U R E D B A
O RATIFIKACIJI PROTOKOLOV O SPREMEMBAH KONVENCIJE O MEDNARODNEM CIVILNEM LETALSTVU
1. člen
Ratificirajo se Protokol o spremembi Konvencije o mednarodnem civilnem letalstvu, sestavljen v Montrealu 27. maja 1947, Protokol o spremembi Konvencije o mednarodnem civilnem letalstvu, sestavljen v Montrealu 14. junija 1954, Protokol o nekaterih spremembah Konvencije o mednarodnem civilnem letalstvu, sestavljen v Montrealu 14. junija 1954, Protokol o spremembi Konvencije o mednarodnem civilnem letalstvu, sestavljen v Montrealu 21. junija 1961, Protokol o spremembi Konvencije o mednarodnem civilnem letalstvu, sestavljen v Rimu 15. septembra 1962, Protokol o spremembi Konvencije o mednarodnem civilnem letalstvu, sestavljen v New Yorku 12. marca 1971, Protokol o spremembi Konvencije o mednarodnem civilnem letalstvu, sestavljen na Dunaju 7. julija 1971, Protokol o spremembi Konvencije o mednarodnem civilnem letalstvu, sestavljen v Montrealu 16. oktobra 1974, Protokol o spremembi Konvencije o mednarodnem civilnem letalstvu, sestavljen v Montrealu 30. septembra 1977, Protokol o spremembi Konvencije o mednarodnem civilnem letalstvu, sestavljen v Montrealu 6. oktobra 1980, Protokol o spremembi Konvencije o mednarodnem civilnem letalstvu, sestavljen v Montrealu 10. maja 1984, Protokol o spremembi Konvencije o mednarodnem civilnem letalstvu, sestavljen v Montrealu 6. oktobra 1989 in Protokol o spremembi Konvencije o mednarodnem civilnem letalstvu, sestavljen v Montrealu 26. oktobra 1990.
2. člen
Protokoli se v originalu v angleškem jeziku in v prevodu v slovenskem jeziku glasijo:

o spremembi Konvencije o mednarodnem civilnem letalstvu
SKUPŠČINA MEDNARODNE ORGANIZACIJE CIVILNEGA LETALSTVA,
KI JO JE SKLICAL začasni svet začasne Mednarodne organizacije civilnega letalstva v Montrealu in se je sestala na svojem prvem zasedanju 6. maja 1947, ter
JE MENILA, da je priporočljivo, da se dopolni Konvencija o mednarodnem civilnem letalstvu, sestavljena v Čikagu 7. decembra 1944,
JE SPREJELA trinajstega maja tisoč devetsto sedeminštiridesetega leta skladno z določbami točke a) 94. člena Konvencije o mednarodnem civilnem letalstvu, sestavljene v Čikagu 7. decembra 1944, predlagano spremembo k omenjeni konvenciji kot »93. bis člen«:
»93. bis člen
(A) Ne glede na zgornje določbe 91., 92. in 93. člena
(1) država, katere vlada je bila na priporočilo Generalne skupščine Združenih narodov izključena iz članstva v mednarodnih organizacijah, ki jih je ustanovila Organizacija združenih narodov ali so z njo povezane, samodejno preneha biti članica Mednarodne organizacije civilnega letalstva;
(2) država, ki je bila izključena iz Organizacije združenih narodov, samodejno preneha biti članica Mednarodne organizacije civilnega letalstva, razen če Generalna skupščina Združenih narodov svojemu uradnemu dokumentu o izključitvi priloži priporočilo o nasprotnem.
(B) Država, ki preneha biti članica Mednarodne organizacije civilnega letalstva v skladu z določbami zgornjega odstavka (A), je lahko po soglasju z Generalno skupščino Združenih narodov na prošnjo in v soglasju z večino v svetu ponovno sprejeta v Mednarodno organizacijo civilnega letalstva.
(C) Članicam organizacije, ki so jim začasno prenehale pravice in ugodnosti, ki izhajajo iz članstva v Združenih narodih, so na zahtevo te začasno prenehale tudi pravice in ugodnosti iz članstva v tej organizaciji.«
JE DOLOČILA šestnajstega maja tisoč devetsto sedeminštiridesetega leta skladno z določbami omenjene točke a) 94. člena konvencije, da zgoraj navedena sprememba začne veljati, ko jo ratificira osemindvajset držav pogodbenic konvencije, in
NAROČILA tega dne generalnemu sekretarju Mednarodne organizacije civilnega letalstva, da sestavi protokol o predlagani spremembi in ga s tem namenom podpišeta predsednik in generalni sekretar prve skupščine.
ZATO se skladno z navedenimi odločitvami skupščine ta protokol predloži v ratifikacijo vsem državam, ki so ratificirale to konvencijo ali so k njej pristopile. Listine o ratifikaciji se pošljejo generalnemu sekretarju Mednarodne organizacije civilnega letalstva, ki jih shrani v arhivih organizacije; generalni sekretar organizacije takoj obvesti vse države pogodbenice konvencije o datumu predložitve vsake listine o ratifikaciji;
zgoraj predlagana sprememba konvencije začne za države, ki so že ratificirale ta protokol, veljati na dan deponiranja osemindvajsete listine o ratifikaciji. Generalni sekretar organizacije takoj obvesti vse države pogodbenice ali podpisnice konvencije o dnevu, na katerega predlagana sprememba začne veljati;
zgoraj predlagana sprememba začne za vsako drugo državo, ki protokol ratificira pozneje, veljati na dan deponiranja listine o ratifikaciji v arhivih organizacije.
V POTRDITEV TEGA predsednik in generalni sekretar prve skupščine Mednarodne organizacije civilnega letalstva, ki ju je za to pooblastila skupščina, podpišeta ta protokol.
SESTAVLJENO v Montrealu sedemindvajsetega maja tisoč devetsto sedeminštiridesetega v enem izvodu v angleškem, francoskem in španskem jeziku, pri čemer so vsa besedila enako verodostojna. Ta protokol ostane shranjen v arhivih Mednarodne organizacije civilnega letalstva; overjene kopije tega protokola generalni sekretar organizacije pošlje vsem državam pogodbenicam ali podpisnicam Konvencije o mednarodnem civilnem letalstvu, sestavljene v Čikagu 7. decembra 1944.

o spremembi Konvencije o mednarodnem civilnem letalstvu
SKUPŠČINA MEDNARODNE ORGANIZACIJE CIVILNEGA LETALSTVA,
KI SE JE SESTALA v Montrealu prvega junija 1954 na svojem osmem zasedanju in
JE MENILA, da je zaželeno, da se dopolni Konvencija o mednarodnem civilnem letalstvu, sestavljena v Čikagu sedmega decembra 1944,
JE SPREJELA štirinajstega junija tisoč devetsto štiriinpetdesetega leta skladno z določbami točke a) 94. člena omenjene konvencije predlagano spremembo konvencije.
Na koncu 45. člena konvencije se pika nadomesti z vejico in doda naslednje:
»in za stalno z odločitvijo skupščine; taka odločitev se sprejme s številom glasov, ki ga določi skupščina. Število tako določenih glasov naj ne bo manjše od treh petin vseh držav pogodbenic.«
JE DOLOČILA skladno z določbami omenjene točke a) 94. člena konvencije, da navedena sprememba začne veljati, ko jo ratificira dvainštirideset držav pogodbenic, in
JE SKLENILA, da generalni sekretar Mednarodne organizacije civilnega letalstva sestavi protokol v angleškem, francoskem in španskem jeziku, pri čemer so vsa besedila enako verodostojna in vsebujejo predlagano spremembo in določila, omenjena v nadaljevanju.
ZATO skladno s prej omenjeno odločitvijo skupščine:
ta protokol podpišeta predsednik in generalni sekretar skupščine;
je ta protokol na voljo za ratifikacijo vsem državam, ki so ratificirale Konvencijo o mednarodnem civilnem letalstvu ali so k njej pristopile;
se listine o ratifikaciji shranijo pri Mednarodni organizaciji civilnega letalstva;
začne ta protokol veljati na dan deponiranja dvainštiridesete listine o ratifikaciji za vse države, ki ga ratificirajo do tega dne;
generalni sekretar takoj obvesti vse države pogodbenice o deponiranju vsake listine o ratifikaciji tega protokola;
generalni sekretar takoj obvesti vse države pogodbenice ali podpisnice omenjene konvencije o datumu začetka veljavnosti tega protokola;
začne ta protokol za vse države pogodbenice, ki ga ratificirajo pozneje, veljati na dan deponiranja listin o ratifikaciji pri Mednarodni organizaciji civilnega letalstva.
V POTRDITEV TEGA predsednik in generalni sekretar osmega zasedanja skupščina Mednarodne organizacije civilnega letalstva, ki ju je za to pooblastila skupščina, podpišeta ta protokol.

o nekaterih spremembah Konvencije o mednarodnem civilnem letalstvu
SKUPŠČINA MEDNARODNE ORGANIZACIJE CIVILNEGA LETALSTVA,
KI SE JE SESTALA v Montrealu prvega junija 1954 na svojem osmem zasedanju in
JE MENILA, da je zaželeno, da se dopolni Konvencija o mednarodnem civilnem letalstvu, sestavljena v Čikagu sedmega decembra 1944,
JE SPREJELA štirinajstega junija tisoč devetsto štiriinpetdesetega leta skladno z določbami točke a) 94. člena omenjene konvencije predlagane spremembe konvencije:
v točki a) 48. člena se beseda »letno« zamenja z besedami »najmanj enkrat na tri leta«;
v točki e) 49. člena se besedi »letni proračun« zamenjata z besedama »letni proračuni« in
v 61. členu se besede »letni proračun« in »izglasuje proračun« zamenjajo z besedami »letni proračuni« in »izglasujejo proračuni«;
JE DOLOČILA skladno z določbami točke a) 94. člena omenjene konvencije, da navedene spremembe začnejo veljati, ko jih ratificira dvainštirideset držav pogodbenic;
JE SKLENILA, da generalni sekretar Mednarodne organizacije civilnega letalstva sestavi protokol v angleškem, francoskem in španskem jeziku, pri čemer so vsa besedila enako verodostojna in vsebujejo predlagane spremembe in določila, omenjena v nadaljevanju.
ZATO skladno s prej omenjeno odločitvijo skupščine:
ta protokol podpišeta predsednik in generalni sekretar skupščine;
je ta protokol na voljo za ratifikacijo vsem državam, ki so ratificirale Konvencijo o mednarodnem civilnem letalstvu ali so k njej pristopile;
se listine o ratifikaciji shranijo pri Mednarodni organizaciji civilnega letalstva;
začne ta protokol veljati na dan deponiranja dvainštiridesete listine o ratifikaciji za vse države, ki ga ratificirajo tega dne;
generalni sekretar takoj obvesti vse države pogodbenice ali podpisnice omenjene konvencije o datumu začetka veljavnosti tega protokola;
začne ta protokol za vse države pogodbenice, ki ga ratificirajo pozneje, veljati na dan deponiranja listin o ratifikaciji pri Mednarodni organizaciji civilnega letalstva.

SKUPŠČINA MEDNARODNE ORGANIZACIJE CIVILNEGA LETALSTVA,
KI SE JE SESTALA v Montrealu devetnajstega junija 1961 na svojem trinajstem (izrednem) zasedanju,
SE JE SEZNANILA s splošno željo držav pogodbenic po povečanju števila članic sveta,
JE MENILA, da je upravičeno, da zato svet dobi šest sedežev več in se tako članstvo poveča z enaindvajset na sedemindvajset,
JE MENILA, da je nujno, da v ta namen dopolni Konvencijo o mednarodnem civilnem letalstvu, sestavljeno v Čikagu sedmega decembra 1944,
JE SPREJELA enaindvajsetega junija tisoč devetsto enainšestdesetega leta skladno z določbami točke a) 94. člena omenjene konvencije predlagano spremembo konvencije:
V točki a) 50. člena konvencije se beseda »enaindvajset« zamenja z besedo »sedemindvajset«;
JE DOLOČILA skladno z določbami omenjene točke a) 94. člena konvencije, da navedena sprememba začne veljati, ko jo ratificira šestinpetdeset držav pogodbenic, in
JE SKLENILA, da generalni sekretar Mednarodne organizacije civilnega letalstva sestavi protokol v angleškem, francoskem in španskem jeziku, pri čemer so vsa besedila enako verodostojna in vsebujejo predlagano spremembo in določila, omenjena v nadaljevanju.
ZATO skladno s prej omenjeno odločitvijo skupščine:
ta protokol sestavi generalni sekretar Organizacije;
je ta protokol na voljo za ratifikacijo vsem državam, ki so ratificirale Konvencijo o mednarodnem civilnem letalstvu ali so k njej pristopile;
se listine o ratifikaciji shranijo pri Mednarodni organizaciji civilnega letalstva;
začne ta protokol veljati na dan deponiranja šestinpetdesete listine o ratifikaciji za vse države, ki ga ratificirajo do tega dne;
generalni sekretar takoj obvesti vse države pogodbenice o datumu deponiranja vsake listine o ratifikaciji tega protokola;
generalni sekretar takoj obvesti vse države pogodbenice ali podpisnice o datumu začetka veljavnosti tega protokola;
začne ta protokol za vse države pogodbenice, ki ga ratificirajo pozneje, veljati na dan deponiranja listin o ratifikaciji pri Mednarodni organizaciji civilnega letalstva.
V POTRDITEV TEGA predsednik in generalni sekretar trinajstega (izrednega) zasedanja skupščine Mednarodne organizacije civilnega letalstva, ki ju je za to pooblastila skupščina, podpišeta ta protokol.

o spremembi Konvencije o mednarodnem civilnem letalstvu
SKUPŠČINA MEDNARODNE ORGANIZACIJE CIVILNEGA LETALSTVA,
KI SE JE SESTALA v Rimu enaindvajsetega avgusta 1962 leta na svojem štirinajstem zasedanju,
SE JE SEZNANILA s splošno željo držav pogodbenic, da se najmanjše število držav pogodbenic, ki lahko zahtevajo sklic izrednega sestanka skupščine, poveča s sedanjega števila deset,
JE MENILA, da je primerno, da poveča omenjeno število na eno petino števila vseh držav pogodbenic,
IN JE MENILA, da je zaradi zgoraj navedenega razloga potrebno dopolniti Konvencijo o mednarodnem civilnem letalstvu, sklenjeno v Čikagu sedmega decembra 1944,
JE SPREJELA štirinajstega septembra tisoč devetsto dvainšestdesetega leta skladno z določbami točke a) 94. člena omenjene konvencije naslednjo predlagano spremembo konvencije.
V točki a) 48. člena konvencije se drugi stavek črta in nadomesti z: »Izredni sestanek Skupščine lahko Svet skliče kadar koli ali se skliče na zahtevo najmanj ene petine vseh držav pogodbenic, naslovljeno na generalnega sekretarja.«
JE DOLOČILA skladno z določbami točke a) 94. člena konvencije, da navedena sprememba začne veljati, ko jo ratificira šestinšestdeset držav pogodbenic, in
JE SKLENILA, da generalni sekretar Mednarodne organizacije civilnega letalstva sestavi protokol v angleškem, francoskem in španskem jeziku, pri čemer so vsa besedila enako verodostojno in vsebujejo spremembo in določbo, omenjeno v nadaljevanju.
ZATO skladno s prej omenjeno odločitvijo skupščine:
ta protokol sestavi generalni sekretar organizacije;
je ta protokol na voljo za ratifikacijo vsem državam, ki so ratificirale Konvencijo o mednarodnem civilnem letalstvu ali so k njej pristopile;
se listine o ratifikaciji shranijo pri Mednarodni organizaciji civilnega letalstva;
začne ta protokol veljati na dan deponiranja šestinšestdesete listine o ratifikaciji za vse države, ki ga ratificirajo do tega dne;
generalni sekretar takoj obvesti vse države pogodbenice o datumu deponiranja vsake listine o ratifikaciji protokola;
generalni sekretar takoj obvesti vse države pogodbenice konvencije ali podpisnice omenjene konvencije o datumu začetka veljavnosti tega protokola;
začne ta protokol veljati za vse države pogodbenice na dan deponiranja ratifikacijskih listin pri Mednarodni organizaciji civilnega letalstva.
V POTRDITEV TEGA predsednik in generalni sekretar štirinajstega zasedanja skupščine Mednarodne organizacije civilnega letalstva, ki ju je za to skupščina pooblastila , podpišeta ta protokol.
SKLENJENO v Rimu petnajstega septembra tisoč devetsto dvainšestdesetega leta v enem izvodu v angleškem jeziku, francoskem in španskem jeziku, pri čemer so vsa besedila enako verodostojna. Ta protokol ostane shranjen v arhivih Mednarodne organizacije civilnega letalstva; generalni sekretar organizacije pošlje overjene kopije protokola vsem državam pogodbenicam Konvencije o mednarodnem civilnem letalstvu, sklenjene v Čikagu sedmega decembra 1944.

SKUPŠČINA MEDNARODNE ORGANIZACIJE CIVILNEGA LETALSTVA,
KI SE JE SESTALA v New Yorku enajstega marca 1971 na izrednem zasedanju,
SE JE SEZNANILA s splošno željo držav pogodbenic po povečanju števila članic sveta,
JE MENILA, da je primerno, da zagotovi svetu tri dodatne sedeže poleg šestih, ki so mu bili dodeljeni s spremembo Konvencije o mednarodnem civilnem letalstvu (Čikago, 1944), sprejeti enaindvajsetega junija 1961, in s tem poveča število članov sveta na trideset
IN JE MENILA, da je zaradi zgoraj navedenega razloga treba dopolniti Konvencijo o mednarodnem civilnem letalstvu, sestavljeno v Čikagu sedmega decembra 1944,
JE SPREJELA dvanajstega marca 1971 skladno z določbami točke a) 94. člena omenjene konvencije predlagano spremembo konvencije:
V točki a) 50. člena te konvencije se drugi stavek nadomesti z:
»Sestavljen je iz tridesetih držav pogodbenic, ki jih je izvolila skupščina.«
JE DOLOČILA skladno z določbami točke a) 94. člena konvencije, da predlagana sprememba začne veljati, ko jo ratificira osemdeset držav pogodbenic, in
JE SKLENILA, da generalni sekretar Mednarodne organizacije civilnega letalstva sestavi protokol v angleškem, francoskem in španskem jeziku, pri čemer so vsa besedila enako verodostojna in vsebujejo predlagano spremembo in določila, omenjena v nadaljevanju:
ZATO skladno s prej omenjeno odločitvijo skupščine:
ta protokol sestavi generalni sekretar Organizacije;
je ta protokol na voljo za ratifikacijo vsem državam, ki so ratificirale Konvencijo o mednarodnem civilnem letalstvu ali so k njej pristopile;
se listine o ratifikaciji shranijo pri Mednarodni organizaciji civilnega letalstva;
začne ta protokol veljati na dan deponiranja osemdesete listine o ratifikaciji za vse države, ki ga ratificirajo do tega dne;
generalni sekretar takoj obvesti vse države pogodbenice o datumu deponiranja vsake listine o ratifikaciji protokola;
generalni sekretar takoj obvesti vse države pogodbenice omenjene konvencije o datumu začetka veljavnosti tega protokola;
začne ta protokol za vse države pogodbenice, ki ga ratificirajo pozneje, veljati na dan deponiranja listin o ratifikaciji pri Mednarodni organizaciji civilnega letalstva.

Ta protokol ostane shranjen v arhivih Mednarodne organizacije civilnega letalstva; generalni sekretar organizacije pošlje overjene kopije protokola vsem državam pogodbenicam Konvencije o mednarodnem civilnem letalstvu, sestavljene v Čikagu sedmega decembra 1944.

o spremembi Konvencije o mednarodnem civilnem letalstvu
SKUPŠČINA MEDNARODNE ORGANIZACIJE CIVILNEGA LETALSTVA,
KI SE JE SESTALA na Dunaju petega julija 1971 na svojem osemnajstem zasedanju,
SE JE SEZNANILA s splošno željo držav pogodbenic po povečanju števila članic Komisije za zračno plovbo,
JE MENILA, da je primerno, da poveča število članic tega telesa z dvanajst na petnajst, in
JE MENILA, da je zaradi zgoraj navedenega razloga treba dopolniti Konvencijo o mednarodnem civilnem letalstvu, sestavljeno v Čikagu sedmega decembra 1944,
1) JE SPREJELA skladno z določbami točke a) 94. člena konvencije predlagano spremembo konvencije:
»V 56. členu konvencije se besedi »dvanajst članic« zamenjata z besedama »petnajst članic«,
2) JE DOLOČILA skladno z določbami navedene točke a) 94. člena konvencije, da predlagana sprememba začne veljati, ko jo ratificira osemdeset držav pogodbenic,
3) JE SKLENILA, da generalni sekretar Mednarodne organizacije civilnega letalstva sestavi protokol v angleškem, francoskem in španskem jeziku, pri čemer so vsa besedila enako verodostojna in vsebujejo predlagano spremembo in določila, omenjena v nadaljevanju,
a) protokol podpišeta predsednik in generalni sekretar skupščine.
b) protokol je na voljo za ratifikacijo vsem državam, ki so ratificirale Konvencijo o mednarodnem civilnem letalstvu ali so k njej pristopile,
ZATO skladno s prej omenjeno odločitvijo skupščine:
ta protokol sestavi generalni sekretar Organizacije;
je ta protokol na voljo za ratifikacijo vsem državam, ki so ratificirale Konvencijo o mednarodnem civilnem letalstvu ali so k njej pristopile;
se listine o ratifikaciji shranijo pri Mednarodni organizaciji civilnega letalstva;
začne ta protokol veljati na dan deponiranja osemdesete listine o ratifikaciji za vse države, ki ga ratificirajo do tega dne;
generalni sekretar takoj obvesti vse države pogodbenice o datumu deponiranja vsake listine o ratifikaciji protokola;
generalni sekretar takoj obvesti vse države pogodbenice omenjene konvencije o datumu začetka veljavnosti tega protokola;

SKUPŠČINA MEDNARODNE ORGANIZACIJE CIVILNEGA LETALSTVA,
KI SE JE SESTALA v Montrealu 14. oktobra 1974 na svojem enaindvajsetem zasedanju,
SE JE SEZNANILA s splošno željo držav pogodbenic po povečanju števila članic sveta,
JE MENILA, da je primerno, da zagotovi svetu tri dodatne sedeže in s tem poveča članstvo s trideset na triintrideset, da bi omogočila povečano zastopstvo držav, ki so bile izvoljene v drugem in še zlasti v tretjem delu volitev, in
JE MENILA, da je zaradi zgoraj navedenega razloga treba dopolniti Konvencijo o mednarodnem civilnem letalstvu, sestavljeno v Čikagu sedmega decembra 1944,
1) JE SPREJELA skladno z določbami točke a) 94. člena omenjene konvencije predlagano spremembo konvencije:
v točki a) 50. člena konvencije se spremeni drugi stavek tako, da se »trideset« nadomesti s »triintrideset«,
2) JE DOLOČILA skladno z določbami omenjene točke a) 94. člena konvencije, da predlagana sprememba začne veljati, ko jo ratificira šestinosemdeset držav pogodbenic, in
3) JE SKLENILA, da generalni sekretar Mednarodne organizacije civilnega letalstva sestavi protokol v angleškem, francoskem in španskem jeziku, pri čemer so vsa besedila enako verodostojna in vsebuje predlagano spremembo in določila, omenjena v nadaljevanju:
a) protokol podpišeta predsednik in generalni sekretar skupščine;
b) protokol je na voljo za ratifikacijo vsem državam, ki so ratificirale Konvencijo o mednarodnem civilnem letalstvu ali so k njej pristopile;
c) listine o ratifikaciji se shranijo pri Mednarodni organizaciji civilnega letalstva;
d) ta protokol začne veljati na dan deponiranja šestinosemdesete listine o ratifikaciji za vse države, ki ga ratificirajo do tega dne;
e) generalni sekretar takoj obvesti vse države pogodbenice o datumu deponiranja vsake listine o ratifikaciji protokola;
f) generalni sekretar takoj obvesti vse države pogodbenice omenjene konvencije o datumu začetka veljavnosti protokola;
g) ta protokol začne veljati za vse države pogodbenice, ki ga ratificira pozneje, na dan deponiranja listine o ratifikaciji pri Mednarodni organizaciji civilnega letalstva;
ZATO skladno s prej navedeno odločitvijo skupščine
ta protokol sestavi generalni sekretar Organizacije.

JE MENILA, da je zaradi navedenega razloga treba dopolniti Konvencijo o mednarodnem civilnem letalstvu, sestavljeno v Čikagu sedmega decembra 1944,
JE SPREJELA skladno z določbami točke a) 94. člena omenjene konvencije predlagano spremembo konvencije:

generalni sekretar takoj obvesti vse države pogodbenice navedene konvencije o datumu začetka veljavnosti protokola;
ta protokol začne za vse države pogodbenice, ki ga ratificirajo pozneje, veljati na dan deponiranja njihovih listin o ratifikaciji pri Mednarodni organizaciji civilnega letalstva.

KI SE JE SESTALA v Montrealu 6. oktobra 1980 na svojem triindvajsetem zasedanju,
SE JE SEZNANILA z resolucijami A21–22 in A22–28 o zakupu, najemu in izmenjavi letal v mednarodnih operacijah,
SE JE SEZNANILA z osnutkom spremembe Konvencije o mednarodnem civilnem letalstvu, ki ga je pripravil Pravni odbor na 23. seji,
SE JE SEZNANILA s splošno željo držav pogodbenic, da bi zagotovile prenos nekaterih nalog in obveznosti države registracije letala na državo letalskega prevoznika ob zakupu, najemu ali izmenjavi oziroma drugem podobnem dogovoru glede takega letala,
JE MENILA, da je zaradi navedenega razloga treba dopolniti Konvencijo o mednarodnem civilnem letalstvu, sestavljeno v Čikagu sedmega decembra 1944,
1. SPREJME skladno z določbami točke a) 94. člena omenjene konvencije predlagano spremembo konvencije:
za 83. členom se doda nov 83. bis člen.
»83. bis člen
Prenos nekaterih nalog in obveznosti
a) Če je ne glede na določbe 12., 30., 31. člena in točke a) 32. člena letalo registrirano v državi pogodbenici in ga skladno z dogovorom o zakupu, najemu ali izmenjavi letala oziroma drugim podobnim dogovorom uporablja letalski prevoznik, ki ima glavni poslovni sedež oziroma če takega sedeža nima, svoje prebivališče v drugi državi pogodbenici, lahko država registracije letala po dogovoru z drugo tako državo prenese nanjo v celoti ali delno svoje naloge in obveznosti glede tega letala po 12., 30., 31. členu in točki a) 32. člena. Država registracije je razrešena odgovornosti glede prenesenih nalog in obveznosti.
b) Prenos ne velja za druge države pogodbenice, dokler se dogovor o prenosu ne registrira pri svetu in javno objavi skladno s 83. členom oziroma dokler država s tem dogovorom neposredno ne seznani pristojnih organov zainteresirane države ali držav o obstoju in obsegu takšnega dogovora.
c) Določbe iz točk a) in b) veljajo tudi za primere iz 77. člena.«
2. DOLOČI skladno z določbami omenjene točke a) 94. člena konvencije, da začne predlagana sprememba veljati, ko jo ratificira osemindevetdeset držav pogodbenic, in

SKUPŠČINA MEDNARODNE ORGANIZACIJE CIVILNEGA LETASTVA,
KI SE JE SESTALA v Montrealu 10. maja 1984 na svojem petindvajsetem (izrednem) zasedanju,
SE JE SEZNANILA s tem, da lahko mednarodno civilno letalstvo v veliki meri pomaga pri sklepanju in ohranjanju prijateljstva in razumevanja med narodi in ljudstvi sveta, njegova zloraba pa lahko ogrozi splošno varnost,
SE JE SEZNANILA z željo po izogibanju trenju in po spodbujanju tega sodelovanja med narodi in ljudstvi, od česar je odvisen svetovni mir,
SE JE SEZNANILA z nujnostjo razvoja mednarodnega civilnega letalstva na varen in urejen način,
SE JE SEZNANILA, da mora biti skladno s temeljnim spoštovanjem človečnosti zagotovljena varnost in morajo biti zavarovana življenja oseb v civilnih letalih,
SE JE SEZNANILA, da v Konvenciji o mednarodnem civilnem letalstvu, sestavljeni v Čikagu sedmega decembra 1944, države pogodbenice:
– priznavajo, da vsaka država uživa popolno in izključno suverenost v zračnem prostoru nad svojim ozemljem,
– jamčijo, da bodo v svojih predpisih o državnih letalih primerno upoštevale varnost plovbe civilnih letal, in
– soglašajo, da ne bodo uporabljale civilnega letalstva za namene, ki niso v skladu s cilji konvencije,
SE JE SEZNANILA z odločnostjo držav pogodbenic, da sprejmejo ustrezne ukrepe za preprečevanje kršitve zračnega prostora drugih držav in uporabe civilnega letalstva za namene, ki niso v skladu s cilji konvencije, in dodatno okrepijo varnost mednarodnega civilnega letalstva,
SE JE SEZNANILA s splošno željo držav pogodbenic po ponovni potrditvi načela o neuporabi orožja proti civilnim letalom med letom,
1. ODLOČI, da je zaradi tega zaželena sprememba Konvencije o mednarodnem civilnem letalstvu, sestavljena v Čikagu sedmega decembra 1944,
2. SPREJME skladno z določbo točke a) 94. člena omenjene konvencije to predlagano spremembo konvencije:
za 3. členom se vstavi nov 3. bis člen:
»3. bis člen
a) Države pogodbenice priznavajo, da se mora vsaka država vzdržati uporabe orožja proti civilnim letalom med letom in da se ob prestrezanju ne smejo ogrožati življenja oseb v letalu in varnost letal. Ta določba se ne sme razlagati tako, da kakor koli spreminja pravice in obveznosti držav, ki so zapisane v Ustanovni listini Združenih narodov.
b) Države pogodbenice priznavajo, da je vsaka država pri uresničevanju svoje suverenosti upravičena zahtevati pristanek civilnega letala na določenem letališču, če leti nad njenim ozemljem brez dovoljenja ali če obstajajo upravičeni razlogi za sklepanje, da se uporablja v namene, ki niso v skladu s cilji te konvencije; takemu letalu sme izdati tudi katera koli druga navodila za preprečevanje takih kršitev. V ta namen lahko države pogodbenice uporabijo katero koli primerno sredstvo, ki je v skladu z ustreznimi pravili mednarodnega prava, vključno z ustreznimi določbami te konvencije, še posebej s točko a) tega člena. Vsaka država pogodbenica soglaša, da bo objavila svoje veljavne predpise o prestrezanju civilnih letal.
c) Vsako civilno letalo mora ravnati v skladu z ukazom, izdanim skladno s točko b) tega člena. V ta namen vsaka država pogodbenica uvede vse potrebne določbe v svojo notranjo zakonodajo ali predpise tako, da je obvezno izpolnjevanje takega ukaza za katero koli letalo, registrirano v tej državi ali ki ga upravlja letalski prevoznik z glavnim poslovnim sedežem oziroma prebivališčem v tej državi. Vsaka država pogodbenica katero koli kršitev veljavnih zakonov ali predpisov strogo kaznuje in preda primer svojim pristojnim organom skladno s svojimi zakoni ali predpisi.
d) Vsaka država pogodbenica izvaja ustrezne ukrepe za prepoved namerne uporabe civilnih letal, registriranih v tej državi, ali ki jih upravlja letalski prevoznik z glavnim poslovnim sedežem ali prebivališčem v tej državi v kateri koli namen, ki ni v skladu s cilji te konvencije. Ta določba ne vpliva na točko a) in ne krši točk b) in c) tega člena.«
3. DOLOČI skladno z določbo točke a) 94. člena konvencije, da začne predlagana sprememba veljati, ko jo ratificirata sto dve državi pogodbenici, in
4. SKLENE, da generalni sekretar Mednarodne organizacije civilnega letalstva sestavi protokol v angleškem, francoskem, ruskem in španskem jeziku, pri čemer so vsa besedila enako verodostojna in vsebuje predlagano spremembo in določbe, omenjene v nadaljevanju:
a) protokol podpišeta predsednik in generalni sekretar skupščine;
b) protokol je na voljo za ratifikacijo vsem državam, ki so ratificirale Konvencijo o mednarodnem civilnem letalstvu ali so k njej pristopile;

f) generalni sekretar takoj obvesti vse države pogodbenice omenjene konvencije o datumu začetka veljavnosti protokola;

JE MENILA, da je primerno, da poveča število članic tega telesa s triintrideset na šestintrideset,
JE MENILA, da je zaradi zgoraj omenjenega razloga treba dopolniti Konvencijo o mednarodnem civilnem letalstvu, sestavljeno v Čikagu sedmega decembra 1944,

SESTAVLJENO v Montrealu šestindvajsetega oktobra tisoč devetsto devetdesetega leta v enem izvodu v angleškem, francoskem, ruskem in španskem jeziku, pri čemer so vsa besedila enako verodostojna. Ta protokol ostane shranjen v arhivih Mednarodne organizacije civilnega letalstva; generalni sekretar Organizacije pošlje overjene kopije protokola vsem državam pogodbenicam Konvencije o mednarodnem civilnem letalstvu, sestavljene v Čikagu sedmega decembra 1944.

relating to an amendment to the Convention on International Civil Aviation
THE ASSEMBLY OF THE INTERNATIONAL CIVIL AVIATION ORGANIZATION,
HAVING been convened at Montreal by the Interim Council of the Provisional International Civil Aviation Organization, and having met in its First Session on May 6th 1947, and
HAVING considered it advisable to amend the Convention on International Civil Aviation done at Chicago on December 7th 1944,
APPROVED on the thirteenth day of May of the year one thousand nine hundred and forty-seven, in accordance with the provisions of Article 94 (a) of the Convention on International Civil Aviation done at Chicago on December 7th 1944, the following proposed amendment to the said Convention which shall be numbered as “Article 93 bis”:
“Article 93 bis
(A) Notwithstanding the provisions of Articles 91, 92 and 93, above,
(1) A State whose government the General Assembly of the United Nations has recommended be debarred from membership in international agencies established by or brought into relationship with the United Nations shall automatically cease to be a member of the International Civil Aviation Organization;
(2) A State which has been expelled from membership in the United Nations shall automatically cease to be a member of the International Civil Aviation Organization unless the General Assembly of the United Nations attaches to its act of expulsion a recommendation to the contrary.
(B) A State which ceases to be a member of the International Civil Aviation Organization as a result of the provisions of paragraph (A) above may, after approval by the General Assembly of the United Nations, be readmitted to the International Civil Aviation Organization upon application and upon approval by a majority of the Council.
(C) Members of the Organization which are suspended from the exercise of the rights and privileges of membership of the United Nations shall, upon the request of the latter, be suspended from the rights and privileges of membership in this Organization”,
SPECIFIED on the sixteenth day of May of the year one thousand nine hundred and forty-seven, pursuant to the provisions of the said Article 94 (a) of the said Convention, that the above mentioned amendment shall come into force when ratified by twenty-eight Contracting States, and
INSTRUCTED at the same date the Secretary General of the International Civil Aviation Organization to draw up a Protocol embodying this proposed amendment and to the following effect, which Protocol shall be signed by the President and the Secretary General of the First Assembly.
CONSEQUENTLY, pursuant to the aforesaid action of the Assembly,
The present Protocol shall be subject to ratification by any State which has ratified or adhered to the said Convention. The instruments of ratification shall be transmitted to the Secretary General of the International Civil Aviation Organization for deposit in the archives of the Organization; the Secretary General of the Organization shall immediately notify all Contracting States of the date of deposit of each ratification;
The aforesaid proposed amendment of the Convention shall come into force, in respect of the States which have ratified this Protocol, on the date on which the twenty-eighth instrument of ratification is deposited. The Secretary General of the Organization shall immediately notify all the States parties to or signatories of the said Convention of the date on which the proposed amendment comes into force;
The aforesaid proposed amendment shall come into force in respect of each State ratifying after that date upon deposit of its instrument of ratification in the archives of the Organization.
IN FAITH WHEREOF the President and the Secretary General of the First Assembly of the International Civil Aviation Organization, being authorized thereto by the Assembly, sign the present Protocol.

relating to an amendment to the Convention on International Civil Aviation
THE ASSEMBLY OF THE INTERNATIONAL CIVIL AVIATION ORGANIZATION,
HAVING MET in its Eighth Session, at Montreal, on the first day of June, 1954, and
HAVING CONSIDERED it desirable to amend the Convention on International Civil Aviation done at Chicago on the seventh day of December, 1944,
APPROVED, on the fourteenth day of June of the year one thousand nine hundred and fifty-four, in accordance with the provisions of Article 94 (a) of the Convention aforesaid, the following proposed amendments to the said Convention:
At the end of Article 45 of the Convention, the full stop shall be substituted by a comma, and the following shall be added, namely:
“and otherwise than temporarily by decision of the Assembly, such decision to be taken by the number of votes specified by the Assembly. The number of votes so specified will not be less than three-fifths of the total number of contracting States.”,
SPECIFIED, pursuant to the provisions of the said Article 94 (a) of the said Convention, forty-two as the number of contracting States upon whose ratification the proposed amendments aforesaid shall come into force, and
RESOLVED that the Secretary General of the International Civil Aviation Organization draw up a Protocol, in the English, French and Spanish languages, each of which shall be of equal authenticity, embodying the proposed amendments above mentioned and the matters hereinafter appearing.
CONSEQUENTLY, pursuant to the aforesaid action of the Assembly,
This Protocol shall be signed by the President of the Assembly and its Secretary General;
This Protocol shall be open to ratification by any State which has ratified or adhered to the said Convention on International Civil Aviation;
The instruments of ratification shall be deposited with the International Civil Aviation Organization;
This Protocol shall come into force among the States which have ratified it on the date on which the forty-second instrument of ratification is so deposited;
The Secretary General shall immediately notify all contracting States of the deposit of each ratification of this Protocol;
The Secretary General shall immediately notify all States parties or signatories to the said Convention of the date on which this Protocol comes into force;
With respect to any contracting State ratifying this Protocol after the date aforesaid, the Protocol shall come into force upon deposit of its instrument of ratification with the International Civil Aviation Organization.

In Article 48 (a), substitute for the word “annually” the expression “not less than once in three years”;
In article 49 (e), substitute for the expression “an annual budget” the expression “annual budgets”; and
In Article 61, substitute for the expressions “an annual budget” and “vote the budget” the expressions “annual budgets” and “vote the budgets”,
SPECIFIED, pursuant to the provisions of the said Article 94 (a) of the said Convention, forty-two as the number of contracting States upon whose ratification the proposed amendment aforesaid shall come into force, and
RESOLVED that the Secretary General of the International Civil Aviation Organization draw up a Protocol, in the English, French and Spanish languages, each of which shall be of equal authenticity, embodying the proposed amendment above mentioned and the matters hereinafter appearing.
CONSEQUENTLY, pursuant to the aforesaid action of the Assembly,

HAVING NOTED that it is the general desire of Contracting States to enlarge the membership of the Council,
HAVING CONSIDERED it proper to provide for six additional seats in the Council and, accordingly, to increase the membership from twenty-one to twenty-seven,
AND HAVING CONSIDERED it necessary to amend for the purpose aforesaid the Convention on International Civil Aviation done at Chicago on the seventh day of December, 1944,
APPROVED, on the twenty-first day of June of the year one thousand nine hundred and sixty-one, in accordance with the provisions of Article 94 (a) of the Convention aforesaid, the following proposed amendment to the said Convention:
In Article 50 (a) of the Convention the expression “twenty-one” shall be deleted and substituted by “twenty-seven”,
SPECIFIED, pursuant to the provisions of the said Article 94 (a) of the said Convention, fifty-six as the number of Contracting States upon whose ratification the proposed amendment aforesaid shall come into force, and

THE ASSEMBLY OF THE INTERNATIONAL CIVIL AVIATION ORGANIZATION,
HAVING MET in its Fourteenth Session, at Rome, on the twenty-first day of August, 1962,
HAVING NOTED that it is the general desire of contracting States that the minimum number of contracting States which may request the holding of an extraordinary meeting of the Assembly should be increased from the present figure of ten,
HAVING CONSIDERED it proper to increase the said number to one-fifth of the total number of contracting States,
AND HAVING CONSIDERED it necessary to amend for the purpose aforesaid the Convention on International Civil Aviation done at Chicago on the seventh day of December, 1944,
APPROVED, on the fourteenth day of September of the year one thousand nine hundred and sixty-two, in accordance with the provisions of Article 94 (a) of the Convention aforesaid, the following proposed amendment to the said Convention:
In Article 48 (a) of the Convention, the second sentence be deleted and substituted by “An extraordinary meeting of the Assembly may be held at any time upon the call of the Council or at the request of not less than one-fifth of the total number of contracting States addressed to the Secretary General.”

HAVING CONSIDERED it proper to provide for three seats in the Council additional to the six seats which were provided for by the amendment adopted on the twenty-first day of June 1961 to the Convention on International Civil Aviation (Chicago, 1944) and, accordingly, to increase the membership of the Council to thirty,
AND HAVING CONSIDERED it necessary to amend for the purpose aforesaid the Convention on International Civil Aviation done at Chicago on the seventh day of December 1944,
APPROVED, on the twelfth day of March 1971, in accordance with the provisions of paragraph a) of Article 94 of the Convention aforesaid, the following proposed amendment to the said Convention:
In paragraph a) of Article 50 of the Convention, the second sentence shall be deleted and replaced by:
“It shall be composed of thirty contracting States elected by the Assembly.”

THE ASSEMBLY OF THE INTERNATIONAL CIVIL AVIATION ORGANIZATION
HAVING MET in its Eighteenth Session, at Vienna, on the fifth day of July 1971,
HAVING NOTED that it is the general desire of Contracting States to enlarge the membership of the Air Navigation Commission,
HAVING CONSIDERED it proper to increase the membership of that body from twelve to fifteen, and
HAVING CONSIDERED it necessary to amend, for the purpose aforesaid, the Convention on International Civil Aviation done at Chicago on the seventh day of December 1944,
(1) APPROVED, in accordance with the provisions of Article 94 (a) of the Convention aforesaid, the following proposed amendment to the said Convention:
»In Article 56 of the Convention the expression ‘twelve members’ shall be replaced by ‘fifteen members’«.
(2) SPECIFIED, pursuant to the provisions of the said Article 94 (a) of the said Convention, eighty as the number of Contracting States upon whose ratification the aforesaid amendment shall come into force, and
(3) RESOLVED that the Secretary General of the International Civil Aviation Organization shall draw up a Protocol, in the English, French and Spanish languages, each of which shall be of equal authenticity, embodying the amendment above-mentioned and the matters hereinafter appearing:
a) The Protocol shall be signed by the President of the Assembly and its Secretary General.

HAVING MET in its Twenty-first Session, at Montreal on 14 October 1974,
HAVING NOTED that it is the general desire of contracting States to enlarge the membership of the Council,
HAVING CONSIDERED it proper to provide for three additional seats in the Council, and accordingly to increase the membership from thirty to thirty-three, in order to permit an increase in the representation of States elected in the second, and particularly the third, part of the election, and
HAVING CONSIDERED it necessary to amend, for the purpose aforesaid, the Convention on International Civil Aviation done at Chicago on the seventh day of December 1944,
(1) APPROVED, in accordance with the provisions of Article 94(a) of the Convention aforesaid, the following proposed amendment to the said Convention:

HAVING NOTED Resolution A21-13 on the authentic Russian text of the Convention on International Civil Aviation,
HAVING NOTED that it is general desire of Contracting States to make a provision that the Convention aforesaid exist in authentic Russian text,
HAVING CONSIDERED it necessary to amend, for the purpose aforesaid, the Convention on International Civil Aviation done at Chicago on the seventh day of December 1944,
1. APPROVES, in accordance with the provisions of Article 94(a) of the Convention aforesaid, the following proposed amendment to the said Convention:
Replace the present text of the final paragraph of the Convention by:
“Done at Chicago the seventh day of December 1944 in the English language. The texts of this Convetnion drawn up in the English, French, Russian and Spanish languages are of equal authenticity. These texts shall be deposited in the archives of the Government of the United States of America, and certified copies shall be transmitted by the Government to the Governments of all the States which may sign or adhere to this Convention. This Convention shall be open for signature at Washington, D.C.”,
2. SPECIFIES, pursuant to the provisions of the said Article 94(a) of the said Convention, ninety-four as the number of Contracting States upon whose ratification the proposed amendment aforesaid shall come into force, and
3. RESOLVES that the Secretary General of the International Civil Aviation Organization draw up a Protocol, in the English, French, Russian and Spanish languages, each of which shall be of equal authenticity, embodying the proposed amendment above-mentioned and the matter hereinafter appearing.
CONSEQUENTLY, pursuant to the aforesaid action of the Assembly,
This Protocol has been drawn up by the Secretary General of the Organization.
The Protocol shall be open to ratification by any State which has ratified or adhered to the said Convetnion on International Civil Aviation.
The instruments of ratification shall be deposited with the International Civil Aviation Organization.
The Protocol shall come into force in respect of the States which have ratified it on the date on which the ninety-fourth instrument of ratification is so deposited.
The Secretary General shall immediately notify all Contracting States of the date of deposit of each ratification of the Protocol.
The Secretary General shall immediately notify all States parties to the said Convention of the date on which the Protocol comes into force.
With respect to any Contracting State ratifying the Protocol after the date aforesaid, the Protocol shall come into force upon deposit of its instrument of ratificaiton with the International Civil Aviation Organization:
IN WITNESS WHEREOF, the President and the Secretary General of the aforesaid Twenty-second Session of the Assembly of the International Civil Aviation Organization, being authorized thereto by the Assembly, sign this Protocol.
DONE at Montreal on the thirtieth day of September of the year one thousand nine hundred and seventy-seven, in a single document in the English, French, Russian and Spanish languages, each of which shall be of equal authenticity. relating to an amendment to the Convention on International Civil Aviation
THE ASSEMBLY OF THE INTERNATIONAL CIVIL AVIATION ORGANIZATION
HAVING MET in its Twenty-third Session, at Montreal on 6 October 1980,
HAVING NOTED Resolutions A21-22 and A22-28 on lease, charter and interchange of aircraft in international operations,
HAVING NOTED the draft amendment to the Convention on International Civil Aviation prepared by the 23rd Session of the Legal Committee,
HAVING NOTED that it is the general desire of Contracting States to make a provision for the transfer of certain functions and duties from the State of registry to the State of the operator of the aircraft in the case of lease, charter or interchange or any similar arrangements with respect to such aircraft,
HAVING CONSIDERED it necessary to amend, for the purpose aforesaid, the Convention on International Civil Aviation done at Chicago on the seventh day of December 1944,
1. APPROVES, in accordance with the provisions of Article 94(a) of the Convention aforesaid, the following proposed amendment to the said Convention:
Insert after Article 83 the following new Article 83 bis:
“Article 83 bis
Transfer of certain functions and duties
(a) Notwithstanding the provisions of Articles 12, 30, 31 and 32 (a), when an aircraft registered in a contracting State is operated pursuant to an agreement for the lease, charter or interchange of the aircraft or any similar arrangement by an operator who has his principal place of business or, if he has no such place of business, his permanent residence in another contracting State, the State of registry may, by agreement with such other State, transfer to it all or part of its functions and duties as State of registry in respect of that aircraft under Articles 12, 30, 31 and 32 (a). The State of registry shall be relieved of responsibility in respect of the functions and duties transferred.
(b) The transfer shall not have effect in respect of other contracting States before either the agreement between States in which it is embodied has been registered with the Council and made public pursuant to Article 83 or the existence and scope of the agreement have been directly communicated to the authorities of the other contracting State or States concerned by a State party to the agreement.
(c) The provisions of paragraphs (a) and (b) above shall also be applicable to cases covered by Article 77".
2. SPECIFIES, pursuant to the provisions of the said Article 94(a) of the said Convention, ninety-eight as the number of Contracting States upon whose ratification the proposed amendment aforesaid shall come into force, and
3. RESOLVES that the Secretary General of the International Civil Aviation Organization draw up a Protocol, in the English, French, Russian and Spanish languages, each of which shall be of equal authenticity, embodying the proposed amendment above-mentioned and the matter hereinafter appearing:
a) The Protocol shall be signed by the President of the Aseembly and its Secretary General.
b) The Protocol shall be open to ratification by any State which has ratified or adhered to the said Convention on International Civil Aviation.
c) The instruments of ratification shall be deposited with the International Civil Aviation Organization.
d) The Protocol shall come into force in respect of the States which have ratified it on the date on which the ninety-eighth instrument of ratification is so deposited.
e) The Secretary General shall immediately notify all Contracting States of the date of deposit of each ratification of the Protocol.
f) The Secretary General shall immediately notify all States parties to the said Convention of the date on which the Protocol comes into force.
g) With respect to any Contracting State ratifying the Protocol after the date aforesaid, the Protocol shall come into force upon deposit of its instrument of ratification with the International Civil Aviation Organization.

Signed at Montreal, on 10 May 1984
THE ASSEMBLY OF THE INTERNATIONAL CIVIL AVIATION ORGANIZATION
HAVING MET in its Twenty-fifth Session (Extraordinary), at Montreal on 10 May 1984,
HAVING NOTED that international civil aviation can greatly help to create and preserve friendship and understanding among the nations and peoples of the world, yet its abuse can become a threat to general security,
HAVING NOTED that it is desirable to avoid friction and to promote that cooperation between nations and peoples upon which the peace of the world depends,
HAVING NOTED that it is necessary that international civil aviation may be developed in a safe and orderly manner,
HAVING NOTED that in keeping with elementary considerations of humanity the safety and the lives of persons on board civil aircraft must be assured,
HAVING NOTED that in the Convention on International Civil Aviation done at Chicago on the seventh day of December 1944 the contracting States
– recognize that every State has complete and exclusive sovereignty over the airspace above its territory,
– undertake, when issuing regulations for their state aircraft, that they will have due regard for the safety of navigation of civil aircraft, and
– agree not to use civil aviation for any purpose inconsistent with the aims of the Convention,
HAVING NOTED the resolve of the contracting States to take appropriate measures designed to prevent the violation of other States’ airspace and the use of civil aviation for purposes inconsistent with the aims of the Convention and to enhance further the safety of international civil aviation,
HAVING NOTED the general desire of contracting States to reaffirm the principle of non-use of weapons against civil aircraft in flight,
1. DECIDES that it is desirable therefore to amend the Convention on International Civil Aviation done at Chicago on the seventh day of December 1944,
2. APPROVES, in accordance with the provision of Article 94 (a) of the Convention aforesaid, the following proposed amendment to the said Convention:
Insert, after Article 3, a new Article 3 bis:
“Article 3 bis
(a) The contracting States recognize that every State must refrain from resorting to the use of weapons against civil aircraft in flight and that, in case of interception, the lives of persons on board and the safety of aircraft must not be endangered. This provision shall not be interpreted as modifying in any way the rights and obligations of States set forth in the Charter of the United Nations.
(b) The contracting States recognize that every State, in the exercise of its sovereignty, is entitled to require the landing at some designated airport of a civil aircraft flying above its territory without authority or if there are reasonable grounds to conclude that it is being used for any purpose inconsistent with the aims of this Convention; it may also give such aircraft any other instructions to put an end to such violations. For this purpose, the contracting States may resort to any appropriate means consistent with relevant rules of international law, including the relevant provisions of this Convention, specifically paragraph (a) of this Article. Each contracting State agrees to publish its regulations in force regarding the interception of civil aircraft.
(c) Every civil aircraft shall comply with an order given in conformity with paragraph (b) of this Article. To this end each contracting State shall establish all necessary provisions in its national laws or regulations to make such compliance mandatory for any civil aircraft registered in that State or operated by an operator who has his principal place of business or permanent residence in that State. Each contracting State shall make any violation of such applicable laws or regulations punishable by severe penalties and shall submit the case to its competent authorities in accordance with its laws or regulations.
(d) Each contracting State shall take appropriate measures to prohibit the deliberate use of any civil aircraft registered in that State or operated by an operator who has his principal place of business or permanent residence in that State for any purpose inconsistent with the aims of this Convention. This provision shall not affect paragraph (a) or derogate from paragraphs (b) and (c) of this Article.”,
3. SPECIFIES, pursuant to the provision of the said Article 94(a) of the said Convention, one hundred and two as the number of contracting States upon whose ratification the proposed amendment aforesaid shall come into force, and
4. RESOLVES that the Secretary General of the International Civil Aviation Organization draw up a Protocol, in the English, French, Russian and Spanish languages, each of which shall be of equal authenticity, embodying the proposed amendment above-mentioned and the matter hereinafter appearing:
a) The Protocol shall be signed by the President of the Assembly and its Secretary General.
b) The Protocol shall be open to ratification by any State which has ratified or adhered to the said Convention on International Civil Aviation.
c) The instruments of ratification shall be deposited with the International Civil Aviation Organization.

THE ASSEMBLY OF THE INTERNATIONAL CIVIL AVIATION ORGANIZATION
HAVING MET in its Twenty-seventh Session at Montreal on 6 October 1989,
HAVING NOTED that it is the general desire of Contracting States to enlarge the membership of the Air Navigation Commission,
HAVING CONSIDERED it proper to increase the membership of that body from fifteen to nineteen, and
HAVING CONSIDERED it necessary to amend, for the purpose aforesaid, the Convention on International Civil Aviation done at Chicago on the seventh day of December 1944,
1. APPROVES, in accordance with the provisions of Article 94(a) of the Convention aforesaid, the following proposed amendment to the said Convention:
“In Article 56 of the Convention the expression ’fifteen members’ shall be replaced by ‘nineteen members’.”
2. SPECIFIES, pursuant to the provisions of the said Article 94(a) of the said Convention, one hundred and eight as the number of Contracting States upon whose ratification the aforesaid amendment shall come into force, and
3. RESOLVES that the Secretary General of the International Civil Aviation Organization shall draw up a Protocol, in the English, French, Russian and Spanish languages, each of which shall be of equal authenticity, embodying the amendment above-mentioned and the matters hereinafter appearing:
a) The Protocol shall be signed by the President of the Assembly and its Secretary General.

Signed at Montreal, on 26 October 1990
THE ASSEMBLY OF THE INTERNATIONAL CIVIL AVIATION ORGANIZATION
HAVING MET in its Twenty-eighth Session (Extraordinary) at Montreal on 25 October 1990,
HAVING NOTED that it is the desire of a large number of Contracting States to enlarge the membership of the Council in order to ensure better balance by means of an increased representation of Contracting States;
HAVING CONSIDERED it appropriate to increase the membership of that body from thirty-three to thirty-six;
HAVING CONSIDERED it necessary to amend, for the purpose aforesaid, the Convention on International Civil Aviation done at Chicago on the seventh day of December 1944,
1. APPROVES, in accordance with the provisions of Article 94(a) of the Convention aforesaid, the following proposed amendment to the said Convention:
“In Article 50(a) of the Convention the second sentence shall be amended by replacing ‘thirty-three’ by ‘thirty-six’.”;
2. SPECIFIES, pursuant to the provisions of the said Article 94(a) of the said Convention, one hundred and eight as the number of Contracting States upon whose ratification the proposed amendment aforesaid shall come into force,
3. RESOLVES that the Secretary General of the International Civil Aviation Organization draw up a Protocol, in the English, French, Russian and Spanish languages, each of which shall be of equal authenticity, embodying the amendment above-mentioned and the matter hereinafter appearing:
