O RATIFIKACIJI UPRAVNEGA DOGOVORA MED UPRAVO REPUBLIKE SLOVENIJE ZA JEDRSKO VARNOST IN KOMISIJO ZA NADZOR NAD ATOMSKO ENERGIJO KANADE V SKLADU S SPORAZUMOM MED VLADO REPUBLIKE SLOVENIJE IN VLADO KANADE O SODELOVANJU NA PODROČJU MIROLJUBNE UPORABE JEDRSKE ENERGIJE
1. člen
Ratificira se Upravni dogovor med Upravo Republike Slovenije za jedrsko varnost in Komisijo za nadzor nad atomsko energijo Kanade v skladu s Sporazumom med Vlado Republike Slovenije in Vlado Kanade o sodelovanju na področju miroljubne uporabe jedrske energije, podpisan 31. maja 1995 v Ljubljani.
2. člen
Upravni dogovor se v izvirniku v slovenskem in angleškem jeziku glasi:
UPRAVNI DOGOVOR
MED UPRAVO REPUBLIKE SLOVENIJE ZA JEDRSKO VARNOST IN KOMISIJO ZA NADZOR NAD ATOMSKO ENERGIJO KANADE V SKLADU S SPORAZUMOM MED VLADO REPUBLIKE SLOVENIJE IN VLADO KANADE O SODELOVANJU NA PODROČJU MIROLJUBNE UPORABE JEDRSKE ENERGIJE
1. Namen
1.1. Da bi omogočili učinkovito izpolnjevanje obveznosti iz Sporazuma med Vlado Republike Slovenije in Vlado Kanade o sodelovanju na področju miroljubne uporabe jedrske energije, podpisanega dne 31. maja 1995, s tem sklepata Uprava Republike Slovenije za jedrsko varnost in Komisija za nadzor nad atomsko energijo Kanade (v nadaljnjem besedilu “Upravi”) v skladu z 2. odstavkom X. člena Sporazuma naslednji upravni dogovor.
2. Definicije in konvencije
2.1. Pomeni izrazov “jedrski material”, “material”, “oprema” in “tehnologija” v besedilu tega dogovora ustrezajo pomenu v Sporazumu. Drugi izrazi, uporabljeni v besedilu tega dogovora, imajo enak pomen, kot ga imajo v členih 98 do 116 dokumenta INFCIRC/153 Mednarodne agencije za atomsko energijo (MAAE) – popravljena verzija.
2.2. Merske enote za jedrski material v besedilu tega dogovora ustrezajo določilom 101. člena dokumenta INFCIRC/153 – popravljena verzija. Merska enota za material je kilogram.
3. Letno poročilo
3.1. Obe upravi bosta druga drugi predložili letno poročilo, ki bo zajemalo dvanajstmesečno obdobje do decembra, o vseh jedrskih materialih, materialih, opremi in tehnologiji na njunih ozemljih, ki so predmet Sporazuma. Letno poročilo bo predloženo takoj, ko bo to mogoče, a najkasneje po izteku treh mesecev od konca vsakega obdobja.
3.2. Upravi bosta v svojih letnih poročilih v zvezi z jedrskimi materiali in materiali upoštevali vse naslednje kategorije:
(a) Naravni uran
(b) Uran, obogaten z izotopom U235 manj kot 20%
(c) Uran, obogaten z izotopom U235 20% ali več
(d) Osiromašeni uran
(e) Uran 233
(f) Plutonij
(g) Torij
(h) Težka voda
3.3. Za vsako kategorijo jedrskega materiala in materiala, kot tudi pri opremi in tehnologiji, bosta obe upravi v svojih letnih poročilih smiselno navedli:
(a) Začetni inventar
(b) Prejete količine
(c) Izdane količine
(d) Druge spremembe inventarja kot tudi spremembe, ki se nanašajo na IV. in VIII. člen Sporazuma.
(e) Končni inventar
3.4. Po potrebi bosta upravi v svojih letnih poročilih pojasnili kakršnekoli informacije, navedene v letnem poročilu. Pojasnilo bo potrebno, če je v obdobju, zajetem v poročilu, prenehal nadzor MAAE nad jedrskimi materiali, ki so predmet Sporazuma, ali takšnimi materiali, ki so v skladu s Sporazumom izzvzeti iz nadzora MAAE.
3.5. Obe upravi bosta v 30 dneh potrdili prejem letnega poročila od druge strani.
3.6. Obe upravi bosta v 90 dneh od prejema letnega poročila posredovali drugi strani morebitna vprašanja v zvezi z navedbami v poročilu.
3.7. Upravi bosta tesno sodelovali in si nudili vso potrebno pomoč pri reševanju teh vprašanj v obojestransko korist do konca koledarskega leta.
4. Ustreznost in sorazmernost
4.1. V letnem poročilu uprav ni potrebna določitev določenega jedrskega materiala ali materiala, ki je bil predmet Sporazuma, mora pa določiti enakovredno količino jedrskega materiala ali materiala. Zamenjava jedrskega materiala, ki je predmet Sporazuma, z jedrskim materialom nižje kakovosti, je dovoljena le ob pristanku obeh uprav.
4.2. Upravi ne bosta uporabljali načel ustreznosti in sorazmernosti na način, ki bi povzročil zmanjšanje celotne količine jedrskega materiala ali materiala, ki je predmet neproliferacijskih obveznosti.
4.3. Pri fizikalnih/kemičnih procesih, kjer je jedrski material, ki je predmet Sporazuma, le del vsega predelanega jedrskega materiala, bo za izdelke, stranske produkte, odpadke in izgube upoštevano preprosto načelo sorazmernosti. Kadar se v procesu mešajo različne vrste jedrskega materiala, bodo osnove za sorazmernost relativne količine pomembnega izotopa ali elementa.
4.4. Pri procesih obsevanja, kjer jedrski material, ki je predmet Sporazuma, prispeva k jedrski proizvodnji, bo količina proizvedenega jedrskega materiala iz Sporazuma enakovredna s prispevkom prvotnega jedrskega materiala v proizvodnem procesu. S tem namenom bosta upravi posebej obravnavali vsak primer “prispevka k proizvodnji” jedrskih materialov iz Sporazuma.
5. Postopki neposrednih prenosov
5.1. Vnaprejšnja najava. Pred vsakim prenosom jedrskega materiala, materiala, opreme ali tehnologije, ki bodo ob prejemu predmet Sporazuma, bo uprava, ki predstavlja stran, ki je izvršila odpremo, najavila prenos drugi upravi. Najava mora vsebovati informacije, navedene v dodatku A. Vsak prenos tehnologije bo pravočasno najavljen, da bi se lahko izvedla posvetovanja, ki jih zahteva pododstavek (f) I. člena Sporazuma.
5.2. Transport. Ob transportu jedrskega materiala, materiala, opreme ali tehnologije, ki bodo ob prejemu predmet Sporazuma, bo uprava, ki predstavlja stran, ki je izvršila odpremo, obvestila drugo upravo. Obvestilo mora vsebovati informacije, navedene v dodatku A.
5.3. Prejem. Ob prejemu jedrskega materiala, materiala, opreme ali tehnologije ki je predmet Sporazuma, bo uprava, ki predstavlja stran, ki je prejela pošiljko, obvestila drugo upravo. Obvestilo mora vsebovati informacije, navedene v dodatku A.
6. Postopki pri ponovnih prenosih
6.1. Zahteva za ponovni prenos in odgovor. Uprava, ki predstavlja stran, ki je izvršila odpremo, bo zahtevala od druge uprave vnaprejšnjo pisno privolitev, kot to določa V. člen Sporazuma, vsaj 6 tednov pred predlaganim datumom transporta. Zahteva bo vsebovala informacije, navedene v dodatku A. Uprava, na katero je zahteva za vnaprejšnjo pismeno privolitev naslovljena, bo drugi upravi odgovorila najkasneje v 3 tednih po prejemu takšne zahteve.
6.2. Transport. Ob transportu jedrskega materiala, materiala, opreme ali tehnologije, ki bodo ob prejemu predmet Sporazuma, bo uprava, ki predstavlja stran, ki je izvršila odpremo, obvestila drugo upravo. Obvestilo mora vsebovati informacije, navedene v dodatku A.
6.3. Prejem. Ob prejemu jedrskega materiala, materiala, opreme ali tehnologije ki je predmet Sporazuma, bo uprava, ki predstavlja stran, ki je prejela pošiljko, obvestila drugo upravo. Obvestilo mora vsebovati informacije, navedene v dodatku A.
7. Komunikacija
7.1. Pri komuniciranju v zvezi s tem dogovorom bosta upravi uporabili primerno varne kanale. Kontaktni naslov pri Upravi Republike Slovenije za jedrsko varnost je:

7.2. Upravi bosta poskrbeli za primeren nadzor za preprečevanje nepooblaščenega odkritja zaupnih informacij v zvezi s tem dogovorom in bosta druga drugo obveščali o informacijah, ki zahtevajo posebno zaščito.
8. Splošno
8.1. Upravi ne bosta imeli druga do druge nobenih zahtev po povrnitvi stroškov priprave kakršnihkoli poročil, ki jih predvideva ta dogovor.
8.2. Ta dogovor se lahko kadarkoli dopolni, če se upravi tako dogovorita. Dodatki bodo pisni in postanejo veljavni, ko jih podpišejo predstavniki obeh uprav.
8.3. Ta dogovor postane veljaven, ko ga podpišejo predstavniki obeh uprav in ko postane za Slovenijo in Kanado veljaven Sporazum.

(a) Referenčna številka, ki jo določi uprava, ki predstavlja stran, ki je izvršila odpremo;
(b) Ime in naslov odpremnika;
(c) Ime in naslov prejemnika;
(d) Datum(i) odpreme ali prejema, kadar je to smiselno;
(e) Opis (npr. kemična oblika, fizična oblika, identifikacijske številke);
(f) Element ali materialna teža in kategorija, število kosov opreme ali tehnologije, kadar je to smiselno, in
(g) Teža izotopov, kadar je to smiselno.
ADMINISTRATIVE ARRANGEMENT
BETWEEN THE SLOVENIAN NUCLEAR SAFETY ADMINISTRATION AND ATOMIC ENERGY CONTROL BOARD OF CANADA PURSUANT TO THE AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF CANADA FOR CO-OPERATION IN THE PEACEFUL USES OF NUCLEAR ENERGY
1. Purpose
1.1 To facilitate the effective fulfilment of the obligations of the Agreement between the Government of the Republic of Slovenia and the Government of Canada for Co-operation in the Peaceful Uses of Nuclear Energy, signed on May 31, 1995, the Slovenian Nuclear Safety Administration and the Atomic Energy Control Board of Canada (hereinafter referred to as “the Authorities”), in accordance with Article X, paragraph (2), of the Agreement, hereby establish the following Administrative Arrangement.
2. Definitions and Conventions
2.1 In this Arrangement the terms “nuclear material”, “material”, “equipment” and “technology” have the same meaning as in the Agreement. Other terms used in this Arrangement have the same meaning as they have in paragraphs 98 – 116 of the International Atomic Energy Agency (IAEA) document INFCIRC/153 (corrected).
2.2 In this Arrangement the units of account for nuclear material will be as specified in paragraph 101 of INFCIRC/153 (corrected). For material, the unit of account will be kilograms.
3. Annual Report
3.1 Each Authority will provide the other with an Annual Report, covering the twelve month period ending in December, on all nuclear material, material, equipment and technology subject to the Agreement in its territory. The Annual Report will be provided as soon as possible and not later than 3 months after the close of each period.
3.2 For nuclear material and material, each Authority will provide for each of the following categories in its Annual Report:
(a) Natural uranium
(b) Uranium enriched to less than 20 per cent in the isotope U235
(c) Uranium enriched to 20 per cent or more in the isotope U235
(d) Depleted uranium
(e) Uranium 233
(f) Plutonium
(g) Thorium
(h) Heavy Water
3.3 For each category of nuclear material and material, as well as for equipment and technology, each Authority will show in its Annual Report, as appropriate:
(a) Opening inventory
(b) Receipts
(c) Shipments
(d) Other inventory changes as well as changes which arise from Articles IV and VIII of the Agreement
(e) Closing inventory
3.4 Where necessary, each Authority will append a note in its Annual Report to explain any information included in the Annual Report. A note will be appended where, in the period covered by the Report, IAEA safeguards have been terminated on nuclear material subject to the Agreement or exemption, compatible with the Agreement, of such material from IAEA safeguards has been granted.
3.5 Each Authority will acknowledge receipt of the other’s Annual Report within 30 days.
3.6 Each Authority will provide the other with any questions it may have concerning the entries in the Annual Report normally within 90 days of receipt of the Report.
3.7 Each Authority will cooperate closely with the other and afford the other every reasonable assistance in resolving such questions to their mutual satisfaction by the end of the calendar year.
4. Equivalence and Proportionality
4.1 Each Authority need not identify in its Annual Report the particular nuclear material or material originally subject to the Agreement but will identify an equivalent quantity of nuclear material or material. The replacement of nuclear material subject to the Agreement by lower quality nuclear material may only occur where the Authorities so decide.
4.2 Each Authority will not apply the principles of equivalence and proportionality so as to result in any reduction to the total quantity of nuclear material or material subject to non-proliferation obligations.
4.3 In physical/chemical processes where nuclear material subject to the Agreement is only part of the total nuclear material processed, the simple proportionality principle will apply to the product, by-product, waste and losses of the process. Where the process involves the mixing of different types of nuclear material, proportionality will be based on the relative quantities of the isotope or element of significance.
4.4 In irradiation processes where nuclear material subject to the Agreement contributes to nuclear production, the quantity of produced nuclear material subject to the Agreement will be equivalent to the contribution to the production process made by the original nuclear material. For this purpose “contribution to production” by nuclear material subject to the Agreement will be discussed by the Authorities on a case-by-case basis.
5. Procedures for Direct Transfers
5.1 Prior Notification. Prior to any transfer of nuclear material, material, equipment or technology that will be subject to the Agreement upon receipt, the Authority representing the shipping Party will notify the other Authority of the transfer by providing the information specified in Annex A. Each notification concerning transfer of technology will be made sufficiently in advance of the transfer to allow time for the completion of the consultations required by Article I, sub-paragraph (f), of the Agreement.
5.2 Shipment. Upon shipment of nuclear material, material, equipment, or technology that will be subject to the Agreement upon receipt, the Authority representing the shipping Party will inform the other Authority by providing the information specified in Annex A.
5.3 Receipt. Upon receipt of nuclear material, material, equipment, or technology subject to the Agreement, the Authority representing the receiving Party will inform the other Authority by providing the information specified in Annex A.
6. Procedures for Retransfers
6.1 Retransfer Request and Response. The Authority, representing the shipping Party, will request the other Authority for the prior written consent required by Article V of the Agreement at least 6 weeks before the proposed shipping date or schedule. The request will include the information specified in Annex A. The Authority to whom the request for prior written consent is made will respond to the other Authority within 3 weeks following receipt of that request.
6.2 Shipment. Upon shipment of nuclear material, material, equipment or technology subject to the Agreement, the Authority representing the shipping Party will inform the other Authority by providing the information specified in Annex A.
6.3 Receipt. Upon receipt of nuclear material, material, equipment or technology subject to the Agreement, the Authority representing the receiving Party will inform the other Authority by providing the information specified in Annex A.
7. Communications
7.1 When communicating pursuant to this Arrangement each Authority will use appropriately secure channels. The point of contact within the Slovenian Nuclear Safety Administration is:

7.2 Each Authority will take every reasonable precaution to prevent unauthorized disclosure of information provided in confidence to it under this Arrangement and will advise the other of information requiring special protection.
8. General
8.1 Neither Authority will have any liability to the other for the costs of preparing any reports required by this Arrangement.
8.2 This Arrangement may be amended as agreed by the Authorities at any time. Amendments will be made in writing and will become effective when signed on behalf of the Authorities.
8.3 This Arrangement will become effective when it has been signed on behalf of the Authorities, and when the Agreement enters into force for both Slovenia and Canada.

Za izvajanje tega upravnega dogovora skrbi Ministrstvo za okolje in prostor – Uprava Republike Slovenije za jedrsko varnost.
4. člen
Ta uredba začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
