O RAZGLASITVI ZAKONA O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE MAKEDONIJE O ZNANSTVENEM IN TEHNOLOšKEM SODELOVANJU
Razglašam Zakon o ratifikaciji Sporazuma med Vlado Republike Slovenije in Vlado Republike Makedonije o znanstvenem in tehnološkem sodelovanju, ki ga je sprejel Državni zbor Republike Slovenije na seji dne 24. julija 1995.

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE MAKEDONIJE O ZNANSTVENEM IN TEHNOLOŠKEM SODELOVANJU
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Republike Makedonije o znanstvenem in tehnološkem sodelovanju, podpisan 24. decembra 1993 v Skopju.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE MAKEDONIJE O ZNANSTVENEM IN TEHNOLOŠKEM SODELOVANJU
Vlada Republike Slovenije in Vlada Republike Makedonije (v nadaljnjem besedilu: pogodbenici) sta se
v želji da bi spodbujali in pospeševali sodelovanje na področju znanosti in tehnologije, ki temelji na Sporazumu o sodelovanju v kulturi, izobraževanju in znanosti med vladama Republike Slovenije in Republike Makedonije,
ker se zavedata tako prednosti, ki izhajajo iz povečanega znanstvenega in tehnološkega sodelovanja za naroda obeh držav, kakor tudi pomena le-tega za razvoj nacionalnih gospodarstev in dobro obeh držav, in
v prepričanju, da bo mednarodno sodelovanje v znanosti in tehnologiji okrepilo prijateljske vezi in razumevanje med državama,
dogovorili o naslednjem:
1. člen
Pogodbenici bosta razvijali in podpirali znanstveno in tehnološko sodelovanje med sodelujočimi organizacijami obeh držav na podlagi načel suverenosti, neodvisnosti, enakosti ter vzajemnosti in v obojestransko korist.
Sodelujejo lahko akademije znanosti, znanstveni inštituti, znanstvena združenja, univerze, vladne organizacije in druge raziskovalne in razvojne organizacije.
2. člen
Po tem sporazumu bo znanstveno in tehnološko sodelovanje potekalo v okviru:
a) znanstvenih in tehnoloških raziskav in razvoja na skupaj dogovorjenih področjih
b) izmenjav znanstvenikov, strokovnjakov, raziskovalcev, univerzitetnih učiteljev in tehničnega osebja
c) izmenjav znanstvenih in tehnoloških informacij in dokumentacije v zvezi z dejavnostjo sodelovanja
d) izmenjav ali souporabe opreme, instrumentov, pripomočkov ali materiala, ki so potrebni za izvajanje tega sporazuma
e) skupnih znanstvenih konferenc, simpozijev, delavnic in drugih srečanj
f) drugih oblik znanstvenega in tehnološkega sodelovanja, o katerih se pogodbenici medsebojno dogovorita.
Poleg navedenega bosta pogodbenici v največji možni meri spodbujali izmenjavo tehnologij med podjetji, vključno z dogovori o tehničnem sodelovanju.
3. člen
Pogodbenici bosta spodbujali in podpirali sodelovanje in udeležbo v multilateralnih in regionalnih znanstvenih, tehnoloških in razvojnih programih in projektih.
4. člen
Sodelovanje v okviru tega sporazuma poteka v skladu z veljavnimi zakoni in predpisi obeh držav, kot tudi v skladu s pravili mednarodnih organizacij, katerih članici sta pogodbenici.
5. člen
Dejavnosti sodelovanja v okviru tega sporazuma potekajo na osnovi dogovorov o izvajanju ali drugih dogovorov (v nadaljevanju: dogovori o izvajanju), ki jih sklenejo vladne organizacije obeh strani. Ti dogovori o izvajanju podrobneje opredeljujejo različne vidike sodelovanja (postopke, financiranje, udeležence, itd.).
6. člen
Obravnava intelektualne lastnine, ki izhaja iz aktivnosti sodelovanja po tem sporazumu, se ureja z dogovori o izvajanju med sodelujočimi organizacijami, v katerih bo zagotovljeno ustrezno in učinkovito varstvo intelektualne lastnine. Sodelujoče organizacije bodo postale solastnice intelektualne lastnine, ki bo izhajala iz sodelovanja po tem sporazumu.
Znanstvene in tehnološke informacije nelastninskega značaja, ki izhajajo iz aktivnosti sodelovanja po tem sporazumu, bodo last obeh strani in bodo tajne; če bo potrebno, bodo na razpolago tretji strani, če ne bo drugače pisno dogovorjeno med sodelujočimi organizacijami.
7. člen
Znanstvenike, strokovnjake in institucije tretjih držav ali mednarodnih organizacij se na podlagi soglasja obeh pogodb lahko na njihove stroške, če ni drugače dogovorjeno, povabi k sodelovanju pri dejavnostih po tem sporazumu.
8. člen
Določila tega sporazuma so lahko predmet sprememb ali dopolnil le s privolitvijo obeh pogodbenic.
9. člen
Za izvajanje tega sporazuma določi Vlada Republike Slovenije Ministrstvo za znanost in tehnologijo Republike Slovenije in Vlada Republike Makedonije Ministrstvo za znanost Republike Makedonije.
10. člen
Za izvajanje tega sporazuma pogodbenici ustanovita Skupni odbor štirih oseb, dve delujeta v imenu Republike Slovenije in dve delujeta v imenu Republike Makedonije.
Srečanja Skupnega odbora so po potrebi, najmanj enkrat letno.
11. člen
Ta sporazum prične veljati, ko pogodbenici izmenjata obvestili o izpolnitvi zahtev internega postopka za njegovo uveljavitev.
Ta sporazum velja pet let in ostane v veljavi nadaljnja obdobja petih let, če katera od pogodbenic šest mesecev pred iztekom pisno ne sporoči svoje namere po odpovedi sporazuma.
12. člen
Sporazum je sestavljen v dveh izvodih v slovenskem, makedonskem in angleškem jeziku, vsi izvodi so enako verodostojni. Ob razlikah v razlagi je odločilno angleško besedilo.
Sestavljeno in podpisano v Skopju dne 24. decembra 1993.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE REPUBLIC OF MACEDONIA FOR SCIENTIFIC AND TECHNOLOGICAL COOPERATION
The Government of the Republic of Slovenia and the Government of the Republic of Macedonia (hereinfter referred to as the Contracting Parties)
Desiring to encourage and promote cooperation in the areas of science and technology, based upon the Agreement of Cooperation in Culture, Education and Science between the Governments of the Republic of Slovenia and the Republic of Macedonia
Recognizing the advantages to be derived by the people of the two countries from the increased scientific and tehnocogical cooperation, as well as of its importance for the development of national economies and prosperity of both countries
Convinced that international cooperation in science and technology will strengthen the bonds of friendship and understanding between the two countries,
have agreed as follows:
Article 1
The Contracting Parties shall develop and support scientific and technological cooperation between cooperating organizations of the two countries on the basis of the principles of sovereignty, independence, equality and reciprocity, to the benefit of both countries.
Cooperating organizations may include academies of sciences, scientific institutes, scientific societies, universities, government agencies and other research and development organisations.
Article 2
According to this Agreement, scientific and technological cooperation shall be promoted through:
a) Scientific and technological research and development in areas jointly agreed upon
b) Exchange of scientists, specialists, researchers, university teachers and technicians
c) Exchange of science and technology information and documentation in the context of cooperative activities
d) Exchange or sharing of equipment, instruments, accessories of materials necessary for the implementation of this Agreement
e) Joint scientific conferences, symposia, workshops and other meetings
f) Other forms of scientific and tehnological cooperation which can mutually be agreed upon by the two Contracting Parties.
Besides, the Contracting Parties shall encourage to the maximum possible extent, exchange of techologies between enterprises, including technical collaboration arrangements.
Article 3
Contracting Parties shall encourage and support cooperation and participation in multilateral and regional scientific, technological and development programs and projects.
Article 4
Cooperation under this Agreement shall be subject to the applicable national laws and regulations of both countries, as well as to the regulations of the international organizations Contracting Parties are members of.
Article 5
Cooperative activities under this Agreement shall take place under implementing memoranda of understanding or other arrangements (hereinafter “implementing arrangements”) concluded between government agencies of the two sides. Such implementing arrangements shall define, in more detail, different aspects of cooperation (procedures, funding, subjects, etc.).
Article 6
The treatment of intellectual property arising from the cooperative activities under this Agreement shall be regulated by the implementing arrangements between the cooperative organizations in which an adequate and efficient intellectual-property protection shall be guaranteed. The cooperative organizations shall become joint owners of intellectual property resulting form cooperation under this Agreement.
Scientific and technological information of non-proprietary deriving from the activities under this Agreement shall be possessed by both sides and kept secret; if necessary such information shall be made available to a third party, unless otherwise agreed in writing by the cooperative organizations.
Article 7
Scientists, technical experts and institutions from other countries or international organizations may be invited, upon consent of both Contracting Parties, to participate at their own expense, unless otherwise agreed, in activities being carried out under this Agreement.
Article 8
The provisions of this Agreement may be modified or amended only upon the consent of both Contractinc Parties.
Article 9
For the purpose of implementing this Agreement the Government of the Republic of Slovenia designates the Ministry of Science and Technology of the Republic of Slovenia and the Government of The Republic of Macedonia designates the Ministry of Science of the Republic of Macedonia.
Article 10
For the purpose of the implementation of this Agreement the Contracting Parties shall set up a Joint Board of four persons, two of them acting on the behalf of the Republic of Slovenia and two of them acting on the behalf of the Republic of Macedonia.
Joint Board meetings shall be held on purpose, at least once a year.
Article 11
This Agreement shall enter into force upon an exchange of notes confirming that the Contracting Parties have completed their respective internal requirements necessary for the entry into force.
This Agreement shall remain in force for a period of five years and continue in force thereafter for successive periods of five years, unless either Contracting Party notifies in writing six months in advance of its intention to the denounce the Agreement.
Article 12
This Agreement is done in duplicate in Slovene, Macedonian and English languages. All copies are equally authentic. In case of different interpretation, the English text prevails.
Done and signed in Skopje on the 24 December, 1993.

3. člen
Za izvajanje sporazuma skrbi ministrstvo, pristojno za znanost in tehnologijo.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije - Mednarodne pogodbe.
