66. Uredba o ratifikaciji Sporazuma o gospodarskem sodelovanju med Vlado Republike Slovenije in Vlado Kraljevine Tajske, stran 609.

Na podlagi petega odstavka 75. člena Zakona o zunanjih zadevah (Uradni list RS, št. 113/03 – uradno prečiščeno besedilo, 20/06 – ZNOMCMO, 76/08, 108/09 in 80/10 ZUTD) izdaja Vlada Republike Slovenije
U R E D B O
O RATIFIKACIJI SPORAZUMA O GOSPODARSKEM SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO KRALJEVINE TAJSKE
1. člen
Ratificira se Sporazum o gospodarskem sodelovanju med Vlado Republike Slovenije in Vlado Kraljevine Tajske, podpisan v Ljubljani 1. februarja 2011.
2. člen
Besedilo sporazuma se v slovenskem prevodu in v izvirniku v angleškem jeziku glasi:
S P O R A Z U M
O GOSPODARSKEM SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO KRALJEVINE TAJSKE
Vlada Republike Slovenije in Vlada Kraljevine Tajske (v nadaljnjem besedilu: pogodbenici) sta se,
– potrjujoč prijateljske odnose med svojima državama in narodoma,
– v želji, da bi spodbujali razvoj gospodarskega sodelovanja na področjih skupnega interesa na podlagi enakosti, obojestranske koristi in vzajemnosti,
– ob upoštevanju obojestranskih koristi od povečane trgovine in naložb ter v želji po nadaljnji krepitvi odnosov, zlasti s spodbujanjem dvostranske trgovine, naložb, pravic intelektualne lastnine, sodelovanja v izobraževanju, gospodarskih vezi in tesnejšega sodelovanja, ter
– ob upoštevanju obveznosti obeh držav po mednarodnih sporazumih
dogovorili:
1. člen
Pogodbenici si v skladu s svojimi zakoni in drugimi predpisi ter ob upoštevanju svojih mednarodnih obveznosti in sporazumov kar najbolj prizadevata za razvoj in krepitev čim širšega gospodarskega sodelovanja na vseh področjih, za katera menita, da so v njunem interesu in skupno korist.
2. člen
Pogodbenici si prizadevata ustvariti ugodne razmere za krepitev gospodarskega sodelovanja, zlasti s tem da:
– olajšujeta in podpirata izmenjavo in stike med svojimi gospodarskimi subjekti;
– prepoznavata in omogočata naložbene priložnosti;
– olajšujeta izmenjavo informacij o dejavnostih na domačem trgu, vključno s predpisi o varstvu potrošnikov;
– spodbujata in podpirata gospodarske in naložbene projekte, analize trga, uporabo pravic intelektualne lastnine, izmenjavo trgovinskih in tržnih informacij, poslovne in institucionalne povezave ter druge pobude, ki povezujejo mogoče trgovinske partnerje;
– spodbujata izmenjavo akademskega osebja, usposabljanje in štipendiranje;
– si pomagata pri organizaciji sejmov, razstav, simpozijev itn.;
– spodbujata in krepita industrijsko sodelovanje v zasebnem sektorju, vključno s prenosom tehnologije, na ustrezen način v skladu s svojimi gospodarskimi in razvojnimi politikami ter prednostnimi nalogami.
3. člen
V ta namen pogodbenici ustanovita Slovensko-tajski gospodarski svet, ki obravnava področja, opredeljena v tem sporazumu, in:
– prepoznava področja, na katera se lahko razširi sodelovanje med pogodbenicama, predlaga ukrepe in daje priporočila za njihovo izvajanje;
– oblikuje predloge za izboljšanje možnosti za sodelovanje med gospodarskimi subjekti obeh držav;
– izmenjava informacije o gospodarskih razmerah v obeh državah, predpisih, gospodarskih programih in druge informacije v skupnem interesu;
– ugotavlja težave, ki ovirajo dvostransko trgovino in gospodarsko sodelovanje, ter predlaga ukrepe za njihovo reševanje.
4. člen
Gospodarski svet sestavljajo predstavniki pogodbenic, po potrebi pa so lahko k sodelovanju povabljeni tudi predstavniki drugih ustanov zasebnega ali javnega sektorja.
5. člen
1. Gospodarski svet se praviloma sestaja enkrat letno ali po potrebi na zahtevo ene od pogodbenic.
2. O datumu in dnevnem redu sestanka gospodarskega sveta se pogodbenici dogovorita.
3. O poteku in sklepih sestanka gospodarskega sveta pogodbenica gostiteljica sestavi zapisnik, ki ga na koncu podpišeta vodji delegacij.
6. člen
Vsaka pogodbenica lahko kadar koli po diplomatski poti zahteva spremembo tega sporazuma.
7. člen
Ta sporazum ne vpliva na obveznosti iz članstva v Evropski uniji. Na njegove določbe se zato ni mogoče sklicevati ali jih razlagati tako, da razveljavljajo ali kako drugače vplivajo na obveznosti iz Pogodbe o Evropski uniji ali sporazumov med Kraljevino Tajsko in Evropsko unijo.
8. člen
Z dnem začetka veljavnosti tega sporazuma preneha veljati Sporazum o gospodarskem in trgovinskem sodelovanju med Vlado Republike Slovenije in Vlado Kraljevine Tajske, podpisan 13. maja 1999.
9. člen
1. Ta sporazum začne veljati prvega dne drugega meseca po dnevu prejema zadnje od not, s katerima se pogodbenici obvestita o dokončanju notranjepravnih postopkov, potrebnih za začetek njegove veljavnosti.
Velja eno (1) leto in se samodejno podaljšuje za enaka obdobja.
2. Pogodbenica lahko sporazum odpove tako, da drugo pogodbenico o svoji nameri pisno obvesti tri (3) mesece pred potekom vsakega enoletnega obdobja.
Sestavljeno v dveh izvodih v Ljubljani 1. februarja 2011 v angleškem jeziku.

A G R E E M E N T
ON ECONOMIC COOPERATION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE KINGDOM OF THAILAND
The Government of the Republic of Slovenia and the Government of the Kingdom of Thailand (hereinafter referred to as “the Contracting Parties”),
– confirming friendly relations between their states and their people;
– wishing to promote the development of their economic cooperation in the fields of mutual interests on the basis of equality, mutual benefit and reciprocity;
– taking into account the mutual benefit arising from increased trade and investment, and the wish to strengthen further the relations, especially through the promotion of bilateral trade, investment, intellectual property rights, educational cooperation, economic ties and closer cooperation; and
– taking into account the obligations of their states arising from international agreements,
Have agreed as follows:
Article 1
The Contracting Parties shall, within the framework of their respective laws, regulations and other provisions and taking into account their respective international obligations and agreements, make their best efforts to develop and strengthen economic cooperation on the widest possible basis and in all the fields they deem to be of their mutual interest and benefit.
Article 2
The Contracting Parties shall strive to create favourable conditions to strengthen economic cooperation especially by:
– facilitating and supporting the exchange and contacts between their economic operators;
– identifying and facilitating investment opportunities;
– facilitating the exchange of information on activities in the domestic market, including the rules regarding consumer protection;
– promoting and supporting economic and investment missions, market analysis, the use of intellectual property rights, exchange of commercial and marketing information, business and institutional linkages and other initiatives which bring together potential commercial partners;
– promoting exchange of academic personnel, training and scholarship;
– helping each other in the organisation of fairs, exhibitions symposium etc.;
– promoting and enhancing private sector industrial cooperation including transfer of technology, through appropriate channels in accordance with their respective economic and development policies and priorities.
Article 3
To this end the Contracting Parties hereby establish the Thai-Slovenian Economic Council which shall deal with the fields covered by this Agreement and:
– identify the fields to which the cooperation between the Contracting Parties is to be extended, propose measures and give recommendations for their implementation;
– prepare proposals for improving the possibilities of cooperation between the economic operators of the two states;
– exchange information on the economic situation in both states, as well as on regulations, economic programmes and other information of mutual interests;
– determine problems which hinder bilateral trade and economic cooperation and propose measures for their solution.
Article 4
The Economic Council shall be composed of the representatives of the Contracting Parties and, where necessary, the representatives of other establishments of the private or the public sector may also be invited to participate.
Article 5
1. The Economic Council shall meet as a rule once a year or whenever necessary upon request of either of the Contracting Parties.
2. The date of the meeting and the agenda of the Economic Council shall be agreed upon by both Contracting Parties.
3. The host Contracting Party shall take the minutes of the course and the conclusions of the meeting of the Economic Council, which shall be signed by the leaders of both delegations at the end of the meeting.
Article 6
Either of the Contracting Parties may at any time request an amendment to this Agreement through diplomatic channels.
Article 7
This Agreement shall apply without prejudice to the obligations following from membership of the European Union, Consequently the provisions of this agreement may not be invoked or interpreted in such way as to invalidate or otherwise affect the obligations imposed by the Treaty on European Union or by the agreements between the Kingdom of Thailand and the European Union.
Article 8
On the date of entry into force of this Agreement, the Agreement on Trade and Economic Cooperation between the Government of the Republic of Slovenia and the Government of the Kingdom of Thailand, signed on 13 May 1999, shall be terminated.
Article 9
1. This Agreement shall enter into force on the first day of the second month after the day of receiving the last note by which the Contracting Parties shall inform each other on the fulfillment of internal legal procedures required for the entry into force of this Agreement.
It shall be valid for one (1) year and shall be automatically extended for equal periods.
2. Either of the Contracting Parties may terminate this Agreement by informing the other Contracting Party of its intention in writing three (3) months prior to the expiration of any one year period.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za zunanje zadeve.
4. člen
Ta uredba začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
