O RAZGLASITVI ZAKONA O RATIFIKACIJI SPORAZUMA O TRGOVINSKEM IN GOSPODARSKEM SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO UKRAJINE (BUKTGS)
Razglašam Zakon o ratifikaciji Sporazuma o trgovinskem in gospodarskem sodelovanju med Vlado Republike Slovenije in Vlado Ukrajine (BUKTGS), ki ga je sprejel Državni zbor Republike Slovenije na seji dne 19. februarja 1997.

O RATIFIKACIJI SPORAZUMA O TRGOVINSKEM IN GOSPODARSKEM SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO UKRAJINE (BUKTGS)
1. člen
Ratificira se Sporazum o trgovinskem in gospodarskem sodelovanju med Vlado Republike Slovenije in Vlado Ukrajine, podpisan 28. avgusta 1996 v Ljubljani.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:*
S P O R A Z U M
O TRGOVINSKEM IN GOSPODARSKEM SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO UKRAJINE
Vlada Republike Slovenije in Vlada Ukrajine (v nadaljnjem besedilu: pogodbenici) sta se
– z namenom, da razvijata in krepita dolgoročno trgovinsko in gospodarsko sodelovanje na podlagi enakopravnosti in obojestranske koristi,
– v prepričanju, da je ta sporazum primerna in stabilna podlaga za gospodarsko sodelovanje med državama,
– ob upoštevanju prakse in norm mednarodnega trga
sporazumeli o naslednjem:
1. člen
Pogodbenici bosta podpirali in olajševali nadaljnji razvoj gospodarskega sodelovanja med državama in bosta v skladu s svojima nacionalnima zakonodajama in z določili tega sporazuma omogočali različne oblike gospodarskih povezav med subjekti obeh držav ter sporazumno premagovali morebitne ovire pri tem sodelovanju.
2. člen
Pogodbenici bosta druga drugo obravnavali kot državo z največjimi ugodnostmi za proizvode in storitve, ki izvirajo z njunega območja, in sicer glede carine in drugih dajatev z enakim učinkom, ki se plačujejo pri uvozu in izvozu, glede načina njihovega plačevanja ter glede vseh predpisov in formalnosti v zvezi z uvozom in izvozom.
Prejšnji odstavek se ne nanaša na:
a) ugodnosti, ki jih ena ali druga pogodbenica odobri ali jih je odobrila kateri izmed sosednjih držav, da bi olajšala maloobmejni promet in trgovino;
b) ugodnosti, ki sta jih pogodbenici priznali ali jih bosta priznali tretjim državam na podlagi udeležbe v carinski uniji in/ali na prostem trgovinskem območju in/ali v regionalnih integracijskih sporazumih.
3. člen
Pogodbenici si bosta v skladu s svojimi pooblastili prizadevali za zagotovitev čim bolj stabilnih pogojev za razvoj trgovinske menjave in drugih oblik gospodarskega sodelovanja med državama, pri čemer bosta še posebej spodbujali sodelovanje na gospodarskem, industrijskem, tehničnem in znanstveno-tehnološkem področju.
4. člen
Pogodbenici bosta z vidika razvoja trgovinskega in gospodarskega sodelovanja podpirali medsebojno izmenjavo informacij, zlasti glede svoje zakonodajne ureditve in programov z gospodarskega področja ter drugih informacij v skupnem interesu.
5. člen
Vsa plačila med pogodbenicama se bodo opravljala v prosto konvertibilni valuti v skladu s predpisi, ki veljajo v obeh pogodbenicah in ob upoštevanju cen in veljavnih pogojev na mednarodnem trgu.
Obračuni v okviru tega sporazuma se lahko opravijo na kakršen koli v mednarodni bančni praksi uveljavljen način na podlagi dogovora med zainteresiranimi gospodarskimi subjekti ob upoštevanju pravne ureditve pogodbenic.
6. člen
Medsebojna menjava blaga in opravljanje storitev bosta potekala po pogodbah, sklenjenih med gospodarskimi subjekti pogodbenic, ki lahko opravljajo zunanjetrgovinsko dejavnost po veljavnih predpisih v ustrezni državi pogodbenici.
7. člen
Vsaka od pogodbenic se zavezuje, da ne bo izvažala nobenega blaga drugi pogodbenici po dumpinških ali subvencioniranih cenah na način, ki vpliva na domačo proizvodnjo druge pogodbenice.
V vseh primerih se bosta pogodbenici ravnali v skladu s Splošnim sporazumom o carinah in trgovini (GATT 1994).
8. člen
Pogodbenici si bosta v skladu z mednarodnimi sporazumi in svojima nacionalnima zakonodajama pomagali pri organiziranju sejmov, specializiranih razstav in promocijskih akcij.
Pogodbenici se strinjata, da bosta oprostili plačila carine in drugih dajatev v skladu z njunima notranjima zakonodajama, uvoz naslednjega:
a) reklamno gradivo, brezplačni vzorci iz druge pogodbenice in predmeti, ki se dobijo v drugi pogodbenici na tekmovanjih, razstavah in drugih prireditvah;
b) blago in oprema za sejme in razstave, ki ni namenjeno za prodajo.
9. člen
Za uresničevanje ciljev tega sporazuma ustanovita pogodbenici mešano komisijo iz predstavnikov državnih institucij in gospodarskih subjektov obeh pogodbenic. Komisija se bo sestajala po potrebi izmenoma v eni od pogodbenic.
Mešana komisija določi način svojega delovanja.
10. člen
Ta sporazum je sklenjen za eno leto in se vsakokrat podaljšuje še za eno leto, če ga ena od obeh pogodbenic pisno po diplomatski poti ne odpove tri mesece pred prenehanjem njegove veljavnosti.
Spremembe ali prenehanje veljavnosti tega sporazuma ne bo vplivalo na izpolnitev pogodb, sklenjenih med gospodarskimi subjekti obeh držav med njegovo veljavnostjo.
11. člen
Ta sporazum začne veljati z dnem izmenjave not, s katerima se pogodbenici medsebojno obvestita o izpolnitvi svojih ustavnopravnih in zakonodajnih zahtev za njegovo uveljavitev.
Sklenjeno v Ljubljani dne 28. avgusta 1996 v dveh izvirnikih v slovenskem, ukrajinskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. V primeru razlik v razlagi je odločilno angleško besedilo.

A G R E E M E N T
ON TRADE AND ECONOMIC COOPERATION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF UKRAINE
The Government of the Republic of Slovenia and the Government of Ukraine (hereinafter: the Contracting Parties),
– desirous to develop and enhance long term trade and economic cooperation based on equality and mutual benefit,
– convinced that this Agreement is an appropriate and stable foundation for economic cooperation between the two countries,
– considering the practices and standards of the international market,
have agreed as follows:
Article 1
The Contracting Parties shall support and facilitate further development of economic cooperation between the two countries and, in accordance with the provisions of this Agreement and with the respective legislation and regulations which apply in the two countries, the Contracting Parties will enable various forms of economic links among the entities of both countries and surmount any obstacle in this cooperation by mutual agreement.
Article 2
The Contracting Parties shall accord to each other the treatment of most-favoured-nation treatment for products and services originating from their respective territories; this shall be practised with regard to customs duties and other levies imposed to the same effect and charged for exportation, importation, regarding the method of payment as well as all regulations and formalities related to exports and imports.
The provisions contained in the first paragraph hereof, however, do not apply to the:
a) advantages which either Contracting Party has accorded or will accord to any neighbouring state in order to facilitate frontier traffic and trade;
b) advantages which the Contracting Parties have accorded or will accord to third states based on cooperation within the framework of a customs union and/or a free trade area and/or agreements on regional integration.
Article 3
The Contracting Parties shall endeavour, within the scope of their authority, to secure stable conditions for the development of trade and other forms of economic cooperation between the two countries, focusing in particular on cooperation in economic, industrial, technical and scientific-technological domain.
Article 4
In view of the development of trade and economic cooperation, the Contracting Parties shall encourage mutual exchange of information, particularly concerning their respective legislations and economic programmes, as well as other information of mutual interest.
Article 5
All payments between the Contracting Parties shall be effected in freely convertible currency in compliance with regulations applicable in the countries of the contracting Parties and in accordance with prices and standard terms of the international market.
Accounts within the framework of this Agreement may be settled in any internationally accepted way according to banking practice, based on mutual agreement among the economic entities involved and considering the laws and regulations of the Contracting Parties.
Article 6
Mutual supply of goods and rendering of services shall be based on contracts concluded between economic entities of the Contracting Parties, which have been authorised for foreign trade transactions in accordance with valid regulations of the Contracting Party.
Article 7
Each Contracting Party undertakes not to export any commodity to the other Party at dumping or subsidised prices in a way that effects the local production of the other Contracting Party.
Contracting Parties shall act in accordance with the General Agreement on Trade and Tariffs (GATT 1994).
Article 8
The Contracting Parties shall, following international agreements and the legal order of their respective countries, render each other assistance in organising fairs, specialised exhibitions and promotion actions.
The Contracting Parties agree to exempt from customs duties, levies and other charges based on their respective laws and regulations the imports of:
a) promotion material, free samples originating from the country of the other Contracting Party, as well as articles which are obtained in the country of the other Party at competitions, exhibitions and other festivities;
b) goods and equipment for fairs and exhibitions, which are not intended for sale.
Article 9
A Joint Committee consisting of representatives of State institutions and economic entities of both Contracting Parties shall be constituted for the purpose of implementing the objectives of this Agreement. The Committee shall meet when needed in the country of either Contracting Party, alternately.
Joint Committee shall define its regulations for the conduct of meetings and adopt Rules of procedure.
Article 10
This Agreement shall be concluded for the period of one year and automatically prolonged for another year unless either Contracting Party terminates this Agreement in writing through diplomatic channels by giving three months’ notice before the expiry of its validity.
The modification or termination of the Agreement shall in no way interfere with the fulfilment of contracts concluded between the economic entities of both countries during the period of the validity hereof.
Article 11
This Agreement shall enter into force on the date of the exchange of notes, whereby the contracting parties notify each other of the compliance with their constitutional and legislative requirements, pertaining to the entry into force of this Agreement.
Done at Ljubljana on this day 28 of August 1996 in two originals, in the Slovene, Ukrainian and English language, all texts being equally authentic. In case of differences of interpretation, the English text shall prevail.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za ekonomske odnose in razvoj.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
