Razglašam Zakon o ratifikaciji Sporazuma med Republiko Slovenijo in Portugalsko republiko o mednarodnem cestnem prevozu potnikov in blaga ter Protokola po 17. členu o izvajanju Sporazuma med Republiko Slovenijo in Portugalsko republiko o mednarodnem cestnem prevozu potnikov in blaga (BPOMCP), ki ga je sprejel Državni zbor Republike Slovenije na seji 31. maja 2000.

O RATIFIKACIJI SPORAZUMA MED REPUBLIKO SLOVENIJO IN PORTUGALSKO REPUBLIKO O MEDNARODNEM CESTNEM PREVOZU POTNIKOV IN BLAGA TER PROTOKOLA PO 17. ČLENU O IZVAJANJU SPORAZUMA MED REPUBLIKO SLOVENIJO IN PORTUGALSKO REPUBLIKO O MEDNARODNEM CESTNEM PREVOZU POTNIKOV IN BLAGA (BPOMCP)
1. člen
Ratificirata se Sporazum med Republiko Slovenijo in Portugalsko republiko o mednarodnem cestnem prevozu potnikov in blaga ter Protokol po 17. členu o izvajanju Sporazuma med Republiko Slovenijo in Portugalsko republiko o mednarodnem cestnem prevozu potnikov in blaga, podpisana 19. maja 1999 v Varšavi.
2. člen
Sporazum in protokol se v izvirniku v slovenskem in angleškem jeziku glasita:*
S P O R A Z U M
MED REPUBLIKO SLOVENIJO IN PORTUGALSKO REPUBLIKOO MEDNARODNEM CESTNEM PREVOZU POTNIKOV IN BLAGA
Republika Slovenija in Portugalska republika (v nadaljnjem besedilu pogodbenici) sta se
v želji, da bi prispevali k razvoju cestnega prevoza potnikov in blaga med državama kot tudi v tranzitu čez njuni ozemlji, in
ob upoštevanju potrebe, da se na evropski ravni sprejme politika, usmerjena k postopni liberalizaciji prevoznih storitev, uskladitvi konkurenčnih pogojev, varstvu okolja in varnosti v cestnem prometu,
sporazumeli, kot sledi:
I. UVODNE DOLOČBE
1. člen
Obseg
Ta sporazum brez vpliva na določbe drugega odstavka 7. člena daje prevoznikom s sedežem v eni ali drugi pogodbenici pravico, da opravljajo cestne prevoze potnikov ali blaga med ozemljema pogodbenic ali v tranzitu čez njuni ozemlji.
2. člen
Opredelitev izrazov
Za namen tega sporazuma imajo posamezni izrazi naslednji pomen:
a) izraz »prevoznik« pomeni fizično ali pravno osebo, ki je bodisi v Republiki Sloveniji bodisi v Portugalski republiki pravilno pooblaščena:
1) da za račun tretjega opravlja mednarodni cestni prevoz potnikov ali blaga;
2) da opravlja prevoz za svoj račun;
b) izraz »vozilo« pomeni:
1) če gre za prevoz potnikov, motorno vozilo, namenjeno za prevoz potnikov, z več kot 9 sedeži, vključno z voznikovim, kot tudi priklopnike za prevoz prtljage, če so ti registrirani v isti pogodbenici kot motorno vozilo;
2) če gre za prevoz blaga, tovorno vozilo, vlečno vozilo, priklopnik ali polpriklopnik kot tudi sestavljeno vozilo ali kombinacijo tovornega vozila in priklopnika pod pogojem, da je vsaj motorno vozilo registrirano na ozemlju ene od obeh pogodbenic;
c) izraz »tranzit« pomeni prevoz, ki ga prevoznik s sedežem v eni od pogodbenic opravlja čez ozemlje druge pogodbenice, ne da bi tam prevzemal ali razlagal blago in ne da bi tam vstopali ali izstopali potniki.
II. PREVOZ POTNIKOV
3. člen
Vrste prevoza
1. Prevoz potnikov, ki se opravlja po določbah tega sporazuma, je:
a) linijski prevoz;
b) izmenični prevoz;
c) občasni prevoz.
2. »Linijski prevoz« je prevoz, pri katerem se potniki prevažajo na določenih progah po predhodno določenem načrtu potovanja, voznem redu, prevoznini in postajališčih, na katerih potniki vstopajo in izstopajo.
3. »Izmenični prevoz« je prevoz, pri katerem se opravlja prevoz vnaprej organiziranih skupin potnikov z več potovanji iz istega odhodnega kraja do istega namembnega kraja.
»Odhodni kraj« oziroma »namembni kraj« pomeni kraj, kjer se potovanje začne oziroma konča, pri čemer so v obeh primerih vključeni okoliški kraji v polmeru 50 km.
Izmenični prevoz poleg tega vključuje nastanitev potnikov v namembnem kraju vsaj za dve nočitvi.
Ne glede na določbe točke b) tretjega odstavka 4. člena tega sporazuma pri izmeničnem prevozu:
– se vsaka skupina potnikov, ki je skupaj odpotovala iz odhodnega kraja, s poznejšim potovanjem skupaj vrne v odhodni kraj;
– potniki ne smejo vstopati ali izstopati zunaj odhodnega oziroma namembnega kraja;
– prva vožnja nazaj v odhodni kraj in zadnja vožnja v namembni kraj se opravita s praznim vozilom.
4. »Občasni prevoz« je prevoz, ki po opredelitvi pojma ne spada niti med linijski niti med izmenični prevoz.
4. člen
Sistem dovolilnic
1. Ne glede na izjeme, o katerih je govor v prvem odstavku 5. člena, so za prevoz potnikov, ki se opravlja po tem sporazumu, potrebne dovolilnice, ki jih pristojni organ druge pogodbenice izda po načelu vzajemnosti.
2. Glede linijskega prevoza:
a) vzpostavitev linijskega prevoza kot tudi sprememba pogojev za njegovo opravljanje se odobrita s skupnim soglasjem pristojnih organov pogodbenic pod pogojem, da z njima, kadar je to potrebno, soglašajo tudi pristojni organi tranzitnih držav;
b) dovoljenje, ki ga izda pristojni organ pogodbenice, velja le za del proge, ki je na ozemlju te iste pogodbenice;
c) načeloma se dovoljenje za vsak linijski prevoz izda na podlagi vzajemnosti;
d) trajanje veljavnosti dovoljenja ne sme preseči pet let.
3. Glede izmeničnega prevoza:
a) trajanje veljavnosti dovolilnice ne sme preseči šest mesecev;
b) dovolilnica se v določenem odstotku prevozov lahko izda za prevoz potnikov v določeni skupini v namembni kraj, ki se prepeljejo nazaj v odhodni kraj v drugi skupini.
5. člen
Prevozi, za katere dovolilnice niso potrebne
1. Dovolilnice niso potrebne za naslednje občasne prevoze:
a) za »vožnjo zaprtih vrat«, t. j. prevoz, pri katerem se ista skupina potnikov prevaža z istim vozilom ves čas potovanja in se vrne v odhodni kraj pod pogojem, da sta odhodni in namembni kraj na ozemlju pogodbenice, v kateri je registrirano vozilo;
b) za prevoz, ki vključuje vožnjo polnega vozila iz odhodnega kraja, ki je na ozemlju pogodbenice, v kateri je vozilo registrirano, do namembnega kraja, ki je na ozemlju druge pogodbenice, sledi pa ji vožnja praznega vozila nazaj v odhodni kraj;
c) za prevoz, ki vključuje vožnjo praznega vozila na ozemlje druge pogodbenice in tej sledi vožnja polnega vozila, pod pogojem, da vsi potniki vstopijo v istem kraju in:
– da so v skupino organizirani s prevozno pogodbo, sklenjeno pred vstopom na ozemlje druge pogodbenice, ali
– da jih je isto podjetje predhodno pripeljalo na ozemlje druge pogodbenice ali
– da so bili povabljeni na ozemlje pogodbenice, v kateri je sedež prevoznika, stroške prevoza pa krije oseba, odgovorna za povabilo;
d) za vožnjo praznega potniškega vozila, poslanega kot zamenjava za vozilo, ki se je pokvarilo v drugi državi, da bi nadaljevalo prevoz potnikov na podlagi iste potniške spremnice pokvarjenega vozila.
2. Prevozi, za katere dovolilnica po določbah prvega odstavka tega člena ni potrebna, se opravljajo na podlagi kontrolnega dokumenta, določenega s protokolom, omenjenim v 17. členu tega sporazuma.
III. PREVOZ BLAGA
6. člen
Sistem dovolilnic
1. Ne glede na izjeme, navedene v tretjem odstavku tega člena, je po določbah tega sporazuma za prevoz blaga za račun tretjega ali za svoj račun, ki ga prevoznik s sedežem v državi ene od pogodbenic opravlja z motornim vozilom, registriranim v isti državi, potrebna dovolilnica, ki jo izda pristojni organ druge pogodbenice.
2. Pristojna organa pogodbenic se lahko dogovorita o naslednjih dveh vrstah dovolilnic:
a) navadnih dovolilnicah, veljavnih za eno vožnjo, ali
b) časovnih dovolilnicah, veljavnih za posamezno koledarsko leto.
Trajanje veljavnosti je od 1. januarja do 31. januarja prihodnjega leta.
3. Dovolilnice niso potrebne za naslednje vrste prevozov:
a) prevoz blaga z vozili, katerih skupna dovoljena masa, vključno s priklopniki, ne presega 6 ton ali pri katerih dovoljena nosilnost, vključno s priklopniki, ne presega 3,5 tone;
b) prevoz blaga na letališča ali z njih v primerih, ko je letalski prevoz preusmerjen;
c) prevoz vozil, ki so poškodovana ali pokvarjena, in vožnja servisnih vozil;
d) vožnjo praznega tovornega vozila, poslanega kot zamenjava za vozilo, ki se je pokvarilo v drugi državi, in po popravilu tudi povratna vožnja vozila, ki se je pokvarilo;
e) prevoz rezervnih delov ter hrane in potrebščin za čezoceanske ladje in letala;
f) prevoz medicinskih potrebščin in opreme za nujne primere, še zlasti ob naravnih nesrečah;
g) prevoz umetniški del in predmetov za sejme in razstave;
h) prevoz rekvizitov, pripomočkov in živali na gledališke, glasbene, filmske, športne ali cirkuške predstave ali sejme ter z njih v nekomercialne namene in tistih, ki so namenjeni za radijska snemanja ali filmsko ali televizijsko produkcijo;
i) prevoz poštnih pošiljk kot javna storitev;
j) prevoz posmrtnih ostankov.
4. Skupni odbor, naveden v 18. členu tega sporazuma, lahko širi ali krči seznam vrst prevoza, za katere dovolilnice niso potrebne.
7. člen
Kvote
1. Pristojni organ pogodbenice, v kateri je registrirano vozilo, izdaja dovolilnice v okviru kvot, o katerih se vsako leto sporazumno dogovorita pristojna organa pogodbenic.
2. Del kvote, navedene v prvem odstavku tega člena, ki jo sporazumno določita pristojna organa pogodbenic, lahko prevozniki, ki imajo sedež na ozemlju ene od pogodbenic, uporabijo za opravljanje prevozov med ozemljem druge pogodbenice in tretjo državo.
IV. SPLOŠNE DOLOČBE
8. člen
Kabotaža
Po tem sporazumu prevoznik s sedežem v eni od pogodbenic ne sme prevzeti potnikov ali blaga na ozemlju druge pogodbenice, da bi jih prevažal znotraj istega ozemlja, razen v primeru, ko pristojni organ druge pogodbenice izda posebno dovolilnico v ta namen.
9. člen
Davčni in carinski sistem
1. Vozila, registrirana na ozemlju ene od pogodbenic in začasno uvožena na ozemlje druge pogodbenice, da bi opravljala prevoze v skladu s tem sporazumom, so po načelu vzajemnosti oproščena plačila davkov na vozila in prevozne storitve kot tudi plačila pristojbin.
2. Določba prvega odstavka tega člena ne velja za cestnine za uporabo avtocest, mostov in druge infrastrukture, ki se zaračunavajo po načelu enake obravnave.
3. Pri prevozih, opravljenih po tem sporazumu, je začasni uvoz vozil ene pogodbenice na ozemlje druge pogodbenice oproščen carinskih dajatev.
4. Oprostitev uvoznih carin in drugih dajatev pri prevozih, opravljenih po tem sporazumu, se vzajemno priznava za:
a) gorivo v standardnih rezervoarjih vozil;
b) maziva (v potrebni količini), namenjena vzdrževanju med vožnjo.
5. Vsaka pogodbenica dovoljuje začasni uvoz s popolno oprostitvijo uvoznih carin in drugih dajatev ter jamstev za rezervne dele, namenjene popravilu vozil, ki opravljajo mednarodne prevozne storitve po tem sporazumu, pod pogojem, da se neuporabljeni deli ali deli, ki so bili zamenjani, ponovno izvozijo ali uničijo v skladu z določbami, ki veljajo na ozemlju posamezne pogodbenice.
10. člen
Masa in dimenzije vozil
1. Vsaka pogodbenica se zavezuje, da za vozila, registrirana na ozemlju druge pogodbenice, ne bo zahtevala strožjih pogojev glede mase in dimenzij vozil, kot so tisti, ki veljajo za vozila, registrirana na njenem ozemlju.
2. Kadar masa in/ali dimenzije vozila presegajo največje omejitve, dovoljene na ozemlju druge pogodbenice, je treba pridobiti posebno dovoljenje, ki ga izda pristojni organ te pogodbenice.
3. Dovoljenje, navedeno v drugem odstavku tega člena, se odobri samo za prevoz blaga, pri katerem so presežene dovoljene mase in/ali dimenzije.
4. Kadar dovolilnica določa, da mora vozilo peljati po posebnem načrtu potovanja, ta dovolilnica velja le za ta načrt potovanja.
11. člen
Neprenosnost
Dovolilnice, ki se zahtevajo po določbah tega sporazuma, so osebne in neprenosljive. Uporablja jih lahko le prevoznik, v čigar imenu so bile izdane.
12. člen
Sankcije
1. Če prevoznik ali njegovo osebje, ko je na ozemlju druge pogodbenice, krši določbe tega sporazuma ali zakone in predpise, veljavne na tem ozemlju, pristojni organ države, v kateri ima prevoznik svoj sedež, na zahtevo pristojnega organa druge pogodbenice sprejme enega od naslednjih ukrepov:
a) izreče opomin ali
b) ukine, začasno ali stalno, delno ali v celoti, pravico do opravljanja prevozov po določbah tega sporazuma na ozemlju države, kjer je bila kršitev storjena.
2. O uveljavitvi ukrepa se čim prej obvesti pristojni organ, ki je zahteval sprejem takega ukrepa.
3. Določbe tega člena ne vplivajo na sankcije, ki jih predvidevajo zakoni in predpisi, veljavni v pogodbenici, na ozemlju katere je bila kršitev storjena.
13. člen
Obrazci dovolilnic, dovoljenj in kontrolnih dokumentov
Obrazci dovolilnic, dovoljenj in kontrolnih dokumentov, kot jih zahteva ta sporazum, se določijo s skupnim soglasjem pristojnih organov pogodbenic, ki sta navedena v 16. členu.
14. člen
Nadzor
Dovoljenja ali njihov overjeni izvod, če gre za linijski prevoz potnikov, kot tudi vse kontrolne dokumente, ki se zahtevajo po določbah tega sporazuma, je treba imeti v vozilu in jih pokazati na zahtevo predstavnikov nadzornih organov.
15. člen
Dopolnilne določbe
V vseh zadevah, ki niso urejene z določbami tega sporazuma ali drugih mednarodnih sporazumov, ki zavezujejo Republiko Slovenijo in Portugalsko republiko, se uporabljajo zakoni in predpisi obeh pogodbenic.
16. člen
Pristojni organi
Organa, pristojna za izvajanje tega sporazuma, ki sta navedena v protokolu, sta v neposrednem stiku.
17. člen
Izvajanje sporazuma
1. Pristojna organa pogodbenic opredelita pogoje za izvajanje tega sporazuma v protokolu, ki ga podpišeta.
2. Skupni odbor, omenjen v 18. členu tega sporazuma, je pristojen za spremembe protokola.
18. člen
Skupni odbor
1. Predstavniki pristojnih organov pogodbenic ustanovijo skupni odbor, da bi zagotovili pravilno izvajanje tega sporazuma in čim prej rešili vsa odprta vprašanja. Če je to potrebno, so lahko na sestanke skupnega odbora povabljeni tudi predstavniki drugih ustanov.
2. Na zahtevo pristojnega organa ene ali druge pogodbenice so sestanki skupnega odbora izmenično v eni ali drugi državi pogodbenici.
V. KONČNE DOLOČBE
19. člen
Začetek veljavnosti
1. Pogodbenici si izmenjata diplomatski noti, s katerima se uradno obvestita o tem, da so izpolnjene ustavne zahteve, ki se nanašajo na začetek veljavnosti tega sporazuma.
2. Ta sporazum začne veljati na dan zadnjega uradnega obvestila, da so bile izpolnjene vse ustavne zahteve pogodbenic.
20. člen
Trajanje
1. Ta sporazum je sklenjen za nedoločen čas.
2. Vsaka od pogodbenic lahko drugo pogodbenico po diplomatski poti vsaj tri mesece pred koncem vsakega koledarskega leta obvesti o tem, da namerava odpovedati ta sporazum. V tem primeru sporazum preneha veljati s prvim januarjem naslednjega leta.
V dokaz tega sta podpisana, ki sta ju za to pravilno pooblastili njuni vladi, podpisala ta sporazum.
Sestavljeno v Varšavi dne 19. maja 1999 v dveh izvirnikih v slovenskem, portugalskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Ob različni razlagi prevlada angleško besedilo sporazuma.

po 17. členu o izvajanju Sporazuma med Republiko Slovenijo in Portugalsko republiko o mednarodnem cestnem prevozu potnikov in blaga
Da bi zagotovili izvajanje tega sporazuma, sta se pogodbenici sporazumeli, kot sledi:
PREVOZ POTNIKOV
1 4. člen
1.1 Glede linijskega prevoza:
a) vloge za dovolilnice se pošljejo pristojnemu organu pogodbenice, v kateri ima prevoznik svoj sedež, in vključujejo te podatke:
– ime in naslov prevoznika;
– načrt potovanja, pogostost voženj in vozni red;
– karto v ustreznem merilu za načrt potovanja, iz katere morajo biti jasno razvidni kraji, kjer bodo potniki vstopali in/ali izstopali;
b) kadar bo nameraval odobriti vlogo za dovolilnico, bo pristojni organ, omenjen v a) zgoraj, poslal izvod te vloge pristojnemu organu druge pogodbenice, in kadarkoli bo to potrebno, pristojnim organom tranzitnih držav;
c) šteje se, da je linijski prevoz odobren takoj, ko si pogodbenici izmenjata dovoljenja in je pridobljeno tudi soglasje tranzitnih držav, kadarkoli je potrebno.
1.2 Glede občasnega prevoza se vloge za dovolilnice praviloma z obvestilom, poslanim tri tedne pred začetkom opravljanja storitve, predložijo pristojnemu organu pogodbenice, v kateri ima prevoznik svoj sedež. Vsaka vloga mora vključevati te podatke:
– ime in naslov organizatorja storitve;
– ime in naslov prevoznika;
– registrsko številko vozil, ki se bodo uporabljala;
– načrt potovanja z navedbo krajev, kjer potniki vstopajo in/ali izstopajo;
– datuma začetka in konca prevoza;
– datume in kraje prehodov meje druge pogodbenice pri vožnjah tja in nazaj.
Vsako dovolilnico izda pristojni organ pogodbenice, kjer ima prevoznik svoj sedež. Ta dovolilnica in kontrolni dokument morata biti v vozilu.
Pristojna organa pogodbenic si vsako leto izmenjata določeno število obrazcev dovolilnic za občasne prevoze, dogovorjeno s skupnim soglasjem. Obrazce podpiše in overi pristojni organ države, ki je izdal dovolilnico.
1.3 Za izmenični prevoz se uporabljajo določbe iz 1.2 tega protokola; vloge za dovolilnice se predložijo najkasneje šest tednov pred začetkom potovanja in morajo vključevati te podatke:
– trajanje prevoza;
– število in datume voženj v namembni kraj in voženj nazaj v odhodni kraj za vsak prevoz;
– naslov hotelov v namembnem kraju, v katerih bodo potniki nastanjeni;
– po možnosti odstotek potnikov, ki so bili prepeljani kot skupina v namembni kraj, nazaj pa se vračajo v odhodni kraj z drugo skupino.
PREVOZ BLAGA
2 6. člen
Glede dovolilnic:
a) oštevilčene obrazce podpiše in žigosa organ, pristojen za izdajo dovolilnic;
b) vsaka dovolilnica se en mesec po datumu uporabe ali koncu obdobja veljavnosti, če ni bila uporabljena, vrne organu, ki jo je izdal.
3 7. člen
Glede kvot:
a) pristojna organa pogodbenic si pred 30. novembrom vsakega koledarskega leta izmenjata obrazce dovolilnic v skupnem številu v skladu s kvoto, o kateri sta se po načelu vzajemnosti dogovorila za naslednje koledarsko leto;
b) za prvo leto izvajanja sporazuma se kvota 500 navadnih dovolilnic določi za prevoznike vsake pogodbenice, od katerih jih 30 odstotkov prevozniki s sedežem v eni pogodbenici lahko uporabijo za opravljanje prevozov med ozemljem druge pogodbenice in tretjo državo;
c) če je potrebno, se lahko kvota dovolilnic poveča s skupnim soglasjem pristojnih organov pogodbenic.
SPLOŠNE DOLOČBE
4 10. člen
Posebno dovolilnico, ki se zahteva po drugem odstavku tega člena, izdajo:
a) v Republiki Sloveniji:

5 14. člen
Pristojna organa pogodbenic zagotovita za vozila, ki prevažajo živino ali pokvarljiva živila, poenostavljene kontrolne postopke.
6 16. člen
Organa, pristojna za izvajanje tega sporazuma, sta:
a) v Republiki Sloveniji:
Ministrstvo za promet in zveze;
b) v Portugalski republiki:
Generalna uprava za kopenski promet
Ministrstvo za opremo, načrtovanje in prostorsko urejanje.
Sestavljeno v Varšavi dne 19. maja 1999 v dveh izvirnikih v slovenskem, portugalskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Ob različni razlagi prevlada angleško besedilo protokola.

BETWEEN THE REPUBLIC OF SLOVENIA AND THE PORTUGUESE REPUBLIC CONCERNING THE INTERNATIONAL TRANSPORT OF PASSENGERS AND GOODS BY ROAD
The Republic of Slovenia and the Portuguese Republic of, hereinafter referred to as the “Contracting Parties“;
wishing to contribute to the development of the transport of passengers and goods by road between the two countries, as well as in transit through their territories;
taking into account the need to establish at an European level a policy directed towards the progressive liberalization of transport services, in connection with harmonization of competition conditions, environmental protection and safety in road traffic;
Have agreed as follows:
I INTRODUCTORY PROVISIONS
Article 1
Scope
Without prejudice to the provisions of paragraph 2 of Article 7, this Agreement entitles carriers established in either Contracting Party to transport passengers or goods by road between the territories of the Contracting Parties or in transit through them.
Article 2
Definitions
For the purpose of this Agreement:
a) a “carrier“ is any physical or juridical person duly authorized either in the Republic of Slovenia or in the Portuguese Republic of:
1) to engage in the international transport of passengers or goods by road for hire or reward;
2) to perform transport on his own account;
b) a “vehicle“ is:
1) in the case of transport of passengers, any motor vehicle intended for carriage of passengers with more than 9 seats – including the driver’s seat – as well as trailers for transport of passenger luggage, provided that the trailer is registered in the same Contracting Party as the motor vehicle;
2) in the case of transport of goods, any lorry, tractor, trailer or semi-trailer, as well as any articulated vehicle or a combination of lorry and trailer, provided that at least the motor vehicle is registered in the territory of either Contracting Party;
c) “transit“ is the transport performed by a carrier established in one of the Contracting Parties through the territory of the other Contracting Party without taking or leaving there any passengers or goods.
II TRANSPORT OF PASSENGERS
Article 3
Types of Services
1. The transport services of passengers to be performed under the provisions of this Agreement may be:
a) regular services;
b) shuttle services;
c) occasional services.
2. “Regular services“ are services which provide for the carriage of passengers on specified routes, according to previously determined itinerary, schedule, fares and stopping points for collecting and setting down passengers.
3. “Shuttle services“ are services whereby, by means of several outward and return journeys, groups of passengers assembled in advance are carried from the same area of departure to the same area of destination.
“Area of departure“ and “area of destination“ mean respectively the place where the journey begins and the place where the journey ends, as well as, in each case, all localities within a radius of 50 kms.
Besides transport, shuttle services should include the accommodation of passengers in the area of destination for a period of at least two nights.
Without prejudice to the provisions of paragraph 3 b) of Article 4 of this Agreement, in shuttle services:
– each group of passengers having made the outward journey together is carried back to the starting point together in a later journey;
– passengers shall not be collected or set down outside the areas of departure and destination;
– the first return journey and the last outward journey are empty runs.
4. “Occasional services“ are services which do not fall within the definition of regular services nor within the definition of shuttle services.
Article 4
Regime of Authorization
1. Apart from the exceptions referred to in paragraph 1 of Article 5, any passenger transport services performed under this Agreement are subject to an authorization granted by the competent authority of the other Contracting Party on the basis of reciprocity.
2. In what regards regular services:
a) the establishment of a regular service, as well as the modification of the operating conditions thereof, will be authorized by common agreement between the competent authorities of the Contracting Parties, provided that an approval is obtained from the competent authorities of the transit countries, whenever necessary;
b) an authorization granted by the competent authority of a Contracting Party will be valid only in that part of the route which is situated in the territory of the same Contracting Party.
c) in principle, the authorization for each regular service will be granted on a basis of reciprocity;
d) the term of validity of an authorization cannot exceed five years.
3. In what concerns shuttle services:
a) the term of validity of an authorization cannot exceed six months;
b) authorization may be granted to allow for in a given percentage, passengers having been carried in the outward journey within a certain group to be carried in the return journey within another group.
Article 5
Transport Services Exempted from Authorization
1. The following occasional services do not require authorization:
a) “closed door tours“, i.e., services whereby the same vehicle carries the same group of passengers throughout the journey and brings them back to the place of departure, provided that the place of departure and destination is situated in the territory of the Contracting Party where the vehicle is registered;
b) services involving a laden journey from a place of departure situated in the territory of the Contracting Party where the vehicle is registered to a place of destination situated in the territory of the other Contracting Party, followed by an empty journey back to the place of departure;
c) services including an unladen journey entering the territory of the other Contracting Party, followed by a laden journey, provided that all passengers are picked up in the same place and:
– that they are grouped by a transport contract concluded before they enter the territory of the other Contracting Party; or
– that they have been previously carried by the same undertaking to the territory of the other Contracting Party; or
– that have been invited to come to the territory of the Contracting Party where the carrier is established, the costs of transport being at the charge of the person responsible for the invitation.
d) unladen runs of a passenger vehicle sent to replace a vehicle which has broken down in another country, in order to continue the carriage of passengers under cover of the waybill of the broken down vehicle.
2. Services exempted from authorization under the provisions of paragraph 1 of this Article shall be carried out under cover of a control document to be established in the Protocol referred to in Article 17 of this Agreement.
III TRANSPORT OF GOODS
Article 6
Regime of Authorization
1. Apart from the exceptions referred to in paragraph 3 of this Article, the transport of goods for hire or reward or on own account performed under the provisions of this Agreement by a carrier established in the country of one of the Contracting Parties, by means of a motor vehicle registered in the same country, is subject to a permit granted by the competent authority of the other Contracting Party.
2. The competent authorities of both Contracting Parties may agree on the following two types of permits:
a) journey permits, valid for one journey; or
b) yearly permits, valid for respective calendar year.
The term of validity of which is from the 1st of January up to the 31st of January of the coming year.
3. The following transports are exempted from permit:
a) transport of goods by motor vehicles whose Total Permissible Laden Weight (TPLW), including trailers, does not exceed 6 tons, or whose permitted payload, including trailers, does not exceed 3.5 tons;
b) transport of goods to or from airports, in cases where air services are diverted;
c) transport of vehicles which are damaged or have broken down and the transport of breakdown repair vehicles;
d) unladen runs by a goods vehicle sent to replace a vehicle which has broken down in another country and also the return run, after repair, of the vehicle that had broken down;
e) transport of spare parts and provisions for ocean-going ships and aircraft;
f) transport of medical supplies and equipment needed for emergencies, particularly in response to natural disasters;
g) transport of works and objects for fairs and exhibitions;
h) transport for non commercial purposes of material, accessories and animals to or from theatrical, musical, film, sportive, circus performances or fairs, as well as transport of material intended for radio recordings or for film or television production;
i) transport of mail as public service;
j) funeral transport.
4. The Joint Committee refered to in Article 18 hereof may add to, or remove from, the list of transport categories exempted form the permit requirements.
Article 7
Quotas
1. Permits shall be issued by the competent authority of the Contracting Party where the vehicle is registered, within the limits of the quota fixed annually by common agreement between the competent authorities of the Contracting Parties.
2. A part of the quota referred to in paragraph 1 of this Article, to be fixed by common agreement between the competent authorities of the Contracting Parties, may be used by carriers established in the territory of one of the Contracting Parties to perform transports between the territory of the other Contracting Party and a third country.
IV GENERAL PROVISIONS
Article 8
Cabotage
This Agreement does not entitle a carrier established in one of the Contracting Parties to collect passengers or to load goods in the territory of the other Contracting Party for transport within the same territory, except in cases where a special authorization is granted by the competent authority of the latter Contracting Party.
Article 9
Fiscal and Customs Regime
1. Vehicles which are registered in the territory of one Contracting Party and are temporarily imported into the territory of the other Contracting Party to perform transport services in accordance with this Agreement shall be exempt, according to the reciprocity principle, from taxes on vehicles and transport services as well as from user charges.
2. The provision of paragraph 1 of this article does not apply to tolls related to the use of motorways, bridges and other infrastructures, which shall be levied on the basis of the principle of non discrimination.
3. In transports carried out under this Agreement the temporary admission of vehicles of one Contracting Party into the territory of the other Contracting Party is exempted from customs duties.
4. For transports carried out under this Agreement the exemption from import duties as well as other charges will be mutually granted to:
a) fuel contained in the normal tanks of the vehicles;
b) lubricants (in the necessary quantity) to ensure their maintenance during the journey.
5. Each Contracting Party shall allow the temporary admission, with total relief of import duties and other charges and the waiving of garanty submission, of spare parts meant for repairing the vehicle performing international transport operations under the present Agreement, provided that the non used parts or those having been replaced shall be re-exported or destroyed, in accordance with the provisions in force in the territory of the respective Contracting Party.
Article 10
Weight and Dimensions of Vehicles
1. In what concerns weights and dimensions of vehicles, each Contracting Party undertakes not to submit vehicles registered in the territory of the other Contracting Party to more severe conditions than those that are imposed on vehicles registered in its own country.
2. When the weight and/or the dimensions of a vehicle exceed the maximum limits admissible in the territory of the other Contracting Party, a special authorization is required from the respective authority of the same Contracting Party.
3. The authorization referred to in paragraph 2 of this Article will be granted only for the carriage of goods of abnormal weight and/or dimensions.
4. Whenever the authorization stipulates that the vehicle must use a specific itinerary, it shall be valid only for that itinerary.
Article 11
Nontransferability
Authorizations, as required under the provisions of this Agreement, are personal and nontransferable. They may be used only by the carrier in whose name they have been issued.
Article 12
Sanctions
1. If a carrier or his driving personnel, when in the territory of the other Contracting Party, infringe the provisions of this Agreement or the laws and regulations applicable in that territory, the competent authority of the country where the carrier is established shall, at request of the competent authority of the other Contracting Party, adopt one of the following measures:
a) issue a warning; or
b) withdraw, on a temporary or permanent basis, partially or totally, the right to perform transports under the provisions of this Agreement in the territory of the country where the infringement has been committed.
2. The competent authority having requested the adoption of a sanction shall be informed as soon as possible about its effective adoption.
3. The provisions of this article shall apply without prejudice to any sanction provided for by the laws and regulations in force in the Contracting Party in whose territory the infringement was committed.
Article 13
Authorization and Control Document Forms
The forms for authorizations, permits and control documents as required by this Agreement shall be established by common agreement between the competent authorities of the Contracting Parties referred to in Article 16.
Article 14
Control
The authorizations – or a certified copy thereof in the case of regular passenger services – as well as any control document required under the provisions of this Agreement shall be carried inside the vehicle and be presented at request of representatives of the control authorities.
Article 15
Supplementary Provisions
The laws and regulations of both Contracting Parties shall apply in all matters that are not regulated by the provisions of this Agreement or of other international agreements which are binding for the Republic of Slovenia and the Portuguese Republic.
Article 16
Competent Authorities
The competent authorities for implementing this Agreement, referred to in the Protocol, shall contact each other directly.
Article 17
Implementation of the Agreement
1. The competent authorities of the Contracting Parties define the conditions for implementing this Agreement in a Protocol to be signed by them.
2. The Joint Committee mentioned in Article 18 of this Agreement is competent to modify the Protocol.
Article 18
Joint Committee
1. Representatives of the competent authorities of the Contracting Parties shall form a Joint Committee in order to ensure the correct implementation of this Agreement and to settle as soon as possible all unresolved issues. In case of necessity, representatives of other institutions may be invited to participate at the Joint Committee meetings.
2. At request of the competent authority of either Contracting Party, the Joint Committe shall hold its meetings alternately in the territories of both Contracting Parties.
V FINAL PROVISIONS
Article 19
Entry into Force
1. The Contracting Parties shall exchange diplomatic notes by which it is notified that the Constitutional requirements pertaining to the entry into force of this Agreement have been fulfilled.
2. This Agreement shall enter into force on the date of the last notification, if all constitutional formalities required by the Contracting Parties have been complied with.
Article 20
Duration
1. This Agreement is concluded for an indefinite period of time.
2. Either Contracting Party may inform the other Contracting Party by means of diplomatic notes, at least three months before the end of each calendar year, of its intention to terminate this Agreement. In this case, the Agreement will cease to be in force from the first of January of the following year.
In witness whereof the undersigned, being duly authorised thereto by their respective Governments, have signed this Agreement.
Done in Warsaw, on 19 May 1999, in two original copies, each in Slovene, Portuguese and English languages, all texts being equally authentic. In case of divergence of interpretation, the English text of the Agreement shall prevail.

under Article 17 on the implementation of the Agreement between the Republic of Slovenia and the Portuguese Republic concerning the international transport of passengers and goods by road
In order to ensure the implementation of this Agreement, the Contracting Parties have agreed as follows:
TRANSPORT OF PASSENGERS
1. Article 4
1.1. In what concerns regular services:
a) requests for authorizations should be submitted to the competent authority of the Contracting Party where the carrier is established, including the following data:
– name and address of the carrier;
– itinerary, frequency and timetable of the service;
– a map, drawn on an appropriate scale, of the itinerary where the places where passengers are going to be taken and/or set down should be duly identified;
b) when intending to approve a request, the competent authority mentioned in a) above will send a copy thereof to the competent authority of the other Contracting Party, and to the competent authorities of the transit countries, whenever necessary;
c) a regular service is deemed to be approved as soon as both Contracting Parties have exchanged authorizations thereupon and the approval from the transit countries has been obtained, whenever necessary.
1.2. In what concerns occasional services, requests for authorizations should be submitted to the competent authority of the Contracting Party where the carrier is established at three weeks notice, as a rule, of the date of beginning of the service. Each request should include the following data:
– name and address of the organizer of the service;
– name and address of the carrier;
– registration numbers of the vehicles to be used;
– itinerary, mentioning the places where passengers are to be taken and/or set down;
– dates for the beginning and the ending of the service;
– dates and places where the border of the other Contracting Party is to be crossed, both in outward and return journeys.
Each authorization shall be issued by the competent authority where the carrier is established. This authorization and the control document should be carried on board of the vehicle.
The competent authorities of the Contracting Parties shall exchange annually a certain number, to be fixed by common agreement, of authorization forms for occasional services. The forms will be signed and certified by the competent authority of the country having granted the authorization.
1.3. As for shuttle services, the same provisions of 1.2. of this Protocol shall apply; requests for authorizations shall be submitted not later than six weeks prior to the commencement of the journey and should include the following data:
– duration of the service;
– number and dates of outward and return journeys for each service;
– address of hotels where passengers will stay in the area of destination;
– eventually, the percentage number of passengers which, having been carried together in a group in the outward journey, will be carried back in the return journey within another group.
TRANSPORT OF GOODS
2. Article 6
In what concerns permits:
a) forms will be numbered and signed by the authority competent to grant the permit, and bear the stamp thereof;
b) each permit shall be returned to the issuing authority in a month’s period after the date of its use or after the end of its period of validity when it has not been used.
3. Article 7
In what concerns quotas:
a) before November 30 of each calendar year the competent authorities of the Contracting Parties will exchange permit forms in a total number according to the quota that has been established, on the basis of reciprocity, for the following calendar year;
b) for the first year of the period of implementation of the Agreement a quota of 500 journey permits is established for the hauliers of each Contracting Party, 30 per cent of which may be used by hauliers established in one of the Contracting Parties to perform transports between the territory of the other Contracting Party and a third country;
c) in case of necessity, the annual quota may be increased by common agreement between the competent authorities of the Contracting Parties.
GENERAL PROVISIONS
4. Article 10
The special authorization required under paragraph 2 of this article shall be issued by:

5. Article 14
The competent authorities of the Contracting Parties shall ensure simplified control procedures for vehicles transporting livestock or perishable foodstuffs.
6. Article 16
The competent authorities for implementing this Agreement are:
