O RAZGLASITVI ZAKONA O RATIFIKACIJI EVROPSKEGA SPORAZUMA O UREDITVI GIBANJA OSEB MED DRŽAVAMI ČLANICAMI SVETA EVROPE (MESUGS)
Razglašam Zakon o ratifikaciji Evropskega sporazuma o ureditvi gibanja oseb med državami članicami Sveta Evrope (MESUGS), ki ga je sprejel Državni zbor Republike Slovenije na seji 25. oktobra 2001.

O RATIFIKACIJI EVROPSKEGA SPORAZUMA O UREDITVI GIBANJA OSEB MED DRŽAVAMI ČLANICAMI SVETA EVROPE (MESUGS)
1. člen
Ratificira se Evropski sporazum o ureditvi gibanja oseb med državami članicami Sveta Evrope, sestavljen v Parizu dne 13. decembra 1957.
2. člen
Evropski sporazum se v izvirniku v angleškem jeziku in slovenskem prevodu glasi: *
EUROPEAN AGREEMENT
ON REGULATIONS GOVERNING THE MOVEMENT OF PERSONS BETWEEN MEMBER STATES OF THE COUNCIL OF EUROPE
The governments signatory hereto, being members of the Council of Europe,
Desirous of facilitating personal travel between their countries,
Have agreed as follows:
Article 1
1 Nationals of the Contracting Parties, whatever their country of residence, may enter or leave the territory of another Party by all frontiers on presentation of one of the documents listed in the appendix to this Agreement, which is an integral part thereof.
2 The facilities mentioned in paragraph 1 above shall be available only for visits of not more than three months’ duration.
3 Valid passports and visas may be required for all visits of more than three months’ duration or whenever the territory of another Party is entered for the purpose of pursuing a gainful activity.
4 For the purposes of this Agreement, the term “territory” of a Contracting Party shall have the meaning assigned to it by such a Party in a declaration addressed to the Secretary General of the Council of Europe for communication to all other Contracting Parties.
Article 2
To the extent that one or more Contracting Parties deem necessary, the frontier shall be crossed only at authorised points.
Article 3
The foregoing provisions shall in no way prejudice the laws and regulations governing visits by aliens to the territory of any Contracting Party.
Article 4
This Agreement shall not prejudice the provisions of any domestic law and bilateral or multilateral treaties, conventions or agreements now in force or which may hereafter enter into force, whereby more favourable terms are applied to the nationals of other Contracting Parties in respect of the crossing of frontiers.
Article 5
Each Contracting Party shall allow the holder of any of the documents mentioned in the list drawn up by it and embodied in the appendix to this Agreement to re-enter its territory without formality even if his nationality is under dispute.
Article 6
Each Contracting Party reserves the right to forbid nationals of another Party whom it considers undesirable to enter or stay in its territory.
Article 7
Each Contracting Party reserves the option, on grounds relating to ordre public, security or public health, to delay the entry into force of this Agreement or order the temporary suspension thereof in respect of all or some of the other Parties, except insofar as the provisions of Article 5 are concerned. This measure shall immediately be notified to the Secretary General of the Council of Europe, who shall inform the other Parties. The same procedure shall apply as soon as this measure ceases to be operative.
A Contracting Party which avails itself of either of the options mentioned in the preceding paragraph may not claim the application of this Agreement by another Party save insofar as it also applies it in respect of that Party.
Article 8
This Agreement shall be open to the signature of the members of the Council of Europe, who may become Parties to it either by:
(a) signature without reservation in respect of ratification;
(b) signature with reservation in respect of ratification followed by ratification.
Instruments of ratification shall be deposited with the Secretary General of the Council of Europe.
Article 9
This Agreement shall enter into force on the first day of the month following the date on which three members of the Council shall, in accordance with Article 8, have signed the Agreement without reservation in respect of ratification or shall have ratified it.
In the case of any member who shall subsequently sign the Agreement without reservation in respect of ratification or shall ratify it, the Agreement shall enter into force on the first day of the month following such signature or the deposit of the instrument of ratification.
Article 10
After entry into force of this Agreement, the Committee of Ministers of the Council of Europe may invite any non-member State to accede to it. Such accession shall take effect on the first day of the month following the deposit of the instrument of accession with the Secretary General of the Council of Europe.
Article 11
Any government wishing to sign or accede to this Agreement which has not yet drawn up its list of the documents mentioned in Article 1, paragraph 1, and appearing in the appendix, shall submit a list of such documents to the Contracting Parties through the Secretary General of the Council of Europe. This list shall be considered to be approved by all the Contracting Parties and shall be added to the appendix to this Agreement if no objection is raised within two months of its transmission by the Secretary General.
The same procedure shall apply if a signatory government wishes to alter the list of documents drawn up by it and embodied in the appendix.
Article 12
The Secretary General of the Council of Europe shall notify members of the Council and acceding States:
(a) of the date of entry into force of this Agreement and the names of any members who have signed without reservation in respect of ratification or who have ratified it;
(b) of the deposit of any instrument of accession in accordance with Article 10;
(c) of any notification received in accordance with Article 13 and of its effective date.
Article 13
Any Contracting Party may terminate its own application of the Agreement by giving three months’ notice to that effect to the Secretary General of the Council of Europe.
In witness whereof the undersigned, being duly authorised thereto, have signed this Agreement.
Done at Paris, this 13th day of December 1957, in English and French, both texts being equally authentic, in a single copy which shall remain deposited in the archives of the Council of Europe. The Secretary General of the Council of Europe shall transmit certified copies to the signatory governments.
EVROPSKI SPORAZUM
O UREDITVI GIBANJA OSEB MED DRŽAVAMI ČLANICAMI SVETA EVROPE
Vlade podpisnice tega sporazuma, članice Sveta Evrope, so se
v želji, da bi osebam olajšale potovanje med svojimi državami,
sporazumele:
1. člen
(1) Državljani držav pogodbenic lahko ne glede na državo svojega prebivališča ob predložitvi katerega od dokumentov, navedenih v prilogi sporazuma, ki je njegov sestavni del, vstopijo na ozemlje drugih držav pogodbenic in ga zapustijo na vseh mejah.
(2) Olajšave, navedene v prvem odstavku, veljajo le za bivanje, ki ni daljše od treh mesecev.
(3) Veljavni potni listi in vizumi so potrebni za bivanje, daljše od treh mesecev, ali kadar ima oseba namen na ozemlju države pogodbenice opravljati pridobitno dejavnost.
(4) V tem sporazumu izraz “ozemlje“ države pogodbenice pomeni, da je ta v izjavi, naslovljeni na generalnega sekretarja Sveta Evrope, natančno določila izraz, s katerim generalni sekretar seznani vse države pogodbenice.
2. člen
Če ena ali več držav pogodbenic meni, da je to potrebno, se prestop meje dovoli le na uradnih mejnih prehodih.
3. člen
Določbe prejšnjih členov ne posegajo v pravne predpise, ki urejajo bivanje tujcev na ozemlju katere koli države pogodbenice.
4. člen
Ta sporazum ne posega v določbe notranje zakonodaje držav, dvostranskih ali večstranskih pogodb, sporazumov ali dogovorov, ne glede na to, ali ti že veljajo ali pa bodo šele začeli veljati, če vsebujejo ugodnejše pogoje za prestop meje državljanov drugih držav pogodbenic.
5. člen
Vsaka država pogodbenica imetniku katerega koli dokumenta iz seznama, ki je priloga tega sporazuma, dovoli vrnitev na svoje ozemlje brez formalnosti, čeprav bi dvomila o državljanstvu te osebe.
6. člen
Vsaka država pogodbenica si pridrži pravico, da nezaželenemu državljanu druge države pogodbenice ne dovoli vstopa ali bivanja na svojem ozemlju.
7. člen
Vsaka država pogodbenica si pridrži pravico, da zaradi javnega reda, javne varnosti ali zdravja odloži začetek veljavnosti sporazuma ali pa ga začasno za določen čas preneha izvajati z vsemi ali nekaterimi državami pogodbenicami, razen določb 5. člena. Z ukrepom mora nemudoma seznaniti generalnega sekretarja Sveta Evrope, ki o tem obvesti druge pogodbenice. Isti postopek velja tudi ob preklicu tega ukrepa.
Država pogodbenica, ki uporabi eno od možnosti iz prejšnjega odstavka, lahko od druge pogodbenice zahteva izvajanje tega sporazuma le do tiste mere, do katere tudi sama izvaja sporazum v odnosu do te pogodbenice.
8. člen
Ta sporazum je na voljo za podpis vsem članicam Sveta Evrope, ki lahko postanejo pogodbenice:
(a) s podpisom brez pridržka ratifikacije,
(b) s podpisom s pridržkom ratifikacije s poznejšo ratifikacijo.
Listine o ratifikaciji se deponirajo pri generalnem sekretarju Sveta Evrope.
9. člen
Sporazum začne veljati prvi dan naslednjega meseca po dnevu, ko so tri članice Sveta Evrope v skladu z 8. členom podpisale sporazum brez pridržka ratifikacije ali pa ga ratificirale.
Za vsako državo članico, ki podpiše sporazum brez pridržka ratifikacije ali ga ratificira, začne sporazum veljati prvi dan naslednjega meseca po podpisu sporazuma ali deponiranju listine o ratifikaciji.
10. člen
Ko sporazum začne veljati, lahko odbor ministrov Sveta Evrope vsako državo nečlanico povabi, da pristopi k sporazumu. Tak pristop začne veljati prvi dan naslednjega meseca po mesecu, v katerem je bila deponirana pristopna listina pri generalnem sekretarju Sveta Evrope.
11. člen
Vsaka vlada, ki želi podpisati ta sporazum ali želi pristopiti k njemu in še ni pripravila seznama dokumentov po prvem odstavku 1. člena in navedenega v prilogi, ga mora poslati državam pogodbenicam prek generalnega sekretarja Sveta Evrope. Ta seznam priznajo vse države pogodbenice in se vključi v prilogo tega sporazuma, če v dveh mesecih, ko jim ga pošlje generalni sekretar, ne ugovarja nobena država pogodbenica.
Isti postopek se uporabi, če želi vlada ene izmed držav pogodbenic spremeniti seznam dokumentov, ki ga je pripravila in navedenega v prilogi.
12. člen
Generalni sekretar Sveta Evrope uradno obvesti članice Sveta in pristopne države o:
(a) začetku veljavnosti tega sporazuma in imenih držav članic, ki so sporazum podpisale brez pridržka ratifikacije ali so ga ratificirale;
(b) deponiranju vseh pristopnih listin po 10. členu;
(c) vsakem uradnem obvestilu, prejetem v skladu s 13. členom, in o datumu začetka njegove veljavnosti.
13. člen
Katera koli država pogodbenica lahko preneha izvajati sporazum ob upoštevanju trimesečnega odpovednega roka, kar sporoči generalnemu sekretarju Sveta Evrope.
Da bi to potrdili, so podpisani, ki so bili za to pravilno pooblaščeni, podpisali ta sporazum.
Sestavljeno v Parizu 13. decembra 1957 v angleščini in francoščini, pri čemer sta besedili enako verodostojni, v enem izvodu, ki se shrani v arhivu Sveta Evrope. Generalni sekretar Sveta Evrope pošlje overjene kopije vladam podpisnicam.
3. člen
Za izvajanje tega sporazuma skrbi Ministrstvo za notranje zadeve.
4. člen
Republika Slovenija ob deponiranju listine o ratifikaciji Evropskega sporazuma o ureditvi gibanja oseb med državami članicami Sveta Evrope poda naslednjo izjavo:
Skladno s prvim in drugim odstavkom 7. člena Evropskega sporazuma o ureditvi gibanja oseb med državami članicami Sveta Evrope Republika Slovenija ob deponiranju listine o ratifikaciji izjavlja, da Republika Slovenija odlaga uveljavitev sporazuma v odnosu z Republiko Turčijo glede na to, da med njima vzajemno velja vizni režim, razen za imetnike diplomatskih, službenih ali specialnih potnih listov, skladno s sporazumom z dne 29.11. 1999 med Republiko Slovenijo in Turčijo.
Glede na to Republika Slovenija do nadaljnjega glede Turčije v skladu s 7. členom evropskega sporazuma ne bo izvajala določb prvega in drugega odstavka 1. člena evropskega sporazuma.
5. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
