O RATIFIKACIJI SPORAZUMA MED REPUBLIKO SLOVENIJO IN KRALJEVINO NIZOZEMSKO O STATUSU URADNIKA ZA ZVEZO PRI EUROPOLU

Ratificira se Sporazum med Republiko Slovenijo in Kraljevino Nizozemsko o statusu uradnika za zvezo pri Europolu, sklenjen z izmenjavo not dne 22. decembra 2003.

The Ministry of Foreign Affairs presents its compliments to the Embassy of the Republic of Slovenia and has the honour to propose, with reference to the Co-operation Agreement between the Republic of Slovenia and the European Police Office of 1 October 2001 (hereinafter ‘the Agreement’), and in view of Article 41, paragraph 2 of the Convention based on Article K.3 of the Treaty on European Union, on the establishment of a European Police Office (Europol Convention, 26 July 1995), that the privileges and immunities necessary for the proper performance of the tasks of the liaison officers at Europol referred to in Article 14 and Annex 3 of the Agreement, be agreed upon as set out in the Attachment.
If this proposal is acceptable to the Embassy of the Republic of Slovenia, the Ministry of Foreign Affairs proposes that this note and the affirmative note of the Embassy of the Republic of Slovenia shall constitute an Agreement between the Kingdom of the Netherlands and the Republic of Slovenia, which shall be applied provisionally from the day on which this affirmative note has been received by the Ministry of Foreign Affairs, and which shall enter into force on the first day of the second month following the date on which the Kingdom of the Netherlands and the Republic of Slovenia have informed each other that the formalities required for the entry into force have been complied with.
The Ministry avails itself of this opportunity to renew to the Embassy of the Republic of Slovenia the assurances of its highest consideration.

Attachment
 
1. Definitions
In this Agreement:
a. “Liaison officer” means: any official stationed at Europol in accordance with Article 14 of the Agreement;
b. “Government” means the Government of the Kingdom of the Netherlands;
c. “Host State authorities” means such State, municipal or other authorities of the Kingdom of the Netherlands as may be appropriate in the context of and in accordance with the laws and customs applicable in the Kingdom of the Netherlands;
d. “Sending State” means the Republic of Slovenia;
e. “Archives of the liaison officer” means all records, correspondence, documents, manuscripts, computer and media data, photographs, films, video and sound recordings belonging to or held by the liaison officer, and any other similar material which in the unanimous opinion of the Sending State and the Government forms part of the archives of the liaison officer.
2. Privileges and immunities
1. Subject to the provisions of this Agreement, the liaison officer and members of his family who form part of his household and do not possess Dutch nationality, shall enjoy in and vis-à-vis the Kingdom of the Netherlands the same privileges and immunities as are conferred on members of the diplomatic staff by the Vienna Convention on Diplomatic Relations of 18 April 1961.
2. The immunity granted to persons mentioned in paragraph 1 of this Article shall not extend to either:
i) civil action by a third party for damages, including personal injury or death, arising from a traffic accident caused by any such person; or
ii) criminal and civil jurisdiction over acts performed outside the course of their official duties.
3. The obligations of Sending States and their personnel that apply under the Vienna Convention to members of the diplomatic staff, shall apply to the persons referred to in paragraph 1 of this Article.
3. Entry, stay and departure
1. The Government shall facilitate, if necessary, the entry, stay and departure of the liaison officer and members of his family forming part of the household.
2. This Article shall not prevent the requirement of reasonable evidence to establish that persons claiming the treatment provided for under this Article come within the classes described in paragraph 1 of this Article.
3. Visas which may be required by persons referred to in this Article shall be granted without charge and as promptly as possible.
4. Employment
Members of the family forming part of the household of the liaison officer not having the nationality of an EU Sending State shall be exempt from the obligation to obtain working permits for the duration of the secondment of the liaison officer.
5. Inviolability of archives
The archives of the liaison officer wherever located and by whomsoever held shall be inviolable.
6. Personal Protection
The Host State authorities shall, if so requested by the Sending State, take all reasonable steps in accordance with their national laws to ensure the necessary safety and protection of the liaison officer, as well as members of his family who form part of his household, whose security is endangered due to the performance of the tasks of the liaison officer at Europol.
7. Facilities and immunities in respect of communication
1. The Government shall permit the liaison officer to communicate freely and without a need for special permission, for all official purposes, and shall protect the right of the liaison officer to do so. The liaison officer shall have the right to use codes and to dispatch and receive official correspondence and other official communications by courier or in sealed bags which shall be subject to the same privileges and immunities as diplomatic couriers and bags.
2. The liaison officer shall, as far as may be compatible with the International Telecommunications Convention of 6 November 1982, for his official communications enjoy treatment not less favourable than that accorded by the Kingdom of the Netherlands to any international organisation or government, in the matter of priorities for communication by mail, cable, telegraph, telex, radio, television, telephone, fax, satellite, or other means.
8. Notification
1. The Sending State shall promptly notify the Government of the name of the liaison officer, his arrival and his final departure or the termination of his secondment as well as the arrival and final departure of the members of the family forming part of the household and, where appropriate, the fact that a person has ceased to form part of the household.
2. The Government shall issue to the liaison officer and members of his family forming part of the household, an identification card bearing the photograph of the holder. This card shall serve to identify the holder in relation to all Host State authorities.
9. Settlement of Disputes
1. Any dispute between the Sending State and the Government concerning the interpretation or application of this Agreement, or any question affecting the liaison officer or the relationship between the Sending State and the Government which is not settled amicably, shall be referred for final decision to a tribunal of three arbitrators, at the request of the Sending State or the Government. Each party shall appoint one arbitrator. The third, who shall be chairman of the tribunal, is to be chosen by the first two arbitrators.
2. If one of the parties fails to appoint an arbitrator within two months following a request from the other party to make such an appointment, the other party may request the President of the Court of Justice of the European Communities or in his absence the Vice-President, to make such an appointment.
3. Should the first two arbitrators fail to agree upon the third within two months following their appointment, either party may request the President of the Court of Justice of the European Communities, or in his absence the Vice-President, to make such appointment.
4. Unless the parties agree otherwise, the tribunal shall determine its own procedure.
5. The tribunal shall reach its decision by a majority of votes. The Chairman shall have a casting vote. The decision shall be final and binding on the Parties to the dispute.
10. Territorial scope
With respect to the Kingdom of the Netherlands, this Agreement shall apply to the part of the Kingdom in Europe only.

The Embassy of the Republic of Slovenia presents its compliments to the Ministry of Foreign Affairs of the Kingdom of the Netherlands and has the honour to acknowledge receipt of the Ministry’s Note DJZ/VE-1133/03 of 22 December 2003, which reads as follows:
“The Ministry of Foreign Affairs of Netherlands presents its compliments to the Embassy of the Republic of Slovenia and has the honour to propose, with reference to the Co-operation Agreement between the Republic of Slovenia and the European Police Office of 1 October 2001 (hereinafter ‘the Agreement’), and in view of Article 41, paragraph 2 of the Convention based on Article K.3 of the Treaty on European Union, on the establishment of a European Police Office (Europol Convention, 26 July 1995), that the privileges and immunities necessary for the proper performance of the tasks of the liaison officers at Europol referred to in Article 14 and Annex 3 of the Agreement, be agreed upon as set out in the Attachment.

The Embassy of the Republic of Slovenia has the honour to inform the Ministry of Foreign Affairs that the Government of the Republic of Slovenia agrees to the contents of the above-mentioned Note, and that the Ministry’s Note and this Note expressing the agreement of the Government of the Republic of Slovenia shall constitute an Agreement between the Kingdom of the Netherlands and the Republic of Slovenia, which shall be applied provisionally from the day on which this affirmative note has been received by the Ministry of Foreign Affairs, and which shall enter into force on the first day of the second month following the day on which both Parties have informed each other in writing that the legal requirements for entry into force have been complied with.
The Embassy of the Republic of Slovenia avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Kingdom of the Netherlands the assurances of its highest consideration.
 
Attachment
 
1. Definitions
In this Agreement:

Ministrstvo za zunanje zadeve izraža spoštovanje Veleposlaništvu Republike Slovenije in ima v zvezi s Sporazumom o sodelovanju med Republiko Slovenijo in Evropskim policijskim uradom z dne 1. oktobra 2001 (v nadaljevanju »sporazum«) ter glede na drugi odstavek 41. člena Konvencije, temelječe na členu K.3 Pogodbe o Evropski uniji, o ustanovitvi Evropskega policijskega urada (Konvencija o Europolu, 26. julij 1995) čast predlagati, da se o privilegijih in imunitetah, ki so potrebni za ustrezno izvajanje nalog uradnikov za zvezo pri Europolu po 14. členu sporazuma in Prilogi 3 k sporazumu, dogovori, kot je navedeno v prilogi.
Če je ta predlog sprejemljiv za Veleposlaništvo Republike Slovenije, Ministrstvo za zunanje zadeve predlaga, da ta nota in pritrdilna nota Veleposlaništva Republike Slovenije sestavljata sporazum med Kraljevino Nizozemsko in Republiko Slovenijo, ki se začasno uporablja od dneva, ko je Ministrstvo za zunanje zadeve prejelo to pritrdilno noto, in začne veljati prvi dan drugega meseca po datumu, ko se Kraljevina Nizozemska in Republika Slovenija obvestita, da so končani postopki, potrebni za začetek njegove veljavnosti.
 
Ministrstvo ob tej priložnosti Veleposlaništvu Republike Slovenije ponovno izraža svoje najgloblje spoštovanje.

Priloga
 
1. Pomen izrazov
V tem sporazumu:
a. »uradnik za zvezo« pomeni uradnika, ki je nameščen pri Europolu v skladu s 14. členom sporazuma;
b. »vlada« pomeni Vlado Kraljevine Nizozemske;
c. »organi države gostiteljice« pomenijo državne, mestne ali druge organe Kraljevine Nizozemske, ki so ustrezni po zakonih in običajih, ki se uporabljajo v Kraljevini Nizozemski, in so v skladu z njimi;
d. »država pošiljateljica« pomeni Republiko Slovenijo;
e. »arhiv uradnika za zvezo« pomeni vse evidence, korespondenco, dokumente, rokopise, računalniške podatke in nosilnike podatkov, fotografije, filme, videoposnetke in zvočne posnetke, ki pripadajo uradniku za zvezo ali jih ta ima, in drugo podobno gradivo, za katero država pošiljateljica in vlada soglašata, da je del arhiva uradnika za zvezo.
2. Privilegiji in imunitete
1. V skladu z določbami tega sporazuma imajo uradnik za zvezo in njegovi družinski člani, ki živijo z njim v skupnem gospodinjstvu in nimajo nizozemskega državljanstva, v Kraljevini Nizozemski in nasproti njej enake privilegije in imunitete, kakršni se podeljujejo članom diplomatskega osebja po Dunajski konvenciji o diplomatskih odnosih z dne 18. aprila 1961.
2. Imuniteta, ki se podeljuje osebam iz prvega odstavka tega člena, ne velja v primeru:
i) civilne tožbe tretje stranke za odškodnino, vključno za telesno poškodbo ali smrt, zaradi prometne nesreče, ki jo povzročijo te osebe, ali
ii) kazenske in civilne pristojnosti za dejanja, ki jih niso storile pri opravljanju svojih uradnih dolžnosti.
3. Obveznosti držav pošiljateljic in njihovega osebja, ki po dunajski konvenciji veljajo za člane diplomatskega osebja, veljajo za osebe, navedene v prvem odstavku tega člena.
3. Vstop, prebivanje in odhod
1. Vlada po potrebi olajša vstop, prebivanje in odhod uradnika za zvezo in njegovih družinskih članov, ki z njim živijo v skupnem gospodinjstvu.
2. Ta člen ne prepreči zahteve po razumnem dokazu z namenom ugotavljanja, da so osebe, ki zahtevajo obravnavo, določeno po tem členu, osebe iz prvega odstavka tega člena.
3. Vizumi, za katere zaprosijo osebe iz tega člena, se odobrijo brezplačno in kakor hitro je to mogoče.
4. Zaposlitev
Družinski člani, ki z uradnikom za zvezo živijo v skupnem gospodinjstvu in nimajo državljanstva države pošiljateljice, članice EU, so oproščeni obveznosti, da si pridobijo delovno dovoljenje med trajanjem napotitve uradnika za zvezo.
5. Nedotakljivost arhiva
Arhiv uradnika za zvezo, kjer koli je in kdor koli ga hrani, je nedotakljiv.
6. Osebna zaščita
Če jih za to zaprosi država pošiljateljica, organi države gostiteljice izvedejo vse primerne ukrepe v skladu s svojo notranjo zakonodajo, da zagotovijo potrebno varnost in zaščito uradnika za zvezo in njegovih družinskih članov, ki z njim živijo v skupnem gospodinjstvu, katerih varnost je ogrožena zaradi izvajanja nalog uradnika za zvezo pri Europolu.
7. Sredstva in imunitete v zvezi s sporazumevanjem
1. Vlada dovoli uradniku za zvezo prosto sporazumevanje za vse uradne namene, ne da bi bilo za to potrebno posebno dovoljenje, in ščiti to njegovo pravico. Uradnik za zvezo ima pravico uporabljati šifre ter pošiljati in prejemati uradno korespondenco in druga uradna sporočila po kurirju ali v zapečatenih pošiljkah, za katere veljajo enaki privilegiji in imunitete kot za diplomatske kurirje in pošiljke.
2. Pri svojem uradnem sporazumevanju je uradnik za zvezo, če je to v skladu z Mednarodno konvencijo o telekomunikacijah z dne 6. novembra 1982, deležen obravnave, ki ni manj ugodna od tiste, ki jo Kraljevina Nizozemska namenja kateri koli mednarodni organizaciji ali vladi glede prednosti pri sporazumevanju po pošti, kabelski povezavi, telegrafu, teleksu, radijskih zvezah, televiziji, telefonu, telefaksu, satelitu ali na drug način.
8. Uradno obveščanje
1. Država pošiljateljica takoj uradno obvesti vlado o imenu uradnika za zvezo, njegovem prihodu in dokončnem odhodu ali prenehanju njegove napotitve ter o prihodu in dokončnem odhodu njegovih družinskih članov, ki z njim živijo v skupnem gospodinjstvu, in kadar je to ustrezno, tudi o dejstvu, da neka oseba ne živi več v tem gospodinjstvu.
2. Vlada uradniku za zvezo in njegovim družinskim članom, ki z njim živijo v skupnem gospodinjstvu, izda identifikacijsko kartico s fotografijo imetnika. Namen te kartice je identificirati imetnika v odnosu do organov države gostiteljice.
9. Reševanje sporov
1. Vsak spor med državo pošiljateljico in vlado v zvezi z razlago ali uporabo tega sporazuma ali vsako vprašanje, povezano z uradnikom za zvezo ali odnosom med državo pošiljateljico in vlado, ki se ne reši sporazumno, se na zahtevo države pošiljateljice ali vlade predloži v končno odločitev tričlanskemu razsodišču. Vsaka stranka imenuje enega razsodnika. Tretjega, ki predseduje razsodišču, izbereta prva dva razsodnika.
2. Če ena od strank v dveh mesecih po zaprosilu druge stranke, da imenuje razsodnika, tega ne stori, lahko druga stranka zaprosi predsednika Sodišča Evropskih skupnosti ali v njegovi odsotnosti podpredsednika, da opravi to imenovanje.
3. Če se prva dva razsodnika v dveh mesecih po svojem imenovanju ne sporazumeta o tretjem, lahko katera koli stranka zaprosi predsednika Sodišča Evropskih skupnosti ali v njegovi odsotnosti podpredsednika, da opravi to imenovanje.
4. Če se stranki ne sporazumeta drugače, si razsodišče samo določi postopek.
5. Razsodišče odloči z večino glasov. Predsedujoči ima odločilni glas. Odločitev je dokončna in zavezujoča za stranki v sporu.
10. Ozemeljska veljavnost
Ta sporazum velja le za del Kraljevine Nizozemske, ki je v Evropi.

Veleposlaništvo Republike Slovenije izraža spoštovanje Ministrstvu za zunanje zadeve Kraljevine Nizozemske in ima čast potrditi prejem note ministrstva DJZ/VE-1133/03 z dne 22. decembra 2003, ki se glasi:

Veleposlaništvo Republike Slovenije ima čast obvestiti Ministrstvo za zunanje zadeve Kraljevine Nizozemske, da se Vlada Republike Slovenije strinja z vsebino zgoraj navedene note in da nota ministrstva in ta nota, ki izraža soglasje Vlade Republike Slovenije, sestavljata sporazum med Kraljevino Nizozemsko in Republiko Slovenijo, ki se začasno uporablja od dneva, ko je Ministrstvo za zunanje zadeve prejelo to pritrdilno noto, in začne veljati prvi dan drugega meseca po datumu, ko se pogodbenici pisno obvestita, da so izpolnjene pravne zahteve za začetek njegove veljavnosti.
Veleposlaništvo Republike Slovenije ob tej priložnosti Ministrstvu za zunanje zadeve Kraljevine Nizozemske ponovno izraža svoje najgloblje spoštovanje.
 
Priloga
 
1. Pomen izrazov
V tem sporazumu:
a. »uradnik za zvezo« pomeni uradnika, ki je nameščen pri Europolu v skladu s 14. členom sporazuma;
b. »vlada« pomeni Vlado Kraljevine Nizozemske;
c. »organi države gostiteljice« pomenijo državne, mestne ali druge organe Kraljevine Nizozemske, ki so ustrezni po zakonih in običajih, ki se uporabljajo v Kraljevini Nizozemski, in so v skladu z njimi;
d. »država pošiljateljica« pomeni Republiko Slovenijo;
e. »arhiv uradnika za zvezo« pomeni vse evidence, korespondenco, dokumente, rokopise, računalniške podatke in nosilnike podatkov, fotografije, filme, videoposnetke in zvočne posnetke, ki pripadajo uradniku za zvezo ali jih ta ima, in drugo podobno gradivo, za katero država pošiljateljica in vlada soglašata, da je del arhiva uradnika za zvezo.
2. Privilegiji in imunitete
1. V skladu z določbami tega sporazuma imajo uradnik za zvezo in njegovi družinski člani, ki živijo z njim v skupnem gospodinjstvu in nimajo nizozemskega državljanstva, v Kraljevini Nizozemski in nasproti njej enake privilegije in imunitete, kakršni se podeljujejo članom diplomatskega osebja po Dunajski konvenciji o diplomatskih odnosih z dne 18. aprila 1961.
2. Imuniteta, ki se podeljuje osebam iz prvega odstavka tega člena, ne velja v primeru:
i) civilne tožbe tretje stranke za odškodnino, vključno za telesno poškodbo ali smrt, zaradi prometne nesreče, ki jo povzročijo te osebe, ali
ii) kazenske in civilne pristojnosti za dejanja, ki jih niso storile pri opravljanju svojih uradnih dolžnosti.
3. Obveznosti držav pošiljateljic in njihovega osebja, ki po dunajski konvenciji veljajo za člane diplomatskega osebja, veljajo za osebe, navedene v prvem odstavku tega člena.
3. Vstop, prebivanje in odhod
1. Vlada po potrebi olajša vstop, prebivanje in odhod uradnika za zvezo in njegovih družinskih članov, ki z njim živijo v skupnem gospodinjstvu.
2. Ta člen ne prepreči zahteve po razumnem dokazu z namenom ugotavljanja, da so osebe, ki zahtevajo obravnavo, določeno po tem členu, osebe iz prvega odstavka tega člena.
3. Vizumi, za katere zaprosijo osebe iz tega člena, se odobrijo brezplačno in kakor hitro je to mogoče.
4. Zaposlitev
Družinski člani, ki z uradnikom za zvezo živijo v skupnem gospodinjstvu in nimajo državljanstva države pošiljateljice, članice EU, so oproščeni obveznosti, da si pridobijo delovno dovoljenje med trajanjem napotitve uradnika za zvezo.
5. Nedotakljivost arhiva
Arhiv uradnika za zvezo, kjer koli je in kdor koli ga hrani, je nedotakljiv.
6. Osebna zaščita
Če jih za to zaprosi država pošiljateljica, organi države gostiteljice izvedejo vse primerne ukrepe v skladu s svojo notranjo zakonodajo, da zagotovijo potrebno varnost in zaščito uradnika za zvezo in njegovih družinskih članov, ki z njim živijo v skupnem gospodinjstvu, katerih varnost je ogrožena zaradi izvajanja nalog uradnika za zvezo pri Europolu.
7. Sredstva in imunitete v zvezi s sporazumevanjem
1. Vlada dovoli uradniku za zvezo prosto sporazumevanje za vse uradne namene, ne da bi bilo za to potrebno posebno dovoljenje, in ščiti to njegovo pravico. Uradnik za zvezo ima pravico uporabljati šifre ter pošiljati in prejemati uradno korespondenco in druga uradna sporočila po kurirju ali v zapečatenih pošiljkah, za katere veljajo enaki privilegiji in imunitete kot za diplomatske kurirje in pošiljke.
2. Pri svojem uradnem sporazumevanju je uradnik za zvezo, če je to v skladu z Mednarodno konvencijo o telekomunikacijah z dne 6. novembra 1982, deležen obravnave, ki ni manj ugodna od tiste, ki jo Kraljevina Nizozemska namenja kateri koli mednarodni organizaciji ali vladi glede prednosti pri sporazumevanju po pošti, kabelski povezavi, telegrafu, teleksu, radijskih zvezah, televiziji, telefonu, telefaksu, satelitu ali na drug način.
8. Uradno obveščanje
1. Država pošiljateljica takoj uradno obvesti vlado o imenu uradnika za zvezo, njegovem prihodu in dokončnem odhodu ali prenehanju njegove napotitve ter o prihodu in dokončnem odhodu njegovih družinskih članov, ki z njim živijo v skupnem gospodinjstvu, in kadar je to ustrezno, tudi o dejstvu, da neka oseba ne živi več v tem gospodinjstvu.
2. Vlada uradniku za zvezo in njegovim družinskim članom, ki z njim živijo v skupnem gospodinjstvu, izda identifikacijsko kartico s fotografijo imetnika. Namen te kartice je identificirati imetnika v odnosu do organov države gostiteljice.
9. Reševanje sporov
1. Vsak spor med državo pošiljateljico in vlado v zvezi z razlago ali uporabo tega sporazuma ali vsako vprašanje, povezano z uradnikom za zvezo ali odnosom med državo pošiljateljico in vlado, ki se ne reši sporazumno, se na zahtevo države pošiljateljice ali vlade predloži v končno odločitev tričlanskemu razsodišču. Vsaka stranka imenuje enega razsodnika. Tretjega, ki predseduje razsodišču, izbereta prva dva razsodnika.
2. Če ena od strank v dveh mesecih po zaprosilu druge stranke, da imenuje razsodnika, tega ne stori, lahko druga stranka zaprosi predsednika Sodišča Evropskih skupnosti ali v njegovi odsotnosti podpredsednika, da opravi to imenovanje.
3. Če se prva dva razsodnika v dveh mesecih po svojem imenovanju ne sporazumeta o tretjem, lahko katera koli stranka zaprosi predsednika Sodišča Evropskih skupnosti ali v njegovi odsotnosti podpredsednika, da opravi to imenovanje.
4. Če se stranki ne sporazumeta drugače, si razsodišče samo določi postopek.
5. Razsodišče odloči z večino glasov. Predsedujoči ima odločilni glas. Odločitev je dokončna in zavezujoča za stranki v sporu.
10. Ozemeljska veljavnost
Ta sporazum velja le za del Kraljevine Nizozemske, ki je v Evropi.

Besedilo sporazuma se v izvirniku v angleškem jeziku in v prevodu v slovenskem jeziku glasi:

Za izvajanje sporazuma skrbi Ministrstvo za notranje zadeve.
4. člen
Ta uredba začne veljati petnajsti dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
