BETWEEN THE MINISTRY OF DEFENCE OF THE REPUBLIC OF SLOVENIA AND THE SUPREME HEADQUARTERS ALLIED POWERS EUROPE (SHAPE) REGARDING THE PROVISION OF HOST NATION LOGISTICS SUPPORT DURING THE EXERCISE COOPERATIVE ADVENTURE EXCHANGE 98
PREAMBLE
NOTING THAT Exercise Cooperative Adventure Exchange is to be conducted in the Framework of Partnership for Peace in the Republic of Slovenia, from 14 to 28 November 1998;
IN RECOGNITION OF THE CONCEPT BEHIND the deployment of the Land Component of Allied Command Europe Mobile Force (AMF(L)) and the deployment of all forces in support of the exercise;
HAVING REGARD TO the Republic of Slovenia, hereafter called the Host Nation (HN), and the Supreme Headquarters Allied Powers Europe (SHAPE), duly represented by the Commander, Allied Forces Southern Europe;
AND IN CONSIDERATION OF the needs of the LANDSOUTH, AMF(L) and all Participants to be supported logistically by the Host Nation when so deployed in its territory,
NOW THEREFORE, THE HOST NATION AND SHAPE, (HEREINAFTER THE PARTIES), AGREE AS FOLLOWS:
SECTION ONE
DEFINITIONS.
1-1 The Participants: Land Component of The Allied Command Europe Mobile Force (Land) (AMF(L)) and all of those land forces assigned by member States of NATO to deploy within the territory of Slovenia under the Operational Control (OPCON) of the Commander AMF(L) (COMAMF(L)); the personnel of member states participating on behalf of HQ Allied Land Forces Southern Europe (hereinafter “LANDSOUTH“) or HQ Allied Forces Southern Europe (hereinafter “AFSOUTH“) the personnel of non-NATO states whose governments have ratified the Partnership for Peace Agreement.
1-2 Host Nation Support (HNS). HNS is defined as the civil and military assistance rendered by the HN to the LANDSOUTH, AMF(L) or participating force personnel when deployed in, or in transit through, the HN territory, for the purposes of Exercise Co-operative Adventure Exchange 98.
1-3 Obligatory Co-operation is defined as: “Commanders or military leaders between whom no institutional status of subordination exists and who are to co-operate in a special way are specifically directed by order to co-operate. Co-operation includes the obligation to inform, advise and support each other in all matters where joint execution is required by military necessity.“

2-1 The North Atlantic Treaty signed in Washington, D.C., on 4 April 1949.
2-2 The Agreement between the Parties to the North Atlantic Treaty regarding the Status of their Forces (signed in London on 19 June 1951), hereafter called for short “NATO SOFA“, and the Protocol on the Status of International Military Headquarters set up pursuant to the North Atlantic Treaty, signed in Paris on 28 August 1952, hereafter called for short “The Paris Protocol“.
2-3 The Agreement among the States Parties to the North Atlantic Treaty and the Other States Participating in the Partnership for Peace regarding the Status of their Forces, and additional Protocol thereto signed in Brussels on 19 Jun 1995.
SECTION THREE
PURPOSE AND SCOPE.
3-1 This Memorandum of Understanding (MOU) identifies the requirements and procedures for providing and securing HN logistics support to LANDSOUTH, AMF(L) and the forces of the Participants during Exercise Co-operative Adventure Exchange 98. It will not conflict with Slovenian law nor any international agreement which might be in force. If conflicts are discovered, however, the interested agencies, states and forces will be notified and the current international agreements will prevail.
3-2 The Host Nation Support (HNS) covered in this MOU will begin with the entry of initial personnel or equipment of LANDSOUTH, AMF(L) or participating forces into the territory of the Republic of Slovenia and will continue until the last components of LANDSOUTH, AMF(L) or participating forces depart Slovenia. HNS for the Participants will especially be rendered in accordance with the respective Annexes.
SECTION FOUR
RESPONSIBILITIES OF THE HOST NATION.
4-1 Upon initiation of the exercise, the HN will authorise the participating forces to move to designated areas of operations as quickly as circumstances will permit.
4-2 The Slovenian Government, as HN, will take all measures necessary to facilitate the movement of personnel, vehicles, equipment and stores from the Points of Entry (POE) to the areas of operations, including the use by the participating forces of Slovenian National Air Routes, Slovenian National Railways, and Slovenian national roads.
4-3 Subject to paragraphs 4-6 and 4-7, the HN will afford the Participants such port facilities and airports as were agreed prior to the commencement of the exercise as necessary to ensure speedy embarkation or debarkation of the personnel and their equipment, including the import or export of materials.
4-4 The HN will authorise participants to carry individual arms and ammunition in transit or in exercise area within Slovenia in accordance with security measures agreed between the HN and COMAMF(L) on behalf of all participating forces.
4-4.1 The Participants and the Republic of Slovenia acknowledge that it is the responsibility of the Republic of Slovenia to provide protection for the Participating forces and their equipment.
4-4.2 The Participants and the Republic of Slovenia acknowledge that the participating forces have the inherent right to employ force in self-defence.
4-5 A Host Nation Support Unit (HNSU) will be provided to supplement the logistic assets of the participating forces, and to provide security and intelligence assistance (see Annex A).
4-6 The HN will provide such supplies and services as are agreed upon by negotiation between Slovenian Ministry of Defence and AMF(L) or Landsouth, either on their own behalf or on behalf of participating forces, and prior to the exercise as detailed in this MOU and its Annexes. By contributing personnel to this exercise, participating nations acknowledge that they are bound by the full terms of this MOU, and that COMAMF-L may act as their agent for the purpose of negotiating contact terms, technical arrangements, or other such provisions as may be provided by the host nation to the participating force.
4-7 Where the HN cannot provide such supplies from its Military or Governmental resources, the HN agrees to render such assistance as necessary to enable AMF(L), on behalf of all participating forces, or LANDSOUTH to obtain the necessary supplies or services at the most advantageous prices from commercial sources within Slovenia.
4-8 The HN shall not arrange for support or services from commercial sources on behalf of the AMF(L)/Landsouth or any participating party, unless specifically requested by the AMF(L) or Landsouth.
4-9 The HNS as agreed in this MOU will be provided through, and in co-ordination with, the HNSU. Any problems with the provision of support from Slovenian military sources will be solved by the HNSU within its level of responsibility. The HNSU will also assist in solving all other problems; e.g., the exercise of criminal jurisdiction as per the provisions of Article VII of the NATO SOFA and Article IVa of the Paris Protocol, and the settlement of claims per Article VIII of the NATO SOFA.
4-10 Any request for additional support outside the scope of this MOU will be discussed between The Ministry of Defence of the Republic of Slovenia (Slovenia MOD) and HQ AMF(L), HQ LANDSOUTH, or the requesting Participant, and resolved by mutual agreement.
4-11 The Parties acknowledge that among the participating forces are those of NATO member states that have not ratified the Partnership for Peace Status of Forces Agreement, and those of non-NATO member states who have ratified that Partnership for Peace Status of Forces Agreement. The Republic of Slovenia acknowledges that it will accord the personnel of all participants the status, rights, benefits, immunities and privileges accorded under the Partnership for Peace Status of Forces Agreement to the personnel of signatory nations. The Republic of Slovenia will make no distinction between Sending States, and accord to all sending states the rights, privileges and immunities preserved to sending states under the Partnership for Peace Status of Forces Agreement, and the NATO Status of Forces Agreement, and will endeavor to extend to all Participants the rights, privileges and benefits accorded under the Paris Protocol.
SECTION FIVE
RESPONSIBILITIES OF PARTICIPANTS
5-1 The Personnel of the Participants will respect Slovenian legislation, criminal and civil laws. The Participants will conduct their operations in accordance with the Exercise Operation Orders (OPORDER).
5-2 AMF(L) will reimburse the HN for all supplies requested by AMF(L) and rendered by the HNSU, save for those items provided at no cost or on loan. Any item loaned to AMF(L) will be returned to the HNSU prior to departure from Slovenia. Loan items will be used with care and returned to the HN in the same condition in which they were received, except for wear and tear encountered during normal use.
5-3 LANDSOUTH will reimburse the HN for all supplies requested by LANDSOUTH and rendered by the HNSU, save for those items provided at no cost or on loan. Any item loaned to LANDSOUTH will be returned to the HNSU prior to departure from Slovenia. Loan items will be used with care and returned to the HN in the same condition in which they were received, except for wear and tear encountered during normal use.
5-4 Subject to the provisions of paragraph 4-7 above, negotiation of commercial contracts for the Participants is an AMF(L) responsibility. LANDSOUTH may negotiate on its own behalf with the Republic of Slovenia.
SECTION SIX
FINANCIAL PROVISIONS. (See Reference 2-2 and 2-3)
6-1 Costs of services and supplies requested by AMF(L), or LANDSOUTH and received from commercial or governmental sources will be tax exempt and, whenever practicable, will be paid by AMF(L), or Landsouth prior to departure from Slovenia.
6-2a The AMF(L) units and their national contingents (National Support Elements, (NSE)) will reimburse the HN for all mutually accepted costs incurred by the latter in implementing this MOU.
6-2b The LANDSOUTH units will reimburse the HN for all mutually accepted costs incurred by the latter in implementing this MOU.
6-2c Detailed financial arrangements, including arrangements for reimbursement in kind, will be specified in Annex G to this MOU. Accounts will be settled in accordance with the billing and/or claims procedures contained in the current edition of STANAG 2034, 2135 and 3113. COMAMF(L) will monitor reimbursement by the national contingents to the HN.
SECTION SEVEN
DAMAGES.
7-1 The relevant articles of the NATO SOFA and the Paris Protocol, in particular Article VIII of NATO SOFA and Article VI of the Paris Protocol, will apply to the investigation and resolution of all kinds of damage, accident and incident matters. All investigations will be conducted jointly by representatives of both HN and the AMF(L) or LANDSOUTH, if LANDSOUTH personnel or property were involved.
SECTION EIGHT
COMMENCEMENT, DURATION AND TERMINATION.
8-1 This MOU to include its associated Annexes, will enter into force on the date when Slovenian side officially notifies the other participant on the fulfilment of the conditions of national law for its entering into force; it will be applied provisionally as from the date of its signing. It will remain valid until the departure of the last participants personnel from the HN, with the exception of the financial provisions, which will remain in force until all outstanding bills and claims have been settled.
SECTION NINE
MODIFICATION AND DISPUTES.
9-1 This MOU may be reviewed or amended in writing, upon mutual agreement between HQ AMF(L) or LANDSOUTH, and The Ministry of Defence of the Republic of Slovenia, according to the procedure laid down by Section Eight of the MOU. AMF(L) is duly authorised by the Participants to represent the interests of the Participants in discussions with the MOD, Slovenia.
9-2 Should any disagreement arise concerning the interpretation and/or implementation of this MOU, the Participants will immediately consult each other with a view to settling the dispute by amicable arrangement and without recourse to outside jurisdiction.
SECTION TEN
DISCLOSURE OF INFORMATION.
10-1 Information provided by either Party to the other in confidence, and such information produced by either or any Party pursuant to this MOU requiring confidentiality, will either retain its original classification, or be assigned a classification that will ensure a degree of protection against disclosure, equivalent to that required by the other Party.
10-2 Each Party will take all available lawful steps to prevent the disclosure of information exchanged in confidence under this MOU, unless the other Party consents to such disclosure.
10-3 To assist in providing the desired protection, each Party will mark such information furnished to the other in confidence with a legend indicating its origin, the security classification, the conditions of release, that the information relates to this MOU and that it is furnished in confidence.
SECTION ELEVEN
11-1 This MOU is written in English. In witness thereof, the undersigned, duly authorised by their respective authorities, have signed this MOU.

CAE 98 MOU
ADMINISTRATIVE MATTERS
1. Finance and Charges.
a. Bills for support provided by civilian contractors and/or HN governmental sources will be presented to either the AMF(L) Force Supply Officer (FSO) or to the designated representative for LANDSOUTH, if support was provided to LANDSOUTH. Bills submitted to AMF(L) will be paid for by AMF(L) units prior to their departure from Slovenia. Payments will be in Slovenian Tolars unless specified differently in the contract. HNS provided by military sources, including transportation, services, infrastructure, and real estate will be at no cost to AMF(L) if not otherwise indicated. Bills submitted to LANDSOUTH will be paid by LANDSOUTH within thirty days following receipt of the invoice. Payments will be in Slovenian Tolars unless specified differently in the contract. HNS provided by military sources, including transportation, services, infrastructure, and real estate will be at no cost to LANDSOUTH if not otherwise indicated.
b. HQ AMF(L), LANDSOUTH and each NSE may open bank accounts in Slovenia in accordance with Slovenian laws on foreign exchange.
c. All purchases will be exempt of retail sales tax (to include VAT). The HN will implement procedures to ensure that all purchases are tax free. Tax exemption of the retail sales tax payment will be implemented through a system of the tax rebate.
2. Customs.
a. HN will acknowledge the documents listed below for customs clearance.
(1) For Sea Movement.
(a) Strength return with an attached nominal roll for all personnel in accordance with STANAG 2166.
(b) Sailing Signal Freight (hard copy) for all equipment/supplies (except for duty free items) in accordance with STANAG 2166.
(c) Certificate of duty free items.
(2) For Air Movement.
(a) Passenger/cargo manifest for personnel and/or equipment/supplies as appropriate in accordance with STANAG 3345.
(b) Certificate of duty free items.
(3) Relevant NATO documents will be used for road and rail movements.
b. The format of the documents used by the nations will be in accordance with the respective STANAG’s 2166, 2171,2176 and 3345.
c. Each document will be prepared per vessel/aircraft and in triplicate.
d. Personnel arriving and/or departing individually will be issued a NATO Travel Order.
3. Import/Export Arrangements. In accordance with Article XI of the NATO SOFA and Article VIII-2 of the Paris Protocol, the Republic of Slovenia authorises the AMF(L), LANDSOUTH and the Participating Forces to import, and to subsequently export as necessary, a limited range of goods free of duty for the exclusive, personal and communal use of the AMF(L), LANDSOUTH and the Participating Forces. Goods will not be disposed of in Slovenia except to members of the AMF(L), LANDSOUTH and the Participating Forces unless authorised by the competent national authorities.
4. Identification. All personnel deployed to Slovenia in support of NATO operational and support plans are required to be in possession of identity documents specified in Article III of the NATO SOFA. Identity documents must be carried at all times.
5. Public Events. The Slovenia Authorities will provide suitable facilities and manpower for public events, (see Annex H and J) to be held as requested by COMAMF(L) during the exercise and as agreed by the HN.
6. Protocol. All agreed protocol events will be organised in coordination with the Slovenian Military Authorities through the Joint Visitors and Observers Bureau (VOB).
7. Treatment of Civilians.
a. Responsibility for the protection of AMF(L) forces in Slovenia against civil disturbances and similar incidents rests with the Government of Slovenia. Slovenian police should be used to contain the threat or deter an attack.
b. The HN acknowledges that every member of the Force has the same legal rights as any Slovenian citizen, to detain any person found to be committing an offence against the personnel or property of the Force, provided that such person is handed over to the proper Slovenian authority at the earliest opportunity.
c. Detainees shall be transferred immediately to Slovenian authorities.
8. Troop Movement and Security.
a. For security reasons, road movements outside training areas have to be executed in accordance with STANAGs 2154 and 2155 and with Slovenian peacetime regulations.
b. The movement of vehicles not conforming with Slovenian regulations in terms of weights and dimensions will be handled in accordance with STANAG 2154.
c. Surface transport requests will be submitted in accordance with STANAG 2158.
d. Transport of POL and Ammunition will be conducted in accordance with HN peacetime regulations.
e. The Slovenian Government also acknowledges that pursuant to the NATO SOFA, no vehicle of AMF(L), LANDSOUTH or the Participating Forces need conform to any legislation or regulations requiring vehicles or their drivers to be insured against accidental damage, or third party risks. AMF(L), LANDSOUTH and the Participating Forces acknowledge that troop movement will be conducted under the control of the Slovenian military authorities and that it will be in convoys escorted by Slovenian Military Police. Nevertheless, the HN acknowledges that where Slovenian Military Police resources are insufficient to provide escort for AMF(L), LANDSOUTH or the Participating Forces vehicle movement, then such vehicles may move along roads and highways unescorted, provided that notification is given by AMF(L), LANDSOUTH or the Participating Forces to the Slovenian Authorities as soon as possible.
f. Members of the FMPU and CTS whilst on duty are authorised to carry and use firearms to effect military discipline and to police the camps wherein AMF-L, LANDSOUTH, and Participating Force personnel shall remain. NATO Peacetime rules of engagement (i.e., use of force in self-defense) shall apply. Rules applicable to the use of force by Slovenian Military Police shall apply equally to FMPU personnel with respect to military personnel of the exercise participants, while in the exercise areas.
9. Traffic Accidents, Damage, Pollution, Discipline/Police Incidents.
a. All discipline incidents will be investigated by the Force Military Police Unit (a NATO combined Military Police Unit IAW STANAG 2085) in conjunction with HN Police agencies IAW the NATO SOFA.
b. All traffic accidents and Police incidents will be investigated by HN Police agencies in accordance with national legislation and in conjunciton with the Force Military Police Unit IAW the NATO SOFA.
c. No third party insurance coverage will be requested for participants.
d. Damage and Pollution matters will be investigated in accordance with Article VIII of the NATO SOFA.
10. Deaths. In the event of the death of a member of a Participating Force, authorisation must be obtained from HN authorities prior to the removal and repatriation of cadavers. In the event that an autopsy must be performed, HN authorities shall give favorable consideration to a request of the Sending State to permit its medical personnel to participate in the procedure. The HN will respect the traditions and customs of the Sending State.

UVOD
OB UPOŠTEVANJU dejstva, naj se vojaška vaja “Cooperative Adventure Exchange” izvede v Republiki Sloveniji v okviru Partnerstva za mir od 14. do 28. novembra 1998;
OB PRIZNAVANJU KONCEPTA, ki je podlaga razporeditve kopenskega dela mobilne sile Združenega poveljstva za Evropo (ZMS(K)) in razporeditve vseh preostalih sil v podporo vojaški vaji;
OB UPOŠTEVANJU Republike Slovenije, v nadaljnjem besedilu imenovane država gostiteljica (DG), in Vrhovnega poveljstva zavezniških sil za Evropo (VPZSE), ki ga pravilno zastopa poveljnik zavezniških sil za južno Evropo,
IN GLEDE NA potrebe Poveljstva zavezniških kopenskih sil za južno Evropo, ZMS(K) in vseh udeležencev po logistični podpori države gostiteljice ob razporeditvi njihovih enot na njenem ozemlju
STA DRŽAVA GOSTITELJICA IN VPZSE, V NADALJNJEM BESEDILU SKUPAJ IMENOVANA POGODBENICI, SKLENILA NASLEDNJE:
PRVO POGLAVJE
OPREDELITEV POJMOV
1-1 Udeleženci: Kopenski del mobilne sile Združenega poveljstva za Evropo (kopno) (ZMS(K)) in vse kopenske sile, ki jih države članice Nata določijo za razporeditev na ozemlju Republike Slovenije, pod operacijskim nadzorom (OPNAD) poveljnika ZMS(K) (PZMS(K)); osebje držav članic, ki deluje v imenu Poveljstva zavezniških kopenskih sil za južno Evropo (v nadaljevanju: ZKSJE) ali v imenu Poveljstva zavezniških sil za južno Evropo (v nadaljevanju: ZSJE); osebje držav, ki niso članice Nata in katerih vlade so ratificirale sporazum Partnerstvo za mir.
1-2 Podpora države gostiteljice (PDG): PDG se opredeli kot civilna in vojaška pomoč, ki jo DG daje ZKSJE, ZMS(K) ali osebju sil udeležencev ob razporeditvi ali tranzitu na ozemlju DG za namene vojaške vaje “Cooperative Adventure Exchange 98”.
1- 3 Obvezno sodelovanje se opredeli kot: “Poveljnikom ali vojaškim vodjem, med katerimi ne obstaja nikakršen institucionalni podrejeni status in ki morajo na poseben način sodelovati, je po ukazu izrecno določeno sodelovati. Sodelovanje vključuje obveznost vzajemnega obveščanja, svetovanja in podpore pri vseh zadevah, pri katerih vojaška nujnost narekuje skupno izvedbo.”

2-1 Severnoatlantski pakt, podpisan 4. aprila 1949 v Washingtonu, D.C.
2-2 Sporazum med pogodbenicami Severnoatlantskega pakta o statusu njihovih sil (podpisan v Londonu 19. junija 1951), v nadaljevanju krajše imenovan “NATO SOFA”, in Protokol o statusu mednarodnih vojaških poveljstev, ustanovljenih v skladu s Severnoatlantsko pogodbo, podpisan v Parizu 28. avgusta 1952, v nadaljevanju krajše imenovan “Pariški protokol”.
2-3 Sporazum med državami pogodbenicami Severnoatlantskega pakta in drugimi državami, ki sodelujejo v Partnerstvu za mir, glede statusa njihovih sil in dodatni protokol k temu sporazumu, sklenjen v Bruslju 19. junija 1995.
TRETJE POGLAVJE
NAMEN IN OBSEG
3-1 Ta memorandum o soglasju (MS) določa zahteve in postopke za preskrbo in zagotovitev logistične podpore države gostiteljice ZKSJE, ZMS(K) in silam udeležencev med vojaško vajo “Cooperative Adventure Exchange 98”. Memorandum ni v neskladju s slovensko zakonodajo ali katerim koli veljavnim mednarodnim sporazumom. Če se neskladja kljub temu pojavijo, se obvestijo zainteresirani organi, države in sile, obveljajo pa veljavni mednarodni sporazumi.
3-2 Podpora države gostiteljice (PDG), ki jo zajema ta MS, se začne ob prvem vstopu osebja ali opreme ZKSJE, ZMS(K) ali sil udeležencev na ozemlje Republike Slovenije in traja do odhoda zadnjih delov ZKSJE, ZMS(K) ali sil udeležencev iz Slovenije. PDG udeležencem se izvaja izrecno v skladu z zadevnimi prilogami.
ČETRTO POGLAVJE
DOLŽNOSTI DRŽAVE GOSTITELJICE
4-1 Z začetkom vojaške vaje DG pooblasti sile udeležencev za premike do območij, namenjenih za njihove operacije, v najkrajšem času, ki ga dopuščajo okoliščine.
4-2 Slovenska vlada kot DG izvede vse ukrepe, ki so nujni, da se omogoči gibanje osebja, vozil, opreme in zalog od vstopnih točk (VT) do območij operacij, vključno z uporabo slovenskih državnih zračnih poti, slovenskih državnih železnic in slovenskih državnih cest s strani sil udeležencev.
4-3 V skladu z odstavkoma 4-6 in 4-7 DG daje silam udeležencev v uporabo vsa pristanišča in letališča, za katera je bil sklenjen dogovor pred začetkom vojaške vaje in ki so nujna za zagotovitev hitrega vkrcanja in izkrcanja njihovega osebja in opreme, vključno z uvozom in izvozom opreme.
4-4 DG pooblasti udeležence za nošenje osebnega orožja in streliva v tranzitu in na območju vojaške vaje v Sloveniji v skladu z varnostnimi ukrepi, dogovorjenimi med DG in PZMS(K) v imenu vseh sil udeležencev.
4-4.1 Udeleženci in Republika Slovenija potrjujejo, da je za zagotovitev zaščite sil udeležencev in njihove opreme odgovorna Republika Slovenija.
4-4.2 Udeleženci in Republika Slovenija potrjujejo, da imajo sile udeležencev izvirno pravico do uporabe sile v samoobrambi.
4-5 Vzpostavi se podporna enota države gostiteljice (PEDG) za dopolnitev logistične podpore enotam sil udeležencev in za zagotovitev pomoči pri varnosti in obveščevalnih dejavnostih (glej: Priloga A).
4-6 DG zagotovi oskrbo in storitve, za katere je bil na podlagi pogajanj med Ministrstvom za obrambo RS in ZMS(K) ali ZKSJE sklenjen dogovor v njihovem imenu ali pa v imenu sil udeležencev pred začetkom vojaške vaje, kot je natančneje določeno s tem MS in njegovimi prilogami. Udeleženci s tem, ko prispevajo svoje sile za vojaško vajo, priznavajo, da je ta MS v celoti obvezujoč in da PZMS(K) lahko nastopa kot njihov pooblaščenec pri pogajanjih glede pogodbenih določb, tehnične ureditve ali katerih drugih določb, ki jih država gostiteljica določi silam udeležencev.
4-7 Kadar DG te oskrbe ne more zagotoviti iz svojih vojaških ali vladnih virov, daje ZMS(K)-ju, ki nastopa v imenu vseh sil udeležencev, ali ZKSJE pomoč, potrebno za zagotovitev nujne oskrbe in storitev, iz komercialnih virov Slovenije po najugodnejših cenah.
4-8 DG ne daje pomoči in storitev iz komercialnih virov v imenu ZMS(K)/ZKSJE ali katere od sil udeležencev, kadar tega ZMS(K) ali ZKSJE izrecno ne zahtevata.
4-9 Podpora DG, kot je dogovorjena s tem MS, se izvaja v okviru in ob usklajevanju s PEDG. PEDG v okviru svojih pooblastil rešuje vse težave v zvezi z dajanjem pomoči iz slovenskih vojaških virov. PEDG prav tako pomaga pri reševanju vseh drugih težav, npr. pri izvajanju kazenske zakonodaje glede na določbe VII. člena NATO SOFA in IV.a člena Pariškega protokola ter pri reševanju odškodninskih zahtevkov v skladu z VIII. členom NATO SOFA.
4-10 Vse zahteve za dodatno pomoč zunaj obsega tega MS se rešujejo med Ministrstvom za obrambo Republike Slovenije (MO RS) in Poveljstvom ZMS(K), Poveljstvom ZKSJE ali zainteresiranim udeležencem in s skupnim dogovorom.
4-11 Pogodbenici priznavata, da med sile udeležencev spadajo tudi sile držav članic Nata, ki niso ratificirale sporazuma Partnerstva za mir o statusu sil, in sile držav, ki niso članice Nata in ki so ratificirale sporazum Partnerstva za mir o statusu sil. Republika Slovenija potrjuje, da bo osebju vseh udeležencev zagotovila položaj, pravice, ugodnosti, imunitete in privilegije, ki so določeni za osebje držav podpisnic na podlagi sporazuma Partnerstva za mir o statusu sil. Republika Slovenija ne razlikuje med državami pošiljateljicami in vsem državam pošiljateljicam zagotovi pravice, prednosti in privilegije, določene s sporazumom Partnerstva za mir o statusu sil in sporazumom Nata o statusu sil, in si prizadeva, da vsem udeležencem zagotovi pravice, privilegije in ugodnosti, določene na podlagi Pariškega protokola.
PETO POGLAVJE
DOLŽNOSTI UDELEŽENCEV
5-1 Osebje udeležencev mora spoštovati slovensko zakonodajo, kazensko in civilno. Udeleženci svoje operacije izvajajo v skladu s poveljem za delovanje na vaji (PDV).
5-2 ZMS(K) povrne DG vse stroške dobav, ki jih je zahteval ZMS(K) in opravil PEDG, razen dobav, ki so bile opravljene brez stroškov ali na podlagi posojila. Vsa oprema, posojena ZMS(K), se vrne PEDG pred odhodom iz Slovenije. Posojena oprema se uporablja skrbno in se vrne DG v stanju, v kakršnem je bila ob sprejemu, z izjemo obrabe, ki se pojavi ob običajni uporabi.
5-3 ZKSJE povrne DG vse stroške dobav, ki jih je zahteval ZKSJE in opravil PEDG, razen dobav, ki so bile opravljene brez stroškov ali na podlagi posojila. Vsa oprema, posojena ZKSJE, se vrne PEDG pred odhodom iz Slovenije. Posojena oprema se uporablja skrbno in se vrne DG v stanju, v kakršnem je bila ob sprejemu, z izjemo obrabe, ki se pojavi ob običajni uporabi.
5-4 V skladu z določbo 4-7 je za pogajanja glede komercialnih pogodb za potrebe udeležencev odgovoren ZMS(K). ZKSJE se lahko pogaja v svojem imenu z Republiko Slovenijo.
ŠESTO POGLAVJE
FINANČNE DOLOČBE (Glej: REFERENCE 2-2 in 2-3)
6-1 Stroški storitev in dobav, ki jih zahtevata ZMS(K) ali ZKSJE in ki se financirajo iz komercialnih ali vladnih virov, so oproščeni davka in jih ZMS(K) ali ZKSJE plačata, kadar je to mogoče, pred svojim odhodom iz Slovenije.
6-2a Enote ZMS(K) in njihovi nacionalni kontingenti (elementi državne podpore, (EDP)) povrnejo DG vse skupaj odobrene stroške, ki jih prevzame DG pri izvajanju tega MS.
6-2b Enote ZKSJE povrnejo DG vse skupaj odobrene stroške, ki jih prevzame DG pri izvajanju tega MS.
6-2c Finančna ureditev, vključno s povračili v naravi, se podrobneje določi v Prilogi G tega MS. Računi se poravnajo v skladu s postopki fakturiranja in/ali terjatev, ki jih vsebuje veljavna izdaja STANAG (standard Nata) 2034, 2135 in 3113. PZMS(K) nadzoruje povračila stroškov nacionalnih kontingentov DG-ju.
SEDMO POGLAVJE
ŠKODA
7-1 Vsi zadevni členi NATO SOFA in Pariškega protokola, zlasti VIII. člen NATO SOFA in VI. člen Pariškega protokola, se uporabljajo za preiskave in razrešitve vseh vrst škode, nesreč in incidentov. Vse preiskave vodijo skupaj predstavniki DG in ZMS(K) ali ZKSJE, kadar je pri tem vpleteno osebje ali lastnina ZKSJE.
OSMO POGLAVJE
ZAČETEK, TRAJANJE IN PRENEHANJE
8-1 Ta MS, vključno s prilogami, začne veljati z dnem, ko slovenska stran uradno obvesti drugo pogodbenico, da so izpolnjeni notranjepravni pogoji za začetek njegove veljavnosti, začasno pa se uporablja od dne podpisa. V veljavi ostane do odhoda zadnjega osebja udeležencev iz DG, razen finančnih določb, ki veljajo do poravnave vseh neplačanih računov in terjatev.
DEVETO POGLAVJE
SPREMEMBE IN SPORI
9-1 Ta MS se spremeni ali dopolni pisno na podlagi skupnega dogovora med Poveljstvom ZMS(K) ali ZKSJE in Ministrstvom za obrambo Republike Slovenije v skladu s postopkom, določenim v osmem poglavju tega sporazuma. Udeleženci pravilno pooblaščajo ZMS(K), da zastopa njihove interese v dogovorih z MO Republike Slovenije.
9-2 Kadar se pojavijo nesoglasja glede razlage in/ali izvajanja tega MS, se udeleženci takoj medsebojno posvetujejo z namenom rešitve spora s prijateljskim dogovorom in brez uporabe zunanje jurisdikcije.
DESETO POGLAVJE
RAZKRITJE PODATKOV
10-1 Podatki, ki jih ena izmed pogodbenic zaupno posreduje drugi, in podatki, ki se pojavijo na podlagi tega MS pri kateri od pogodbenic in so zaupni, ostanejo zaupni po prvotni določitvi ali pa se jim določi stopnja zaščite pred razkritjem, ki je enaka stopnji, ki jo zahteva druga pogodbenica.
10-2 Vsaka pogodbenica sprejme ustrezne zakonske ukrepe za zaščito pred razkritjem podatkov, ki se zaupno izmenjajo na podlagi tega MS, razen kadar druga pogodbenica privoli v to razkritje.
10-3 V pomoč zagotavljanju želene stopnje zaščite podatkov vsaka pogodbenica označi podatke, ki jih drugi posreduje zaupno, z legendo, ki navaja njihov izvor, stopnjo zaupnosti, pogoje njihove izdaje ter da se ti podatki sklicujejo na ta MS in da so posredovani zaupno.

11-1 Ta MS je napisan v angleščini. V potrditev tega so podpisani, ki so jih pravilno pooblastile njihove oblasti, podpisali ta MS.

UPRAVNE ZADEVE
1. Finance in stroški
a. Računi, izstavljeni za podporo, ki jo po pogodbi zagotavljajo civilne osebe in/ali vladni viri DG, se vročijo častniku ZMS(K), odgovornemu za dobave, ali pa predstavniku ZKSJE, kadar je bila podpora zagotovljena ZKSJE. Račune, vročene ZMS(K), plača ZMS(K) pred odhodom iz Slovenije. Plačila so v slovenskih tolarjih, razen če ni drugače določeno s pogodbo. Podpora DG iz vojaških virov, vključno s transportom, storitvami, infrastrukturami in nepremičninami, je za ZMS(K) brezplačna, razen če ni drugače določeno. Račune, vročene ZKSJE, plača ZKSJE v tridesetih dneh od prejema računa. Plačila so v slovenskih tolarjih, razen če ni drugače določeno s pogodbo. Podpora DG iz vojaških virov, vključno s transportom, storitvami, infrastrukturami in nepremičninami, je za ZKSJE brezplačna, razen če ni drugače določeno.
b. Poveljstvo ZMS(K), ZKSJE in elementi nacionalne podpore lahko v Sloveniji odprejo bančni račun v skladu s slovensko zakonodajo o deviznem poslovanju.
c. Vse nabave so oproščene prometnega davka (vključno z davkom na dodano vrednost). DG izvede vse postopke za zagotovitev oprostitve davka za vse nabave. Oprostitev prometnega davka se izvaja po sistemu davčnih povračil.
2. Carina
a. DG priznava spodaj naštete dokumente za carinski pregled:
(1) Za gibanje po morju:
(a) Dokument za vrnitev osebja s priloženim poimenskim seznamom osebja v skladu s STANAG 2166.
(b) Seznam tovora (na papirju) za vso opremo/zaloge (razen izdelkov, oproščenih carine) v skladu s STANAG 2166.
(c) Potrdilo za izdelke, oproščene carine.
(2) Za gibanje po zraku:
(a) Seznam potnikov/tovora za osebje in/ali opremo/zaloge, kadar je to ustrezno, v skladu s STANAG 3345.
(b) Potrdilo za izdelke, oproščene carine.
(3) Za gibanje po cestah in železnicah se uporabljajo zadevni dokumenti Nata.
b. Oblika dokumentov, ki jih uporabijo države, je v skladu z zadevnimi STANAG št. 2166, 2171, 2176 in 3345.
c. Vsak dokument se pripravi za vsako plovilo/zrakoplov v treh izvodih.
d. Osebju, ki pride in/ali odide posamično, se izda potni nalog Nata.
3. Uvozna/izvozna ureditev. V skladu z XI. členom NATO SOFA in drugim odstavkom VIII. člena Pariškega protokola Republika Slovenija pooblasti ZMS(K), ZKSJE in vse sile udeležencev za uvoz in po potrebi za kasnejši izvoz omejenega obsega blaga brez plačila carinskih dajatev za izključno osebno in skupno rabo ZMS(K), ZKSJE in sil udeležencev. Blago se v Sloveniji ne prodaja, razen članom ZMS(K), ZKSJE in sil udeležencev, ki jih pooblastijo pristojni državni organi.
4. Identifikacija. Vse osebje, ki je v Sloveniji razporejeno za namene operacijskih načrtov in podpore, mora imeti identifikacijske dokumente, ki so podrobno določeni v III. členu NATO SOFA. Te dokumente mora imeti osebje vedno pri sebi.
5. Javne prireditve. Slovenske oblasti zagotovijo ustrezne prostore in osebje za organizacijo javnih prireditev (glej: Prilogi H in J), ki potekajo na zahtevo PZMS(K) med vojaško vajo in kot je dogovorjeno z DG.
6. Protokol. Organizacijo vseh dogovorjenih protokolarnih prireditev vodi Skupni biro za obiskovalce in opazovalce v sodelovanju s slovenskimi vojaškimi organi.
7. Obravnava civilistov
a. Za zaščito sil ZMS(K) v Sloveniji pred civilnimi nemiri in podobnimi incidenti je odgovorna slovenska vlada. Slovenska policija se uporablja za zadrževanje ali odvračanje napada.
b. DG priznava, da ima vsak pripadnik sile enake zakonske pravice kot slovenski državljani v smislu dovoljenja za pridržanje vsake osebe, ki stori prekršek v zvezi z osebjem ali lastnino sile, pod pogojem, da so te osebe v najkrajšem možnem času izročene ustreznim slovenskim oblastem.
c. Pridržane osebe se takoj izročijo slovenskim oblastem.
8. Gibanje enot in varnost
a. Iz varnostnih razlogov se gibanje po cestah zunaj območij, namenjenih za vajo, izvaja v skladu s STANAG 2154 in 2155 in s slovenskimi mirnodobnimi predpisi.
b. Gibanje vozil, ki ni v skladu s slovenskimi predpisi v smislu teže in dimenzij, se obravnava v skladu s STANAG 2154.
c. Zahteve v zvezi s kopenskim transportom se obravnavajo v skladu s STANAG 2158.
d. Transport kurilnega olja in maziv ter streliva se izvaja v skladu z mirnodobnimi predpisi DG.
e. V skladu z NATO SOFA slovenska vlada priznava, da za nobeno vozilo ZMS(K), ZKSJE in sil udeležencev ne veljajo nobeni zakoni ali predpisi, ki za vozila ali njihove voznike zahtevajo nezgodno zavarovanje ali zavarovanje proti tretji osebi. ZMS(K), ZKSJE in sile udeležencev se strinjajo, da bo gibanje njihovih enot potekalo pod nadzorom slovenskih vojaških organov v konvojih, ki jih spremlja slovenska vojaška policija. Kljub temu DG dovoljuje, da kadar so viri slovenske vojaške policije nezadostni za kritje potreb spremstva gibanja vozil ZMS(K), ZKSJE in sil udeležencev, se ta vozila lahko gibljejo po cestah in avtocestah brez spremstva pod pogojem, da ZMS(K), ZKSJE in sile udeležencev o tem kar najhitreje obvestijo slovenske oblasti.
f. Pripadniki EVPS (enote vojaške policije sile) in protiterorističnega oddelka so pri opravljanju dolžnosti pooblaščeni za nošenje in uporabo strelnega orožja za izvajanje vojaškega reda in nadzora nad območji, na katerih je nameščeno osebje ZMS(K), ZKSJE in sil udeležencev. Pri tem se uporabljajo mirnodobna pravila Nata (npr. uporaba sile v samoobrambi). Pravila, ki veljajo za slovensko vojaško policijo v primeru uporabe sile, se uporabljajo tudi za EVPS glede vojaškega osebja udeležencev vojaške vaje, kadar so na območjih vojaške vaje.
9. Prometne nesreče, škoda, onesnaževanje, disciplinski/policijski incidenti
a. Vse disciplinske incidente preiskuje enota vojaške policije sile (kombinirana enota vojaške policije Nata na podlagi STANAG 2085) skupaj s policijskimi organi DG na podlagi NATO SOFA.
b. Vse prometne nesreče in policijske incidente preiskujejo policijski organi DG v skladu z notranjo zakonodajo in skupaj z enoto vojaške policije sile na podlagi NATO SOFA.
c. Za udeležence se ne zahteva zavarovalno kritje proti tretji osebi.
d. Zadeve v zvezi s škodo in onesnaževanjem se preiskujejo v skladu z VIII. členom NATO SOFA.
10. Smrt. V primeru smrti pripadnika sile udeležencev je pred vrnitvijo trupla v domovino ali njegovo odstranitvijo treba pridobiti dovoljenje organov DG. Kadar je treba opraviti obdukcijo, se DG trudi ugodno rešiti prošnjo države pošiljateljice, da se njenemu medicinskemu osebju dovoli sodelovati pri postopku. DG spoštuje navade in običaje države pošiljateljice.
3. člen
Za izvajanje memoranduma skrbi Ministrstvo za obrambo Republike Slovenije.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
