Razglašam Zakon o ratifikaciji Sporazuma o razvojnem sodelovanju med Vlado Republike Slovenije in Vlado Republike Zelenortski otoki (BCVRS), ki ga je sprejel Državni zbor Republike Slovenije na seji 30. marca 2011.

O RATIFIKACIJI SPORAZUMA O RAZVOJNEM SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE ZELENORTSKI OTOKI (BCVRS)
1. člen
Ratificira se Sporazum o razvojnem sodelovanju med Vlado Republike Slovenije in Vlado Republike Zelenortski otoki, podpisan v New Yorku 22. septembra 2010.
2. člen
Sporazum se v izvirniku v angleškem jeziku in prevodu v slovenskem jeziku glasi:
A G R E E M E N T
ON DEVELOPMENT COOPERATION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE REPUBLIC OF CAPE VERDE
The Government of the Republic of Slovenia and the Government of the Republic of Cape Verde (hereinafter referred to as “the Parties”),
Taking into consideration the guidelines of the OECD Development Assistance Committee (DAC), the cooperation of the European Union and the Republic of Cape Verde and the implementation of the Special Partnership between the European Union and the Republic of Cape Verde, and reaffirming the efforts of the international community in the country,
In the desire that the Republic of Slovenia contribute to the economic and social development of the Republic of Cape Verde and its attainment of development goals, with the assistance of international organisations, financial institutions and other donors,
Aiming to establish a legal basis for cooperation between the Republic of Slovenia and the Republic of Cape Verde based on partnership and transparency of development cooperation, with the objective of contributing to the economic development of the Republic of Cape Verde,
Have agreed as follows:
Article 1
Objectives
1. The target areas of development cooperation shall be as follows:
(a) Enhancing good governance, the rule of law and social services;
(b) Fostering sustainable economic development;
(c) Environmental protection;
(d) Health;
(e) Support for education and the granting of scholarships;
(f) Empowerment of women;
(g) Promotion of cooperation of local self-governments;
(h) Promotion of cooperation between non-governmental organisations.
2. Specific forms of development cooperation under this Agreement shall be in compliance with the long-term programme of international development cooperation of the Republic of Slovenia and shall be agreed upon by Memoranda of Cooperation concluded between the project and programme holders or providers and the beneficiaries in the Republic of Cape Verde.
Article 2
Funds
1. Within the framework of development cooperation, the Republic of Slovenia shall provide to the Republic of Cape Verde development assistance to be determined by the value of planned programmes and projects agreed upon in the Memoranda of Cooperation referred to in Article 1, paragraph 2 hereof.
2. The implementation of a specific programme or project shall be proposed either by the Joint Committee referred to in Article 6 hereof or by individual holders and providers of specific development cooperation activities/projects.
3. All equipment, services, materials and other resources financed by the Republic of Slovenia within the scope of the programmes and projects under this Agreement on development cooperation shall be exempt from taxes, duties and other compulsory charges applied in the Republic of Cape Verde or subject to reimbursement according to the legislation applicable in the Republic of Cape Verde.
4. All employment contracts, professional services, equipment and supplies provided under the cooperation programme shall be exempt from all national and municipal taxes and duties applied in the Republic of Cape Verde, including Value Added Tax (VAT). The legislation on public contracts applicable in the Republic of Cape Verde does not apply to the above acquisitions and contracts.
5. The customs procedure under the special law (lex specialis) for cooperative agents shall be applied to persons appointed by the Government of the Republic of Slovenia involved in the implementation of projects, as well as to their family members.
6. Foreign personnel appointed by the Government of the Republic of Slovenia, and their family members shall be exempt from direct taxes and similar charges applied in the Republic of Cape Verde.
7. Foreign personnel appointed by the Government of the Republic of Slovenia and their family members shall be granted, without cost or delay, entry visas, exit visas, residence permits, work permits and other related documents required by the Government of the Republic of Cape Verde.
Article 3
Assessment and monitoring
In the assessment and monitoring of development programmes and projects, the Parties shall comply with the criteria and procedures applicable in the European Union.
Article 4
Compatibility with European Union policies
1. In the implementation of this Agreement, the Republic of Slovenia shall respect its obligations arising from the acquis communautaire.
2. Projects and activities financed under the development assistance programme shall comply with European Union policies, including those concerning environmental protection, gender equality, transport, Trans-European Networks (TENs), competition, and public procurement.
Article 5
Coherence with other donors
1. The Parties agree that other countries and/or international organisations both from the UN development system and others, as well as other institutions of regional cooperation may participate in the financial support for the implementation of projects and activities under this Agreement.
2. The financial support from other partners shall not exceed 90 per cent of total project value.
Article 6
Joint Committee
1. A Joint Committee shall be established, tasked primarily with proposing priorities, programmes and projects of international development cooperation, taking into account the assessment of development cooperation programmes and projects that have already been concluded. The Joint Committee shall be composed of two members from each Party.
2. The members of the Joint Committee shall be appointed by the Minister of Foreign Affairs of the Republic of Slovenia and the Minister of Foreign Affairs of the Republic of Cape Verde, respectively.
3. The authorities competent for the coordination of activities and monitoring the implementation of development cooperation programmes and projects shall be the Ministry of Foreign Affairs of the Republic of Slovenia and the Ministry of Foreign Affairs, Cooperation and Communities of the Republic of Cape Verde.
Article 7
Impediments and force majeure
In case of impediments to the implementation of this Agreement due to force majeure recognised by the Parties (such as war, civil unrest or natural disasters), the Parties may agree on temporary suspension of programmes and projects which are being implemented.
Article 8
Settlement of disputes
Any disputes arising from the implementation of this Agreement shall be resolved through diplomatic channels.
Article 9
Amendments
The Parties may amend this Agreement. Any amendment shall take effect according to the procedure set forth in Article 10, paragraph 1.
Article 10
Entry into force
1. This Agreement shall enter into force on the date of receipt of the last of the two notifications by which the Parties inform each other that their respective internal procedures required for its entry into force have been completed.
2. This Agreement shall be concluded for an indefinite period of time, unless either Party terminates it by written notification through diplomatic channels. The Agreement shall cease to apply six months following the receipt of such notification through diplomatic channels.

S P O R A Z U M
O RAZVOJNEM SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE ZELENORTSKI OTOKI
Vlada Republike Slovenije in Vlada Republike Zelenortski otoki (v nadaljnjem besedilu: pogodbenici) sta se
ob upoštevanju smernic Odbora za razvojno pomoč Organizacije za gospodarsko sodelovanje in razvoj, sodelovanja med Evropsko unijo in Republiko Zelenortski otoki ter uresničevanja posebnega partnerstva med Evropsko unijo in Republiko Zelenortski otoki ter ob potrditvi prizadevanj mednarodne skupnosti v tej državi,
v želji, da bi Republika Slovenija prispevala h gospodarskemu in družbenemu razvoju Republike Zelenortski otoki in njenemu doseganju razvojnih ciljev, ob podpori mednarodnih organizacij, finančnih ustanov in drugih donatorjev,
z namenom, da Republika Slovenija in Republika Zelenortski otoki vzpostavita pravno podlago za sodelovanje, ki temelji na partnerstvu in preglednosti razvojnega sodelovanja ter prispeva h gospodarskemu razvoju Republike Zelenortski otoki,
dogovorili:
1. člen
Cilji
1. Ciljna področja razvojnega sodelovanja so:
(a) krepitev dobrega upravljanja, pravne države in družbenih dejavnosti,
(b) spodbujanje trajnostnega gospodarskega razvoja,
(c) varovanje okolja,
(d) zdravje,
(e) podpora izobraževanju in štipendiranje,
(f) krepitev vloge žensk,
(g) spodbujanje sodelovanja v lokalni samoupravi,
(h) spodbujanje sodelovanja nevladnih organizacij.
2. Konkretne oblike razvojnega sodelovanja po tem sporazumu se uskladijo z dolgoročnim programom mednarodnega razvojnega sodelovanja Republike Slovenije in določijo z memorandumi o sodelovanju, ki jih sklenejo nosilci ali izvajalci projektov in programov sodelovanja s prejemniki pomoči v Republiki Zelenortski otoki.
2. člen
Sredstva
1. V okviru razvojnega sodelovanja zagotavlja Republika Slovenija Republiki Zelenortski otoki razvojno pomoč, ki je določena z vrednostjo načrtovanih programov in projektov na podlagi memorandumov o sodelovanju iz drugega odstavka 1. člena tega sporazuma.
2. Pobudo za izvedbo konkretnega programa ali projekta da skupni odbor iz 6. člena tega sporazuma ali posamezni nosilec ali izvajalec konkretnih dejavnosti in projektov razvojnega sodelovanja.
3. Vsa oprema, storitve, materiali in druga sredstva, ki jih financira Republika Slovenija po programih in projektih iz tega sporazuma o razvojnem sodelovanju, so oproščeni davkov, carin in drugih obveznih dajatev, ki se uporabljajo v Republiki Zelenortski otoki, ali zanje velja možnost povračila skladno z veljavno zakonodajo v Republiki Zelenortski otoki.
4. Vse pogodbe o zaposlitvi, strokovne storitve, oprema in material v okviru programa sodelovanja so oproščeni vseh državnih in občinskih davkov in dajatev, ki se uporabljajo v Republiki Zelenortski otoki, skupaj z davkom na dodano vrednost. Za taka naročila in pogodbe se ne uporablja veljavna zakonodaja Republike Zelenortski otoki o javnih naročilih.
5. Za osebe, ki sodelujejo pri izvajanju projektov in jih izbere Vlada Republike Slovenije, ter njihove družinske člane se uporablja carinski postopek po posebnem zakonu (lex specialis).
6. Osebje, ki ga izbere Vlada Republike Slovenije, in njegovi družinski člani so oproščeni neposrednih davkov in podobnih dajatev, ki se uporabljajo v Republiki Zelenortski otoki.
7. Osebju, ki ga izbere Vlada Republike Slovenije, in njegovim družinskim članom se brezplačno in čim prej izdajo vstopni in izstopni vizumi, dovoljenja za prebivanje in delo ter drugi podobni dokumenti, ki jih zahteva Vlada Republike Zelenortski otoki.
3. člen
Ocenjevanje in spremljanje
Pogodbenici ocenjujeta in spremljata razvojne programe in projekte v skladu z merili in postopki Evropske unije.
4. člen
Skladnost s politikami Evropske unije
1. Pri izvajanju tega sporazuma Republika Slovenija spoštuje svoje obveznosti, ki izhajajo iz pravnega reda Evropske unije.
2. Projekti in dejavnosti, financirani po programu razvojne pomoči, so skladni s politikami Evropske unije, med drugim o varovanju okolja, enakosti med spoloma, prometu, vseevropskih omrežjih (TEN), konkurenci in javnih naročilih.
5. člen
Usklajenost z drugimi donatorji
1. Pogodbenici se strinjata, da lahko projekte in dejavnosti po tem sporazumu finančno podprejo tudi druge države ali mednarodne organizacije iz sistema OZN za razvoj in druge države ali mednarodne organizacije ter druge ustanove za regionalno sodelovanje.
2. Finančna podpora drugih partnerjev ne sme presegati 90 odstotkov celotne vrednosti projekta.
6. člen
Skupni odbor
1. Ustanovi se skupni odbor, ki predlaga prednostne naloge, programe in projekte mednarodnega razvojnega sodelovanja ob upoštevanju ocene že končanih programov in projektov razvojnega sodelovanja. Sestavljata ga po dva člana vsake pogodbenice.
2. Člane skupnega odbora imenujeta ministra za zunanje zadeve Republike Slovenije in Republike Zelenortski otoki.
3. Za usklajevanje dejavnosti in spremljanje izvajanja programov in projektov razvojnega sodelovanja sta pristojni Ministrstvo za zunanje zadeve Republike Slovenije ter Ministrstvo za zunanje zadeve, sodelovanje in skupnosti Republike Zelenortski otoki.
7. člen
Ovire in višja sila
Če se pri izvajanju tega sporazuma pojavijo ovire zaradi višje sile, ki jo priznavata obe pogodbenici, na primer vojna, družbeni nemiri ali naravne nesreče, se pogodbenici lahko sporazumeta o začasni ustavitvi programov in projektov, ki se izvajajo.
8. člen
Reševanje sporov
Spori v zvezi z izvajanjem tega sporazuma se rešujejo po diplomatski poti.
9. člen
Spremembe
Pogodbenici lahko ta sporazum spremenita. Spremembe začnejo veljati v skladu s postopkom iz prvega odstavka 10. člena.
10. člen
Začetek veljavnosti
1. Ta sporazum začne veljati na dan prejema zadnjega od uradnih obvestil, s katerima se pogodbenici obvestita, da so končani notranji postopki, potrebni za začetek njegove veljavnosti.
2. Sporazum se sklene za nedoločen čas, razen če ga katera od pogodbenic ne odpove s pisnim uradnim obvestilom po diplomatski poti. Sporazum preneha veljati šest mesecev po prejemu takega obvestila po diplomatski poti.
Sestavljeno v New Yorku dne 22. septembra 2010 v dveh izvirnikih v angleškem jeziku.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za zunanje zadeve.
4. člen
Ta zakon začne veljati petnajsti dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
