O RAZGLASITVI ZAKONA O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO HELENSKE REPUBLIKE O ZNANSTVENEM IN TEHNOLOŠKEM SODELOVANJU (BGRZTS)
Razglašam Zakon o ratifikaciji Sporazuma med Vlado Republike Slovenije in Vlado Helenske republike o znanstvenem in tehnološkem sodelovanju (BGRZTS), ki ga je sprejel Državni zbor Republike Slovenije na seji 23. marca 2000.

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO HELENSKE REPUBLIKE O ZNANSTVENEM IN TEHNOLOŠKEM SODELOVANJU (BGRZTS)
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Helenske republike o znanstvenem in tehnološkem sodelovanju, podpisan 10. novembra 1999 v Ljubljani.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:*
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN VLADO HELENSKE REPUBLIKE O ZNANSTVENEM IN TEHNOLOŠKEM SODELOVANJU
Vlada Republike Slovenije in Vlada Helenske republike, v nadaljevanju pogodbenici, sta se,
ker se zavedata pomena znanosti in tehnologije za razvoj nacionalnih gospodarstev in izboljšanje družbeno-ekonomskega življenjskega standarda,
v želji okrepiti in razviti znanstveno in tehnološko sodelovanje na podlagi enakega obravnavanja in obojestranske koristi,
upoštevajoč Sporazum med Vlado Republike Slovenije in Vlado Republike Grčije o sodelovanju v kulturi, izobraževanju in znanosti, ki je bil podpisan v Ljubljani dne 10. novembra 1993,
sporazumeli, kot sledi:
1. člen
Pogodbenici v skladu z določbami tega sporazuma in zakoni in predpisi vsake pogodbenice spodbujata in podpirata sodelovanje na področju znanosti in tehnologije na podlagi obojestranske koristi.
2. člen
Sodelovanje vključuje predvsem naslednje oblike:
a) izvajanje skupnih raziskovalnih, razvojnih in ciljnih projektov, vključno z izmenjavo rezultatov in znanstvenikov, raziskovalcev in tehničnih strokovnjakov;
b) organizacijo in udeležbo na srečanjih, konferencah, simpozijih, tečajih, delavnicah, razstavah, itd.;
c) izmenjavo znanstvenih in tehnoloških informacij in dokumentacije ter opreme in potrošnega materiala;
d) skupno uporabo raziskovalnih in razvojnih zmogljivosti in znanstvene opreme;
e) druge, sporazumno dogovorjene oblike.
3. člen
1. Za izvajanje tega sporazuma se ustanovi Skupna komisija, ki jo sestavljajo predstavniki, ki jih imenujeta obe pogodbenici. Pogodbenici druga drugo uradno obvestita o svojih predstavnikih v Skupni komisiji.
2. Naloge Skupne komisije so:
a) opredeliti področja sodelovanja na podlagi informacij ustanov vsake države in nacionalnih politik za znanost in tehnologijo;
b) ustvariti ugodne pogoje za izvajanje tega sporazuma;
c) omogočiti in podpreti izvajanje skupnih programov in projektov;
d) preučiti napredek pri dejavnostih v zvezi s tem sporazumom;
e) izmenjati izkušnje, ki izhajajo iz dvostranskega znanstvenega in tehnološkega sodelovanja, ter preučiti predloge za nadaljnji razvoj tega sodelovanja.
3. Skupna komisija se, če ni drugače dogovorjeno, sestane vsake 2 (dve) leti, izmenično v Republiki Sloveniji in Helenski republiki, sklene in podpiše protokole, ki vsebujejo oceno preteklih in tekočih dejavnosti, cilje prihodnjega sodelovanja ter seznam obojestransko sprejetih projektov sodelovanja, po prejetju ocene skupnih predlogov.
4. Skupna komisija lahko sestavi svoj poslovnik.
4. člen
Da bi pospešili znanstveno in tehnološko sodelovanje, Skupna komisija v protokolu sprejme Izvršilni program. Izvršilni program opredeli:
a) področja sodelovanja;
b) določene projekte;
c) ustanove, pristojne za realizacijo in izvajanje skupnih projektov, v nadaljevanju »sodelujoči partnerji«, še posebej: vladne agencije, znanstvene subjekte, raziskovalne in razvojne subjekte, znanstvena združenja in druge organizacijske enote, vključno z zasebnimi in javnimi družbami. Izraz sodelujoči partnerji v skladu s pravom vsake pogodbenice opredeli Skupna komisija;
d) načine uporabe rezultatov skupnih raziskovalnih in razvojnih projektov;
e) finančna sredstva in pogoje;
f) pravila in postopke, ki veljajo za izvrševanje skupnih projektov.
5. člen
1. Znanstveni in tehnološki rezultati in vse druge informacije, ki izhajajo iz dejavnosti sodelovanja po tem sporazumu se zavarujejo, objavijo ali poslovno izkoristijo s privolitvijo obeh sodelujočih partnerjev in v skladu z mednarodnimi konvencijami in zakoni pogodbenic o intelektualni lastnini.
2. K udeležbi pri projektih in programih, ki se izvajajo po tem sporazumu, se s privolitvijo obeh sodelujočih partnerjev lahko povabi znanstvenike, raziskovalce, tehnične strokovnjake in ustanove tretjih držav ali mednarodne organizacije. Stroške takšne udeležbe običajno nosi tretja stran,če se pogodbenici pisno ne sporazumeta drugače.
6. člen
Vsa vprašanja v zvezi z razlago ali izvajanjem tega sporazuma se razrešijo s posvetovanjem v okviru Skupne komisije ali med pogodbenicama.
7. člen
V zvezi s sodelovanjem po tem sporazumu vsaka pogodbenica sprejme v skladu s svojimi zakoni in predpisi vse potrebne ukrepe za zagotavljanje najboljših možnih pogojev za izvajanje teh dejavnosti.
8. člen
V zvezi s sodelovanjem po tem sporazumu vsaka pogodbenica ob upoštevanju svojih mednarodnih obveznosti, notranjih zakonov in predpisov, predvsem glede ekonomske integracije, carinske unije in drugih ekonomskih vprašanj ter na podlagi vzajemnosti:
a) ukrepa s svojimi nacionalnimi organi, da bi omogočila lažji vstop in izhod s svojega ozemlja ustreznemu osebju in opremi druge pogodbenice, ki se uporablja pri projektih in programih po tem sporazumu;
b) v skladu z veljavnimi predpisi omogoči brezcarinski vstop in izhod za ves potrebni material in opremo, ki se zagotovi v skladu s tem sporazumom za uporabo pri skupnih dejavnostih.
9. člen
Ta sporazum ne vpliva na ali ne posega v veljavnost ali izvršitev katerihkoli obveznosti, ki izhajajo iz drugih mednarodnih pogodb ali sporazumov, ki jih je sklenila ena ali druga pogodbenica, vključno s tistimi, ki izhajajo iz Evropske unije.
10. člen
1. Ta sporazum začne veljati na dan, ko pogodbenici uradno obvestita druga drugo, da je bil sporazum sprejet v skladu z ustreznimi pravnimi postopki vsake države, ko se ti zaključijo. Dan zadnjega uradnega obvestila se šteje za dan začetka veljavnosti tega sporazuma.
2. Ta sporazum velja pet let in se njegova veljavnost avtomatično podaljšuje za nadaljnja petletna obdobja, če ena ali druga pogodbenica uradno pisno ne obvesti druge pogodbenice o svoji nameri prekiniti ta sporazum. Sporazum preneha veljati šest mesecev po dnevu omenjenega uradnega obvestila.
3. Prenehanje veljavnosti tega sporazuma ne vpliva na projekte ali programe, ki izhajajo iz tega sporazuma in ob prenehanju veljavnosti tega sporazuma niso v celoti izvedeni.
4. Z dnem začetka veljavnosti tega sporazuma v odnosih med Republiko Slovenijo in Helensko republiko preneha veljati Sporazum med Socialistično federativno republiko Jugoslavijo in Republiko Grčijo o izmenjavi znanstveno raziskovalnih delavcev, podpisan 17. aprila 1976 v Beogradu.
11. člen
Organa, imenovana za izvajanje tega sporazuma, sta Ministrstvo za znanost in tehnologijo Republike Slovenije in Ministrstvo za razvoj Helenske republike, Generalni sekretariat za raziskave in tehnologijo.
Sestavljeno in podpisano v Ljubljani dne 10. novembra 1999, v slovenskem, grškem in angleškem jeziku, vsa besedila so enako verodostojna. Ob razlikah v razlagi je odločilno angleško besedilo.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE HELLENIC REPUBLIC ON SCIENTIFIC AND TECHNOLOGICAL CO-OPERATION
The Government of the Republic of Slovenia and the Government of the Hellenic Republic hereinafter referred to as »The Contracting Parties«,
Recognizing the importance of science and technology in the development of their national economies and in the improvement of their socio-economic standards of life,
Wishing to strengthen and develop scientific and technological co-operation on the basis of equality and mutual benefit,
Taking in consideration the Agreement between the Government of the Republic of Slovenia and the Government of the Hellenic Republic on Cooperation in the Fields of Education, Culture and Science, signed in Ljubljana on 10 November 1993,
Have agreed as follows:
ARTICLE I
The Contacting Parties shall encourage and support the co-operation in the field of science and technology on the basis of mutual benefit, according to the provisions of the present Agreement and the laws and regulations of each Party.
ARTICLE II
The co-operation will have in particular the following forms:
a/ realisation of joint research, development and design projects, including the exchange of their results, as well as exchange of scientists, researchers and technical experts;
b/ organisation of and participation in meetings, conferences, symposia, courses, workshops, exhibitions, etc.;
c/ exchange of scientific and technological information and documentation as well as equipment and consumable materials;
d/ joint use of research and development facilities and scientific equipment;
e/ other, mutually agreed upon.
ARTICLE III
1. For the purpose of implementation of the present Agreement, a Joint Commission, composed of representatives designated by the two Contracting Parties, is established.
2. The tasks of the Joint Commission shall be as follows:
a/ identify the fields of co-operation on the basis of information received from institutions of each country and the respective national policies in science and technology;
b/ create the favourable conditions for the implementation of the present Agreement,
c/ facilitate and support the implementation of joint programmes and projects,
d/ examine the progress of activities related to the present Agreement,
e/ exchange of experience arising from the bilateral scientific and technological co-operation and the examination of the proposals for its further development.
3. The Joint Commission will meet at least once every 2 (two) years, unless otherwise agreed, alternately in the Republic of Slovenia and in the Hellenic Republic, and will conclude and sign Protocols containing the evaluation of the past and current activities and future purposes of co-operation as well as the list of mutually accepted projects of co-operation after evaluation of the joint proposals received.
4. The Joint Commission may elaborate its own rules of procedure.
ARTICLE IV
With a view to facilitate scientific and technological co-operation, the Joint Commission will adopt in the Protocol an Executive Programme. The Executive Programmes will establish:
a/ fields of co-operation;
b/ specific projects;
c/ institutions responsible for the realisation and implementation of joint projects, hereinafter referred to as “co-operating partners”, in particular: governmental agencies, scientific entities, research and development entities, scientific associations, and other organisational units including private and public companies. Definition of co-operating partners, according to the law of each Contracting Party will be performed by the Joint Commission,
d/ ways of use of joint research and development projects results;
e/ financial resources and conditions;
f/ rules and procedures guiding the execution of the joint projects.
ARTICLE V
1. Scientific and technological results and any other information derived from the co-operation activities under the present Agreement, will be insured, published or commercially exploited with the consent of both co-operating partners and according to the international conventions and laws of the Contracting Parties concerning intellectual property.
2. Scientists, researchers, technical experts and institutions of the third countries or international organisations may be invited, upon consent of both co-operating partners, to participate in projects and programmes being carried out under the present Agreement. The cost of such participation shall normally be borne by the Third Party, unless the Contracting Parties agree otherwise in writing.
ARTICLE VI
Any questions related to the interpretation or implementation of the present Agreement shall be settled through consultations within the Joint Commission or between the Contracting Parties.
ARTICLE VII
With respect to the co-operation established under the present Agreement, each Contracting Party shall take, in accordance with its laws and regulations, all necessary measures to ensure the best possible conditions for its implementation.
ARTICLE VIII
With respect to co-operation under the present Agreement, each Contracting Party, subject to its international obligations, national laws and regulations especially regarding economic integration, customs union and other economic issues and on the basis of reciprocity shall endeavour to:
a/ take steps with its national authorities to facilitate the entry into and exit from its territory of appropriate personnel and equipment of the other Contracting Party used in projects and programmes under the present Agreement;
b/ facilitate, according to regulations in force, duty free entry and exit for necessary materials and equipment provided pursuant to the present Agreement for use in joint activities.
ARTICLE IX
The present Agreement shall not affect or will not prejudice the validity or execution of any obligations arising from other international treaties or agreements concluded by either Contracting Party, including those arising from the European Union.
ARTICLE X
1. The present Agreement shall enter into force on the date when the Contracting Parties notify each other that the Agreement has been approved in accordance with the relevant legal procedures of each country, when completed. The date of the last notification is deemed to be the date of the coming into force of the present Agreement.
2. The present Agreement shall remain in force for a period of five years and shall automatically be renewed for further periods of five years, unless either Contracting Party notifies in writing its intentions to terminate the present Agreement. The termination will come into effect in six months from the date of the said notification.
3. The termination of the present Agreement shall not affect projects or programmes undertaken under the present Agreement and not fully executed at the time of the termination of the present Agreement.
4. Upon the entry into force of the present Agreement, the Agreement on the Exchange of Scientists and Researchers between the Socialist Federal Republic of Yugoslavia and the Hellenic Republic signed on 17 April 1976 in Belgrade shall cease to have effect in relations between the Republic of Slovenia and the Hellenic Republic.
ARTICLE XI
Authorities nominated for the implementation of the present Agreement are the Ministry of Science and Technology of the Republic of Slovenia and the Ministry for Development of the Hellenic Republic, General Secretariat for Research and Technology.
Done in Ljubljana on 10 November 1999 in duplicate in Slovene, Greek and English languages, all the texts being equally authentic. In the case of any divergence in interpretation the English text shall prevail.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za znanost in tehnologijo.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
