Razglašam Zakon o ratifikaciji Sporazuma med Evropsko skupnostjo in Republiko Slovenijo o sodelovanju Republike Slovenije v Evropski agenciji za okolje in evropskem okoljskem informacijskem in opazovalnem omrežju (MESEAO), ki ga je sprejel Državni zbor Republike Slovenije na seji 28. junija 2001.

RATIFIKACIJI SPORAZUMA MED EVROPSKO SKUPNOSTJO IN REPUBLIKO SLOVENIJO O SODELOVANJU REPUBLIKE SLOVENIJE V EVROPSKI AGENCIJI ZA OKOLJE IN EVROPSKEM OKOLJSKEM INFORMACIJSKEM IN OPAZOVALNEM OMREŽJU (MESEAO)
1. člen
Ratificira se Sporazum med Evropsko skupnostjo in Republiko Slovenijo o sodelovanju Republike Slovenije v Evropski agenciji za okolje in Evropskem okoljskem informacijskem in opazovalnem omrežju, sprejet s podpisom Sklepne listine v Bruslju 9. oktobra 2000.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:

pogajanj za sprejem Sporazuma med Evropsko Skupnostjo in Republiko Slovenijo o sodelovanju Republike Slovenije v Evropski agenciji za okolje in v Evropskem okoljskem informacijskem in opazovalnem omrežju
V letu 2000 so se predstavniki Republike Slovenije in Evropske komisije pogajali, da bi se sporazumeli o besedilu Sporazuma med Evropsko skupnostjo in Republiko Slovenijo o sodelovanju Republike Slovenije v Evropski agenciji za okolje in v Evropskem okoljskem informacijskem in opazovalnem omrežju ter da bi to besedilo sprejeli.
Predstavniki Evropske komisije so se pogajali na podlagi Priporočila Sveta Evropske skupnosti o pogajanjih v imenu Evropske Skupnosti o pogojih za sodelovanje držav za pristop k Evropski agenciji za okolje, z dne 14. februarja 2000.
Predstavniki Vlade Republike Slovenije in Evropske komisije so upoštevali rezultate dveh predhodnih pogajanj, ki sta bili 27. marca 2000 in 10. julija 2000 v Bruslju.
Predstavniki Vlade Republike Slovenije in Evropske komisije so potrdili izid pogajanj in sprejeli besedilo Sporazuma med Evropsko skupnostjo in Republiko Slovenijo o sodelovanju Republike Slovenije v Evropski agenciji za okolje in v Evropskem okoljskem informacijskem in opazovalnem omrežju, ki je priloženo tej Sklepni listini.
V skladu z njegovim 18. členom, bosta pogodbenici Sporazum med Evropsko skupnostjo in Republiko Slovenijo o sodelovanju Republike Slovenije v Evropski agenciji za okolje in v Evropskem okoljskem informacijskem in opazovalnem omrežju odobrili v skladu s svojimi postopki. Sporazum začne veljati prvi dan drugega meseca po datumu, ko druga pogodbenica uradno obvesti prvo pogodbenico, da je zaključila svoje postopke.
V potrditev tega so predstavniki podpisali to Sklepno listino.

S P O R A Z U M
MED EVROPSKO SKUPNOSTJO IN REPUBLIKO SLOVENIJO O SODELOVANJU SLOVENIJE V EVROPSKI AGENCIJI ZA OKOLJE IN EVROPSKEM OKOLJSKEM INFORMACIJSKEM IN OPAZOVALNEM OMREŽJU
EVROPSKA SKUPNOST na eni strani
in REPUBLIKA SLOVENIJA, v nadaljevanju “Slovenija“, na drugi strani
STA SE
OB UPOŠTEVANJU prijave Slovenije za sodelovanje v Evropski agenciji za okolje že pred pristopom,
OB SKLICEVANJU, da je Evropski svet v Luxembourgu (decembra 1997) uvedel sodelovanje v programih in agencijah Skupnosti kot način za pospeševanje predpristopne strategije za srednje- in vzhodnoevropske države,
OB UPOŠTEVANJU Uredbe Sveta 1210/901 o ustanovitvi Evropske agencije za okolje in Evropskega okoljskega informacijskega in opazovalnega omrežja, kot je bila spremenjena z Uredbo Sveta 933/19992,
OB ZAVEDANJU, da je končni cilj Slovenije postati članica Evropske unije in da bo sodelovanje v Evropski agenciji za okolje pomagalo Sloveniji doseči ta cilj,
SPORAZUMELI, KOT SLEDI:
1. člen
Slovenija polnopravno sodeluje v Evropski agenciji za okolje, v nadaljevanju ‘Agencija’, in v Evropskem okoljskem informacijskem in opazovalnem omrežju EIONET, ki sta bila ustanovljena z Uredbo Sveta (EGS) 1210/90, spremenjeno z Uredbo Sveta 933/1999.
2. člen
Slovenija finančno prispeva za dejavnosti, omenjene v 1. členu (Agencija in EIONET), v skladu z naslednjim:
– Prispevek se bo postopoma povečeval v triletnem obdobju, v katerem bo Slovenija uvajala te dejavnosti. Zahtevani finančni prispevki so:
– 1. leto 195.000 evrov
– 2. leto 246.000 evrov
– 3. leto 298.000 evrov
Od četrtega leta po začetku veljavnosti tega sporazuma mora Slovenija plačevati polni finančni prispevek, to je 298.000 evrov.
– V prvem triletnem obdobju lahko Slovenija za plačevanje prispevkov Agenciji deloma uporabi pomoč Skupnosti, pri čemer je najvišji delež sredstev Phare v prvem letu 75%, v drugem 60% in v tretjem 50%.
Od četrtega leta Slovenija celoten prispevek Agenciji krije sama.
Nadaljnja določila in pogoji o finančnem prispevku Slovenije so v Prilogi I, ki je sestavni tega sporazuma.
3. člen
Slovenija polnopravno sodeluje v Upravnem odboru Agencije, vendar brez pravice do glasovanja in sodeluje pri delu Znanstvenega odbora Agencije.
4. člen
Slovenija v treh mesecih po začetku veljavnosti tega sporazuma obvesti Agencijo o glavnih sestavnih elementih svojih državnih informacijskih omrežij, kot je določeno v drugem odstavku 4. člena Uredbe Sveta (EGS) 1210/90, spremenjene z Uredbo Sveta 933/1999.
5. člen
Slovenija med institucijami, omenjenimi v 4. členu, ali med drugimi organizacijami, ustanovljenimi na njenem ozemlju, določi nacionalno točko za koordinacijo in/ali posredovanje informacij, ki se na državni ravni zagotavljajo Agenciji in institucijam ali organom, ki sestavljajo EIONET, ter tematske centre, omenjene v 6. členu.
6. člen
Slovenija lahko v obdobju, opredeljenem v 4. členu, tudi določi institucije ali druge organizacije, ustanovljene na njenem ozemlju, ki bi jim lahko predvsem zaupala sodelovanje z Agencijo na nekaterih področjih posebnega pomena. Tako določena institucija mora biti sposobna skleniti sporazum z Agencijo, da bi lahko delovala kot tematski center omrežja za posebne naloge. Takšni centri sodelujejo z drugimi institucijami, ki so del omrežja.
7. člen
V treh mesecih po prejemu podatkov, omenjenih v 4., 5. in 6. členu, Upravni odbor Agencije pregleda glavne elemente omrežja, da oceni sodelovanje Slovenije.
8. člen
Slovenija zagotovi podatke v skladu z obveznostmi in prakso, določenimi za delo Agencije.
9. člen
Agencija se lahko strinja z institucijami ali organi, ki jih določi Slovenija in ki so del omrežja v skladu s 4., 5. in 6. členom, na podlagi potrebnih dogovorov, predvsem pogodb, za uspešno opravljanje nalog, ki jim jih zaupa.
10. člen
Okoljski podatki, ki jih dobi ali da Agencija, se lahko objavijo in so na voljo javnosti, če je v Sloveniji zagotovljena enaka stopnja varstva zaupnih podatkov kot v Skupnosti.
11. člen
Agencija je v Sloveniji pravna oseba in v Sloveniji uživa najširšo pravno sposobnost, ki jo imajo pravne osebe po zakonu.
12. člen
Slovenija za Agencijo po potrebi uporablja Protokol o privilegijih in imunitetah Evropskih skupnosti, ki je kot Priloga II sestavni del tega sporazuma.
13. člen
Ne glede na točko a) drugega odstavka 12. člena Uredbe Sveta 259/68 o kadrovskih predpisih za funkcionarje in pogojih pogodbe o zaposlitvi za druge uslužbence Evropskih skupnosti3 lahko državljane Slovenije, ki uživajo polne državljanske pravice, po pogodbi zaposli izvršni direktor Agencije.
14. člen
Pogodbenici sprejmeta vse splošne in posebne ukrepe, ki so potrebni za izpolnjevanje njihovih obveznosti po tem sporazumu. Poskrbita, da se dosežejo cilji, določeni v sporazumu.
15. člen
Ta sporazum se sklene za nedoločen čas, dokler Slovenija ne postane članica Evropske unije. Katera koli pogodbenica ga lahko odpove, tako da o tem obvesti drugo pogodbenico. Ta sporazum preneha veljati šest mesecev po datumu takšnega uradnega obvestila.
16. člen
Ta sporazum se na eni strani uporablja na ozemljih, na katerih se uporabljajo pogodbe o ustanovitvi Evropske skupnosti, Evropske skupnosti za atomsko energijo in Evropske skupnosti za premog in jeklo, in pod pogoji, določenimi v teh pogodbah, ter na drugi strani na ozemlju Slovenije.
17. člen
Ta sporazum je sestavljen v dveh izvirnikih v angleškem, danskem, finskem, francoskem, grškem, italijanskem, nemškem, nizozemskem, portugalskem, španskem, švedskem in slovenskem jeziku, pri čemer so vsa besedila enako verodostojna.
18. člen
Ta sporazum pogodbenici potrdita v skladu s svojimi postopki. Veljati začne prvi dan drugega meseca po datumu, ko sta se pogodbenici uradno obvestili, da so postopki končani.
PRILOGA I
Finančni prispevek Slovenije Evropski agenciji za okolje
1. Finančni prispevek Slovenije v proračun Evropske unije za sodelovanje v Evropski agenciji za okolje znaša:
– 1. leto sodelovanja 195.000 evrov,
– 2. leto sodelovanja 246.000 evrov,
– 3. leto sodelovanja 298.000 evrov.
Od četrtega leta mora Slovenija plačevati polni finančni prispevek, to je 298.000 evrov.
2. V prvem triletnem obdobju lahko Slovenija za plačevanje prispevkov Evropski agenciji za okolje deloma uporabi pomoč Skupnosti, pri čemer je najvišji delež sredstev Phare v prvem letu 75%, v drugem 60% in v tretjem 50%. V skladu posebnim programskim postopkom Phare se zahtevana sredstva Phare nakažejo Sloveniji na podlagi posebnega finančnega memoranduma.
Preostali del prispevka krije Slovenija. Od četrtega leta Slovenija celoten prispevek Agenciji krije sama.
3. Prispevek Slovenije se vodi v skladu s finančno uredbo, ki se uporablja za splošni proračun Evropske unije.
Potne stroške in stroške bivanja slovenskih predstavnikov in strokovnjakov, ki sodelujejo v dejavnostih ali na srečanjih Evropske agencije za okolje v zvezi z izvajanjem delovnega programa Agencije, povrne Evropska agencija za okolje na isti podlagi in po postopkih, ki veljajo za države članice Evropske unije.
4. Po začetku veljavnosti tega sporazuma in na začetku vsakega naslednjega leta Komisija pošlje Sloveniji zahtevek za sredstva v višini njenega prispevka Evropski agenciji za okolje po tem sporazumu. Za prvo koledarsko leto sodelovanja Slovenija plača prispevek, izračunan od datuma začetka sodelovanja do konca leta po načelu sorazmernosti. Njen prispevek za naslednja leta je v skladu s tem sporazumom.
5. Prispevek se izrazi v evrih in plača na bančni račun Evropske komisije, ki se vodi v evrih.
6. Slovenija svoj prispevek plačuje na podlagi zahtevka za sredstva:
svoj delež do 1. maja, če Komisija pošlje zahtevek za sredstva do 1. aprila, ali najpozneje v 30 dneh od zahtevka za sredstva;
delež sredstev Phare do 1. maja, če do tega datuma Slovenija prejme ustrezne zneske, ali najpozneje v 30 dneh po prejemu teh sredstev.
7. Za vsako zamudo pri plačilu prispevka Slovenija plača obresti za neporavnani znesek od dneva zapadlosti. Obrestna mera je enaka višini obrestne mere, ki jo na datum zapadlosti uporablja Evropska centralna banka za svoje poslovanje v evrih, povečana za 1,5 odstotne točke.
PRILOGA II
PROTOKOL O PRIVILEGIJIH IN IMUNITETAH EVROPSKIH SKUPNOSTI
VISOKE POGODBENICE SO SE
OB UPOŠTEVANJU, da v skladu z 28. členom Pogodbe o ustanovitvi skupnega sveta in skupne komisije Evropskih skupnosti te Skupnosti in Evropska investicijska banka uživajo na ozemljih držav članic take privilegije in imunitete, kot so potrebne za izvajanje njihovih nalog,
SPORAZUMELE o naslednjih določbah, ki se priložijo tej Pogodbi.
I. POGLAVJE
LASTNINA, SKLADI, PREMOŽENJE IN DELOVANJE EVROPSKIH SKUPNOSTI
1. člen
Poslovni prostori in zgradbe Skupnosti so nedotakljivi. Izvzeti so iz postopkov preiskave, prisilnega odvzema, zaplembe ali razlastitve. Za lastnino in premoženje Skupnosti ne veljajo nikakršne upravne ali pravne omejitve, ne da bi jih odobrilo Sodišče.
2. člen
Arhivi Skupnosti so nedotakljivi.
3. člen
Skupnosti, njihovo premoženje, prihodki in druga lastnina so oproščeni vseh neposrednih davkov.
Vlade držav članic, kadar je to mogoče, ustrezno ukrepajo, da bi pokrile ali povrnile znesek posrednih davkov ali prometnih davkov, vključenih v ceno premičnin ali nepremičnin, kadar Skupnosti za svoje poslovanje opravijo večje nakupe, v ceno katerih so vključeni taki davki. Vendar se te določbe ne uporabljajo, tako da bi izkrivljale konkurenco v Skupnostih.
Oprostitev ne vključuje davkov in taks za stroške javnih storitev.
4. člen
Skupnosti so oproščene vseh carinskih dajatev, prepovedi in omejitev uvoza in izvoza izdelkov za svoje poslovanje: tako uvoženih izdelki se ne smejo odtujiti za plačilo ali brezplačno na ozemlju države, v katero so bili uvoženi, razen pod pogoji, ki jih določi vlada te države.
Skupnosti so tudi oproščene vseh carinskih dajatev ter prepovedi in omejitev uvoza in izvoza za svoje publikacije.
5. člen
Evropska Skupnost za premog in jeklo ima lahko katerokoli valuto in vodi račune v katerikoli valuti.
II. POGLAVJE
KOMUNICIRANJE IN DOVOLJENJE ZA PREHOD MEJE
6. člen
Institucije Skupnosti se glede svojih uradnih sporočil in pošiljanja vseh svojih dokumentov, na ozemlju vsake države članice obravnavajo tako, kot posamezna država obravnava diplomatske misije.
Uradna korespondenca in druga uradna sporočila institucij Skupnosti se ne cenzurirajo.
7. člen
1. Dovoljenja za prehod meje v obliki, kakršno predpiše Svet in ki jih pristojni organi držav članic priznajo kot veljavne potne listine, lahko izdajo članom in uslužbencem institucij Skupnosti predsedniki teh institucij. Dovoljenja za prehod meje se izdajo funkcionarjem in drugim uslužbencem pod pogoji, ki jih določajo Kadrovski predpisi za funkcionarje in pogoji pogodbe o zaposlitvi za druge uslužbence Skupnosti.
Komisija lahko sklene sporazume, da se dovoljenja za prehod meje priznajo kot veljavne potne listine na ozemlju tretjih držav.
2. Določbe 6. člena Protokola o privilegijih in imunitetah Evropske skupnosti za premog in jeklo pa se še naprej uporabljajo za člane in uslužbence institucij, ki imajo na datum začetka veljavnosti Pogodbe dovoljenje za prehod meje iz omenjenega člena, dokler se ne začnejo uporabljati določbe prvega odstavka tega člena.
III. POGLAVJE
ČLANI EVROPSKEGA PARLAMENTA
8. člen
Prosto gibanje članov Evropskega parlamenta, ki potujejo na kraj zasedanja Evropskega parlamenta ali se vračajo, se ne sme upravno ali drugače omejevati.
Glede carinske in devizne kontrole članom Evropskega parlamenta:
a. njihova vlada odobri enake olajšave, kot jih imajo višji funkcionarji, ki potujejo v tujino na opravljanje začasnih uradnih nalog;
b. vlade drugih držav članic odobrijo enake olajšave, kot jih imajo predstavniki tujih vlad pri opravljanju začasnih uradnih nalog.
9. člen
Članov Evropskega parlamenta zaradi njihovega mnenja ali glasovanja pri opravljanju njihovih dolžnosti ni mogoče na noben način preiskovati, zadrževati ali proti njim sprožiti pravnih postopkov.
10. člen
Med sejami Evropskega parlamenta člani uživajo:
a. na ozemlju svoje države imunitete, ki jih imajo člani njihovega parlamenta;
b. na ozemlju katere koli druge države članice imuniteto pred vsemi ukrepi zadrževanja in pravnimi postopki.
Za člane imuniteta velja tudi med potovanjem na kraj zasedanja Evropskega parlamenta in vračanjem.
Imunitete ne more uveljavljati tisti član, ki ga zalotijo pri kaznivem dejanju, in imuniteta ne preprečuje Evropskemu parlamentu, da uveljavi pravico do odvzema imunitete svojemu članu.
IV. POGLAVJE
PREDSTAVNIKI DRŽAV ČLANIC, KI SODELUJEJO PRI DELU INSTITUCIJ EVROPSKIH SKUPNOSTI
11. člen
Predstavniki držav članic, ki sodelujejo pri delu institucij Skupnosti, njihovi svetovalci in tehnični strokovnjaki pri opravljanju svojih dolžnosti ter med potovanjem na kraj srečanja in vračanjem uživajo običajne privilegije, imunitete in olajšave.
Ta člen se uporablja tudi za člane svetovalnih teles Skupnosti.
V. POGLAVJE
FUNKCIONARJI IN DRUGI USLUŽBENCI EVROPSKIH SKUPNOSTI
12. člen
Na ozemlju vsake države članice funkcionarji in drugi uslužbenci Skupnosti ne glede na državljanstvo:
a. v skladu z določbami pogodb, ki se nanašajo na pravila o obveznostih funkcionarjev in drugih uslužbencev do Skupnosti na eni strani ter do pristojnosti Sodišča v sporih med Skupnostmi in njihovimi funkcionarji in drugimi uslužbenci na drugi strani, uživajo imuniteto pred pravnimi postopki za dejanja, ki jih storijo pri opravljanju uradnih dolžnosti, vključno z izrečenimi ali zapisanimi besedami. Imuniteto uživajo tudi po tem, ko prenehajo opravljati svoje dolžnosti;
b. zanje, njihove zakonce in vzdrževane družinske člane ne veljajo omejitve priseljevanja ali formalnosti za prijavo tujcev;
c. imajo glede valutnih ali deviznih predpisov iste olajšave, kot so običajne za funkcionarje mednarodnih organizacij;
d. imajo pravico, da brez carine uvozijo pohištvo in premičnine ob prvem prevzemu dolžnosti v tej državi, ter pravico, da jih ponovno brez carine izvozijo ob prenehanju opravljanja dolžnosti v tej državi, obakrat pod pogoji, ki jih določi vlada države, v kateri uveljavljajo to pravico;
e. imajo pravico, da brez carine uvozijo avtomobil za osebno uporabo, ki ga kupijo bodisi v državi, kjer so nazadnje bivali, bodisi v državi, katere državljani so, pod pogoji, ki veljajo na domačem trgu v tej državi, in ga ponovno izvozijo brez carine, obakrat pod pogoji, ki jih določi vlada te države.
13. člen
Funkcionarji in drugi uslužbenci Skupnosti so zavezanci za plačilo davka v korist Skupnosti na plače, mezde in honorarje, ki jim jih izplačajo Skupnosti v skladu s pogoji in postopki, ki jih določi Svet na predlog Komisije.
Oproščeni so nacionalnih davkov na plače, mezde in honorarje, ki jim jih izplačajo Skupnosti.
14. člen
Glede davka na dohodek, davka na premožnost in davka na dediščino ter uporabe konvencij o izogibanju dvojnega obdavčevanja sklenjenih med državami članicami Skupnosti, funkcionarje in druge uslužbence Skupnosti, ki se samo zaradi opravljanja svojih dolžnosti v službi pri Skupnosti nastanijo na ozemlju države članice, ki ni njihova matična država za obračun davka v času, ko nastopijo službo pri Skupnostih, obravnavajo v državi njihovega trenutnega bivanja in v matični državi za obračun davka, kakor da v slednji stalno bivajo, pod pogojem, da je ta članica Skupnosti. Ta določba se uporablja tudi za zakonca, če ta ne opravlja lastnega donosnega poklica, in za otroke, ki so odvisni od oseb iz tega člena in za katere te osebe skrbijo.
Premičnine, ki pripadajo osebam iz prejšnjega odstavka in so na ozemlju države na katerem te osebe bivajo, so v tej državi oproščene davka na dediščino; glede odmere takega davka se te premičnine obravnavajo, kot da so v matični državi za davčne namene, ob upoštevanju pravic tretjih držav in morebitni uporabi določb mednarodnih konvencij o dvojnem obdavčenju.
Določbe tega člena se ne uporabljajo za stalno prebivališče, pridobljeno le zaradi opravljanja dolžnosti v službi pri drugih mednarodnih organizacijah.
15. člen
Na predlog Komisije Svet soglasno določi načrt koristi socialnega zavarovanja za funkcionarje in druge uslužbence Skupnosti.
16. člen
Svet na predlog Komisije in po posvetu z drugimi ustreznimi institucijami določi kategorije funkcionarjev in drugih uslužbencev Skupnosti, za katere se v celoti ali delno uporabljajo določbe 12. člena, drugega odstavka 13. člena in 14. člena.
Imena, stopnje in nazivi funkcionarjev in drugih uslužbencev, ki so spadajo v take kategorije, se v redno sporočajo vladam držav članic.
VI. POGLAVJE
PRIVILEGIJI IN IMUNITETE MISIJ TRETJIH DRŽAV, AKREDITIRANIH V EVROPSKIH SKUPNOSTIH
17. člen
Države članice, na katerih ozemlju imajo Skupnosti sedež, podelijo običajne diplomatske imunitete in privilegije misijam tretjih držav akreditiranim v Skupnostih.
VII. POGLAVJE
SPLOŠNE DOLOČBE
18. člen
Privilegiji, imunitete in olajšave se funkcionarjem in drugim uslužbencem Skupnosti podelijo le v interesu Skupnosti.
Od vsake institucije Skupnosti se zahteva, da odvzame imuniteto, podeljena funkcionarju ali drugemu uslužbencu, če ta institucija meni, da odvzem take imunitete ni v nasprotju z interesi Skupnosti.

Členi od 12 do 15 in 18. člen se uporabljajo za člane Komisije.

Členi od 12 do 15 in 18. člen se uporabljajo za sodnike, pravobranilce, generalnega sekretarja in pravne sodelavce Sodišča ne glede na določbe 3. člena Protokolov o statutu Sodišča, ki se nanašajo na sodno imuniteto za sodnike in pravobranilce.
22. člen
Ta protokol se uporablja tudi za Evropsko investicijsko banko, za člane njenih organov, za njeno osebje in za predstavnike držav članic, ki sodelujejo v njenih dejavnostih, ne glede na določbe protokola o statutu banke.
Evropska investicijska banka je poleg tega oproščena vseh oblik obdavčenja ali podobnih obveznosti ob vsakem povečanju svojega kapitala in raznih formalnosti, ki so lahko s tem povezane v državi, v kateri ima banka svoj sedež. Prav tako ne more biti obdavčena ob razpustitvi ali likvidaciji. Dejavnosti banke in njenih organov, ki se izvajajo v skladu z njenim statutom, so tudi oproščene davka na promet.
V POTRDITEV TEGA so podpisani pooblaščenci podpisali ta protokol.

Final Act
Of the Negotiations To adopt the Agreement between the European Community and the Republic of Slovenia concerning the participation of the Republic of Slovenia to the European Environment Agency and the European Environment Information and Observation network
Representatives of the Government of the Republic of Slovenia and of the European Commission have held negotiations in the course of the year Two Thousand for the purpose of negotiating and adopting the text of an Agreement between the European Community and the Republic of Slovenia concerning the participation of the Republic of Slovenia to the European Environment Agency and the European Environment Information and Observation network.
The representatives of the European Commission prusued the above-mentioned negotiations on the basis of a Recommendation of the Council of the European Community of the negotiations, in the name of the European Community, of the conditions for participation of the accession countries in the European Environment Agency, dated the Fourteenth of February of the year Two Thousand.
The representatives of the Government of the Republic of Slovenia and of the European Commission took note of the results of two prior negotiating sessions, held in Brussels on the Twenty Seventh of March of the year Two Thousand and on the Tenth of July of the year Two Thousand.
The representatives of the Government of the Republic of Slovenia and of the European Commission endorsed the outcome of the negotiations and adopted the text of the Agreement between the European Community and the Republic of Slovenia concerning the participation of the Republic of Slovenia to the European Environment Agency and the European Environment Information and Observation network, appended to this Final Act.
In conformity with its Article 18, the Agreement between the European Community and the Republic of Slovenia concerning the participation of the Republic of Slovenia to the European Environment Agency and the European Environment Information and Observation netweork will be approved by the Parties in accordance with their own procedures. The Agreement shall then enter into force on the first day of the second month following the date on which the last Party has notified the first Party that its procedures have been completed.
IN WITNESS WHEREOF the Representatives have signed this Final Act.

A G R E E M E N T
BETWEEN THE EUROPEAN COMMUNITY AND THE REPUBLIC OF SLOVENIA CONCERNING THE PARTICIPATION OF THE REPUBLIC OF SLOVENIA TO THE EUROPEAN ENVIRONMENT AGENCY AND THE EUROPEAN ENVIRONMENT INFORMATION AND OBSERVATION NETWORK
The EUROPEAN COMMUNITY of the one part,
And the REPUBLIC OF SLOVENIA, hereinafter referred to as “Slovenia“, of the other part,
TAKING INTO ACCOUNT Slovenia´s application for participation in the European Environment Agency already before accession,
RECALLING that the Luxembourg European Council (December 1997) made participation in the Community programmes and agencies a way of stepping up the pre-accession strategy for the central and eastern European countries,
TAKING INTO ACCOUNT the Council Regulation 1210/901 as amended by Council Regulation 933/19992, on the establishment of the European Environment Agency and the European Environment Information and Observation Network,
RECOGNISING the fact that Slovenia’s ultimate objective is to become a member of the European Union, and that the participation in the European Environment Agency will help Slovenia achieve this objective,
HAVE AGREED AS FOLLOWS:
Article 1
Slovenia shall participate fully in the European Environment Agency, hereinafter referred to as the ‘Agency’, and the European Environment Information and Observation Network (EIONET), as set up in Council Regulation (EEC) No. 1210/90 amended by Council Regulation 933/1999.
Article 2
Slovenia shall contribute financially to the activities referred to under Article 1 (Agency and EIONET) in accordance to the following:
– The contribution will progressively increase in a 3-year period during which the activities will be phased in by Slovenia. The financial contributions required are:
– Year 1 € 195 000
– Year 2 € 246 000
– Year 3 € 298 000
From the fourth year of the coming into force of this Agreement Slovenia has to bear the full cost of its financial contribution, i.e. € 298 000.
– For the first 3-year period Slovenia may partially use Community assistance to pay the contribution to the Agency with a maximum of Phare contribution of 75% in year 1, 60% in year 2 and 50% in year 3.
From the fourth year the full cost of its financial contribution in the Agency shall be fully covered by Slovenia.
The further terms and conditions on the Financial Contribution of Slovenia are set out in Annex I to this Agreement, which shall form an integral part to it.
Article 3
Slovenia shall participate fully, without the right to vote, in the Agency Management Board and shall be associated with the work of the Scientific Committee of the Agency.
Article 4
Slovenia shall, within three months from the entry into force of this Agreement, inform the Agency of the main component elements of its national information networks as set out in Article 4(2) of Council Regulation (EEC) No. 1210/90 as amended by Council Regulation 933/1999.
Article 5
Slovenia shall in particular designate from among the institutions referred to in Article 4 or from among other organisations established in its territory a “national focal point” for co-ordinating and/or transmitting the information to be supplied at national level to the Agency and to the institutions or bodies forming part of the EIONET, including the topic centres referred to under Article 6.
Article 6
Slovenia may also, within the period laid down in Article 4, identify the institutions or other organisations established in its territory, which could be specifically entrusted with the task of co-operating with the Agency as regards certain topics of particular interest. An institution thus identified should be in a position to conclude an agreement with the Agency to act as a topic centre of the network for specific tasks. These centres shall co-operate with other institutions, which form part of the network.
Article 7
Within three months of receiving the information referred to in Articles 4,5 and 6, the Management Board of the Agency shall review the main elements of the network to take account of the participation of Slovenia.
Article 8
Slovenia should provide data according to the obligations and practice established in the Agency work.
Article 9
The Agency may agree with the institutions or bodies designated by Slovenia and which form part of the network, as referred to in Articles 4,5 and 6, upon the necessary arrangements, in particular contracts, for successfully carrying out the tasks which it may entrust to them.
Article 10
Environmental data supplied to or emanating from the Agency may be published and shall be made accessible to the public, provided that confidential information is afforded the same degree of protection in the Slovenia as it is afforded within the Community.
Article 11
The Agency shall have legal personality in Slovenia and it shall enjoy in Slovenia the most extensive legal capacity accorded to legal persons under its laws.
Article 12
Slovenia shall, as relevant, apply to the Agency the privileges and immunities from the Protocol of Privileges and Immunities of the European Communities, which, as annex II to this Agreement, shall form an integral part thereof.
Article 13
By way of derogation from Article 12(2)(a) of the Council Regulation 259/68 on Staff Regulations of officials and the conditions of employment of other servants of the European Communities3, nationals of Slovenia enjoying their full rights as citizens may be engaged under contract by the Executive Director of the Agency.
Article 14
The Parties shall take any general or specific measures required to fulfil their obligations under the Agreement. They shall see to it that the objectives set out in the Agreement are attained.
Article 15
This Agreement is concluded for an unlimited period until Slovenia will become a member of European Union. Either Party may denounce this Agreement by notifying the other Party. This Agreement shall cease to apply six months after the date of such notification.
Article 16
This Agreement shall apply, on the one hand, to the territories in which the Treaties establishing the European Community, the European Atomic Energy Community and the European Coal and Steel Community are applied and under the conditions laid down in those Treaties and, on the other hand, to the territory of Slovenia.
Article 17
This Agreement is drawn up in duplicate in the Danish, Dutch, English, Finnish, French, German, Italian, Spanish, Swedish, Greek, Portuguese and Slovenian languages, each of these texts being equally authentic.
Article 18
This Agreement will be approved by the Parties in accordance with their own procedures. This Agreement shall enter into force on the first day of the second month following the date on which the last Party has notified the first Party that its procedures have been completed.
ANNEX I
Financial contribution of Slovenia to the European Environment Agency
1. The financial contribution to be paid by Slovenia to the budget of the European Union to participate in the European Environment Agency will be in
– Year 1 of participation € 195 000,
– Year 2 of participation € 246 000,
– Year 3 of participation € 298 000.
From the fourth year Slovenia has to bear the full cost of its financial contribution, i.e. € 298 000.
2. For the first 3-year period Slovenia may partially use Community assistance to pay the contribution to the European Environment Agency with a maximum of Phare contribution of 75% in year 1, 60% in year 2 and 50% in year 3. Subject to a Phare separate programming procedure, the requested Phare funds will be transferred to Slovenia by means of a separate Financing Memorandum.
The remaining part of the contribution will be covered by Slovenia. From the fourth year the full cost of participation in the Agency shall be fully covered by Slovenia.
3. The contribution of Slovenia will be managed in accordance with the financial regulation applicable to the general budget of the European Union.
Travel costs and subsistence costs incurred by representatives and experts of Slovenia for the purposes of taking part in the European Environment Agency activities or meetings related to the implementation of the Agency’s work programme shall be reimbursed by the European Environment Agency on the same basis as and in accordance with the procedures currently in force for the Member States of the European Union.
4. After the entry into force of this Agreement and at the beginning of each following year, the Commission will send to Slovenia a call for funds corresponding to its contribution to the European Environment Agency under this Agreement. For the first calendar year of its participation Slovenia will pay a contribution calculated from the date of participation to the end of the year on a pro rata basis. For the following years the contribution will be in accordance to this Agreement.
5. This contribution shall be expressed in EURO and paid into an EURO bank account of the European Commission.
6. Slovenia will pay its contribution according to the call for funds:
For its own part by 1 May provided that the call for funds is sent by the Commission before 1 April, or at the latest in a period of 30 days after the call for funds is sent.
For the Phare part by 1 May provided that the corresponding amounts have been sent to Slovenia by this time, or at the latest in a period of 30 days after these funds have been sent to Slovenia.
7. Any delay in the payment of the contribution shall give rise to the payment of interest by Slovenia on the outstanding amount from the due date. The interest rate corresponds to the rate applied by the European Central Bank, on the due date, for its operations in EURO, increased by 1.5 percentage points.
ANNEX II
PROTOCOL ON THE PRIVILEGES AND IMMUNITIES OF THE EUROPEAN COMMUNITIES
THE HIGH CONTRACTING PARTIES,
CONSIDERING that, in accordance with Article 28 of the Treaty establishing a Single Council and a Single Commission of the European Communities, these Communities and the European Investment Bank shall enjoy in the territories of the Member States such privileges and immunities as are necessary for the performance of their tasks,
HAVE AGREED upon the following provisions, which shall be annexed to this Treaty.
CHAPTER I
PROPERTY, FUNDS, ASSETS AND OPERATIONS OF THE EUROPEAN COMMUNITIES
Article 1
The premises and buildings of the Communities shall be inviolable. They shall be exempt from search, requisition, confiscation or expropriation.
The property and assets of the Communities shall not be the subject of any administrative or legal measure of constraint without the authorization of the Court of Justice.
Article 2
The archives of the Communities shall be inviolable.
Article 3
The Communities, their assets, revenues and other property shall be exempt from all direct taxes.
The governments of the Member States shall, wherever possible, take the appropriate measures to remit or refund the amount of indirect taxes or sales taxes included in the price of movable or immovable property, where the Communities make, for their official use, substantial purchases the price of which includes taxes of this kind. These provisions shall not be applied, however, so as to have the effect of distorting competition within the Communities.
No exemption shall be granted in respect of taxes and dues which amount merely to charges for public utility services.
Article 4
The Communities shall be exempt from all customs duties, prohibitions and restrictions on imports and exports in respect of articles intended for their official use: articles so imported shall not be disposed of, whether or not in return for payment, in the territory of the country into which they have been imported, except under conditions approved by the government of that country.
The Communities shall also be exempt from any customs duties and any prohibitions and restrictions on import and exports in respect of their publications.
Article 5
The European Coal and Steel Community may hold currency of any kind and operate accounts in any currency.
CHAPTER II
COMMUNICATIONS AND LAISSEZ PASSER
Article 6
For their official communications and the transmission of all their documents, the institutions of the Communities shall enjoy in the territory of each Member State the treatment accorded by that State to diplomatic missions.
Official correspondence and other official communications of the institutions of the Communities shall not be subject to censorship.
Article 7
1. Laissez passer in a form to be prescribed by the Council, which shall be recognized as valid travel documents by the authorities of the Member States, may be issued to members and servants of the institutions of the Communities by the Presidents of these institutions. These laissez passer shall be issued to officials and other servants under conditions laid down in the Staff Regulations of officials and the Conditions of Employment of other servants of the Communities.
The Commission may conclude agreements for these laissez passer to be recognized as valid travel documents within the territory of third countries.
2. The provisions of Article 6 of the Protocol on the privileges and immunities of the European Coal and Steel Community shall, however, remain applicable to members and servants of the institutions who are at the date of entry into force of this Treaty in possession of the laissez passer provided for in that Article, until the provisions of paragraph 1 of this Article are applied.
CHAPTER III
MEMBERS OF THE EUROPEAN PARLIAMENT
Article 8
No administrative or other restriction shall be imposed on the free movement of Members of the European Parliament travelling to or from the place of meeting of the European Parliament.
Members of the European Parliament shall, in respect of customs and exchange control, be accorded:
a. by their own government, the same facilities as those accorded to senior officials travelling abroad on temporary official missions;
b. by the government of other Member States, the same facilities as those accorded to representatives of foreign governments on temporary official missions.
Article 9
Members of the European Parliament shall not be subject to any form of inquiry, detention or legal proceedings in respect of opinions expressed or votes cast by them in the performance of their duties.
Article 10
During the sessions of the European Parliament, its Members shall enjoy:
a. in the territory of their own State, the immunities accorded to members of their parliament;
b. in the territory of any other Member State, immunity from any measure of detention and from legal proceedings.
Immunity shall likewise apply to Members while they are travelling to and from the place of meeting of the European Parliament.
Immunity cannot be claimed when a Member is found in the act of committing an offence and shall not prevent the European Parliament from exercising its right to waive the immunity of one of its Members.
CHAPTER IV
REPRESENTATIVES OF MEMBER STATES TAKING PART IN THE WORK OF THE INSTITUTIONS OF THE EUROPEAN COMMUNITIES
Article 11
Representatives of Member States taking part in the work of the institutions of the Communities, their advisers and technical experts shall, in the performance of their duties and during their travel to and from the place of meeting, enjoy the customary privileges, immunities and facilities.
This Article shall also apply to members of the advisory bodies of the Communities.
CHAPTER V
OFFICIALS AND OTHER SERVANTS OF THE EUROPEAN COMMUNITIES
Article 12
In the territory of each Member State and whatever their nationality, officials and other servants of the Communities shall:
a. subject to the provisions of the Treaties relating, on the one hand, to the rules on the liability of officials and other servants towards the Communities and, on the other hand, to the jurisdiction of the Court in disputes between the Communities and their officials and other servants, be immune from legal proceedings in respect of acts performed by them in their official capacity, including their words spoken or written. They shall continue to enjoy this immunity after they have ceased to hold office;
b. together with their spouses and dependent members of their families, not be subject to immigration restrictions or to formalities for the registration of aliens;
c. in respect of currency or exchange regulations, be accorded the same facilities as are customarily accorded to officials of international organizations;
d. enjoy the right to import free of duty their furniture and effects at the time of first taking up their post in the country concerned, and the right to re export free of duty their furniture and effects, on termination of their duties in that country, subject in either case to the conditions considered to be necessary by the government of the country in which this right is exercised;
e. have the right to import free of duty a motor car for their personal use, acquired either in the country of their last residence or in the country of which they are nationals on the terms ruling in the home market in that country, and to re export it free of duty, subject in either case to the conditions considered to be necessary by the government of the country concerned.
Article 13
Officials and other servants of the Communities shall be liable to a tax for the benefit of the Communities on salaries, wages and emoluments paid to them by the Communities, in accordance with the conditions and procedure laid down by the Council, acting on a proposal from the Commission.
They shall be exempt from national taxes on salaries, wages and emoluments paid by the Communities.
Article 14
In the application of income tax, wealth tax and death duties and in the application of conventions on the avoidance of double taxation concluded between Member States of the Communities, officials and other servants of the Communities who, solely by reason of the performance of their duties in the service of the Communities, establish their residence in the territory of a Member State other than their country of domicile for tax purposes at the time of entering the service of the Communities, shall be considered, both in the country of their actual residence and in the country of domicile for tax purposes, as having maintained their domicile in the latter country provided that it is a member of the Communities. This provision shall also apply to a spouse, to the extent that the latter is not separately engaged in a gainful occupation, and to children dependent on and in the care of the persons referred to in this Article.
Movable property belonging to persons referred to in the preceding paragraph and situated in the territory of the country where they are staying shall be exempt from death duties in that country; such property shall, for the assessment of such duty, be considered as being in the country of domicile for tax purposes, subject to the rights of third countries and to the possible application of provisions of international conventions on double taxation.
Any domicile acquired solely by reason of the performance of duties in the service of other international organizations shall not be taken into consideration in applying the provisions of this Article.
Article 15
The Council shall, acting unanimously on a proposal from the Commission, lay down the scheme of social security benefits for officials and other servants of the Communities.
Article 16
The Council shall, acting on a proposal from the Commission and after consulting the other institutions concerned, determine the categories of officials and other servants of the Communities to whom the provisions of Article 12, the second paragraph of Article 13, and Article 14 shall apply, in whole or in part.
The names, grades and addresses of officials and other servants included in such categories shall be communicated periodically to the governments of the Member States.
CHAPTER VI
PRIVILEGES AND IMMUNITIES OF MISSIONS OF THIRD COUNTRIES ACCREDITED TO THE EUROPEAN COMMUNITIES
Article 17
The Member State in whose territory the Communities have their seat shall accord the customary diplomatic immunities and privileges to missions of third countries accredited to the Communities.
CHAPTER VII
GENERAL PROVISIONS
Article 18
Privileges, immunities and facilities shall be accorded to officials and other servants of the Communities solely in the interests of the Communities.
Each institution of the Communities shall be required to waive the immunity accorded to an official or other servant wherever that institution considers that the waiver of such immunity is not contrary to the interests of the Communities.
Article 19
The institutions of the Communities shall, for the purpose of applying this Protocol, cooperate with the responsible authorities of the Member States concerned.
Article 20
Articles 12 to 15 and Article 18 shall apply to Members of the Commission.
Article 21
Articles 12 to 15 and Article 18 shall apply to the Judges, the Advocates General, the Registrar and the Assistant Rapporteurs of the Court of Justice, without prejudice to the provisions of Article 3 of the Protocols on the Statute of the Court of Justice concerning immunity from legal proceedings of Judges and Advocates General.
Article 22
This Protocol shall also apply to the European Investment Bank, to the members of its organs, to its staff and to the representatives of the Member States taking part in its activities, without prejudice to the provisions of the Protocol on the Statute of the Bank.
The European Investment Bank shall in addition be exempt from any form of taxation or imposition of a like nature on the occasion of any increase in its capital and from the various formalities which may be connected therewith in the State where the Bank has its seat. Similarly, its dissolution or liquidation shall not give rise to any imposition. Finally, the activities of the Bank and of its organs carried on in accordance with its Statute shall not be subject to any turnover tax.
