nata in Partnerstva za mir (PzM)/partnerske cilje (cilje zmogljivosti).
2. Za izpolnitev navedenih ciljev morajo biti BZNS sposobne:
a) načrtovati in izvajati večnacionalno usposabljanje ter sodelovati pri usposabljanju, ki je namenjeno doseganju in ohranjanju ustrezne pripravljenosti, zmogljivosti in operativne učinkovitosti ter izboljšanju povezljivosti;
b) sodelovati pri nalogah z mandatom ZN na dogovorjenem območju odgovornosti;
c) izvajati druge dejavnosti, o katerih se skupaj dogovorijo pogodbeniki.
4. člen 
Aktiviranje BZNS 
1. BZNS so na voljo za morebitno aktiviranje:
a) na zahtevo ene ali več pogodbenic ali
b) na zahtevo ustrezne mednarodne organizacije ali
c) na zahtevo katere koli države.
2. Na podlagi predhodnega soglasja državnih organov vsakega pogodbenika o aktiviranju BZNS odloča Usmerjevalni odbor (UO).
5. člen 
Sestava, poveljniška razmerja in odločanje BZNS 
1. BZNS delujejo v miru in ob krizah, kot je podrobno opredeljeno v tem členu.
2. BZNS so večnacionalna zdravstvena enota, ki deluje kot premestljiva modularna vojaška zmogljivost, oblikovana iz obstoječih nacionalnih zdravstvenih zmogljivosti.
3. Stalni sedež BZNS (SS BZNS) je stalen mirnodobni organ BZNS, odgovoren za organizacijo in načrtovanje usposabljanja ter mirnodobno delovanje in/ali delovanje BZNS v nepredvidljivih razmerah. Poleg tega je odgovoren za pripravo, usposabljanje in certificiranje enote.
4. Usmerjevalni odbor (UO) je najvišji organ odločanja, sestavljen iz pooblaščenih političnih in vojaških predstavnikov vsakega pogodbenika. UO sprejema odločitve soglasno.
5. Podrobna sestava in poveljniška razmerja BZNS so opredeljeni v memorandumu o soglasju ali drugih ustreznih dokumentih, ki jih podpišejo ustrezni organi pogodbenikov.
6. Organizacijska sestava aktivirane BZNS začne veljati ob krizah in se opredeli v memorandumu o soglasju ali drugih ustreznih dokumentih, ki jih podpišejo ustrezni organi pogodbenikov.
6. člen 
Uradni in delovni jeziki 
Uradni jeziki BZNS so državni jeziki pogodbenic. Angleščina je delovni jezik in vsi operativni dokumenti morajo biti izdani v tem jeziku.
7. člen 
Finančni vidiki 
1. Stroške ustanovitve, upravljanja in delovanja BZNS krijejo pogodbeniki in/ali sponzorji.
2. Skupni izdatki BZNS se krijejo iz večnacionalnega proračuna, ki ga financirajo pogodbeniki po formuli o delitvi stroškov, določeni v memorandumu o soglasju.
3. Oprema, ki se nabavi iz skupnih finančnih virov, in oprema, ki jo zagotovijo sponzorji, sta last BZNS. Lastništvo nacionalne opreme, ki jo zagotovi država gostiteljica, ostane državi gostiteljici.
4. Podrobna načela in načine financiranja BZNS ureja memorandum o soglasju.
8. člen 
Podpora države gostiteljice in nosilne države 
1. Država gostiteljica zagotavlja logistično podporo za stalni sedež BZNS skladno z določbami memoranduma o soglasju.
2. Eden od pogodbenikov na temelju rotacije prevzame vlogo nosilne države (ND). Kot taka mora poleg svojih obveznosti kot pogodbenica zagotavljati osnovno infrastrukturo, osebje in opremo, potrebno za zmogljivost ROLE 2. Podrobne obveznosti ND ureja memorandum o soglasju.
9. člen 
Pravni vidiki 
Status osebja BZNS, kadar je to primerno, urejajo določbe Sporazuma med pogodbenicami Severnoatlantske pogodbe o statusu njihovih sil (NATO SOFA z dne 19. junija 1951), Sporazuma med državami pogodbenicami Severnoatlantske pogodbe in drugimi državami, ki sodelujejo v Partnerstvu za mir, glede statusa njihovih sil (PzM SOFA z dne 19. junija 1995) ter Konvencije ZN o privilegijih in imunitetah Združenih narodov (z dne 13. februarja 1946).
10. člen 
Pristop k BZNS in sodelovanje v dejavnostih BZNS 
1. K temu sporazumu lahko pristopi katera koli država, potem ko pridobi pisno soglasje vseh pogodbenikov in podpiše noto o pristopu k temu sporazumu.
2. Pri usposabljanju ali delovanju BZNS lahko sodelujejo katera koli mednarodna organizacija, subjekt ali država/sile države na podlagi predhodnega soglasja vseh pogodbenikov in podpisa ustreznega dogovora.
11. člen 
Varnostne določbe 
1. Vsi podatki, izmenjani ali nastali v zvezi s tem sporazumom, se uporabljajo, prenašajo, hranijo, obravnavajo in/ali varujejo v skladu z veljavno notranjo zakonodajo in mednarodnim pravom.
2. Prenos podatkov poteka samo po dovoljeni poti.
3. Pogodbeniki zagotovijo, da se podatki izmenjujejo samo za predviden namen v okviru ciljev in obsega tega sporazuma.
12. člen 
Reševanje sporov 
Morebitni spori glede razlage ali izvajanja tega sporazuma se rešujejo samo na podlagi soglasja med pogodbeniki in se ne predložijo v reševanje nacionalnemu ali mednarodnemu sodišču ali tretji strani.
13. člen 
Izvedbeni dogovori 
Podrobna vprašanja o BZNS se uredijo v posebnem memorandumu o soglasju ali drugih ustreznih dokumentih, ki jih podpišejo ustrezni organi pogodbenikov.
14. člen 
Končne določbe 
1. Ta sporazum se sklene za nedoločen čas.
2. Ta sporazum začne veljati 30. dan po tem, ko država gostiteljica prejme zadnje uradno obvestilo pogodbenikov, da so končani vsi notranji postopki, potrebni za začetek njegove veljavnosti.
3. Ta sporazum se lahko spremeni na podlagi soglasja pogodbenikov. Sprememba se predlaga pisno po diplomatski poti in začne veljati v skladu z drugim odstavkom tega člena.
4. Ta sporazum se lahko kadar koli odpove na podlagi soglasja pogodbenikov. Od sporazuma lahko odstopi kateri koli od pogodbenikov s šestmesečnim (6-mesečnim) odpovednim rokom, o katerem uradno obvesti državo gostiteljico, ta pa obvesti druge pogodbenike po diplomatski poti.
5. Ob odpovedi tega sporazuma ali če od sporazuma odstopi kateri koli od pogodbenikov, pogodbeniki uredijo vse nerešene zadeve in druga morebitna področja v zvezi z odpovedjo ali odstopom od sporazuma.
6. Z odpovedjo sporazuma prenehajo veljati vsi izvedbeni dogovori/memorandumi o soglasju.
7. Država gostiteljica bo depozitar tega sporazuma.
V potrditev tega so podpisani predstavniki, ki so jih za to pravilno pooblastile njihove vlade, podpisali ta sporazum.
Podpisano v šestih (6) izvirnikih v angleškem jeziku.

3. člen 
Za izvajanje sporazuma skrbi ministrstvo, pristojno za obrambo.
4. člen 
Ta uredba začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
