88. Uredba o ratifikaciji Sporazuma med Vlado Republike Slovenije in Vlado Republike Indonezije o znanstvenem in tehnološkem sodelovanju, stran 1687.

Na podlagi sedme alinee petega odstavka 75. člena Zakona o zunanjih zadevah (Uradni list RS, št. 113/03 – uradno prečiščeno besedilo in 20/06 – ZNOMCMO) izdaja Vlada Republike Slovenije
U R E D B O
O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE INDONEZIJE O ZNANSTVENEM IN TEHNOLOŠKEM SODELOVANJU
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Republike Indonezije o znanstvenem in tehnološkem sodelovanju, sestavljen v Ljubljani, 30. novembra 2006.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi(*):
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE INDONEZIJE O ZNANSTVENEM IN TEHNOLOŠKEM SODELOVANJU
Vlada Republike Slovenije in Vlada Republike Indonezije (v nadaljevanju: pogodbenici) sta se
V ŽELJI spodbujati nadaljnje tesne in prijateljske odnose med pogodbenicama,
OB ZAVEDANJU pomena znanosti in tehnologije za razvoj uspešnih narodnih gospodarstev,
OB PREPRIČANJU, da bo mednarodno sodelovanje v znanosti in tehnologiji okrepilo vezi prijateljstva in razumevanja med njunimi ljudmi ter pospešilo razvoj znanosti in tehnologije v korist obeh držav,
DA BI NADOMESTILI določbe o znanstvenem in tehnološkem sodelovanju po Sporazumu med Vlado Republike Slovenije in Vlado Republike Indonezije o gospodarskem, znanstvenem in tehnološkem sodelovanju, podpisanem v Džakarti 1. decembra 1997,
SKLADNO z veljavnimi zakoni in drugimi predpisi obeh držav
dogovorili:
1. člen
Cilji
1. Pogodbenici spodbujata sodelovanje na področju znanosti in tehnologije med državama po načelu enakopravnosti in vzajemne koristi.
2. Med seboj lahko sodelujejo organizacije, kot so: znanstveni inštituti, znanstvena združenja, univerze, vladne agencije ter druge raziskovalne in razvojne organizacije.
2. člen
Obseg sodelovanja
Po tem sporazumu se znanstveno in tehnološko sodelovanje spodbuja:
a. z izmenjavo znanstvenikov, strokovnjakov, raziskovalcev in izvedencev;
b. z izmenjavo znanstvenih in tehnoloških informacij in dokumentacije;
c. s skupnimi znanstvenimi konferencami, simpoziji, delavnicami in drugimi srečanji;
d. z drugimi oblikami znanstvenega in tehnološkega sodelovanja, o katerih se pogodbenici dogovorita.
3. člen
Stroški
Pogodbenici krijeta stroške za sodelovanje po tem sporazumu po načelu enakopravnosti in vzajemnosti ter glede na razpoložljivost sredstev.
4. člen
Pravice intelektualne lastnine
Pogodbenici zagotavljata ustrezno in učinkovito varstvo pravic intelektualne lastnine, pridobljenih na podlagi tega sporazuma, v skladu z zakoni in drugimi predpisi, veljavnimi v državi vsake pogodbenice, in v skladu z ustreznimi mednarodnimi sporazumi, katerih pogodbenici sta.
5. člen
Imenovanje ministrstev
Za izvajanje tega sporazuma pogodbenici imenujeta:
– za Vlado Republike Slovenije: Ministrstvo za visoko šolstvo, znanost in tehnologijo Republike Slovenije,
– za Vlado Republike Indonezije: Ministrstvo za raziskave in tehnologijo Republike Indonezije.
6. člen
Ustanovitev skupnega delovnega odbora
1. Za izvajanje tega sporazuma imenovani ministrstvi ustanovita Skupni delovni odbor za znanstveno in tehnološko sodelovanje (v nadaljevanju: skupni delovni odbor), sestavljen iz enakega števila predstavnikov in strokovnjakov, ki jih imenujeta pristojni ministrstvi.
2. Skupni delovni odbor:
a. pregleduje napredek pri sodelovanju po tem sporazumu;
b. opredeljuje področja in oblike sodelovanja;
c. pripravlja izhodišča za sodelovanje, vključno s finančnimi vprašanji;
d. pripravlja redna poročila o dejavnostih po tem sporazumu.
3. Skupni delovni odbor se sestaja redno vsaki dve leti ali na predlog katere koli pogodbenice izmenično v Republiki Sloveniji in Republiki Indoneziji.
7. člen
Spremembe
Ta sporazum se lahko spremeni ali dopolni na podlagi pisnega soglasja pogodbenic. Sprememba ali dopolnitev, o kateri se pogodbenici dogovorita, se opravi z izmenjavo diplomatskih not in je sestavni del tega sporazuma.
8. člen
Reševanje sporov
Vsi spori v zvezi z razlago ali uporabo tega sporazuma se rešujejo po mirni poti s posvetovanji ali pogajanji.
9. člen
Začetek veljavnosti, trajanje in odpoved
1. Sporazum začne veljati z dnem zadnjega uradnega obvestila o izmenjavi not, ki potrjujeta, da sta pogodbenici opravili vse notranjepravne postopke za začetek njegove veljavnosti.
2. Sporazum velja pet let in se samodejno podaljšuje za nadaljnja enoletna obdobja, razen če ena ali druga pogodbenica šest mesecev prej pisno z uradnim obvestilom ne sporoči, da ga namerava odpovedati.
3. Odpoved tega sporazuma ne vpliva na veljavnost ali trajanje katerega koli posebnega dogovora o projektih ali dejavnostih, sklenjenega po tem sporazumu, dokler se ti posebni projekti ali dejavnosti ne končajo.
V POTRDITEV TEGA sta podpisana, ki sta ju za to pravilno pooblastili njuni vladi, podpisala ta sporazum.
SESTAVLJENO v dveh izvodih v Ljubljani, tridesetega novembra dva tisoč šest v slovenskem, indonezijskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Pri različni razlagi sporazuma prevlada angleško besedilo.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE REPUBLIC OF INDONESIA ON SCIENTIFIC AND TECHNOLOGICAL COOPERATION
The Government of the Republic of Slovenia and the Government of the Republic of Indonesia (hereinafter referred to as the “Parties”)
DESIRING to promote further the close and friendly relations existing between the Parties;
RECOGNIZING the importance of science and technology in the development of prosperous national economies;
CONVINCED that international cooperation in science and technology will strengthen the bonds of friendship and understanding between their peoples and will advance the development of science and technology to the benefit of both countries;
SUPERSEDING the provision of scientific and technological cooperation under the Agreement between the Government of the Republic of Slovenia and the Government of the Republic of Indonesia on Economic, Scientific and Technological Cooperation, signed in Jakarta on 1 December 1997;
PURSUANT TO the prevailing laws and regulations in the respective countries;
have agreed as follows:
Article 1
Objectives
1. The Parties shall promote the cooperation in the fields of science and technology between the two countries on the basis of equality and mutual benefit.
2. Cooperating organizations may include scientific institutes, scientific societies, universities, government agencies and other research and development organizations.
Article 2
Scope of Cooperation
According to this Agreement, scientific and technological cooperation shall be promoted through:
a. Exchange of scientists, specialists, researchers and experts;
b. Exchange of scientific and technological information and documentation;
c. Joint scientific conferences, symposia, workshops and other meetings;
d. Other forms of scientific and technological cooperation, mutually agreed upon by the Parties.
Article 3
Expenses
The Parties shall bear the expenses incurred in connection with the cooperative activities under this Agreement on the basis of the principle of equality and reciprocity and in accordance with the availability of assets.
Article 4
Intellectual property rights
The Parties shall ensure appropriate and efficient protection of intellectual property rights obtained on the basis of this Agreement, in accordance with the laws and regulations in force in their respective countries and in accordance with the international agreements to which they are parties.
Article 5
Designated Ministries
For implementation of this Agreement, the Parties designate the following ministries:
– For the Government of the Republic of Slovenia: The Ministry of Higher Education, Science and Technology of the Republic of Slovenia,
– For the Government of the Republic of Indonesia: The State Ministry of Research and Technology of the Republic of Indonesia as the Coordinator.
Article 6
Establishment of the Joint Working Committee
1. For the purpose of the implementation of this Agreement the designated institutions shall establish a Joint Working Committee for Scientific and Technological Cooperation (hereinafter referred to as “the Joint Working Committee”) which shall consist of equal number of representatives and experts designated by each responsible institution.
2. The Joint Working Committee shall:
a. review the progress in cooperative activities under this Agreement;
b. identify fields and forms of cooperation,
c. elaborate platforms of cooperation, including the financial issues,
d. prepare periodic reports concerning the activities undertaken under this Agreement.
3. The Joint Working Committee shall meet periodically, every two years, or at the request of either Party, alternately in the Republic of Slovenia and in the Republic of Indonesia.
Article 7
Amendments
This Agreement may be amended or modified by mutual consent of the Parties in writing. The amendment or modification which has been agreed by the Parties shall be carried out through exchange of diplomatic notes and shall form an integral part of this Agreement.
Article 8
Settlement of Disputes
Any disputes related to the interpretation or implementation of this Agreement shall be settled amicably through consultations or negotiations.
Article 9
Entry into force, Duration and Termination
1. This Agreement shall enter into force on the date of last notification of exchange of notes confirming that the Parties have fulfilled all necessary legal requirements for entry into force of this Agreement.
2. This Agreement shall remain in force for a period of five years and shall be automatically extended for consecutive periods of one year, unless either Party notifies the other in writing six months in advance of its intention to terminate this Agreement.
3. The termination of this Agreement shall not affect the validity or the duration of any specific arrangement of projects or activities made under this Agreement until the completion of such specific arrangements of projects or activities.
IN WITNESS WHERE OF, the undersigned, being duly authorized thereto by their respective governments, have signed this Agreement.
DONE in duplicate in Ljubljana on the thirtieth day of November in the year two thousand and six in the Slovenian, Indonesian and English languages, all texts being equally authentic. In case of different interpretation of the Agreement, the English text shall prevail.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za visoko šolstvo, znanost in tehnologijo.
4. člen
Ta uredba začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
