Na podlagi petega odstavka 75. člena Zakona o zunanjih zadevah (Uradni list RS, št. 113/03 – uradno prečiščeno besedilo, 20/06 ZNOMCMO, 76/08 in 108/09) izdaja Vlada Republike Slovenije

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO SOCIALISTIČNE REPUBLIKE VIETNAM O ODPRAVI VIZUMSKE OBVEZNOSTI ZA IMETNIKE DIPLOMATSKIH, SLUŽBENIH IN URADNIH POTNIH LISTOV
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Socialistične republike Vietnam o odpravi vizumske obveznosti za imetnike diplomatskih, službenih in uradnih potnih listov, sklenjen z izmenjavo not 22. decembra 2009.
2. člen
Besedilo sporazuma se v izvirniku v angleškem jeziku in prevodu v slovenskem jeziku glasi:

The Ministry of Foreign Affairs of the Republic of Slovenia presents its compliments to the Embassy of the Socialist Republic of Vietnam and has the honour to propose the conclusion of the following Agreement between the Government of the Republic of Slovenia and the Government of the Socialist republic of Vietnam on Visa exemption for holders of Diplomatic, Service and Official passports;
The two governments, hereinafter referred to as »the Contracting Parties«, desiring to strengthen their friendly relations and facilitate travel between the Republic of Slovenia and the Socialist Republic of Vietnam, agree on the following arrangement.
For the purpose of this agreement:
a) “diplomatic passport” refers to the diplomatic passport of the Republic of Slovenia and to the diplomatic passport of the Socialist Republic of Vietnam;
b) “service passport” refers only to the service passport of the Republic of Slovenia as designated on the document;
c) “official passport” refers only to the official passport of the Socialist Republic of Vietnam as designated on the document.
Nationals of the Contracting Parties holding valid diplomatic, service or official passports may enter the territory of the other Contracting Party and stay in it without a visa not more than three (3) months within six (6) months from the date of their first entry.
Irrespective of the provision of previous Paragraph, nationals of the Contracting Parties holding diplomatic, service or official passports and forming part of diplomatic missions and consulates of one of the Contracting Party based in the territory of the other Contracting Party, and their family members forming part of their household and holding diplomatic, service or official passports may freely and without the obligation to acquire a visa stay in the territory until the end of their assignment subject to the completion of residence formalities at the competent authorities in the territory of the relevant Contracting Party.
Holders of valid diplomatic, service or official passports of the Contracting Parties may enter the territory of the other Contracting Party at all points of entry open to international passenger traffic provided that required formalities are met in accordance with applicable regulations of relevant authorities of the other Contracting Party.
This Agreement does not exempt nationals of the Contracting Parties from their obligation to abide by the laws and regulations of the other Contracting Party when entering its territory and staying in it.
Either Contracting Party shall reserve the right to deny the entry or to terminate the stay of any citizen of the other Contracting Party, holding valid diplomatic, service or official passports, considered as persona non grata.
This Agreement does not affect the applicable laws and/or regulations of the two countries relating to internal security and the entry, stay or movement of foreigners.
Either Contracting Party may temporarily suspend the application of this Agreement wholly or partially for reasons of public order, national security or public health. Each Contracting Party shall immediately inform the other Contracting Party through diplomatic channels of the introduction and withdrawal of such measures. These measures shall enter into force or cease to apply on the date of receipt of a notification to that effect.
The Contracting Parties shall exchange, through diplomatic channels, specimens of their diplomatic, service and official passports within thirty (30) days prior to the entry into force of this Agreement.
In the event of the introduction of new passports, the Contracting Party concerned shall provide the other Contracting Party with the new specimens and necessary information through diplomatic channels thirty (30) days prior to the introduction, if possible.
This Agreement may be amended or supplemented by mutual consent of the Contracting Parties through the exchange of diplomatic notes, whereas for its entry into force the provisions of this Agreement apply.
This Agreement shall enter into force on the sixtieth (60th) day from the date of receipt of the last written notification by which the Contracting Parties inform each other that the internal legal requirements for its entry into force have been fulfilled.
This Agreement shall remain in force for an indefinite period of time; either Contracting Party may terminate it at any time by giving written notification to the other Contracting Party to that effect through diplomatic channels. The Agreement shall remain in force thirty (30) days after the receipt of the notification by the other Contracting Party.
If the foregoing proposals are acceptable to the Government of the Socialist Republic of Vietnam, the Ministry has the honour to propose that this Note and the affirmative reply of the Embassy of the Socialist Republic of Vietnam will constitute an Agreement between the two Governments on this matter.
The Ministry of Foreign Affairs of the Republic of Slovenia avails itself of this opportunity to extend to the esteemed Embassy of the Socialist Republic of Vietnam the renewed assurances of its highest consideration.

The Embassy of the Socialist Republic of Vietnam presents its compliments to the Ministry of Foreign Affairs of the Republic of Slovenia and has honour to acknowledge receipt of the Ministry’s Note number 921-95-191/07 dated 13th of October, 2009, which reads as follows:
“The Ministry of Foreign Affairs of the Republic of Slovenia presents its compliments to the Embassy of the Socialist Republic of Vietnam and has honour to propose the conclusion of the following Agreement between the Government of the Republic of Slovenia and the Government of the Socialist Republic of Vietnam on Visa exemption for holders of Diplomatic, Service and Official passports.

The Embassy of the Socialist Republic of Vietnam has the honour to confirm that the proposal of the Government of Slovenia is acceptable to the Government of the Socialist Republic of Vietnam, and the above Note of the Ministry of Foreign Affairs of the Republic of Slovenia and this reply will constitute the Agreement between the Government of the Socialist Republic of Vietnam and the Government of the Republic of Slovenia on Visa exemption for holders of Diplomatic, Service and Official passports.
The Embassy of the Socialist Republic of Vietnam in Vienna avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Slovenia the assurances of its highest consideration.

Ministrstvo za zunanje zadeve Republike Slovenije izraža Veleposlaništvu Socialistične republike Vietnam svoje odlično spoštovanje in mu ima čast predlagati sklenitev naslednjega Sporazuma med Vlado Republike Slovenije in Vlado Socialistične republike Vietnam o odpravi vizumske obveznosti za imetnike diplomatskih, službenih in uradnih potnih listov.
Vladi (v nadaljnjem besedilu: pogodbenici) sta se v želji, da okrepita prijateljske odnose ter poenostavita potovanje med Republiko Slovenijo in Socialistično republiko Vietnam, sporazumeli o naslednjem:
V tem sporazumu:
a) »diplomatski potni list« pomeni diplomatski potni list Republike Slovenije in diplomatski potni list Socialistične republike Vietnam;
b) »službeni potni list« pomeni samo službeni potni list Republike Slovenije, kot je označeno na dokumentu;
c) »uradni potni list« pomeni samo uradni potni list Socialistične republike Vietnam, kot je označeno na dokumentu.
Državljani pogodbenic, ki so imetniki veljavnih diplomatskih, službenih ali uradnih potnih listov, lahko vstopijo na ozemlje druge pogodbenice in tam bivajo brez vizuma največ tri (3) mesece v obdobju šestih (6) mesecev od dneva prvega vstopa.
Ne glede na določbo prejšnjega odstavka lahko državljani obeh pogodbenic, ki so imetniki diplomatskih, službenih ali uradnih potnih listov in so člani diplomatskega predstavništva ali konzulata ene pogodbenice na ozemlju druge pogodbenice, in njihovi družinski člani, ki živijo z njimi v skupnem gospodinjstvu in so imetniki diplomatskih, službenih ali uradnih potnih listov, neovirano in brez obveznosti pridobitve vizuma ostanejo v državi do izteka uradne dolžnosti, če pri pristojnih organih na ozemlju druge pogodbenice izpolnijo formalnosti, povezane z bivanjem.
Imetniki veljavnih diplomatskih, službenih ali uradnih potnih listov pogodbenic lahko vstopijo na ozemlje druge pogodbenice na vseh vstopnih mejnih prehodih za mednarodni potniški promet, če so izpolnjene potrebne formalnosti v skladu z veljavnimi predpisi pristojnih organov druge pogodbenice.
Ta sporazum ne odvezuje državljanov pogodbenic od spoštovanja zakonov in predpisov druge pogodbenice pri vstopu na njeno ozemlje in med bivanjem na tem ozemlju.
Pogodbenici si pridržujeta pravico, da zavrneta vstop ali odrečeta prebivanje na svojem ozemlju vsakemu državljanu druge pogodbenice, ki je imetnik veljavnega diplomatskega, službenega ali uradnega potnega lista in velja za nezaželeno osebo.
Ta sporazum ne vpliva na veljavne zakone ali predpise obeh držav s področja notranje varnosti ter vstopa, bivanja ali gibanja tujcev.
Pogodbenici lahko zaradi državne varnosti, javnega reda in miru ter javnega zdravja v celoti ali delno začasno odložita izvajanje tega sporazuma. Po diplomatski poti se takoj obvestita o uvedbi in preklicu takšnih ukrepov. Ukrepi začnejo in prenehajo veljati na dan prejema uradnega obvestila.
Pogodbenici si po diplomatski poti izmenjata vzorce diplomatskih, službenih in uradnih potnih listov najmanj trideset (30) dni pred začetkom veljavnosti tega sporazuma.
Ob uvedbi novih potnih listov pogodbenica po diplomatski poti drugi pogodbenici zagotovi nove vzorce in vse potrebne informacije, če je le mogoče, najmanj trideset (30) dni pred uvedbo.
Sporazum se lahko s soglasjem obeh pogodbenic spremeni ali dopolni z izmenjavo diplomatskih not, za njegovo uveljavitev pa se uporabljajo določbe tega sporazuma.
Ta sporazum začne veljati šestdeseti (60.) dan od dneva prejema zadnjega pisnega uradnega obvestila, s katerim se pogodbenici obvestita, da so izpolnjene notranjepravne zahteve za začetek njegove veljavnosti.
Sporazum se sklene za nedoločen čas; pogodbenici ga lahko kadar koli odpovesta in to pisno sporočita po diplomatski poti. Sporazum velja še trideset (30) dni po tem, ko druga pogodbenica prejme obvestilo o odpovedi.
Če je navedeni predlog sprejemljiv za Vlado Socialistične republike Vietnam, ima ministrstvo čast predlagati, da ta nota in pritrdilni odgovor Veleposlaništva Socialistične republike Vietnam sestavljata sporazum med vladama o tem.
Ministrstvo za zunanje zadeve Republike Slovenije tudi ob tej priložnosti Veleposlaništvu Socialistične republike Vietnam na Dunaju izraža svoje odlično spoštovanje.

Veleposlaništvo Socialistične republike Vietnam izraža svoje spoštovanje Ministrstvu za zunanje zadeve Republike Slovenije in ima čast potrditi prejem note ministrstva št. 921-95-191/07 z dne 13. oktobra 2009, ki se glasi:
»Ministrstvo za zunanje zadeve Republike Slovenije izraža Veleposlaništvu Socialistične republike Vietnam svoje odlično spoštovanje in mu ima čast predlagati sklenitev naslednjega Sporazuma med Vlado Republike Slovenije in Vlado Socialistične republike Vietnam o odpravi vizumske obveznosti za imetnike diplomatskih, službenih in uradnih potnih listov.
Vladi (v nadaljnjem besedilu: pogodbenici) sta se v želji, da okrepita prijateljske odnose ter poenostavita potovanje med Republiko Slovenijo in Socialistično republiko Vietnam, sporazumeli o naslednjem:

Ta sporazum ne odvezuje državljanov pogodbenic od spoštovanja zakonov in predpisov druge pogodbenice pri vstopu na njeno ozemlje in med bivanjem na tem ozemlju.
Pogodbenici si pridržujeta pravico, da zavrneta vstop ali odrečeta prebivanje na svojem ozemlju vsakemu državljanu druge pogodbenice, ki je imetnik veljavnega diplomatskega, službenega ali uradnega potnega lista in velja za nezaželeno osebo.

Veleposlaništvo Socialistične republike Vietnam ima čast potrditi, da je predlog Vlade Slovenije sprejemljiv za Vlado Socialistične republike Vietnam ter da zgornja nota Ministrstva za zunanje zadeve Republike Slovenije in ta odgovor sestavljata Sporazum med Vlado Socialistične republike Vietnam in Vlado Republike Slovenije o odpravi vizumske obveznosti za imetnike diplomatskih, službenih in uradnih potnih listov.
Veleposlaništvo Socialistične republike Vietnam na Dunaju tudi ob tej priložnosti Ministrstvu za zunanje zadeve Republike Slovenije izraža svoje odlično spoštovanje.
