33. Uredba o ratifikaciji Protokola med Ministrstvom za notranje zadeve Republike Slovenije, Policijo, in Ministrstvom za notranje zadeve Republike Hrvaške, Ravnateljstvom policije, o sodelovanju v turističnih sezonah, stran 186.

Na podlagi petega odstavka 75. člena Zakona o zunanjih zadevah (Uradni list RS, št. 113/03 – uradno prečiščeno besedilo, 20/06 – ZNOMCMO, 76/08, 108/09 in 80/10 – ZUTD) izdaja Vlada Republike Slovenije
U R E D B O
o ratifikaciji Protokola med Ministrstvom za notranje zadeve Republike Slovenije, Policijo, in Ministrstvom za notranje zadeve Republike Hrvaške, Ravnateljstvom policije, o sodelovanju v turističnih sezonah
1. člen
Ratificira se Protokol med Ministrstvom za notranje zadeve Republike Slovenije, Policijo, in Ministrstvom za notranje zadeve Republike Hrvaške, Ravnateljstvom policije, o sodelovanju v turističnih sezonah, sklenjen 13. maja 2014 v Valbandonu.
2. člen
Besedilo protokola se v izvirniku v slovenskem in angleškem jeziku glasi(1):
P R O T O K O L
med Ministrstvom za notranje zadeve Republike Slovenije, Policijo, in Ministrstvom za notranje zadeve Republike Hrvaške, Ravnateljstvom policije, o sodelovanju v turističnih sezonah
Ministrstvo za notranje zadeve Republike Slovenije, Policija (v nadaljevanju: slovenska policija), in Ministrstvo za notranje zadeve Republike Hrvaške, Ravnateljstvo policije (v nadaljevanju: hrvaška policija), sta se
– v skladu s Sporazumom med Vlado Republike Slovenije in Vlado Republike Hrvaške o čezmejnem policijskem sodelovanju, podpisanim 6. novembra 2002 v Zagrebu (v nadaljevanju: sporazum),
– da bi pomagala ustreznim institucijam Republike Slovenije in Republike Hrvaške, katerih glavna naloga je zagotavljanje javnega reda in miru, ter da bi zagotovila varnost in pomoč slovenskim turistom, ki v poletni turistični sezoni prebivajo v Republiki Hrvaški, in hrvaškim turistom, ki v zimski turistični sezoni prebivajo v Republiki Sloveniji,
dogovorila:
1. člen
(1) Po predhodnem dogovoru in ocenjenih potrebah slovenska policija v poletni turistični sezoni med 1. julijem in 1. septembrom napoti policiste iz Republike Slovenije v Republiko Hrvaško (v nadaljevanju: slovenski policisti), hrvaška policija pa v zimski turistični sezoni med 1. decembrom in 1. marcem napoti policiste iz Republike Hrvaške v Republiko Slovenijo (v nadaljevanju: hrvaški policisti).
(2) Pred vsako turistično sezono slovenska in hrvaška policija s pisnim dogovorom določita policijsko upravo, obdobje napotitve in število policistov, ki bodo napoteni.
(3) Slovenski policisti v Republiki Hrvaški in hrvaški policisti v Republiki Sloveniji opravljajo naloge po tem protokolu, kakor odredi enota iz prvega odstavka 3. člena tega protokola, in delujejo v skladu z notranjo zakonodajo države gostiteljice.
(4) Naloge napotenih policistov so:
a) pomoč pri sporazumevanju z njihovimi državljani;
b) izražanje mnenj in svetovanje o načinu obravnave njihovih državljanov;
c) pomoč pri stikih njihovih državljanov z njihovim veleposlaništvom.
(5) Med opravljanjem nalog v skladu s četrtim odstavkom tega člena napoteni policisti ne izvajajo policijskih pooblastil in ukrepov. Naloge opravljajo po navodilih vodje policijske postaje pristojne policijske uprave policije sprejemnice.
(6) Napoteni policisti med opravljanjem nalog nosijo svojo uniformo in niso oboroženi.
2. člen
Slovenski policisti seznanijo hrvaške, hrvaški policisti pa slovenske policiste z ustrezno notranjo zakonodajo in s posebnimi pogoji dela v zimski ali poletni turistični sezoni.
3. člen
(1) Razpored nalog napotenih policistov pripravi pristojna policijska uprava policije sprejemnice. V nujnih primerih so napoteni policisti pripravljeni opravljati svoje naloge kadar koli.
(2) Napoteni policisti nemudoma obvestijo pristojno policijsko enoto sprejemnico o svojih zdravstvenih težavah ali poškodbah.
(3) Policija pošiljateljica uredi dodatno zdravstveno in nezgodno zavarovanje za svoje policiste za čas opravljanja nalog po tem protokolu.
4. člen
Med opravljanjem nalog po tem protokolu za napotene policiste veljajo določbe glede zaščite in pomoči, delovnopravnih razmerjih ter odškodninske odgovornosti iz 16. in 17. člena sporazuma.
5. člen
Slovenska policija določi koordinatorja za usklajevanje nalog hrvaških policistov, hrvaška policija pa koordinatorja za usklajevanje nalog slovenskih policistov.
6. člen
(1) Policija sprejemnica uredi vse administrativne zadeve, povezane s sprejemom napotenih policistov. S tem povezana zaprosila se pošiljajo koordinatorjema.
(2) Policija sprejemnica zagotovi napotenim policistom brezplačno namestitev, prehrano in lokalni prevoz med njihovim prebivanjem. Slovenska policija napotenim policistom zagotovi brezplačne smučarske vozovnice.
7. člen
Pri opravljanju nalog napoteni policisti uporabljajo slovenski, hrvaški ali angleški jezik.
8. člen
(1) Napotitev napotenega policista lahko policija sprejemnica kadar koli prekine, če:
a) je bil pri opravljanju svojih nalog malomaren ali nespoštljiv,
b) je ravnal v nasprotju s pravili stroke in kodeksom policijske etike.
(2) V takem primeru se policiji pošiljateljici pošlje poročilo.
9. člen
(1) Protokol se sklene za nedoločen čas.
(2) Ob soglasju obeh pogodbenikov se ta protokol lahko spremeni ali dopolni.
(3) Protokol začne veljati na dan prejema zadnjega od obvestil, s katerima se pogodbenika po diplomatski poti obvestita, da so izpolnjene njune notranjepravne zahteve za začetek veljavnosti, in velja še tri mesece po datumu, ko en pogodbenik prejme obvestilo drugega pogodbenika o odpovedi protokola.
Sklenjeno v Valbandonu 13. maja 2014 v dveh izvirnikih v slovenskem, hrvaškem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Ob razlikah pri razlagi prevlada angleško besedilo.

P R O T O C O L
between the Ministry of the Interior of the Republic of Slovenia, the Police, and the Ministry of the Interior of the Republic of Croatia, General Police Directorate, on cooperation during the tourist seasons
The Ministry of the Interior of the Republic of Slovenia, the Police (hereinafter “the Slovenian Police”), and the Ministry of the Interior of the Republic of Croatia, General Police Directorate (hereinafter “the Croatian Police”),
– pursuant to the Agreement between the Government of the Republic of Slovenia and the Government of the Republic of Croatia on cross-border police cooperation, signed on 6th of November 2002 in Zagreb (hereinafter: “the Agreement”),
– in order to assist the proper institutions of the Republic of Slovenia and the Republic of Croatia whose main task is to maintain public order, and to guarantee safety and support for Slovenian tourists who are staying in the Republic of Croatia during the summer tourist season and for Croatian tourists who are staying in the Republic of Slovenia during the winter tourist season,
Have agreed as follows:
Article 1
(1) Pursuant to previous agreement and assessment of needs, the Slovenian Police shall second police officers from the Republic of Slovenia to the Republic of Croatia (hereinafter: “the Slovenian police officers”) during summer tourist season in the period from 1st of July till 1st of September and the Croatian Police shall second police officers from the Republic of Croatia to the Republic of Slovenia (hereinafter: “the Croatian police officers”) during winter tourist season in the period from 1st of December till 1st of March.
(2) Before every tourist season, the Slovenian and Croatian Police shall determine, by way of a written document, the police administration, period of stay and number of police officers who shall be seconded.
(3) The Slovenian police officers in the Republic of Croatia and the Croatian police officers in the Republic of Slovenia shall perform their duties under this Protocol as instructed by the unit specified in the first paragraph of Article 3 of this Protocol, and shall comply with the national legislation of the host country.
(4) The tasks of the seconded police officers shall be:
a) facilitating the communication with their nationals;
b) expressing their views and advice on the manner of proceeding with their nationals;
c) assisting their nationals in communication with their embassy.
(5) While performing their tasks defined in the fourth paragraph of this Article the seconded police officers shall not exercise any police powers or undertake any police measures. They shall perform their tasks in accordance with the instructions of the head of police station in the competent police administration of the receiving Police.
(6) The seconded police officers shall wear their uniforms and shall not be armed while performing their tasks.
Article 2
The Slovenian Police shall inform the Croatian police officers while the Croatian Police shall inform the Slovenian police officers about the relevant national legislation and the specific conditions of service during the winter or summer tourist season.
Article 3
(1) Duty schedule of the seconded police officers shall be prepared by the competent police administration of the receiving Police. In case of emergency the seconded police officers shall be ready to perform their tasks at any time.
(2) The seconded police officers shall inform without delay the competent receiving police unit about their health problems or injuries.
(3) The sending Police shall arrange supplementary health and personal accident insurance for their police officers during their service under this Protocol.
Article 4
During their service under this Protocol, the seconded police officers shall be subject to provisions of Article 16 and 17 of the Agreement in respect of protection and assistance, labour-law relations and liability for damages.
Article 5
The Slovenian Police shall designate a coordinator to coordinate the Croatian police officers' duties while the Croatian Police shall designate a coordinator to coordinate the Slovenian police officers' duties.
Article 6
(1) The receiving Police shall take care of all administrative matters connected with the reception of seconded police officers. All requests in these matters shall be directed to the coordinators.
(2) The receiving Police shall provide the seconded police officers free accommodation, board and local transport during their stay. The Slovenian Police shall provide free ski passes to the seconded police officers.
Article 7
The seconded police officers shall use Slovenian, Croatian or English language while performing their duties.
Article 8
(1) The secondment of the seconded police officer may be cancelled by the receiving Police if any of the following apply:
a) they performed their tasks with negligence or disrespect;
b) they failed to act in accordance with the professional rules and code of police ethics.
(2) Such a case shall be reported to the sending Police.
Article 9
(1) This Protocol is concluded for an indefinite period of time.
(2) This Protocol may be modified or amended upon agreement of both Parties.
(3) This Protocol shall enter into force on the day of the receipt of the last notification of the Parties, through diplomatic channels, that their internal legal requirements necessary for its entry into force have been fulfilled and shall remain in force until three months after the date when one Party receives a notice on the termination of the Protocol from the other Party.
Done at Valbandon, on 13 May 2014, in two originals each in the Slovenian, Croatian and English languages, all texts being equally authentic. In case of any divergence in the interpretation, the English text shall prevail.

3. člen
Za izvajanje protokola skrbi ministrstvo, pristojno za notranje zadeve.
4. člen
Ta uredba začne veljati petnajsti dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
