U R E D B O
O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN ZVEZNIM SVETOM ŠVICE O OLAJŠAVAH ZA MEDNARODNI CESTNI PREVOZ BLAGA V ZVEZI S SPORAZUMI S TRETJIMI DRŽAVAMI O PREVOZU PO KOPNEM
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Zveznim svetom Švice o olajšavah za mednarodni cestni prevoz blaga v zvezi s sporazumi s tretjimi državami o prevozu po kopnem, sklenjen z izmenjavo not z dne 16. oktobra 2003 in 21. novembra 2003 v Ljubljani.
2. člen
Besedilo sporazuma se v izvirniku v angleškem jeziku ter v prevodu v slovenskem jeziku glasi:

The Embassy of Switzerland presents its compliments to the Ministry of Foreign Affairs of the Republic of Slovenia and has the honour to submit the following proposal for an agreement between the two states on facilitating international carriage of goods by road in reference to third countries’ agreements on land transport.
The Federal Council of Switzerland and the Government of the Republic of Slovenia agree under consideration that in Switzerland the actual maximum laden weight limit for articulated vehicles and road trains is limited to 34 tons for all types of traffic until December 31, 2004 that Switzerland grants Slovenia the following quotas for vehicles in international traffic for which the actual total laden weight is in excess of 34 tons but does not exceed 40 tons:
a) 600 authorisations for the last six months of the year 2003 (1st of July – 31st of December; annual basis of 1’200 authorisations) and 400 authorisations for the first four months of the year 2004 (1st of January – 30th of April; annual basis of 1’200 authorisations) for international traffic. International traffic means either transit traffic (the carriage of goods across the territory of Switzerland without loading or unloading), or export and import traffic (each inward and outward run with loading and unloading of goods in Switzerland) whereas transports between two points situated on the territory of Switzerland (inland transport / cabotage) are not authorised under this agreement.
b) in addition to the distance-related heavy vehicle fee (HVF) for a 34-ton vehicle, an average additional charge (difference 34 t – 40 t) of CHF 55.- for the years 2003 and 2004 will be levied on passing through Swiss customs for each first entrance for a journey with an authorisation under the quota.
Should the Government of the Republic of Slovenia give its consent to the present proposal, the text of this proposal together with the reply of the Ministry of Foreign Affairs of the Republic of Slovenia shall constitute an agreement between the two governments which shall be applied provisionally from the date of the Ministry's note accepting the provisional application and shall enter into force definitively on the date of the Ministry's note informing the Embassy that the Government of Slovenia has completed all the necessary internal procedures required for the entry into force of the Agreement. This agreement shall be applicable until 30th of April 2004. After Slovenia’s accession to the European Union (on 1st of May 2004), Slovenia will be granted its authorisations for international transport on Swiss territory by the European Commission.
The Embassy avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Slovenia the assurances of its highest consideration.

Veleposlaništvo Švice izraža spoštovanje Ministrstvu za zunanje zadeve Republike Slovenije in ima čast predložiti naslednji predlog sporazuma med državama o olajšavah za mednarodni cestni prevoz blaga v zvezi s sporazumi s tretjimi državami o prevozu po kopnem.
Zvezni svet Švice in Vlada Republike Slovenije ob upoštevanju, da je v Švici za vse vrste prometa do 31. decembra 2004 dejanska meja največje mase natovorjenega vozila za tovorna vozila in cestne vlake omejena na 34 ton, soglašata, da Švica podeli Sloveniji naslednje kvote za vozila v mednarodnem prometu, za katera dejanska skupna natovorjena masa presega 34 ton, ne pa 40 ton:
a) 600 dovolilnic za zadnjih šest mesecev leta 2003 (1. julij–31. december; 1200 dovolilnic na leto) in 400 dovolilnic za prve štiri mesece leta 2004 (1. januar–30. april; 1200 dovolilnic na leto) za mednarodni promet. Mednarodni promet pomeni tranzitni promet (prevoz blaga čez ozemlje Švice brez natovarjanja ali raztovarjanja) ali izvozni in uvozni promet (vsaka vožnja v državo in iz države z natovarjanjem in raztovarjanjem blaga v Švici), medtem ko po tem sporazumu niso dovoljeni prevozi med dvema krajema na ozemlju Švice (notranji prevoz/kabotaža).
b) Poleg pristojbine za težka vozila na podlagi prevožene razdalje (HVF) za 34-tonsko vozilo se zaračuna povprečna dodatna dajatev (razlika od 34 t do 40 t) 55 CHF za leti 2003 in 2004 ob prehodu čez švicarsko carino za vsak prvi vstop za vožnjo z dovolilnico iz te kvote.
Če Vlada Republike Slovenije soglaša s tem predlogom, besedilo tega predloga skupaj z odgovorom Ministrstva za zunanje zadeve Republike Slovenije pomeni sporazum med vladama, ki se uporablja začasno od datuma note ministrstva, s katero se sprejme začasna uporaba, in začne dokončno veljati na datum note ministrstva, s katero se veleposlaništvo obvesti, da je Vlada Republike Slovenije dokončala vse potrebne notranje postopke za začetek veljavnosti sporazuma. Ta sporazum se uporablja do 30. aprila 2004. Po vstopu Slovenije v Evropsko unijo (1. maja 2004) bo Sloveniji dodelila njene dovolilnice za mednarodni prevoz po švicarskem ozemlju Evropska komisija.
Veleposlaništvo tudi ob tej priložnosti izraža Ministrstvu za zunanje zadeve Republike Slovenije globoko spoštovanje.

The Ministry of Foreign Affairs of the Republic of Slovenia presents its compliments to the Embassy of Switzerland and has the honour to confirm the receipt of its Note No. 39/2003 dated 16 October 2003 which reads as follows:
"The Embassy of Switzerland presents its compliments to the Ministry of Foreign Affairs of the Republic of Slovenia and has the honour to submit the following proposal for an agreement between the two states on facilitating international carriage of goods by road in reference to third countries’ agreements on land transport.

Ministrstvo za zunanje zadeve Republike Slovenije izraža spoštovanje Veleposlaništvu Švice in ima čast potrditi prejem njegove note št. 39/2003 z dne 16. oktobra 2003, ki se glasi, kot sledi:
"Veleposlaništvo Švice izraža spoštovanje Ministrstvu za zunanje zadeve Republike Slovenije in ima čast predložiti naslednji predlog sporazuma med državama o olajšavah za mednarodni cestni prevoza blaga v zvezi s sporazumi s tretjimi državami o prevozu po kopnem.

Ministrstvo za zunanje zadeve Republike Slovenije ima v imenu Vlade Republike Slovenije čast sporočiti njeno soglasje z zgoraj navedenim.
Ministrstvo za zunanje zadeve Republike Slovenije tudi ob tej priložnosti izraža Veleposlaništvu Švice globoko spoštovanje.

4. člen
Ta uredba začne veljati petnajsti dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
