Razglašam Zakon o ratifikaciji Sporazuma med Vlado Republike Slovenije in Organizacijo za gospodarsko sodelovanje in razvoj o privilegijih, imunitetah in ugodnostih, ki se podeljujejo organizaciji, ter izmenjanih pisem (MSOGSP), ki ga je sprejel Državni zbor Republike Slovenije na seji 21. maja 2010.

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN ORGANIZACIJO ZA GOSPODARSKO SODELOVANJE IN RAZVOJ O PRIVILEGIJIH, IMUNITETAH IN UGODNOSTIH, KI SE PODELJUJEJO ORGANIZACIJI, TER IZMENJANIH PISEM (MSOGSP)
1. člen
Ratificirajo se Sporazum med Vlado Republike Slovenije in Organizacijo za gospodarsko sodelovanje in razvoj o privilegijih, imunitetah in ugodnostih, ki se podeljujejo organizaciji, podpisan 21. januarja 2010 v Parizu, ter izmenjani pismi z dne 21. januarja 2010.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku, izmenjani pismi pa v izvirniku v angleškem jeziku ter prevodu v slovenskem jeziku glasijo:(1)
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN ORGANIZACIJO ZA GOSPODARSKO SODELOVANJE IN RAZVOJ O PRIVILEGIJIH, IMUNITETAH IN UGODNOSTIH, KI SE PODELJUJEJO ORGANIZACIJI
VLADA REPUBLIKE SLOVENIJE IN ORGANIZACIJA ZA GOSPODARSKO SODELOVANJE IN RAZVOJ (V NADALJNJEM BESEDILU: POGODBENICI) STA SE
OB UPOŠTEVANJU določb Konvencije o Organizaciji za gospodarsko sodelovanje in razvoj z dne 14. decembra 1960 (v nadaljnjem besedilu: konvencija), zlasti točke c 5. člena
SPORAZUMELI:
1. člen
V tem sporazumu:
a) »Vlada« pomeni Vlado Republike Slovenije,
b) »organizacija« pomeni Organizacijo za gospodarsko sodelovanje in razvoj ter vse organe ali agencije, ki pri njej delujejo,
c) »uradniki« pomenijo tisto osebje, za katero veljajo določbe tega sporazuma, ki jih določi generalni sekretar organizacije,
d) »prostori organizacije« pomenijo poslopja ali njihove dele (skupaj s pripadajočim zemljiščem), ki se stalno ali začasno uporabljajo za uradne namene organizacije,
e) »lastnina organizacije« pomeni vso lastnino, skupaj s sredstvi in premoženjem, ki pripada organizaciji ali s katero organizacija ali kdo drug v njenem imenu razpolaga ali jo upravlja,
f) »arhiv organizacije« pomeni vse evidence in korespondenco, dokumente in drugo gradivo, tudi magnetne trakove in filme, zvočne posnetke, programsko opremo in pisno gradivo, videoposnetke in plošče ali nosilce, na katerih so shranjeni informacije ali gradivo, ki pripadajo organizaciji ali s katerimi organizacija ali kdo drug v njenem imenu razpolaga,
g) »članice« pomenijo države, ki so članice organizacije, ali druge subjekte, ki sodelujejo pri delu organizacije v skladu s 13. členom konvencije,
h) »sodelujoče nečlanice« pomenijo države ali gospodarstva, ki niso članice organizacije, ali mednarodne organizacije, ki jih je ta povabila, naj kot opazovalke ali kako drugače sodelujejo na zasedanju, ki ga skliče organizacija,
i) »predstavniki« pomenijo vse delegate, namestnike, svetovalce, tehnične izvedence in administrativno osebje delegacij članic ali sodelujočih nečlanic,
j) »zasedanje, ki ga skliče organizacija« pomeni vsako zasedanje organov organizacije in vsako drugo zasedanje, konferenco, seminar ali srečanje, ki ga ta skliče,
k) »strokovnjaki« pomenijo osebe, ki niso navedene v točki c tega člena in jih organizacija imenuje za opravljanje svojih nalog,
l) »prispevki za pokojninsko ali socialno varnost« pomenijo vse prispevke za pokojninsko ali socialno varnost ne glede na to, ali so povezani z zaposlitvijo uradnikov pri organizaciji, ter vse prispevke za pokojnine ali druge pokojninske prejemke, nadomestila za brezposelnost, zdravstveno zavarovanje in družinske prejemke.
2. člen
Organizacija je pravna oseba. Lahko sklepa pogodbe, pridobi in odtuji premičnine in nepremičnine in začne pravni postopek.
3. člen
Organizacija je upravičena do privilegijev, oprostitev in imunitet iz tega sporazuma ter katerega koli ugodnejšega privilegija, oprostitve in imunitete, ki jih Vlada podeli podobni mednarodni organizaciji.
4. člen
Organizacija in njena lastnina ne glede na to, kje je in kdo z njo razpolaga, uživata imuniteto pred vsemi pravnimi postopki, razen če se organizacija v posameznem primeru izrecno ne odpove imuniteti. Razume pa se, da se odpoved imuniteti ne nanaša na ukrepe izvršbe.
5. člen
Lastnina organizacije ne more biti predmet preiskave, zasega, zaplembe, razlastitve ali drugega upravnega, sodnega ali zakonodajnega ukrepa, ne glede na to, kje je in kdo z njo razpolaga.
6. člen
1. Prostori organizacije, tudi prostori, ki jih ta uporablja med zasedanjem, ki ga skliče organizacija, so nedotakljivi, organizacija pa ima nad njimi izključni nadzor in pristojnost.
2. Vlada z ustreznimi ukrepi zavaruje prostore organizacije, predvsem pa vsaki osebi ali skupini oseb prepreči, da bi nepooblaščeno vstopila v prostore ali povzročala nerede v njihovi neposredni bližini.
7. člen
Arhiv organizacije in na splošno vsi dokumenti, ki ji pripadajo ali jih hrani, so nedotakljivi ne glede na to, kje so.
8. člen
Organizacija lahko, ne da bi jo pri tem omejevali kakršen koli finančni nadzor, predpisi ali moratoriji:
a) hrani sredstva in ima račune v kateri koli valuti,
b) prosto nakazuje sredstva v Republiki Sloveniji, na njeno ozemlje in z njega ter zamenja vsako valuto za drugo valuto pod enakimi pogoji, kot veljajo za druge mednarodne organizacije ali tuje vlade.
9. člen
Organizacija in njena lastnina sta oproščeni:
a) vseh vrst neposredne obdavčitve, skupaj s prispevki za pokojninsko ali socialno varnost v skladu s točko c prvega odstavka 13. člena sporazuma; pri čemer pa organizacija ne bo zahtevala oprostitve plačila pristojbin in davkov, ki pomenijo samo plačilo komunalnih storitev;
b) carin, prepovedi in omejitev v zvezi z blagom, ki ga organizacija uvozi ali izvozi za delovanje ali opravljanje svojih dejavnosti;
c) carin, prepovedi in omejitev v zvezi z uvozom in izvozom publikacij ali davkov od prodaje publikacij ali drugega blaga ali storitev organizacije;
d) vseh vrst posredne obdavčitve blaga in storitev, ki jih organizacija kupi za delovanje ali opravljanje svojih dejavnosti, skupaj z davki, vključenimi v ceno tega blaga in storitev, pod enakimi pogoji, kot veljajo za diplomatska predstavništva v Republiki Sloveniji.
10. člen
1. V zvezi s prednostnim prenosom, pristojbinami in davki na poštne pošiljke, kablograme, telegrame, radiograme, telefotografije, telefakse, telefonijo, elektronske in druge komunikacije ter zakup prostora v tiskanih in radijskih medijih Republika Slovenija uradnih komunikacij organizacije ne sme obravnavati manj ugodno kot komunikacije drugih mednarodnih organizacij ali tujih vlad in njihovih diplomatskih predstavništev. Korespondenca in druge vrste komunikacije organizacije se ne cenzurirajo.
2. Organizacija ima pravico do šifriranja svojih sporočil ter pošiljanja in prejemanja korespondence ter drugih listin in dokumentov po kurirju.
11. člen
Organizaciji so na voljo osnovne javne storitve pod enakimi pogoji kot diplomatskim predstavništvom v Republiki Sloveniji.
12. člen
1. Predstavniki članic in sodelujočih nečlanic v Svetu ali drugem organu organizacije ali na zasedanju, ki ga skliče organizacija, med opravljanjem svoje funkcije ter med potovanjem v kraj zasedanja in iz njega uživajo privilegije, imunitete in ugodnosti iz enajstega in dvanajstega odstavka 4. člena Konvencije o privilegijih in imunitetah Združenih narodov z dne 13. februarja 1946.
2. Privilegiji, imunitete in ugodnosti se predstavnikom članic in sodelujočih nečlanic ne podeljujejo v njihovo osebno korist, pač pa za zaščito njihove funkcije v zvezi z organizacijo. Članica ali sodelujoča nečlanica zato nima le pravice, pač pa tudi dolžnost, da se odreče imuniteti svojega predstavnika, če bi po njenem mnenju ta ovirala sodni postopek, odpoved imuniteti pa ne bi škodila namenu, za katerega je bila podeljena.
13. člen
1. Uradniki organizacije:
a) uživajo imuniteto pred odvzemom prostosti in pridržanjem zaradi dejanj, storjenih po uradni dolžnosti, ter pred zasegom prtljage in druge lastnine;
b) uživajo imuniteto pred pravnimi postopki zaradi izgovorjenih ali zapisanih besed in dejanj, ki jih storijo kot uradniki ali v zvezi s svojo zaposlitvijo pri organizaciji; tako imuniteto uživajo tudi po izteku funkcije uradnika;
c) so oproščeni vseh vrst neposredne obdavčitve plač, honorarjev, nadomestil, pokojnin ali drugih prejemkov, ki jim jih izplača organizacija, tudi prispevkov za pokojninsko ali socialno varnost. Če organizacija v Republiki Sloveniji zaposli osebje, ki pri njej nima zagotovljene sheme socialne varnosti, se to osebje vključi v sistem socialnega varstva Republike Slovenije, s tem povezani prispevki pa se plačujejo v skladu s slovensko zakonodajo s področja socialnega varstva;
d) so skupaj z zakonci, partnerji in družinskimi člani, kot jih priznava organizacija, izvzeti iz omejitev priseljevanja in prijave tujcev;
e) so oproščeni vojaške obveznosti v državi;
f) imajo skupaj z zakonci, partnerji in družinskimi člani, kot jih priznava organizacija, v primerih mednarodne krize pri vrnitvi v državo sedeža organizacije ali domovino enake ugodnosti kot člani diplomatskih predstavništev;
g) imajo pravico, da ob prvem nastopu položaja v Republiki Sloveniji in v enem letu po prihodu v Republiko Slovenijo brez carine uvozijo svoje pohištvo in osebne predmete;
h) imajo enake privilegije glede valut in menjave kot diplomatski uslužbenci primerljivega ranga;
i) so oproščeni obveznosti varščine za blago, začasno uvoženo v Republiko Slovenijo;
j) imajo pravico do šifriranja svojih sporočil organizaciji ter pošiljanja in prejemanja korespondence ter drugih listin in dokumentov po kurirju.
2. Točka g prvega odstavka se ne uporablja za slovenske državljane, ki imajo v času, ko jih organizacija napoti v Republiko Slovenijo, v njej stalno prebivališče.
14. člen
Poleg privilegijev, imunitet in ugodnosti iz 13. člena:
1. generalni sekretar organizacije uživa enake privilegije, imunitete in ugodnosti kot vodje diplomatskih predstavništev; njegov zakonec ali partner in otroci do 18. leta starosti, kot jih priznava organizacija, pa uživajo enake privilegije, imunitete in ugodnosti kot družinski člani, ki so del gospodinjstva vodje diplomatskega predstavništva;
2. namestniki in pomočniki generalnega sekretarja uživajo enake privilegije, imunitete in ugodnosti kot diplomatski uslužbenci primerljivega ranga; njihovi zakonci ali partnerji in otroci do 18. leta starosti, kot jih priznava organizacija, pa uživajo enake privilegije, imunitete in ugodnosti kot družinski člani, ki so del gospodinjstva diplomatskih uslužbencev primerljivega ranga.
15. člen
Strokovnjaki, ki opravljajo naloge za organizacijo, in posamezniki, povabljeni na zasedanje, ki ga skliče organizacija, med opravljanjem naloge, tudi na poteh v zvezi z njo, na ozemlju Republike Slovenije uživajo privilegije, imunitete in ugodnosti, potrebne za neodvisno opravljanje njihovih nalog. Strokovnjakom so podeljene zlasti:
a) imuniteta pred odvzemom prostosti in pridržanjem ter zasegom prtljage in druge lastnine;
b) imuniteta pred pravnimi postopki zaradi izgovorjenih ali zapisanih besed in dejanj, ki jih storijo med opravljanjem naloge; tako imuniteto uživajo tudi po opravljeni nalogi;
c) nedotakljivost vseh dokumentov in listin;
d) pravica do šifriranja sporočil organizaciji ter pošiljanja in prejemanja korespondence ter drugih listin in dokumentov po kurirju;
e) enake ugodnosti glede valutnih in menjalnih omejitev kot predstavnikom tujih vlad na začasnih uradnih misijah;
f) oprostitev od obveznosti varščine za blago, začasno uvoženo v Republiko Slovenijo.
16. člen
Uradniki in strokovnjaki uživajo privilegije, imunitete in ugodnosti v interesu organizacije, in ne v svojo osebno korist. Generalni sekretar organizacije ima pravico in dolžnost odreči imuniteto vsakemu uradniku ali strokovnjaku, kadar koli po njegovem izključnem mnenju taka imuniteta ovira sodni postopek in jo je mogoče odreči brez škode za interese organizacije. Generalnemu sekretarju, njegovim namestnikom in pomočnikom lahko imuniteto odreče Svet organizacije.
17. člen
Vlada z vsemi primernimi ukrepi olajša vstop v Republiko Slovenijo, bivanje na njenem ozemlju in odhod iz nje ter zagotovi prosto gibanje predstavnikov članic in sodelujočih nečlanic, uradnikov in strokovnjakov ter vseh drugih oseb, ki jih organizacija povabi v uradne namene.
18. člen
Organizacija ves čas sodeluje z Vlado, da olajša učinkovito vodenje sodnih postopkov ter prepreči zlorabe v zvezi s privilegiji, imunitetami, oprostitvami in ugodnostmi iz sporazuma.
19. člen
Vlada z namenom, da organizaciji omogoči celovito in učinkovito opravljanje dolžnosti in nalog:
a) pomaga pri odpravljanju težav, ki bi jih organizacija utegnila imeti pri zagotavljanju blaga, storitev in zmogljivosti na ozemlju Republike Slovenije, ter pri dejanskem uveljavljanju privilegijev, imunitet in ugodnosti, ki so ji priznane;
b) organizaciji povrne stroške ali nadomesti izgube, ki nastanejo zaradi tega, ker kateri koli javni organ v Republiki Sloveniji ne spoštuje privilegijev, imunitet in ugodnosti, vsebovanih v sporazumu ali priznanih na njegovi podlagi.
20. člen
Sporazum se razlaga in izvaja v skladu z njegovim osnovnim namenom, omogočiti organizaciji celovito in učinkovito opravljanje dolžnosti in nalog.
21. člen
1. Pogodbenici skušata vse spore v zvezi z razlago ali izvajanjem sporazuma rešiti s pogajanji ali na drug dogovorjen način.
2. Če se spor v šestdesetih dneh ne reši v skladu s prvim odstavkom, se lahko na zahtevo katere koli pogodbenice predloži v arbitražo.
3. Arbitražno sodišče sestavljajo trije arbitri. Vsaka pogodbenica izbere po enega, tretjega, predsednika sodišča, pa pogodbenici izbereta skupaj. Če arbitražno sodišče ni ustanovljeno v treh mesecih od dne, ko je vložena zahteva za arbitražo, arbitre, ki še niso določeni, na zahtevo katere koli pogodbenice imenuje generalni sekretar Stalnega arbitražnega sodišča.
4. Arbitražno sodišče uporablja določbe tega sporazuma ter načela in pravila mednarodnega prava, njegova odločitev pa je dokončna in zavezujoča za obe pogodbenici.
22. člen
1. Sporazum začne veljati z dnem, ko Vlada obvesti organizacijo, da so izpolnjene notranjepravne zahteve za njegovo uveljavitev.
2. Z začetkom veljavnosti tega sporazuma se razveljavi Sporazum med Republiko Slovenijo in Organizacijo za gospodarsko sodelovanje in razvoj o privilegijih, imunitetah in ugodnostih, ki se podeljujejo organizaciji, podpisan 9. februarja 1996, ki je začel veljati 10. decembra 1997.
23. člen
Če Republika Slovenija preneha biti pogodbenica konvencije, se sporazum lahko odpove soglasno ali s pisnim obvestilom o odpovedi ene od pogodbenic. Pisno obvestilo o odpovedi začne veljati ne prej kot eno leto po tem, ko ga druga pogodbenica prejme.
24. člen
Pogodbenici lahko skleneta dopolnilne sporazume, ki bi utegnili biti potrebni v okviru tega sporazuma.
Sestavljeno v Parizu, dne 21. januarja 2010 v dveh izvirnikih v angleškem, francoskem in slovenskem jeziku, pri čemer so vsa besedila enako verodostojna. Pri razlikah v razlagi prevlada angleško besedilo.

Spoštovani minister,
v čast mi je zapisati, da sta se v zvezi s Sporazumom med Vlado Republike Slovenije in Organizacijo za gospodarsko sodelovanje in razvoj o privilegijih, imunitetah in ugodnostih, ki se podeljujejo Organizaciji, podpisanim 21. januarja 2010 (v nadaljnjem besedilo: sporazum) pogodbenici dogovorili:
Za učinkovitejše izvajanje 13. člena sporazuma se Vladi sporočijo imena uradnikov, ki jih Organizacija napoti v Republiko Slovenijo, ko ti prevzamejo svoje naloge.
Oprostitev plačevanja prispevkov za pokojninsko ali socialno varnost iz točke c) prvega odstavka 13. člena sporazuma ne izključuje možnosti, da se uradniki na lastne stroške prostovoljno vključijo v sistem pokojninske in socialne varnosti Republike Slovenije pod pogoji, določenimi s slovensko zakonodajo.
Pogodbenici začneta pogajanja za sklenitev sporazuma, ki bo omogočil prenos pokojninskih pravic iz sistema pokojninskega zavarovanja Republike Slovenije v sistem pokojninskega zavarovanja Organizacije osebam, ki so bile zaposlene v Republiki Sloveniji in so se zatem zaposlile v Organizaciji, in za prenos pokojninskih pravic iz sistema pokojninskega zavarovanja Organizacije v sistem pokojninskega zavarovanja Republike Slovenije za nekdanje uradnike Organizacije, ki se zaposlijo v Republiki Sloveniji.
Če se Vlada Republike Slovenije strinja z navedenim, mi je v čast predlagati, da to pismo in odgovor Vaše ekscelence sestavljata dogovor med pogodbenicama, ki začne veljati isti dan kot Sporazum med Vlado Republike Slovenije in Organizacijo za gospodarsko sodelovanje in razvoj o privilegijih, imunitetah in ugodnostih, ki se podeljujejo Organizaciji, podpisan 21. januarja 2010.

Spoštovani gospod generalni sekretar,
v čast mi je, da v imenu Vlade Republike Slovenije potrdim prejem Vašega pisma z dne 21. januarja 2010, ki se glasi:
»V čast mi je zapisati, da sta se v zvezi s Sporazumom med Vlado Republike Slovenije in Organizacijo za gospodarsko sodelovanje in razvoj o privilegijih, imunitetah in ugodnostih, ki se podeljujejo Organizaciji, podpisanim 21. januarja 2010 (v nadaljnjem besedilu: sporazum) pogodbenici dogovorili:
Za učinkovitejše izvajanje 13. člena sporazuma se Vladi sporočijo imena uradnikov, ki jih Organizacija napoti v Republiko Slovenijo, ko ti prevzamejo svoje naloge.
Oprostitev plačevanja prispevkov za pokojninsko ali socialno varnost iz točke c) prvega odstavka 13. člena sporazuma ne izključuje možnosti, da se uradniki na lastne stroške prostovoljno vključijo v sistem pokojninske in socialne varnosti Republike Slovenije pod pogoji, določenimi s slovensko zakonodajo.
Pogodbenici začneta pogajanja za sklenitev sporazuma, ki bo omogočil prenos pokojninskih pravic iz sistema pokojninskega zavarovanja Republike Slovenije v sistem pokojninskega zavarovanja Organizacije osebam, ki so bile zaposlene v Republiki Sloveniji in so se zatem zaposlile v Organizaciji, in za prenos pokojninskih pravic iz sistema pokojninskega zavarovanja Organizacije v sistem pokojninskega zavarovanja Republike Slovenije za nekdanje uradnike Organizacije, ki se zaposlijo v Republiki Sloveniji.
Če se Vlada Republike Slovenije strinja z navedenim, mi je v čast predlagati, da to pismo in odgovor Vaše ekscelence sestavljata dogovor med pogodbenicama, ki začne veljati isti dan kot Sporazum med Vlado Republike Slovenije in Organizacijo za gospodarsko sodelovanje in razvoj o privilegijih, imunitetah in ugodnostih, ki se podeljujejo Organizaciji, podpisan 21. januarja 2010.«
V čast mi je sporočiti, da Vlada Republike Slovenije soglaša s predlaganim dogovorom in da Vaše pismo in ta odgovor sestavljata dogovor med pogodbenicama, ki začne veljati isti dan kot Sporazum med Vlado Republike Slovenije in Organizacijo za gospodarsko sodelovanje in razvoj o privilegijih, imunitetah in ugodnostih, ki se podeljujejo Organizaciji.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE ORGANISATION FOR ECONOMIC CO-OPERATION AND DEVELOPMENT ON THE PRIVILEGES, IMMUNITIES AND FACILITIES GRANTED TO THE ORGANISATION
THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE ORGANISATION FOR ECONOMIC CO-OPERATION AND DEVELOPMENT (HEREINAFTER REFERRED TO AS “THE PARTIES”),
HAVING REGARD to the provisions of the Convention on the Organisation for Economic Cooperation and Development of 14 December 1960 (hereinafter referred to as “the OECD Convention”), in particular Article 5 c);
HAVE AGREED as follows:
Article 1
For the purposes of this Agreement:
(a) “Government” means the Government of the Republic of Slovenia;
(b) “Organisation” means the Organisation for Economic Co-operation and Development and all the entities or agencies functioning under its framework;
(c) “officials” means the categories of staff to which the provisions of this Agreement apply as specified by the Secretary-General of the Organisation;
(d) “premises of the Organisation” means buildings or parts thereof (including the land ancillary thereto), utilised permanently or temporarily for official purposes of the Organisation;
(e) “property of the Organisation” means all property, including funds and assets, belonging to the Organisation or held or administered by the Organisation or on its behalf;
(f) “archives of the Organisation” means all records and correspondence, documents and other material, including tapes and films, sound recordings, computer software and written material, video tapes and discs or support storing any information or material belonging to or held by the Organisation or on its behalf;
(g) “Members” means countries which are Members of the Organisation or other entities which participate in the work of the Organisation in pursuance of Article 13 of the OECD Convention;
(h) “non member participants” means countries or economies which are not Members of the Organisation, or international organisations which have received an invitation from the Organisation to participate, as observers or on any other basis, in a meeting convened by the Organisation;
(i) “representatives” means all delegates, alternates, advisers, technical experts and secretaries of delegations of Members or non member participants;
(j) “meeting convened by the Organisation” means any meeting of a body of the Organisation, and any other meeting, conference, seminar or gathering convened by the Organisation;
(k) “experts” means persons other than those mentioned in paragraph c) of this Article, who are appointed by the Organisation to carry out missions for the Organisation;
(l) “charges for pension or social security purposes” means all charges related to pension or social security coverage, whether or not such charges are related to the employment of officials by the Organisation and including all charges related to pensions or retirement benefits, unemployment benefits, health insurance and family benefits.
Article 2
The Organisation possesses juridical personality. It has the capacity to conclude contracts, to acquire and dispose of movable and immovable property and to institute legal proceedings.
Article 3
The Organisation shall be granted the privileges, exemptions and immunities provided for in this Agreement and any more favourable privilege, exemption and immunity which the Government has agreed to provide to an international organisation of a similar kind.
Article 4
The Organisation and its property, wherever located and by whomsoever held, shall enjoy immunity from every form of legal process except insofar as in any particular case it has expressly waived its immunity. It is, however, understood that no waiver of immunity shall extend to any measure of execution.
Article 5
The property of the Organisation, wherever located and by whomsoever held, shall not be subject to search, requisition, confiscation, expropriation or any other form of interference whether by administrative, judicial or legislative action.
Article 6
1. The premises of the Organisation, including premises utilised by the Organisation for the duration of a meeting convened by the Organisation, shall be inviolable and shall be under its exclusive control and authority.
2. The Government shall take appropriate measures to ensure the security of the Organisation's premises; in particular, it shall prevent any person, or group of persons from penetrating without authorisation into the premises or causing disorder in the immediate vicinity thereof.
Article 7
The archives of the Organisation, and more generally all documents belonging to it or held by it, shall be inviolable wherever located.
Article 8
Without being restricted by financial controls, regulations or moratoria of any kind:
(a) the Organisation may hold currency of any kind and operate accounts in any currency;
(b) the Organisation may freely transfer its funds within, into and out of the territory of the Republic of Slovenia and convert any currency held by it into any other currency under the same conditions as those which apply to other international organisations or to any foreign government.
Article 9
The Organisation and its property shall be exempt from:
(a) any form of direct taxation including charges for pension or social security purposes subject to Article 13(1)(c) of this Agreement; however, the Organisation will not claim exemption from rates and taxes which constitute no more than a payment for public utilities;
(b) duties, prohibitions and restrictions in respect of goods imported or exported by the Organisation for its own functioning or in pursuance of its activities;
(c) duties, prohibitions and restrictions in respect of import and export of publications or any taxes in respect of the sales of its publications or other goods produced or services provided by it;
(d) any form of indirect taxation on goods and services purchased by the Organisation for its own functioning or in pursuance of its activities, including taxes forming part of the price to be paid for such goods and services, under the same conditions as applicable for diplomatic missions in the Republic of Slovenia.
Article 10
1. The Organisation shall enjoy, for its official communications, treatment not less favourable than that accorded by the Republic of Slovenia to any international organisation or foreign government, including its diplomatic mission, in the matter of priorities, rates and taxes on mails, cables, telegrams, radiograms, telephotos, telefaxes, telephone, electronic communications and other communications and press rates for information to the press and radio. No censorship shall be applied to the correspondence and other communications of the Organisation.
2. The Organisation shall enjoy the right, for its communications, to use codes and to send and receive correspondence and other papers and documents by courier.
Article 11
Essential public services shall be made available to the Organisation on the same basis and conditions as those which apply to diplomatic missions in the Republic of Slovenia.
Article 12
1. Representatives of Members and non member participants in the OECD Council or in any other body of the Organisation or participating in a meeting convened by the Organisation shall, while exercising their functions and during their journey to and from the place of meeting, enjoy the privileges, immunities and facilities provided for by Article IV sections 11 and 12 of the Convention on the Privileges and Immunities of the United Nations of 13 February 1946.
2. Privileges, immunities and facilities are accorded to the representatives of Members and non member participants in order to safeguard their functions in connection with the Organisation and not for their personal benefit. Consequently, a Member or a non member participant has not only the right but also the duty to waive the immunity of its representative in any case where, in the opinion of the Member or non member participant, the immunity would impede the course of justice, and it can be waived without prejudice to the purpose for which the immunity is accorded.
Article 13
1. Officials of the Organisation shall:
(a) enjoy immunity from arrest and detention for acts performed in their official capacity and from seizure of their baggage and other belongings;
(b) enjoy immunity from legal process for words spoken or written and acts performed in their capacity of official of the Organisation or in the context of their employment with the Organisation; they shall continue to be so immune after completion of their functions as officials of the Organisation;
(c) be exempt from any form of direct taxation, including charges for pension or social security purposes, on salaries, emoluments, indemnities, pensions or other element of remuneration paid to them by the Organisation. Should the Organisation employ persons in the Republic of Slovenia whose social security coverage would not be provided by the Organisation, such persons shall be affiliated to the social security system of the Republic of Slovenia and the associated charges shall be payable according to Slovenian social security legislation;
(d) be exempt, together with their spouses, partners and members of their families, as recognised by the Organisation, from immigration restrictions and alien registration;
(e) be exempt from any national military service;
(f) enjoy, together with their spouses, partners and members of their families, as recognised by the Organisation, the same benefits in cases of international crisis as members of diplomatic missions in respect of repatriation to the country hosting the Organisation’s headquarters or to their country of nationality;
(g) have the right to import free of duty their furniture and effects at the time of first taking up their post in the Republic of Slovenia and within one year after their arrival in the Republic of Slovenia;
(h) be accorded the same privileges in respect of currency and exchange as are accorded to diplomatic agents of comparable rank;
(i) be exempt from any obligation to deposit security payable in respect of goods temporarily admitted into the Republic of Slovenia;
(j) enjoy the right, for the purpose of communicating with the Organisation, to use codes and to send and receive correspondence and other papers and documents by courier.
2. Subparagraph 1(g) shall not apply to Slovenian nationals who are resident in the Republic of Slovenia at the time of their posting by the Organisation in the Republic of Slovenia.
Article 14
In addition to the privileges, immunities and facilities mentioned in Article 13:
(a) the Secretary-General of the Organisation shall enjoy the privileges, immunities and facilities granted to the heads of diplomatic missions; his/her spouse or partner and children under the age of 18, as recognised by the Organisation, shall enjoy the privileges, immunities and facilities granted to the members of family forming part of the household of heads of diplomatic missions;
(b) the Deputy and Assistant Secretaries-General shall enjoy the privileges, immunities and facilities granted to diplomatic agents of comparable rank; their spouses or partners and children under the age of 18, as recognised by the Organisation, shall enjoy the privileges, immunities and facilities granted to the members of family forming part of the household of diplomatic agents of comparable rank.
Article 15
Experts performing missions for the Organisation and individuals invited to participate in a meeting convened by the Organisation, shall enjoy, in the territory of the Republic of Slovenia, such privileges, immunities and facilities as are necessary for the independent exercise of their functions during the period of their missions, including time spent on journeys in connection with their missions. In particular experts shall enjoy:
(a) immunity from personal arrest or detention and from seizure of their baggage and other belongings;
(b) immunity from legal process in respect of words spoken or written, and of all acts done in the performance of their mission; such immunity shall continue after the completion of their mission;
(c) inviolability for all papers and documents;
(d) the right, for the purpose of communicating with the Organisation, to use codes and to send and receive correspondence and other papers and documents by courier;
(e) the same facilities with respect to currency and exchange restrictions as are accorded to a representative of a foreign government on temporary official mission;
(f) exemption from any obligation to deposit security payable in respect of goods temporarily admitted into the Republic of Slovenia.
Article 16
Privileges, immunities and facilities are granted to officials and experts in the interest of the Organisation and not for the sake of personal profit. The Secretary-General of the Organisation shall have the right and duty to waive the immunity of any official or expert where, in his exclusive opinion, the immunity of this official or expert would impede the course of justice and can be waived without prejudice to the interests of the Organisation. In the case of the Secretary-General and the Deputy and Assistant Secretaries-General of the Organisation, the Council of the Organisation shall have the right to waive immunity.
Article 17
The Government shall take all appropriate measures to facilitate the entry into, stay in, and exit from the territory of the Republic of Slovenia, and to ensure the freedom of movement within such territory of representatives of Members and non member participants, officials and experts of the Organisation and any other person invited by the Organisation for official purposes.
Article 18
The Organisation shall co-operate at all times with the Government to facilitate the proper administration of justice and prevent the occurrence of any abuse in connection with the privileges, immunities, exemptions and facilities mentioned in this Agreement.
Article 19
In order to enable the Organisation to fully and efficiently discharge its responsibilities and fulfil its tasks:
(a) the Government shall assist the Organisation in resolving any difficulty the Organisation may encounter with the procurement of goods, services and facilities in the territory of the Republic of Slovenia and in ensuring effective respect for the privileges, immunities and facilities accorded to it; and
(b) the Government shall reimburse or compensate the Organisation for costs or losses incurred as a result of the failure of any public authority of Slovenia to respect the privileges, immunities and facilities set out in this Agreement or granted in its pursuance.
Article 20
This Agreement shall be interpreted and applied in the light of its primary purpose which is to enable the Organisation to fully and efficiently discharge its responsibilities and fulfil its tasks.
Article 21
1. The Parties shall attempt to settle any dispute as to the interpretation or application of this Agreement by negotiations or by any other mutually agreed method.
2. If the dispute is not settled in accordance with paragraph 1 within a period of sixty days, it shall, at the request of either Party, be referred to arbitration.
3. The arbitral tribunal shall be composed of three arbitrators. Each Party shall choose one arbitrator and the third, who shall be the chairman of the tribunal, shall be chosen jointly by the Parties. If the tribunal is not constituted within three months from the request for arbitration, the appointment of the arbitrator(s) not yet designated shall be made by the Secretary-General of the Permanent Court of Arbitration at the request of either Party.
4. The tribunal shall apply the provisions of the present Agreement as well as the principles and rules of international law and its award shall be final and binding on both Parties.
Article 22
1. This Agreement shall enter into force on the date on which the Government shall have informed the Organisation of the completion of the domestic requirements for its entry into force.
2. The present Agreement, on the date of its entry into force, will abrogate the “Agreement between the Organisation for Economic Co-operation and Development and the Republic of Slovenia on the Privileges, Immunities and Facilities granted to the Organisation”, which was signed on 9 February 1996 and entered into force on 10 December 1997.
Article 23
If the Republic of Slovenia ceases to be a party to the OECD Convention, the present Agreement may be terminated by mutual consent or by written notice of termination by either Party. Such written notice of termination shall take effect no earlier than one year after receipt of the notice by the other Party.
Article 24
The Parties may enter into any supplementary agreements as may be necessary within the scope of this Agreement.
Done in Paris this 21(na st) day of January 2010, in two originals, in the English, French and Slovenian languages, each text being authentic. In case of divergence between the texts, the English text shall prevail.

Dear Minister,
I have the honour to record the understanding of the two Parties on the following matter relating to the Agreement between the Government of the Republic of Slovenia and the Organisation for Economic Co-operation and Development on the Privileges, Immunities and Facilities granted to the Organisation signed on 21 January 2010 (hereinafter referred to as “the Agreement”):
For the purpose of facilitating the application of Article 13 of the Agreement, the names of officials posted by the Organisation in the Republic of Slovenia shall be made known to the Government at the beginning of their posting.
With regard to Article 13(1)(c) of the Agreement, the exemption of officials from charges for pension or social security purposes shall not preclude the voluntary affiliation of officials at their own expense to the pension and social security system of the Republic of Slovenia under the conditions stipulated in Slovenian legislation.
The Parties shall undertake negotiations with the objective of concluding an agreement to allow the transfer of retirement pension rights from pension schemes in the Republic of Slovenia to the pension schemes of the Organisation when persons who have been employed in the Republic of Slovenia are subsequently employed by the Organisation and the transfer of pension rights from the pension schemes of the Organisation to pension schemes in the Republic of Slovenia when officials of the Organisation are subsequently employed in the Republic of Slovenia.
If the understanding set out above is acceptable to the Government of the Republic of Slovenia, I have the honour to suggest that this letter and Your Excellency’s reply to it will constitute the understanding of the two Parties which shall come into effect on the same date as the Agreement between the Government of the Republic of Slovenia and the Organisation for Economic Co-operation and Development on the Privileges, Immunities and Facilities granted to the Organisation signed on 21 January 2010.
