Razglašam Zakon o ratifikaciji Sporazuma o vzajemnem varovanju tajnih podatkov med Vlado Republike Slovenije in Vlado Kraljevine Norveške (BNOVTP), ki ga je sprejel Državni zbor Republike Slovenije na seji 31. maja 2006.

O RATIFIKACIJI SPORAZUMA O VZAJEMNEM VAROVANJU TAJNIH PODATKOV MED VLADO REPUBLIKE SLOVENIJE IN VLADO KRALJEVINE NORVEŠKE (BNOVTP)
1. člen
Ratificira se Sporazum o vzajemnem varovanju tajnih podatkov med Vlado Republike Slovenije in Vlado Kraljevine Norveške, podpisan 23. februarja 2006 v Ljubljani.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:(*1)
S P O R A Z U M
O VZAJEMNEM VAROVANJU TAJNIH PODATKOV MED VLADO REPUBLIKE SLOVENIJE IN VLADO KRALJEVINE
NORVEŠKE
Vlada Republike Slovenije in Vlada Kraljevine Norveške, v nadaljevanju pogodbenici, sta se zaradi varovanja tajnih podatkov, ki se izmenjavajo neposredno ali prek drugih državnih organov, organov lokalnih skupnosti, nosilcev javnih pooblastil, pravnih in drugih oseb, ki pridobijo tajne podatke po tem sporazumu ali razpolagajo z njimi, dogovorili:
1. člen
UPORABA
Ta sporazum je sestavni del katere koli pogodbe ali sporazuma o izmenjavi tajnih podatkov, ki ga bosta pogodbenici v prihodnje oblikovali ali podpisali v zvezi z naslednjimi zadevami:
a. sodelovanjem med državnimi organi pogodbenic,
b. sodelovanjem, izmenjavo podatkov, skupnimi vlaganji, pogodbenimi in drugimi razmerji med državnimi organi in/ali pravnimi osebami pogodbenic,
c. prodajo opreme in znanja ene pogodbenice drugi.
Nobena od pogodbenic se ne more sklicevati na ta sporazum za pridobitev tajnih podatkov, ki jih je druga pogodbenica prejela od tretje osebe.
2. člen
POMEN IZRAZOV
V tem sporazumu:
»tajni podatek« pomeni:
a. pošiljko, ki vsebuje tajne podatke, v obliki ustnega obvestila o vsebini tajne narave ali električnega oziroma elektronskega prenosa sporočila tajne narave ali »material«, opredeljen v točki (b);
b. izraz »material« pomeni »dokument«, opredeljen v točki (c), in kateri koli del stroja, opreme, orožja ali oborožitvenega sistema, ki je izdelan ali se izdeluje;
c. izraz »dokument« pomeni kakršno koli obliko zapisane/posnete informacije ne glede na vrsto zapisa ali snemalnega medija;
»pogodba« pomeni
dogovor med dvema ali več pogodbenicami, s katerim se določijo in opredelijo izvršljive pravice in obveznosti med pogodbenicami;
»pogodba s tajnimi podatki« pomeni
pogodbo, ki vsebuje ali se nanaša na tajne podatke;
»pogodbenica izvora« pomeni
pogodbenico, iz katere izvirajo tajni podatki;
»pogodbenica prejemnica« pomeni
pogodbenico, ki prejme tajne podatke;
»izvajalec« pomeni
posameznika ali pravno osebo, sposobno za sklepanje pogodb;
»kršitev varovanja tajnosti« pomeni
storitev ali opustitev dejanja v nasprotju z notranjimi zakoni in podzakonskimi predpisi, ki lahko ogrozi ali razkrije tajne podatke;
»razkritje tajnosti« pomeni,
da so tajni podatki razkriti, ker se je vedenje o njih v celoti ali delno preneslo na fizične ali druge osebe ali države brez ustreznega varnostnega dovoljenja pristojnega organa za tak dostop ali obstaja tveganje, da bi do takega prenosa prišlo;
»varnostno potrdilo« pomeni
pozitivno ugotovitev varnostnega preverjanja fizične ali druge osebe, s katerim se potrdi sposobnost za dostop do tajnih podatkov določene stopnje tajnosti in ravnanje z njimi v skladu z ustreznimi notranjimi predpisi o varovanju tajnih podatkov;
»varnostno zagotovilo« pomeni
izjavo pristojnega varnostnega organa, ki zagotavlja varovanje tajnih podatkov stopnje »interno« v skladu z notranjimi predpisi;
»potreba po seznanitvi« pomeni
dostop do tajnih podatkov, ki se lahko odobri samo osebi s potrebo po seznanitvi zaradi opravljanja funkcije ali delovnih nalog, na podlagi katerih se podatki posredujejo pogodbenici prejemnici;
»stopnje tajnosti«
se uporabljajo za podatke, katerih nepooblaščeno razkritje bi lahko imelo naslednje posledice za interese države, in pomenijo:

3. člen
VZAJEMNO VAROVANJE TAJNOSTI
V skladu z notranjimi zakoni, podzakonskimi predpisi in prakso sta pogodbenici dolžni izvajati ustrezne ukrepe za varovanje tajnih podatkov, ki se pošiljajo, prejemajo, izdelujejo ali oblikujejo na podlagi katerega koli sporazuma med pogodbenicama. Pogodbenici za vse poslane, prejete, izdelane ali oblikovane tajne podatke zagotovita enako stopnjo tajnosti kot za svoje tajne podatke enake stopnje tajnosti, opredeljene v 2. in 5. členu tega sporazuma. Dostop do tajnih podatkov ter krajev in objektov, kjer potekajo dejavnosti tajne narave ali se hranijo tajni podatki, se omeji na osebe z dovoljenjem za dostop do tajnih podatkov, opredeljenim v 2. členu, ter na osebe s potrebo po seznanitvi zaradi opravljanja funkcije ali delovnih nalog, kot je opredeljeno v 2. členu.
Vsaka pogodbenica s skupnimi obiski uradnih predstavnikov v obeh državah nadzira spoštovanje zakonov, podzakonskih predpisov in prakse na področju varovanja tajnih podatkov v organih in prostorih v njeni pristojnosti, ki imajo, razvijajo, izdelujejo in/ali uporabljajo tajne podatke druge pogodbenice.
4. člen
RAZKRITJE TAJNIH PODATKOV
Pogodbenici ne razkrijeta tajnih podatkov po tem sporazumu tretjim osebam ali državljanom drugih držav brez predhodnega pisnega soglasja pogodbenice izvora. Tajni podatki, ki jih pogodbenica prejme od druge pogodbenice, se smejo uporabljati samo za namen, ki je bil določen, ko so bili podatki poslani.
Če katera od pogodbenic in/ali njeni organi ali osebe, za katere veljajo določbe 1. člena, sklenejo pogodbo za izvedbo na ozemlju druge pogodbenice in taka pogodba vsebuje tajne podatke, pogodbenica, na ozemlju katere poteka izvedba po tem sporazumu, prevzame odgovornost za ravnanje s tajnimi podatki v skladu z notranjimi zakoni in podzakonskimi predpisi.
Pogodbenica, ki od druge pogodbenice prejme tajne podatke, mora pred razkritjem teh podatkov izvajalcem ali možnim izvajalcem ene od pogodbenic:
a. zagotoviti, da izvajalci ali možni izvajalci in njihovi objekti izpolnjujejo pogoje za ustrezno varovanje tajnih podatkov;
b. izdati tem izvajalcem ustrezno varnostno potrdilo za njihove objekte;
c. izdati ustrezna dovoljenja za dostop do tajnih podatkov za tiste osebe, ki morajo imeti dostop do tajnih podatkov zaradi opravljanja funkcije ali delovnih nalog;
d. zagotoviti, da so vse osebe, ki imajo dostop do tajnih podatkov, seznanjene s svojo odgovornostjo glede varovanja tajnih podatkov v skladu z veljavno zakonodajo;
e. izvajati občasne varnostne inšpekcije zadevnih objektov, za katere so bila izdana varnostna potrdila.
5. člen
STOPNJE TAJNOSTI
Za označevanje tajnih podatkov se uporabljajo naslednje stopnje tajnosti:

Pogodbenica prejemnica in/ali njene osebe ne smejo spremeniti tajnosti prejetih tajnih podatkov niti ne znižati stopnje tajnosti teh podatkov brez predhodnega pisnega soglasja pogodbenice izvora. Pogodbenica izvora obvesti pogodbenico prejemnico o spremembah stopenj tajnosti izmenjanih podatkov.
Pogodbenica prejemnica označi prejete tajne podatke v skladu s tem sporazumom. Prevodi in razmnoženi dokumenti se označijo z enako stopnjo tajnosti kot izvirnik.
6. člen
PRISTOJNA VARNOSTNA ORGANA
Pristojna varnostna organa, odgovorna za nadzor nad izvajanjem tega sporazuma in katerega koli sporazuma skladno z določbami 1. člena, sta:

Pristojna varnostna organa skladno s pristojnostmi v svoji državi pripravljata, izdajata in nadzorujeta navodila in postopke za varovanje tajnih podatkov, ki se izmenjavajo na podlagi katerega koli drugega sporazuma med pogodbenicama.
Vsak pristojni varnostni organ na zahtevo priskrbi drugemu pristojnemu varnostnemu organu podatke o organiziranosti in postopkih varovanja tajnosti, ki omogočajo primerjavo in ohranjanje enakih standardov varovanja tajnosti ter so v pomoč pri skupnih obiskih uradnih predstavnikov v obeh državah. S tovrstnimi obiski se morata pogodbenici strinjati.
Pogodbenici zagotavljata, da bosta pristojna varnostna organa izvajala določbe tega sporazuma v skladu s svojimi pooblastili.
7. člen
OBISKI
Dovoljenje za obiske, namenjene izmenjavi tajnih podatkov, v prostorih, v katerih se oblikujejo, obdelujejo ali hranijo tajni podatki ali potekajo projekti s tajnimi podatki, izda pogodbenica obiskovalcem iz države druge pogodbenice samo, če je bilo predhodno pridobljeno pisno dovoljenje pristojnega varnostnega organa pogodbenice prejemnice. Dovoljenje se izda samo osebam, ki imajo dovoljenje za dostop do tajnih podatkov in potrebo po seznanitvi.
Pristojni varnostni organ pogodbenice pošiljateljice obvesti pristojni varnostni organ pogodbenice prejemnice o pričakovanih obiskovalcih najmanj tri (3) tedne pred načrtovanim obiskom.
Zaprosilo za obisk vsebuje:
a. obiskovalčev priimek, ime, datum in kraj rojstva, državljanstvo, delodajalca, številko potnega lista ali osebne izkaznice;
b. overjeno varnostno potrdilo obiskovalca v skladu z namenom obiska;
c. točen in podroben opis predmeta in namena obiska ali obiskov;
d. pričakovani datum in trajanje obiska ali obiskov, na katere se nanaša zaprosilo;
e. priimek in ime osebe za stike, lahko pa tudi službene telefonske številke, številke telefaksov in naslov elektronske pošte ustanove/objekta, kjer bo potekal obisk, podatke o predhodnih stikih in druge informacije, ki utemeljujejo obisk ali obiske.
Podatki iz prejšnjega odstavka se uporabljajo za izvajanje tega sporazuma. Pogodbenici zagotovita varovanje teh osebnih podatkov v skladu z notranjimi zakoni in podzakonskimi predpisi.
Zaprosilo bo predloženo:
a. prek norveškega veleposlaništva v Ljubljani za obisk v Sloveniji, ki ga želi opraviti norveški državljan;
b. prek slovenskega veleposlaništva v Köbenhavnu, Danska, za obisk na Norveškem, ki ga želi opraviti slovenski državljan;
c. po dogovoru med pristojnima varnostnima organoma se lahko uporabljajo tudi drugi postopki.
Veljavnost odobritve obiska traja največ dvanajst (12) mesecev.
Za tajne podatke, ki se izmenjajo med obiskom, se zagotovita enako varovanje in stopnja tajnosti kot za podatke pogodbenice izvora.
8. člen
POGODBE
Pristojni varnostni organ pogodbenice, ki želi skleniti pogodbo s tajnimi podatki z izvajalcem v državi druge pogodbenice ali pooblastiti enega od svojih izvajalcev za sklenitev take pogodbe v državi druge pogodbenice v okviru projekta s tajnimi podatki, mora od pristojnega varnostnega organa druge pogodbenice predhodno pridobiti pisno zagotovilo, da ima predlagani izvajalec varnostno potrdilo ustrezne stopnje tajnosti in objekte za obdelavo in hrambo tajnih podatkov enake stopnje tajnosti. Za stopnjo tajnosti INTERNO je treba priskrbeti varnostno zagotovilo, kot je opredeljeno v 2. členu.
Vsaka pogodba s tajnimi podatki mora vsebovati ustrezno poglavje o varovanju tajnosti in seznam stopenj tajnosti skladno s tem sporazumom.
Pristojni varnostni organ, v katerega državi bodo potekala dela, prevzame odgovornost za predpisovanje in izvajanje varnostnih ukrepov za pogodbo na podlagi enakih standardov in zahtev za urejanje varovanja tajnosti za lastne pogodbe s tajnimi podatki.
Izvajalec mora pristojnemu varnostnemu organu vnaprej predložiti v odobritev podizvajalce, ki jih zanimajo podizvajalske pogodbe s tajnimi podatki. Izbrani podizvajalec mora izpolnjevati enake pogoje za varovanje tajnosti, kot so predvideni za izvajalca.
Uradno obvestilo o projektu, sporazumu, pogodbi ali podizvajalski pogodbi s tajnimi podatki se vnaprej pošlje pristojnemu varnostnemu organu države, v kateri se bo projekt izvajal.
Dva (2) izvoda poglavja o varovanju tajnosti v pogodbi s tajnimi podatki se pošljeta pristojnemu varnostnemu organu, v katerega državi bodo potekala dela.
9. člen
OBVEŠČANJE IN PRENOS
Fizični prenos tajnih podatkov med pogodbenicama običajno poteka po diplomatski poti.
Tajne podatke lahko izmenjavajo tudi ustrezno preverjeni predstavniki, ki so jih pooblastili organi v obeh državah. Tako pooblastilo se lahko, če je potrebno, prav tako podeli predstavnikom industrije, ki so vključeni v določen projekt.
Predaja večjih pošiljk ali količin tajnih podatkov se opravi za vsak primer posebej.
Drugi odobreni načini prenosa ali izmenjave se lahko uporabijo, če se o tem dogovorita pristojna varnostna organa.
10. člen
KRŠITEV VAROVANJA TAJNOSTI
Ob kršitvi varovanja tajnosti, kot je opredeljeno v 2. členu, glede tajnih podatkov, ki izvirajo ali so prejeti od druge pogodbenice, ali če gre za skupne interese, pristojni varnostni organ, v katerega državi pride do kršitve, čim prej obvesti pristojni varnostni organ druge države in izpelje preiskavo. Če je potrebno, druga pogodbenica sodeluje v preiskavi. V vsakem primeru mora biti druga pogodbenica seznanjena z ugotovitvami preiskave in mora prejeti končno poročilo o vzrokih in obsegu kršitve varovanja tajnosti.
11. člen
STROŠKI
Stroškov, ki jih ima katera od pogodbenic v zvezi s tem sporazumom, zlasti glede izvajanja varnostnih ukrepov, pogodbenici druga drugi ne povrneta.
12. člen
REŠEVANJE SPOROV
Morebitne spore glede razlage ali uporabe tega sporazuma rešita pogodbenici s posvetovanji in se ne predložijo kateremu koli nacionalnemu ali mednarodnemu sodišču ali razsodišču ali tretji strani v reševanje.
13. člen
KONČNE DOLOČBE
Ta sporazum začne veljati naslednji dan po prejemu zadnjega uradnega obvestila, s katerim pogodbenici sporočita, da so končani vsi notranjepravni postopki, potrebni za uveljavitev tega sporazuma. Pogodbenici ga lahko kadar koli odpovesta z uradnim pisnim obvestilom. V takem primeru sporazum preneha veljati šest (6) mesecev po datumu, ko je druga pogodbenica prejela uradno obvestilo o odpovedi.
Ta sporazum je mogoče kadar koli spremeniti in dopolniti s pisnim soglasjem pogodbenic.
Ob odpovedi sporazuma se pošiljke, ki vsebujejo tajne podatke, in/ali tajni podatki, posredovani skladno s pogoji tega sporazuma, čim prej vrnejo drugi pogodbenici. Tajni podatki in/ali pošiljke, ki se ne vrnejo v soglasju s pogodbenico izvora ali pa zaradi drugih posebnih razlogov, se varujejo v skladu z določbami tega sporazuma.
Sestavljeno v Ljubljani dne 23. februar 2006 v dveh izvirnikih, vsak v slovenskem, norveškem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna in enako pravno veljavna. Pri razlikah v razlagi prevlada angleško besedilo.

A G R E E M E N T
ON MUTUAL PROTECTION OF CLASSIFIED
INFORMATION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE KINGDOM OF NORWAY
The Government of the Republic of Slovenia and the Government of the Kingdom of Norway, hereafter called the Parties, have in order to safeguard the classified information exchanged directly or through other government agencies, local community agencies, holders of public authorizations, legal and other entities that deal with classified information under this Agreement agreed upon following:
Article 1
APPLICABILITY
This Agreement shall form an integral part of any contract or agreement involving exchange of classified information, that will be made or signed in the future between the Parties concerning the following subjects:
a. co-operation between government agencies of the two Parties;
b. co-operation, exchange of information, joint ventures, contractual or any other relations between government agencies and/or legal entities of the Parties;
c. sale of equipment and know-how by one Party to the other.
This Agreement may not be invoked by either Party to obtain classified information that the other Party has received from a third party.
Article 2
DEFINITIONS
For the purpose of this Agreement:
“Classified information” means
a. any classified item, be it an oral communication of classified contents or the electrical or electronic transmission of a classified message, or a »material« as defined in (b) below;
b. the term »material« includes »document« as defined in (c) below, and any item of machinery, equipment, weapon or weapon-systems either manufactured or in the process of manufacture;
c. the term »document« means any form of recorded information regardless of type of recording media.
“Contract” means
an agreement between two or more parties creating and defining enforceable rights and obligations between the parties.
“Classified contract” means
a contract which contains or involves classified information.
“Originating Party” means
a party which originated the classified information.
“Receiving Party” means
a party which received classified information.
“Contractor” means
an individual or legal entity possessing the legal capability to undertake contracts.
“Breach of security” means
an act or an omission contrary to national laws and regulations, the result of which may endanger or compromise classified information.
“Security compromise” means
that classified information is compromised because knowledge of it has, in whole or part, passed to persons or entities or countries without appropriate security clearance of the competent authority to have such access, or when it has been subject to a risk of such passing.
“Security clearance” means
a positive determination following an investigative procedure to ascertain the capability of a person or entity to have access to and to handle classified information on a certain level in accordance with the respective national security regulations.
“Security assurance” means
a statement issued by the Competent Security Authority declaring that classified information at restricted level will be protected in accordance with its national regulations.
»Need to know« means
that access to classified information may only be granted if the person requiring it has a verified need to know connection with his/her official duties, within the framework of which the information was released to the receiving Party.
Security classification levels
are to be applied to information of which unauthorized disclosure would have the following consequences for the interest of the State:

Article 3
MUTUAL SECURITY PROTECTION
In accordance with their national laws, regulations and practice, both Parties shall take appropriate measures to protect classified information, which is transmitted, received, produced or developed as a result of any agreement between the Parties. The Parties will afford to all of the transmitted, received, produced or developed classified information the same degree of security protection as is provided to their own classified information of equivalent level of classification, as defined in Articles 2 and 5 of this Agreement. Access to classified information and to locations and facilities where classified activities are performed or where classified information is stored, will be limited to those who have been granted a security clearance, as defined in Article 2, and who, due to their functions or employment, have a »need to know«, as defined in Article 2.
Each Party shall supervise the observance of security laws, regulations and practice at the agencies and premises, within their jurisdiction that posses, develop, produce and/or use classified information of the other Party, by means of joint visits in both countries by certified officials.
Article 4
DISCLOSURE OF CLASSIFIED INFORMATION
The Parties shall not disclose classified information under this Agreement to third parties or nationals of other countries without prior written consent of the originating Party. Received classified information from one Party to the other Party shall be used for the specified purpose only which has been determined at the time of information transmission.
In the event that either Party and/or its agencies or entities concerned with the subjects set out in Article 1, award a contract for performance within the territory of the other Party, and such contract involves classified information, then the Party of the country in which the performance under the Agreement is taking place, will assume responsibility for administering such classified information in accordance with national laws and regulations.
Prior to release to either Party's contractors or prospective contractors of any classified information received from the other Party, the receiving Party shall:
a. ensure that such contractors or prospective contractors and their facilities have the capability to protect the classified information adequately;
b. grant an appropriate facility security clearance to the relevant contractors;
c. grant an appropriate personnel security clearance for all personnel whose functions and employment require access to the classified information;
d. ensure that all persons having access to classified information, are informed of their responsibilities to protect the classified information in accordance with applicable laws;
e. carry out periodic security inspections of relevant cleared facilities.
Article 5
SECURITY CLASSIFICATIONS
Classified information shall be marked in one of the following security classification levels:

The receiving Party and/or its entities shall neither reclassify received classified information, nor declassify that information without the prior written consent of the originating Party. The originating Party shall inform the receiving Party of any changes in security classification of the exchanged information.
The receiving party shall mark the received classified information in accordance with this Agreement. Translations and reproductions shall be marked with the same security classification as the original.
Article 6
COMPETENT SECURITY AUTHORITIES
The Competent Security Authorities responsible for supervising the implementation of this and any other agreement, as defined in Article 1, are:

The Competent Security Authorities, each within the jurisdiction of its own state, shall prepare, distribute and supervise security instructions and procedures for the protection of the classified information exchanged as a result of any other agreement between the Parties.
Each Competent Security Authority shall, upon request, furnish the other Competent Security Authority information concerning its security organization and procedures to make it possible to compare and maintain the same security standards and facilitate joint visits in both countries by certified officials. Both Parties must agree upon such visits.
Each Party undertakes to ensure that its respective Competent Security Authority will duly observe the provisions of this Agreement in accordance with its powers.
Article 7
VISITS
Visits aimed at exchanging classified information to premises where classified information is developed, handled or stored, or where classified projects are carried out, will only be granted by one Party to visitors from the country of the other Party if a prior written permission from the Competent Security Authority of the receiving Party has been obtained. Such permission will only be granted to persons who have been security cleared and have a »need to know«.
The Competent Security Authority of the sending Party shall notify the Competent Security Authority of the receiving Party of expected visitors at least three – 3 – weeks prior to the planned visit.
The visit request shall include:
a. a visitor's surname, name, place and date of birth, nationality and employer, passport or ID card;
b. certification of the visitor's security clearance in accordance with the purpose of the visit;
c. accurate and sufficiently detailed object and purpose of the visit or visits;
d. expected date and duration of the requested visit or visits;
e. name of the point of contact, possibly with business telephone numbers, fax numbers and e-mail address of the establishment/facility to be visited, information about previous contacts and any other information justifying the visit or visits.
The information referred to in the preceding paragraph shall be used for the implementation of this Agreement. Each party shall ensure the protection of this personal information in accordance with national laws and regulations.
The request will be submitted:
a. through the Norwegian Embassy in Ljubljana for visit requested of Norwegian citizen to Slovenia;
b. through the Slovenian Embassy in Copenhagen, Denmark for visit requested of Slovenian citizens to Norway;
c. other procedures may be used if agreed upon by the two Competent Security Authorities.
The validity of visit authorization shall not exceed twelve – 12 – moths.
The classified information exchanged during a visit shall have the same degree of protection and classification level as that of the originating Party.
Article 8
CONTRACTS
The Competent Security Authority of one Party, wishing to place a classified contract with a contractor in the country of the other Party, or wishing to authorize one of its own contractors to place a classified contract in the country of the other Party within a classified project, shall obtain a prior written assurance from the Competent Security Authority of the other Party that the proposed contractor holds a security clearance of appropriate level and has the facilities to handle and store classified information of the same level. For RESTRICED level a security assurance, as defined in Article 2, will be provided.
Every classified contract shall contain an appropriate security section and a security classification list, based on the terms of this Agreement.
The Competent Security Authority, in whose country the work ~s to be performed, shall assume responsibility for prescribing and administering security measures for the contract under the same standards and requirements that govern the protection of its own classified contracts.
Sub-contractors interested in classified subcontracts, shall be submitted in advance by the contractor to the Competent Security Authority for approval. If approved, the sub-contractor must fulfill the same security obligations as have been set for the contractor.
Notification of any classified project, agreement, contract or sub-contract shall be forwarded in advance to the Competent Security Authority of the country where the project is to be performed.
Two – 2 – copies of the security section of any classified contract shall be forwarded to the Competent Security Authority in whose country the work is to be performed.
Article 9
COMMUNICATIONS AND TRANSMISSIONS
Classified information shall normally be physically transmitted between the Parties through their respective diplomatic channels.
Exchange of classified information can also take place through appropriately cleared representatives officially appointed by the authorities in both countries. Such authorization may, when required, be given to representatives of industrial undertakings engaged in specific project.
Delivery of large items or quantities of classified information shall be arranged on a case by case basis.
Other approved means of transmission or exchange may be used if agreed upon by each Competent Security Authority.
Article 10
BREACH OF SECURITY
In case of a breach of security, as defined in Article 2, concerning classified information originated or received from the other Party, or if common interests are involved, the Competent Security Authority in whose country the compromise occurs shall inform the Competent Security Authority of the other country as soon as possible and carry out the appropriate investigation. The other Party shall, if required, co-operate in the investigation. In any case, the other Party is to be informed of the results of the investigation and shall receive a final statement as to the reasons and extent of the security violation.
Article 11
EXPENSES
Expenses incurred by either Party with respect to this Agreement, in particular concerning the implementation of security measures, shall not be subject to reimbursement between the Parties.
Article 12
DISPUTE SETTLEMENT
Any dispute regarding the interpretation or application of this Agreement shall be resolved by consultation between the Parties and will not be referred to any national or international court or tribunal or third party for settlement.
Article 13
FINAL PROVISIONS
This Agreement comes into effect the day following the receipt of the final official notification in which Parties to the Agreement communicate that all national legislative procedures necessary for the implementation of this Agreement have been completed. It may be terminated at any time by either Party in the way of a written notification. In such a case the Agreement expires six – 6 – months from the date the notification of termination has been received by the other Party.
Changes and amendments to the present Agreement may be done at any time with consent of both Parties in written form.
In the event of termination, classified items and/or information transmitted under the terms of this Agreement shall be returned to the other Party as soon as possible. Classified information and/or items that are not returned based on the consent of the originating Party or due to some other specific reasons, shall be protected in accordance with the provisions laid down in this Agreement.
Done in Ljubljana on 23th February 2006 in two originals, each in the Slovene, the Norwegian and the English languages, each text being equally authentic and has equal legal force. In case of divergence of interpretation the English text shall prevail.
