Razglašam Zakon o ratifikaciji Sporazuma med Republiko Slovenijo in Kraljevino Nizozemsko b zračnem prometu med njunima ozemljema in zunaj njunih ozemelj, ki ga je sprejel Državni zbor Republike Slovenije na seji dne 27. septembra 1994.

O RATIFIKACIJI SPORAZUMA MED REPUBLIKO SLOVENIJO IN KRALJEVINO NIZOZEMSKO O ZRAČNEM PROMETU MED NJUNIMA OZEMLJEMA IN ZUNAJ NJUNIH OZEMELJ
1. člen
Ratificira se Sporazum med Republiko Slovenijo in Kraljevino Nizozemsko o Zračnem prometu med njunima ozemljema in zunaj njunih ozemelj, podpisan 24. novembra 1993 v Ljubljani.
2. člen
Sporazum se v izvirniku v angleškem jeziku in prevodu v slovenskem jeziku glasi:
AGREEMENT
BETWEEN THE REPUBLIC OF SLOVENIA AND THE KINGDOM OF THE NETHERLANDS FOR AIR SERVICES BETWEEN AND BEYOND THEIR RESPECTIVE TERRITORIES
The Republic of Slovenia and the Kingdom of the Netherlands being parties to the Convention on International Civil Aviation opened for signature at Chicago on 7 December 1944;
desiring to contribute to the progress of international civil aviation;
desiring to conclude an Agreement for the purpose of establishing air services between and beyond their respective territories, have agreed as follows:
Article 1
Definitions
For the purpose of this Agreement and its Annex, unless the context otherwise requires:
a. the term »the Convention« means the Convention on International Civil Aviation, opened for signature at Chicago on 7 December 1944, and includes any Annex adopted under Article 90 of that Convention and any amendment of the Annexes or the Convention under Articles 90 and 94 thereof, insofar as those Annexes and amendments have become effective for, or been ratified by both Contracting Parties;
b. the term »aeronautical authorities« means:
for the Kingdom of the Netherlands the Minister of Transport, Public Works and Water Management;
for the Republic of Slovenia the Ministry of Transport and Communication, Civil Aviation Authority;
or in either case any person or body authorized to perform any functions at present exercised by the said authorities;
c. the term »designated airline« means an airline which has been designated and authorized in accordance with Article 4 of this Agreement;
d. the term »territory« in relation to a State has the meaning assigned to it in Article 2 of the Convention;
e. the terms »air service«, »international air service«, »airline« and »stop for non-traffic purposes« have the meaning respectively assigned to them in Article 96 of the. Convention;
f. the terms »agreed service« and »specified route« mean international air service pursuant to Article 2 of this Agreement and the route specified in the appropriate Section of the Annex to this Agreement respectively;
g. the term »stores« means articles of a readily consumable nature for use or sale on board an aircraft during flight, including commissary supplies;
h. the term »Agreement« means this Agreement, its Annex drawn up in application thereof, and any amendments to the Agreement or to the Annex;
i. the term »tariff« means any amount charged or to be charged by airlines, directly or through their agents, to any person or entity for the carriage of passengers (and their baggage) and cargo (excluding mail) in air transportation, including:
I. the conditions governing the availability and applicability Of a tariff, and
II. the charges and conditions for any services ancillary to such carriage which are offered by airlines;
j. the term »change of aircraft« means the operation of one of the agreed services by a designated airline in such a way that one or more sectors of the route are flown by aircraft different in capacity from those used on another sector.
Article 2
Grant of Rights
1. Each Contracting Party grants to the other Contracting Party except as otherwise specified in the Annex the following rights for the conduct of international air transportation by the designated airline of the other Contracting Party:
a. the right to fly across its territory without landing
b. the right to make stops in its territory for non-traffic purposes; and
c. while operating an agreed service on a specified route, the right to make stops in its territory for the purpose of taking up and discharging international traffic in passengers, cargo and mail, separately or in combination.
2. Nothing in paragraph 1 of this Article, shall be, deemed to grant the right to one Contracting Party's airline to participate in air transportation between points in the territory of the other Contracting Party.
3. If because of armed conflict, political disturbances or developments, or special and unusual circumstances, the designated airline of one Contracting Party is unable to operate a service on its normal routing, the other Contracting Party shall use its best efforts to facilitate the continued operation of such service through appropriate rearrangements of such routes, including the grant of rights for such time as may be necessary to facilitate viable operations.
Article 3
Change of Aircraft
1. Each designated airline may on any or all flights on the agreed services and at its option, change aircraft in the territory of the other Contracting Party or at any point along the specified routes, provided that:
a. aircraft used beyond the point of change of aircraft shall be scheduled in coincidence with the inbound or outbound aircraft, as the case may be;
b. in the case of change of aircrat in the territory of the other Contracting Party and when more than one aircraft is operated beyond the point of change, not more than one such aircraft may be of equal size and none may be larger that the aircraft used on the third and fourth freedom sector.
2. A designated airline may use different or identical flight numbers for the sectors of its change of aircraft operations.
Article 4
Designation and Authorization
1. The aeronautical authorities of each Contracting Party shall have the right by written notification to the aeronautical authorities of the other Contracting Party to designate an airline to operate air services on the routes specified in the Annex and to substitute another airline for an airline previously designated.
2. On receipt of such notification, each Contracting Party shall, without delay, grant to the airline so designated by the other Contracting Party the appropriate operating authorization subject to the provisions of this Article.
3. Upon receipt of the operating authorization of paragraph 2 of this Article the designated airline may at any time begin to operate the agreed services, in part or in whole, provided that it complies with the provisions of this Agreement and that tariffs for such services have been established in accordance with the provisions of Article 6 of this Agreement.
4. Each Contracting Party shall have the right to refuse to grant the operating authorization referred to in paragraph 2 of this Article, or to grant this authorization under conditions that may be deemed necessary on the exercise by the designated airline of the rights specified in Article 2 of this Agreement, if it is not satisfied that substantial ownership and effective control of the airline are vested in the Contracting Party designating it or in its nationals or in both.
Article 5
Revocation and Suspension of Authorization
1. The aeronautical authorities of each Contracting Party shall have the right to withhold the authorizations referred to in Article 4 of this Agreement with respect to an airline designated by the other Contracting Party, to revoke or suspend such authorizations or impose conditions:
a. in the event of failure by such airline to qualify before the aeronautical authorities of that Contracting Party under the laws and regulations normally and reasonably applied by these authorities in conformity with the Convention;
b. in the event of failure by such airline to comply with the laws and regulations of,that Contracting Party;
c. in the event that they are not satisfied that substantial ownership and effective control of the airline are vested in the Contracting Party designating the airline or in its nationals; and
d. in case the airline otherwise fails to operate in accordance with the conditions prescribed under this Agreement.
2. Unless immediate action is essential to prevent further infringement of the laws and regulations referred to above, the rights enumerated in paragraph 1 of this Article shall be exercised only after consultations with the aeronautical authorities of the other Contracting Party. Unless otherwise agreed by the Contracting Parties, such consultations shall begin with a period of sixty (60) days from the date of receipt of the request.
Article 6
Tariffs
1. The tariffs to be charged by the designated airlines of the Contracting Parties for carriage between their territories shall be those approved by the aeronautical authorities of both Contracting Parties and shall be established at reasonable levels, due regard being paid to all relevant factors, including cost of operation, reasonable profit and the tariffs of other airlines for any. part of the specified route.
2. Tariffs referred to in paragraph 1 of this Article shall, whenever possible, be agreed by the designated airlines through the rate-fixing procedure established by the international body which formulates proposals in this matter. When this is not possible the tariffs shall be agreed between the designated airlines. In any case the tariffs shall be subject to the approval of the aeronautical authorities of both Contracting Parties.
3. All tariffs so agreed shall be submitted for approval to the aeronautical authorities of both Contracting Parties at least sixty (60) days before the proposed date of their introduction, except where the said authorities agree to reduce this period in special cases.
4. Approval of tariffs may be given expressly; or, if neither of the aeronautical authorities has expressed disapproval within thirty (30) days from the date of submission, in accordance with paragraph 3 of this Article, the tariffs shall be considered as approved.
In the event ot the period for submission being reduced, as provided for in paragraph 3 of this Article, the aeronautical authorities may agree that the period within which any disapproval must be notified shall be reduced accordingly.
5. If a tariff cannot be agreed in accordance with paragraph 2 of this Article, or if, during the period applicable in accordance with paragraph 4 of this Article, one aeronautical authority gives the other aeronautical authority notice of its disapproval of any tariff agreed in accordance with the provisions of paragraph 2 of this Article, the aeronautical authorities of the two Contracting Parties shall endeavour to determine the tariff by mutual agreement.
6. If the aeronautical authorities cannot agree on a tariff submitted to them under paragraph 3 of this Article, or on the determination of a tariff under paragraph 5 of this Article, the dispute shall be settled in accordance with the provisions of Article 17 of this Agreement.
7. Tariffs established in accordance with the provisions of this Article shall remain in force until new tariffs have been established.
8. The aeronautical authorities of each Contracting Party shall exercise their best efforts to ensure that the designated airlines conform to the agreed tariffs filed with the aeronautical authorities of the Contracting Parties, and that no airline illegally rebates any portion of such tariffs by any means, directly or indirectly.
Article 7
Commercial Activites
1. The designated airlines of both Contracting Parties shall on reciprocal basis be allowed:
a. to establish in the territory of the other Contracting Party offices for the promotion of air transportation and sale of air tickets as well as other facilities required for the provision of air transportation;
b. in the territory of the other Contracting Party to engage directly and, at that airline's discretion, through its agents in the sale of air transportation.
2. The designated airline of one Contracting Party shall be allowed to bring in and maintain in the territory of the other Contracting Party its managerial, commercial, operational and technical staff as it may require in connection with the provision of air transportation.
3. These staff requirements may, at the option of the designated airline, be satisfied by its own personnel or by using the services of any other organization, company or airline operating in the territory of the other Contracting Party, and authorized to perform such services in the territory of that Contracting Party.
4. The above activities shall be carried out in accordance with the laws and regulations of the other Contracting Party.
Article 8
Fair Competition
1. There shall be fair and equal opportunity for the. designated airlines of both Contracting Parties to participate in the international air transportation covered by this Agreement.
2. Each Contracting Party shall take all appropriate action within its jurisdiction to eliminate all forms of discrimination or unfair competitive practices adversely affecting the competitive position of the airline of the other Contracting Party.
Article 9
Timetable
1. The airline designated by each Contracting Party shall notify the aeronautical authorities of the other Contracting Party, forty-five (45) days in advance, of the timetable of its intended services, specifying the frequency, type of aircraft, configuration and number of seats to be made available to the public.
2. Requests for permission to operate additional flights can be submitted by the designated airline for approval directly to the aeronautical authorities of the other Contracting Party. Such request shall in principle be submitted at least two (2) working-days before operating such flights.
Article 10
Taxes, Customs and Charges
1. Aircraft operating on international air services by the designated airline of either. Contracting Party, as well as their regular equipment, spare parts, supplies of fuels and lubricants, aircraft stores (including food, beverages and tobacco) on board as well as advertising and promotional material kept on board such aircraft shall be exempt from all customs duties, inspection fees and similar national or local duties and charges, on arrival in the territory of the Contracting Party, provided such equipment and supplies remain on board the aircraft up to such time as they are re-exported.
2. With regard to regular equipment, spare parts, supplies of fuels and lubricants and aircraft stores introduced into the territory of one Contracting Party by or on behalf of a designated airline of the other Contracting Party or taken on board the aircraft operated by such designated airline and intended solely for use on board aircraft while operating international services, no duties and charges, including customs duties and inspection fees imposed in the territory of the first Contracting Party, shall be applied, even when these supplies are to be used on the parts of the journey performed over the territory of the Contracting Party in which they are taken on board. The articles referred to above may be required to be kept under customs supervision and control.
3. Regular airborne equipment, spare parts, supplies of fuels and lubricants and aircraft stores retained on board the aircraft of either Contracting Party may be unloaded in the territory of the other Contracting Party only with the approval of the customs authorities of the Contracting Party, who may require that these materials be placed under their supervision up to such time as they are re-exported or otherwise disposed of in accordance with customs regulations.
Article 11
Double Taxation
1. Income and profits from the operation of aircraft in international traffic shall be taxable only in the State in which the place of effective management of the enterprise is situated.
2. Gains from the alienation of aircraft operated in international traffic shall be taxable only in the State in which the place of effective management of the enterprise is situated.
3. Capital represented by aircraft operated in international traffic and by movable property pertaining to the operation of such aircraft shall be taxable only in the State in which the place of effective management of the enterprise is situated.
4. The provisions of paragraph 1 of this Article shall also apply to income and profits from the participation in a pool, a joint business or an international operating agency.
Article 12
Transfer of Funds
1. The designated airlines of the Contracting Parties shall be free to sell air transport services in the territories of both the Contracting Parties, either directly or through an agent, in any currency.
2. The designated airlines of the Contracting Parties shall have the right to transfer without any further approval from the territory of sale to their home territory the excess, in the territory of sale, of receipts over expenditure. Included in such net transfer shall be revenues from sales, made directly or through agents, of air transport services, and ancillary or supplemental services, and normal commercial interest earned on such revenues while on deposit awaiting transfer.
3. The designated airlines of the Contracting Parties shall have the right to transfer the excess, mentioned in paragraphs of this Article, including the normal commercial interest earned on such revenues while on deposit awaiting transfer, into a freely convertible currency, at the official rate of exchange for conversion of local currency, as at the date of remittance.
Article 13
Application of Laws, Regulations and Procedures
1. The laws, regulations and procedures of either Contracting Party relating to the admission to or departure from its territory of aircraft engaged in international air services, or to the operation and navigation of such aircraft, shall be complied with by the designated airline of the other Contracting Party upon its entrance into, and until and including its departure from, the said territory.
2. The laws, regulations and procedures of either Contracting Party relating to immigration, passports, or other approved travel documents, entry, clearance, customs and quarantine shall be complied with by or on behalf of crews, passengers, cargo and mail carried by aircraft of the designated airline of the other Contracting Party upon their entrance into, and until and including their departure from, the territory of the said Contracting Party.
3. Fees and charges applied in the territory of either Contracting Party to the airline operations of the other Contracting Party for the use of airports and other aviation facilities in the territory of the first Contracting Party, shall not be higher than those applied to the operations of any other airline engaged in similar operations.
4. Neither of the Contracting Parties shall give preference to any other airline over the designated airline of the other Contracting Party in the application of its customs, immigration, quarantine, and similar regulations; or in the use of airports, airways and air traffic services and associated facilities under its control.
Article 14 Recognition of Certificates and Licences Certificates of airworthiness, certificates of competency and licences issued, or validated, by one Contracting Party and unexpired shall be recognized as valid by the other Contracting Party for the purpose of operating the agreed services on the specified routes, provided always that such certificates or licences were issued, or validated, in conformity with the standards established under the Convention.
Each Contracting Party, however, reserves the right to refuse to recognize, for flights above its own territory, certificates of competency and licences granted to its own nationals by the other Contracting Party.
Article 15
Security
1. The Contracting Parties agree to provide aid to each other as necessary with a view to preventing unlawful seizure of aircraft and other unlawful acts against the safety of aircraft, airports and air navigation facilities and any other threat to aviation security.
2. Each Contracting Party agrees to observe non-discriminatory and generally applicable security provisions required by the other Contracting Party for entry into-the territory of the other Contracting Party and to take adequate measures to inspect passengers and their carryon items. Each Contracting Party shall also give sympathetic consideration to any request from the other Contracting Party for special security measures for its aircraft or passengers to meet a particular threat.
3. The Contracting Parties shall act in accordance with applicable aviation security provisions established by the International Civil Aviation Organization. Should a Contracting Party depart from such provisions, the other Contracting Party may request consultations with that Contracting Party. Unless otherwise agreed by the Contracting Parties, such consultations shall begin within a period of sixty (60) days of the date of receipt of such a request. Failure to reach a satisfactory agreement could constitute grounds for the application of Article 17 of this Agreement.
4. The Contracting Parties shall act in conformity with the provisions of the Convention on Offences and Certain Other Acts Committed on Board Aircraft, signed at Tokyo on 14 September 1963, the Convention for the Suppression of Unlawful Seizure of Aircraft, signed at The Hague on 16 December 1970, the Convention for the Suppression of Unlawful Acts Against the Safety of Civil Aviation, signed at Montreal on 23 September 1971 and- its supplementary Protocol for the Suppression of Unlawful Acts of Violence at Airports serving International Civil Aviation, signed at Montreal on 24 February 1988, insofar as the Contracting Parties are both party to these Conventions.
5. When an incident, or threat of an incident, of unlawful seizure of aircraft or other unlawful acts against the safety of aircraft, airports and air navigation facilities occurs, the Contracting Parties shall assist each other by facilitating communications intended to terminate rapidly and safely such incident or threat thereof.
Article 16
Consultation and Amendment
1. In a spirit of close cooperation the aeronautical authorities of the Contracting Parties shall consult each other from time to time with a view to ensuring the implementation of, and satisfactory compliance with, the provisions of this Agreement.
2. Either Contracting Party may request consultations with a view to modifying the present Agreement or its Annex. These consultations shall begin within sixty (60) days of the date of the receipt of the request by the other Contracting Party, unless otherwise agreed.
3. Any modification to the present Agreement agreed upon by the Contracting Parties, shall come into force on the date on which the Contracting Parties have informed each other in writing of the completion of their respective constitutional requirements.
4. Any modification of the Annex to the present Agreement shall be agreed upon in writing between the aeronautical authorities and shall take effect on a date to be determined by the said authorities.
Article 17
Settlement of Disputes
1. If any dispute arises between the Contracting Parties relating to the interpretation or application of the present Agreement, the Contracting Parties shall in the first place endeavour to settle it by negotiation between themselves.
2. If the Contracting Parties fail to reach a settlement by negotiation, the dispute may at the request of either Contracting Party be submitted for decision to a tribunal of three arbitrators, one to be named by each Contracting Party and the third to be agreed upon by the two arbitrators so chosen, provided that such third arbitrator shall not be a national of either Contracting Party. Each of the Contracting Parties shall designate an arbitrator whithin a period of sixty (60) days from the date of receipt by either Contracting Party from the other Contracting Party of a diplomatic note requesting arbitration of the dispute and the third arbitrator shall be agreed upon within a further period of sixty (60) days. If either of the Contracting Parties fails to designate its own arbitrator within the period of sixty (60) days or if the third arbitrator is not agreed upon within the period indicated, the President of the Council of the International Civil Aviation Organization may be requested by either Contracting Party to appoint an arbitrator or arbitrators.
3. The Contracting Parties undertake to comply with any decision given under paragraph 2 of this Article.
4. The arbitral tribunal shall determine its own procedure. Each Contracting Party shall pay the expenses of its arbitrator. The remaining expenses of the arbitral tribunal shall be shared equally by the Contracting Parties.
Article 18
Termination
1. Either Contracting Party may at any time give notice in writing through diplomatic channels to the other Contracting Party of its decision to terminate this Agreement.
2. Such notice shall be simultaneously communicated to the International Civil Aviation Organization. In such case the Agreement shall terminate twelve (12) months after the date of receipt of the notice by the other Contracting Party, unless the notice to terminate is withdrawn by agreement before the expiry of this period. In the absence of acknowledgement of receipt by the other Contracting Party, notice shall be deemed to have been received fourteen (14) days after the receipt of the notice by the International Civil Aviation Organization.
Article 19
Registration with ICAO
This Agreement and any amendment thereto shall be registered with the International Civil Aviation Organization.
Article 20
Applicability of Multilateral Agreements
1. The provisions of the Convention shall be applied to this Agreement.
2. If a multilateral agreement concernig any matter covered by this Agreement, accepted by both Contracting Parties, enters into force, the relevant provisions of that agreement shall supersede the relevant provisions of the present Agreement.
Article 21
Applicability
As regards the Kingdom of the Netherlands, this Agreement shall apply to the Kingdom in Europe only.
Article 22
Entry into Force
The present Agreement shall come into force on the first day of the second month following the date on which the Contracting Parties have informed each other in writing that the formalities constitutionally required in their respective countries have been complied with.
In witness whereof, the undersigned, being duly authorized thereto by their respective Governments, have signed this Agreement.

ANNEX
to the Air Services Agreement between the Republic of Slovenia and the Kingdom of'the Netherlands
1. The designated airline of the Republic of Slovenia shall be entitled to operate air services on the routes specified hereunder:
points in Slovenia – intermediate points – points in the Netherlands – points beyond and vice versa.
2. The designated airline of the Kingdom od the Netherlands shall be entitled to operate air services on the routes specified hereunder:
points in the Netherlands – intermediate points -points in Slovenia – points beyond and vice versa.
3. Any or all of the points on the specified routes may, at the option of each designated airline, be omitted on any or all of the flights.
4. The designated airlines of the Contracting Parties shall be allowed to operate flights on the routes mentioned above, without restrictions as to frequency and aircraft type, in any configuration.
5. Each designated airline shall have the right to exercise full fifth freedom rights on all intermediate and beyond points in its respective route schedule within Europe or outside Europe subject to agreement between the designated airlines of both Contracting Parties.
SPORAZUM
MED REPUBLIKO SLOVENIJO IN KRALJEVINO NIZOZEMSKO 6 ZRAČNEM PROMETU MED NJUNIMA OZEMLJEMA IN ZUNAJ NJUNIH OZEMELJ
Republika Slovenija in Kraljevina Nizozemska kot pogodbenici Konvencije o mednarodnem civilnem letalstvu, odprte za podpis v Chicagu 7. decembra 1944, sta se
v želji, da prispevata k razvoju mednarodnega civilnega letalstva
in v želji, da skleneta sporazum, katerega cilj je uvesti zračni promet med njunima ozemljema in zunaj njunih ozemelj, dogovorili o naslednjem:
1. člen
Definicije
Posamezni izrazi v tem sporazumu in njegovi prilogi imajo, razen če kontekst zahteva drugače, naslednji pomen:
a) "konvencija" pomeni Konvencijo o mednarodnem civilnem letalstvu, ki je bila odprta za podpis v Chicagu 7. decembra 1944 ter vključuje vsako prilogo, sprejeto v skladu z 90. členom omenjene konvencije, in vsako spremembo prilog ali konvencije v skladu z njenim 90. in 94. členom, v tisti meri, v kateri sta obe pogodbenici te priloge ali spremembe sprejeli ali ratificirali;
b) "pristojna organa" pomeni za Republiko Slovenijo Ministrstvo za promet in zveze, Republiško upravo za zračno plovbo, in za Kraljevino Nizozemsko ministra za promet, javna dela in upravljanje voda ali v obeh primerih katero koli osebo ali organ, pooblaščen za opravljanje nalog, ki jih zdaj opravljata omenjena organa;
c) "določeni prevoznik" pomeni zračnega prevoznika, ki je bil določen in je dobil dovoljenje v skladu s 4. členom tega sporazuma;
d) "ozemlje" v zvezi z državo ima pomen, kot je določen v 2. členu konvencije;
e) "zračni promet", "mednarodni zračni promet", "prevoznik" in "pristanek v nekomercialne namene" imajo pomen, določen v 96. členu konvencije;
f) "dogovorjeni promet" in "določene proge" pomenita mednarodni zračni promet v skladu z 2. členom tega sporazuma oziroma proge določene v ustrezni točki priloge tega sporazuma;
g) "zaloge" pomeni predmete, ki so pripravljeni za porabo ali prodajo na zrakoplovu med letom, vključno s predmeti za komisijsko prodajo;
h) "sporazum" pomeni ta sporazum, njegovo prilogo in katero koli spremembo sporazuma ali priloge;
i) "tarifa" pomeni kateri koli že zaračunan znesek ali znesek, ki ga bo za zračni prevoz zaračunal prevoznik direktno ali po agentih kateri koli osebi ali organizaciji za prevoz potnikov in njihove prtljage ter tovora, razen pošte, vključno s:
I. pogoji, ki določajo veljavnost in primernost tarife, in
II. cenami in pogoji za kakršne koli dopolnilne storitve, ki jih prevoznik nudi ob takem prevozu;
j) "zamenjava zrakoplova" pomeni, da lahko določeni prevoznik dogovorjeni promet na določeni progi opravlja tako, da del te proge leti z zrakoplovom, ki ima drugačno zmogljivost od tistega, ki ga uporablja na drugem delu proge.
2. člen
Podelitev pravic
1. Vsaka pogodbenica podeli drugi pogodbenici, razen če je drugače določeno v prilogi, pri opravljanju mednarodnega zračnega prometa, ki ga bo opravljal določeni prevoznik druge pogodbenice, naslednje pravice:
a) pravico do preleta ozemlja druge pogodbenice brez pristanka;
b) pravico do pristanka na tem ozemlju v nekomercialne namene;
c) med opravljanjem dogovorjenega prometa na določenih progah pravico do pristanka na svojem ozemlju z namenom vkrcati in izkrcati v mednarodnem prometu potnike, tovor in pošto, ločeno ali kombinirano.
2. Nobeno določilo 1. odstavka tega člena ne daje prevozniku ene pogodbenice pravice sodelovati v zračnem prevozu med kraji na ozemlju druge pogodbenice.
3. Če določeni prevoznik ene pogodbenice zaradi oboroženih spopadov, političnih nemirov ali dogodkov ali posebnih in neobičajnih okoliščin ne more opravljati prometa po normalni progi, si bo druga pogodbenica prizadevala omogočiti nadaljevanje prometa z ustreznimi spremembami prog, vključno s podelitvijo pravic za čas, ki je potreben za normalno opravljanje prometa.
3. člen
Zamenjava zrakoplova
1. Vsak določeni prevoznik lahko na katerem koli ali vseh poletih v dogovorjenem prometu in po lastni odločitvi zamenja zrakoplov na ozemlju druge pogodbenice ali v katerem koli kraju na določenih progah pod pogojem, da:
a) bo zrakoplov, ki bo uporabljen od kraja zamenjave dalje, časovno razporejen v skladu s prihajajočim ali odhajajočim zrakoplovom, odvisno od posameznega primera;
b) da je ob zamenjavi zrakoplova na ozemlju druge pogodbenice in kadar je od kraja zamenjave dalje uporabljenih več zrakoplovov, samo en zrakoplov enako velik in noben večji kot zrakoplov, ki se uporablja na področju pravice tretje in četrte svobode.
2. Določeni prevoznik lahko uporablja različne ali iste številke letov za sektorje, na katerih zamenja zrakoplove.
4. člen
Določitev in izdaja dovoljenja
1. Pristojna organa obeh pogodbenic imata pravico s pisnim sporočilom pristojnemu organu druge pogodbenice določiti enega prevoznika za opravljanje zračnega prometa na progah, določenih v prilogi, in prej določenega prevoznika nadomestiti z drugim prevoznikom.
2. Po prejemu takega sporočila in v skladu z določili tega člena bosta pogodbenici nemudoma izdali tako določenemu prevozniku druge pogodbenice ustrezno operativno dovoljenje.
3. Po prejemu takega operativnega dovoljenja iz 2. odstavka tega člena lahko določeni prevoznik kadar koli prične opravljati dogovorjeni promet delno ali v celoti, če izpolnjuje določila tega sporazuma in če so tarife za tak promet določene v skladu z določili 6. člena tega sporazuma.
4. Vsaka pogodbenica ima pravico odkloniti izdajo operativnega dovoljenja iz 2. odstavka tega člena ali izdati dovoljenje pod takimi pogoji, za katere meni, da so nujni zato, da lahko določeni prevoznik uveljavlja pravice, določene v 2. členu tega sporazuma, če nima zadostnih dokazov, da je pretežno lastništvo in dejanski nadzor nad prevoznikom, ki ga je druga pogodbenica določila, dejansko v rokah te pogodbenice ali njenih državljanov.
5. člen
Preklic in suspenz dovoljenja
1. Pristojni organ vsake pogodbenice ima pravico odreči izdajo dovoljenj iz 4. člena tega sporazuma prevozniku, ki ga je določila druga pogodbenica, taka dovoljenja preklicati ali suspendirati ali določiti pogoje:
a) če prevoznik ne more dokazati pristojnemu organu te pogodbenice, da izvaja zakone in predpise, ki jih ti organi normalno in primerno uporabljajo v skladu s konvencijo;
b) če prevoznik ne spoštuje zakonov in predpisov te pogodbenice;
c) če nima zadostnih dokazov, da sta pretežno lastništvo in dejanski nadzor nad prevoznikom, ki ga je druga pogodbenica določila, dejansko v rokah, te pogodbenice ali njenih državljanov;
d) če prevoznik ne opravlja prometa pod pogoji, ki so določeni v tem sporazumu.
2. Razen če je takojšnja akcija nujna za preprečitev nadaljnje kršitve zakonov in predpisov, ki so navedeni zgoraj, bodo pravice, naštete v 1. odstavku tega člena, uporabljene samo po posvetovanju s pristojnim organom druge pogodbenice. Razen če se pogodbenici ne dogovorita drugače, se bodo taka posvetovanja pričela v šestdesetih (60) dneh od dne, ko je bil prejet zahtevek.
6. člen
Tarife
1. Tarife, ki jih bosta zaračunavala določena prevoznika obeh pogodbenic za prevoz med njunima ozemljema, bodo tiste, ki jih bosta odobrila pristojna organa obeh pogodbenic in bodo določene na primernih ravneh, pri čemer bo primerna pozornost posvečena vsem pomembnim dejavnikom, vključno s celotnimi stroški operacije, primernim dobičkom in tarifami drugih prevoznikov na katerem koli delu določene proge.
2. O tarifah iz 1. odstavka tega člena se bosta, kadar koli bo mogoče, določena prevoznika dogovorila po postopku za določanje tarif, uveljavljenem v mednarodnem telesu, ki oblikuje predloge na tem področju. Kadar to ne bo mogoče, se bosta določena prevoznika o tarifah dogovorila. V vsakem primeru pa morata tarife odobriti pristojna organa obeh pogodbenic.
3. Vse tako dogovorjene tarife je treba predložiti v odobritev pristojnima organoma obeh pogodbenic najmanj šestdeset (60) dni pred dnem, ki je predlagan za njihovo uveljavitev, razen če sta se pristojna organa v posebnih primerih dogovorila o skrajšanju tega roka.
4. Odobritev tarif je lahko izrecna. Če nobeden od pristojnih organov ne izrazi svojega nestrinjanja v tridesetih (30) dneh od dneva ko so bile tarife predložene v skladu z določili 3. odstavka tega člena, se bo štelo, da so tarife odobrene.
Če bi bil rok za predložitev skrajšan, kot je predvideno v 3. odstavku tega člena, se lahko pristojna organa dogovorita, da se rok, v katerem je treba sporočiti nestrinjanje, ustrezno skrajša.
5. Če se o neki tarifi ni mogoče dogovoriti v skladu z 2. odstavkom tega člena ali če je v roku iz 4. odstavka
tega člena pristojni organ sporočil drugemu pristojnemu organu svoje nestrinjanje s tarifo, o kateri je bilo dogovorjeno v skladu z 2. odstavkom tega člena, se bosta pristojna organa obeh pogodbenic zavzela za sporazumno določitev tarife.
6. Če se pristojna organa ne moreta dogovoriti o tarifi, ki jima je bila predložena v skladu s 3. odstavkom tega člena, ali o določitvi tarife v skladu s 5. odstavkom tega člena, bo spor razrešen v skladu z določili 17. člena tega sporazuma.
7. Tarife, uveljavljene v skladu z določili tega člena, ostanejo veljavne, dokler ne bodo določene nove tarife.
8. Pristojna organa obeh pogodbenic si bosta po najboljših močeh prizadevala, da bi zagotovila, da bosta določena prevoznika spoštovala dogovorjene tarife, ki bodo registrirane pri pristojnih organih obeh pogodbenic, in da noben prevoznik ne bo na noben način neposredno ali posredno protizakonito zmanjševal nobenega deleža teh tarif.
7. člen
Komercialne dejavnosti
1. Določenima prevoznikoma obeh pogodbenic bo na vzajemni podlagi dovoljeno:
a) na ozemlju druge pogodbenice ustanoviti urade za promocijo zračnega prevoza in prodajo letalskih vozovnic kot tudi druge objekte, ki so potrebni za zagotovitev zračnega prevoza;
b) na ozemlju druge pogodbenice neposredno ali, če se tako odločijo, preko agentov prodajati zračni prevoz.
2. Določenemu prevozniku ene pogodbenice bo dovoljeno pripeljati in imeti na ozemlju druge pogodbenice svoje vodilno, komercialno, operativno in tehnično osebje, ki je potrebno v zvezi z zagotavljanjem zračnega prevoza.
3. Potrebe po osebju lahko "določeni prevoznik po lastni presoji zadovolji z lastnim osebjem ali z uporabo storitev katerekoli druge organizacije, podjetja ali prevoznika, ki deluje na ozemlju druge pogodbenice in ima dovoljenje za opravljanje takih storitev na ozemlju te pogodbenice.
4. Navedene dejavnosti bodo opravljali v skladu z zakoni in predpisi druge pogodbenice.
8. člen
Poštena konkurenca
1. Določena prevoznika obeh pogodbenic bosta imela poštene in enake možnosti sodelovati v mednarodnem zračnem prevozu, za katerega velja ta sporazum.
2. Pogodbenici bosta v okviru svojih pristojnosti storili vse, kar je mogoče, za odpravo vseh oblik diskriminacije ali nepoštene konkurence, ki bi škodovala konkurenčnemu položaju prevoznika druge pogodbenice.
9. člen
Red letenja
1. Določena prevoznika obeh pogodbenic bosta petinštirideset (45) dni pred nameravano uveljavitvijo predložila pristojnemu organu druge pogodbenice vozni red svojega nameravanega prometa s specifikacijo frekvenc, tip zrakoplova, razporeditev in število sedežev, ki jih bosta ponudila javnosti.
2. Zahteve za odobritev opravljanja dodatnih letov lahko prevoznik predloži neposredno pristojnemu organu druge pogodbenice. Taka zahteva mora biti v načelu vložena najmanj dva (2) delovna dneva pred takim letom.
10. člen
Davki, carine in takse
1. Zrakoplovi, ki jih uporabljata v mednarodnem zračnem prometu določena prevoznika obeh pogodbenic, kot tudi njihova običajna oprema, rezervni deli, zaloge goriv in maziv, zaloge na zrakoplovu (vključno s hrano, pijačo in tobakom) kot tudi oglasno in propagandno gradivo, ki je v takem zrakoplovu, bodo ob prihodu na ozemlje druge pogodbenice oproščeni vseh carin, inšpekcijskih taks in podobnih nacionalnih ali lokalnih obremenitev ali taks, če taka oprema in zaloge ostanejo v zrakoplovu, dokler niso ponovno izvožene.
2. Glede običajne opreme, rezervnih delov, zalog goriv in maziv in zalog na zrakoplovih, ki jih pripelje na ozemlje ene pogodbenice določeni prevoznik druge pogodbenice ali nekdo drug zanj, ali ki so vkrcane v zrakoplov, ki ga upravlja tak določeni prevoznik, in so namenjene samo za uporabo v zrakoplovu med opravljanjem mednarodnega zračnega prometa, se davki in takse, vključno s cenami in inšpekcijskimi taksami, ki se zaračunavajo na ozemlju prve pogodbenice, ne bodo zaračunavali, tudi če bodo te zaloge uporabljene na delih potovanja nad ozemljem pogodbenice, v kateri so bile vkrcane.
Za omenjene predmete se lahko zahteva, da so pod carinskim varstvom in nadzorom.
3. Običajna oprema v zrakoplovu, rezervni deli, zaloge goriv in maziv in zaloge, ki so v zrakoplovih ene ali druge pogodbenice, so lahko izkrcane na ozemlju druge pogodbenice le z odobritvijo carinskih organov te pogodbenice, ki lahko zahtevajo, da so ti predmeti pod njihovim nadzorom, dokler niso ponovno izvoženi ali drugače porabljeni v skladu s carinskimi predpisi.
11. člen
Dvojno obdavčenje
1. Dohodek in dobički od uporabe zrakoplovov v mednarodnem zračnem prometu bodo obdavčljivi samo v državi, v kateri ima sedež uprava podjetja.
2. Zaslužki od odtujitve zrakoplovov, uporabljenih v mednarodnem zračnem prometu, bodo obdavčljivi samo v državi, v kateri ima sedež uprava podjetja.
3. Kapital, ki ga predstavljajo zrakoplovi, ki opravljajo mednarodni zračni promet, in premično premoženje, ki sodi h poslovanju s temi zrakoplovi, bosta obdavčljiva samo v" državi, v kateri ima sedež uprava podjetja.
4. Določila 1. odstavka tega člena se nanašajo tudi na dohodek in dobičke od skupnega poslovanja, skupnih podjetij ali od sodelovanja v mednarodnih agencijah.
12. člen Transfer denarja
1. Določena prevoznika obeh pogodbenic bosta lahko prosto prodajala storitve zračnega prevoza na ozemljih obeh pogodbenic neposredno ali preko agentov v kateri koli valuti.
2. Določena prevoznika obeh pogodbenic bosta lahko brez kakršnega koli dodatnega dovoljenja transferirala z ozemlja prodaje na domače ozemlje na ozemlju prodaje ustvarjen presežek prejemkov nad izdatki. V tak neto transfer bodo vključeni dohodki od prodaje zračnega prevoza neposredno ali preko agentov ter dopolnilnih ali dodatnih storitev in normalne komercialne obresti na take dohodke za čas, ko naloženi v bankah čakajo na transfer.
3. Določena prevoznika obeh pogodbenic imata pravico transferirati presežek, omenjen v 2. odstavku tega člena, vključno z normalnimi komercialnimi obrestmi na take dohodke, medtem ko naloženi čakajo na transfer, v prosto konvertibilno valuto po uradnem menjalnem tečaju lokalne valute na dan nakazila v tujino.
13. člen
Uporaba zakonov, predpisov in postopkov
1. Zakone, predpise in postopke ene pogodbenice, ki se nanašajo na prihod na njeno ozemlje ali odhod z njenega ozemlja zrakoplovov, ki opravljajo mednarodni zračni promet, ali na uporabo in vodenje takih zrakoplovov, bo določeni prevoznik druge pogodbenice spoštoval pri vstopu na to ozemlje, med zadrževanjem na njem in ob odhodu s tega ozemlja.
2. Zakoni, predpisi in postopki ene pogodbenice glede priseljevanja, potnih listov ali drugih odobrenih potnih dokumentov, vstopa, carinskega postopka, carine in karantene bodo spoštovani s strani ali v imenu posadk, potnikov, tovora in pošte v zrakoplovih določenega prevoznika druge pogodbenice pri vstopu na ozemlje te pogodbenice, med zadrževanjem na tem ozemlju in ob odhodu s tega ozemlja.
3. Prispevki in takse, ki se zaračunavajo na ozemlju vsake pogodbenice prevozniku druge pogodbenice za uporabo letališč in objektov za zračno plovbo na ozemlju prve pogodbenice, ne bodo višji od tistih, ki se zaračunavajo kateremukoli prevozniku, ki opravlja podoben promet.
4. Nobena pogodbenica ne bo dala kateremu koli drugemu prevozniku prednosti pred določenim prevoznikom druge pogodbenice pri uporabi carinskih, priselitvenih, karantenskih in podobnih predpisov; ali pri uporabi letališč, zračnih poti in služb zračnega prometa ter s tem povezanih objektov, ki jih nadzoruje.
14. člen
Priznavanje potrdil in dovoljenj
1. Spričevala o plovnosti, spričevala o sposobnosti in dovoljenja, ki jih je izdala ali potrdila ena pogodbenica in ki so veljavna, bo druga pogodbenica priznala kot veljavna za opravljanje dogovorjenega prometa na določenih progah, pod pogojem, da so bila taka potrdila ali dovoljenja izdana ali potrjena v skladu s standardi, določenimi na podlagi konvencije.
2. Vsaka pogodbenica pa si pridržuje pravico, da za prelete nad svojim ozemljem ne prizna spričeval o sposobnosti in dovoljenj, ki jih je njenim državljanom izdala druga pogodbenica.
15. člen
Varnost
1. Pogodbenici si bosta zagotavljali medsebojno pomoč, če bo ta potrebna, da bi preprečili nezakonite ugrabitve zrakoplovov in druga nezakonita dejanja proti varnosti zrakoplovov, letališč in navigacijskih naprav ter vsako drugo ogrožanje varnosti zračne plovbe.
2. Obe pogodbenici se strinjata, da bosta spoštovali nediskriminacijske in splošno veljavne varnostne predpise, ki jih zahteva druga pogodbenica za vstop na svoje ozemlje, in da bosta na primeren način pregledali potnike in njihovo ročno prtljago. Obe pogodbenici bosta tudi z naklonjenostjo obravnavali vsako zahtevo druge pogodbenice za uvedbo posebnih varnostnih ukrepov za njene zrakoplove ali potnike zaradi neposredne grožnje.
3. Pogodbenici bosta ravnali v skladu z ustreznimi določili o letalski varnosti, ki jih predpiše Mednarodna organizacija civilnega letalstva. Če ena pogodbenica ne bi spoštovala takih določil, lahko druga pogodbenica zahteva posvetovanja s prvo pogodbenico. Če se pogodbenici ne dogovorita drugače, se bodo taka posvetovanja pričela v šestdesetih (60) dneh od dneva, ko je bila taka zahteva prejeta. Če se ne moreta zadovoljivo sporazumeti, je to lahko razlog za uporabo 17. člena tega sporazuma.
4. Pogodbenici bosta ravnali v skladu z določili Konvencije o kaznivih dejanjih in nekaterih drugih dejanjih, storjenih na letalih, podpisani v Tokiu 14. septembra 1963, konvencije o zatiranju nezakonite ugrabitve zrakoplovov, podpisane v Haagu 16. decembra 1970, Konvencije o zatiranju nezakonitih aktov zoper varnost civilnega letalstva, podpisane v Montrealu 23. septembra 1971 in njenega dopolnilnega Protokola o zatiranju nezakonitih nasilnih dejanj na letališčih za mednarodno civilno zrakoplovstvo, podpisanega v Montrealu 24. februarja 1988, če sta obe pogodbenici tudi pogodbenici teh konvencij.
5. Ob nezakoniti ugrabitvi ali grožnji z ugrabitvijo oziroma drugih nezakonitih dejanjih proti varnosti zrakoplovov, letališč ali navigacijskih naprav bosta pogodbenici pomagali druga drugi, s tem da bosta poskrbeli za komunikacije in druge ukrepe, da bi se čim hitreje in varno končal tak incident ali grožnja.
16. člen
Posvetovanja in dopolnitve
1. V duhu tesnega sodelovanja bosta pristojna organa pogodbenic imela občasna posvetovanja z namenom zagotoviti uresničevanje in primerno spoštovanje določil tega sporazuma.
2. Vsaka pogodbenica lahko zahteva posvetovanja s ciljem spremeniti ta sporazum ali njegovo prilogo. Taka posvetovanja, razen če je dogovorjeno drugače, se bodo pričela v šestdesetih (60) dneh po prejemu zahteve druge pogodbenice.
3. Vsaka sprememba tega sporazuma, za katero se pogodbenici dogovorita, prične veljati tisti dan, ko pogodbenici pisno obvestita druga drugo, da so izpolnjeni ustrezni ustavni predpisi.
4. O kakršni koli spremembi priloge tega sporazuma se bosta pisno sporazumela pristojna organa in bo pričela veljati tisti dan, ki ga bosta omenjena organa določila.
17. člen
Reševanje sporov
1. Če pride med pogodbenicama do spora v zvezi z razlago ali izvajanjem tega sporazuma, si bosta pogodbenici zlasti prizadevali, da bi ga rešili z medsebojnimi pogajanji.
2. Če pogodbenici ne moreta doseči rešitve s pogajanji, je lahko spor na zahtevo ene ali druge pogodbenice predložen v odločitev arbitraži treh razsodnikov, od katerih vsaka pogodbenica določi enega, tako izbrana razsodnika pa se dogovorita o tretjem, ki ne sme biti državljan ene ali druge pogodbenice. Vsaka pogodbenica bo imenovala svojega razsodnika v šestdesetih (60) dneh od dneva, ko je po diplomatski poti prejela zahtevo druge pogodbenice, da se spor reši z arbitražo, in tretji razsodnik bo dogovorjen v naslednjih šestdesetih (60) dneh. Če katera koli pogodbenica ne imenuje svojega razsodnika v šestdesetih (60) dneh ali če o tretjem razsodniku ni dogovorjeno v predvidenem času, lahko katera koli pogodbenica zahteva od predsednika Sveta Mednarodne organizacije civilnega letalstva, naj določi razsodnika ali razsodnike.
3. Pogodbenici se obvezujeta, da bosta spoštovali vsako odločitev, ki bo sprejeta na podlagi 2. odstavka tega člena.
4. Arbitražno razsodišče določi svoj postopek. Vsaka pogodbenica plača stroške svojega razsodnika. Preostale stroške arbitražnega razsodišča krijeta pogodbenici v enakih deležih.
18. člen
Odpoved
1. Vsaka pogodbenica lahko kadarkoli pisno po diplomatski poti sporoči drugi pogodbenici svojo odločitev, da odpoveduje sporazum.
2. Tako sporočilo bo hkrati poslano Mednarodni organizaciji civilnega letalstva. V takem primeru bo sporazum prenehal veljati dvanajst (12) mesecev po dnevu, ko druga pogodbenica prejme sporočilo o odpovedi, razen če je sporočilo o odpovedi sporazumno umaknjeno pred iztekom tega roka. Če druga pogodbenica ne potrdi prejema sporočila o odpovedi, se šteje, da ga je prejela Štirinajst (14) dni po dnevu, ko ga je prejela Mednarodna organizacija civilnega letalstva.
19. člen
Registracija pri mednarodni organizaciji civilnega letalstva
Ta sporazum in kakršna koli njegova sprememba bosta registrirana pri Mednarodni organizaciji civilnega letalstva.
20. člen
Uporaba večstranskih sporazumov
1. Določila konvencije se bodo uporabljala za ta sporazum.
2. Če nek večstranski sporazum, ki se nanaša ha karkoli, kar je predmet tega sporazuma, in ki ga sprejmeta obe pogodbenici, prične veljati, bodo ustrezna določila takega sporazuma nadomestila določila v tem sporazumu.
21. člen
Uporaba
Kar zadeva Kraljevino Nizozemsko, se ta sporazum uporablja samo za kraljevino v Evropi.
22. člen
Uveljavitev
Ta sporazum bo začel veljati prvi dan drugega meseca, ki bo sledil dnevu, ko bosta obe pogodbenici pisno obvestili druga drugo, da so v njunih državah izpolnjeni notranje pravni pogoji za njegovo uveljavitev.
V potrditev dogovorjenega sta podpisana, ki sta imela za to ustrezno pooblastilo svojih vlad, podpisala ta sporazum.
Sestavljeno dne 24. novembra 1993 v Ljubljani v dveh izvodih v angleškem jeziku.

PRILOGA
Sporazuma o zračnem prometu med Republiko Slovenijo in Kraljevino Nizozemsko
1. Določeni prevoznik iz Republike Slovenije ima pravico opravljati zračni promet na spodaj določenih progah:
kraji v Sloveniji – vmesni kraji – kraji na Nizozemskem – naslednji kraji in vice versa.
2. Določeni prevoznik iz Kraljevine Nizozemske ima pravico opravljati zračni promet na spodaj določenih progah:
kraji na Nizozemskem – vmesni kraji – kraji v Sloveniji – naslednji kraji in vice versa.
3. Katerekoli ali vse kraje na določenih progah lahko določeni prevoznik, če to želi, izpusti na posameznem ali na vseh letih.
4. Določena prevoznika obeh pogodbenic lahko opravljata lete na omenjenih progah brez omejitev glede frekvence in tipa zrakoplova, ne glede na konfiguracijo.
5. Vsak določeni prevoznik ima pravico, da izvršuje pravico popolne pete svobode na vseh vmesnih in naslednjih krajih po svojem pregledu prog v Evropi ali zunaj Evrope, če se o tem dogovorita določena prevoznika obeh pogodbenic.
3. člen
Za izvajanje tega sporazuma skrbi ministrstvo, pristojno za promet in zveze – Uprava za zračno plovbo.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
