O RAZGLASITVI ZAKONA O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO HELENSKE REPUBLIKE O SODELOVANJU V BOJU PROTI KRIMINALU, ŠE POSEBEJ PROTI TERORIZMU, NEZAKONITI TRGOVINI S PREPOVEDANIMI DROGAMI IN ORGANIZIRANEMU KRIMINALU (BGRBKT)
Razglašam Zakon o ratifikaciji Sporazuma med Vlado Republike Slovenije in Vlado Helenske republike o sodelovanju v boju proti kriminalu, še posebej proti terorizmu, nezakoniti trgovini s prepovedanimi drogami in organiziranemu kriminalu (BGRBKT), ki ga je sprejel Državni zbor Republike Slovenije na seji 28. novembra 2003.

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO HELENSKE REPUBLIKE O SODELOVANJU V BOJU PROTI KRIMINALU, ŠE POSEBEJ PROTI TERORIZMU, NEZAKONITI TRGOVINI S PREPOVEDANIMI DROGAMI IN ORGANIZIRANEMU KRIMINALU (BGRBKT)
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Helenske republike o sodelovanju v boju proti kriminalu, še posebej proti terorizmu, nezakoniti trgovini s prepovedanimi drogami in organiziranemu kriminalu, podpisan v Ljubljani 27. septembra 2002.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:*
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN VLADO HELENSKE REPUBLIKE O SODELOVANJU V BOJU PROTI KRIMINALU, ŠE POSEBEJ PROTI TERORIZMU, NEZAKONITI TRGOVINI S PREPOVEDANIMI DROGAMI IN ORGANIZIRANEMU KRIMINALU
Vlada Republike Slovenije in Vlada Helenske republike, v nadaljevanju pogodbenici, sta se,
pripravljeni okrepiti in izboljšati že obstoječe prijateljske odnose in sodelovanje med državama,
zaskrbljeni zaradi nevarnosti razširjanja mednarodnega organiziranega kriminala, mednarodne nezakonite trgovine s prepovedanimi drogami, psihotropnimi snovmi in predhodnimi sestavinami ter mednarodnega terorizma,
ob spoštovanju mednarodnih sporazumov in zakonodaje, ki veljajo v obeh državah, in brez poseganja v obveznosti, ki temeljijo na dvostranskih in večstranskih sporazumih s tretjimi državami,
dogovorili:
1. člen
Pogodbenici sodelujeta in zagotavljata vzajemno pomoč na teh področjih:
a) boj proti mednarodnemu terorizmu,
b) boj proti organiziranemu kriminalu,
c) boj proti nezakonitemu gojenju, proizvodnji in trgovini s prepovedanimi drogami, psihotropnimi snovmi in predhodnimi sestavinami,
d) boj proti nedovoljenim dejavnostim, ki zadevajo orožje, vključno z biološkim, kemičnim in radiološkim orožjem, strelivom, razstrelivi, jedrskimi in radioaktivnimi snovmi ter strupenimi snovmi,
e) boj proti tihotapljenju in nezakonitim mednarodnim gospodarskim dejavnostim in legalizaciji premoženjskih koristi (pranje denarja), ki izvirajo iz kriminalnih dejavnosti,
f) boj proti nezakonitemu priseljevanju in nedovoljeni trgovini z ljudmi,
g) boj proti ponarejanju in spreminjanju katere koli vrste dokumentov,
h) boj proti spreminjanju in ponarejanju bankovcev, kreditnih kartic, vrednostnih papirjev in drugih vrednih predmetov,
i) boj proti kaznivim dejanjem zoper življenje, zdravje, svobodo in spolno nedotakljivost,
j) boj proti kaznivim dejanjem zoper lastnino, še posebej proti tatvinam in nedovoljeni trgovini z vozili,
k) iskanje pogrešanih oseb in oseb, ki so storile kazniva dejanja na ozemlju druge pogodbenice, ter identifikacija trupel,
l) boj proti nedovoljeni trgovini z deli zgodovinske in kulturne dediščine, dragimi kamni in plemenitimi kovinami ter drugimi dragocenimi predmeti,
m) izboljšanje metod in sredstev za vzdrževanje in ponovno vzpostavitev javnega reda in obvladovanje kriznih razmer, kot so na primer ugrabitve prevoznih sredstev in oseb itd.,
n) usposabljanje in izobraževanje policijskega osebja,
o) sodelovanje na kulturnem, športnem in družabnem področju z izmenjavami policijskih delegacij.
Pogodbenici sodelujeta na drugih področjih, ki zadevajo kriminaliteto na splošno, preprečevanje kriminala in vzdrževanje javnega reda, če obstaja vzajemni interes.
2. člen
Sodelovanje med pogodbenicama na področjih iz 1. člena bo potekalo s pomočjo:
a) izmenjave informacij in izkušenj na področjih skupnega interesa;
b) izmenjave izkušenj pri uporabi kriminalistične tehnike ter metod in sredstev kriminoloških raziskav;
c) izmenjave informacij, znanja in izkušenj na področju mejne kontrole ter materialne in tehnične podpore v službah kontrole potnih listov z namenom odkrivanja ponarejenih in spremenjenih potovalnih dokumentov in preprečevanja nezakonitega vstopa in nedovoljenega priseljevanja;
d) izmenjave vzorcev novih potovalnih dokumentov, žigov in vrst vizumov z namenom preprečevanja nezakonitega prehajanja meja in boja proti njemu;
e) izmenjave informacij za preprečevanje in zatiranje vseh oblik kriminala, posebno vseh dejanj terorizma, organiziranega kriminala in nedovoljene trgovine z orožjem in radioaktivnimi snovmi;
f) izmenjave informacij, izkušenj in pomoči v zvezi z novimi metodami proizvodnje prepovedanih drog in psihotropnih snovi, mednarodne trgovine z njimi, prikrivanja in razpečevanja kot tudi v zvezi z novimi metodami boja proti njim iz odstavka c) 1. člena skladno z Enotno konvencijo o mamilih iz leta 1961, ki je bila dopolnjena z dopolnilnim protokolom leta 1972, Konvencijo o psihotropnih substancah iz leta 1971 in Konvencijo Združenih narodov zoper nezakonit promet mamil in psihotropnih snovi iz leta 1988;
g) izmenjave zakonodaje o vprašanjih, ki jih obravnava ta sporazum;
h) izmenjave publikacij in izsledkov znanstvenih raziskav s področij, ki jih obravnava ta sporazum, z organiziranjem in sprejemanjem ukrepov, ki so v skupnem interesu.
3. člen
Da bi izboljšali učinkovitost sodelovanja, pogodbenici organizirata sestanke strokovnjakov v okviru tega sporazuma, kadar soglašata, da je to potrebno.
4. člen
1. Vsaka pogodbenica lahko v celoti ali delno odkloni sodelovanje, kadar bi lahko bila ogrožena njena državna suverenost, varnost ali državni interesi ali bi bilo sodelovanje v nasprotju z njeno notranjo zakonodajo.
O zavrnitvi sodelovanja se druga pogodbenica nemudoma pisno obvesti.
2. Izvajanje tega sporazuma je predmet notranje zakonodaje vsake pogodbenice.
3. Nobena pogodbenica ne sme objaviti ali dati tretji državi zaupnih informacij, razen če druga pogodbenica s tem soglaša.
4. Službi, pristojni za izvajanje tega sporazuma, sta:
 
za Republiko Slovenijo:
Ministrstvo za notranje zadeve, Generalna policijska uprava, Sektor za mednarodno policijsko sodelovanje.
 
za Helensko republiko:
Oddelek za mednarodno policijsko sodelovanje pri Ministrstvu za javni red,
Za neposredno sodelovanje v zelo nujnih primerih pogodbenici izmenjata seznam pooblaščenih služb, ki so pristojne za stike in sodelovanje.
5. člen
1. Pogodbenici ustanovita usklajevalni odbor, odgovoren za izvajanje sporazuma, ki mu predsedujeta minister za notranje zadeve za Republiko Slovenijo in minister za javni red za Helensko republiko ali predstavniki teh ministrstev s sodelovanjem strokovnjakov. Usklajevalni odbor bo tudi zagotavljal uresničevanje in ocenjevanje izvajanja tega sporazuma.
Če je potrebno, lahko na sestankih tega odbora sodelujejo tudi predstavniki drugih ministrstev.
2. Usklajevalni odbor se sestaja izmenično v Sloveniji in Grčiji v času, ki se določi s posvetovanjem.
3. Delovni jezik bo angleščina, ni pa izključena uporaba katerega drugega razširjenega mednarodnega jezika.
6. člen
Pogodbenici se zavezujeta, da bosta med izmenjavo kakršnih koli osebnih podatkov za namene tega sporazuma uporabljali vse ustrezne določbe iz svojih zakonov o varstvu osebnih podatkov.
7. člen
Ta sporazum ne vpliva na pravice in obveznosti iz drugih mednarodnih sporazumov, ki zavezujejo pogodbenici.
8. člen
1. Ta sporazum začne veljati trideseti dan po prejemu zadnjega uradnega obvestila, s katerim se pogodbenici obvestita, da so dokončani vsi ustrezni notranjepravni postopki.
2. Ta sporazum se sklene za nedoločen čas. Pogodbenica ga lahko odpove s tridesetdnevnim odpovednim rokom, o čemer obvesti drugo pogodbenico po diplomatski poti.
3. Pogodbenica lahko kadar koli v celoti ali delno začasno preneha izvajati ta sporazum zaradi državne varnosti, javnega reda in javnega zdravja. O tem obvesti drugo pogodbenico po diplomatski poti.
9. člen
Ta sporazum se lahko spremeni s soglasjem obeh pogodbenic. Vsaka sprememba začne veljati v skladu s postopkom iz prvega odstavka 8. člena.
Podpisano v Ljubljani dne 27. septembra 2002 v dveh izvirnikih v slovenskem, grškem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Pri razlikah v razlagi besedila tega sporazuma prevlada angleško besedilo.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE HELLENIC REPUBLIC ON COOPERATION IN FIGHTING CRIME, ESPECIALLY TERRORISM, ILLICIT DRUG TRAFFICKING AND ORGANIZED CRIME
The Government of the Republic of Slovenia and the Government of the Hellenic Republic, hereinafter referred to as “the Parties”,
expressing their willingness to strengthen and improve the already existing friendly and co-operative relations between the two States,
expressing their concern about the danger of the spreading of international organized crime, international illicit trafficking in narcotic drugs, psychotropic substances and precursors, as well as international terrorism,
respecting the international agreements and legislation existing in both States and without prejudice to their previous commitments, based on bilateral and multilateral agreements with third countries,
have agreed as follows:
Article 1
The Parties shall cooperate and provide mutual assistance in the following fields:
a) Fighting against international terrorism.
b) Fighting against organized crime.
c) Fighting against illicit cultivation, production and trafficking in narcotic drugs, psychotropic substances and precursors.
d) Fighting against illicit activities concerning weapons, including biological, chemical and radiological weapons, ammunition, explosives, nuclear and radioactive material as well as poisonous substances.
e) Fighting against smuggling and international illegal economic activities and legalisation of proceeds (money laundering) from criminal activities.
f) Fighting against illegal immigration and illicit trafficking in human beings.
g) Fighting against forgery and altering of any kind of documents.
h) Fighting against altering and forgery of banknotes, credit cards, securities and other valuable items.
i) Fighting crime against human life, health, freedom and sexual integrity.
j) Fighting crime against property and especially against theft and illicit trafficking in vehicles.
k) Search for disappeared persons and persons who have committed crimes within the territory of the other Party, as well as the identification of corpses.
l) Fighting against illicit trafficking in works of historical and cultural heritage, valuable stones and metals, as well as other valuable items.
m) Improving methods and means of maintaining and restoring public order and handling crisis situations, such as hijacking, kidnapping, etc.
n) Training and education of police officers.
o) Co-operation in cultural, sporting and social fields through the exchange of police delegations.
The Parties shall cooperate in other areas concerning criminality in general, prevention of crime and maintenance of public order, if there is mutual interest.
Article 2
The co-operation between the two Parties in the above mentioned fields in the Article 1 will be achieved through:
a) Exchange of information and experience in fields of common interest.
b) Exchange of experience on the use of forensic technology, as well as on methods and means of criminological research.
c) Exchange of information, knowledge and experience in the field of border controls, as well as material and technical support of the passport control services in order to detect forged and altered travel documents and prevent illegal entry and illicit immigration.
d) Exchange of specimens of new travel documents, seals and types of visas, in order to prevent and combat illegal crossing of borders.
e) Exchange of information for the prevention and suppression of any form of crime, in particular all acts of terrorism, organized crime and illicit trafficking in weapons and radioactive materials.
f) Exchange of information, experience and assistance on new methods used for the production of narcotic drugs and psychotropic substances, their international trafficking, concealment and distribution, as well as new methods to combat them, which are mentioned in the paragraph (c) of the above Article 1, in accordance with the Single Convention on Narcotic Drugs of 1961, as it was amended by the Amendment Protocol in 1972, the Convention on Psychotropic Substances of 1971 and the 1988 United Nations Convention against Illicit Trafficking in Narcotic Drugs and Psychotropic Substances.
g) Exchange of legislation concerning the items of this Agreement.
h) Exchange of publications and results of scientific researches in the fields covered by this Agreement, through organising and taking measures of common interest.
Article 3
In order to improve the effectiveness of the co-operation, the Parties shall hold meetings of experts within the framework of this Agreement, whenever both agree that it is necessary.
Article 4
1. Either Party may totally or partially deny the co-operation in such cases which could put in danger its national sovereignty, its security or its national interests or it is contrary to its national legislation.
The denial of co-operation is served in writing on the other Party without delay.
2. The implementation of this Agreement is subject to the national legislation of each Party.
3. Neither Party may make public or transfer to a third country any confidential information, unless it receives the other Party’ s consent.
4. The responsible services for the implementation of this Agreement are:
 
For the Republic of Slovenia:
Ministry of Interior, General Police Directorate, Section of International Police Co-operation.
 
For the Hellenic Republic:
The International Police Co-operation Division of the Ministry of Public Order.
For the direct co-operation in very urgent cases, the Parties shall exchange a list containing the authorized services responsible for communication and co-operation.
Article 5
1. The Parties shall set up a Co-ordination Committee, responsible for the implementation of the Agreement, which shall be chaired by the Minister of the Interior for the Republic of Slovenia and by the Minister of Public Order for the Hellenic Republic, or the representatives of the two Ministries, with participation of experts. The Co-ordination Committee will also assure the promotion and evaluation of this Agreement.
Representatives of other Ministries may attend the meetings of this Committee if it is necessary.
2. The Co-ordination Committee shall meet in periods determined through consultations, alternately, in Slovenia and Greece.
3. The working language will be English, not excluding the use of any other widely spoken international language.
Article 6
The Parties are committed to apply all the relevant provisions, which are included in their data protection laws, during the exchange of any kind of personal data for the purposes of this Agreement.
Article 7
This Agreement does not affect the rights and obligations arising from other international agreements binding upon the Parties.
Article 8
1. The present Agreement shall enter into force on the 30th day after the date of receipt of the last notification by which each Party informs the other about the completion of its relevant internal procedures.
2. The present Agreement is concluded for an indefinite period. Either Party may terminate it upon a thirty-day prior written notice communicated to the other Party through diplomatic channels.
3. Either Party may at any time suspend totally or partially the implementation of this Agreement for reasons of national security, public order and public health. The suspension shall be communicated to the other Party through diplomatic channels.
Article 9
The present Agreement may be modified through a common accord of the Parties. Any modification shall enter into force according to the procedure described in par.1 of Article 8.
Signed in Ljubljana on 27th 09 2002 in two original copies in the Slovenian, Greek and English languages, all texts being equally authentic. In case of any divergence in the interpretation of the Agreement, the English text shall prevail.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za notranje zadeve Republike Slovenije.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
