Razglašam Zakon o ratifikaciji Sporazuma med Vlado Republike Slovenije in Vlado Azerbajdžanske republike o sodelovanju v kulturi, izobraževanju in znanosti (BAZSKIZ), ki ga je sprejel Državni zbor Republike Slovenije na seji dne 26. septembra 2012.

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO AZERBAJDŽANSKE REPUBLIKE O SODELOVANJU V KULTURI, IZOBRAŽEVANJU IN ZNANOSTI (BAZSKIZ)
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Azerbajdžanske republike o sodelovanju v kulturi, izobraževanju in znanosti, sestavljen v Ljubljani 9. junija 2011.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi(*):
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN VLADO AZERBAJDŽANSKE REPUBLIKE O SODELOVANJU V KULTURI, IZOBRAŽEVANJU IN ZNANOSTI
Vlada Republike Slovenije in Vlada Azerbajdžanske republike (v nadaljnjem besedilu: pogodbenici) sta se
v želji po razvoju in krepitvi prijateljskih odnosov med državama, poglobitvi sodelovanja ter izmenjavi v kulturi, izobraževanju in znanosti,
v skladu s pravili in načeli mednarodnega prava ter Ustanovne listine Združenih narodov in
odločeni, da podpišeta ta sporazum o sodelovanju v kulturi, izobraževanju in znanosti (v nadaljnjem besedilu: sporazum),
dogovorili:
1. člen
Pogodbenici v skladu z načeloma enakopravnosti in obojestranske koristi spodbujata in podpirata izmenjavo ter sodelovanje na področju izobraževanja, znanosti, kulture, umetnosti, športa, turizma in mladine.
2. člen
Pogodbenici v skladu s svojo notranjo zakonodajo spodbujata sodelovanje v izobraževanju in znanosti, in sicer z:
– izmenjavo predavateljev, znanstvenikov in strokovnjakov, udeležbo na konferencah, s predavanji in raziskovanjem, da bi se seznanili s šolskim sistemom druge pogodbenice;
– izmenjavo dodiplomskih in podiplomskih študentov, ki temelji na neposrednem sodelovanju med zainteresiranimi ustanovami;
– vzpostavitvijo neposrednega sodelovanja in stikov med univerzami in drugimi izobraževalnimi, znanstvenimi in raziskovalnimi ustanovami, tudi diplomatskima akademijama;
– izmenjavo pripravnikov na usposabljanju, ki temelji na neposrednem sodelovanju med zainteresiranimi ustanovami;
– spodbujanjem študija jezika, književnosti, kulture in zgodovine druge države.
3. člen
Pogodbenici preučita možnosti za vzajemno priznavanje izobraževalnih programov.
4. člen
Pogodbenici spodbujata ozaveščanje javnosti o kulturni dediščini druge pogodbenice in njenih kulturnih dosežkih, klasičnih in sodobnih.
V ta namen spodbujata:
– izmenjavo informacij o kulturnem življenju v obeh državah,
– izmenjavo umetniških in fotografskih razstav,
– udeležbo na mednarodnih glasbenih, pevskih in folklornih festivalih, ki jih organizirata pogodbenici,
– povabila pisateljem, umetnikom in drugim kulturnikom obeh pogodbenic,
– izvajanje Ljubljanskega procesa na področju kulturne dediščine ter Bakujskega procesa na področju medkulturnega dialoga pri pogodbenicah.
5. člen
Pogodbenici spodbujata stike in sodelovanje med muzeji, knjižnicami in arhivi ter ustanovami na področju arheologije in obnove zgodovinskih spomenikov.
6. člen
Pogodbenici spodbujata sodelovanje na področju radia in televizije ter izmenjavo radijskih in televizijskih oddaj.
Prav tako spodbujata sodelovanje med tiskovnima agencijama obeh držav.
7. člen
Pogodbenici spodbujata sodelovanje v športu ter izmenjavo med mladinskimi organizacijami obeh držav.
8. člen
Pogodbenici v skladu s cilji tega sporazuma spodbujata turistično izmenjavo.
9. člen
Država pošiljateljica osebam, vključenim v izmenjavo po tem sporazumu, pred njihovim prihodom v državo sprejemnico uredi zdravstveno zavarovanje za čas njihovega bivanja v tej državi.
10. člen
Za izvajanje sporazuma pogodbenici redno pripravljata programe izmenjav in se dogovarjata o finančnih podrobnostih za njihovo izvedbo.
Pristojni organi in ustanove obeh držav lahko na podlagi tega sporazuma sklepajo sporazume ali protokole o neposrednem sodelovanju.
11. člen
Sporazum se lahko s soglasjem pogodbenic spremeni z ločenimi protokoli, ki so sestavni del tega sporazuma in začnejo veljati v skladu s postopkom iz 12. člena.
12. člen
Sporazum se sklene za nedoločen čas. Veljati začne na dan, ko pogodbenici prejmeta zadnje pisno uradno obvestilo po diplomatski poti, da so dokončani notranjepravni postopki, potrebni za začetek njegove veljavnosti.
Pogodbenica lahko sporazum kadar koli pisno odpove. V tem primeru sporazum preneha veljati šest mesecev od dneva, ko druga pogodbenica prejme obvestilo o odpovedi sporazuma.
Odpoved sporazuma ne vpliva na programe, ki se trenutno izvajajo in v času veljavnosti sporazuma niso bili dokončani.
Sestavljeno v Ljubljani 9. junija 2011 v dveh izvirnikih v slovenskem, azerbajdžanskem in angleškem jeziku, od katerih so vsi enako verodostojni. Ob razlikah v razlagi prevlada angleško besedilo.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE REPUBLIC OF AZERBAIJAN ON COOPERATION IN THE FIELDS OF CULTURE, EDUCATION AND SCIENCE
The Government of the Republic of Slovenia and the Government of the Republic of Azerbaijan (hereinafter referred to as “the Contracting Parties”)
Desiring to develop and enhance friendly relations between the two countries and deepen cooperation and exchange in the fields of culture, education and science;
Guided by the norms and principles of international law and the UN Charter; and
Resolved to sign this Agreement on Cooperation in the Fields of Culture, Education and Science (hereinafter referred to as “the Agreement”);
have agreed as follows:
Article 1
The Contracting Parties, in conformity with the principles of equality and mutual benefit, shall encourage and support exchange and cooperation in the fields of education, science, culture, art, sport, tourism, and youth.
Article 2
The Contracting Parties, in accordance with their respective national legislations, shall encourage cooperation in the field of education and science through:
– Exchanging lecturers, scientists and experts, participation in conferences, delivering lectures, and conducting research, with a view to familiarizing both Contracting Parties with their respective education systems;
– Exchanging undergraduate and postgraduate students, based on direct cooperation between interested institutions;
– Establishing direct cooperation and contacts between universities and other educational, scientific and research institutions, including the respective diplomatic academies;
– Exchange of trainees for training, based on direct cooperation between interested institutions;
– Promoting the study of the language, literature, culture, and history of the other country.
Article 3
The Contracting Parties shall examine the possibility of reciprocal recognition of education programmes.
Article 4
The Contracting Parties shall encourage public awareness of the cultural heritage of the other Contracting Party and of its cultural achievements, both classical and contemporary.
To this end, they shall encourage:
– Exchange of information on the cultural life of both countries;
– Exchange of art and photo exhibitions;
– Participation in international music, song and folk dance festivals held by both Contracting Parties;
– Invitations extended to writers, artists, and other cultural professionals of either Contracting Party;
– The implementation of the “Ljubljana Process” in the sphere of cultural heritage and the “Baku Process” in the sphere of intercultural dialogue in the Contracting Parties.
Article 5
The Contracting Parties shall foster contacts and cooperation between museums, libraries and archives as well as institutions in the fields of archaeology and the restoration of historical monuments.
Article 6
The Contracting Parties shall encourage cooperation in the field of radio and television, and promote the exchange of radio and television programmes.
They shall also foster cooperation between the press agencies of both countries.
Article 7
The Contracting Parties shall encourage cooperation in the field of sport as well as exchanges between youth organizations of both countries.
Article 8
In line with the objectives of this Agreement, the Contracting Parties shall encourage tourist exchange.
Article 9
The sending state shall arrange adequate health insurance for persons exchanged in compliance with the Agreement prior to their arrival in the receiving state for the period of their stay in that state.
Article 10
In the implementation of this Agreement, the Contracting Parties shall periodically develop specific exchange programmes and agree upon the financial terms for their application.
On the basis of the Agreement, relevant bodies and institutions of both countries may conclude agreements or protocols on direct cooperation.
Article 11
Amendments to the Agreement may be made by mutual consent of the Contracting Parties in the form of separate protocols which are an integral part of the Agreement and enter into force in accordance with the procedure set forth in Article 12 hereof.
Article 12
This Agreement is concluded for an indefinite period of time. It shall enter into force on the date of receipt by the Contracting Parties of the last written notification through diplomatic channels that the internal legal procedures required for the entry into force of this Agreement have been fulfilled.
Each Contracting Party shall have the right to terminate this Agreement in writing at any time. In such a case, the Agreement shall expire six months following the date on which the notification of termination was received by the other Contracting Party.
The termination of this Agreement shall have no effect on the implementation of programmes in progress that have not been completed during the validity of this Agreement.
Done at Ljubljana this 9 day of June 2011, in duplicate in the Slovenian, Azerbaijani and English languages, each text being equally authentic. In case of divergence in interpretation, the English text shall prevail.

3. člen
Za izvajanje sporazuma skrbi ministrstvo, pristojno za izobraževanje, znanost, kulturo in šport.
4. člen
Ta zakon začne veljati petnajsti dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
