Razglašam Zakon o ratifikaciji Sporazuma o sodelovanju med Vlado Republike Slovenije in Organizacijo Severnoatlantskega pakta (MSOSAP), ki ga je sprejel Državni zbor Republike Slovenije na seji 15. decembra 1998.

O RATIFIKACIJI SPORAZUMA O SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN ORGANIZACIJO SEVERNOATLANTSKEGA PAKTA (MSOSAP)

Ratificira se Sporazum o sodelovanju med Vlado Republike Slovenije in Organizacijo Severnoatlantskega pakta, sklenjen z izmenjavo pisem dne 31. julija 1997 in 11. avgusta 1997.

Dear Minister,
I have the honour to refer to the General Framework Agreement for Peace in Bosnia and Herzegovina (Peace Agreement) dated 14th December 1995, and the United Nations Security Council Resolution (UNSCR) No. 188 dated 12th December 1996 providing for the establishment of a Stabilization Force (SFOR) in the Republic of Bosnia and Herzegovina.
In accordance with the Peace Agreement and the UNSCR, the North Atlantic Treaty Organization has decided to establish a multinational SFOR involving NATO and no-NATO forces. Therefore, based upon previous discussions and communications, I accept with appreciation the offer of the Government of the Republic of Slovenia to provide to the SFOR three 412 Bell helicopters and one Turbolet transport aircraft on call in Slovenia with air crews, supervisory staff and maintenance crews for non-combat transportation missions. It is my understanding that it is the intention of the Government of the Republic of Slovenia to maintain its participation in the SFOR until SFOR’s mandate is terminated. Thereafter, this contribution may be extended by mutual agreement.
The principles concerning the establishment, functions, and responsibilities of the SFOR are set out in the Peace Agreement, the UNSCR, and NATO’s operational planning documents. It is understood that your ultimate decision with respect to participation will be contingent upon your acceptance of the provisions of these documents. I seek your agreement that the Slovenian contingent shall conduct itself in accordance with the terms of these documents and any changes to them throughout the course of the operation. Also, I would like to emphasize the importance of continuity of service of units in the SFOR and to seek your agreement that the Slovenian contingent will not be withdrawn without at least four months prior notification to the Commander, SFOR (COMSFOR), except as otherwise agreed.
I draw your attention to the Status of Forces Agreements between NATO and the Republic of Croatia, and the Republic of Bosnia and Herzegovina, and the agreement on transit arrangements between NATO and the Federal Republic of Yugoslavia, as well as the other agreements, which set out the rights, obligations, privileges and immunities of the SFOR and its members when present in those respective host nations. I trust you will confirm that the appropriate authorities of your national contingent shall take the necessary measures to assure the maintenance of proper discipline of your personnel and to exercise jurisdiction with respect to any crime or disciplinary offence which might be committed by your personnel. Of particular importance are paragraph 21 of both SOFAs and 18 of the Transit Arrangements, which stipulate that individual SFOR members from each non-NATO troop contributing nation shall enjoy the same rights, privileges and immunities as accorded to NATO personnel, and paragraph 3 of both SOFAs and 6 of the Transit Arrangements, which require SFOR personnel to respect the laws of the host nation and to avoid any activities incompatible with the nature of the operation carried out by SFOR. With regard to criminal jurisdiction, paragraph 7 of both SOFAs and 10 of the Transit Arrangements state that SFOR military personnel shall be subject to the exclusive jurisdiction of their respective national elements in respect of any criminal or disciplinary offences which may be committed by them in the host nation.
With reference to the Peace Agreement, I seek your agreement that national contingents provided to the SFOR, having fully arrived in the Theatre Area of Operarions and having been assessed as capable of performing its assigned SFOR mission, shall be placed under the operational control of the Supreme Allied Commander Europe (SACEUR) and subject to NATO Rules of Engagement. SACEUR will assume overall authority for the operation and operational command or control, designating the Commander in Chief Allied Land Forces Central Europe as the commander in Theatre of the SFOR. The COMSFOR will issue orders to the national contingents through the chain of command established by him. Non-NATO nations will retain national command of their own contingents.
The exchange of SFOR classified information between NATO and non-NATO nations will be carried out in accordance with Security Agreements to be executed by all participating nations.
Any issues not covered in the present letter remain the responsibility of the Government of the Republic of Slovenia and will not entail any financial responsibility of NATO or any of the national constituent elements of the SFOR.
Troop contributing nations will have the right to participate in the International Coordination Centre (ICC) at SHAPE.
Troop contributing nations can address issues of a political nature concerning the operation to the NATO Secretary General.
COMSFOR will utilize national contingents in accordance with their capabilities taking into account the advice of the contingent Commander.
I have the honour to propose that this letter and your reply confirming the agreement of your government to the terms thereof, shall constitute an agreement which shall enter into force on the date on which the Government of the Republic of Slovenia informs the NATO that all its procedures required for the entering into force of this Agreement have been fulfilled; it shall however be applied provisionally as of the date of your reply.

Spoštovani minister,
Čast imam sklicevati se na Splošni okvirni sporazum za mir v Bosni in Hercegovini (Mirovni sporazum) z dne 14. decembra 1995 in na resolucijo Varnostnega sveta Združenih narodov (UNSCR) št. 1088 z dne 12. decembra 1996, ki predvidevata ustanovitev Stabilizacijskih sil (SFOR) v Republiki Bosni in Hercegovini.
V skladu z Mirovnim sporazumom in UNSCR se je Organizacija Severnoatlantskega pakta odločila, da ustanovi večnacionalni SFOR, ki vključuje sile Nata in sile držav nečlanic Nata. Zato na podlagi prejšnjih razprav in sporočil z veseljem sprejemam ponudbo Vlade Republike Slovenije, da za SFOR zagotovi tri helikopterje Bell 412 in eno transportno letalo Turbolet z letalsko posadko, pripravljeno v Sloveniji, nadzorno osebje in enote za vzdrževanje za nebojne transportne naloge. Razumem, da je namen Republike Slovenije ohraniti sodelovanje v SFOR-ju do konca SFOR-jevega mandata. To sodelovanje se lahko podaljša z obojestranskim sporazumom.
Načela glede ustanovitve, nalog in odgovornosti SFOR-ja so določena v Mirovnem sporazumu, UNSCR in dokumentih Nata o operativnem načrtu. Razume se, da bo vaša končna odločitev glede sodelovanja pogojena z vašim sprejetjem določb teh dokumentov. Prosim za vaš pristanek, da slovenski kontingent ravna v skladu s pogoji teh dokumentov in vsemi spremembami le-teh med celotno operacijo. Rad bi tudi poudaril pomembnost stalnosti služenja enot v SFOR-ju in vaš pristanek, da brez obvestila poveljniku SFOR-ja (COMSFOR) vsaj štiri mesece vnaprej ne boste odpoklicali slovenskega kontingenta, razen če ni drugače dogovorjeno.
Opozarjam vas na Sporazume o položaju sil med Natom in Republiko Hrvaško ter Republiko Bosno in Hercegovino in na Sporazum o dogovorih za tranzit med Natom in Zvezno republiko Jugoslavijo kot tudi na druge sporazume, ki določajo pravice, obveznosti, privilegije in imunitete SFOR-ja in njegovih članov, kadar so v eni od držav gostiteljic. Prepričan sem, da boste potrdili, da bodo ustrezne oblasti v vašem kontingentu vaše države ustrezno ukrepale za zagotavljanje ohranjanja primerne discipline osebja in izvajale jurisdikcijo v zvezi s kakršnim koli kaznivim dejanjem ali disciplinskim prekrškom, ki bi ga morda storilo vaše osebje. Še posebej pomembna sta 21. odstavek obeh Sporazumov o položaju sil (SOFA) in 18. odstavek Dogovorov za tranzit, ki določajo, da posamezni člani SFOR-ja vsake čete iz države, ki ni članica Nata, uživajo enake pravice, privilegije in imunitete, kot so podeljene osebju Nata, in 3. odstavek obeh Sporazumov o položaju sil (SOFA) in 6. odstavek Dogovorov za tranzit, ki zahtevajo, da osebje SFOR-ja spoštuje zakone države gostiteljice ter se izogiba kakršnim koli dejavnostim, ki niso v skladu z operacijo, ki jo izvaja SFOR. V zvezi s kazensko pristojnostjo 7. odstavek obeh Sporazumov o položaju sil (SOFA) in 10. odstavek Dogovorov za tranzit določajo, da je vojaško osebje SFOR-ja v izključni sodni pristojnosti organov v svoji državi v zvezi s katerim koli kaznivim dejanjem ali disciplinskim prekrškom, ki bi ga morda storili v državi gostiteljici.
V zvezi z Mirovnim sporazumom prosim za vaš pristanek, da se državni kontingenti, dodeljeni SFOR-ju, potem ko so v celoti prispeli na območje operacij in je bilo ocenjeno, da so zmožni za izvedbo predpisane naloge SFOR-ja, razporedijo pod operativni nadzor Vrhovnega poveljnika zavezniških sil v Evropi (SACEUR) ter da zanje velja Natov pravilnik o delovanju (Rules of Engagement). SACEUR bo prevzel celotno pristojnost za operacijo in operativno poveljstvo ali nadzor, pri čemer bo za poveljnika območja SFOR-ja določil Vrhovnega poveljnika zavezniških kopenskih sil v Srednji Evropi. COMSFOR bo izdajal ukaze državnim kontingentom preko linije poveljevanja, ki jo bo vzpostavil. Države, ki niso članice Nata, bodo nad svojimi kontingenti obdržale poveljstvo.
Izmenjava zaupnih podatkov SFOR-ja med državami članicami in nečlanicami Nata bo potekalo v skladu z varnostnimi sporazumi, ki jih morajo izvajati vse sodelujoče države.
Vsa vprašanja, ki jih to pismo ne zajema, ostajajo odgovornost Vlade Republike Slovenije in ne bodo imela za posledico nobene finančne odgovornosti Nata ali katerega koli nacionalnega sestavnega elementa SFOR-ja.
Države, ki prispevajo čete, bodo imele pravico sodelovati v Mednarodnem centru za koordinacijo (International Coordination Centre - ICC) pri SHAPE.
Države, ki prispevajo čete, lahko vprašanja politične narave v zvezi z operacijo naslovijo na generalnega sekretarja Nata.
COMSFOR bo uporabil državne kontingente v skladu z njihovimi zmožnostmi, pri čemer bo upošteval nasvete poveljnika kontingenta.
Čast imam predlagati, da to pismo in vaš odgovor, ki potrjuje, da vaša vlada soglaša s temi pogoji, sestavljata sporazum, ki začne veljati na dan, ko Vlada Republike Slovenije obvesti Nato, da so izpolnjeni vsi potrebni postopki za začetek veljavnosti tega sporazuma, začasno pa se uporablja od dneva vašega odgovora.

Spoštovani gospod generalni sekretar,
čast imam potrditi prejem vašega pisma z dne 31. julija 1997, ki se glasi:
»Čast imam sklicevati se na Splošni okvirni sporazum za mir v Bosni in Hercegovini (Mirovni sporazum) z dne 14. decembra 1995 in na resolucijo Varnostnega sveta Združenih narodov (UNSCR) št. 1088 z dne 12. decembra 1996, ki predvidevata ustanovitev Stabilizacijskih sil (SFOR) v Republiki Bosni in Hercegovini.
V skladu z Mirovnim sporazumom in UNSCR se je Organizacija Severnoatlantskega pakta odločila, da ustanovi večnacionalni SFOR, ki vključuje sile Nata in sile držav nečlanic Nata. Zato na podlagi prejšnjih razprav in sporočil z veseljem sprejemam ponudbo Vlade Republike Slovenije, da za SFOR zagotovi tri helikopterje Bell 412 in eno transportno letalo Turbolet z letalsko posadko, pripravljeno v Sloveniji, nadzorno osebje in enote za vzdrževanje za nebojne transportne naloge. Razumem, da je namen Republike Slovenije ohraniti sodelovanje v SFOR-ju do konca SFOR-jevega mandata. To sodelovanje se lahko podaljša z obojestranskim sporazumom.
Načela glede ustanovitve, nalog in odgovornosti SFOR-ja so določena v Mirovnem sporazumu, UNSCR in dokumentih Nata o operativnem načrtu. Razume se, da bo vaša končna odločitev glede sodelovanja pogojena z vašim sprejetjem določb teh dokumentov. Prosim za vaš pristanek, da slovenski kontingent ravna v skladu s pogoji teh dokumentov in vsemi spremembami le-teh med celotno operacijo. Rad bi tudi poudaril pomembnost stalnosti služenja enot v SFOR-ju in vaš pristanek, da brez obvestila poveljniku SFOR-ja (COMSFOR) vsaj štiri mesece vnaprej ne boste odpoklicali slovenskega kontingenta, razen če ni drugače dogovorjeno.
Opozarjam vas na Sporazume o položaju sil med Natom in Republiko Hrvaško ter Republiko Bosno in Hercegovino in na Sporazum o dogovorih za tranzit med Natom in Zvezno republiko Jugoslavijo kot tudi na druge sporazume, ki določajo pravice, obveznosti, privilegije in imunitete SFOR-ja in njegovih članov, kadar so v eni od držav gostiteljic. Prepričan sem, da boste potrdili, da bodo ustrezne oblasti v vašem kontingentu vaše države ustrezno ukrepale za zagotavljanje ohranjanja primerne discipline osebja in izvajale jurisdikcijo v zvezi s kakršnim koli kaznivim dejanjem ali disciplinskim prekrškom, ki bi ga morda storilo vaše osebje. Še posebej pomembna sta 21. odstavek obeh Sporazumov o položaju sil (SOFA) in 18. odstavek Dogovorov za tranzit, ki določajo, da posamezni člani SFOR-ja vsake čete iz države, ki ni članica Nata, uživajo enake pravice, privilegije in imunitete, kot so podeljene osebju Nata, in 3. odstavek obeh Sporazumov o položaju sil (SOFA) in 6. odstavek Dogovorov za tranzit, ki zahtevajo, da osebje SFOR-ja spoštuje zakone države gostiteljice ter se izogiba kakršnim koli dejavnostim, ki niso v skladu z operacijo, ki jo izvaja SFOR. V zvezi s kazensko pristojnostjo 7. odstavek obeh Sporazumov o položaju sil (SOFA) in 10. odstavek Dogovorov za tranzit določajo, da je vojaško osebje SFOR-ja v izključni sodni pristojnosti organov v svoji državi v zvezi s katerim koli kaznivim dejanjem ali disciplinskim prekrškom, ki bi ga morda storili v državi gostiteljici.
V zvezi z Mirovnim sporazumom prosim za vaš pristanek, da se državni kontingenti, dodeljeni SFOR-ju, potem ko so v celoti prispeli na območje operacij in je bilo ocenjeno, da so zmožni za izvedbo predpisane naloge SFOR-ja, razporedijo pod operativni nadzor Vrhovnega poveljnika zavezniških sil v Evropi (SACEUR) ter da zanje velja Natov pravilnik o delovanju (Rules of Engagement). SACEUR bo prevzel celotno pristojnost za operacijo in operativno poveljstvo ali nadzor, pri čemer bo za poveljnika območja SFOR-ja določil Vrhovnega poveljnika zavezniških kopenskih sil v Srednji Evropi. COMSFOR bo izdajal ukaze državnim kontingentom preko linije poveljevanja, ki jo bo vzpostavil. Države, ki niso članice Nata, bodo nad svojimi kontingenti obdržale poveljstvo.
Izmenjava zaupnih podatkov SFOR-ja med državami članicami in nečlanicami Nata bo potekalo v skladu z varnostnimi sporazumi, ki jih morajo izvajati vse sodelujoče države.
Vsa vprašanja, ki jih to pismo ne zajema, ostajajo odgovornost Vlade Republike Slovenije in ne bodo imela za posledico nobene finančne odgovornosti Nata ali katerega koli nacionalnega sestavnega elementa SFOR-ja.
Države, ki prispevajo čete, bodo imele pravico sodelovati v Mednarodnem centru za koordinacijo (International Coordination Centre - ICC) pri SHAPE.
Države, ki prispevajo čete, lahko vprašanja politične narave v zvezi z operacijo naslovijo na generalnega sekretarja Nata.
COMSFOR bo uporabil državne kontingente v skladu z njihovimi zmožnostmi, pri čemer bo upošteval nasvete poveljnika kontingenta.
Čast imam predlagati, da to pismo in vaš odgovor, ki potrjuje, da vaša vlada soglaša s temi pogoji, sestavljata sporazum, ki začne veljati na dan, ko Vlada Republike Slovenije obvesti Nato, da so izpolnjeni vsi potrebni postopki za začetek veljavnosti tega sporazuma, začasno pa se uporablja od dneva vašega odgovora.«
Z veseljem vas obveščam, da je moja vlada sprejela omenjeno pismo, ki skupaj s tem odgovorom, ki potrjuje, da se moja vlada strinja z njegovimi pogoji, sestavlja sporazum, ki začne veljati na dan, ko Vlada Republike Slovenije obvesti Nato, da so izpolnjeni vsi potrebni postopki za začetek veljavnosti sporazuma, začasno pa se uporablja od dneva tega odgovora.
Sprejmite, prosim, gospod generalni sekretar, izraze mojega odličnega spoštovanja.

Za izvajanje sporazuma skrbi Ministrstvo za zunanje zadeve v sodelovanju z Ministrstvom za obrambo.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
