O RAZGLASITVI ZAKONA O RATIFIKACIJI PROTOKOLA TER DRUGEGA, ČETRTEGA IN PETEGA PROTOKOLA K SPLOŠNEMU SPORAZUMU O PRIVILEGIJIH IN IMUNITETAH SVETA EVROPE
Razglašam Zakon o ratifikaciji Protokola ter drugega, četrtega in petega protokola k Splošnemu sporazumu o privilegijih in imunitetah Sveta Evrope, ki ga je sprejel Državni zbor Republike Slovenije na seji dne 27. septembra 1994.

ZAKON
O RATIFIKACIJI PROTOKOLA TER DRUGEGA, ČETRTEGA IN PETEGA PROTOKOLA K SPLOŠNEMU SPORAZUMU O PRIVILEGIJIH IN IMUNITETAH SVETA EVROPE
1. člen
Ratificira se Protokol k Splošnemu sporazumu o privilegijih in imunitetah Sveta Evrope z dne 6. novembra 1952, Drugi protokol k Splošnemu sporazumu o privilegijih in imunitetah Sveta Evrope z dne 15. decembra 1956, Četrti protokol k Splošnemu sporazumu o privilegijih in imunitetah Sveta Evrope, z dne 16. decembra 1961 in Peti protokol k Splošnemu sporazumu o privilegijih in imunitetah Sveta Evrope z dne 18. junija 1990.
2. člen
Protokoli se v izvirniku v angleškem jeziku in prevodu v slovenskem jeziku glasijo:
PROTOCOL
TO THE GENERAL AGREEMENT ON PRIVILEGES AND IMMUNITIES OF THE COUNCIL OF EUROPE
The Governments signatory to the General Agreement on Privileges and Immunities of the Council of Europe, signed at Paris on the 2nd September 1949 (hereinafter referred to as the Agreement),
Desirous of extending the provisions of the Agreement,
Have agreed as follows:
Article 1
Any present or future Member of the Council of Europe not a signatory of the Agreement may accede to the latter and to this Protocol by depositing its instrument of accession to them both with the Secretary-General of the Council of Europe, who shall notify the Members of the Council thereof.
Article 2
a) The provisions of Part IV of the Agreement shall apply to representatives attending meeting of the Ministers' Deputies.
b) The provisions of Part IV of the Agreement shall apply to representatives other than Representatives to the Consultative Assembly attending meetings convened by the Council of Europe and held when neither the Committee of Ministers nor the Ministers' Deeputies are in session save that representatives attending such meetings shall not be exempt from arrest and prosecution when found committing, attempting to commit, or just having committed an offence.
Article 3
The provisions of Article 15 of the Agreement shall apply to Representatives to the Assembly, and their Substitutes, at any time when they are attending or travelling to and from, meetings of Committees and Sub-Committees of the Consultative Assembly, whether or not the Assembly is itself in session at such time.
Article 4
The permanent representatives of Members of the Council of Europe shall, while exercising their functions and during their journey to and from the place of meetings, enjoy the privileges, immunities and facilities normally enjoyed by diplomatic envoys of comparable rank.
Article 5
Privileges, immunities and facilities are accorded to the representatives of Members not for the personal benefit of the individuals concerned, but in order to safeguard the independent exercise of their functions in connection with the Council of Europe. Consequently, a Member has not only the right but the duty to waive the immunity of its representative in any case where, in the opinion of the Member, the immunity would impede the course of justice and it can be waived without prejudice to the purpose for which the immunity is accorded.
Article 6
The prosivions of Article 4 are not applicable in relation to the authorities of the State of which the person is a national or of the Member of which he is or has been a representative.
Article 7
a) This Protocol shall be open to signature by all Members which have signed the Agreement. The Protocol shall be ratified at the same time as or after the ratification of the Agreement. Instruments of ratification shall be deposited with the Secretary-General of the Council of Europe.
b) This Protocol shall enter into force on the day when it shall have been ratified by all the signatories who at that date have ratified the Agreement, on condition that the number of signatories who have ratified the Agreement and the Protocol shall not be fewer than seven.
c) As regards and signatory ratifying subsequently, the Protocol shall enter into force at the date of the deposit of its instrument of ratification.
d) In the case of Members which have acceded to the Agreement and Protocol in accordance with the terms of Article I the Agreement and Protocol shall enter into force:
(i) On the date specified in paragraph (b) above in cases where the instrument of accession has been deposited prior to this date; or
(ii) On the date of deposit of the instrument of accession in cases where this instrument is deposited at a date subsequent to that specified in paragraph (b) above.
In witness hereof the undersigned, being duly authorised thereto, have signed the present Protocol
Done at Strasbourg on the 6th day of November 1952, in English and French, both texts being equally authoritative, in a single copy which shall remain deposited in the archives of the Council of Europe. The Secretary-General shall transmit certified copies to each of the signatory and acceding Governments.
SECOND PROTOCOL
TO THE GENERAL AGREEMENT ON PRIVILEGES AND IMMUNITIES OF THE COUNCIL OF EUROPE
PROVISIONS IN RESPECT OF THE MEMBERS OF THE EUROPEAN COMMISSION OF HUMAN RIGHTS
The Governments signatory hereto, being Members of the Council of Europe,
Considering that, under the terms of Afticle 59 of the Convention for the Protection of Human Rights and Fundamental Freedoms, signed at Rome on 4th November, 1950, the members of the European Commission of Human Rights (hereinafter referred to as »The Commission«) are entitled, during the discharge of their functions, to the privileges and immunities provided for in Article 40 of the Statute of the Council of Europe and in the Agreements made thereunder;
Considering that it is necessary to specify and define the said privileges and immunities in a Protocol to the General Agreement on Privileges and Immunities of the Council of Europe, signed at Paris on 2nd September, 1949,
Have agreed as follows:
Article 1
The members of the Commission shall, while exercising their functions and during their journeys to and from their place of meeting, enjoy the following privileges and immunities:
(a) immunity from personal arrest or detention and from seizure of their personal baggage, and, in respect of words spoken or written and all acts done by them in their official capacity, immunity from legal process of every kind;
(b) inviolability from all papers and documents;
(c) exemption in respect of themselves and their spouses from immigration restrictions or aliens registration in the State which they are visiting or through which they are passing in the exercise of their functions.
Article 2
1. No administative or other restrictions shall be imposed on the free movement of members of the Commission to and from the place of meeting of the Commission.
2. Members of the Commission shall, in the matter of customs and exchange control, be accorded:
(a) by their own Government, the same facilities as those accorded to senior officials travelling abroad on temporary official duty;
(b) by the Governments of other Members, the same facilities as those accorded to representatives of foreign Governments on temporary official duty.
Article 3
In order to secure for the members of the Commission complete freedom of speech and complete independence in the discharge of their duties, the immunity from legal process in respect of words spoken or written and all acts done by them in discharging their duties shall continue to be accorded, notwithstanding that the persons concerned are no longer engaged in the discharge of such duties.
Article 4
Privileges and immunities are accorded to the members of the Commission, not for the personal benefit of the individuals themselves, but in order to safeguard the independent exercise of their functions, The Commission alone shall be competent to waive the immunity of its members; it has not only the right, but is under a duty, to waive the immunity of one of its members in any case where, in its opinion, the immunity would impede the course of justice, and where it can be waived without prejudice to the purpose for which the immunity is accorded.
Article 5
This Protocol shall be open to the signature of the Members of the Council of Europe who may become Parties to it either by:
(a) signature without reservation in respect of ratification or by
(b) signature with reservation in respect of ratification followed by ratification.
Instruments of ratification shall be deposited with the Secretary-General of the Council of Europe.
Article 6
1. This Protocol shall enter into force as soon as three members of the Council of Europe shall, in accordance with Article 5, have signed it without reservation in respect of ratification or shall have ratified it,
2. As regards any Member subsequently signing it without reservation in respect of ratification, or ratifying it, this Protocol shall enter into force at the date of signature or deposit of the instrument of ratification.
Article 7
The Secretary-General of the Council of Europe shall notify Members of the Council of the date of entry into force of the Protocol and shall give the names of any Members who have signed it without reservation in respect of ratification or who have ratified it.
In witness whereof the. undersigned, being duly authorised to that effect, have signed the present Protocol.
Done at Paris, this 15th day of December, 1956 in English and in French, both texts being equally authoritative, in a single copy which shall remain deposited in the archives of the Council of Europe. The Secretary-General shall send copies to each of the signatory Governments.
FOURTH PROTOCOL
TO THE GENERAL AGREEMENT ON PRIVILEGES AND IMMUNITIES OF THE COUNCIL OF EUROPE
PROVISIONS CONCERNING THE EUROPEAN COURT OF HUMAN RIGHTS
The Governments signatory hereto, being Members of the Council of Europe,
Considering that, under the terms of Article 59 of the Convention for the Protection of Human Rights and Fundamental Freedoms, signed at Rome on 4th November 1950 (hereinafter referred to as »the Convention«), the membes of the European Court of Human Rights (hereinafter referred to as »the Court«) are entitled, during the discharge of their functions, to the privileges and immunities provided for in Article 40 of the Statute of the Council of Europe and in the Agreements made thereunder;
Considering that it is necessary to specify and define the said privileges and immunities in a Protocol to the General Agreement on Privileges and Immunities of the Council of Europe, signed at Paris on 2nd September 1949;
Have agreed as follows:
Article 1
For the purposes of this Protocol, the term »judges« means judges elected in accordance with Article 39 of the Convention as well as any ad hoc judge appointed by a State party concerned in pursuance of Article 43 of the Convention.
Article 2
The judges shall, while exercising their functions and during journeys made in the exercise of their functions, enjoy the following privileges and immunities:
(a) immunity from personal arrest or detention and from seizure of their personal baggage, and, in respect of words spoken or written and all acts done by them-in their official capacity, immunity from legal process of every kind;
(b) exemption in respect of themselves and their spouses as regards any restrictions on their freedom of movement on exit from and return to their country of residence, and entry into and exit from the country in which they exercise their functions; and from aliens' registration in the country which they are visiting or through which they are passing in the exercise of their functions.
Article 3
In the course of journeys undertaken in the exercise of their functions, the judges shall, in the matter of customs and exchange control, be accorded:
(a) by their own Government the same facilities as those accorded to senior Government officials traveling abroad on temporary official duty;
(b) by the Governments of other Members, the same facilities as those accorded to heads of diplomatic missions.
Article 4
1. Documents and papers of the Court, judges and Registry, in so far as they relate to the business of the Court, shall be inviolable.
2. The official correspondence and other official communications of the Court, its members and the Registry may not be held up or subjected to censorship.
Article 5
In order to secure for the judges complete freedom of speech and complete independence in the discharge of their duties, the immunity from legal process in respect of words spoken or written and all acts done by them in discharging their duties shall continue to be accorded, notwithstanding that the persons concerned are no longer engaged in the discharge of such duties.
Article 6
Privileges and immunities are accorded to judges not for the personal benefit of the individuals themselves but in order to safeguard the independent exercise of their functions. The Court alone, sitting in plenary session, shall be competent to waive the immunity of judges; it has not only the right, but is under a duty, to waive the immunity of a judge in any case where, in its opinion, the immunity would impede the course of justice, and where it can be waived without prejudice to the purpose for which the immunity in accorded:
Article 7
1. The provisions of Articles 2 to 5 of this Protocol shall apply to the Registrar of the Court and to the Deputy Registrar when he is acting as the Registrar, without prejudice to any privileges and imunities to which they may be entitled under Article 18 od the General Agreement on Privileges and Immunities of the Council of Europe.
2. Te provisions of Article 18 of the General Agreement on Privileges and Immunities of the Council of Europe shall apply to the Deputy Registrar of the Court in respect of his services as such when he is not acting as Registrar.
3. The privileges and immunities referred to in paragraphs 1 and 2 of this Article are accorded to the Registrar and Deputy Registrar, not for the personal benefit of the individuals themselves but to facilitate the discharge of their duties. The Court alone, sitting in plenary session, shall be competent to waive the immunity of its Registrar and Deputy Registrar; it has not only the right, but is under a duty, to waive such immunity in any case where, in its opinion, the immunity would impede the course of justice, and where it can be waived without prejudice to the purpose for which the immunity is accorded.
Article 8
1. Any State may, at the time of its signature without reservation in respect of ratification, of its ratification or at any time thereafter, declare, by notification addressed to the Secretary-General of the Council of Europe, that the present Protocol shall extend to all or any of the territories for whose international relations it is responsible and where, according to Article 63 of the Convention for the Protection of Human Rights and Fundamental Freedoms, the said Convention applies.
2. The Protocol shall extend to the territory or territories named in the notification as from the thirtieth day after the receipt of this notification by the Secretary-General of the Council of Europe.
Article 9
This Protocol shall be open to the signature of the Members of the Council of Europe who may become parties to it either by:
(a) signature without reservation in respect of ratification, or by
(b) signature with reservation in respect of ratification followed by ratification.
Instruments of ratification shall be deposited with the Secreatary-General of the Council of Europe.
Article 10
1. This Protocol shall enter into force as soon as three Members of the Council of Europe shall, in accordance with Article 9, have signed it without reservation in respect of ratification or shall have ratified it.
2. As regards any Member subsequently signing it without reservation in respect of ratification, or ratifying it, this Protocol shall enter into force at the date of signature or deposit of the instrument of ratification.
Article 11
The Secretary-General of the Council of Europe shall notify Members of the Council of:
(a) the names of signatories and the deposit of any instrument of ratification;
(b) the date of entry into force of this Protocol.
In witness whereof the undersigned, being duly authorised to that effect, have signed the present Protocol.
Done at Paris, this 16th day of December, 1961, in English and in French, both texts being equally authoritative, in a single copy which shall remain deposited in the archives of the Council of Europe. The Secretary-General shall send certified copies to each of the signatory Governments.
FIFTH PROTOCOL
TO THE GENERAL AGREEMENT ON PRIVILEGES AND IMMUNITIES OF THE COUNCIL OF EUROPE
The member States of Council of Europe, signatories hereto,
Considering that, under the terms of Article 59 of the Convention for the Protection of Human Rights and Fundamental Freedoms (hereinafter referred to as »the Convention«), signed at Rome on 4 November 1950, the members of the European Commission of Human Rights (hereinafter referred to as »the Commission«) and of the European Court of Human Rights (hereinafter referred to as »the Court«) are entitled, during the discharge of their functions, to the privileges and immunities provided for in Article 40 of the Statute of the Council of Europe and in the Agreements made thereunder;
Recalling that the said privileges and immunities have been specified and defined in the Second and Fourth Protocols, signed at Paris on 15 December 1956 and 16 December 1961 respectively, to the General Agreement on Privileges and Immunities of the Council of Europe, signed at Paris on 2 September 1949;
Considering that it is necessary, in the light of changes in the operation of the Convention's control machinery, to supplement the above-mentioned General Agreement by another Protocol,
Have agreed as follows:
Article 1
1. Members of the Commission and members of the Court shall be exempt from taxation on salaries, emoluments and allowances paid to them by the Council of Europe.
2. The term »members of the Commission and members of the Court« includes members who, after having been replaced, continue to deal with cases which they already have under consideration as well as any ad hoc judge appointed in pursuance of the provisions of the Convention.
Article 2
1. This Protocol shall be open for signature by the member States of the Council of Europe, which may express their consent to be bound by:
a. signature without reservation as to ratification, acceptance or approval, or
b. signature subject to ratification, acceptance or approval, followed by ratification, acceptance or approval.
2. No member State of the Council of Europe shall sign without reservation as to ratification, ratify, accept or approve this Protocol unless it has already ratified, or simultaneously ratifies, the General Agreement on Privileges and Immunities of the Council of Europe.
3. Instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.
Article 3
1. This Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date on which three member States of the Council of Europe have expressed their consent to be bound by the Protocol in accordance with the provisions of Article 2.
2. In respect of any member State, which subsequently expresses its consent to be bound by it, the Protocol shall enter into force on the first day of the month following the expiration of a period of three months, after the date of signature or of the deposit of the instrument of ratification, acceptance or approval.
Article 4
Pending the entry into force of this Protocol in accordance with paragraphs 1 and 2 of Article 3, the Signatories agree to apply the Protocol provisionally from the date of signature, so far as it is possible to do so under their respective constitutional systems.
Article 5
The Secretary General of the Council of Europe shall notify the member Stares of Council of:
a. any signature;
b. the deposit of any instrument of ratification, acceptance or approval;
c. any date of entry into force of this Protocol in accordance with Article 3;
d. any other act, notification or communication relating to this Protocol.
In witness whereof the undersigned, being duly authorised thereto, have signed this Protocol.
Done at Strasbourg, this 18th day of June 1990, in English and French, both texts being equally authentic, in a single copy which shall be deposited in the archives of the Council of Europe. The Secretary General of the Council of Europe shall transmit certified copies to each member State of the Council of Europe.
PROTOKOL
K SPLOŠNEMU SPORAZUMU O PRIVILEGIJIH IN IMUNITETAH SVETA EVROPA
Vlade podpisnice Splošnega sporazuma o privilegijih in imunitetah Sveta Evrope, ki je bil podpisan 2. septembra 1949 v Parizu (v nadaljevanju sporazum),
so se v želji, da bi razširile določbe sporazuma,
dogovorile:
1. člen
Vsaka sedanja ali prihodnja članica Sveta Evrope, ki ni podpisnica sporazuma, lahko pristopi k slednjemu in k temu protokolu tako, da deponira svojo pristopno listino pri generalnem sekretarju Sveta Evrope, ki bo o tem obvestil članice Sveta.
2. člen
a) Določbe IV. dela sporazuma bodo veljale za predstavnike, ki bodo prisotni na srečanjih namestnikov ministrov.
b) Določbe IV. dela sporazuma bodo veljale za predstavnike, ki niso predstavniki v Posvetovalni skupščini, ki bodo sodelovali na srečanjih, ki jih bo sklical Svet Evrope in bodo potekala takrat, ko ne bo zasedal niti Odbor ministrov niti njihovih namestnikov, pri čemer pa predstavniki, ki sodelujejo na teh srečanjih, ne bodo oproščeni aretacije in pregona, kadar jih odkrijejo pri storitvi kaznivega dejanja, poskusu storitve kaznivega dejanja ah da so storili kaznivo dejanje.
3. člen
Določbe 15. člena sporazuma bodo veljale za predstavnike v skupščini in njihove namestnike, kadar koli bodo prisotni na sestankih odborov in pododborov Posvetovalne skupščine, in na poti v kraj ali iz kraja sestanka, ne glede na to, ali skupščina sama v tem času zaseda ali ne.
4. člen
Stalni predstavniki članic Sveta Evrope bodo med opravljanjem svojih funkcij in med potjo v kraj ali iz kraja sestankov uživali privilegije, imunitete in ugodnosti, ki jih običajno uživajo diplomatski poslaniki primerljivega ranga.
5. člen
Privilegiji, imunitete in ugodnosti so predstavnikom članic podeljeni z namenom, da se zagotovi neodvisno opravljanje njihovih funkcij v povezavi s Svetom Evrope, in ne zaradi osebnih koristi omenjenih posameznikov. Zato članica nima samo pravice, ampak tudi dolžnost, da svojemu predstavniku odvzame imuniteto v vsakem primeru; kadar bi po mnenju članice imuniteta ovirala uresničevanje pravice, in jo je moč odvzeti brez škode za namen, zaradi katerega je bila podeljena.
6. člen
Določbe 4. člena ne veljajo v zvezi z organi države, katere državljan je oseba, ali članice, katere predstavnik je oziroma je bil.
7. člen
a) Ta protokol bo odprt za, podpis vsem članicam, ki so podpisale sporazum. Protokol bo ratificiran hkrati s sporazumom ali kasneje. Ratifikacijske listine bodo deponirane pri generalnem sekretarju Sveta Evrope.
b) Ta protokol začne veljati z dnem, ko ga ratificirajo vse podpisnice, ki so. na ta dan ratificirale sporazum, vendar pod pogojem, da podpisnic, ki so ratificirale sporazum in protokol, ni manj kot sedem.
c) Za vsako podpisnico, ki bo protokol ratificirala kasneje, začne ta veljati z dnem deponiranja njene ratifikacijske listine.
d) Za članice, ki so pristopile k sporazumu in k protokolu v skladu s 1. členom, bosta sporazum in protokol pričela veljati:
(i) z datumom, kot je navedeno v odstavku (b) v primerih, ko je bila pristopna listina deponirana pred tem datumom, ali
(ii) z datumom deponiranja pristopne listine v primerih, ko je ta dokument deponiran kasneje po datumu, navedenem v odstavku (b).
V dokaz česar so spodaj podpisani pooblaščenci podpisali ta protokol.
Sestavljeno v Strasbourgu dne 6. novembra 1952 v angleščini in francoščini; besedili sta enako verodostojni, v enem samem izvodu, ki bo deponiran v arhivu Sveta Evrope. Generalni sekretar bo poslal overjene kopije vsem vladam podpisnicam in pristopnicam.
DRUGI PROTOKOL
K SPLOŠNEMU SPORAZUMU O PRIVILEGIJIH IN IMUNITETAH SVETA EVROPE
DOLOČBE O ČLANIH EVROPSKE KOMISIJE ZA ČLOVEKOVE PRAVICE
Vlade podpisnice tega protokola, članice Sveta Evrope,
so glede na določbe 59. člena Konvencije o varstvu človekovih pravic in temeljnih svoboščin, ki je bila podpisana 4. novembra 1950 v Rimu in ki članom Evropske komisije za človekove pravice (v nadaljevanju Komisija) med opravljanjem njihovih funkcij podeljuje privilegije in imunitete iz 40. člena Statuta Sveta Evrope in iz sporazumov Sveta Evrope;
glede na to, da je treba podrobno navesti in določiti omenjene privilegije in imunitete v Protokolu k Splošnemu sporazumu o privilegijih in imunitetah Sveta Evrope, ki je bil podpisan 2. septembra 1949 v Parizu,
sklenile:
1. člen
Člani Komisije bodo med opravljanjem svojih funkcij in med potjo v kraj in iz kraja sestanka uživali naslednje privilegije in imunitete:
(a) imuniteto pred osebno aretacijo ali priporom in pred zasegom svoje osebne prtljage ter imuniteto pred kakršnim koli sodnim postopkom v zvezi z ustnimi ali pisnimi izjavami, ki bi jih dali ob izvajanju svojih uradnih pooblastil;
(b) nedotakljivost vseh listin in dokumentov;
(c) oprostitev zase in za svoje zakonce iz imigracijske omejitve ali pri registriranju tujcev v državah, kamor potujejo ali skozi katere potujejo, med opravljanjem svojih funkcij.
2. člen
1. Prosto gibanje članov Komisije v kraj in iz kraja sestanka Komisije ne sme biti administrativno ali kako drugače omejevano.
2. Člani Komisije uživajo pri carinskem in deviznem nadzoru
(a) s strani svojih vlad enake ugodnosti, kot so predvidene za višje funkcionarje, ki potujejo v tujino zaradi začasnih uradnih dolžnosti;
(b). od vlad drugih članic enake ugodnosti, kot so podeljene predstavnikom tujih vlad na začasnih uradnih dolžnostih.
3. člen
Da bi članom Komisije zagotovili popolno svobodo govora in popolno neodvisnost pri opravljanju njihovih funkcij, jim bo podeljena imuniteta pred sodnim procesom zaradi izgovorjenih ali napisanih besed ter vseh dejanj, ki so jih storili pri opravljanju svojih funkcij, in to tudi potem, ko ne bodo več opravljali takih dolžnosti.
4. člen
Privilegiji in imunitete so članom Komisije podeljeni z namenom, da bi se zagotovila neodvisnost opravljanja njihovih funkcij in ne zaradi osebnih koristi posameznikov. Komisija je pristojna, da odvzame imuniteto svojim članom; ne le njena pravica, ampak tudi dolžnost je, da odvzame imuniteto enemu izmed svojih članov v vsakem primeru, ko bi po njenem mnenju le-ta ovirala uresničevanje pravice, in ko jo je mogoče odvzeti brez škode glede na namen, zaradi katerega je bila podeljena.
5. člen
Ta protokol bo odprt za podpis članicam Sveta Evrope, ki lahko postanejo pogodbenice bodisi:
(a) s podpisom brez pridržka glede ratifikacije ali
(b) s podpisom s pridržkom glede ratifikacije, ki mu bo sledila ratifikacija.
Ratifikacijsko listino bodo deponirale pri generalnem sekretarju Sveta Evrope.
6. člen
1. Ta protokol bo pričel veljati takoj, ko ga bodo v skladu s 5. členom tri članice Sveta Evrope podpisale brez pridržka glede ratifikacije ali pa ga bodo ratificirale.
2. Za katero koli članico, ki bo kasneje podpisala protokol brez pridržka glede ratifikacije ali pa ga bo ratificirala, bo pričel veljati z dnem podpisa ali deponiranja ratifikacijske listine.
7. člen
Generalni sekretar Sveta Evrope bo obvestil članice Sveta Evrope o datumu pričetka veljavnosti tega protokola in sporočil imena vseh članic, ki so ga podpisale brez pridržka glede ratifikacije ali pa so ga ratificirale.
V dokaz česar so spodaj podpisani pooblaščenci podpisali ta protokol.
Sestavljeno v Parizu 15. decembra 1956 v angleščini in francoščini, besedili sta enako verodostojni, v enem samem izvodu, ki bo deponiran v arhivu Sveta Evrope. Generalni sekretar bo poslal kopije vsaki od vlad podpisnic.
ČETRTI PROTOKOL
K SPLOŠNEMU SPORAZUMU O PRIVILEGIJIH IN IMUNITETAH SVETA EVROPE
DOLOČBE, KI SE NANAŠAJO NA EVROPSKO SODIŠČE ZA ČLOVEKOVE PRAVICE
Vlade podpisnice tega protokola, članice Sveta Evrope, so se
glede na to, da so članice Evropskega sodišča za človekove pravice po 59. členu Konvencije o varstvu človekovih pravic in temeljnih svoboščin, ki je bila podpisana v Rimu 4. novembra 1950 (v nadaljevanju konvencija), pri opravljanju svojih funkcij upravičene do privilegijev in imunitet, ki jih določajo 40. člen Statuta Sveta Evrope in na njegovi podlagi sprejeti sporazumi;
in glede na to, da je treba podrobno opisati in določiti omenjene privilegije in imunitete v Protokolu k Splošnemu sporazumu o privilegijih in imunitetah Sveta Evrope, ki je bil podpisan v Parizu 2. septembra 1949;
sporazumele:
1. člen
V tem protokolu izraz »sodniki« pomeni sodnike, ki so izvoljeni v skladu z 39. členom konvencije, kot tudi vse ad hoc sodnike, ki jih imenuje država udeleženka po 43. členu konvencije.
2. člen
Sodniki bodo med opravljanjem svojih funkcij in med potovanji pri opravljanju svojih funkcij uživali naslednje privilegije in imunitete:
(a) imuniteto pred osebno aretacijo ali priporom in pred zasegom svoje osebne prtljage ter imuniteto pred kakršnimi koli vrstami sodnih postopkov zaradi izgovorjenih ali napisanih besed ter dejanj, ki so jih storili pri opravljanju svojih funkcij;
(b) oprostitev vseh omejitev zanje in za svoje soproge glede svobode gibanja pri izhodu iz države, kjer živijo, in pri vrnitvi vanjo ter pri vstopu v državo, v kateri opravljajo svoje funkcije, in pri izstopu iz te države; oprostitev obveznega registriranja tujcev v državi, ki jo obiskujejo ali skozi katero potujejo med opravljanjem svojih funkcij.
3. člen
Med potovanji, na katera se odpravijo zaradi opravljanja svojih funkcij, bodo sodniki pri carinski in devizni kontroli uživali:
(a) s strani svoje vlade enake ugodnosti, kot so jih deležni višji vladni funkcionarji, ko potujejo v tujino zaradi začasne uradne dolžnosti,
(b) s strani vlad drugih članic enake ugodnosti, kot so jih deležni vodje diplomatskih misij.
4. člen
1. Dokumenti in listine Sodišča, sodniki in register so nedotakljivi, če se nanašajo na delo Sodišča.
2. Uradna korespondenca in druga uradna sporočila Sodišča in njegovih članov ter registri se ne smejo zadrževati ali cenzurirati.
5. člen
Da bi sodnikom zagotovili popolno svobodo govora in popolno neodvisnost pri opravljanju njihovih dolžnosti, jim bo imuniteta pred sodnim postopkom zaradi izgovorjenih in napisanih besed ter dejanj, ki so jih storili med opravljanjem svojih dolžnosti, dodeljena tudi potem, ko ne bodo več opravljali teh dolžnosti.
6. člen
Privilegiji in imunitete so sodnikom podeljeni, da bi zagotovili neodvisno opravljanje njihovih funkcij in ne zaradi njihovih osebnih koristi. Sodišče bo imelo pravico, da med plenarnim zasedanjem odvzame imuniteto sodnikom; to ni le njegova pravica, ampak je njegova dolžnost v vsakem primeru, ko bi po njegovem mnenju imuniteta lahko ovirala uresničevanje načela zakonitosti, in kadar jo je mogoče odvzeti brez škode za namen, zaradi katerega je bila podeljena.
7. člen
1. Določbe 2. in 5. člena tega protokola bodo veljale za registratorja Sodišča in za namestnika registratorja, kadar deluje v njegovi funkciji, brez škode za vse privilegije in imunitete, do katerih sta upravičena po 18. členu Splošnega sporazuma o privilegijih in imunitetah Sveta Evrope.
2. Določbe 18. člena Splošnega sporazuma o privilegijih in imunitetah Sveta Evrope veljajo za namestnika registratorja Sodišča za njegovo delo, kadar ne nastopa kot registrator.
3. Privilegiji in imunitete, na katere se nanašata 1. in 2. odstavek tega člena, so podeljeni registratorju in njegovemu namestniku zaradi lažjega izpolnjevanja njunih dolžnosti in ne zaradi njunih osebnih koristi. Samo Sodišče ima pravico, da med plenarnim zasedanjem odvzame imuniteto svojemu registratorju in njegovemu namestniku; to ni le njegova pravica, ampak tudi dolžnost, da odvzame tako imuniteto v vsakem primeru, ko bi po njegovem mnenju ta imuniteta ovirala uresničevanje načela zakonitosti, in kadar jo je moč odvzeti brez škode glede na namen, zaradi katerega je bila podeljena.
8. člen
1. Vsaka država lahko ob podpisu brez pridržka glede ratifikacije, ob ratifikaciji ali kadar koli kasneje z obvestilom, naslovljenim na generalnega sekretarja Sveta Evrope, izjavi, da bo veljavnost tega protokola razširila na vsa ali na nekatera ozemlja, za katerih mednarodne povezave je odgovorna in kjer se v skladu s 63. členom Konvencije o varstvu človekovih pravic in temeljnih svoboščin omenjena konvencija uporablja.
2. Veljavnost protokola se bo razširila na ozemlje ah ozemlja, ki bodo imenovana v obvestilu, trideset dni po tem, ko bo generalni sekretar Sveta Evrope prejel to obvestilo.
9. člen
Ta protokol bo odprl za podpis za članice Sveta Evrope, ki lahko postanejo članice:
(a) s podpisom brez pridržka ratifikacije ali
(b) s podpisom s pridržkom ratifikacije, ki mu sledi ratifikacija.
Ratifikacijske listine bodo deponirane pri generalnem sekretarju Sveta Evrope.
10. člen
1. Ta protokol bo pričel veljati takoj, ko ga bodo tri članice Sveta Evrope v skladu z 9. členom podpisale brez pridržka glede ratifikacije ali ga bodo ratificirale.
2. Za članice, ki bodo protokol podpisale kasneje brez pridržka ratifikacije ali ga bodo ratificirale, bo pričel veljati z dnem podpisa ali z dnem deponiranja ratifikacijske listine.
11. člen
Generalni sekretar Sveta Evrope bo obvestil članice Sveta o:
(a) imenih vseh podpisnic in depozitu vsake ratifikacijske listine;
(b) datumu, s katerim bo ta protokol pričel veljati.
V dokaz dogovorjenega so podpisani s polnim pooblastilom v ta namen podpisali ta protokol.
Sestavljeno v Parizu 16. decembra 1961, v angleščini in francoščini; besedili sta enako verodostojni in bosta v enem izvodu deponirani v arhivu Sveta Evrope. Generalni sekretar bo poslal overjene kopije vsem vladam podpisnicam.
PETI PROTOKOL
K SPLOŠNEMU SPORAZUMU O PRIVILEGIJIH IN IMUNITETAH SVETA EVROPE
Države članice Sveta Evrope, podpisnice tega protokola, so
glede na določbe 59. člena Konvencije o varstvu človekovih pravic in temeljnih svoboščin (v nadaljevanju konvencije), ki je bila podpisana v Rimu 4. novembra 1950 in ki članom Evropske komisije za človekove pravice (v nadaljevanju Komisije) in Evropskega sodišča za človekove pravice (v nadaljevanju Sodišča) med opravljanjem njihovih funkcij podeljuje privilegije in imunitete iz 40. člena Statuta Sveta Evrope in iz sporazumov, sklenjenih po tem Statutu;
sklicujoč se na to, da so bili omenjeni privilegiji in imunitete določeni in opredeljeni v Drugem in Četrtem protokolu, ki sta bila podpisana v Parizu 15. decembra 1956 oziroma 16. decembra 1961, dodatno k Splošnemu sporazumu o privilegijih in imunitetah Sveta Evrope, podpisanemu v Parizu, 2. septembra 1949;
glede na to, da je zaradi sprememb pri delovanju kontrolnega mehanizma konvencije treba dopolniti zgoraj omenjeni splošni sporazum s še enim protokolom,
sklenile:
1. člen
1. Člani Komisije in člani Sodišča so oproščeni davkov na plače, honorarje in dnevnice, ki jim jih plača Svet Evrope.
2. Izraz »člani Komisije in člani Sodišča« vključuje člane, ki so po tem, ko so jih zamenjali, še naprej obravnavali primere, s katerimi so se že prej ukvarjali, kakor tudi katerega koli ad hoc sodnika, imenovanega v skladu z določili konvencije.
2. člen
1. Ta protokol je odprt za podpis držav članic Sveta Evrope, ki lahko izrazijo svoje privoljenje, da jih obvezuje:
a) podpis brez pridržka glede ratifikacije, sprejema ali odobritve ali
b) podpis s pridržkom glede ratifikacije, sprejema ali odobritve, ki mu sledijo ratifikacija, sprejem ali odobritev.
2. Nobena država članica Sveta Evrope ne more podpisati tega protokola brez pridržka glede ratifikacije niti ga ratificirati, sprejeti ali odobriti, če ni že ratificirala Splošnega sporazuma o privilegijih in imunitetah Sveta Evrope ali če ga hkrati ne ratificira.
3. Listina o ratifikaciji, sprejemu ali odobritvi se deponira pri generalnem sekretarju Sveta Evrope.
3. člen
1. Ta protokol prične veljati prvega dne v mesecu, ki sledi trimesečnemu obdobju po datumu, ko so tri države članice Sveta Evrope dale svoje privoljenje, da je protokol zanje obvezujoč v skladu z določili 2. člena.
2. Za državo članico, ki kasneje izrazi svoje privoljenje, da je protokol zanjo obvezujoč, prične ta veljati prvega dne v mesecu, ki sledi izteku trimesečnega obdobja po datumu podpisa ali deponiranja listine o ratifikaciji, sprejemu ali odobritvi.
4. člen
Dokler ne prične ta protokol veljati v skladu s 1. in 2. odstavkom 3. člena, se podpisnice strinjajo, da pričnejo začasno uporabljati protokol z datumom podpisa, če je to mogoče v skladu z njihovimi ustavnimi predpisi.
5. člen Generalni sekretar Sveta Evrope obvesti države članice Sveta o:
a) vsakem podpisu;
b) deponiranju vsake listine o ratifikaciji, sprejemu ah odobritvi;
c) vsakem datumu pričetka veljavnosti tega protokola v skladu s 3. členom;
d) vsakem drugem dejanju, obvestilu ali sporočilu v zvezi s tem protokolom.
V dokaz dogovorjenega so podpisani s polnim pooblastilom v ta namen podpisali ta protokol.
Sestavljeno v Strasbourgu 18. junija 1990 v angleščini in francoščini; besedili sta enako verodostojni in bosta v enem izvodu deponirani v arhivu Sveta Evrope. Generalni sekretar bo poslal overjeno kopijo vsaki državi članici Sveta Evrope.
3. člen
Za izvajanje protokolov skrbijo ministrstvo, pristojno za zunanje zadeve, ministrstvo, pristojno za pravosodje, in ministrstvo, pristojno za finance.
4. člen
Ta zakon začne veljati petnajsti dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
