O RAZGLASITVI ZAKONA O RATIFIKACIJI PRVEGA IN DRUGEGA PROTOKOLA K EVROPSKI KONVENCIJI O PREPREČEVANJU MUČENJA IN NEČLOVEŠKEGA ALI PONIŽEVALNEGA RAVNANJA ALI KAZNOVANJA
Razglašam Zakon o ratifikaciji Prvega in Drugega protokola k Evropski konvenciji o preprečevanju mučenja in nečloveškega ali poniževalnega ravnanja ali kaznovanja, ki ga je sprejel Državni zbor Republike Slovenije na seji dne 3. novembra 1994.

O RATIFIKACIJI PRVEGA IN DRUGEGA PROTOKOLA K EVROPSKI KONVENCIJI O PREPREČEVANJU MUČENJA IN NEČLOVEŠKEGA ALI PONIŽEVALNEGA RAVNANJA ALI KAZNOVANJA
1. člen
Ratificirata se Prvi in Drugi protokol k Evropski konvenciji o preprečevanju mučenja in nečloveškega ali poniževalnega ravnanja ali kaznovanja z dne 4. novembra 1993.
2. člen
Protokola se v izvirniku v angleškem jeziku in prevodu v slovenskem jeziku glasita:

to the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment
The member States of the Council of Europe, signatories to this Protocol to the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment, signed at Strasbourg on 26 November 1987 (hereinafter referred to as »the Convention«), considering that non-member States of the Council of Europe should be allowed to accede to the Convention at the invitation of the Committee of Ministers.
Have agreed as follows:
Article 1
A sub-paragraph shall be added to Article 5, paragraph 1, of the Convention as follows:
»Where a member is to be elected to the Committee in respect of a non-member State of the Council of Europe, the Bureau of the Consultative Assembly shall invite the Parliament of that State to put forward three candidates, of whom two at least shall be its nationals. The election by the Committee of Ministers shall take place after consultation with the Party concerned.«
Article 2
Article 12 of the Convention shall read as follows:
»Subject to the rules of confidentiality in Article 11, the Committee shall every year submit to the Committee of Ministers a general report on its activities which shall be transmitted to the Consultative Assembly and to any non-member State of the Council of Europe which is a party to the Convention, and made public.«
Article 3
The text of Article 18 of the Convention shall become paragraph 1 of that article and shall be supplemented by the following second paragraph:
»2 The Committee of Ministers of the Council of Europe may invite any non-member State of the Council of Europe to accede to the Convention.«
Article 4
In paragraph 2 of Article 19 of the Convention, the word »member« shall be deleted and the words »or approval,« shall be replaced by »approval or accession.«
Article 5
In paragraph 1 of Article 20 of the Convention, the words »or approval« shall be replaced by »approval or accession.«
Article 6
1. The introductory sentence of Article 23 of the Convention shall read as follows:
»The Secretary General of the Council of Europe shall notify the member States and any non-member State of the Council of Europe party to the Convention of:«
2. In Article 23.b of the Convention, the words »or approval;« shall be replaced by »approval or accession;«.
Article 7
1. This Protocol shall be open for signature by member States of the Council of Europe signatories to the Convention, which may express their consent to be bound by:
a signature without reservation as to ratification, acceptance or approval; or
b signature subject to ratification, acceptance or approval, followed by ratification, acceptance or approval.
2. Instrumenst of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.
Article 8
This Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date on which all Parties to the Convention have expressed their consent to be bound by the Protocol, in accordance with the provisions of Article 7.
Article 9
The Secretary General of the Council of Europe shall notify the member States of the Council of Europe of:
a any signature;
b the deposit of any instrument of ratification, acceptance or approval;
c the date of entry into force of this Protocol, in accordance with Article 8;
d any other act, notification or communication relating to this Protocol.
In witness whereof, the undersigned, being duly authorised thereto, have signed this Protocol.

Done at Strasbourg, this 4th day of November 1993, in English and French, both texts being equally authentic, in a single copy which shall be deposited in the archives of the Council of Europe. The Secretary General of the Council of Europe shall transmit certified copies to each member State ot the Council of Europe

to the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment
The States, signatories to this Protocol to the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment, signed at Strasbourg on 26 November 1987 (hereinafter referred to as »the Convention«),
Convinced of the advisability of enabling members of the European Committee for the Prevention of Torture and Inhuman and Degrading Treatment or Punishment (hereinafter referred to as »the Committee«) to be re-elected twice;
Also considering the need to guarantee an orderly renewal of the membership of the Committee,
Have agreed as follows:
Article 1
1. In Article 5, paragraph 3, the second sentence shall read as follows:
»They may be re-elected twice.«
2. Article 5 of the Convention shall be supplemented by the following paragraph 4 and 5:
»4. In order to ensure that; as far as possible, one half of the membership of the Committee shall be renewed every two years, the Committee of Ministers may decide, before proceeding to any subsequent election, that the term or terms of office of one or more members to be elected shall be for a period other than four years but not more than six and not less than two years.
5. In cases where more than one term of office is involved and the Committee of Ministers applies the preceding paragraph, the allocation of the terms of office shall be effected by the drawing of lots by the Secretary General, immediately after the election.«
Article 2
1. This Protocol shall be open for signature by States signatories to the Convention or acceding thereto, which may express their consent to be bound by:
a signature without reservation as to ratification, acceptance or approval; or
b signature subject to ratification, acceptance or approval, followed by ratification, acceptance or approval.
2 Instrument of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.
Article 3

k Evropski konvenciji o preprečevanju mučenja in nečloveškega ali poniževalnega ravnanja ali kaznovanja
Države članice Sveta Evrope, podpisnice tega Protokola k Evropski konvenciji o preprečevanju mučenja in nečloveškega ali ponižujočega ravnanja ali kaznovanja, podpisani 26. novembra 1987 v Strasbourgu (v nadaljevanju besedila imenovani konvencija), so se
ob upoštevanju dejstva, da je treba državam nečlanicam Sveta Evrope dovoliti, da pristopijo h konvenciji na povabilo Odbora ministrov,
dogovorile:
1. člen
1. odstavku 5. člena konvencije se doda pododstavek:
»Ko mora biti v Odbor izvoljen član iz države nečlanice Sveta Evrope, povabi urad Posvetovalne skupščine te države, da predlaga tri kandidate, od katerih sta vsaj dva njena državljana. Odbor ministrov izvede volitve po posvetovanju z zadevno pogodbenico.«
2. člen
12. člen konvencije se glasi:
»Na podlagi določil o zaupnosti iz 11. člena mora Odbor vsako leto predložiti Odboru ministrov splošno poročilo o svojih dejavnostih, ki se mora predložiti Posvetovalni skupščini ali kateri koli od držav nečlanic Sveta Evrope, ki je pogodbenica konvencije, in javno objaviti.«
3. člen
Besedilo 18. člena konvencije postane prvi odstavek tega člena, ki se dopolni z naslednjim drugim odstavkom:
»2. Odbor ministrov Sveta Evrope lahko povabi vsako državo nečlanico Sveta Evrope, da pristopi h konvenciji.«
4. člen
V drugem odstavku 19. člena se črta beseda »članico«, besedi »ali odobritvi« pa se nadomestita z »odobritvi ali pristopu«.
5. člen
V prvem odstavku 20. člena konvencije se besedi »ali odobritvi« nadomestita z »odobritvi ali pristopu«.
6. člen
1. Uvodni stavek 23. člena konvencije se glasi:
»Generalni sekretar Sveta Evrope mora obveščati vse države članice in vse države nečlanice Sveta Evrope, ki so pogodbenice konvencije, o:«
2. V 23. členu konvencije se v točki b) besedi »ali odobritvi« zamenjata z »odobritvi ali pristopu«.
7. člen
1. Ta protokol je odprt za podpis državam članicam Sveta Evrope, podpisnicam konvencije, ki lahko izrazijo svoje soglasje, da jih ta protokol zavezuje:
a) s podpisom brez pridržka ratifikacije, sprejema ali odobritve ali
b) s podpisom bo pridržku ratifikacije, sprejema ali odobritve.
2. Listine o ratifikaciji, sprejemu ali odobritvi se deponirajo pri generalnem sekretarju Sveta Evrope.
8. člen
Ta protokol začne veljati prvi dan v mesecu po preteku treh mesecev od datuma, ko so vse pogodbenice konvencije izjavile svoje soglasje, da jih zavezuje ta protokol v skladu z določbami 7. člena.
9. člen
Generalni sekretar Sveta Evrope obvesti države članice sveta Evrope o:
a) vsakem podpisu;
b) deponiranju vsake listine o ratifikaciji, sprejemu ali odobritvi;
c) začetku veljavnosti tega protokola v skladu z 8. členom;
d) vsakem drugem dokumentu, obvestilu ali sporočilu, ki se nanaša na ta protokol.
Da bi to potrdili, so podpisani, ki so bili za to pooblaščeni, podpisali ta protokol.

Sestavljeno v Strasbourgu 4. novembra 1993 v angleščini in francoščini, od katerih sta obe besedili enako verodostojni, in sicer samo v enem izvodu, ki je shranjen v arhivih Sveta Evrope. Generalni sekretar Sveta Evrope pošlje overjene kopije vsem državam članicam Sveta Evrope.

k Evropski konvenciji o preprečevanju mučenja in nečloveškega ali ponižujočega ravnanja ali kaznovanja
Države podpisnice tega protokola k Evropski konvenciji o preprečevanju mučenja in nečloveškega ali ponižujočega ravnanja ali kaznovanja, podpisani 26. novembra 1987 v Strasbourgu (v nadaljevanju besedila imenovani konvencija), so se
prepričane, da je smotrno članom Evropskega odbora za preprečevanje mučenja in nečloveškega ali ponižujočega ravnanja ali kaznovanja (v nadaljevanju besedila imenovanega Odbor) omogočiti, da so dvakrat ponovno izvoljeni,
ter ob upoštevanju potreb po zagotavljanju rednega obnavljanja članstva v Odboru,
dogovorile:
1. člen
1. Drugi stavek v 3. odstavku 5. člena se glasi:
»Lahko so dvakrat ponovno izvoljeni.«
2. 5. člen konvencije se dopolni s 4. in 5. odstavkom:
»4. Zato da bi kar najbolje zagotovili obnavljanje polovice članov Odbora vsaki dve leti, lahko Odbor ministrov pred nadaljevanjem volitev določi, da mandat enega ali več članov ne bo trajal štiri leta, vendar pa tudi ne sme biti daljši kot šest let in ne krajši od dveh let.
5. V primerih, ko gre za več kot en mandat in Odbor ministrov uporabi določbe prejšnjega odstavka, določi razporeditev mandatov z žrebom generalni sekretar takoj po volitvah.«
2. člen
1. Ta protokol je odprt za podpis državam podpisnicam konvencije ali tistim, ki so k njej pristopile, ki lahko izrazijo svoje soglasje, da jih ta protokol zavezuje:
a) s podpisom brez pridržka ratifikacije, sprejema ali odobritve ali
b) s podpisom ob pridržku ratifikacije, sprejema ali odobritve.
2. Listine o ratifikaciji, sprejemu ali odobritvi se deponirajo pri generalnem sekretarju Sveta Evrope.
3. člen
Ta protokol začne veljati prvi dan v mesecu po preteku treh mesecev od datuma, ko so vse pogodbenice konvencije izjavile svoje soglasje, da jih zavezuje ta protokol v skladu z določbami 2. člena.
4. člen
Generalni sekretar Sveta Evropa obvesti države članice Sveta Evrope ter države nečlanice in pogodbenice Konvencije o:
a) vsakem podpisu;
b) deponiranju vsake listine o ratifikaciji, sprejemu ali odobritvi;
c) začetku veljavnosti tega protokola v skladu s 3. členom;
d) vsakem drugem dokumentu, obvestilu ali sporočilu, ki se nanaša na ta protokol.
Po potrditvi so podpisani, ki so bili za to pooblaščeni, podpisali ta protokol;
Sestavljeno v Strasbourgu 4. novembra 1993 v angleščini in francoščini, od katerih sta obe besedili enako verodostojni, in sicer samo v enem izvodu, ki je shranjen v arhivih Sveta Evrope. Generalni sekretar Sveta Evrope pošlje overjene kopije vsem državam članicam Sveta Evrope.
3. člen
Za izvajanje protokolov skrbi ministrstvo, pristojno za zunanje zadeve, in ministrstvo, pristojno za pravosodje.
4. člen
Ta zakon začne veljati petnajsti dan po objavi v Uradnem listu Republike Slovenije - Mednarodne pogodbe.
