O RAZGLASITVI ZAKONA O RAFITIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE BOLGARIJE O SODELOVANJU NA PODROČJU KARANTENE IN VARSTVA RASTLIN (BBOKVR)
Razglašam Zakon o ratifikaciji Sporazuma med Vlado Republike Slovenije in Vlado Republike Bolgarije o sodelovanju na področju karantene in varstva rastlin (BBOKVR), ki ga je sprejel Državni zbor Republike Slovenije na seji 22. marca 2000.

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE BOLGARIJE O SODELOVANJU NA PODROČJU KARANTENE IN VARSTVA RASTLIN (BBOKVR)
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Republike Bolgarije o sodelovanju na področju karantene in varstva rastlin, podpisan 30. junija 1998 v Sofiji.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:*
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE BOLGARIJE O SODELOVANJU NA PODROČJU KARANTENE IN VARSTVA RASTLIN
Vlada Republike Slovenije in Vlada Republike Bolgarije (v nadaljevanju pogodbenici)
sta se v želji, da bi poglobili medsebojno sodelovanje na področju karantene in varstva rastlin,
ob prizadevanju za boljšo zaščito ozemlja svojih držav pred vdorom karantenskih škodljivih organizmov in za omejitev izgub zaradi njihovega delovanja in tudi za lažje medsebojno trgovanje in izmenjavo blaga rastlinskega izvora,
sporazumeli o naslednjem:
1. člen
Izrazi, navedeni v tem sporazumu, pomenijo:
a) rastline – žive rastline in njihovi deli, vključno s semeni;
b) rastlinski proizvod – nepredelani material rastlinskega izvora (vključno z zrni) in tisti predelani proizvodi, ki so po svoji naravi ali načinu predelave lahko nevarni za razširitev škodljivih organizmov;
c) semena – semena za sajenje in ne za porabo ali predelavo;
d) rastlinska pošiljka – postavke, navedene v točkah a), b) in c) 1. člena;
e) škodljivi organizem – rastlinski škodljivi organizem – vse vrste rastlinskih ali živalskih oblik ali patogenih dejavnikov, ki so škodljivi ali potencialno škodljivi za rastline ali rastlinske proizvode;
f) karantenski škodljivi organizem – škodljivi organizem potencialnega narodnega gospodarskega pomena za državo, ki jo ogroža in v njej še ni prisoten ali pa je prisoten, vendar ne zelo razširjen, in je pod aktivnim nadzorom.
2. člen
Organa pogodbenic, pristojna za izvajanje tega sporazuma in pooblaščena za dajanje pobud za spremembe ali dopolnitve tega sporazuma na podlagi soglasja pogodbenic, sta:
– za Republiko Slovenijo – Ministrstvo za kmetijstvo, gozdarstvo in prehrano Republike Slovenije;
– za Republiko Bolgarijo – Ministrstvo za kmetijstvo, gozdarstvo in agrarno reformo Republike Bolgarije prek Državne službe za varstvo rastlin, karanteno in agrokemijo.
3. člen
Pristojna organa pogodbenic se takoj obvestita o pojavu karantenskih škodljivih organizmov s seznamov vsake pogodbenice in o sprejetih ukrepih proti njihovi razširitvi in ukrepih za njihovo zatiranje.
4. člen
Izvoz in tranzit rastlinskih pošiljk z ozemlja države ene pogodbenice na ali čez ozemlje države druge pogodbenice se izvedeta v skladu z zakonodajo druge pogodbenice o karanteni in varstvu rastlin.
5. člen
Pogodbenici prepovedujeta uvoz zemlje (razen šote) in uporabo slame, sena, rezanice, mahu, lubja itd. za embalažo. Semena in rastline, ki se izvažajo, se zavijejo v ovojni material, ki pred izvozom še ni bil uporabljen.
Prevozna sredstva, ki se uporabljajo za prevoz blaga rastlinskega izvora na ozemlju države druge pogodbenice, morajo biti temeljito očiščena in po potrebi tudi dezinficirana ali dezinsekcirana.
6. člen
Vsaka izvozna rastlinska pošiljka, za katero se zahteva fitosanitarni pregled, mora biti opremljena s fitosanitarnim spričevalom, ki ga izda organ službe za karanteno in varstvo rastlin, in potrjuje, da ta pošiljka ne vsebuje škodljivih organizmov, ki so karantenski škodljivi organizmi v državi uvoznici.
Rastlinske pošiljke, ki se ponovno izvažajo, morajo biti opremljene s fitosanitarnim spričevalom za ponovni izvoz in izvirnikom fitosanitarnega spričevala države porekla ali njegovo overjeno kopijo.
Predložitev fitosanitarnega spričevala ne izključuje pravice države uvoznice do fitosanitarnega pregleda dobavljenih rastlinskih pošiljk in do ustreznega ukrepanja.
V nujnih primerih lahko pristojna organa pogodbenic določita dodatne fitosanitarne zahteve.
7. člen
Pogodbenici se obvestita o mejnih prehodih na svojih državnih ozemljih, na katerih potekajo izvoz, uvoz in tranzit rastlinskih pošiljk.
8. člen
Če pri fitosanitarnem pregledu odkrijejo karantenske škodljive organizme ali ugotovijo kakšne druge kršitve predpisov države uvoznice o karanteni rastlin, imata pristojna organa pogodbenic pravico zavrniti uvoz takšnega blaga rastlinskega izvora ali ga uničiti ali izvesti kakšen drug nujen fitosanitarni ukrep.
9. člen
Pogodbenici se zavezujeta, da bosta spoštovali določbe tega sporazuma pri izmenjavi različnih rastlinskih pošiljk, vključno z darili, znanstvenimi izmenjavami in tudi kadar se pošiljajo za diplomatske ali druge reprezentančne namene.
10. člen
Pristojna organa pogodbenic drug drugemu po potrebi dajeta strokovno, tehnično in drugo pomoč na področju karantene in varstva rastlin v skladu s sporazumom.
11. člen
Pristojna organa pogodbenic
a) izmenjata zakone in druge predpise, ki se nanašajo na karanteno in varstvo rastlin, najkasneje v 30 dneh od dneva, ko začnejo veljati,
b) se obvestita o pomembnih in posebnih revijah, monografijah in publikacijah s področja karantene in varstva rastlin, ki izidejo v njunih državah.
12. člen
Da bi pospešili prevoz in zmanjšali nevarnost vnosa karantenskih škodljivih organizmov, sme fitosanitarni pregled ob privolitvi obeh strani opraviti pristojni organ države ene pogodbenice na ozemlju države druge pogodbenice.
Pristojni organ pogodbenice, na katere ozemlju se opravi fitosanitarni pregled, po potrebi zagotovi uradne prostore in vso nujno potrebno opremo ter zagotovi spoštovanje predpisov o varstvu pri delu.
Pristojna organa pogodbenic se sporazumeta o postopku in drugih pogojih fitosanitarnega pregleda.
13. člen
Pristojna organa pogodbenic po potrebi skličeta skupna posvetovanja, na katerih se obravnavajo praktična vprašanja v zvezi z izvajanjem tega sporazuma. Posvetovanja potekajo izmenično v Republiki Sloveniji in Republiki Bolgariji. Dan in kraj posvetovanj se določita sporazumno.
Pristojni organ vsake pogodbenice plača stroške potovanja, oskrbe in nastanitve svojih predstavnikov.
14. člen
Določbe tega sporazuma ne vplivajo na pravice in obveznosti pogodbenic, ki izhajajo iz sporazumov, sklenjenih z drugimi državami, ali iz članstva v mednarodnih organizacijah za karanteno in varstvo rastlin.
15. člen
Vse spore med pogodbenicama, ki izhajajo iz razlik pri razlagi ali izvajanju tega sporazuma, rešuje skupna komisija, sestavljena iz treh članov na vsaki strani. Če skupna komisija ne more najti rešitve, se spor reši po diplomatski poti.
16. člen
Konvencija o varstvu rastlin med Vlado Federativne ljudske republike Jugoslavije in Vlado ljudske republike Bolgarije, podpisana 4. junija 1957 v Beogradu, preneha veljati v odnosih med Republiko Slovenijo in Republiko Bolgarijo z dnem, ko začne veljati ta sporazum.
17. člen
Ta sporazum mora biti odobren v skladu z notranjo zakonodajo pogodbenic in začne veljati 30. dan po dnevu izmenjave diplomatskih not o njegovi odobritvi.
Sporazum se sklene za pet let in se samodejno podaljšuje za naslednja petletna obdobja, če ga ena od pogodbenic pisno ne odpove najkasneje šest mesecev pred iztekom tega obdobja.
Sestavljeno v Sofiji dne 30. junija 1998 v dveh izvirnikih v slovenskem, bolgarskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Ob razlikah pri razlagi je odločilno angleško besedilo.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE REPUBLIC OF BULGARIA ON COOPERATION IN THE FIELD OF PLANT QUARANTINE AND PLANT PROTECTION
The Government of the Republic of Slovenia and the Government of the Republic of Bulgaria (hereinafter referred to as the Contracting Parties),
wishing to deepen mutual cooperation in the field of plant quarantine and plant protection,
endeavouring to improve protection of the territories of their States against introduction of quarantine pests and to limit losses occurring due to their action, and also to simplify the mutual trade and exchange of commodities of plant origin,
have agreed on the following items:
Article 1
The expressions cited in this Agreement have the following significance:
a/ plants – living plants and parts thereof, including seeds;
b/ plant product – unmanufactured material of plant origin (including grain) and those manufactured products that by their nature or that of their processing, may create a risk for the spread of pests;
c/ seeds – seeds for planting not for consumption or processing;
d/ plant consignment – items stated in Article 1 a), b), and c);
e/ pest – plant pest – any form of plant or animal life, or any pathogenic agent, injurious or potentially injurious to plants or plant products;
f/ quarantine pest – a pest of potential national economic importance to the country endangered thereby and not yet present there, or present but not widely distributed and being actively controlled;
Article 2
The competent bodies of the Contracting Parties responsible for the implementation of this Agreement and authorised to initiate amendments or modifications hereto on the basis of mutual consent of the Contracting Parties, are:
– for the Republic of Slovenia – the Ministry of Agriculture, Forestry and Food of the Republic of Slovenia
– for the Republic of Bulgaria – the Ministry of Agriculture, Forestry and Agrarian Reform of the Republic of Bulgaria, through National Service for Plant Protection, Quarantine and Agrochemistry.
Article 3
Competent bodies of the Contracting Parties will immediately inform each other of the occurrence of quarantine pests cited in the lists of each Contracting Party, as well as on the measures taken against their spreading and the measures realized to eradicate them.
Article 4
The export and transit of plant consignments from the territory of the state of one Contracting Party onto or through the territory of the state of the other Contracting Party will be performed according to the legislation of the other Contracting Party related to plant quarantine and plant protection.
Article 5
The Contracting Parties shall forbid the imports of soil (with the exception of peat) and the usage of straw, hay, chaffs, moss, barks etc. as packing materials. Exported seeds and plants shall be wrapped in a wrapping which has not been used prior to the export.
Transport means being used to transport commodities of plant origin on the territory of the state of the other Contracting Party must be thoroughly cleaned and, if necessary, also disinfected or disinsectized.
Article 6
Each exported plant consignment which is subject to phytosanitary inspection must be accompanied by a phytosanitary certificate, issued by a body of the plant quarantine and protection service, confirming that this consignment does not contain pests which are quarantine pests in the importing state.
Plant consignment being re-exported must be accompanied by the phytosanitary certificate for re-export and the original phytosanitary certificate or a verified copy thereof of the country of origin.
The submission of the phytosanitary certificate does not exclude the right of the importing state to perform the phytosanitary inspection of supplied plant consignments and to take the appropriate measures.
In the case of emergency competent bodies of the Contracting Parties may determine additional phytosanitary requirements.
Article 7
The Contracting Parties shall inform each other about border crossings on their state territories through which they perform export, import and transit of plant consignments.
Article 8
If during a phytosanitary inspection a quarantine pest is found, or some other violations of the plant quarantine regulations of the importing country are ascertained, then competent bodies of the Contracting Parties are entitled to refuse the import of such commodity of plant origin, or to destroy it or to perform other urgent phytosanitary measure.
Article 9
The Contracting Parties undertake to observe the stipulations of this Agreement during the exchange of various plant consignments, including cases of donation, scientific exchanges, and also when such consignments are destined for diplomatic or other representative purposes.
Article 10
Competent bodies of the Contracting Parties, if necessary, will provide each other expert, technical, and other assistance in the field of plant quarantine and plant protection in compliance with the Agreement.
Article 11
Competent bodies of the Contracting Parties
a/ shall exchange the laws and other regulations related to plant quarantine and plant protection within 30th days following the date of their coming into force at the latest,
b) shall inform each other on important and special periodicals, monographs, and publications in the field of plant quarantine and plant protection, issued in their states.
Article 12
In order to speed up transportation and to reduce the risk of introduction of quarantine pests, a phytosanitary inspection may be performed, subject to mutual consent, by competent bodies of the state of one Contracting Party on the territory of the state of the other Contracting Party.
The competent body of the Contracting Party on the territory of which the phytosanitary inspection is carried out shall, if necessary, provide official premises and all the required equipment indispensable therefor, and ensure observance of the regulations pertaining to safety at work.
The competent bodies of the Contracting Parties shall agree on the procedure and other conditions of the phytosanitary inspection.
Article 13
Competent bodies of the Contracting Parties, if necessary, will convene joint consultations to deal with practical questions related to the implementation of this Agreement. The consultations will take place alternately in the Republic of Slovenia and in the Republic of Bulgaria. The date and the place of the consultations will be determined by mutual consent.
The competent body of each of the Contracting Parties shall cover the travelling, board and accommodation expenses of its representatives.
Article 14
Provisions of this Agreement do not affect the rights and obligations of the Contracting Parties, resulting from concluded agreements with other states or from the membership in international organizations for plant quarantine and plant protection.
Article 15
Any disputes between the Contracting Parties arising from differences in the interpretation or implementation of this Agreement, shall be solved by a Joint Commission, composed of three members on each side. If the Joint Commission cannot find a solution, the dispute shall be solved through diplomatic channels.
Article 16
The Convention on Plant Protection between the Government of the Federative People’s Republic of Yugoslavia and the Government of the People’s Republic of Bulgaria signed on 4 June 1957 in Belgrade shall cease to be valid in relations between the Republic of Slovenia and the Republic of Bulgaria on the date of coming into force of this Agreement.
Article 17
This Agreement is subject to approval in accordance with the national legislation of the Contracting Parties and will enter into force on the 30th day after the date of exchange of diplomatic notes on its approval.
The Agreement is concluded for five years and it will be automatically prolonged for the following five-year periods unless terminated by either Contracting Party in writing within six months prior to the expiration of this period, at the latest.
Done at Sofia on 30 June 1998 in two original copies in the Slovene, Bulgarian and English languages, each text being equally authentic. In case of divergence of interpretation the English text shall prevail.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za kmetijstvo, gozdarstvo in prehrano.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije - Mednarodne pogodbe.
