O RAZGLASITVI ZAKONA O RATIFIKACIJI SPORAZUMA O TRGOVINSKEM IN GOSPODARSKEM SODELOVANJU MED REPUBLIKO SLOVENIJO IN REPUBLIKO TURČIJO (BTUTGS)
Razglašam Zakon o ratifikaciji Sporazuma o trgovinskem in gospodarskem sodelovanju med Republiko Slovenijo in Republiko Turčijo (BTUTGS), ki ga je sprejel Državni zbor Republike Slovenije na seji dne 1. oktobra 1996.

O RATIFIKACIJI SPORAZUMA O TRGOVINSKEM IN GOSPODARSKEM SODELOVANJU MED REPUBLIKO SLOVENIJO IN REPUBLIKO TURČIJO (BTUTGS)
1. člen
Ratificira se Sporazum o trgovinskem in gospodarskem sodelovanju med Republiko Slovenijo in Republiko Turčijo, podpisan v Ljubljani dne 8. marca 1996.
2. člen
Sporazum se v izvirniku v angleškem in v prevodu v slovenskem jeziku glasi:
A G R E E M E N T
ON TRADE AND ECONOMIC COOPERATION BETWEEN THE REPUBLIC OF SLOVENIA AND THE REPUBLIC OF TURKEY
The Government of the Republic of Slovenia and the Government of the Republic of Turkey (hereinafter referred to as the Contracting Parties),
– desiring to promote and diversify the mutually advantageous economic and commercial relations between their countries on a stable and balanced basis,
– aiming to strengthen further their friendly relations in accordance with the principles of equality, mutual respect and common benefit,
have agreed on the following:
ARTICLE 1
The Contracting Parties, in accordance with the provisions of this Agreement and their national legislation in force, shall take the necessary measures in order to develop and diversify their trade relations on a long term, stable and balanced basis and to expand economic cooperation within the framework of existing possibilities.
ARTICLE 2
The Contracting Parties shall grant each other the most-favoured-nation treatment with respect to customs duties and charges of any kind applied to imports and exports of goods originating from their countries.
This provision shall not apply to:
1) Privileges granted to neighbouring countries to facilitate border and coastal trade.
2) Privileges which result from agreements leading to a customs union or a free trade area to which either of the Contracting Parties is or may hereafter become a party.
3) Privileges granted with the aim of creating special arrangements with developing countries in the field of trade and economic relations.
ARTICLE 3
The Contracting Parties, in accordance with their national legislation in force, agreed to exempt from customs duties and taxes, the goods imported temporarily for use in trade promotional events such as fairs, exhibitions, missions and seminars, provided that such goods are not sold or otherwise transferred.
ARTICLE 4
The Contracting Parties, aiming to improve and diversify the bilateral trade and develop economic cooperation between their countries, agreed to facilitate and accelerate the exchange of information, particularly concerning their respective legislations and economic programmes, to encourage contacts between their companies and other entities involved in trade and economic cooperation.
ARTICLE 5
The Contracting Parties agreed to support the cooperation between their countries in the fields of industry and technology.
Furthermore, the Contracting Parties identified, inter alia, the following areas as the possible fields of cooperation:
– iron and steel industry,
– agriculture and food industry,
– transport and telecommunications,
– construction and contracting activities,
– chemical industry,
– metal processing industry,
– textiles, apparel and footwear industry,
– timber and wood industry,
– oil industry,
– mining and mineral ore processing,
– ship building industry,
– automotive industry,
– cooperation on the third markets, regarding joint investments and other economic activities,
– tourism.
ARTICLE 6
All payments pertaining to imports and exports of goods and services between the two countries shall be effected in freely convertible currencies, unless otherwise agreed, in compliance with the legislation in force in each country.
ARTICLE 7
The Contracting Parties shall encourage the adoption of arbitration for the settlement of disputes arising from the commercial transactions.
ARTICLE 8
Taking into account the importance of banking in developing mutual economic and commercial activities, the Contracting Parties agreed to promote the cooperation between the relevant organizations in the fields of finance and banking.
ARTICLE 9
The Contracting Parties decided to establish a Slovenian – Turkish Joint Economic Commission in order to review the implementation of this Agreement, to examine the issues arising from its implementation and to make recommendations to their Governments for further expansion of bilateral economic and trade relations.
This Commission will be composed of the representatives appointed by their Governments and will meet on mutually acceptable dates in Slovenia and Turkey alternately.
ARTICLE 10
This Agreement does not affect the rights and obligations of the Contracting Parties resulting from bilateral and multilateral international agreements in force.
ARTICLE 11
In the event of the termination of this Agreement, its provisions shall continue to apply to the contracts concluded during its period of validity.
ARTICLE 12
This Agreement shall enter into force on the date when both Contracting Parties notify each other through diplomatic channels that their national requirements necessary for the entry into force of this Agreement have been fulfilled, and shall remain in force for a period of five years.
This Agreement shall automatically be extended for successive periods of one year unless either of the Contracting Parties notify each other in writing to terminate the Agreement, six months prior to its expiration.

S P O R A Z U M
O TRGOVINSKEM IN GOSPODARSKEM SODELOVANJU MED REPUBLIKO SLOVENIJO IN REPUBLIKO TURČIJO
Vlada Republike Slovenije in Vlada Republike Turčije (v nadaljevanju besedila pogodbenici) sta se
– v želji, da bi spodbudili in popestrili vzajemno koristne gospodarske in poslovne odnose med državama na stabilni in uravnoteženi podlagi,
– in z namenom, da bi še bolj okrepili prijateljske odnose v skladu z načeli enakosti, vzajemnega spoštovanja in skupne koristi,
sporazumeli o naslednjem:
1. člen
Pogodbenici v skladu z določbami tega sporazuma in s svojo veljavno notranjepravno zakonodajo ustrezno ukrepata, zato da bi razvili in popestrili svoje trgovinske odnose na dolgoročni stabilni in uravnoteženi podlagi in da bi razširili gospodarsko sodelovanje v okviru obstoječih možnosti.
2. člen
Pogodbenici druga drugi priznata največje ugodnosti glede carin in dajatev kakršnekoli vrste, ki se uporabljajo za uvoz in izvoz blaga, ki izvira iz ene ali druge pogodbenice.
To določilo se ne uporablja:
1) za privilegije, priznane sosednjim državam za lajšanje obmejne in obalne trgovine;
2) za privilegije, ki izhajajo iz sporazumov, ki vodijo v carinsko unijo ali prostotrgovinsko območje, katerih pogodbenica je ena od pogodbenic ali pa to lahko postane po sklenitvi tega sporazuma;
3) za privilegije, priznane z namenom, da se oblikujejo posebni dogovori z državami v razvoju na področju trgovinskih in gospodarskih odnosov.
3. člen
Pogodbenici v skladu s svojo veljavno notranjepravno zakonodajo soglašata, da bosta oprostili carin in dajatev blago, ki se začasno uvaža za uporabo ob trgovinsko-predstavitvenih dogokih, kot so sejmi, razstave, misije in seminarji, pod pogojem, da se to blago ne proda ali kako drugače prenese.
4. člen
Pogodbenici v prizadevanju po izboljšanju in popestritvi dvostranske trgovine in po razvijanju gospodarskega sodelovanja med državama soglašata, da bosta lajšali in pospeševali izmenjavo informacij, zlasti tistih, ki se nanašajo na njuno zakonodajo in gospodarske programe, zato, da bi spodbujali stike med svojimi podjetji in drugimi osebki, udeleženimi pri trgovinskem in gospodarskem sodelovanju.
5. člen
Pogodbenici soglašata, da bosta podpirali sodelovanje med državama na področju industrije in tehnologije.
Nadalje pogodbenici med dugim opredeljujeta spodaj navedena področja kot možna področja sodelovanja:
– železarska in jeklarska industrija,
– kmetijstvo in živilska industrija,
– prevoz in telekomunikacije,
– gradbeništvo in izvajalske dejavnosti,
– kemična industrija,
– kovinsko-predelovalna industrija,
– tekstilna, oblačilna in obutvena industrija,
– industrija stavbnega lesa in lesna industrija,
– naftna industrija,
– rudarstvo in predelava mineralnih rud,
– ladjedelniška industrija,
– avtomobilska industrija,
– sodelovanje na tretjih trgih pri skupnih vlaganjih in drugih gospodarskih dejavnostih,
– turizem.
6. člen
Če ni drugače dogovorjeno, se vsa plačila, ki se nanašajo na uvoz in izvoz blaga in storitev med državama, opravijo v prosto konvertibilnih valutah v skladu z zakonodajo, ki velja v obeh državah.
7. člen
Pogodbenici spodbujata sprejetje arbitraže za reševanje sporov, ki bi nastali pri poslovnih transakcijah.
8. člen
Ob upoštevanju pomena bančništva pri razvijanju vzajemnih gospodarskih in poslovnih dejavnostih se pogodbenici dogovorita, da bosta pospeševali sodelovanje med ustreznimi bančnimi in finančnimi ustanovami.
9. člen
Pogodbenici sta se odločili, da ustanovita slovensko-turško skupno gospodarsko komisijo, zato da bi pregledovala uresničevanje tega sporazuma, proučevala vprašanja, ki nastajajo v zvezi z njegovim uresničevanjem, in dajala priporočila vsaka svoji vladi za nadaljno širitev dvostranskih gospodarskih in trgovinskih odnosov.
Ta komisija bo sestavljena iz predstavnikov, ki jih imenujeta njihovi vladi, in se bo sestajala ob vzajemno dogovorjenih datumih izmenično v Sloveniji in Turčiji.
10. člen
Ta sporazum ne vpliva na pravice in obveznosti pogodbenic, ki izhajajo iz veljavnih dvostranskih ali mnogostranskih mednarodnih sporazumov.
11. člen
V primeru prenehanja tega sporazuma veljajo njegova določila še naprej za pogodbe, ki se sklenejo med njegovo veljavnostjo.
12. člen
Ta sporazum začne veljati na dan, ko pogodbenici druga drugo po diplomatski poti obvestita, da so izpolnjene njune nacionalne zahteve, potrebne za začetek veljavnosti tega sporazuma, in velja pet let.
Ta sporazum se samodejno podaljšuje vsakič za eno leto, razen če ena od pogodbenic šest mesecev pred iztekom veljavnosti sporazuma pisno ne obvesti druge pogodbenice, da ga odpoveduje.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za ekonomske odnose in razvoj.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
