O RAZGLASITVI ZAKONA O RATIFIKACIJI DOGOVORA MED VLADO REPUBLIKE SLOVENIJE IN VLADO KANADE O MEDSEBOJNEM SODELOVANJU PRI PREPREČEVANJU NEZAKONITEGA PRESELJEVANJA (BCAPNP)
Razglašam Zakon o ratifikaciji Dogovora med Vlado Republike Slovenije in Vlado Kanade o medsebojnem sodelovanju pri preprečevanju nezakonitega preseljevanja (BCAPNP), ki ga je sprejel Državni zbor Republike Slovenije na seji dne 26. januarja 1996.

O RATIFIKACIJI DOGOVORA MED VLADO REPUBLIKE SLOVENIJE IN VLADO KANADE O MEDSEBOJNEM SODELOVANJU PRI PREPREČEVANJU NEZAKONITEGA PRESELJEVANJA (BCAPNP)
1. člen
Ratificira se Dogovor med Vlado Republike Slovenije in Vlado Kanade o medsebojnem sodelovanju pri preprečevanju nezakonitega preseljevanja, sklenjen z izmenjavo not 28. julija 1995.
2. člen
Dogovor se v izvirniku v slovenskem in angleškem jeziku glasi:
Veleposlaništvo Kanade v Budimpešti izraža spoštovanje Ministrstvu za zunanje zadeve Republike Slovenije in ima čast, z željo da bi podpirali obstoječe vezi prijateljstva med državama, predlagati sklenitev Dogovora med Vlado Kanade in Vlado Republike Slovenije o medsebojnem sodelovanju pri preprečevanju nezakonitega preseljevanja, tako da:
1. podpirata dejavnosti nadzora priseljevanja, ki jih opravljajo uradniki obeh držav v zvezi s preprečevanjem nezakonitega preseljevanja;
2. omogočita diplomatom obeh držav ali gostujočim strokovnjakom posebno usposabljanje in podporo letalskim družbam, ki morajo skrbeti za to, da imajo vsi potniki ustrezne dokumente za potovanje;
3. sprejmeta vse možne ukrepe za preprečevanje nezakonitega priseljevanja preko njunih ozemelj s pomočjo preiskav in pregona storilcev, ki tihotapijo osebe, kar bi vključevalo tiste, ki se ukvarjajo z vnosom, izdelavo in prodajo ponarejenih priseljeniških ali osebnih dokumentov, organizatorje verig tihotapcev in tiste, ki spremljajo nezakonite priseljence;
4. da izmenjujeta podatke o nezakonitem preseljevanju in tihotapljenju.
Ob upoštevanju nacionalne zakonodaje ene in druge države bo vsaka država pomagala pri izvajanju in uveljavljanju njunih zakonov in vseh zakonitih preiskav, tako da bo na zahtevo dala podatke o osebah, ki kršijo zakon o priseljevanju ene od obeh držav, ali za katere obstaja utemeljen razlog za domnevo, da naj bi ga kršile. Dodatek k temu dogovoru opredeljuje pogoje, pod katerimi se lahko razkrijejo osebni podatki.
5. da sprejmeta vse možne varnostne ukrepe zoper zlorabo potnih listov in dokumentov za priseljevanje; sem spadajo tudi ustrezen nadzor nad izdajanjem take dokumentacije, poizvedovanje o možnih zlorabah dokumentov ene in druge države in prizadevanja za izboljšanje varnostnih lastnosti takih dokumentov.
6. Ta dogovor se uporablja od 1. avgusta 1995 in začne veljati dne 1. januarja 1996.
7. Ta dogovor lahko ena ali druga stran začasno razveljavi ali odpove s pisnim obvestilom tri mesece vnaprej po diplomatski poti.
Če je predlog tega dogovora sprejemljiv za Vlado Republike Slovenije, ima Veleposlaništvo Kanade v Budimpešti čast predlagati, da ta nota in nota odgovor Ministrstva za zunanje zadeve Republike Slovenije sestavljata Dogovor med Vlado Kanade in Vlado Republike Slovenije o medsebojnem sodelovanju pri preprečevanju nezakonitega preseljevanja.
Veleposlaništvo Kanade v Budimpešti tudi ob tej priložnosti izraža Ministrstvu za zunanje zadeve Republike Slovenije svoje globoko spoštovanje.

2. Namen izmenjave osebnih podatkov in njihova uporaba
(i) Zoper določenega posameznika poteka preiskava zaradi domnevne kršitve kanadskih ali slovenskih predpisov.
(ii) Pogodbenica, ki prejme osebne podatke po Dogovoru med Vlado Kanade in Vlado Republike Slovenije o medsebojnem sodelovanju pri preprečevanju nezakonitega preseljevanja (v nadaljevanju “Dogovor”), jih ne bo uporabljala za druge namene kot za izvajanje in uveljavljanje zakona in jih brez pisnega privoljenja pogodbenice, ki je podatke priskrbela, ne bo dala tretjemu.
3. Obveznosti spoštovanja zaupnosti
Poizvedovanja, podatki in prošnje za podatke, ki jih prejme ena ali druga država po Dogovoru, se bodo obravnavali zaupno in bodo deležni varovanja v obsegu, ki ga glede zasebnosti in varstva podatkov določa zakon države, ki prejme podatke.
4. Posredovanje osebnih podatkov posameznikom, na katere se nanašajo
Pogodbenici se obvezujeta, da bosta vzdrževali, spoštovali in varovali zaupnost podatkov, izmenjanih po Dogovoru, in da jih ne bosta nikomur razkrili, tudi ne osebi, na katero se nanašajo, razen če je tako razkritje jasno odobreno v Dogovoru ali s pisnim privoljenjem pogodbenice, ki podatke daje.
5. Pooblaščeni organi
Vsa poizvedovanja in prošnje za podatke ter podatki v odgovor nanje po Dogovoru dajejo uradniki pogodbenic, ki jih v ta namen imenuje za Kanado pomočnik namestnika ministra International Service of Citizenship and Immigration Canada (Mednarodna služba za državljanstvo in priseljevanje, Kanada) in za Republiko Slovenijo minister za notranje zadeve.
Ministrstvo za zunanje zadeve Republike Slovenije izraža odlično spoštovanje Veleposlaništvu Kanade v Budimpešti in ima čast potrditi prejem note Veleposlaništva številka 0794/95 z dne 28. julija 1995, ki se glasi:
“Veleposlaništvo Kanade v Budimpešti izraža spoštovanje Ministrstvu za zunanje zadeve Republike Slovenije in ima čast, z željo da bi podpirali obstoječe vezi prijateljstva med državama, predlagati sklenitev Dogovora med Vlado Kanade in Vlado Republike Slovenije o medsebojnem sodelovanju pri preprečevanju nezakonitega preseljevanja, tako da:
1. podpirata dejavnosti nadzora priseljevanja, ki jih opravljajo uradniki obeh držav v zvezi s preprečevanjem nezakonitega preseljevanja;
2. omogočita diplomatom obeh držav ali gostujočim strokovnjakom posebno usposabljanje in podporo letalskim družbam, ki morajo skrbeti za to, da imajo vsi potniki ustrezne dokumente za potovanje;
3. sprejmeta vse možne ukrepe za preprečevanje nezakonitega priseljevanja preko njunih ozemelj s pomočjo preiskav in pregona storilcev, ki tihotapijo osebe, kar bi vključevalo tiste, ki se ukvarjajo z vnosom, izdelavo in prodajo ponarejenih priseljeniških ali osebnih dokumentov, organizatorje verig tihotapcev in tiste, ki spremljajo nezakonite priseljence;
4. da izmenjujeta podatke o nezakonitem preseljevanju in tihotapljenju.
Ob upoštevanju nacionalne zakonodaje ene in druge države bo vsaka država pomagala pri izvajanju in uveljavljanju njunih zakonov in vseh zakonitih preiskav, tako da bo na zahtevo dala podatke o osebah, ki kršijo zakon o priseljevanju ene od obeh držav, ali za katere obstaja utemeljen razlog za domnevo, da naj bi ga kršile. Dodatek k temu dogovoru opredeljuje pogoje, pod katerimi se lahko razkrijejo osebni podatki.
5. da sprejmeta vse možne varnostne ukrepe zoper zlorabo potnih listov in dokumentov za priseljevanje; sem spadajo tudi ustrezen nadzor nad izdajanjem take dokumentacije, poizvedovanje o možnih zlorabah dokumentov ene in druge države in prizadevanja za izboljšanje varnostnih lastnosti takih dokumentov.
6. Ta dogovor se uporablja od 1. avgusta 1995 in začne veljati dne 1. januarja 1996.
7. Ta dogovor lahko ena ali druga stran začasno razveljavi ali odpove s pisnim obvestilom tri mesece vnaprej po diplomatski poti.

Ministrstvo za zunanje zadeve Republike Slovenije ima čast sporočiti Veleposlaništvu Kanade v Budimpešti, da je predlog sprejemljiv za Vlado Republike Slovenije in da glede na to nota Veleposlaništva in ta nota odgovor sestavljata Dogovor med Vlado Republike Slovenije in Vlado Kanade o medsebojnem sodelovanju pri preprečevanju nezakonitega preseljevanja.
Ministrstvo za zunanje zadeve Republike Slovenije tudi ob tej priložnosti Veleposlaništvu Kanade v Budimpešti ponovno izraža svoje odlično spoštovanje.

2. Namen izmenjave osebnih podatkov in njihova uporaba
(i) Zoper določenega posameznika poteka preiskava zaradi domnevne kršitve kanadskih ali slovenskih predpisov.
(ii) Pogodbenica, ki prejme osebne podatke po Dogovoru med Vlado Kanade in Vlado Republike Slovenije o medsebojnem sodelovanju pri preprečevanju nezakonitega preseljevanja (v nadaljevanju “Dogovor”), jih ne bo uporabljala za druge namene kot za izvajanje in uveljavljanje zakona in jih brez pisnega privoljenja pogodbenice, ki je podatke priskrbela, ne bo dala tretjemu.
3. Obveznosti spoštovanja zaupnosti
Poizvedovanja, podatki in prošnje za podatke, ki jih prejme ena ali druga država po Dogovoru, se bodo obravnavali zaupno in bodo deležni varovanja v obsegu, ki ga glede zasebnosti in varstva podatkov določa zakon države, ki prejme podatke.
4. Posredovanje osebnih podatkov posameznikom, na katere se nanašajo
Pogodbenici se obvezujeta, da bosta vzdrževali, spoštovali in varovali zaupnost podatkov, izmenjanih po Dogovoru, in da jih ne bosta nikomur razkrili, tudi ne osebi, na katero se nanašajo, razen če je tako razkritje jasno odobreno v Dogovoru ali s pisnim privoljenjem pogodbenice, ki podatke daje.
5. Pooblaščeni organi
Vsa poizvedovanja in prošnje za podatke ter podatki v odgovor nanje po Dogovoru dajejo uradniki pogodbenic, ki jih v ta namen imenuje za Kanado pomočnik namestnika ministra International Service of Citizenship and Immigration Canada (Mednarodna služba za državljanstvo in priseljevanje, Kanada) in za Republiko Slovenijo minister za notranje zadeve.
The Canadian Embassy in Budapest presents its compliments to the Ministry of Foreign Affairs of the Republic of Slovenia and, wishing to further the existing ties of friendship between both countries, has the honour to propose the conclusion of the Arrangement between the Government of Canada and the Government of the Republic of Slovenia on the mutual cooperation on combating illegal migration as follows:
1. To support the immigration control activities of each others officials with regards to combating illegal migration.
2. To allow their respective diplomats or visiting experts teams to provide specialized training and support to airline companies which are obligated to ensure that all passengers are properly documented for travel.
3. To undertake all possible action to impede illegal immigration through their respective territories by investigating and prosecuting the perpetrators of human smuggling which would include those involved in the importation, fabrication or selling of fraudulent immigration or identity documentation, organizers of smuggling rings, and escorts of illegal immigrants.
4. To exchange information on illegal migration and smuggling activities.
Subject to the national laws of the respective countries, each country will assist each other in the administration and enforcement of their respective laws, and any lawful investigation thereto, by providing upon request, information relating to persons who are, or where there are reasonable grounds to believe would be, in violation of the respective immigration law of one of the two countries. The Annex of this Arrangement specifies the terms under which disclosure of personal information may be made.
5. To take every possible precaution to guard against abuse of their respective passports and immigration documents; this would include proper controls on the issuance of such documentation, investigations into potential abuse of their respective documents and efforts to improve the security features of such documents.
6. This Arrangement shall be applied as of August 1, 1995 and will enter into effect on January 1st, 1996.
7. This Arrangement may be suspended or terminated by either of the Parties upon three months written notice, via diplomatic channels.
If the proposal of this Arrangement is acceptable to the Government of the Republic of Slovenia, the Canadian Embassy has the honour to suggest that this note and the note in answer of the Ministry of Foreign Affairs of the Republic of Slovenia will constitute the Arrangement between the Government of Canada and the Government of the Republic of Slovenia on the mutual cooperation on combating illegal migration.
The Canadian Embassy in Budapest avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Slovenia the assurances of its highest consideration.

2. Purpose for the sharing of personal information and use of the personal information
(i) Individual in question is under investigation for suspected violation of Canadian or Slovenian law.
(ii) Personal information provided under the Arrangement between the Government of Canada and the Government of the Republic of Slovenia on the mutual cooperation on combatting illegal migration (hereinafter referred to as “Arrangement”) will not be used by the receiving Party for purposes other than the administration or enforcement of a law, and will not be communicated to a third party without the written consent of the Party providing the information.
3. Obligations to observe confidentiality
Inquiries, information and requests for information received by either country under the Arrangement will be treated as confidential and shall be accorded protection to the extent provided for under the law of the receiving country in regard to privacy and data protection.
4. Disclosure of personal information to individual concerned
Each party undertakes to fully maintain, respect and protect the confidentiality of the information exchanged under the Arrangement, and not to release it to anyone, including the individual to whom it relates, except if such release is clearly authorized herein or by written consent of the Party providing the information.
5. Designated officials
All inquiries and requests for information, and information provided in response thereto under the Arrangement,will be communicated between officials of the respective Parties designated for that purpose by, in the case of Canada, the Assistant Deputy Minister, International Service of Citizenship and Immigration and in the case of the Republic of Slovenia, the Minister of the Interior.
The Ministry of Foreign Affairs of the Republic of Slovenia presents its compliments to the Canadian Embassy in Budapest and has the honour to confirm the receipt of the Embassy’s Note No. 0794/95 of July 28 1995 which reads as follows:
