O RATIFIKACIJI PROTOKOLA MED VLADO REPUBLIKE SLOVENIJE IN VLADO ČRNE GORE O IZVAJANJU SPORAZUMA MED EVROPSKO SKUPNOSTJO IN REPUBLIKO ČRNO GORO O PONOVNEM SPREJEMU OSEB, KI PREBIVAJO BREZ DOVOLJENJA
1. člen
Ratificira se Protokol med Vlado Republike Slovenije in Vlado Črne gore o izvajanju Sporazuma med Evropsko skupnostjo in Republiko Črno goro o ponovnem sprejemu oseb, ki prebivajo brez dovoljenja, podpisan 9. maja 2008 v Podgorici.
2. člen
Besedilo protokola se v izvirniku v slovenskem in angleškem jeziku glasi(1):
P R O T O K O L
MED VLADO REPUBLIKE SLOVENIJE IN VLADO ČRNE GORE O IZVAJANJU SPORAZUMA MED EVROPSKO SKUPNOSTJO IN REPUBLIKO ČRNO GORO O PONOVNEM SPREJEMU OSEB, KI PREBIVAJO BREZ DOVOLJENJA
Na podlagi 19. člena Sporazuma med Evropsko skupnostjo in Republiko Črno goro o ponovnem sprejemu oseb, ki prebivajo brez dovoljenja (v nadaljnjem besedilu: sporazum), sta se Vlada Republike Slovenije in Vlada Črne gore (v nadaljnjem besedilu: pogodbenici) za njegovo izvajanje dogovorili:
I. PONOVNI SPREJEM DRŽAVLJANOV POGODBENIC
1. člen
(dokazovanje državljanstva)
(1) Za namene izvajanja sporazuma se poleg dokumentov, določenih v prilogah 1 in 2 sporazuma, državljanstvo osebe dokazuje še z naslednjimi veljavnimi javnimi listinami:
a) za Republiko Slovenijo:
– potrdilom o državljanstvu Republike Slovenije skupaj z drugo veljavno javno listino s fotografijo;
b) za Črno goro:
– potni list (nacionalni in skupinski potni list), ki ga je po 15. juniju 1997 izdalo Ministrstvo za notranje zadeve Republike Črne gore (»modri potni list«), in potni list (diplomatski in službeni potni list), ki ga je izdalo Ministrstvo za zunanje zadeve Republike Črne gore,
– osebna izkaznica, ki jo je po 1. maju 1994 izdalo Ministrstvo za notranje zadeve Republike Črne gore,
– potrdilom o državljanstvu Črne gore skupaj z drugo veljavno javno listino s fotografijo.
(2) Na podlagi predloženih omenjenih javnih listin pristojni organ zaprošene pogodbenice prizna državljanstvo osebe in nadaljnje ugotavljanje ni potrebno.
2. člen
(domneva državljanstva)
(1) Državljanstvo se lahko domneva na podlagi:
a) fotokopij dokumentov, naštetih v 1. členu protokola;
b) dokumentov, naštetih v 1. členu protokola, ki jim je potekla veljavnost, in njihovih fotokopij;
c) rojstnega lista ali njegove fotokopije;
d) veljavnega vozniškega dovoljenja ali njegove fotokopije;
e) kakršnih koli dokumentov, ki jih izdajo državni organi;
f) kakršnih koli veljavnih dokumentov, ki dokazujejo pripadnost oboroženim silam ali policijskim organom pogodbenic;
g) izjave obravnavane osebe ali verodostojne priče, zapisane v uradnem zapisniku;
h) primerjave prstnih odtisov, ki so shranjeni v evidencah druge pogodbenice;
i) če je zaprošena država Črna gora, pa se poleg navedenih dokazil o domnevi državljanstva upoštevajo še:
– potni list, ki ga je pred 15. junijem 1997 (»rdeči potni list«) izdalo Ministrstvo za notranje zadeve Črne gore, in njegove fotokopije,
– osebna izkaznica, ki jo je pred 1. majem 1994 izdalo Ministrstvo za notranje zadeve Črne gore, in njegove fotokopije.
(2) Šteje se, da je državljanstvo ugotovljeno, če ga v teh primerih potrdi zaprošena pogodbenica.
II. POSTOPEK IZROČITVE IN PONOVNEGA SPREJEMA
3. člen
(prošnja za ponovni sprejem)
Prošnja za ponovni sprejem osebe, za katero se dokaže ali domneva, da je državljan pogodbenice, državljan tretje države ali oseba brez državljanstva, ki je prebivala na ozemlju pogodbenice, se vloži v skladu s 7. členom sporazuma na predpisanem obrazcu iz priloge 6 sporazuma, v katerem se navedeta tudi mejni prehod, na katerem bo oseba izročena in ponovno sprejeta, ter čas izročitve in ponovnega sprejema.
III. TRANZIT DRŽAVLJANOV TRETJIH DRŽAV ALI OSEB BREZ DRŽAVLJANSTVA
4. člen
(tranzitni postopek)
(1) Tranzitni postopek mora potekati na način, kot to določa 14. člen sporazuma. Poleg zahtevanega pa morajo biti v vlogi tudi podatki:
a) o mejnem prehodu vstopa in izstopa;
b) o predvidenem času in načinu tranzita ter načrtu potovanja;
c) o tem, ali je potrebno spremstvo ali morebitna druga pomoč;
d) o tem, ali bo oseba potovala sama ali v spremstvu.
(2) Če oseba potrebuje zdravstveno oskrbo, pogodbenica prosilka priloži tudi opis njenega zdravstvenega stanja, vključno s fotokopijami vseh zdravstvenih potrdil in informacijami o potrebni posebni obravnavi, kot je na primer zdravstvena ali druga oskrba, nadzor ali prevoz z rešilnim avtomobilom.
(3) Vlogo za tranzit je treba pisno predložiti pristojnemu organu zaprošene pogodbenice.
(4) O času in načinu tranzita (npr. številka leta, čas odhoda in prihoda, ime in priimek spremljajočih uradnih oseb, registrska številka vozila idr.) se pristojna organa pogodbenic dogovorita neposredno.
(5) Pogodbenici lahko prekličeta vsako izdano dovoljenje, če se pozneje pojavijo ali ugotovijo okoliščine iz tretjega odstavka 13. člena sporazuma ali če nadaljnje potovanje v morebitne države tranzita ali ponovni sprejem v namembni državi ni več zagotovljen.
(6) Pogodbenica prosilka mora med tranzitom skrbeti za državljane tretjih držav ali osebe brez državljanstva in jih ponovno sprejeti, če ni bil zagotovljen sprejem v namembno državo.
5. člen
(splošne obveznosti)
(1) Pristojni organ zaprošene pogodbenice sporoči pristojnemu organu pogodbenice prosilke vsa dejstva, ki se nanašajo na izredne dogodke med tranzitom.
(2) Zaprošena pogodbenica zagotovi policijskim uslužbencem pogodbenice prosilke pri opravljanju njihovih nalog po tem protokolu enako zaščito in pomoč, kot jo imajo njeni policijski uslužbenci, ki opravljajo podobne naloge.
(3) Policijski uslužbenci pogodbenice prosilke so pri opravljanju svojih nalog glede nezakonitih dejanj, v katerih so udeleženi kot storilci ali žrtve, izenačeni v pravicah in obveznostih s policijskimi uslužbenci zaprošene pogodbenice.
6. člen
(spremstvo)
(1) Tranzit oseb z uradnim spremstvom se opravi v skladu z veljavnimi predpisi zaprošene pogodbenice, čez ozemlje katere poteka tranzit.
(2) Če se tranzit opravi v spremstvu policije, policijski uslužbenci pogodbenice prosilke svojo dolžnost opravljajo v civilu, brez orožja in z dovoljenjem za tranzit.
(3) V tranzitu po zračni poti lahko zaprošena pogodbenica po potrebi prevzame odgovornost za nadzor in vkrcanje osebe v dogovoru z osebjem v spremstvu.
(4) Nadzor in vkrcanje osebe v tranzitu brez spremstva po zračni poti zagotovijo policijski uslužbenci zaprošene pogodbenice pod pogojem, da to predhodno pisno potrdi zaprošena pogodbenica.
(5) Če tranzita iz prejšnjega odstavka ni mogoče opraviti v vnaprej predvidenem času, zaprošena pogodbenica o razlogih takoj pisno obvesti pogodbenico prosilko, ki mora v štiriindvajsetih urah pisno odgovoriti in predlagati nadaljnji postopek.
(6) Če oseba potrebuje zdravstveno oskrbo, pogodbenica prosilka priloži tudi opis njenega zdravstvenega stanja, vključno s fotokopijami zdravstvenih potrdil in informacijami o potrebni posebni obravnavi, kot je na primer zdravstvena ali druga oskrba, nadzor ali prevoz z rešilnim avtomobilom.
7. člen
(policijski uslužbenci)
Policijski uslužbenci pogodbenice prosilke, ki po tem protokolu opravljajo svoje naloge na ozemlju države tranzita, morajo na zahtevo pooblaščene uradne osebe dokazati svojo identiteto in uradno funkcijo ter pokazati dovoljenje za tranzit, ki ga je izdala zaprošena pogodbenica.
8. člen
(povračilo škode, nastale med tranzitom)
Če policijski uslužbenec pogodbenice prosilke pri izvajanju nalog po tem protokolu utrpi škodo, je pogodbenica prosilka odgovorna za plačilo odškodnine, pri čemer od zaprošene pogodbenice ne zahteva nikakršnega povračila.

9. člen

(2) Pristojna organa se obveščata o vseh podatkih, potrebnih za medsebojno sporazumevanje.
(3) Najave in prošnje za ponovni sprejem ali vloge za tranzit ter odgovore si pristojna organa pošiljata pisno po telefaksu, redni ali elektronski pošti.
10. člen
(mejni prehodi)
Izročitev, ponovni sprejem in tranzit oseb se opravljajo na teh mejnih prehodih:
a) v Republiki Sloveniji: Mednarodni mejni prehod Obrežje, Mednarodni mejni prehod Jelšane in Mejni prehod za mednarodni zračni promet Ljubljana – Brnik na Letališču Jožeta Pučnika Ljubljana;
b) v Črni gori: Mednarodni mejni prehod Debeli Brijeg, Mednarodni mejni prehod Ilino Brdo in Mednarodni mejni prehod Letališče Podgorica.
V. KONČNE DOLOČBE
11. člen
(jezik in spremembe)
(1) Pri izvajanju tega protokola vsaka pogodbenica uporablja uradni jezik svoje države, razen če v posameznem primeru ni drugače dogovorjeno.
(2) Ta protokol lahko pogodbenici spremenita z medsebojnim soglasjem.
12. člen
(veljavnost)
(1) Ta protokol je treba ratificirati ali odobriti. Po prejemu zadnjega uradnega obvestila, da so končani notranjepravni postopki za začetek njegove veljavnosti, pristojni organ slovenske pogodbenice o tem uradno obvesti Odbor za ponovni sprejem iz 18. člena sporazuma.
(2) Protokol začne veljati, ko Odbor za ponovni sprejem potrdi prejem uradnega obvestila, o čemer slovenska pogodbenica nemudoma uradno obvesti črnogorsko pogodbenico.
(3) Protokol preneha veljati isti dan kot sporazum.
Sestavljeno v Podgorici dne 9. maja 2008 v dveh izvirnikih v slovenskem, črnogorskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Pri različni razlagi prevlada angleško besedilo.

P R O T O C O L
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF MONTENEGRO IMPLEMENTING THE AGREEMENT BETWEEN THE EUROPEAN COMMUNITY AND THE REPUBLIC OF MONTENEGRO ON THE READMISSION OF PERSONS RESIDING WITHOUT AUTHORISATION
Pursuant to Article 19 of the Agreement between the European Community and the Republic of Montenegro on the readmission of persons residing without authorisation (hereinafter referred to as the Agreement), the Government of the Republic of Slovenia and the Government of Montenegro (hereinafter referred to as the Contracting Parties) have agreed the following, for the purpose of its implementation:
I. READMISSION OF NATIONALS OF THE CONTRACTING PARTIES
Article 1
(Proving the Nationality)
(1) For the purposes of the implementation of the Agreement, the nationality of a person shall be proved by means of the following valid public documents, in addition to the documents referred to in Annex 1 and 2 of the Agreement:
a) for the Republic of Slovenia:
– certificate of nationality of the Republic of Slovenia together with another valid public document bearing a photograph;
b) for Montenegro:
– passport (national and group passport) issued by the Ministry of the Interior of the Republic of Montenegro after 15 June 1997 (“blue passport”) and passport (diplomatic and service passport) issued by the Ministry of Foreign Affairs of the Republic of Montenegro;
– identity card issued by the Ministry of the Interior of Republic of Montenegro after 1 May 1994;
– certificate of nationality of Montenegro together with another valid public document bearing a photograph.
(2) Based on the submission of the aforementioned public documents, the competent authority of the requested Contracting Party shall acknowledge the nationality of a person and no future establishment of nationality shall be required.
Article 2
(Presumption of nationality)
(1) Nationality may be presumed on the basis of the following:
a) photocopies of the documents listed in Article 1 of the Protocol;
b) documents listed in Article 1 of the Protocol whose period of validity has expired and photocopies thereof;
c) a birth certificate or a photocopy thereof;
d) a valid driving licence or a photocopy thereof;
e) any document issued by state authorities;
f) any valid document that proves membership of the armed forces or the police force of a Contracting Party;
g) a statement from the person in question or from a trustworthy witness entered in the official records;
h) comparison of fingerprints entered in the records of the other Contracting Party;
i) in the event of the requested Contracting Party being Montenegro, the following documents shall be considered, in addition to the aforementioned documentary evidence based on which the nationality may be presumed:
– passport issued by the Ministry of the Interior of Montenegro before 15 June 1997 (“red passport”) and photocopies thereof,
– identity card issued by the Ministry of the Interior of Montenegro before 1 May 1994 and photocopies thereof.
(2) Nationality shall be deemed to have been established if in the above cases the requested Contracting Party confirms it.
II. RETURN AND READMISSION PROCEDURE
Article 3
(Readmission Application)
An application for readmission of a person for whom it has been proved or presumed that he/she is a national of a Contracting Party, a third-country national or a stateless person having resided on the territory of the Contracting Party shall be made in accordance with Article 7 of the Agreement on the prescribed form from Annex 6 of the Agreement, which shall also indicate the border crossing point at which the person is to be returned and readmitted and the time of return and readmission.
III. TRANSIT OF THIRD-COUNTRY NATIONALS OR STATELESS PERSONS
Article 4
(Transit Procedure)
(1) Transit procedure must be carried out in the manner provided for in Article 14 of the Agreement. In addition to what is required therein, the application must contain information on:
a) the border crossing point of entry and exit;
b) envisaged time and method of transit, as well as the travel plan;
c) whether an escort or any other assistance is required;
d) whether the person will be travelling alone or escorted.
(2) If the person requires medical care, the requesting Contracting Party shall also submit a description of the person's state of health, including photocopies of healthcare certificates and information regarding requirements for special treatment, such as health or other care, supervision or ambulance transport.
(3) A transit application must be submitted in writing to the competent authority of the requested Contracting Party.
(4) The competent authorities of the Contracting Parties shall agree directly on the time and method of transit (e.g. flight number, departure and arrival times, name and surname of officials providing escort, vehicle registration numbers, etc).
(5) The Contracting parties may revoke any issued permit in the event where circumstances referred to in Article 13, paragraph 3 of the Agreement subsequently occur or are established, or where further travel to potential countries of transit or readmission by the destination country is no longer guaranteed.
(6) During transit, the requesting Contracting Party shall remain responsible for third-country nationals or stateless persons and shall be obliged to readmit them again if readmission by the destination country has not been guaranteed.
Article 5
(General Requirements)
(1) The competent authority of the requested Contracting Party shall inform the competent authority of the requesting Contracting Party of all facts regarding any incident occurring during transit.
(2) The requested Contracting Party shall provide the same protection and assistance to police officers of the requesting Contracting Party in the performance of their tasks under this Protocol as are enjoyed by its police officers performing similar tasks.
(3) When in performing their tasks they are involved in illegal acts either as perpetrators or victims, police officers of the requesting Contracting Party shall enjoy the same rights and obligations as police officers of the requested Contracting Party.
Article 6
(Escort)
(1) Transit of persons under official escort shall be conducted pursuant to the regulations in force in the requested Contracting Party across whose territory transit is conducted.
(2) If transit is conducted under police escort, the escorting police officers of the requesting Contracting Party shall carry out their mission in civilian clothes, unarmed and provided with a transit authorisation.
(3) In air transit, the requested Contracting Party may, if necessary, take over responsibility for supervision and boarding of the plane, in agreement with the escorting personnel.
(4) Supervision and boarding of unescorted persons in air transit shall be provided by police officers of the requested Contracting Party, subject to prior written confirmation by the requested Contracting Party.
(5) If transit referred to in the preceding paragraph cannot be conducted within the envisaged time frame, the requested Contracting Party shall inform the requesting Contracting Party in writing without delay while the latter must respond in writing within 24 hours and propose further procedure.
(6) If the person requires medical care, the requesting Contracting Party shall also submit a description of the person's state of health, including photocopies of healthcare certificates and information regarding requirements for special treatment, such as health or other care, supervision or ambulance transport.
Article 7
(Police Officers)
Police officers of the requesting Contracting Party who perform their tasks under this Protocol on the territory of the country of transit must be able to prove, if requested by an authorised official, their identity and that they are acting in an official capacity, as well as carry a transit authorisation that has been issued by the requested Contracting Party.
Article 8
(Compensation of Damage Incurred during Transit)
If a police officer of the requesting Contracting Party suffers damage during the performance of his/her tasks under this Protocol, the requesting Contracting Party is responsible for paying the compensation due, without seeking redress from the requested Contracting Party.
IV. COMPETENT AUTHORITIES AND BORDER CROSSING POINTS
Article 9
(Competent Authorities)
(1) The implementation of the Agreement and this Protocol shall be within the competence of:

(2) The competent authorities shall keep each other informed of all data required for mutual communication.
(3) Announcements and readmission or transit applications as well as responses shall be sent by the competent authorities in writing by fax, regular post or e-mail.
Article 10
(Border Crossing Points)
Return, readmission and transit of persons shall be conducted at the following border crossing points:
a) in the Republic of Slovenia: International Border Crossing Point Obrežje, International Border Crossing Point Jelšane and Border Crossing Point for International Air Traffic Ljubljana – Brnik at the Ljubljana Jože Pučnik airport;
b) in Montenegro: International Border Crossing Point Debeli Brijeg, International Border Crossing Point Ilino and International Border Crossing Point Airport Podgorica.
V. FINAL PROVISIONS
Article 11
(Language and Amendments)
(1) In implementing this Protocol, each Contracting Party shall use the official language of its country, unless agreed otherwise on a case-by-case basis.
(2) The Contracting Parties may amend this Protocol by mutual agreement.
Article 12
(Entry into force and Termination)
(1) This Protocol shall be subject to ratification or approval. Following the receipt of the last notification of the completion of internal legal procedures required for its entry into force, the competent authority of the Slovenian contracting Party shall notify the Readmission Committee referred to in Article 18 of the Agreement.
(2) The Protocol shall enter into force when the Readmission Committee acknowledges the receipt of the notification, and the Slovenian Contracting Party shall immediately inform the Montenegrin Contracting Party thereof.
(3) The Protocol shall cease to have effect on the same day as the Agreement.
Done at Podgorica on 9 may 2008 in two original copies in the Slovenian, Montenegrin and English languages, all texts being equally authentic. In the case of divergence in the interpretation, the English test shall prevail.

4. člen
Ta uredba začne veljati petnajsti dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
