Razglašam Zakon o ratifikaciji Sporazuma med Vlado Republike Slovenije in Vlado Ruske federacije o sodelovanju v boju proti organizirani kriminaliteti, nedovoljenemu prometu z mamili, terorizmu in drugim oblikam kriminalitete (BRUBOK), ki ga je sprejel Državni zbor Republike Slovenije na seji 25. oktobra 2001.

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO RUSKE FEDERACIJE O SODELOVANJU V BOJU PROTI ORGANIZIRANI KRIMINALITETI, NEDOVOLJENEMU PROMETU Z MAMILI, TERORIZMU IN DRUGIM OBLIKAM KRIMINALITETE (BRUBOK)
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Ruske federacije o sodelovanju v boju proti organizirani kriminaliteti, nedovoljenemu prometu z mamili, terorizmu in drugim oblikam kriminalitete, podpisan v Moskvi 15. maja 2001.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi: *
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN VLADO RUSKE FEDERACIJE O SODELOVANJU V BOJU PROTI ORGANIZIRANI KRIMINALITETI, NEDOVOLJENEMU PROMETU Z MAMILI, TERORIZMU IN DRUGIM OBLIKAM KRIMINALITETE
Vlada Republike Slovenije in Vlada Ruske federacije (v nadaljevanju pogodbenici),
ki izražata zaskrbljenost zaradi povečanja kriminalitete, še posebej organizirane kriminalitete,
ki priznavata pomen razvijanja sodelovanja na področju boja proti kriminaliteti,
ki želita okrepiti skupna prizadevanja v boju proti terorizmu in nedovoljenemu prometu z mamili,
ki upoštevata namene in načela mednarodnih sporazumov, katerih pogodbenici sta, ter resolucij Združenih narodov in njihovih specializiranih agencij o boju proti kriminaliteti,
sta se sporazumeli, kot sledi:
1. člen
1. Pogodbenici v skladu s svojo notranjo zakonodajo in tem sporazumom sodelujeta v boju proti kriminaliteti, še posebej organizirani kriminaliteti, v primerih, ko je za preprečevanje, identifikacijo, zatiranje in preiskovanje kriminalitete potrebno sodelovanje med pristojnimi organi obeh držav.
2. Pogodbenici sodelujeta še zlasti v boju proti naslednjim oblikam kriminalitete:
terorizmu;
nezakonitemu prometu z mamili, psihotropnimi snovmi in prekurzorji;
tihotapljenju;
legalizaciji (pranju) prihodkov, ki izvirajo iz kriminalitete;
nezakonitemu prometu z orožjem, strelivom, jedrskim in radioaktivnim materialom, razstrelivi in strupenimi snovmi;
nezakonitemu priseljevanju, trgovini z ljudmi in okoriščanju tretjih oseb s prostitucijo;
gospodarski kriminaliteti, vključno s kaznivimi dejanji na področju davkov;
kraji vozil in z njo povezanim nezakonitim poslovanjem;
nezakonit promet s kulturnimi in zgodovinskimi vrednotami.
3. Sodelovanje med pogodbenicama vključuje izmenjavo informacij in druge dejavnosti za namene tega sporazuma, ki se izvrši na podlagi zaprosila za pomoč ali pobude ene od pogodbenic.
4. Ta sporazum se ne uporablja za pravno pomoč v kazenskih primerih in izročitve.
2. člen
1. Pristojni organi pogodbenic so:
– za Republiko Slovenijo:
Ministrstvo za notranje zadeve Republike Slovenije,
Ministrstvo za finance Republike Slovenije in
Ministrstvo za zdravje Republike Slovenije; in
– za Rusko federacijo:
Urad generalnega tožilca Ruske federacije,
Ministrstvo za notranje zadeve Ruske federacije,
Zvezna varnostna služba Ruske federacije,
Odbor državne carine Ruske federacije,
Zvezna mejna služba Ruske federacije in
Zvezna davčna policija Ruske federacije.
Ti organi pri izvajanju tega sporazuma sodelujejo neposredno, operativno in v obsegu svojih pristojnosti; posebna področja dela in oblike sodelovanja se lahko določijo v protokolih med pristojnimi organi.
2. Pogodbenici se po diplomatski poti takoj obvestita o spremembah v sestavi svojih pristojnih organov.
3. člen
1. Zaprosilo za podatke ali dejavnosti, kot je določeno v tem sporazumu, pošljejo pristojni organi pogodbenic pisno in neposredno. V nujnih primerih se zaprosilo lahko posreduje v ustni obliki, ki pa ji mora nemudoma slediti pisna potrditev.
2. Pristojni organi pogodbenic zaprosilu ugodijo na najhitrejši možni način. Zaprošeni pristojni organ lahko zahteva dodatne podatke, če so ti potrebni za ugoditev zaprosilu.
3. Zaprošeni pristojni organ nosi vse stroške, ki pri izvrševanju zaprosila nastanejo v njegovi državi, razen ko pristojni organ prosilec nosi vse stroške potovanja svojih predstavnikov v zvezi z zaprosilom.
O plačilu izrednih stroškov v zvezi z zaprosilom se pristojni organi dogovorijo pred nastankom stroškov.
4. člen
Če je ugoditev zaprosilu za podatke ali dejavnosti zunaj pristojnosti zaprošenega organa, ta organ nemudoma posreduje zaprosilo ustreznemu pristojnemu organu in o tem obvesti organ prosilca.
5. člen
1. Vsaka pogodbenica lahko v celoti ali delno odkloni izvrševanje zaprosila ali postavi določene pogoje zanj, če njena notranja zakonodaja to sodelovanje omejuje, če izvrševanje zaprosila ogroža varnost ali druge temeljne interese države ali je v nasprotju z njeno notranjo zakonodajo.
2. O razlogih za zavrnitev zaprosila za sodelovanje se nemudoma obvesti ustrezni pristojni organ pogodbenice prosilke.
6. člen
V skladu z notranjo zakonodajo pogodbenic veljajo za varovanje osebnih in drugih podatkov, ki si jih pogodbenici izmenjata v okviru svojega sodelovanja, naslednji pogoji:
1) pogodbenica, ki prejme take podatke, jih sme uporabiti le v namene in pod pogoji, ki jih določi pogodbenica, ki jih je posredovala;
2) pogodbenica prejemnica posredujočo pogodbenico na zaprosilo obvesti o uporabi takih podatkov in o rezultatih te uporabe;
3) podatki se smejo izročati le pristojnim organom iz 2. člena tega sporazuma. Ti podatki se smejo izročiti drugim organom le ob predhodnem pisnem soglasju pogodbenice, ki je podatke posredovala;
4) pogodbenica, ki posreduje zaprošene podatke, mora zagotoviti, da so pravilni. Če bi se izkazalo, da so bili posredovani neresnični podatki ali podatki, ki ne bi smeli biti razkriti, mora biti pogodbenica, ki je podatke prejela, o tem nemudoma obveščena. Pogodbenica, ki je podatke prejela, popravi vse neresnične podatke in nemudoma uniči vse podatke, ki so bili posredovani pomotoma ali katerih posredovanje ni bilo dovoljeno;
5) na zahtevo upravičencev se vsi obstoječi podatki o njih kot tudi njihova načrtovana uporaba tem osebam pojasnijo. Obrazložitve glede osebnih podatkov ureja notranja zakonodaja pogodbenice, ki izroča take podatke;
6) posredovani podatki se izbrišejo na zaprosilo pristojnega organa pogodbenice, ki je podatke posredovala, ko niso več potrebni ali ko je ta sporazum odpovedan, o čemer se vnaprej obvesti pristojni organ posredujoče pogodbenice;
7) pogodbenici morata voditi evidenco o pošiljanju, prejemanju in brisanju osebnih podatkov;
8) pogodbenici morata zagotoviti učinkovito zaščito vseh osebnih podatkov in s tem preprečiti dostop nepooblaščenim osebam do takih podatkov in jih tudi ne smeta spreminjati ali objavljati.
7. člen
Carinski službi pogodbenic lahko, če se tako dogovorita, uporabita metodo kontrolirane pošiljke blaga, ki je lahko nedotaknjeno, odstranjeno ali v celoti ali delno zamenjano.
8. člen
1. Pogodbenici jamčita za zaupnost vseh podatkov, ki jih je ena izmed pogodbenic določila kot zaupne.
2. Gradiva, podatke in tehnično opremo, posredovane v skladu s tem sporazumom, je mogoče izročiti tretji državi le ob pisnem pristanku pristojnega organa pogodbenice, ki jih je prvi posredoval.
9. člen
Med sodelovanjem po tem sporazumu pristojni organi pogodbenic kot delovni jezik uporabljajo angleški jezik, če se ne dogovorijo drugače.
10. člen
Pristojni organi pogodbenic sodelujejo tudi pri usposabljanju, izmenjavi izkušenj in strokovnjakov, pri vzajemnem zagotavljanju pravnih informacij in podatkov o stanju glede kriminalitete in kriminalnih trendov v svojih državah. Finančne vidike takšnega sodelovanja sporazumno določijo pristojni organi pogodbenic.
11. člen
Pristojni organi pogodbenic se, če je to potrebno, sestanejo in ocenijo izvajanje tega sporazuma.
12. člen
Določbe tega sporazuma ne vplivajo na pravice in obveznosti pogodbenic, ki izhajajo iz drugih mednarodnih sporazumov, ki sta jih sklenili Republika Slovenija in Ruska federacija.
13. člen
1. Ta sporazum lahko pogodbenici sporazumno dopolnita z izmenjavo diplomatskih not.
2. Ta sporazum začne veljati na petnajsti dan po tem, ko pogodbenici po diplomatski poti prejmeta zadnje uradno obvestilo, da so bile izpolnjene notranje zahteve za začetek veljavnosti tega sporazuma.
3. Ta sporazum je sklenjen za nedoločen čas in ostane v veljavi šest mesecev od dneva, ko katera od pogodbenic drugi pogodbenici po diplomatski poti pošlje obvestilo o nameri, da sporazum odpove.
Sestavljeno v Moskvi dne 15. maja 2001 v dveh izvirnikih v slovenskem, ruskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. V primeru razlik v razlagi prevlada angleško besedilo.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE RUSSIAN FEDERATION CONCERNING THE CO-OPERATION IN THE FIGHT AGAINST ORGANIZED CRIME, ILLICIT DRUG TRAFFICKING, TERRORISM AND OTHER FORMS OF CRIME
The Government of the Republic of Slovenia and the Government of the Russian Federation (hereinafter referred to as the parties),
expressing concern about the rise of crime, especially in its organized forms,
recognizing the importance of development of co-operation in combating crime,
wishing to increase their joint efforts in the fight against terrorism and illicit drug trafficking,
taking into account purposes and principles of international agreements to which they are parties, as well as resolutions of the United Nations and its specialized agencies on fighting crime,
have agreed as follows:
Article 1
1. The Parties, in accordance with the national legislation of their States and this Agreement, shall cooperate in fighting crime, especially in its organized forms, in cases when prevention, identification, suppression and detection of crime require interaction between competent authorities of both Parties.
2. The Parties shall cooperate in fighting particularly the following forms of crime:
terrorism;
illegal trafficking in narcotic drugs, psychotropic substances and precursors;
smuggling;
legalization (laundering) of proceeds from crime;
illegal trafficking in firearms, ammunition, nuclear and radio-active materials, explosives and poisonous substances;
criminal activities related to illegal migration, trade in human beings and exploitation of prostitution by third parties;
economic crime, including crime in the field of taxation;
theft of vehicles and illegal operations related thereto;
illegal trafficking in objects of cultural and historical value.
3. The co-operation between the Parties shall include exchange of information and other actions relevant to the purposes of this Agreement carried out on the basis of request for assistance or initiative of one of the Parties.
4. This Agreement does not apply to legal assistance in criminal matters or to extradition.
Article 2
1. The competent authorities of the Parties are:
- on the part of the Republic of Slovenia:
the Ministry of Interior of the Republic of Slovenia;
the Ministry of Finance of the Republic of Slovenia and
the Ministry of Health of the Republic of Slovenia;
- on the part of the Russian Federation:
the Office of the Prosecutor-General of the Russian Federation,
the Ministry of Interior of the Russian Federation,
the Federal Security Service of the Russian Federation,
the State Customs Committee of the Russian Federation,
the Federal Border Guard Service of the Russian Federation and
the Federal Tax Police Service of the Russian Federation.
The mentioned competent authorities shall cooperate, directly and operatively, within their competencies with a view to implementing this Agreement; the specific fields of work and forms of co-operation may be defined in Protocols between.these competent authorities.
2. The Parties shall immediately inform each other through diplomatic channels of changes in the composition of their competent authorities.
Article 3
1. A request for data or action, as provided for in this Agreement, shall be made in writing and sent directly by the competent authorities of the Parties. In urgent cases, the request may be transmitted orally, followed, however, by an immediate written confirmation.
2. Requests for data or action shall be complied with by the competent authorities of the Parties in the speediest possible way. The requested competent authority may apply for additional data, if it is necessary to meet the request.
3. The requested competent authority shall bear all costs incurred within it’s State when complying with the requests except cases when the requesting competent authority shall bear all costs associated with the travel of its representatives in connection with requests.
The payment of any extraordinary costs in connection with requests shall be agreed upon by the competent authorities before the costs are incurred.
Article 4
When the compliance with the request for data or action is beyond the competence of the requested authority, such authority shall immediately pass the request to a relevant competent authority and inform the requesting authority accordingly.
Article 5
1. Either Party may deny, in whole or in part, its compliance with the request or may set certain conditions therefor, if this is restricted by the national legislation of its State, if the compliance with the request endangers the security or other essential interests of the State or contradicts the national legislation of its State.
2. Grounds for the denial of the request for cooperation shall be immediately brought to the attention of the relevant competent authority of the requesting Party.
Article 6
The following terms and conditions for the protection of personal and other data, exchanged by the Parties within their co-operation, shall apply, subject to the national legislation of the States of the Parties:
1) the Party receiving such data may use it only for the purposes and under the conditions defined by the transmitting Party;
2) the receiving Party shall, upon request by the transmitting Party, inform the latter of the use of such data and of the results of such use;
3) data may be delivered only to the competent authorities mentioned in Article 2 of this Agreement. Such data may be delivered to any other authorities only with previous written consent of the Party that transmitted such data;
4) the Party transmitting the requested data must make sure that the data is correct. Should it turn out that untrue data or data which should not have been disclosed were transmitted, the receiving Party shall immediately be informed of the fact. The receiving Party shall correct any untrue data and immediately destroy any data transmitted by mistake or unpermittedly;
5) upon requests of rightful claimants any existing data about them, as well as the planned use thereof, shall be explained to such persons. Giving explanation on data is governed by the national legislation of the State of the Party providing such data;
6) the transmitted data shall be destroyed on request of the transmitting Party, when it is no longer needed or this Agreement is terminated, of which fact the transmitting Party shall be forthwith informed;
7) the Parties are obliged to keep record of the transmission, receipt and destruction of data;
8) the Parties must provide efficient protection of the data to prevent the access of unauthorized persons to such data and are not allowed to alter or public it.
Article 7
The competent authorities of the Parties may upon mutual agreement and in accordance with the national legislation of the States of the Parties use method of controlled delivery of goods which can be intact, removed or replaced in whole or in part.
Article 8
1. The Parties guarantee the confidentiality of all data that was determined as confidential by any of the Parties.
2. Materials, data and technical equipment transmitted in accordance with this Agreement, may be forwarded to a Third State only upon a written consent of the competent authority of the Party that originally transmitted them.
Article 9
When caring out co-operation the competent authorities of the Parties shall use English language, except should they agree otherwise.
Article 10
The competent authorities of the Parties shall also cooperate in personal training, exchange of experience, providing each other with legal information and data on the situation with regard to crime and criminal trends in their States. The financial terms of such co-operation shall be determined by the competent authorities of the Parties by their mutual consent.
Article 11
The competent authorities of the Parties shall, if necessary, hold consultations to review the implementation of this Agreement.
Article 12
The provisions of this Agreement shall not affect the rights and obligation of the Parties under other international agreements concluded by the Republic of Slovenia and the Russian Federation.
Article 13
1. This Agreement may be amended by mutual consent of both Parties by exchange of diplomatic notes.
2. This Agreement shall come into force on the fifteenth day after the last written notification that the respective internal requirements necessary for the entry into force of this Agreement have been met was received by the Parties through diplomatic channels.
3. This Agreement is concluded for unlimited period of time and shall remain in force for six months after the date on which either Party receives from the other Party, through diplomatic channels, a written notice of its intention to terminate it.
Done at Moscow on 15th May 2001 in two original copies, each in Slovenian, Russian and English languages, all texts being equally authentic. In case of divergence of interpretation, the English text shall be used.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za notranje zadeve.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
