41. Uredba o ratifikaciji Sporazuma med Vlado Republike Slovenije in Vlado Turkmenistana o gospodarskem sodelovanju, stran 253.

Na podlagi petega odstavka 75. člena Zakona o zunanjih zadevah (Uradni list RS, št. 113/03 – uradno prečiščeno besedilo, 20/06 – ZNOMCMO, 76/08, 108/09 in 80/10 ZUTD) izdaja Vlada Republike Slovenije
U R E D B O
o ratifikaciji Sporazuma med Vlado Republike Slovenije in Vlado Turkmenistana o gospodarskem sodelovanju
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Turkmenistana o gospodarskem sodelovanju, podpisan v Ašhabatu 22. julija 2014.
2. člen
Besedilo sporazuma se v izvirniku v slovenskem in angleškem jeziku glasi(1):
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN VLADO TURKMENISTANA O GOSPODARSKEM SODELOVANJU
Vlada Republike Slovenije in Vlada Turkmenistana (v nadaljnjem besedilu: pogodbenici) sta se
ob potrditvi prijateljskih odnosov med državama in narodoma,
v želji spodbuditi razvoj gospodarskega sodelovanja na področjih skupnega interesa na podlagi enakosti, medsebojnega spoštovanja, obojestranske koristi in vzajemnosti,
ob upoštevanju možnosti za širitev dvostranske trgovine in želje po nadaljnji krepitvi stikov s spodbujanjem trgovine in gospodarskega sodelovanja,
ob spoštovanju splošno priznanih načel mednarodnega prava
dogovorili:
1. člen
Pogodbenici ob upoštevanju svoje notranje zakonodaje in mednarodnih obveznosti storita vse, kar je v njuni moči, za širitev in okrepitev gospodarskega sodelovanja v obojestransko korist na vseh področjih skupnega interesa.
2. člen
Pogodbenici si prizadevata za ustvarjanje ugodnih razmer za krepitev gospodarskega sodelovanja, predvsem:
– s pospeševanjem stikov med gospodarskimi subjekti,
– z ustvarjanjem ugodnega naložbenega okolja,
– z omogočanjem izmenjave poslovnih in gospodarskih informacij,
– s sodelovanjem pri organizaciji sejmov, razstav in konferenc,
– z izmenjavo informacij o zakonodaji s področja gospodarske dejavnosti v obeh državah,
– s krepitvijo sodelovanja na področju malih in srednje velikih podjetij ter naložb,
– s spodbujanjem trgovine z blagom in storitvami ter dolgoročnega sodelovanja na področjih industrije, infrastrukture, telekomunikacij, prometa, varstva okolja in turizma.
3. člen
Pogodbenici za oblikovanje priporočil in spremljanje izvajanja določb sporazuma ustanovita Slovensko-turkmenistansko medvladno komisijo za gospodarsko sodelovanje (v nadaljnjem besedilu: komisija).
Njene glavne naloge so:
– iskanje najobetavnejših področij za sodelovanje med pogodbenicama in priprava priporočil za njihovo izvajanje,
– priprava predlogov za izboljšanje sodelovanja med gospodarskimi subjekti obeh držav,
– izmenjava informacij o gospodarskih razmerah v obeh državah, zakonodaji in gospodarskih programih ter drugih informacij skupnega interesa,
– odkrivanje težav, ki zavirajo dvostransko trgovino in gospodarsko sodelovanje, ter predlaganje ukrepov za reševanje teh težav.
4. člen
1. Komisijo sestavljajo predstavniki pogodbenic, po potrebi pa se lahko k sodelovanju povabijo tudi predstavniki drugih ustanov javnega ali zasebnega sektorja.
2. Pogodbenici se na prvem zasedanju komisije dogovorita o poslovniku.
5. člen
1. Komisija zaseda vsaj enkrat letno. Po potrebi se s soglasjem obeh pogodbenic skličejo izredna zasedanja.
2. Pogodbenici se dogovorita o datumih zasedanj komisije in dnevnem redu.
3. Odločitve komisije se sprejemajo s soglasjem pogodbenic v obliki ločenih protokolov, ki jih podpišeta vodji delegacij na zasedanju.
6. člen
Sporazum se uporablja brez poseganja v pravice in obveznosti, ki izhajajo iz mednarodnih pogodb ali iz članstva pogodbenic v mednarodnih organizacijah. Uporablja se brez poseganja v obveznosti, ki izhajajo iz članstva Republike Slovenije v Evropski uniji.
7. člen
Vsi spori v zvezi z uporabo in razlago določb tega sporazuma se rešujejo s pogajanji in posvetovanji med pogodbenicama.
8. člen
1. Sporazum začne veljati na dan prejema zadnjega uradnega obvestila po diplomatski poti, da so končani vsi notranjepravni postopki za začetek veljavnosti sporazuma.
2. Sporazum se sklene za obdobje petih let in se samodejno podaljšuje za nadaljnja enoletna obdobja, razen če ena od pogodbenic šest mesecev pred potekom njegove veljavnosti ne pošlje pisnega uradnega obvestila o odpovedi.
3. S soglasjem obeh pogodbenic se sporazum lahko spremeni z ločenimi protokoli, ki so njegov sestavni del.
Sklenjeno v Ašhabatu dne 22. julija 2014 v dveh izvirnikih v slovenskem, turkmenskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Ob razlikah v razlagi prevlada angleško besedilo.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF TURKMENISTAN ON ECONOMIC COOPERATION
The Government of the Republic of Slovenia and the Government of Turkmenistan (hereinafter referred to as »the Contracting Parties«),
Confirming friendly relations between the two states and their people,
Desiring to promote the development of economic cooperation in the fields of mutual interest on the basis of equality, mutual respect, mutual benefit and reciprocity,
Considering the perspectives of expanding bilateral trade and the desire to further strengthen this interaction by promoting trade and economic cooperation, and
Guided by the universally recognized rules of international law,
Have agreed as follows:
Article 1
The Contracting Parties, considering their national legislations and international obligations, shall make their best efforts to expand and strengthen economic cooperation on the basis of mutual benefit in all fields of common interest.
Article 2
The Contracting Parties shall strive to create favourable conditions to strengthen economic cooperation, in particular by:
– facilitating the establishment of contacts between their economic entities,
– creating a favourable investment climate,
– facilitating the exchange of business and economic information,
– assisting each other with the organisation of fairs, exhibitions and symposiums,
– facilitating the exchange of information on legislation concerning economic activities in both countries,
– expanding their cooperation in the field of small and medium-sized enterprises and investments,
– promoting trade in goods and services, and long-term cooperation in the fields of industry, infrastructure, telecommunications, transport, environment protection and tourism.
Article 3
With the aim to develop recommendations and to monitor the implementation of the provisions of this Agreement, the Contracting Parties shall establish the Intergovernmental Slovenian-Turkmen Commission on Economic Cooperation (hereinafter referred to as »the Commission«).
The main tasks of the Commission shall be:
– identifying the most promising areas of cooperation between the Contracting Parties and preparing recommendations for implementation,
– preparing proposals for improving the cooperation between economic entities of the two countries,
– exchanging information on the economic situation in the two states, legislation, economic programmes and other information of mutual interest,
– identifying problems which hinder bilateral trade and economic cooperation and propose measures for resolving these problems.
Article 4
1. The Commission shall be composed of representatives of the Contracting Parties and, where necessary, representatives of other public or private sector institutions may also be invited to participate in its work.
2. The Contracting Parties shall agree upon the Rules of Procedure of the Commission at its first meeting.
Article 5
1. The Commission shall meet at least once a year. Extraordinary meetings of the Commission shall be held when necessary by mutual consent of the Contracting Parties.
2. The dates of meetings and the agenda of the Commission shall be agreed by both Contracting Parties.
3. The Commission's decisions shall be taken by consensus and made in the form of separate protocols, which shall be signed by the heads of delegation participating in the meeting of the Commission.
Article 6
This Agreement shall apply without prejudice to the rights and obligations arising from the international agreements of the Contracting Parties, as well as from their membership of the international organisations. This Agreement shall apply without prejudice to the obligations arising from the membership of the Republic of Slovenia of the European Union.
Article 7
All disputes relating to the application and interpretation of the provisions of this Agreement shall be resolved through negotiations and consultations between the Contracting Parties.
Article 8
1. This Agreement shall enter into force on the date of receipt of the last notification through diplomatic channels that all internal legal procedures for the entry into force of the Agreement have been fulfilled.
2. This Agreement shall be concluded for a period of five years and shall be automatically extended for successive one-year periods unless either Contracting Party submits a written notification to the other of its intention to terminate the Agreement six months prior to its expiry.
3. By mutual consent of the Contracting Parties this Agreement may be amended with separate protocols which constitute an integral part of this Agreement.
Done at Ashgabat on 22 July 2014 in two original copies, each in the Slovenian, Turkmen and English languages, all texts being equally authentic. In case of divergence in interpretation, the English text shall prevail.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za zunanje zadeve.
4. člen
Ta uredba začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
