87. Uredba o ratifikaciji Sporazuma o znanstvenem in tehnološkem sodelovanju med Vlado Republike Slovenije in Vlado Kraljevine Tajske, stran 1685.

Na podlagi sedme alinee petega odstavka 75. člena Zakona o zunanjih zadevah (Uradni list RS, št. 113/03 – uradno prečiščeno besedilo in 20/06 – ZNOMCMO) izdaja Vlada Republike Slovenije
U R E D B O
O RATIFIKACIJI SPORAZUMA O ZNANSTVENEM IN TEHNOLOŠKEM SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO KRALJEVINE TAJSKE
1. člen
Ratificira se Sporazum o znanstvenem in tehnološkem sodelovanju med Vlado Republike Slovenije in Vlado Kraljevine Tajske, sestavljen v Ljubljani, 8. septembra 2004.
2. člen
Sporazum se v izvirniku v angleškem jeziku in prevodu v slovenskem jeziku glasi:
A G R E E M E N T
ON SCIENTIFIC AND TECHNOLOGICAL COOPERATION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE KINGDOM OF THAILAND
The Government of the Republic of Slovenia and the Government of the Kingdom of Thailand (hereinafter referred to as "the Contracting Parties");
Desirous of strengthening friendly relationship between the two countries and promoting cooperation in science and technology;
Recognizing the importance of science and technology in the national economies of both countries;
Have agreed as follows:
Article 1
The Contracting Parties shall promote, in accordance with their respective laws and regulations, cooperation in the fields of science and technology between the two countries on the basis of equality and mutual benefit.
Article 2
Cooperation under this Agreement shall include:
1. exchange of scientists, researchers, technical personnel and experts;
2. exchange of documents and information of scientific and technological nature;
3. joint organization of scientific and technological seminars, symposiums, conferences and other meetings;
4. joint research on subjects of mutual interest, as well as exchange of its results; and
5. any other form of scientific and technological cooperation as may be agreed upon by the Contracting Parties.
Article 3
1. With a view to facilitating scientific and technological cooperation, the Contracting Parties shall conclude, where necessary, implementing arrangements to carry out cooperative activities between their government agencies, research institutes, universities or other relevant institutions, which shall be within the framework of this Agreement. Such arrangements shall be concluded in accordance with the laws and regulations in force in their respective countries.
2. The arrangements mentioned in paragraph 1 of this Article shall include the terms, conditions and procedures to be followed in particular cooperative activities and other relevant matters.
Article 4
1. In order to ensure optimum conditions for the application of this Agreement, the Contracting Parties shall establish a Joint Committee on Scientific and Technological Cooperation which shall consist of representatives designated by them.
2. The tasks of the Joint Committee shall be:
(A) to review the progress in cooperative activities under this Agreement;
(B) to define new areas of cooperation under this Agreement; and
(C) to discuss any other matter related to this Agreement.
3. The Joint Committee shall meet, if necessary, alternately in the Republic of Slovenia and in the Kingdom of Thailand on dates mutually agreed upon.
Article 5
Cooperation under this Agreement shall be subject to the applicable laws and regulations in force in their respective countries.
Article 6
The Contracting Parties shall ensure appropriate and efficient protection of intellectual property rights, obtained on the basis of this Agreement in accordance with the laws and regulations in force in their respective countries and in accordance with the international agreements to which they are parties.
Article 7
The Contracting Parties shall bear the expenses incurred in connection with the cooperative activities under this Agreement on the basis of the principle of equality and reciprocity and in accordance with the availability of resources.
Article 8
1. This Agreement shall enter into force on the date on which the Contracting Parties have notified each other that their respective internal requirements for the entry into force of this Agreement have been complied with.
2. This Agreement shall remain in force for a period of five years and shall continue to remain in force thereafter for successive periods of five years.
3. Either Contracting Party may terminate this Agreement by giving written notice to the other through diplomatic channels. This Agreement shall remain in force until six months after the date on which the other Contracting Party receives such notice.
4. This Agreement may be amended by written mutual consent of the Contracting Parties. Any amendment or termination of this Agreement shall not prejudice to any right or obligation arising or arisen under this Agreement prior to the effective date of such amendment or termination.
 
IN WITNESS WHEREOF, the undersigned, being duly authorized thereto by their respective Governments, have signed this Agreement.

S P O R A Z U M
O ZNANSTVENEM IN TEHNOLOŠKEM SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO KRALJEVINE TAJSKE
Vlada Republike Slovenije in Vlada Kraljevine Tajske (v nadaljevanju pogodbenici) sta se
V želji, da bi okrepili prijateljske odnose med državama in podprli sodelovanje v znanosti in tehnologiji;
Zavedajoč se pomena znanosti in tehnologije za nacionalni gospodarstvi obeh držav;
dogovorili:
1. člen
Pogodbenici v skladu s svojimi zakoni in predpisi podpirata sodelovanje na področju znanosti in tehnologije na med državama na podlagi enakosti in skupne koristi.
Sodelujoče organizacije so lahko znanstveni inštituti, znanstvena združenja, univerze, vladne agencije ter druge raziskovalne in razvojne organizacije.
2. člen
Sodelovanje v okviru tega sporazuma vsebuje:
1. izmenjave znanstvenikov, raziskovalcev, tehničnega osebja in izvedencev;
2. izmenjavo dokumentov in informacij znanstvene in tehnološke narave;
3. skupno organizacijo znanstvenih in tehnoloških seminarjev, simpozijev, konferenc in drugih srečanj;
4. skupne raziskave na področjih v obojestranskem interesu ter izmenjavo izsledkov; in
5. druge oblike znanstvenega in tehnološkega sodelovanja o katerih se lahko dogovorita pogodbenici.
3. člen
1. Da bi omogočili znanstveno in tehnološko sodelovanje, pogodbenici sklepata, če je potrebno, izvedbene dogovore za izvajanje dejavnosti sodelovanja med njunimi vladnimi agencijami, raziskovalnimi inštituti, univerzami in drugimi ustreznimi inštitucijami, ki so v okviru tega sporazuma. Taki dogovori se sklepajo v skladu z veljavnimi zakoni in predpisi v njunih državah.
2. Dogovori, omenjeni v prvem odstavku tega člena vsebujejo določbe, pogoje in postopke za ravnanje pri posameznih dejavnostih sodelovanja in drugih zadev glede tega.
4. člen
1. Za zagotovitev najugodnejših pogojev za uporabo tega sporazuma pogodbenici ustanovita Skupno komisijo za znanstveno in tehnološko sodelovanje, ki jo bodo sestavljali imenovani predstavniki.
2. Naloge Skupne komisije so:
(A) poročanje o napredku dejavnosti sodelovanja po tem sporazumu;
(B) določanje novih področij sodelovanja po tem sporazumu; in
(C) razpravljanje o drugih zadevah v zvezi s tem sporazumom.
3. Skupna komisija se sestaja, če je potrebno, izmenično v Republiki Sloveniji in Kraljevini Tajski v skupno dogovorjenih terminih.
5. člen
Sodelovanje po tem sporazumu je podrejeno veljavnim zakonom in predpisom v obeh državah.
6. člen
Pogodbenici zagotavljata ustrezno in učinkovito varstvo pravic intelektualne lastnine, pridobljene na podlagi tega sporazuma, v skladu z zakoni in predpisi, veljavnimi v njunih državah in v skladu z mednarodnimi sporazumi, katerih pogodbenici sta.
7. člen
Pogodbenici krijeta stroške, nastale v zvezi z dejavnostmi sodelovanja po tem sporazumu, na podlagi načela enakosti in vzajemnosti in v skladu z razpoložljivimi sredstvi.
8. člen
1. Ta sporazum začne veljati na dan, ko se pogodbenici med seboj obvestita, da so izpolnjene njune notranjepravne zahteve, potrebne za začetek njegove veljavnosti.
2. Ta sporazum velja pet let in ostaja v veljavi za nadaljnja petletna obdobja.
3. Vsaka pogodbenica lahko po diplomatski poti odpove ta sporazum s pisnim obvestilom drugi pogodbenici. Ta sporazum ostaja v veljavi šest mesecev po datumu, ko druga pogodbenica prejme tako obvestilo.
4. Ta sporazum se lahko spremeni s pisno privolitvijo obeh pogodbenic. Nobena sprememba ali odpoved tega sporazuma ne vpliva na katerokoli pravico ali dolžnost, ki izhaja ali je izšla iz tega sporazuma, pred datumom začetka veljavnosti take spremembe ali odpovedi.
 
V POTRDITEV TEGA sta podpisana, ki sta ju za to pravilno pooblastili njuni vladi, podpisala ta sporazum.
 
Sestavljeno v dveh izvodih, v Ljubljani, dne 8. septembra 2004, v angleškem jeziku.

3. člen
Za izvajanje sporazuma je pristojno Ministrstvo za visoko šolstvo, znanost in tehnologijo.
4. člen
Ta uredba začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
