Razglašam Zakon o ratifikaciji Sporazuma med Republiko Slovenijo in Združenimi državami Amerike o sodelovanju pri preprečevanju širjenja orožij za množično uničevanje (BUSPSO), ki ga je sprejel Državni zbor Republike Slovenije na seji 22. marca 2000.

O RATIFIKACIJI SPORAZUMA MED REPUBLIKO SLOVENIJO IN ZDRUŽENIMI DRŽAVAMI AMERIKE O SODELOVANJU PRI PREPREČEVANJU ŠIRJENJA OROŽIJ ZA MNOŽIČNO UNIČEVANJE (BUSPSO)
1. člen
Ratificira se Sporazum med Republiko Slovenijo in Združenimi državami Amerike o sodelovanju pri preprečevanju širjenja orožij za množično uničevanje, podpisan dne 21. junija 1999 v Ljubljani.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:
S P O R A Z U M
MED REPUBLIKO SLOVENIJO IN ZDRUŽENIMI DRŽAVAMI AMERIKE O SODELOVANJU PRI PREPREČEVANJU ŠIRJENJA OROŽIJ ZA MNOŽIČNO UNIČEVANJE
Republika Slovenija in Združene države Amerike, v nadaljevanju pogodbenici,
v želji, da bi v Republiki Sloveniji spodbudili vzpostavitev preverljivih ukrepov za preprečevanje širjenja orožij za množično uničevanje ter tehnologije, materiala in strokovnega znanja v zvezi s takim orožjem;
v želji, da bi preprečili nepooblaščeni prenos in prevoz jedrskega, biološkega in kemičnega orožja ter z njim povezanega materiala,
sta se dogovorili o naslednjem:
1. člen
Pogodbenici sodelujeta, kjer je to ustrezno, z namenom, da bi Republiki Sloveniji pomagali doseči te cilje:
a) vzpostavitev preverljivih ukrepov v Republiki Sloveniji za preprečevanje širjenja orožij za množično uničevanje ter tehnologije, materiala in strokovnega znanja v zvezi s takim orožjem;
b) preprečevanje nepooblaščenega prenosa in prevoza jedrskega, biološkega in kemičnega orožja ter z njim povezanega materiala.
2. člen
1. Pogodbenici lahko, kjer je to ustrezno, prek svojih izvršilnih predstavnikov skleneta izvedbene sporazume ali dogovore, da bi dosegli cilje iz 1. člena tega sporazuma.
2. Pri vsakem neskladju med tem sporazumom in katerimkoli izvedbenim sporazumom prevladajo določbe tega sporazuma.
3. člen
Vsaka pogodbenica imenuje izvršilnega predstavnika za izvajanje tega sporazuma. Za Republiko Slovenijo je izvršilni predstavnik Ministrstvo za obrambo. Za Združene države Amerike je izvršilni predstavnik Ministrstvo za obrambo.
4. člen
Razen če ni drugače predvideno v tem sporazumu ali v izvedbenem sporazumu, se določila tega sporazuma uporabljajo za ves material, usposabljanje ali storitve, ki se zagotovijo v skladu s tem sporazumom ali izvedbenimi sporazumi, in za vse z njimi povezane dejavnosti in osebje.
5. člen
1. Republika Slovenija omogoči prihod uslužbencev Vlade Združenih držav Amerike in osebja izvajalca Združenih držav Amerike na ozemlje Republike Slovenije in njihov odhod s tega ozemlja z namenom izvajanja dejavnosti v skladu s tem sporazumom.
2. Letala in plovila, ki niso redna linijska komercialna letala in jih Združene države Amerike uporabljajo za dejavnosti v skladu s tem sporazumom, so oproščena carinskih dajatev kot tudi pristajalnih taks, navigacijskih pristojbin, pristaniških taks, pristojbin in drugih dajatev, ki jih zahteva Republika Slovenija ali njene agencije, organi v sestavi ali telesa. Carinski nadzor se opravi v skladu s postopki, o katerih se dogovorita pogodbenici.
3. Če Združene države Amerike za prevoz v Republiko Slovenijo uporabijo letalo, ki ni redno linijsko komercialno letalo, se njegov načrt leta registrira v skladu s postopki Mednarodne organizacije za civilno letalstvo, ki se uporabljajo za civilna letala, v opombah načrta leta pa se navede, da je bilo pridobljeno ustrezno dovoljenje. Republika Slovenija letalom Združenih držav Amerike zagotovi brezplačno parkiranje, varovanje, servisiranje in gorivo.
6. člen
1. Razen če ni bilo predhodno pridobljeno pisno soglasje Združenih držav Amerike, Republika Slovenija ne prenese lastninske ali posestne pravice za kakršenkoli material, usposabljanje ali storitve, ki se zagotovijo v skladu s tem sporazumom, na nobeno drugo osebo, razen na častnika, uslužbenca ali predstavnika pogodbenice tega sporazuma, in ne dovoli uporabiti takšen material, usposabljanje ali storitev za namene, drugačne od tistih, za katere so bili zagotovljeni. Republika Slovenija sprejme vse razumne ukrepe, ki so v njeni moči, da bi zagotovila varnost materiala, usposabljanja ali storitev, ki se zagotovijo v skladu s tem sporazumom, in jih zavaruje pred zasegom ali nepravilno uporabo.
2. Če se kakršenkoli material, ki se zagotovi po tem sporazumu, ne uporabi za namen, za katerega je bil namenjen, se za plačilo uvoznih dajatev v zvezi s takim materialom uporabljajo določbe veljavne carinske zakonodaje Republike Slovenije.
7. člen
1. V zvezi s pravnimi postopki in civilnimi zahtevki, ki niso pogodbeni zahtevki, Republika Slovenija prevzame odgovornost in plača odškodnino Združenim državam Amerike in njegovemu osebju, izvajalcem in osebju izvajalcev za škodo na premoženju katerekoli osebe v Republiki Sloveniji ali njeno smrt ali poškodbo, ki izhajajo iz dejavnosti po tem sporazumu.
2. Določbe tega člena pogodbenicama ne preprečijo zagotoviti nadomestilo v skladu s svojo notranjo zakonodajo.
3. V tem členu se nič ne razlaga tako, kot da preprečuje pravne postopke ali zahtevke proti državljanom Republike Slovenije ali osebam s stalnim prebivališčem v Republiki Sloveniji.
8. člen
Dejavnosti Združenih držav Amerike po tem sporazumu so odvisne od razpoložljivosti dodeljenih sredstev.
9. člen
Vojaškemu osebju in civilnim uslužbencem Vlade Združenih držav Amerike in njihovim vzdrževanim osebam na ozemlju Republike Slovenije se, za dejavnosti v zvezi s tem sporazumom, priznajo privilegiji in imunitete, ki so enakovredni tistim, ki se priznajo administrativno tehničnemu osebju po Dunajski konvenciji o diplomatskih odnosih z dne18. aprila 1961.
10. člen
1. Združene države Amerike, njeno osebje, izvajalci in osebje izvajalcev ni dolžno plačati Republiki Sloveniji ali njenim agencijam, organom v sestavi ali telesom nobenih davkov ali podobnih dajatev za dejavnosti, ki se izvedejo v skladu s tem sporazumom. Združene države Amerike zagotovijo Ministrstvu za obrambo Republike Slovenije seznam tistih dejavnosti, ki so oproščene davkov, najkasneje 10 dni pred njihovo izvedbo.
2. Združene države Amerike, njeno osebje, izvajalci in osebje izvajalcev lahko uvozijo v Republiko Slovenijo in iz nje izvozijo kakršnokoli opremo, potrebščine, material ali storitve, ki so potrebni za izvajanje tega sporazuma. Za tak uvoz ali izvoz blaga in storitev, ki se šteje za začasni uvoz ali izvoz, ne veljajo nobene carinske dajatve, davki ali kakršnekoli druge dajatve Republike Slovenije ali njenih agencij, organov v sestavi ali teles.
11. člen
Če Združene države Amerike za izvedbo tega sporazuma dodelijo pogodbe za nabavo blaga in storitev, vključno z gradnjo, se take pogodbe dodelijo v skladu z zakoni in predpisi Združenih držav Amerike. Za nabavo blaga in storitev v Republiki Sloveniji za Združene države Amerike ali v njihovem imenu pri izvajanju tega sporazuma ne veljajo nobeni davki, pristojbine, takse ali podobne dajatve Republike Slovenije ali njenih agencij, organov v sestavi ali teles. V primeru, ko tako blago ali storitve niso oproščeni plačila obveznosti v skladu z zakonodajo Republike Slovenije, gre tako plačilo iz naslova finančnih virov Republike Slovenije.
12. člen
Na pisno zahtevo, ki se zagotovi trideset dni vnaprej, imajo predstavniki Vlade Združenih držav Amerike pravico med trajanjem tega sporazuma in tri leta po tem proučiti uporabo kateregakoli materiala, usposabljanja ali druge storitve, ki so jih Združene države Amerike zagotovile v skladu s tem sporazumom, tam, kjer so ali se uporabljajo, ter pravico pregledati in proučiti vse zapise ali dokumentacijo v zvezi z uporabo materiala ali storitev, ki se zagotovijo v skladu s tem sporazumom.
13. člen
Vse nesporazume ali spore v zvezi z razlago ali izvajanjem tega sporazuma pogodbenici rešita samo s posvetovanjem in jih ne predložita nobeni tretji strani, sodišču ali razsodišču.
14. člen
Ta sporazum začne veljati na dan, ko pogodbenici izmenjata diplomatske note, ki potrjujejo, da je vsaka pogodbenica končala vse ustrezne postopke, potrebne za začetek veljavnosti tega sporazuma in ostane v veljavi sedem let. Ta sporazum se lahko spremeni ali podaljša s pisnim soglasjem pogodbenic in ga lahko ena ali druga pogodbenica odpove, tako da o tem devetdeset (90) dni prej pisno uradno obvesti drugo pogodbenico. Ne glede na odpoved tega sporazuma ali izvedbenih sporazumov, obveznosti Republike Slovenije, določene v 6., 7., 11. in 12. členu tega sporazuma, ostanejo v veljavi ne glede na zadevni časovni okvir, razen če se pogodbenici pisno ne dogovorita drugače.
Sklenjeno v Ljubljani dne 21. junija 1999 v dveh izvodih v slovenskem in angleškem jeziku, pri čemer sta obe besedili enako verodostojni.

A G R E E M E N T
BETWEEN THE REPUBLIC OF SLOVENIA AND THE UNITED STATES OF AMERICA CONCERNING COOPERATION IN THE PREVENTION OF THE PROLIFERATION OF WEAPONS OF MASS DESTRUCTION
The Republic of Slovenia and the United States of America, hereinafter referred to as the Parties,
Desiring to promote the establishment of verifiable measures in the Republic of Slovenia to prevent the proliferation of weapons of mass destruction, and the technology, materials, and expertise related to such weapons;
Desiring to prevent the unauthorized transfer and transportation of nuclear, biological, and chemical weapons and related materials;
Have agreed as follows:
ARTICLE I
The Parties shall cooperate as appropriate in order to assist the Republic of Slovenia in achieving the following objectives:
a) The establishment of a verifiable measures in the Republic of Slovenia to prevent the proliferation of weapons of mass destruction, and the technology, materials, and expertise related to such weapons;
b) The prevention of the unauthorized transfer and transportation of nuclear, biological, and chemical weapons and related materials.
ARTICLE II
1. The Parties, through their Executive Agents, may enter into implementing agreements or arrangements as appropriate to accomplish the objectives set forth in Article I of this Agreement.
2. In case of any inconsistency between this Agreement and any implementing agreements, the provisions of this Agreement shall prevail.
ARTICLE III
Each Party shall appoint an Executive Agent to implement this Agreement. For the Republic of Slovenia, the Executive Agent shall be the Ministry of Defense. For the United States of America, the Executive Agent shall be the Department of Defense.
ARTICLE IV
Except as otherwise provided in this Agreement or in an implementing agreement, the terms of this Agreement shall apply to all material, training or services provided in accordance with this Agreement or implementing agreements, and to all related activities and personnel.
ARTICLE V
1. The Republic of Slovenia shall facilitate the entry and exit of employees of the Government of the United States of America and contractor personnel of the United States of America into and out of the territory of the Republic of Slovenia for the purpose of carrying out activities in accordance with this Agreement.
2. Aircraft and vessels, which are not regularly scheduled commercial airplanes and which are used by the United States of America for activities in accordance with this Agreement, shall be free from customs duties, as well as from landing fees, navigation charges, port duties, levies, and any other charges claimed by the Republic of Slovenia, or any of its agencies, sub-departments or bodies. Customs controls shall be performed according to procedures agreed to by the Parties.
3. If an aircraft other than a regularly scheduled commercial aircraft is used by the United States of America for transportation to the Republic of Slovenia, its fight plan shall be filed in accordance with the procedures of the International Civil Aviation Organization applicable to civil aircraft, including, in the remarks section of the flight plan, a confirmation that the appropriate clearance has been obtained. The Republic of Slovenia shall provide parking, security protection, servicing, and fuel for aircraft of the United States of America free of charge.
ARTICLE VI
1. Unless written consent has been obtained in advance from the United States of America, the Republic of Slovenia shall not transfer title to, or possession of, any material, training or services provided in accordance with this Agreement to any entity, other than an officer, employee or agent of a Party to this Agreement and shall not permit the use of such material, training or services for purposes other than those for which it has been furnished. The Republic of Slovenia shall take all reasonable measures within its power to ensure the security of material, training or services provided pursuant to this Agreement and shall protect them against seizure or improper use.
2. In the event that any material provided under this Agreement is not used for the purpose for which it was intended, the provisions of current customs legislation of the Republic of Slovenia shall apply to the payment of import duties related to such material.
ARTICLE VII
1. In reference to legal proceedings and civil claims other than contractual claims, the Republic of Slovenia shall hold harmless and indemnify the United States of America and its personnel, contractors, and contractors’ personnel, for damages to property, or death or injury to any persons in the Republic of Slovenia, arising out of activities under this Agreement.
2. The provisions of this Article shall not prevent the Parties from providing compensation in accordance with respective national legislation.
3. Nothing in this Article shall be interpreted to prevent legal proceeding or claims against citizens of the Republic of Slovenia or against persons with permanent residence in the Republic of Slovenia.
ARTICLE VIII
The activities of the United States of America under this Agreement shall be subject to the availability of appropriated funds.
ARTICLE IX
Military personnel and civilian employees of the Government of the United States of America and their dependents present in the territory of the Republic of Slovenia for activities related to this agreement shall be granted privileges and immunities equivalent to those granted to administrative and technical personnel under the Vienna Convention on Diplomatic Relations, 18. April 1961.
ARTICLE X
1. The United States of America, its personnel, contractors, contractors’ personnel shall not be liable for the payment of any taxes or similar charges to the Republic of Slovenia or any of its agencies, sub-departments or bodies for activities undertaken in accordance with this Agreement. The United States of America shall provide a list to the Ministry of Defense of the Republic of Slovenia of those specific activities which shall be exempt from taxes not later than 10 days prior to their implementation.
2. The United States of America, its personnel, contractors, and contractors’ personnel may import into, and export out of, the Republic of Slovenia any equipment, supplies, material or services necessary for the implementation of this Agreement. Such import or export of goods and services, which shall be regarded as temporary imports or exports, shall not be subject to any customs, duties, taxes or any other charges by the Republic of Slovenia or any of its agencies, sub-departments or bodies.
ARTICLE XI
In the event that the United States of America awards contracts for the procurement of goods and services, including construction, in order to implement this Agreement, such contracts shall be awarded in accordance with the laws and regulations of the United States of America. The procurement of goods and services in the Republic of Slovenia for or in the name of the United States of America in implementing this Agreement shall not be subject to any taxes, levies, duties or similar charges by the Republic of Slovenia or any other of its agencies, sub-departments or bodies. In any case where such goods or services are not exempted from the payment of liabilities according to the legislation of the Republic of Slovenia, such payment shall be made from the financial resources of the Republic of Slovenia.
ARTICLE XII
Upon written request provided thirty days in advance, representatives of the Government of the United States of America shall have the right, during the period of this Agreement and for three years thereafter, to examine the use of any material, training or other services provided in accordance with this Agreement by the United States of America, at sites of their location or use, and shall have the right to audit and examine all records or documentation related to the use of material or services provided in accordance with this Agreement.
ARTICLE XIII
Any disagreements or disputes concerning the interpretation or implementation of this Agreement shall be resolved solely through consultation by the Parties, and shall not be referred to any third party, court or tribunal.
ARTICLE XIV
This Agreement shall enter into force upon the date on which the Parties exchange diplomatic notes confirming the completion by each Party of all applicable procedures required for entry into force of this Agreement, and shall remain in force for seven years. This Agreement may be amended or renewed with the written consent of the Parties and may be terminated by either Party upon ninety (90) days written notification to the other Party of its intention to do so. Notwithstanding the termination of this Agreement or the implementing agreements, the obligations of the Republic of Slovenia provided for in Articles VI, VII, XI and XII of this Agreement shall remain in force notwithstanding the time frame involved, unless otherwise agreed in writing by the Parties.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za obrambo.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
