O RAZGLASITVI ZAKONA O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO KRALJEVINE ŠVEDSKE O SODELOVANJU V BOJU PROTI ORGANIZIRANEMU KRIMINALU, NEZAKONITI TRGOVINI S PREPOVEDANIMI DROGAMI IN PREDHODNIMI SESTAVINAMI, TERORIZMU IN DRUGIM HUJŠIM KAZNIVIM DEJANJEM (BSEBOK)
Razglašam Zakon o ratifikaciji Sporazuma med Vlado Republike Slovenije in Vlado Kraljevine Švedske o sodelovanju v boju proti organiziranemu kriminalu, nezakoniti trgovini s prepovedanimi drogami in predhodnimi sestavinami, terorizmu in drugim hujšim kaznivim dejanjem (BSEBOK), ki ga je sprejel Državni zbor Republike Slovenije na seji 21. junija 2005.

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO KRALJEVINE ŠVEDSKE O SODELOVANJU V BOJU PROTI ORGANIZIRANEMU KRIMINALU, NEZAKONITI TRGOVINI S PREPOVEDANIMI DROGAMI IN PREDHODNIMI SESTAVINAMI, TERORIZMU IN DRUGIM HUJŠIM KAZNIVIM DEJANJEM (BSEBOK)
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Kraljevine Švedske o sodelovanju v boju proti organiziranemu kriminalu, nezakoniti trgovini s prepovedanimi drogami in predhodnimi sestavinami, terorizmu in drugim hujšim kaznivim dejanjem, podpisan v Stockholmu 18. maja 2004.
2. člen
Besedilo sporazuma se v izvirniku v slovenskem in angleškem jeziku glasi:*
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN VLADO KRALJEVINE ŠVEDSKE O SODELOVANJU V BOJU PROTI ORGANIZIRANEMU KRIMINALU, NEZAKONITI TRGOVINI S PREPOVEDANIMI DROGAMI IN PREDHODNIMI SESTAVINAMI, TERORIZMU IN DRUGIM HUJŠIM KAZNIVIM DEJANJEM
Vlada Republike Slovenije
in
Vlada Kraljevine Švedske,
v nadaljevanju pogodbenici, sta se v želji,
da prispevata k razvoju dvostranskih odnosov,
da sodelujeta v boju proti kriminalu, zlasti organiziranemu kriminalu, nezakoniti trgovini s prepovedanimi drogami in predhodnimi sestavinami, terorizmu in drugim hujšim kaznivim dejanjem,
da okrepita skupna prizadevanja pri preprečevanju terorizma in zlorabi prepovedanih drog,
da uskladita skupne ukrepe proti mednarodnemu organiziranemu kriminalu,
sporazumeli:
1. člen
Pogodbenici v skladu s svojim notranjim pravom sodelujeta pri ukrepih za boj proti organiziranemu kriminalu, tihotapljenju, nezakoniti trgovini s prepovedanimi drogami in predhodnimi sestavinami ter terorizmu kot tudi pri preprečevanju, odkrivanju, zatiranju in pregonu drugih hujših kaznivih dejanj.
Pogodbenici zlasti sodelujeta v primerih, ko so kazniva dejanja storjena ali potekajo priprave nanje na ozemlju države ene od pogodbenic, podatki pa kažejo, da obstaja verjetnost, da potekajo priprave nanje ali so storjena na ozemlju države druge pogodbenice.
Pristojna organa za namene tega sporazuma sta:
v Republiki Sloveniji:
Ministrstvo za notranje zadeve, Generalna policijska uprava, in
v Kraljevini Švedski:
Nacionalna policijska uprava.
2. člen
Sodelovanje med pogodbenicama obsega izmenjavo informacij, sledenje in identifikacijo oseb ter druge ukrepe v skladu z namenom tega sporazuma in glede na obveznosti pogodbenic v skladu z nacionalno zakonodajo in ustreznimi mednarodnimi sporazumi.
Sodelovanje vključuje tudi izmenjavo izkušenj glede ukrepov za preprečevanje kriminala in boj proti njemu. Poleg tega sodelovanje vključuje izmenjavo obiskov strokovnjakov ter zagotavljanje informacij in dejstev o stanju in trendih na področju kriminala v posamezni državi.
Ta sporazum se ne nanaša na vprašanja medsebojne pomoči v kazenskih zadevah ali izročitvah.
3. člen
Zaprosila za podatke ali druge ukrepe v skladu s tem sporazumom pošiljata v imenu Republike Slovenije Generalna policijska uprava v Ministrstvu za notranje zadeve in v imenu Kraljevine Švedske Nacionalna policijska uprava, ki sodelujeta neposredno.
Pristojna organa se sporazumevata v angleškem jeziku, če ni dogovorjeno drugače.
4. člen
Pristojna organa pogodbenic, navedena v tretjem odstavku 1. člena, se lahko dogovorita o načinu izvajanja tega sporazuma.
5. člen
Informacije in dokumenti, prejeti v okviru tega sporazuma, se smejo uporabiti le za namene, navedene v zaprosilu, razen če zaprošena pogodbenica ne da pisnega soglasja za drugačno uporabo.
Izmenjava osebnih podatkov po tem sporazumu poteka v skladu z notranjim pravom pogodbenic in Konvencijo o varstvu posameznikov glede na avtomatsko obdelavo osebnih podatkov (Strasbourg, 28. januar 1981).
6. člen
Pogodbenici jamčita za zaupnost vseh poslanih podatkov, ki jih katera od pogodbenic označi kot zaupne v skladu s svojim notranjim pravom.
Posredovanje podatkov, poslanih v skladu s tem sporazumom, tretji državi je mogoče samo s pisnim soglasjem pristojnega organa pogodbenice pošiljateljice.
7. člen
Vsaka pogodbenica, ki prejme zaprosilo, ga lahko v celoti ali delno zavrne, če ni v skladu z njeno zakonodajo ali ogroža njeno suverenost ali nacionalno ali javno varnost države te pogodbenice ali je v nasprotju z njenimi splošnimi pravnimi načeli ali drugimi pomembnimi interesi.
Pogodbenica, ki pošlje zaprosilo, je čim prej obveščena o razlogih, zaradi katerih ni mogoče ugoditi zaprosilu.
8. člen
Določbe tega sporazuma ne vplivajo na druge dvostranske ali mnogostranske sporazume, ki zavezujejo pogodbenici.
9. člen
Ta sporazum začne veljati na dan prejema zadnjega od uradnih obvestil, s katerima se pogodbenici obvestita, da so izpolnjene vse notranjepravne zahteve, potrebne za začetek njegove veljavnosti.
Ta sporazum je sklenjen za nedoločen čas. Vsaka pogodbenica ga lahko odpove po diplomatski poti. Odpoved začne veljati po šestih mesecih od dneva prejema uradnega obvestila o odpovedi.
Sestavljeno v Stockholmu dne 18. maja 2004 v dveh izvirnikih v slovenskem, švedskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Ob razlikah pri razlagi prevlada angleško besedilo.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE KINGDOM OF SWEDEN ON COOPERATION IN THE FIGHT AGAINST ORGANISED CRIME, ILLICIT TRAFFICKING IN DRUGS AND PRECURSORS, TERRORISM AND OTHER SERIOUS CRIMES
The Government of the Republic of Slovenia
and
The Government of the Kingdom of Sweden
hereinafter referred to as the Contracting Parties,
having the wish to contribute to the development of bilateral relations,
to cooperate in the fight against crime, especially organised crime, illicit trafficking in drugs and precursors, terrorism and other serious crimes,
to enhance their joint efforts in the prevention of terrorism and illicit drugs abuse,
to harmonise joint actions against international organised crime,
have agreed as follows:
Article 1
The Contracting Parties shall cooperate, in accordance with their national law, as regards measures to combat organised crime, smuggling and illicit trafficking in drugs and precursors, terrorism, as well as the prevention, detection, suppression and prosecution of other serious crimes.
The Contracting Parties shall cooperate especially in cases when criminal offences or preparations for these offences are committed on the territory of the State of one of the Contracting Parties and the information indicates a possibility of preparing or committing criminal offences on the territory of the State of the other Contracting Party.
For the purpose of this Agreement, the competent authorities in the respective countries are
on the part of the Republic of Slovenia:
The Ministry of the Interior, General Police Directorate, and
on the part of the Kingdom of Sweden:
the National Police Board.
Article 2
Cooperation between the Contracting Parties shall encompass the exchange of information, the tracing and identification of persons and other measures in accordance with the purposes of this Agreement and in conformity with undertakings made by the Contracting Parties in accordance with their national legislation and relevant international agreements.
Furthermore, this cooperation shall encompass the exchange of experience as regards measures to prevent and combat crime. Moreover, such cooperation shall encompass the exchange of visits by experts and the provision of information and facts regarding the crime situation and crime trends in the respective states.
This Agreement does not affect questions concerning mutual assistance in criminal matters or extraditions.
Article 3
Requests for information or other measures in accordance with this Agreement are transmitted on behalf of the Republic of Slovenia by the General Police Directorate within the Ministry of the Interior and on behalf of the Kingdom of Sweden by the National Police Board, which shall contact each other directly.
All communications between the competent authorities shall take place in English, unless otherwise agreed.
Article 4
The competent authorities of the Contracting Parties listed in Article 1, paragraph 3, may agree about the manner of implementing this Agreement.
Article 5
Information and documents received within the framework of this Agreement may not be used for purposes other than those stated in the request, unless the requested Contracting Party gives its consent to other use in writing.
The exchange of personal data, in accordance with this Agreement, shall be subject to the national law of the Contracting Parties and the Convention for the Protection of Individuals with Regard to Automatic Processing of Personal Data (Strasbourg 28 January 1981).
Article 6
The Contracting Parties guarantee the confidentiality of all transmitted data determined as confidential by either of the Contracting Parties in accordance with their national law.
The forwarding to a Third State of data transmitted in accordance with this Agreement is possible only upon a written consent of the competent authority of the transmitting Contracting Party.
Article 7
Each Contracting Party receiving a request shall be entitled to refuse it, wholly or in part, if it is not compatible with its legislation or entails an infringement of the sovereignty or the national or public security of the State of that Party or is in conflict with its general principles of law or other essential interests.
The Contracting Party sending the request shall be notified as soon as possible of the reason why compliance with the request is not possible.
Article 8
The provisions of this Agreement shall not affect any other bilateral or multilateral agreement binding the Contracting Parties.
Article 9
This Agreement shall enter into force on the date of the receipt of the last notification by which the Contracting Parties inform each other of the fulfilment of the national legal requirements necessary for its entry into force.
This Agreement is concluded for an indefinite period of time. Either Contracting Party may terminate this Agreement through diplomatic channels. The termination shall become effective six months following the day the notification of termination was received.
Done in Stockholm on 18 May 2004 in two original copies each in Slovenian, Swedish and English language, all texts being equally authentic. In the event of any divergence of interpretation the English text shall prevail.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za notranje zadeve.
4. člen
Ta zakon začne veljati petnajsti dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
