O RATIFIKACIJI SPORAZUMA O ZRAČNEM PROMETU MED VLADO REPUBLIKE SLOVENIJE IN VLADO UKRAJINE (BUKZP)

Ratificira se Sporazum o zračnem prometu med Vlado Republike Slovenije in Vlado Ukrajine, podpisan v Ljubljani dne 30. marca 1999.
2. člen
Sporazum se v izvirniku v angleškem in prevodu v slovenskem jeziku glasi:
AIR SERVICES AGREEMENT
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF UKRAINE
The Government of the Republic of Slovenia and the Government of Ukraine, hereinafter referred to as the Contracting Parties;
Being Parties to the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December, 1944;
Desiring to conclude an Agreement for the purpose of establishing air services between and beyond their respective territories;
Have agreed as follows:
Article 1
DEFINITIONS
1. For the purpose of this Agreement, unless the context otherwise requires:
a) term “Convention“ means the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December 1944 and includes any Annex adopted under Article 90 of that Convention and any amendment of the Annexes or of the Convention under Articles 90 and 94 thereof, insofar as those Annexes and amendments have been adopted by both Contracting Parties;
b) term “aeronautical authorities“ means, in the case of the Republic of Slovenia, the Civil Aviation Authority of the Republic of Slovenia, and in the case of Ukraine, the State Aviation Administration of Ukraine or in both cases any person or body authorized to perform any function presently exercised by the said authorities;
c) term “designated airline“ means an airline which has been designated and authorized in accordance with the provisions of Article 3 of this Agreement;
d) terms “territory“, “air service“, “international air service“, “airline“ and “stop for non-traffic purposes“ have the meanings respectively assigned to them in Articles 2 and 96 of the Convention;
e) term “tariff“ means the prices to be paid for the carriage of passengers and cargo and the conditions under which those prices apply, including prices and conditions for agency and other auxiliary services, but excluding remuneration and conditions for the carriage of mail;
f) term “capacity“:
(i) in relation to an aircraft means the payload of that aircraft available on a route or section of a route;
(ii) in relation to a specified air service means the capacity of the aircraft used on such service, multiplied by the frequency operated by such aircraft over a given period on a route or section of a route.
2. The Annex to this Agreement forms an integral part of the Agreement.
Article 2
GRANT OF RIGHTS
1. Each Contracting Party grants to the other Contracting Party the rights specified in this Agreement, for the purpose of establishment scheduled international air services on the routes specified in the Annex thereto (are hereinafter called the “agreed services“ and the “specified routes“, respectively).
2. Each airline designated by either Contracting Party shall enjoy, while operating the agreed services on the specified routes, the following rights:
a) to fly without landing across the territory of the other Contracting Party;
b) to make stops in the territory of the other Contracting Party for non-traffic purposes;
c) to make stops in the territory of the other Contracting Party at the points specified in the Annex to this Agreement for the purpose of taking on and/or discharging international traffic in passengers, cargo and mail.
3. Nothing in paragraph 2 of this Article shall be deemed to confer on the designated airline of either Contracting Party the right of taking on board passengers, cargo and mail carried for hire or reward, between the points in the territory of the other Contracting Party.
Article 3
DESIGNATION AND OPERATING AUTHORIZATIONS
1. Each Contracting Party shall have the right to designate in writing to the other Contracting Party one or more airlines for the purpose of operating the agreed services on the specified routes and to withdraw or alter such designation.
2. On receipt of such designation, the other Contracting Party shall, subject to the provisions of paragraphs 3 and 4 of this Article, without delay grant to the designated airline the appropriate operating authorization.
3. The aeronautical authorities of one Contracting Party before granting operating authorization may require an airline designated by the other Contracting Party to satisfy them that it is qualified to fulfil the conditions prescribed under the laws and regulations normally and reasonably applied to the operation of international air services by such authorities in conformity with the provisions of the Convention.
4. Each Contracting Party shall have the right to refuse granting operating authorization referred to in paragraph 2 of this Article, or to impose such conditions as it may deem necessary on the exercise by a designated airline of the rights specified in Article 2 of this Agreement, in any case where the said Contracting Party is not satisfied that substantial ownership and effective control of that airline are vested in the Contracting Party designating the airline or in its nationals.
5. When an airline or airlines have been so designated and authorized, they may begin at any time to operate the agreed services, provided that tariffs established in accordance with the provisions of Article 12 of this Agreement are in force in respect of such services.
6. Either Contracting Party shall have the right, subject to provisions of this Article, to replace any airline it has designated by another airline and/or designate an additional airline. The newly designated airline shall have the same rights and be subject to the same obligations as the airline which it replaces. The same rights and obligations shall apply to the additionally designated airline.
Article 4
REVOCATION OR SUSPENSION OF OPERATING AUTHORIZATIONS
1. Each Contracting Party shall have the right to revoke an operating authorization or to suspend the exercise of the rights specified in Article 2 of this Agreement by an airline designated by the other Contracting Party, or to impose such conditions as it may deem necessary on the exercise of these rights:
a) in any case where it is not satisfied that substantial ownership and effective control of the said airline are vested in the Contracting Party designating the airline or in its nationals; or
b) in the case of failure by the said airline to comply with laws and regulations of the Contracting Party granting these rights; or
c) in case the airline otherwise fails to operate in accordance with the conditions prescribed under this Agreement.
2. Unless immediate revocation, suspension or imposition of the conditions mentioned in paragraph 1 of this Article is essential to prevent further infringements of laws and regulations, such rights shall be exercised only after consultation with the other Contracting Party in accordance with Article 17 of the present Agreement.
Article 5
APPLICABILITY OF LAWS AND REGULATIONS
1. The laws and regulations of one Contracting Party governing entry into, stay within and departure from its territory of aircraft engaged in international air service or the operation and navigation of such aircraft while within its territory shall apply to an aircraft of any airline designated by the other Contracting Party.
2. The laws and regulations of one Contracting Party relating to arrival, stay in and departure from its territory of passengers, crews, cargo and mail, such as formalities regarding passports, customs, currency and sanitary measures shall apply to passengers, crews, cargo, baggage and mail of an aircraft of any airline designated by the other Contracting Party while they are within the said territory.
Article 6
RECOGNITION OF CERTIFICATES AND LICENCES
1. Certificates of airworthiness, certificates of competency and licences issued or rendered valid by one of the Contracting Parties and unexpired shall be recognized as valid by the other Contracting Party, provided that the requirements under which such certificates or licences were issued or rendered valid are equal to or above the minimum standards which are established or may be established from time to time pursuant to the Convention.
2. Each Contracting Party reserves the right, however, to refuse to recognize as valid, for the purpose of flights over its own territory, certificates of competency and licences granted to or rendered valid for its own nationals by the other Contracting Party or by any other State.
Article 7
USER CHARGES
Any charges for the use of each airport including its installations, technical and other facilities and services, as well as any charges for the use of air navigation facilities, communication facilities and services shall be made in accordance with the rates established by each Contracting Party and shall not be higher than those which would be paid by its national aircraft engaged in similar international air services.
Article 8
CUSTOMS DUTIES AND PROCEDURES
1. An aircraft operated on the international air services by the designated airline of either Contracting Party, as well as their regular equipment, supplies of fuel and lubricants, aircraft stores (including food, beverages and tobacco) on board such aircraft shall be exempt from all customs duties, inspection fees and other duties or taxes on arriving in the territory of the other Contracting Party, provided such equipment and supplies remain on board the aircraft up to such time as they are re-exported.
2. The exemption from same duties and taxes, with the exception of charges corresponding to the service performed also relates to:
a) aircraft stores taken on board in the territory of either Contracting Party, within limits fixed by the authorities of said Contracting Party, and intended for use on board the aircraft engaged in an international service of the other Contracting Party; and
b) spare parts and equipment entered into the territory of either Contracting Party for the maintenance or repair of aircraft used in international services by the designated airline of the other Contracting Party; and
c) fuels and lubricants destined to supply aircraft operated on the agreed services by the designated airline of the other Contracting Party, even when these supplies are to be used on the part of the route performed over the territory of the Contracting Party in which they are taken on board.
3. Materials referred to in paragraph 2 of this Article may be required to be kept under Customs supervision or control.
4. The regular airborne equipment, as well as the materials, supplies and spare parts retained on board the aircraft operated by the designated airline of either Contracting Party may be unloaded in the territory of the other Contracting Party only with the approval of the customs authorities of that territory. In such case, they may be placed under the supervision of the said authorities up to such time as they are re-exported or otherwise disposed of in accordance with customs regulations.
5. The necessary documents of the designated airline of either Contracting Party including air tickets, airway bills as well as advertising materials shall be exempt from all the customs duties and taxes in the territory of the other Contracting Party.
6. Baggage and cargo in direct transit shall be exempt from customs duties and other similar taxes.
Article 9
TRAFFIC OF DIRECT TRANSIT
Passengers, baggage and cargo in direct transit across the territory of either Contracting Party and not leaving the area of the airport reserved for such purpose shall be subject to no more than a simplified control except in respect of security measures against violence, air piracy and smuggling of illicit drugs and controlled substances.
Article 10
PRINCIPLES GOVERNING THE OPERATION OF AGREED SERVICES
1. There shall be fair and equal opportunity for the designated airlines of both Contracting Parties to operate the agreed services on the specified routes between their respective territories.
2. In operating the agreed services, the designated airline of each Contracting Party shall take into account the interests of the designated airline of the other Contracting Party so as not to affect unduly the services which the latter provides on the whole or part of the same routes.
3. The agreed services provided by the designated airlines of the Contracting Parties shall be closely related to the requirements of the public for transportation on the specified routes, and each designated airline shall have as its primary objective the provision, at a reasonable load factor, of capacity adequate to carry the current and reasonably anticipated requirements for the carriage of passengers, cargo, baggage and mail between the territories of both Contracting Parties.
4. The agreed services shall be operated by the designated airlines in accordance with the general principles that capacity is related to:
a) traffic requirements between the countries of origin and destination;
b) traffic requirements of the area through which the agreed services pass; and
c) the requirements through airline operations.
Article 11
SCHEDULES
1. The schedules of the agreed services shall be submitted for approval to the aeronautical authorities of both Contracting Parties at least sixty (60) days before the proposed date of their introduction. In special cases, this time limit may be reduced subject to the consent of the said authorities.
2. Any further amendments concerning the approved schedule of the designated airline of either Contracting Party shall be submitted to the aeronautical authorities of the other Contracting Party for approval.
Article 12
TARIFFS
1.The tariffs on any agreed service shall be established at reasonable levels due regard being paid to all relevant factors including cost of operation, reasonable profit, characteristics of airline (such as standards of speed and accommodation) and the tariffs charged by the other airlines. These tariffs shall be fixed in accordance with the following provisions of this Article.
2. The tariffs referred to in paragraph 1 of this Article shall, if possible, be agreed in respect of each of the specified routes between the designated airlines concerned in consultation with the other airlines operating the whole or part of that route. The tariffs so agreed shall be subject to the approval of the aeronautical authorities of the Contracting Parties.
3. The tariffs so agreed shall be submitted for the approval of the aeronautical authorities of the Contracting Parties at least sixty (60) days before the proposed date of their introduction, except where the said authorities agree to reduce this period in special cases.
4. The approval of tariffs may be given expressly; or, if neither of the aeronautical authorities have expressed disapproval within thirty (30) days from the date of submission, in accordance with paragraph 3 of this Article, the tariffs shall be considered as approved. In the event of the period for submission being reduced, as provided for in paragraph 3, the aeronautical authorities may agree that the period within any disapproval may be notified to be reduced accordingly.
5. If the designated airlines can not agree on any of these tariffs, or if for some other reason a tariff cannot be agreed upon in accordance with the provisions of paragraph 2 of this Article, the aeronautical authorities of the Contracting Parties shall endeavour to determine the tariff by the agreement between themselves.
6. If the aeronautical authorities can not agree on the approval of any tariff submitted to them under paragraph 2 of this Article or on the determination of any tariff under paragraph 3, the dispute shall be settled in accordance with the provisions of Article 19 of this Agreement.
7. The established tariffs shall remain in force until new tariffs have been established in accordance with the provisions of this Article.
8. Neither tariff shall come into force if the aeronautical authorities of either Contracting Party have not approved it.
Article 13
FINANCIAL PROVISIONS
1. The designated airline of either Contracting Party shall be free to sell air transport services in the territory of the other Contracting Party in local currency or in any convertible currency, directly or through agents, subject to appropriate authorizations and in accordance with the respective national laws and regulations.
2. The designated airline of the Contracting Parties shall, in compliance with the applicable laws and regulations of the Contracting Parties, be free to transfer from the territory of sale to their home territory the excess, in the territory of sale, of receipts over expenditure.
3. Such transfer shall be made in accordance with the provisions of the agreement regulating financial matters of the Contracting Parties. In case of the absence of such agreement or respective provisions in it, the transfer shall be effected in hard convertible currency at the official exchange rate in accordance with the foreign exchange regulations of the Contracting Parties.
Article 14
REPRESENTATIONS
1. With the purpose of ensuring the operation of the agreed services, the designated airline of either Contracting Party shall be granted the right to maintain its representation with the necessary administrative, commercial and technical staff in the territory of the other Contracting Party.
2. The representations of the designated airline shall be registered subject to the efficient legislation of the state of stay.
Article 15
AVIATION SECURITY
1. In accordance with their rights and obligations under international law, the Contracting Parties reaffirm that their obligation to each other to protect the security of civil aviation against acts of unlawful interference forms an integral part of this Agreement. Without limiting the generality of their rights and obligations under international law, the Contracting Parties shall in particular act in conformity with the provisions of the Convention on Offences and Certain Other Acts Committed on Board Aircraft, signed at Tokyo on 14 September 1963, the Convention for the Suppression of Unlawful Seizure of Aircraft, signed at the Hague on 16 December 1970, the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation, signed at Montreal on 23 September 1971, the Protocol for Suppression of Unlawful Acts of Violence at Airports Serving International Civil Aviation, signed at Montreal on 24 February 1988, and the provisions of bilateral agreements in force between the Contracting Parties, as well as their agreements to be signed subsequently.
2. The Contracting Parties shall provide, upon request, all necessary assistance to each other to prevent acts of unlawful seizure of a civil aircraft and other unlawful acts against the safety of such an aircraft, its passengers and crew, airports and air navigation facilities, and any other threat to the security of civil aviation.
3. The Contracting Parties shall act in conformity with the aviation security provisions and technical requirements established by the International Civil Aviation Organization and designated as Annexes to the Convention to the extent that such security provisions and requirements are applicable to the Contracting Parties; they shall require that operators of an aircraft of their registry or operators of an aircraft, who have their principal place of business or permanent residence in their territory and the operators of airports in their territory, act in conformity with such aviation security provisions.
4. Each Contracting Party agrees that such operators of an aircraft may be required to observe the aviation security provisions referred to in paragraph 3 above required by the other Contracting Party for entry into, departure from, or while within, the territory of that other Contracting Party. Each Contracting Party shall ensure that adequate measures are effectively applied within its territory to protect the aircraft and to inspect passengers, crews, carry-on items, baggage, cargo and aircraft stores prior to and during boarding and loading. Each Contracting Party shall also give sympathetic consideration to any request from the other Contracting Party for reasonable special security measures to meet a particular threat.
5.When an incident or threat of an incident of unlawful seizure of a civil aircraft or other unlawful acts against the safety of such an aircraft, its passengers and crew, airports or air navigation facilities occurs, the Contracting Parties shall assist each other by facilitating communications and other appropriate measures intended to terminate rapidly and safely such an incident or threat thereof.
Article 16
INVESTIGATION OF AN ACCIDENT
1. Each Contracting Party undertakes to facilitate and assist the aircraft of the other Contracting Party and its passengers and crew in case of emergency or accident in its territory. Such assistance should be offered by either Contracting Party in the same way and extent as it is offered to its own aircraft, passengers and crew.
2. In case of an accident, emergency, forced landing, damage or crash occurred to an aircraft of one Contracting Party, the other Contracting Party shall:
a) act in accordance with the provisions of Annex 13 to the Convention;
b) render all possible assistance to the said aircraft;
c) take immediately all possible measures in order to assist the crew and passengers who were involved in the accident;
d) inform immediately the other Contracting Party about the accident;
e) protect the mail, baggage and cargo carried on board the aircraft;
f) preserve all the remaining wreckage and traces of the crashed aircraft as well as all documentation on board the aircraft and all relevant documentation connected with the flight.
3. The Contracting Party, in whose territory the accident occurred, shall take proper action for an investigation on the circumstances and causes of the accident, and on the request of the other Contracting Party shall allow the representatives of this other Contracting Party free entrance in its territory in order to be present as observers at the investigation of the accident.
4. The Contracting Party, on carrying out the inquiry, shall communicate the results thereof to the other Contracting Party and, on request, the first Contracting Party shall furnish copies of all documents in connection with the accident. These copies shall contain all documents and data required, pursuant to the laws and regulations for international flights in the territory of the Contracting Party performing the investigation.
Article 17
CONSULTATIONS
1. From time to time there shall be consultations between the aeronautical authorities of the Contracting Parties to ensure close collaboration in all matters affecting the fulfilment of this Agreement.
2. Either Contracting Party may at any time request consultations on any problem related to this Agreement. Such consultations shall begin within a period of thirty (30) days from the date the other Contracting Party receives the request unless otherwise agreed by the Contracting Parties.
Article 18
PROVISION OF STATISTICS
1. The aeronautical authorities of either Contracting Party shall supply to the aeronautical authorities of the other Contracting Party, at their request, periodic or other statements of statistics.
2. Such statements shall include all information reasonable required to determine the amount of traffic carried by its designated airline on the agreed services and the origin and destination of such traffic.
Article 19
SETTLEMENT OF DISPUTES
1. If any dispute arises between the Contracting Parties relating to the interpretation or application of this Agreement, the Contracting Parties shall in the first place endeavour to settle it by negotiation.
2. If the Contracting Parties fail to reach a settlement by negotiation, they may agree to refer the dispute for decision to some person or body, or the dispute may, at the request of either Contracting Party, be submitted for decision to a tribunal of three arbitrators, one to be nominated by each Contracting Party and the third to be appointed by the two so nominated. Each of the Contracting Parties shall nominate an arbitrator within a period of sixty (60) days from the date of receipt by either Contracting Party from other of a notice through diplomatic channels requesting arbitration of the dispute and the third arbitrator shall be appointed within a further period of sixty (60) days. If either of the Contracting Parties fails to nominate an arbitrator within the period specified, or if the third arbitrator is not appointed within the specified period, the President of the Council of the International Civil Aviation Organization may be requested by either Contracting Party to appoint an arbitrator or arbitrators, as the case requires. If the President possesses the nationality of one of the Contracting Parties or if he is otherwise prevented from carrying out this function, his deputy in office may make the necessary appointments. In any case, the third arbitrator shall be a national of a third State and shall act as president of the arbitral body.
3. The Contracting Parties undertake to comply with any decision given under paragraph 2 of this Article.
Article 20
MODIFICATIONS
1. If either of the Contracting Parties considers it desirable to modify any provision of this Agreement, it may request consultations with the other Contracting Party, in relation to the proposed modification in accordance with paragraph 2 of Article 19. Any modifications so agreed shall come into effect when they have been confirmed by the exchange of notes through diplomatic channels.
2. Any modifications to the Annex may be agreed directly between the aeronautical authorities of the Contracting Parties and shall come into force when they have been confirmed by the exchange of diplomatic notes.
Article 21
REGISTRATION WITH ICAO
This Agreement and any subsequent amendments thereto shall be registered with the International Civil Aviation Organization.
Article 22
TERMINATION
1. This Agreement shall be concluded for an indefinite period.
2. Either Contracting Party may at any time give notice to the other Contracting Party through diplomatic channels of its decision to terminate this Agreement. Such notice shall be simultaneously communicated to the International Civil Aviation Organization. If such a notice is given, this Agreement shall terminate twelve (12) months after the date of receipt of the notice by the other Contracting Party, unless the notice to terminate is withdrawn by the agreement before the expiry of this period. In the absence of acknowledgement of receipt by the other Contracting Party, the notice shall be deemed to have been received fourteen (14) days after the receipt of the notice by the International Civil Aviation Organization.
Article 23
ENTRY INTO FORCE
1.The present Agreement shall be applied provisionally from the date of its signature.
2. Each Contracting Party shall notify the other Contracting Party in writing through diplomatic channels of the completion of its respective requirements for entry into force of this Agreement. The Agreement shall enter into force on the date of receipt of the latter of these two notifications

A. The airline designated by the Government of the Republic of Slovenia shall be entitled to operate the scheduled international air services in both directions on the routes specified hereafter:

S P O R A Z U M
O ZRAČNEM PROMETU MED VLADO REPUBLIKE SLOVENIJE IN VLADO UKRAJINE
Vlada Republike Slovenije in Vlada Ukrajine, v nadaljevanju pogodbenici, sta se
kot pogodbenici Konvencije o mednarodnem civilnem letalstvu, ki je bila na voljo za podpis v Čikagu sedmega decembra 1944,
v želji, da skleneta sporazum zaradi vzpostavitve zračnega prometa med svojima ozemljema in zunaj njiju,
dogovorili:
1. člen
OPREDELITEV POJMOV
1. Če sobesedilo ne zahteva drugače, v tem sporazumu:
a) izraz “konvencija“ pomeni Konvencijo o mednarodnem civilnem letalstvu, ki je bila na voljo za podpis v Čikagu sedmega decembra 1944, in vključuje vsako prilogo, sprejeto na podlagi 90. člena konvencije, in vsako spremembo prilog ali konvencije po njenem 90. in 94. členu, če sta te priloge in spremembe sprejeli obe pogodbenici;
b) izraz “pristojni organi“ pomeni za Republiko Slovenijo Upravo Republike Slovenije za zračno plovbo in za Ukrajino Državno upravo za zračno plovbo Ukrajine ali v obeh primerih katero koli osebo ali organ, pooblaščen za katero koli nalogo, ki jo zdaj opravljata omenjena organa;
c) izraz “določeni prevoznik“ pomeni prevoznika v zračnem prometu, ki je bil določen in je dobil dovoljenje v skladu s 3. členom tega sporazuma;
d) izrazi “ozemlje“, “zračni promet“, “mednarodni zračni promet“, “prevoznik“ in “pristanek v nekomercialne namene“ imajo pomen, kot ga določata 2. in 96. člen konvencije;
e) izraz “tarifa“ pomeni cene, ki jih je treba plačati za prevoz potnikov in tovora, ter pogoje, pod katerimi se te cene uporabljajo, vključno s cenami in pogoji za zastopanje in druge pomožne storitve, izključuje pa plačilo in pogoje za prevoz pošte;
f) izraz “zmogljivost“:
i) v zvezi z letalom pomeni koristen tovor, ki ga lahko letalo prepelje na določeni progi ali na delu proge;
ii) v zvezi z določenim prevozom pomeni zmogljivost letala, uporabljenega za tak prevoz, pomnoženo s pogostostjo poletov, ki jih to letalo opravi v določenem času na progi ali na njenem delu.
2. Priloga je sestavni del sporazuma.
2. člen
PODELITEV PRAVIC
1. Pogodbenica podeli drugi pogodbenici pravice, določene v tem sporazumu, za vzpostavitev rednega mednarodnega zračnega prometa na progah, določenih v prilogi tega sporazuma (v nadaljevanju “dogovorjeni prevozi“ oziroma “določene proge“).
2. Vsak prevoznik, ki ga določi ena ali druga pogodbenica, ima pri opravljanju dogovorjenih prevozov na določenih progah te pravice:
a) pravico do preleta ozemlja druge pogodbenice brez pristanka;
b) pravico do pristanka na ozemlju druge pogodbenice v nekomercialne namene;
c) pravico, da na ozemlju druge pogodbenice pristane v krajih, ki so za to progo določeni v prilogi k temu sporazumu, zato da v mednarodnem prometu vkrca in/ali izkrca potnike, tovor in pošto.
3. Nobena določba drugega odstavka tega člena ne daje določenemu prevozniku ene ali druge pogodbenice pravice, da za najemnino ali plačilo vkrca potnike, tovor in pošto za prevoz med kraji na ozemlju druge pogodbenice.
3. člen
DOLOČITEV PREVOZNIKA IN DOVOLJENJA ZA OPRAVLJANJE PREVOZOV
1. Pogodbenica ima pravico določiti in pisno sporočiti drugi pogodbenici enega ali več prevoznikov za opravljanje dogovorjenih prevozov na določenih progah in tako določitev umakniti ali spremeniti.
2. Po prejemu take določitve druga pogodbenica ob upoštevanju določb tretjega in četrtega odstavka tega člena določenim prevoznikom brez odlašanja izda ustrezno dovoljenje za opravljanje prevozov.
3. Pred izdajo dovoljenja za opravljanje prevozov lahko pristojni organ ene pogodbenice od določenega prevoznika druge pogodbenice zahteva, naj dokaže, da je sposoben izpolnjevati pogoje, določene v zakonih in predpisih, ki jih pristojni organ v skladu z določbami konvencije običajno in razumno uporablja pri opravljanju mednarodnih zračnih prevozov.
4. Pogodbenica ima pravico odkloniti izdajo dovoljenja za opravljanje prevoza iz drugega odstavka tega člena ali naložiti pogoje, ki jih mora po njenem mnenju izpolnjevati določeni prevoznik pri uresničevanju pravic iz 2. člena tega sporazuma, kadar nima zadovoljivih dokazov, da ima pogodbenica, ki je prevoznika določila, ali njeni državljani pretežni lastninski delež in dejanski nadzor nad tem prevoznikom.
5. Ko je prevoznik ali so prevozniki tako določeni in dobijo dovoljenje, smejo kadar koli začeti opravljati dogovorjene prevoze pod pogojem, da zanje veljajo tarife v skladu z določbami 12. člena tega sporazuma.
6. Pogodbenica ima pravico, da ob upoštevanju določb tega člena zamenja določenega prevoznika z drugim prevoznikom in/ali določi dodatnega prevoznika. Novodoločeni prevoznik ima enake pravice in obveznosti, kot jih je imel prevoznik, ki ga je zamenjal. Enake pravice in obveznosti veljajo tudi za dodatno določenega prevoznika.
4. člen
ODVZEM ALI ZAČASNI PREKLIC DOVOLJENJA ZA OPRAVLJANJE PREVOZOV
1. Pogodbenica ima pravico, da določenemu prevozniku druge pogodbenice odvzame dovoljenje za opravljanje prevozov ali začasno ustavi uresničevanje pravic iz 2. člena tega sporazuma ali da mu glede uresničevanja teh pravic določi pogoje, ki se ji zdijo potrebni:
a) kadar nima zadovoljivih dokazov, da ima pretežni lastninski delež in dejanski nadzor nad tem prevoznikom pogodbenica, ki je prevoznika določila, ali njeni državljani, ali
b) če prevoznik ne ravna skladno z zakoni in predpisi pogodbenice, ki je te pravice dala, ali
c) če prevoznik sicer ne opravlja prevozov v skladu s pogoji, predpisanimi s tem sporazumom.
2. Če takojšen odvzem dovoljenja, začasna ustavitev pravic oziroma določitev pogojev iz prvega odstavka tega člena niso nujni za preprečitev nadaljnjih kršitev zakonov in predpisov, se te pravice uporabijo šele po posvetovanju z drugo pogodbenico v skladu s 17. členom tega sporazuma.
5. člen
VELJAVNOST ZAKONOV IN PREDPISOV
1. Zakoni in predpisi ene pogodbenice, s katerimi so urejeni prihod letala v mednarodnem zračnem prometu na njeno ozemlje, njihovo zadrževanje na njem in odhod z njega ali s katerimi se urejata upravljanje in letenje teh letal, dokler so na njenem ozemlju, veljajo tudi za letala prevoznika, ki ga določi druga pogodbenica.
2. Zakoni in predpisi ene pogodbenice, ki se nanašajo na prihod potnikov, posadk, tovora in pošte na njeno ozemlje, zadrževanje na njem in odhod z njega, kot so postopki v zvezi s potnimi listinami, carino, valutnimi in sanitarnimi ukrepi, veljajo tudi za potnike, posadke, tovor, prtljago in pošto letala določenega prevoznika druge pogodbenice, dokler so na ozemlju prve pogodbenice.
6. člen
PRIZNAVANJE SPRIČEVAL IN DOVOLJENJ
1. Spričevala o plovnosti, spričevala o usposobljenosti in dovoljenja, ki jih izda ali potrdi ena pogodbenica in so še veljavna, prizna tudi druga pogodbenica pod pogojem, da so bile zahteve, po katerih so bila taka spričevala ali dovoljenja izdana ali potrjena, enake ali višje od minimalnih standardov, ki so določeni ali se lahko občasno določijo po konvenciji.
2. Pogodbenica pa si pridržuje pravico, da za polete nad svojim ozemljem ne prizna veljavnosti spričeval o usposobljenosti in dovoljenj, ki jih je njenim državljanom izdala ali potrdila druga pogodbenica ali katera koli druga država.
7. člen
TAKSE ZA UPORABNIKE
Takse za uporabo letališča, vključno z objekti, tehničnimi in drugimi napravami in storitvami, ter vse takse za uporabo letalskih navigacijskih naprav, komunikacijske opreme in storitev se zaračunavajo v višini, ki jo določi vsaka pogodbenica, in ne smejo biti višje od tistih, ki bi se plačala za njena letala, udeležena v podobnem mednarodnem zračnem prometu.
8. člen
CARINSKE DAJATVE IN POSTOPKI
1. Letala, ki jih v mednarodnem zračnem prometu uporablja določeni prevoznik ene pogodbenice, njihova običajna oprema, zaloge goriva in maziva ter druge zaloge na letalu (vključno s hrano, pijačo in tobakom), so po prihodu na ozemlje druge pogodbenice oproščeni vseh carinskih dajatev, taks za pregled in drugih dajatev ali davščin, pod pogojem, da ostanejo na letalu, dokler niso ponovno izvožene.
2. Oprostitev teh dajatev in davščin, razen plačila stroškov za opravljene storitve, se nanaša tudi na:
a) zalogo na letalu, natovorjeno na ozemlju ene pogodbenice v količinah, ki jih določijo njeni organi, in je namenjena za uporabo na letalu druge pogodbenice v mednarodnem zračnem prometu;
b) rezervne dele in opremo letala, pripeljano na ozemlje ene pogodbenice, za vzdrževanje ali popravilo letala, ki ga določeni prevoznik druge pogodbenice uporablja v mednarodnem prometu, in
c) gorivo in mazivo za letalo, ki ju pri dogovorjenih prevozih uporablja določeni prevoznik druge pogodbenice, tudi če bodo te zaloge porabljene na delu poti nad ozemljem pogodbenice, na katerem so bile natovorjene.
3. Za predmete iz drugega odstavka tega člena se lahko zahteva, da so pod carinskim nadzorom.
4. Običajna letalska oprema ter predmeti, zaloge in rezervni deli, ki so na letalu določenega prevoznika ene pogodbenice, se smejo na ozemlju druge pogodbenice raztovoriti le z dovoljenjem njenih carinskih organov. V takem primeru se lahko dajo pod nadzor teh organov, dokler niso ponovno izvoženi ali drugače uporabljeni v skladu s carinskimi predpisi.
5. Potrebni dokumenti določenega prevoznika ene pogodbenice, vključno z letalskimi vozovnicami, tovornimi listi ter oglaševalnim gradivom, so na ozemlju druge pogodbenice oproščeni vseh carinskih dajatev in davščin.
6. Prtljaga in tovor v neposrednem tranzitu sta oproščena carinskih dajatev ter drugih podobnih davščin.
9. člen
NEPOSREDNI TRANZITNI PROMET
Za potnike, prtljago in tovor v neposrednem tranzitu čez ozemlje ene ali druge pogodbenice, ki ne zapustijo območja letališča, določenega v ta namen, zadostuje le poenostavljen pregled, razen za varnostne ukrepe proti nasilju, zračnemu piratstvu in tihotapljenju nedovoljenih drog ali prepovedanih snovi.
10. člen
NAČELA, KI VELJAJO ZA OPRAVLJANJE DOGOVORJENIH PREVOZOV
1. Določeni prevozniki obeh pogodbenic imajo primerne in enake možnosti za opravljanje dogovorjenih prevozov na določenih progah med njunima ozemljema.
2. Pri opravljanju dogovorjenega prevoza določeni prevoznik pogodbenice upošteva interese določenega prevoznika druge pogodbenice, da ne bi neupravičeno škodoval prevozom, ki jih ta opravlja na isti progi ali njenem delu.
3. Dogovorjeni prevozi, ki jih opravljajo določeni prevozniki pogodbenic, morajo biti prilagojeni javnim potrebam po prevozu na določenih progah, glavni cilj vsakega določenega prevoznika pa mora biti, da ob primerni zasedenosti zagotavlja zmogljivosti, ki ustrezajo tekočim in razumno pričakovanim potrebam za prevoz potnikov, tovora, prtljage in pošte med ozemljema obeh pogodbenic.
4. Določeni prevozniki opravljajo dogovorjene prevoze v skladu s splošnimi načeli, da je zmogljivost prilagojena:
a) prometnim potrebam med državo odhoda in namembno državo;
b) prometnim potrebam na območju, čez katero potekajo dogovorjeni prevozi, in
c) razmerju med potrebami in poslovanjem prevoznika.
11. člen
REDI LETENJA
1. Rede letenja dogovorjenih prevozov je treba predložiti v odobritev pristojnim organom obeh pogodbenic najmanj šestdeset (60) dni pred dnem predlaganim za začetek njihove veljavnosti. S soglasjem pristojnih organov se lahko ta rok v posebnih primerih skrajša.
2. Vse kasnejše spremembe odobrenih redov letenja določenega prevoznika ene pogodbenice se predložijo v odobritev pristojnemu organu druge pogodbenice.
12. člen
TARIFE
1. Tarife, ki se zaračunavajo za dogovorjene prevoze, so določene v primernih zneskih, pri čemer se ustrezno upoštevajo vsi pomembni dejavniki, vključno s stroški poslovanja, primernim dobičkom, značilnostmi prevoznika (kot so standardi hitrosti in udobnosti) in tarifami, ki jih zaračunavajo drugi prevozniki. Tarife se določijo v skladu z naslednjimi določbami tega člena.
2. Če je mogoče, se o tarifah iz prvega odstavka tega člena za vsako določeno progo dogovorita določena prevoznika obeh pogodbenic po posvetovanju z drugimi prevozniki, ki opravljajo zračne prevoze na isti progi ali na njenem delu. Tako dogovorjene tarife je treba predložiti v odobritev pristojnim organom pogodbenic.
3. Tako dogovorjene tarife je treba predložiti v odobritev pristojnima organoma pogodbenic najmanj šestdeset (60) dni pred dnem, predlaganim za začetek njihove veljavnosti, razen kadar se pristojna organa v posebnih primerih dogovorita za skrajšanje tega roka.
4. Odobritev tarife je lahko izrecna oziroma šteje se, da so tarife odobrene, če nobeden od pristojnih organov ne izrazi svojega nestrinjanja v tridesetih (30) dneh od dneva, ko so bile tarife predložene v skladu s tretjim odstavkom tega člena. Če je bil rok za predložitev skrajšan, kot je predvideno v tretjem odstavku, se lahko pristojna organa dogovorita, da je ustrezno krajši tudi rok, v katerem lahko sporočita svoje nestrinjanje.
5. Če se določeni prevozniki ne morejo dogovoriti o kaki tarifi ali če iz kakršnega koli drugega razloga tarife ni mogoče določiti v skladu z določbami drugega odstavka tega člena, si pristojna organa obeh pogodbenic prizadevata sporazumno določiti tarifo.
6. Če se pristojna organa ne moreta dogovoriti o odobritvi tarife, ki jima je predložena v skladu z drugim odstavkom tega člena, ali o določitvi tarife v skladu s tretjim odstavkom tega člena, se spor rešuje v skladu z določbami 19. člena tega sporazuma.
7. Sprejete tarife veljajo, dokler se v skladu z določbami tega člena ne določijo nove.
8. Nobena tarifa ne sme začeti veljati, če je ni odobril pristojni organ ene ali druge pogodbenice.
13. člen
FINANČNE DOLOČBE
1. Določeni prevoznik pogodbenice ima pravico, da z ustreznim dovoljenjem in v skladu z ustreznimi notranjimi zakoni in predpisi sam ali s posredniki proda prevozne storitve na ozemlju druge pogodbenice v lokalni ali v prosto zamenljivi valuti.
2. Določeni prevoznik pogodbenic ima pravico, da v skladu z veljavnimi zakoni in predpisi pogodbenic iz države prodaje v svojo državo prenese presežek prejemkov nad izdatki, ki ga je dosegel v državi prodaje.
3. Tak prenos se opravi v skladu z določbami sporazuma, ki ureja finančne zadeve med pogodbenicama. Če takšnega sporazuma ni ali ne vsebuje ustreznih določb, se prenos opravi v trdni zamenljivi valuti po uradnem menjalnem tečaju v skladu z deviznimi predpisi pogodbenic.
14. člen
PREDSTAVNIŠTVA
1. Za opravljanje dogovorjenih prevozov lahko ima določeni prevoznik ene pogodbenice predstavništvo na ozemlju druge pogodbenice s potrebnim administrativnim, komercialnim in tehničnim osebjem.
2. Predstavništvo določenega prevoznika mora biti registrirano po veljavni zakonodaji države, v kateri je ustanovljeno.
15. člen
VARNOST LETALSTVA
1. V skladu s pravicami in obveznostmi po mednarodnem pravu pogodbenici ponovno potrjujeta, da je njuna medsebojna obveznost varovanja civilnega letalstva pred nezakonitimi dejanji sestavni del tega sporazuma. Brez omejevanja svojih splošnih pravic in obveznosti po mednarodnem pravu pogodbenici ravnata zlasti v skladu z določbami Konvencije o kaznivih dejanjih in nekaterih drugih dejanjih, storjenih na letalih, podpisane 14. septembra 1963 v Tokiu, Konvencije o zatiranju nezakonite ugrabitve zrakoplovov, podpisane 16. decembra 1970 v Haagu, Konvencije o zatiranju nezakonitih dejanj zoper varnost civilnega letalstva, podpisane 23. septembra 1971 v Montrealu, in njenega Protokola o zatiranju nezakonitih nasilnih dejanj na letališčih za mednarodno civilno letalstvo, podpisanega 24. februarja 1988 v Montrealu, in določbami veljavnih dvostranskih sporazumov med pogodbenicama ter sporazumov, ki jih bosta podpisali kasneje.
2. Pogodbenici si na zahtevo medsebojno pomagata, da bi preprečili nezakonite ugrabitve civilnih letal in druga nezakonita dejanja proti varnosti takih letal, njihovih potnikov in posadk, letališč in navigacijskih naprav ter vsako drugo ogrožanje varnosti civilnega letalstva.
3. Pogodbenici v medsebojnih odnosih ravnata v skladu z določbami o varnosti civilnega letalstva in s tehničnimi zahtevami Mednarodne organizacije civilnega letalstva, opredeljenimi v prilogah konvencije, v obsegu, ki velja zanju; od prevoznikov, ki so vpisani v njuna registra ali imajo svojo glavno poslovno enoto ali stalni sedež na njunem ozemlju, ter od letaliških podjetij na njunih ozemljih, zahtevata, da delujejo v skladu s takimi varnostnimi predpisi.
4. Pogodbenici se strinjata, da smeta od prevoznikov zahtevati, da spoštujejo letalske varnostne predpise iz tretjega odstavka tega člena, ki jih zahteva druga pogodbenica za vstop, odhod oziroma dokler so letala na njenem ozemlju. Pogodbenica zagotavlja, da se bodo na njenem ozemlju učinkovito izvajali primerni ukrepi za zavarovanje letal in za pregled potnikov, posadk, ročne prtljage, prtljage, tovora in zalog na letalu pred in med vkrcanjem in natovarjanjem. Pogodbenici z razumevanjem obravnavata vsako zahtevo druge pogodbenice za uvedbo razumnih dodatnih varnostnih ukrepov zaradi določene grožnje.
5. Ob nezakoniti ugrabitvi ali grožnji z ugrabitvijo ali drugih nezakonitih dejanjih proti varnosti letala, njegovih potnikov in posadke, letališč ali navigacijskih naprav pogodbenici pomagata druga drugi, s tem da olajšata komunikacije in z drugimi ustreznimi ukrepi za hitro in varno končanje takega dogodka ali grožnje.
16. člen
PREISKAVA NESREČE
1. Pogodbenica se obvezuje, da bo ob nevarnosti ali nesreči na svojem ozemlju pomagala letalu druge pogodbenice ter njegovim potnikom in posadki pomaga. Pogodbenica pomaga enako in v enakem obsegu kot svojim letalom, potnikom in posadkam.
2. Ob nesreči, nevarnosti, zasilnem pristanku, poškodbi ali strmoglavljenju letala ene pogodbenice druga pogodbenica:
a) ravna v skladu z določbami Priloge 13 h konvenciji;
b) daje vso možno pomoč letalu;
c) takoj sprejme vse potrebne ukrepe za pomoč posadki in potnikom, udeleženim v nesreči;
d) o nesreči takoj obvesti drugo pogodbenico;
e) zaščiti pošto, prtljago in tovor na letalu;
f) zavaruje razbitine in sledove strmoglavljenega letala ter vso dokumentacijo na letalu in vso dokumentacijo, povezano s poletom.
3. Pogodbenica, na katere ozemlju se zgodi nesreča, ukrene vse potrebno za preiskavo okoliščin in vzrokov nesreče in na prošnjo druge pogodbenice dovoli predstavnikom druge pogodbenice prost vstop na njeno ozemlje, da bi bili lahko navzoči pri preiskavi nesreče kot opazovalci.
4. Pogodbenica po končani preiskavi sporoči izsledke preiskave drugi pogodbenici in ji na zahtevo pošlje tudi kopije vseh listin, povezanih z nesrečo. Kopije vsebujejo vse potrebne listine in podatke v skladu z zakoni in predpisi o mednarodnih poletih na ozemlju pogodbenice, ki je opravila preiskavo.
17. člen
POSVETOVANJA
1. Pristojna organa pogodbenic se občasno med seboj posvetujeta, da bi zagotovila tesno sodelovanje pri vseh zadevah, ki vplivajo na izvajanje tega sporazuma.
2. Pogodbenica lahko kadar koli zahteva posvetovanje o vsakem vprašanju v zvezi s tem sporazumom. Če se pogodbenici ne dogovorita drugače, se taka posvetovanja začnejo v tridesetih (30) dneh od dneva, ko druga pogodbenica prejme pisno zaprosilo.
18. člen
ZAGOTAVLJANJE STATISTIČNIH PODATKOV
1. Pristojni organ pogodbenice pristojnemu organu druge pogodbenice na njegovo zahtevo zagotavlja občasna ali druga statistična poročila.
2. Taka poročila vsebujejo vse podatke, potrebne za ugotovitev obsega prometa, ki ga je opravil določeni prevoznik pri dogovorjenih prevozih, in o začetnih in končnih krajih tega prometa.
19. člen
REŠEVANJE SPOROV
1. Če pride med pogodbenicama do spora pri razlagi ali uporabi tega sporazuma, si ga pogodbenici prizadevata rešiti predvsem s pogajanji.
2. Če pogodbenici spora ne rešita s pogajanji, se lahko dogovorita, da ga predložita v odločanje določeni osebi ali organu ali na zahtevo ene ali druge pogodbenice arbitražnemu sodišču treh razsodnikov, od katerih vsaka pogodbenica imenuje po enega razsodnika, tretjega pa tako imenovana razsodnika. Pogodbenica imenuje svojega razsodnika v šestdesetih (60) dneh po tem, ko po diplomatski poti prejme obvestilo druge pogodbenice o zahtevani arbitraži, tretji razsodnik pa bo imenovan v naslednjih šestdesetih (60) dneh. Če ena ali druga pogodbenica ne imenuje razsodnika v določenem roku ali če tretji razsodnik ni imenovan v določenem roku, lahko katera koli pogodbenica zahteva od predsednika Sveta Mednarodne organizacije civilnega letalstva, da imenuje razsodnika oziroma razsodnike. Če je predsednik državljan ene od pogodbenic ali sicer ne more opraviti svoje naloge, potrebna imenovanja opravi njegov namestnik. V vsakem primeru mora biti tretji razsodnik državljan tretje države in deluje kot predsednik arbitraže.
3. Pogodbenici se obvezujeta, da bosta ravnali v skladu z vsako odločitvijo, sprejeto po drugem odstavku tega člena.
20. člen
SPREMEMBE
1. Če pogodbenica meni, da je treba spremeniti katero koli določbo tega sporazuma, lahko glede predlagane spremembe zahteva posvetovanje z drugo pogodbenico v skladu z drugim odstavkom 19. člena. Vse tako dogovorjene spremembe začnejo veljati, ko so potrjene z izmenjavo not po diplomatski poti.
2. O spremembah priloge se lahko dogovorita neposredno pristojna organa pogodbenic in začnejo veljati, ko so potrjene z izmenjavo diplomatskih not.
21. člen
REGISTRACIJA PRI MOCL (ICAO)
Ta sporazum in vse njegove spremembe se registrirajo pri Mednarodni organizaciji civilnega letalstva.
22. člen
ODPOVED
1. Ta sporazum je sklenjen za nedoločen čas.
2. Pogodbenica lahko kadar koli po diplomatski poti obvesti drugo pogodbenico o svoji odločitvi, da odpoveduje ta sporazum. Hkrati o tem obvesti Mednarodno organizacijo civilnega letalstva. Če je takšno obvestilo dano, sporazum preneha veljati dvanajst (12) mesecev po tem, ko druga pogodbenica prejme obvestilo, razen če ni pred potekom tega roka obvestilo o odpovedi sporazumno umaknjeno. Če druga pogodbenica ne potrdi prejema obvestila o odpovedi, se šteje, da ga je prejela štirinajst (14) dni po dnevu, ko ga je prejela Mednarodna organizacija civilnega letalstva.
23. člen
ZAČETEK VELJAVNOSTI
1. Ta sporazum se začasno uporablja od dneva podpisa.
2. Pogodbenici druga drugo z izmenjavo diplomatskih not obvestita, da so izpolnjeni njuni notranjepravni pogoji za začetek veljavnosti tega sporazuma. Sporazum začne veljati na dan prejema zadnjega od obeh uradnih obvestil.
Da bi to potrdila, sta pooblaščenca, ki sta ju za to pravilno pooblastili njuni vladi, podpisala ta sporazum.
Sestavljeno v Ljubljani 30. marca 1999 v dveh izvirnikih v angleškem jeziku.

B. Prevoznik, ki ga določi Vlada Ukrajine, lahko opravlja redne mednarodne letalske prevoze v obeh smereh na teh progah:

C. Določeni prevozniki obeh pogodbenic lahko opravljajo prevoze tudi med drugimi kraji vmesnega pristajanja in naslednjimi kraji brez uresničevanja pravic pete svobode.
3. člen
Za izvajanje tega sporazuma skrbi Ministrstvo za promet.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
