O RATIFIKACIJI PROTOKOLA O SPREMEMBI MEDNARODNE KONVENCIJE O POENOSTAVITVI IN USKLADITVI CARINSKIH POSTOPKOV (Z IZJEMO DODATKA III) (MPMKCP)

P R O T O C O L
OF AMENDMENT TO THE INTERNATIONAL CONVENTION ON THE SIMPLIFICATION AND HARMONIZATION OF CUSTOMS PROCEDURES
(done at Brussels on 26th June 1999)
The Contracting Parties to the International Convention on the simplification and harmonization of Customs procedures (done at Kyoto on 18th May 1973 and entered into force on 25th September 1974), hereinafter "the Convention", established under the auspices of the Customs Co-operation Council, hereinafter "the Council",
CONSIDERING that to achieve the aims of:
– eliminating divergence between the Customs procedures and practices of Contracting Parties that can hamper international trade and other international exchanges;
– meeting the needs of international trade and the Customs for facilitation, simplification and harmonization of Customs procedures and practices;
– ensuring appropriate standards of Customs control; and
– enabling the Customs to respond to major changes in business and administrative methods and techniques;
the Convention must be amended,
CONSIDERING also that the amended Convention:
– must provide that the core principles for such simplification and harmonization are made obligatory on Contracting Parties to the amended Convention;
– must provide the Customs with efficient procedures supported by appropriate and effective control methods; and
– will enable the achievement of a high degree of simplification and harmonisation of Customs procedures and practices which is an essential aim of the Council, and thus make a major contribution to facilitation of international trade,
Have agreed as follows:
ARTICLE 1
The Preamble and the Articles of the Convention are amended as set out in the text contained in Appendix I hereto.
ARTICLE 2
The Annexes of the Convention are replaced by the General Annex contained in Appendix II and by the Specific Annexes contained in Appendix III hereto.
ARTICLE 3
1. Any Contracting Party to the Convention may express its consent to be bound by this Protocol, including Appendices I and II, by:
(a) signing it without reservation of ratification;
(b) depositing an instrument of ratification after signing it subject to ratification; or
(c) acceding to it.
2. This Protocol shall be open until 30th June 2000 for signature at the Headquarters of the Council in Brussels by the Contracting Parties to the Convention. Thereafter, it shall be open for accession.
3. This Protocol, including Appendices I and II, shall enter into force three months after forty Contracting Parties have signed this Protocol without reservation of ratification or have deposited their instrument of ratification or accession.
4. After forty Contracting Parties have expressed their consent to be bound by this Protocol in accordance with paragraph 1, a Contracting Party to the Convention shall accept the amendments to the Convention only by becoming a party to this Protocol. For such a Contracting Party, this Protocol shall come into force three months after it signs this Protocol without reservation of ratification or deposits an instrument of ratification or accession.
ARTICLE 4
Any Contracting Party to the Convention may, when it expresses its consent to be bound by this Protocol, accept any of the Specific Annexes or Chapters therein contained in Appendix III hereto and shall notify the Secretary General of the Council of such acceptance and of the Recommended Practices in respect of which it enters reservations.
ARTICLE 5
After the entry into force of this Protocol, the Secretary General of the Council shall not accept any instrument of ratification or accession to the Convention.
ARTICLE 6
In relations between the Parties hereto, this Protocol with its Appendices shall supersede the Convention.
ARTICLE 7
The Secretary General of the Council shall be the depositary of this Protocol and shall perform the functions as provided for in Article 19 contained in Appendix I to this Protocol.
ARTICLE 8
This Protocol shall be open for signature by the Contracting Parties to the Convention at the Headquarters of the Council in Brussels from 26th June 1999.
ARTICLE 9
In accordance with Article 102 of the Charter of the United Nations, this Protocol and its Appendices shall be registered with the Secretariat of the United Nations at the request of the Secretary General of the Council.
In witness whereof the undersigned, being duly authorised thereto, have signed this Protocol.
Done at Brussels, this twenty-sixth day of June nineteen hundred and ninety-nine, in the English and French languages, both texts being equally authentic, in a single original which shall be deposited with the Secretary General of the Council who shall transmit certified copies to all the entities referred to in paragraph 1 of Article 8 contained in Appendix I to this Protocol.
APPENDIX I
INTERNATIONAL CONVENTION ON THE SIMPLIFICATION AND HARMONIZATION OF CUSTOMS PROCEDURES
(as amended)
PREAMBLE
The Contracting Parties to the present Convention established under the auspices of the Customs Co-operation Council,
ENDEAVOURING to eliminate divergence between the Customs procedures and practices of Contracting Parties that can hamper international trade and other international exchanges,
DESIRING to contribute effectively to the development of such trade and exchanges by simplifying and harmonizing Customs procedures and practices and by fostering international co-operation,
NOTING that the significant benefits of facilitation of international trade may be achieved without compromising appropriate standards of Customs control,
RECOGNISING that such simplification and harmonization can be accomplished by applying, in particular, the following principles:
– the implementation of programmes aimed at continuously modernizing Customs procedures and practices and thus enhancing efficiency and effectiveness,
– the application of Customs procedures and practices in a predictable, consistent and transparent manner,
– the provision to interested parties of all the necessary information regarding Customs laws, regulations, administrative guidelines, procedures and practices,
– the adoption of modern techniques such as risk management and audit-based controls, and the maximum practicable use of information technology,
– co-operation wherever appropriate with other national authorities, other Customs administrations and the trading communities,
– the implementation of relevant international standards,
– the provision to affected parties of easily accessible processes of administrative and judicial review,
CONVINCED that an international instrument incorporating the above objectives and principles that Contracting Parties undertake to apply would lead to the high degree of simplification and harmonization of Customs procedures and practices which is an essential aim of the Customs Co-operation Council, and so make a major contribution to facilitation of international trade,
Have agreed as follows:
CHAPTER I
Definitions
Article 1
For the purposes of this Convention:
(a) "Standard" means a provision the implementation of which is recognized as necessary for the achievement of harmonization and simplification of Customs procedures and practices;
(b) "Transitional Standard" means a Standard in the General Annex for which a longer period for implementation is permitted;
(c) "Recommended Practice" means a provision in a Specific Annex which is recognized as constituting progress towards the harmonization and the simplification of Customs procedures and practices, the widest possible application of which is considered to be desirable;
(d) "National legislation" means laws, regulations and other measures imposed by a competent authority of a Contracting Party and applicable throughout the territory of the Contracting Party concerned, or treaties in force by which that Party is bound;
(e) "General Annex" means the set of provisions applicable to all the Customs procedures and practices referred to in this Convention;
(f) "Specific Annex" means a set of provisions applicable to one or more Customs procedures and practices referred to in this Convention;
(g) "Guidelines" means a set of explanations of the provisions of the General Annex, Specific Annexes and Chapters therein which indicate some of the possible courses of action to be followed in applying the Standards, Transitional Standards and Recommended Practices, and in particular describing best practices and recommending examples of greater facilities;
(h) "Permanent Technical Committee" means the Permanent Technical Committee of the Council;
(ij) "Council" means the Organisation set up by the Convention establishing a Customs Co-operation Council, done at Brussels on 15 December 1950;
(k) "Customs or Economic Union" means a Union constituted by, and composed of, States which has competence to adopt its own regulations that are binding on those States in respect of matters governed by this Convention, and has competence to decide, in accordance with its internal procedures, to sign, ratify or accede to this Convention.
CHAPTER II
SCOPE AND STRUCTURE
Scope of the Convention
Article 2
Each Contracting Party undertakes to promote the simplification and harmonization of Customs procedures and, to that end, to conform, in accordance with the provisions of this Convention, to the Standards, Transitional Standards and Recommended Practices in the Annexes to this Convention. However, nothing shall prevent a Contracting Party from granting facilities greater than those provided for therein, and each Contracting Party is recommended to grant such greater facilities as extensively as possible.
Article 3
The provisions of this Convention shall not preclude the application of national legislation with regard to either prohibitions or restrictions on goods which are subject to Customs control.
Structure of the Convention
Article 4
1. The Convention comprises a Body, a General Annex and Specific Annexes.
2. The General Annex and each Specific Annex to this Convention consist, in principle, of Chapters which subdivide an Annex and comprise:
(a) definitions; and
(b) Standards, some of which in the General Annex are Transitional Standards.
3. Each Specific Annex also contains Recommended Practices.
4. Each Annex is accompanied by Guidelines, the texts of which are not binding upon Contracting Parties.
Article 5
For the purposes of this Convention, any Specific Annex(es) or Chapter(s) therein to which a Contracting Party is bound shall be construed to be an integral part of the Convention, and in relation to that Contracting Party any reference to the Convention shall be deemed to include a reference to such Annex(es) or Chapter(s).
CHAPTER III
MANAGEMENT OF THE CONVENTION
Management Committee
Article 6
1. There shall be established a Management Committee to consider the implementation of this Convention, any measures to secure uniformity in the interpretation and application thereof, and any amendments proposed thereto.
2. The Contracting Parties shall be members of the Management Committee.
3. The competent administration of any entity qualified to become a Contracting Party to this Convention under the provisions of Article 8 or of any Member of the World Trade Organisation shall be entitled to attend the sessions of the Management Committee as an observer. The status and rights of such Observers shall be determined by a Council Decision. The aforementioned rights cannot be exercised before the entry into force of the Decision.
4. The Management Committee may invite the representatives of international governmental and non-governmental organizations to attend the sessions of the Management Committee as observers.
5. The Management Committee:
(a) shall recommend to the Contracting Parties:
(i) amendments to the Body of this Convention,
(ii) amendments to the General Annex, the Specific Annexes and Chapters therein and the incorporation of new Chapters to the General Annex, and
(iii) the incorporation of new Specific Annexes and new Chapters to Specific Annexes;
(b) may decide to amend Recommended Practices or to incorporate new Recommended Practices to Specific Annexes or Chapters therein in accordance with Article 16;
(c) shall consider implementation of the provisions of this Convention in accordance with Article 13, paragraph 4;
(d) shall review and update the Guidelines;
(e) shall consider any other issues of relevance to this Convention that may be referred to it;
(f) shall inform the Permanent Technical Committee and the Council of its decisions.
6. The competent administrations of the Contracting Parties shall communicate to the Secretary General of the Council proposals under paragraph 5 (a), (b), (c) or (d) of this Article and the reasons therefor, together with any requests for the inclusion of items on the Agenda of the sessions of the Management Committee. The Secretary General of the Council shall bring proposals to the attention of the competent administrations of the Contracting Parties and of the observers referred to in paragraphs 2, 3 and 4 of this Article.
7. The Management Committee shall meet at least once each year. It shall annually elect a Chairman and Vice-Chairman. The Secretary General of the Council shall circulate the invitation and the draft Agenda to the competent administrations of the Contracting Parties and to the observers referred to in paragraphs 2, 3 and 4 of this Article at least six weeks before the Management Committee meets.
8. Where a decision cannot be arrived at by consensus, matters before the Management Committee shall be decided by voting of the Contracting Parties present. Proposals under paragraph 5 (a), (b) or (c) of this Article shall be approved by a two-thirds majority of the votes cast. All other matters shall be decided by the Management Committee by a majority of the votes cast.
9. Where Article 8, paragraph 5 of this Convention applies, the Customs or Economic Unions which are Contracting Parties shall have, in case of voting, only a number of votes equal to the total votes allotted to their Members which are Contracting Parties.
10. Before the closure of its session, the Management Committee shall adopt a report. This report shall be transmitted to the Council and to the Contracting Parties and observers mentioned in paragraphs 2, 3 and 4.
11. In the absence of relevant provisions in this Article, the Rules of Procedure of the Council shall be applicable, unless the Management Committee decides otherwise.
Article 7
For the purpose of voting in the Management Committee, there shall be separate voting on each Specific Annex and each Chapter of a Specific Annex.
(a) Each Contracting Party shall be entitled to vote on matters relating to the interpretation, application or amendment of the Body and General Annex of the Convention.
(b) As regards matters concerning a Specific Annex or Chapter of a Specific Annex that is already in force, only those Contracting Parties that have accepted that Specific Annex or Chapter therein shall have the right to vote.
(c) Each Contracting Party shall be entitled to vote on drafts of new Specific Annexes or new Chapters of a Specific Annex.
CHAPTER IV
CONTRACTING PARTY
Ratification of the Convention
Article 8
1. Any Member of the Council and any Member of the United Nations or its specialized agencies may become a Contracting Party to this Convention:
(a) by signing it without reservation of ratification;
(b) by depositing an instrument of ratification after signing it subject to ratification; or
(c) by acceding to it.
2. This Convention shall be open until 30th June 1974 for signature at the Headquarters of the Council in Brussels by the Members referred to in paragraph 1 of this Article. Thereafter, it shall be open for accession by such Members.
3. Any Contracting Party shall, at the time of signing, ratifying or acceding to this Convention, specify which if any of the Specific Annexes or Chapters therein it accepts. It may subsequently notify the depositary that it accepts one or more Specific Annexes or Chapters therein.
4. Contracting Parties accepting any new Specific Annex or any new Chapter of a Specific Annex shall notify the depositary in accordance with paragraph 3 of this Article.
5. (a) Any Customs or Economic Union may become, in accordance with paragraphs 1, 2 and 3 of this Article, a Contracting Party to this Convention. Such Customs or Economic Union shall inform the depositary of its competence with respect to the matters governed by this Convention. Such Customs or Economic Union shall also inform the depositary of any substantial modification in the extent of its competence.
(b) A Customs or Economic Union which is a Contracting Party to this Convention shall, for the matters within its competence, exercise in its own name the rights, and fulfil the responsibilities, which the Convention confers on the Members of such a Union which are Contracting Parties to this Convention. In such a case, the Members of such a Union shall not be entitled to individually exercise these rights, including the right to vote.
Article 9
1. Any Contracting Party which ratifies this Convention or accedes thereto shall be bound by any amendments to this Convention, including the General Annex, which have entered into force at the date of deposit of its instrument of ratification or accession.
2. Any Contracting Party which accepts a Specific Annex or Chapter therein shall be bound by any amendments to the Standards contained in that Specific Annex or Chapter which have entered into force at the date on which it notifies its acceptance to the depositary. Any Contracting Party which accepts a Specific Annex or Chapter therein shall be bound by any amendments to the Recommended Practices contained therein, which have entered into force at the date on which it notifies its acceptance to the depositary, unless it enters reservations against one or more of those Recommended Practices in accordance with Article 12 of this Convention.
Application of the Convention
Article 10
1. Any Contracting Party may, at the time of signing this Convention without reservation of ratification or of depositing its instrument of ratification or accession, or at any time thereafter, declare by notification given to the depositary that this Convention shall extend to all or any of the territories for whose international relations it is responsible. Such notification shall take effect three months after the date of the receipt thereof by the depositary. However, this Convention shall not apply to the territories named in the notification before this Convention has entered into force for the Contracting Party concerned.
2. Any Contracting Party which has made a notification under paragraph 1 of this Article extending this Convention to any territory for whose international relations it is responsible may notify the depositary, under the procedure of Article 19 of this Convention, that the territory in question will no longer apply this Convention.
Article 11
For the application of this Convention, a Customs or Economic Union that is a Contracting Party shall notify to the Secretary General of the Council the territories which form the Customs or Economic Union, and these territories are to be taken as a single territory.
Acceptance of the provisions and reservations
Article 12
1. All Contracting Parties are hereby bound by the General Annex.
2. A Contracting Party may accept one or more of the Specific Annexes or one or more of the Chapters therein. A Contracting Party which accepts a Specific Annex or Chapter(s) therein shall be bound by all the Standards therein. A Contracting Party which accepts a Specific Annex or Chapter(s) therein shall be bound by all the Recommended Practices therein unless, at the time of acceptance or at any time thereafter, it notifies the depositary of the Recommended Practice(s) in respect of which it enters reservations, stating the differences existing between the provisions of its national legislation and those of the Recommended Practice(s) concerned. Any Contracting Party which has entered reservations may withdraw them, in whole or in part, at any time by notification to the depositary specifying the date on which such withdrawal takes effect.
3. Each Contracting Party bound by a Specific Annex or Chapter(s) therein shall examine the possibility of withdrawing any reservations to the Recommended Practices entered under the terms of paragraph 2 and notify the Secretary General of the Council of the results of that review at the end of every three-year period commencing from the date of the entry into force of this Convention for that Contracting Party, specifying the provisions of its national legislation which, in its opinion, are contrary to the withdrawal of the reservations.
Implementation of the provisions
Article 13
1. Each Contracting Party shall implement the Standards in the General Annex and in the Specific Annex(es) or Chapter(s) therein that it has accepted within 36 months after such Annex(es) or Chapter(s) have entered into force for that Contracting Party.
2. Each Contracting Party shall implement the Transitional Standards in the General Annex within 60 months of the date that the General Annex has entered into force for that Contracting Party.
3. Each Contracting Party shall implement the Recommended Practices in the Specific Annex(es) or Chapter(s) therein that it has accepted within 36 months after such Specific Annex(es) or Chapter(s) have entered into force for that Contracting Party, unless reservations have been entered as to one or more of those Recommended Practices.
4. (a) Where the periods provided for in paragraph 1 or 2 of this Article would, in practice, be insufficient for any Contracting Party to implement the provisions of the General Annex, that Contracting Party may request the Management Committee, before the end of the period referred to in paragraph 1 or 2 of this Article, to provide an extension of that period. In making the request, the Contracting Party shall state the provision(s) of the General Annex with regard to which an extension of the period is required and the reasons for such request.
(b) In exceptional circumstances, the Management Committee may decide to grant such an extension. Any decision by the Management Committee granting such an extension shall state the exceptional circumstances justifying the decision and the extension shall in no case be more than one year. At the expiry of the period of extension, the Contracting Party shall notify the depositary of the implementation of the provisions with regard to which the extension was granted.
Settlement of disputes
Article 14
1. Any dispute between two or more Contracting Parties concerning the interpretation or application of this Convention shall so far as possible be settled by negotiation between them.
2. Any dispute which is not settled by negotiation shall be referred by the Contracting Parties in dispute to the Management Committee which shall thereupon consider the dispute and make recommendations for its settlement.
3. The Contracting Parties in dispute may agree in advance to accept the recommendations of the Management Committee as binding.
Amendments to the Convention
Article 15
1. The text of any amendment recommended to the Contracting Parties by the Management Committee in accordance with Article 6, paragraph 5 (a) (i) and (ii) shall be communicated by the Secretary General of the Council to all Contracting Parties and to those Members of the Council that are not Contracting Parties.
2. Amendments to the Body of the Convention shall enter into force for all Contracting Parties twelve months after deposit of the instruments of acceptance by those Contracting Parties present at the session of the Management Committee during which the amendments were recommended, provided that no objection is lodged by any of the Contracting Parties within a period of twelve months from the date of communication of such amendments.
3. Any recommended amendment to the General Annex or the Specific Annexes or Chapters therein shall be deemed to have been accepted six months after the date the recommended amendment was communicated to Contracting Parties, unless:
(a) there has been an objection by a Contracting Party or, in the case of a Specific Annex or Chapter, by a Contracting Party bound by that Specific Annex or Chapter; or
(b) a Contracting Party informs the Secretary General of the Council that, although it intends to accept the recommended amendment, the conditions necessary for such acceptance are not yet fulfilled.
4. If a Contracting Party sends the Secretary General of the Council a communication as provided for in paragraph 3(b) of this Article, it may, so long as it has not notified the Secretary General of the Council of its acceptance of the recommended amendment, submit an objection to that amendment within a period of eighteen months following the expiry of the six-month period referred to in paragraph 3 of this Article.
5. If an objection to the recommended amendment is notified in accordance with the terms of paragraph 3 (a) or 4 of this Article, the amendment shall be deemed not to have been accepted and shall be of no effect.
6. If any Contracting Party has sent a communication in accordance with paragraph 3 (b) of this Article, the amendment shall be deemed to have been accepted on the earlier of the following two dates:
(a) the date by which all the Contracting Parties which sent such communications have notified the Secretary General of the Council of their acceptance of the recommended amendment, provided that, if all the acceptances were notified before the expiry of the period of six months referred to in paragraph 3 of this Article, that date shall be taken to be the date of expiry of the said six-month period;
(b) the date of expiry of the eighteen-month period referred to in paragraph 4 of this Article.
7. Any amendment to the General Annex or the Specific Annexes or Chapters therein deemed to be accepted shall enter into force either six months after the date on which it was deemed to be accepted or, if a different period is specified in the recommended amendment, on the expiry of that period after the date on which the amendment was deemed to be accepted.
8. The Secretary General of the Council shall, as soon as possible, notify the Contracting Parties to this Convention of any objection to the recommended amendment made in accordance with paragraph 3 (a), and of any communication received in accordance with paragraph 3 (b), of this Article. The Secretary General of the Council shall subsequently inform the Contracting Parties whether the Contracting Party or Parties which have sent such a communication raise an objection to the recommended amendment or accept it.
Article 16
1. Notwithstanding the amendment procedure laid down in Article 15 of this Convention, the Management Committee in accordance with Article 6 may decide to amend any Recommended Practice or to incorporate new Recommended Practices to any Specific Annex or Chapter therein. Each Contracting Party shall be invited by the Secretary General of the Council to participate in the deliberations of the Management Committee. The text of any such amendment or new Recommended Practice so decided upon shall be communicated by the Secretary General of the Council to the Contracting Parties and those Members of the Council that are not Contracting Parties to this Convention.
2. Any amendment or incorporation of new Recommended Practices decided upon under paragraph 1 of this Article shall enter into force six months after their communication by the Secretary General of the Council. Each Contracting Party bound by a Specific Annex or Chapter therein forming the subject of such amendments or incorporation of new Recommended Practices shall be deemed to have accepted those amendments or new Recommended Practices unless it enters a reservation under the procedure of Article 12 of this Convention.
Duration of accession
Article 17
1. This Convention is of unlimited duration but any Contracting Party may denounce it at any time after the date of its entry into force under Article 18 thereof.
2. The denunciation shall be notified by an instrument in writing, deposited with the depositary.
3. The denunciation shall take effect six months after the receipt of the instrument of denunciation by the depositary.
4. The provisions of paragraphs 2 and 3 of this Article shall also apply in respect of the Specific Annexes or Chapters therein, for which any Contracting Party may withdraw its acceptance at any time after the date of the entry into force.
5. Any Contracting Party which withdraws its acceptance of the General Annex shall be deemed to have denounced the Convention. In this case, the provisions of paragraphs 2 and 3 also apply.
CHAPTER V
FINAL PROVISIONS
Entry into force of the Convention
Article 18
1. This Convention shall enter into force three months after five of the entities referred to in paragraphs 1 and 5 of Article 8 thereof have signed the Convention without reservation of ratification or have deposited their instruments of ratification or accession.
2. This Convention shall enter into force for any Contracting Party three months after it has become a Contracting Party in accordance with the provisions of Article 8.
3. Any Specific Annex or Chapter therein to this Convention shall enter into force three months after five Contracting Parties have accepted that Specific Annex or that Chapter.
4. After any Specific Annex or Chapter therein has entered into force in accordance with paragraph 3 of this Article, that Specific Annex or Chapter therein shall enter into force for any Contracting Party three months after it has notified its acceptance. No Specific Annex or Chapter therein shall, however, enter into force for a Contracting Party before this Convention has entered into force for that Contracting Party.
Depositary of the Convention
Article 19
1. This Convention, all signatures with or without reservation of ratification and all instruments of ratification or accession shall be deposited with the Secretary General of the Council.
2. The depositary shall:
(a) receive and keep custody of the original texts of this Convention;
(b) prepare certified copies of the original texts of this Convention and transmit them to the Contracting Parties and those Members of the Council that are not Contracting Parties and the Secretary General of the United Nations;
(c) receive any signature with or without reservation of ratification, ratification or accession to this Convention and receive and keep custody of any instruments, notifications and communications relating to it;
(d) examine whether the signature or any instrument, notification or communication relating to this Convention is in due and proper form and, if need be, bring the matter to the attention of the Contracting Party in question;
(e) notify the Contracting Parties, those Members of the Council that are not Contracting Parties, and the Secretary General of the United Nations of:
– signatures, ratifications, accessions and acceptances of Annexes and Chapters under Article 8 of this Convention,
– new Chapters of the General Annex and new Specific Annexes or Chapters therein which the Management Committee decides to recommend to incorporate in this Convention,
– the date of entry into force of this Convention, of the General Annex and of each Specific Annex or Chapter therein in accordance with Article 18 of this Convention,
– notifications received in accordance with Articles 8, 10, 11, 12 and 13 of this Convention,
– withdrawals of acceptances of Annexes/Chapters by Contracting Parties,
– denunciations under Article 17 of this Convention, and
– any amendment accepted in accordance with Article 15 of this Convention and the date of its entry into force.
3. In the event of any difference appearing between a Contracting Party and the depositary as to the performance of the latter's functions, the depositary or that Contracting Party shall bring the question to the attention of the other Contracting Parties and the signatories or, as the case may be, the Management Committee or the Council.
Registration and authentic texts
Article 20
In accordance with Article 102 of the Charter of the United Nations, this Convention shall be registered with the Secretariat of the United Nations at the request of the Secretary General of the Council.
In witness whereof the undersigned, being duly authorized thereto, have signed this Convention.
Done at Kyoto, this eighteenth day of May nineteen hundred and seventy-three in the English and French languages, both texts being equally authentic, in a single original which shall be deposited with the Secretary General of the Council who shall transmit certified copies to all the entities referred to in paragraph 1 of Article 8 of this Convention.

CHAPTER 1
GENERAL PRINCIPLES
 
1.1 Standard
The Definitions, Standards and Transitional Standards in this Annex shall apply to Customs procedures and practices specified in this Annex and, insofar as applicable, to procedures and practices in the Specific Annexes.
 
1.2. Standard
The conditions to be fulfilled and Customs formalities to be accomplished for procedures and practices in this Annex and in the Specific Annexes shall be specified in national legislation and shall be as simple as possible.
 
1.3. Standard
The Customs shall institute and maintain formal consultative relationships with the trade to increase co-operation and facilitate participation in establishing the most effective methods of working commensurate with national provisions and international agreements.
CHAPTER 2
DEFINITIONS
    For the purposes of the Annexes to this Convention:
E1./ F23.  "appeal" means the act by which a person who is directly affected by
           a decision or omission of the Customs and who considers himself to be
           aggrieved thereby seeks redress before a competent authority;
E2./ F19.  "assessment of duties and taxes" means the determination of the
           amount of duties and taxes payable;
E3./ F4.   "audit-based control" means measures by which the Customs satisfy
           themselves as to the accuracy and authenticity of declarations through
           the examination of the relevant books, records, business systems and
           commercial data held by persons concerned;
E4./ F15.  "checking the Goods declaration" means the action taken by the
           Customs to satisfy themselves that the Goods declaration is correctly
           made out and that the supporting documents required fulfil the
           prescribed conditions;
E5./ F9.   "clearance" means the accomplishment of the Customs formalities
           necessary to allow goods to enter home use, to be exported or to be
           placed under another Customs procedure;
E6./ F10.  "Customs" means the Government Service which is responsible for the
           administration of Customs law and the collection of duties and taxes
           and which also has the responsibility for the application of other laws
           and regulations relating to the importation, exportation, movement or
           storage
           of goods;
E7./ F3.   "Customs control" means measures applied by the Customs to ensure
           compliance with Customs law;
E8./ F11.  "Customs duties" means the duties laid down in the Customs tariff to
           which goods are liable on entering or leaving the Customs territory;
E9./ F16.  "Customs formalities" means all the operations which must be carried
           out by the persons concerned and by the Customs in order to comply with
           the Customs law;
E10./F18.  "Customs law" means the statutory and regulatory provisions relating
           to the importation, exportation, movement or storage of goods, the
           administration and enforcement of which are specifically charged to the
           Customs, and any regulations made by the Customs under their statutory
           powers;
E11./ F2.  "Customs office" means the Customs administrative unit competent for
           the performance of Customs formalities, and the premises or other areas
           approved for that purpose by the competent authorities;
E12./ F25. "Customs territory" means the territory in which the Customs law of a
           Contracting Party applies;
E13./F6.   "decision" means the individual act by which the Customs decide upon a
           matter relating to Customs law;
E14./ F7.  "declarant" means any person who makes a Goods declaration or in whose
           name such a declaration is made;
E15./ F5.  "due date" means the date when payment of duties and taxes is due;
E16./ F12. "duties and taxes" means import duties and taxes and/or export duties
           and taxes;
E17./F27.  "examination of goods" means the physical inspection of goods by the
           Customs to satisfy themselves that the nature, origin, condition,
           quantity and value of the goods are in accordance with the particulars
           furnished in the Goods declaration;
E18./ F13. "export duties and taxes" means Customs duties and all other duties,
           taxes or charges which are collected on or in connection with the
           exportation of goods, but not including any charges which are limited
           in amount to the approximate cost of services rendered or collected by
           the Customs on behalf of another national authority;
E19./F8.   "Goods declaration" means a statement made in the manner prescribed by
           the Customs, by which the persons concerned indicate the Customs
           procedure to be applied to the goods and furnish the particulars which
           the Customs require for its application;
E20./ F14. "import duties and taxes" means Customs duties and all other duties,
           taxes or charges which are collected on or in connection with the
           importation of goods, but not including any charges which are limited
           in amount to the approximate cost of services rendered or collected by
           the Customs on behalf of another national authority;
E21./F1.   "mutual administrative assistance" means actions of a Customs
           administration on behalf of or in collaboration with another Customs
           administration for the proper application of Customs law and for the
           prevention, investigation and repression of Customs offences;
E22./ F21. "omission" means the failure to act or give a decision required of the
           Customs by Customs law within a reasonable time on a matter duly
           submitted to them;
E23./ F22. "person" means both natural and legal persons, unless the context
           otherwise requires;
E24./ F20. "release of goods" means the action by the Customs to permit goods
           undergoing clearance to be placed at the disposal of the persons
           concerned;
E25./ F24. "repayment" means the refund, in whole or in part, of duties and taxes
           paid on goods and the remission, in whole or in part, of duties and
           taxes where payment has not been made;
E26./F17.  "security" means that which ensures to the satisfaction of the Customs
           that an obligation to the Customs will be fulfilled. Security is
           described as "general" when it ensures that the obligations arising
           from several operations will be fulfilled;
E27./F26.  "third party" means any person who deals directly with the Customs, for
           and on behalf of another person, relating to the importation,
           exportation, movement or storage of goods.
CHAPTER 3
CLEARANCE AND OTHER CUSTOMS FORMALITIES
Competent Customs offices
3.1. Standard
The Customs shall designate the Customs offices at which goods may be produced or cleared. In determining the competence and location of these offices and their hours of business, the factors to be taken into account shall include in particular the requirements of the trade.
 
3.2. Standard
At the request of the person concerned and for reasons deemed valid by the Customs, the latter shall, subject to the availability of resources, perform the functions laid down for the purposes of a Customs procedure and practice outside the designated hours of business or away from Customs offices. Any expenses chargeable by the Customs shall be limited to the approximate cost of the services rendered.
 
3.3. Standard
Where Customs offices are located at a common border crossing, the Customs administrations concerned shall correlate the business hours and the competence of those offices.
 
3.4. Transitional standard
At common border crossings, the Customs administrations concerned shall, whenever possible, operate joint controls.
 
3.5. Transitional standard
Where the Customs intend to establish a new Customs office or to convert an existing one at a common border crossing, they shall, wherever possible, co-operate with the neighbouring Customs to establish a juxtaposed Customs office to facilitate joint controls.
The declarant
(a) Persons entitled to act as declarant
 
3.6. Standard
National legislation shall specify the conditions under which a person is entitled to act as declarant.
 
3.7. Standard
Any person having the right to dispose of the goods shall be entitled to act as declarant.
 
(b) Responsibilities of the declarant
 
3.8. Standard
The declarant shall be held responsible to the Customs for the accuracy of the particulars given in the Goods declaration and the payment of the duties and taxes.
 
(c) Rights of the declarant
 
3.9. Standard
Before lodging the Goods declaration the declarant shall be allowed, under such conditions as may be laid down by the Customs:
(a) to inspect the goods; and
(b) to draw samples.
 
3.10. Standard
The Customs shall not require a separate Goods declaration in respect of samples allowed to be drawn under Customs supervision, provided that such samples are included in the Goods declaration concerning the relevant consignment.
The Goods declaration
(a) Goods declaration format and contents
 
3.11. Standard
The contents of the Goods declaration shall be prescribed by the Customs. The paper format of the Goods declaration shall conform to the UN-layout key.
For automated Customs clearance processes, the format of the electronically lodged Goods declaration shall be based on international standards for electronic information exchange as prescribed in the Customs Co-operation Council Recommendations on information technology.
 
3.12. Standard
The Customs shall limit the data required in the Goods declaration to only such particulars as are deemed necessary for the assessment and collection of duties and taxes, the compilation of statistics and the application of Customs law.
 
3.13. Standard
Where, for reasons deemed valid by the Customs, the declarant does not have all the information required to make the Goods declaration, a provisional or incomplete Goods declaration shall be allowed to be lodged, provided that it contains the particulars deemed necessary by the Customs and that the declarant undertakes to complete it within a specified period.
 
3.14. Standard
If the Customs register a provisional or incomplete Goods declaration, the tariff treatment to be accorded to the goods shall not be different from that which would have been accorded had a complete and correct Goods declaration been lodged in the first instance.
The release of the goods shall not be delayed provided that any security required has been furnished to ensure collection of any applicable duties and taxes.
 
3.15. Standard
The Customs shall require the lodgment of the original Goods declaration and only the minimum number of copies necessary.
 
(b) Documents supporting the Goods declaration
 
3.16. Standard
In support of the Goods declaration the Customs shall require only those documents necessary to permit control of the operation and to ensure that all requirements relating to the application of Customs law have been complied with.
 
3.17. Standard
Where certain supporting documents cannot be lodged with the Goods declaration for reasons deemed valid by the Customs, they shall allow production of those documents within a specified period.
 
3.18. Transitional Standard
The Customs shall permit the lodgment of supporting documents by electronic means.
 
3.19. Standard
The Customs shall not require a translation of the particulars of supporting documents except when necessary to permit processing of the Goods declaration.
Lodgment, registration and checking of the goods declaration
 
3.20. Standard
The Customs shall permit the lodging of the Goods declaration at any designated Customs office.
 
3.21. Transitional Standard
The Customs shall permit the lodging of the Goods declaration by electronic means.
 
3.22. Standard
The Goods declaration shall be lodged during the hours designated by the Customs.
 
3.23. Standard
Where national legislation lays down a time limit for lodging the Goods declaration, the time allowed shall be sufficient to enable the declarant to complete the Goods declaration and to obtain the supporting documents required.
 
3.24. Standard
At the request of the declarant and for reasons deemed valid by the Customs, the latter shall extend the time limit prescribed for lodging the Goods declaration.
 
3.25. Standard
National legislation shall make provision for the lodging and registering or checking of the Goods declaration and supporting documents prior to the arrival of the goods.
 
3.26. Standard
When the Customs cannot register the Goods declaration, they shall state the reasons to the declarant.
 
3.27. Standard
The Customs shall permit the declarant to amend the Goods declaration that has already been lodged, provided that when the request is received they have not begun to check the Goods declaration or to examine the goods.
 
3.28. Transitional Standard
The Customs shall permit the declarant to amend the Goods declaration if a request is received after checking of the Goods declaration has commenced, if the reasons given by the declarant are deemed valid by the Customs.
 
3.29. Transitional Standard
The declarant shall be allowed to withdraw the Goods declaration and apply for another Customs procedure, provided that the request to do so is made to the Customs before the goods have been released and that the reasons are deemed valid by the Customs.
 
3.30. Standard
Checking the Goods declaration shall be effected at the same time or as soon as possible after the Goods declaration is registered.
 
3.31. Standard
For the purpose of checking the Goods declaration, the Customs shall take only such action as they deem essential to ensure compliance with Customs law.
Special procedures for authorized persons
 
3.32. Transitional Standard
For authorized persons who meet criteria specified by the Customs, including having an appropriate record of compliance with Customs requirements and a satisfactory system for managing their commercial records, the Customs shall provide for:
– release of the goods on the provision of the minimum information necessary to identify the goods and permit the subsequent completion of the final Goods declaration;
– clearance of the goods at the declarant's premises or another place authorised by the Customs; and, in addition, to the extent possible, other special procedures such as:
– allowing a single Goods declaration for all imports or exports in a given period where goods are imported or exported frequently by the same person;
– use of the authorized persons' commercial records to self-assess their duty and tax liability and, where appropriate, to ensure compliance with other Customs requirements;
– allowing the lodgment of the Goods declaration by means of an entry in the records of the authorized person to be supported subsequently by a supplementary Goods declaration.
Examination of the goods
(a) Time required for examination of goods
 
3.33. Standard
When the Customs decide that goods declared shall be examined, this examination shall take place as soon as possible after the Goods declaration has been registered.
 
3.34. Standard
When scheduling examinations, priority shall be given to the examination of live animals and perishable goods and to other goods which the Customs accept are urgently required.
 
3.35. Transitional Standard
If the goods must be inspected by other competent authorities and the Customs also schedules an examination, the Customs shall ensure that the inspections are co-ordinated and, if possible, carried out at the same time.
 
(b) Presence of the declarant at examination of goods
 
3.36. Standard
The Customs shall consider requests by the declarant to be present or to be represented at the examination of the goods. Such requests shall be granted unless exceptional circumstances exist.
 
3.37. Standard
If the Customs deem it useful, they shall require the declarant to be present or to be represented at the examination of the goods to give them any assistance necessary to facilitate the examination.
 
(c) Sampling by the Customs
 
3.38. Standard
Samples shall be taken only where deemed necessary by the Customs to establish the tariff description and/or value of goods declared or to ensure the application of other provisions of national legislation. Samples drawn shall be as small as possible.
Errors
 
3.39. Standard
The Customs shall not impose substantial penalties for errors where they are satisfied that such errors are inadvertent and that there has been no fraudulent intent or gross negligence. Where they consider it necessary to discourage a repetition of such errors, a penalty may be imposed but shall be no greater than is necessary for this purpose.
Release of goods
 
3.40. Standard
Goods declared shall be released as soon as the Customs have examined them or decided not to examine them, provided that:
– no offence has been found;
– the import or export license or any other documents required have been acquired;
– all permits relating to the procedure concerned have been acquired, and
– any duties and taxes have been paid or that appropriate action has been taken to ensure their collection.
 
3.41. Standard
If the Customs are satisfied that the declarant will subsequently accomplish all the formalities in respect of clearance they shall release the goods, provided that the declarant produces a commercial or official document giving the main particulars of the consignment concerned and acceptable to the Customs, and that security, where required, has been furnished to ensure collection of any applicable duties and taxes.
 
3.42. Standard
When the Customs decide that they require laboratory analysis of samples, detailed technical documents or expert advice, they shall release the goods before the results of such examination are known, provided that any security required has been furnished and provided they are satisfied that the goods are not subject to prohibitions or restrictions.
 
3.43. Standard
When an offence has been detected, the Customs shall not wait for the completion of administrative or legal action before they release the goods, provided that the goods are not liable to confiscation or forfeiture or to be needed as evidence at some later stage and that the declarant pays the duties and taxes and furnishes security to ensure collection of any additional duties and taxes and of any penalties which may be imposed.
Abandonment or destruction of goods
 
3.44. Standard
When goods have not yet been released for home use or when they have been placed under another Customs procedure, and provided that no offence has been detected, the person concerned shall not be required to pay the duties and taxes or shall be entitled to repayment thereof:
– when, at his request, such goods are abandoned to the Revenue or destroyed or rendered commercially valueless under Customs control, as the Customs may decide. Any costs involved shall be borne by the person concerned;
– when such goods are destroyed or irrecoverably lost by accident or force majeure, provided that such destruction or loss is duly established to the satisfaction of the Customs;
– on shortages due to the nature of the goods when such shortages are duly established to the satisfaction of the Customs.
Any waste or scrap remaining after destruction shall be liable, if taken into home use or exported, to the duties and taxes that would be applicable to such waste or scrap imported or exported in that state.
 
3.45. Transitional Standard
When the Customs sell goods which have not been declared within the time allowed or could not be released although no offence has been discovered, the proceeds of the sale, after deduction of any duties and taxes and all other charges and expenses incurred, shall be made over to those persons entitled to receive them or, when this is not possible, held at their disposal for a specified period.
CHAPTER 4
DUTIES AND TAXES
A. ASSESSMENT, COLLECTION AND PAYMENT OF DUTIES AND TAXES
 
4.1. Standard
National legislation shall define the circumstances when liability to duties and taxes is incurred.
 
4.2. Standard
The time period within which the applicable duties and taxes are assessed shall be stipulated in national legislation. The assessment shall follow as soon as possible after the Goods declaration is lodged or the liability is otherwise incurred.
 
4.3. Standard
The factors on which the assessment of duties and taxes is based and the conditions under which they are determined shall be specified in national legislation.
 
4.4. Standard
The rates of duties and taxes shall be set out in official publications.
 
4.5. Standard
National legislation shall specify the point in time to be taken into consideration for the purpose of determining the rates of duties and taxes.
 
4.6. Standard
National legislation shall specify the methods that may be used to pay the duties and taxes.
 
4.7. Standard
National legislation shall specify the person(s) responsible for the payment of duties and taxes.
 
4.8. Standard
National legislation shall determine the due date and the place where payment is to be made.
 
4.9. Standard
When national legislation specifies that the due date may be after the release of the goods, that date shall be at least ten days after the release. No interest shall be charged for the period between the date of release and the due date.
 
4.10. Standard
National legislation shall specify the period within which the Customs may take legal action to collect duties and taxes not paid by the due date.
 
4.11. Standard
National legislation shall determine the rate of interest chargeable on amounts of duties and taxes that have not been paid by the due date and the conditions of application of such interest.
 
4.12. Standard
When the duties and taxes have been paid, a receipt constituting proof of payment shall be issued to the payer, unless there is other evidence constituting proof of payment.
 
4.13. Transitional Standard
National legislation shall specify a minimum value and/or a minimum amount of duties and taxes below which no duties and taxes will be collected.
 
4.14. Standard
If the Customs find that errors in the Goods declaration or in the assessment of the duties and taxes will cause or have caused the collection or recovery of an amount of duties and taxes less than that legally chargeable, they shall correct the errors and collect the amount underpaid. However, if the amount involved is less than the minimum amount specified in national legislation, the Customs shall not collect or recover that amount.
B. DEFERRED PAYMENT OF DUTIES AND TAXES
 
4.15. Standard
Where national legislation provides for the deferred payment of duties and taxes, it shall specify the conditions under which such facility is allowed.
 
4.16. Standard
Deferred payment shall be allowed without interest charges to the extent possible.
 
4.17. Standard
The period for deferred payment of duties and taxes shall be at least fourteen days.
C. REPAYMENT OF DUTIES AND TAXES
 
4.18. Standard
Repayment shall be granted where it is established that duties and taxes have been overcharged as a result of an error in their assessment.
 
4.19. Standard
Repayment shall be granted in respect of imported or exported goods which are found to have been defective or otherwise not in accordance with the agreed specifications at the time of importation or exportation and are returned either to the supplier or to another person designated by the supplier, subject to the following conditions:
– the goods have not been worked, repaired or used in the country of importation, and are re-exported within a reasonable time;
– the goods have not been worked, repaired or used in the country to which they were exported, and are re-imported within a reasonable time.
Use of the goods shall, however, not hinder the repayment if such use was indispensable to discover the defects or other circumstances which caused the re-exportation or re-importation of the goods.
As an alternative to re-exportation or re-importation, the goods may be abandoned to the Revenue or destroyed or rendered commercially valueless under Customs control, as the Customs may decide. Such abandonment or destruction shall not entail any cost to the Revenue.
 
4.20. Transitional Standard
Where permission is given by the Customs for goods originally declared for a Customs procedure with payment of duties and taxes to be placed under another Customs procedure, repayment shall be made of any duties and taxes charged in excess of the amount due under the new procedure.
 
4.21. Standard
Decisions on claims for repayment shall be reached, and notified in writing to the persons concerned, without undue delay, and repayment of amounts overcharged shall be made as soon as possible after the verification of claims.
 
4.22. Standard
Where it is established by the Customs that the overcharge is a result of an error on the part of the Customs in assessing the duties and taxes, repayment shall be made as a matter of priority.
 
4.23. Standard
Where time limits are fixed beyond which claims for repayment will not be accepted, such limits shall be of sufficient duration to take account of the differing circumstances pertaining to each type of case in which repayment may be granted.
 
4.24. Standard
Repayment shall not be granted if the amount involved is less than the minimum amount specified in national legislation.
CHAPTER 5
SECURITY
 
5.1. Standard
National legislation shall enumerate the cases in which security is required and shall specify the forms in which security is to be provided.
 
5.2. Standard
The Customs shall determine the amount of security.
 
5.3. Standard
Any person required to provide security shall be allowed to choose any form of security provided that it is acceptable to the Customs.
 
5.4. Standard
Where national legislation provides, the Customs shall not require security when they are satisfied that an obligation to the Customs will be fulfilled.
 
5.5. Standard
When security is required to ensure that the obligations arising from a Customs procedure will be fulfilled, the Customs shall accept a general security, in particular from declarants who regularly declare goods at different offices in the Customs territory.
 
5.6. Standard
Where security is required, the amount of security to be provided shall be as low as possible and, in respect of the payment of duties and taxes, shall not exceed the amount potentially chargeable.
 
5.7. Standard
Where security has been furnished, it shall be discharged as soon as possible after the Customs are satisfied that the obligations under which the security was required have been duly fulfilled.
CHAPTER 6
CUSTOMS CONTROL
6.1. Standard
All goods, including means of transport, which enter or leave the Customs territory, regardless of whether they are liable to duties and taxes, shall be subject to Customs control.
 
6.2. Standard
Customs control shall be limited to that necessary to ensure compliance with the Customs law.
 
6.3. Standard
In the application of Customs control, the Customs shall use risk management.
 
6.4. Standard
The Customs shall use risk analysis to determine which persons and which goods, including means of transport, should be examined and the extent of the examination.
 
6.5. Standard
The Customs shall adopt a compliance measurement strategy to support risk management.
 
6.6. Standard
Customs control systems shall include audit-based controls.
 
6.7. Standard
The Customs shall seek to co-operate with other Customs administrations and seek to conclude mutual administrative assistance agreements to enhance Customs control.
 
6.8. Standard
The Customs shall seek to co-operate with the trade and seek to conclude Memoranda of Understanding to enhance Customs control.
 
6.9. Transitional Standard
The Customs shall use information technology and electronic commerce to the greatest possible extent to enhance Customs control.
 
6.10. Standard
The Customs shall evaluate traders' commercial systems where those systems have an impact on Customs operations to ensure compliance with Customs requirements.
CHAPTER 7
APPLICATION OF INFORMATION TECHNOLOGY
7.1. Standard
The Customs shall apply information technology to support Customs operations, where it is cost-effective and efficient for the Customs and for the trade. The Customs shall specify the conditions for its application.
 
7.2. Standard
When introducing computer applications, the Customs shall use relevant internationally accepted standards.
 
7.3. Standard
The introduction of information technology shall be carried out in consultation with all relevant parties directly affected, to the greatest extent possible.
 
7.4. Standard
New or revised national legislation shall provide for:
– electronic commerce methods as an alternative to paper-based documentary requirements;
– electronic as well as paper-based authentication methods;
– the right of the Customs to retain information for their own use and, as appropriate, to exchange such information with other Customs administrations and all other legally approved parties by means of electronic commerce techniques.
CHAPTER 8
RELATIONSHIP BETWEEN THE CUSTOMS AND THIRD PARTIES
8.1. Standard
Persons concerned shall have the choice of transacting business with the Customs either directly or by designating a third party to act on their behalf.
 
8.2. Standard
National legislation shall set out the conditions under which a person may act for and on behalf of another person in dealing with the Customs and shall lay down the liability of third parties to the Customs for duties and taxes and for any irregularities.
 
8.3. Standard
The Customs transactions where the person concerned elects to do business on his own account shall not be treated less favourably or be subject to more stringent requirements than those Customs transactions which are handled for the person concerned by a third party.
 
8.4. Standard
A person designated as a third party shall have the same rights as the person who designated him in those matters related to transacting business with the Customs.
 
8.5. Standard
The Customs shall provide for third parties to participate in their formal consultations with the trade.
 
8.6. Standard
The Customs shall specify the circumstances under which they are not prepared to transact business with a third party.
 
8.7. Standard
The Customs shall give written notification to the third party of a decision not to transact business.
CHAPTER 9
INFORMATION, DECISIONS AND RULINGS SUPPLIED BY THE CUSTOMS
A. INFORMATION OF GENERAL APPLICATION
9.1. Standard
The Customs shall ensure that all relevant information of general application pertaining to Customs law is readily available to any interested person.
 
9.2. Standard
When information that has been made available must be amended due to changes in Customs law, administrative arrangements or requirements, the Customs shall make the revised information readily available sufficiently in advance of the entry into force of the changes to enable interested persons to take account of them, unless advance notice is precluded.
 
9.3. Transitional Standard
The Customs shall use information technology to enhance the provision of information.
B. INFORMATION OF A SPECIFIC NATURE
9.4. Standard
At the request of the interested person, the Customs shall provide, as quickly and as accurately as possible, information relating to the specific matters raised by the interested person and pertaining to Customs law.
 
9.5. Standard
The Customs shall supply not only the information specifically requested but also any other pertinent information which they consider the interested person should be made aware of.
 
9.6. Standard
When the Customs supply information, they shall ensure that they do not divulge details of a private or confidential nature affecting the Customs or third parties unless such disclosure is required or authorized by national legislation.
 
9.7. Standard
When the Customs cannot supply information free of charge, any charge shall be limited to the approximate cost of the services rendered.
C. DECISIONS AND RULINGS
9.8. Standard
At the written request of the person concerned, the Customs shall notify their decision in writing within a period specified in national legislation. Where the decision is adverse to the person concerned, the reasons shall be given and the right of appeal advised.
 
9.9. Standard
The Customs shall issue binding rulings at the request of the interested person, provided that the Customs have all the information they deem necessary.
CHAPTER 10
APPEALS IN CUSTOMS MATTERS
A. RIGHT OF APPEAL
10.1. Standard
National legislation shall provide for a right of appeal in Customs matters.
 
10.2. Standard
Any person who is directly affected by a decision or omission of the Customs shall have a right of appeal.
 
10.3. Standard
The person directly affected by a decision or omission of the Customs shall be given, after having made a request to the Customs, the reasons for such decision or omission within a period specified in national legislation. This may or may not result in an appeal.
 
10.4. Standard
National legislation shall provide for the right of an initial appeal to the Customs.
 
10.5. Standard
Where an appeal to the Customs is dismissed, the appellant shall have the right of a further appeal to an authority independent of the Customs administration.
 
10.6. Standard
In the final instance, the appellant shall have the right of appeal to a judicial authority.
B. FORM AND GROUNDS OF APPEAL
10.7. Standard
An appeal shall be lodged in writing and shall state the grounds on which it is being made.
 
10.8. Standard
A time limit shall be fixed for the lodgment of an appeal against a decision of the Customs and it shall be such as to allow the appellant sufficient time to study the contested decision and to prepare an appeal.
 
10.9. Standard
Where an appeal is to the Customs they shall not, as a matter of course, require that any supporting evidence be lodged together with the appeal but shall, in appropriate circumstances, allow a reasonable time for the lodgment of such evidence.
C. CONSIDERATION OF APPEAL
10.10. Standard
The Customs shall give its ruling upon an appeal and written notice thereof to the appellant as soon as possible.
 
10.11. Standard
Where an appeal to the Customs is dismissed, the Customs shall set out the reasons therefor in writing and shall advise the appellant of his right to lodge any further appeal with an administrative or independent authority and of any time limit for the lodgement of such appeal.
 
10.12. Standard
Where an appeal is allowed, the Customs shall put their decision or the ruling of the independent or judicial authority into effect as soon as possible, except in cases where the Customs appeal against the ruling.
P R O T O C O L E
D'AMENDEMENT A LA CONVENTION INTERNATIONALE POUR LA SIMPLIFICATION ET L'HARMONISATION DES REGIMES DOUANIERS
(fait à Bruxelles, le 26 juin 1999)
Les Parties contractantes à la Convention internationale pour la simplification et l'harmonisation des régimes douaniers (faite à Kyoto le 18 mai 1973 et entrée en vigueur le 25 septembre 1974), ci-après dénommée "la Convention", établie sous les auspices du Conseil de coopération douanière, ci-après dénommé "le Conseil",
CONSIDERANT que, en vue d'atteindre les objectifs qui consistent:
– à éliminer les disparités entre les régimes douaniers et les pratiques douanières des Parties contractantes, qui peuvent entraver le commerce international et les autres échanges internationaux,
– à répondre aux besoins du commerce international et de la douane en matière de facilitation, de simplification et d'harmonisation des régimes douaniers et des pratiques douanières,
– à assurer l'établissement de normes adéquates en matière de contrôle douanier, et
– à permettre à la douane de faire face aux changements majeurs intervenus dans le commerce et dans les méthodes et techniques administratives,
la Convention doit être amendée,
CONSIDERANT également que la Convention amendée:
– doit assurer que les principes fondamentaux régissant cette simplification et cette harmonisation ont un caractère contraignant à l'égard des Parties contractantes à cette Convention,
– doit permettre à la douane de se doter de procédures efficaces appuyées par des méthodes de contrôle adéquates et efficaces, et
– permettra de parvenir à un degré élevé de simplification et d'harmonisation des régimes douaniers et des pratiques douanières, ce qui est un objectif essentiel du Conseil, et d'apporter ainsi une contribution majeure à la facilitation du commerce international,
Sont convenues de ce qui suit:
ARTICLE 1
Le préambule et les articles de la Convention sont amendés conformément au texte figurant à l'appendice I du présent Protocole.
ARTICLE 2
Les Annexes de la Convention sont remplacées par l'Annexe générale figurant à l'appendice II et les Annexes spécifiques figurant à l'appendice III du présent Protocole.
ARTICLE 3
1. Toute Partie contractante à la Convention peut exprimer son consentement à être liée par le présent Protocole, y compris les appendices I et II:
a) en le signant sans réserve de ratification;
b) en déposant un instrument de ratification après l'avoir signé sous réserve de ratification, ou
c) en y adhérant.
2. Le présent Protocole est ouvert jusqu'au 30 juin 2000, au siège du Conseil à Bruxelles, à la signature des Parties contractantes à la Convention. Après cette date, il sera ouvert à l'adhésion.
3. Le présent Protocole, y compris les appendices I et II, entre en vigueur trois mois après que quarante Parties contractantes ont signé le Protocole sans réserve de ratification ou ont déposé leurs instruments de ratification ou d'adhésion.
4. Après que quarante Parties contractantes ont exprimé leur consentement à être liées par le présent Protocole, conformément au paragraphe 1, une Partie contractante à la Convention accepte les amendements à la Convention uniquement en devenant partie au présent Protocole. Le Protocole entre en vigueur à l'égard de cette Partie contractante trois mois après qu'elle l'a signé sans réserve de ratification ou après qu'elle a déposé un instrument de ratification ou d'adhésion.
ARTICLE 4
Une Partie contractante à la Convention peut, au moment où elle exprime son consentement à être liée par le présent Protocole, accepter une ou plusieurs des Annexes spécifiques ou des Chapitres de celles-ci figurant à l'appendice III et elle informe le Secrétaire général du Conseil de cette acceptation ainsi que des pratiques recommandées à l'égard desquelles elle a émis des réserves.
ARTICLE 5
Après l'entrée en vigueur du présent Protocole, le Secrétaire général du Conseil n'accepte aucun instrument de ratification ou d'adhésion à la Convention.
ARTICLE 6
Dans les relations entre les parties au présent Protocole, le présent Protocole et ses appendices se substituent à la Convention.
ARTICLE 7
Le Secrétaire général du Conseil est le dépositaire du présent Protocole et assume les responsabilités telles que prévues à l'article 19 figurant à l'appendice I du présent Protocole.
ARTICLE 8
Le présent Protocole sera ouvert à la signature des Parties contractantes à la Convention, au siège du Conseil à Bruxelles, à compter du 26 juin 1999.
ARTICLE 9
Conformément à l'article 102 de la Charte des Nations Unies, le présent Protocole et ses appendices seront enregistré au Secrétariat des Nations unies à la requête du Secrétaire général du Conseil.
En foi de quoi les soussignés à ce dûment autorisés ont signé le présent Protocole.
Fait à Bruxelles, le vingt-six juin mil neuf cent quatre-vingt-dix-neuf, en langues française et anglaise, les deux textes faisant également foi, en un seul exemplaire qui sera déposé auprès du Secrétaire général du Conseil qui en transmettra des copies certifiées conformes à toutes les entités visées au paragraphe 1 de l'article 8 figurant à l'appendice I du présent Protocole.

CONVENTION INTERNATIONALE

ET L'HARMONISATION
DES REGIMES DOUANIERS

PREAMBULE
Les Parties contractantes à la présente Convention élaborée sous les auspices du Conseil de coopération douanière,
S'EFFORCANT d'éliminer les disparités entre les régimes douaniers et les pratiques douanières des Parties contractantes, qui peuvent entraver le commerce international et les autres échanges internationaux,
DESIRANT apporter une contribution efficace au développement du commerce et de ces échanges en simplifiant et en harmonisant les régimes douaniers et les pratiques douanières et en favorisant la coopération internationale,
NOTANT que les avantages significatifs procurés par la facilitation du commerce international peuvent être obtenus sans porter atteinte aux normes régissant normalement le contrôle douanier,
RECONNAISSANT que cette simplification et cette harmonisation peuvent être accomplies notamment en appliquant les principes ci-après:
– la mise en oeuvre de programmes en vue de moderniser constamment les régimes et pratiques douaniers et d'améliorer leur efficacité et leur rendement,
– l'application de régimes douaniers et de pratiques douanières de manière prévisible, cohérente et transparente,
– la mise à la disposition des parties intéressées de tous les renseignements nécessaires concernant les lois, réglementations, directives administratives, régimes et pratiques de la douane,
– l'adoption de techniques modernes telles que les systèmes de gestion des risques et les contrôles par audit, ainsi que l'utilisation qui soit la plus large possible de la technologie de l'information,
– la coopération, lorsqu'il y a lieu, avec les autres autorités nationales, les autres administrations des douanes et les milieux commerciaux,
– la mise en oeuvre de normes internationales pertinentes,
– l'ouverture aux parties lésées de voies de recours administratives et judiciaires d'un accès facile,
CONVAINCUES qu'un instrument international reprenant les objectifs et les principes ci-dessus que les Parties contractantes s'engagent à mettre en oeuvre est de nature à conduire au haut degré de simplification et d'harmonisation des régimes douaniers et des pratiques douanières qui est l'un des principaux buts du Conseil de coopération douanière, apportant ainsi une contribution majeure à la facilitation du commerce international,
Sont convenues de ce qui suit:
CHAPITRE I
Définitions
Article 1
Pour l'application de la présente Convention, on entend par:
a) "norme": une disposition dont la mise en oeuvre est reconnue comme étant nécessaire pour aboutir à l'harmonisation et la simplification des régimes douaniers et des pratiques douanières;
b) "norme transitoire": une norme de l'Annexe générale pour laquelle un délai de mise en oeuvre plus long est accordé;
c) "pratique recommandée": une disposition d'une Annexe spécifique reconnue comme constituant un progrès dans la voie de l'harmonisation et de la simplification des régimes douaniers et pratiques douanières et dont l'application la plus large possible est jugée souhaitable;
d) "législation nationale": les lois, règlements et autres mesures imposés par une autorité compétente d'une Partie contractante et applicables sur l'ensemble du territoire de la Partie contractante concernée, ou les traités en vigueur par lesquels cette Partie est liée;
e) "Annexe générale": l'ensemble de dispositions applicables à tous les régimes douaniers et pratiques douanières visés par la présente Convention;
f) "Annexe spécifique": un ensemble de dispositions applicables à un ou plusieurs régimes douaniers et pratiques douanières visés par la présente Convention;
g) "Directives": un jeu d'explications des dispositions de l'Annexe générale, des Annexes spécifiques et des Chapitres de celles-ci, qui indique certaines des lignes de conduite pouvant être suivies pour appliquer les normes, les normes transitoires et les pratiques recommandées, et qui précise les pratiques conseillées ainsi que les exemples de facilités plus grandes recommandées;
h) "Comité technique permanent": le Comité technique permanent du Conseil;
ij) "Conseil": l'organisation établie par la Convention portant création d'un Conseil de coopération douanière, conclue à Bruxelles le 15 décembre 1950;
k) "Union douanière ou économique": une Union constituée et composée par des Etats ayant compétence pour adopter sa propre réglementation qui est obligatoire pour ces Etats dans les matières couvertes par la présente Convention et pour décider, selon ses procédures internes, de signer ou de ratifier la présente Convention ou d'y adhérer.
CHAPITRE II
CHAMP D'APPLICATION ET STRUCTURE
Champ d'application de la Convention
Article 2
Chaque Partie contractante s'engage à promouvoir la simplification et l'harmonisation des régimes douaniers et, à cette fin, à se conformer, dans les conditions prévues par la présente Convention, aux normes, normes transitoires et pratiques recommandées faisant l'objet des Annexes à la présente Convention. Toutefois, il est loisible à toute Partie contractante d'accorder des facilités plus grandes que celles que prévoit la Convention et il est recommandé à chaque Partie contractante d'accorder de telles facilités dans toute la mesure possible.
Article 3
Les dispositions de la présente Convention ne font pas obstacle à l'application de la législation nationale pour ce qui concerne, soit les prohibitions, soit les restrictions portant sur les marchandises assujetties à un contrôle douanier.
Structure de la Convention
Article 4
1. La convention comprend un Corps, une Annexe générale et des Annexes spécifiques.
2. L'Annexe générale et chaque Annexe spécifique de la présente Convention se composent de Chapitres qui constituent une subdivision de l'Annexe et comprennent:
a) des définitions, et
b) des normes, dont certaines, contenues dans l'Annexe générale, sont transitoires.
3. Chaque Annexe spécifique contient également des pratiques recommandées.
4. Chaque Annexe est accompagnée de Directives dont les textes ne lient pas les Parties contractantes.
Article 5
Pour l'application de la présente Convention, les Annexes spécifiques et les Chapitres de celles-ci en vigueur à l'égard d'une Partie contractante sont considérés comme faisant partie intégrante de la Convention et en ce qui concerne cette Partie contractante, toute référence à la Convention est considérée comme faisant également référence à ces Annexes et Chapitres.
CHAPITRE III
GESTION DE LA CONVENTION
Comité de gestion
Article 6
1. Un Comité de gestion est créé pour examiner la mise en application de la présente Convention et étudier toute mesure destinée à en assurer une interprétation et une application uniformes ainsi que tout amendement proposé.
2. Les Parties contractantes sont membres du Comité de gestion.
3. L'administration compétente de toute entité qui, aux termes de l'article 8, remplit les conditions pour devenir Partie contractante à la présente Convention ou de tout Membre de l'Organisation mondiale du commerce, peut assister aux sessions du Comité de gestion en qualité d'observateur. Le statut et les droits de ces observateurs sont définis par une Décision du Conseil. Les droits visés ci-avant ne peuvent être exercés avant l'entrée en vigueur de la Décision.
4. Le Comité de gestion peut inviter les représentants d'organisations internationales, gouvernementales et non gouvernementales à assister aux sessions du Comité de gestion en qualité d'observateurs.
5. Le Comité de gestion:
a) recommande aux Parties contractantes:
i) les amendements à apporter au Corps de la présente Convention;
ii) les amendements à apporter à l'Annexe générale, aux Annexes spécifiques et aux Chapitres de celles-ci, l'adjonction de nouveaux Chapitres à l'Annexe générale, et
iii) l'adjonction de nouvelles Annexes spécifiques et de nouveaux Chapitres dans les Annexes spécifiques;
b) peut décider d'amender les pratiques recommandées ou d'insérer de nouvelles pratiques recommandées dans les Annexes spécifiques ou Chapitres de celles-ci, conformément à l'article 16;
c) envisage la mise en oeuvre des dispositions de la présente Convention conformément au paragraphe 4 de l'article 13;
d) procède à la révision et à la mise à jour des Directives;
e) prend en considération toute autre question qui lui est soumise en rapport avec la présente Convention;
f) informe le Comité technique permanent et le Conseil de ses décisions.
6. Les administrations compétentes des Parties contractantes communiquent au Secrétaire général du Conseil les propositions visées aux alinéas a), b), c) ou d) du paragraphe 5 de cet article et les raisons qui les motivent, ainsi que les demandes d'inscription de questions à l'ordre du jour des sessions du Comité de gestion. Le Secrétaire général du Conseil porte les propositions d'amendement à la connaissance des administrations compétentes des Parties contractantes et des observateurs visés aux paragraphes 2, 3 et 4 du présent article.
7. Le Comité de gestion se réunit au moins une fois par an. Il procède annuellement à l'élection de son Président et de son Vice-Président. Le Secrétaire général du Conseil distribue l'invitation et le projet d'ordre du jour aux administrations compétentes des Parties contractantes et aux observateurs visés aux paragraphes 2, 3 et 4 du présent article au moins six semaines avant la session du Comité de gestion.
8. Lorsqu'une décision ne peut être prise par voie de consensus, les questions soumises au Comité de gestion sont mises aux voix des Parties contractantes présentes. Les propositions faites au titre des alinéas a), b) ou c) du paragraphe 5 du présent article sont approuvées à la majorité des deux tiers des voix émises. Le Comité de gestion décide de toutes les autres questions à la majorité des voix émises.
9. En cas d'application de l'article 8, paragraphe 5, de la présente Convention, les Unions douanières ou économiques qui sont Parties contractantes ne disposent, en cas de vote, que d'un nombre de voix égal au total des voix attribuables à leurs Membres qui sont Parties contractantes.
10. Le Comité de gestion adopte un rapport avant la clôture de sa session. Ce rapport est transmis au Conseil ainsi qu'aux Parties contractantes et aux observateurs visés aux paragraphes 2, 3 et 4.
11. En l'absence de dispositions spécifiques dans le présent article, le Règlement intérieur du Conseil est applicable, sauf si le Comité de gestion en décide autrement.
Article 7
Aux fins du vote au sein du Comité de gestion, il est procédé séparément au vote sur chaque Annexe spécifique et sur chaque Chapitre d'une Annexe spécifique.
a) Chaque Partie contractante est habilitée à voter s'agissant des questions relatives à l'interprétation, à l'application et à l'amendement du Corps et de l'Annexe générale de la Convention.
b) Pour ce qui concerne les questions relatives à une Annexe spécifique ou à un Chapitre d'une Annexe spécifique déjà en vigueur, seules sont habilitées à voter les Parties contractantes qui ont accepté cette Annexe ou ce Chapitre.
c) Chaque Partie contractante est habilitée à voter s'agissant des projets de nouvelles Annexes spécifiques ou de nouveaux Chapitres d'une Annexe spécifique.
CHAPITRE IV
PARTIE CONTRACTANTE
Ratification de la Convention
Article 8
1. Tout Membre du Conseil et tout Membre de l'Organisation des Nations Unies ou de ses institutions spécialisées peut devenir Partie contractante à la présente Convention:
a) en la signant, sans réserve de ratification;
b) en déposant un instrument de ratification après l'avoir signée sous réserve de ratification, ou
c) en y adhérant.
2. La présente Convention est ouverte jusqu'au 30 juin 1974 au siège du Conseil, à Bruxelles, à la signature des Membres visés au paragraphe 1 du présent article. Après cette date, elle sera ouverte à l'adhésion de ces Membres.
3. Toute Partie contractante précise, au moment de signer ou de ratifier la présente Convention ou d'y adhérer, la ou les Annexes spécifiques ou le ou les Chapitres de celles-ci qu'elle accepte. Elle peut ultérieurement notifier au dépositaire qu'elle accepte une ou plusieurs autres Annexes spécifiques ou Chapitres de celles-ci.
4. Les Parties contractantes qui acceptent une nouvelle Annexe spécifique ou un nouveau Chapitre d'une Annexe spécifique le notifient au dépositaire conformément au paragraphe 3 du présent article.
5. a) Toute Union douanière ou économique peut, conformément aux dispositions des paragraphes 1, 2 et 3 du présent article, devenir Partie contractante à la présente Convention. Elle informe alors le dépositaire de sa compétence en relation avec les matières couvertes par la présente Convention. Elle informe également le dépositaire de toute modification substantielle apportée à l'étendue de sa compétence.
b) Les Unions douanières ou économiques Parties contractantes à la présente Convention exercent, pour les questions qui relèvent de leur compétence, en leur nom propre, les droits et s'acquittent des responsabilités que la présente Convention confère aux Membres de ces Unions qui sont Parties contractantes à la présente Convention. En pareil cas, les Membres de ces Unions ne sont pas habilités à exercer individuellement ces droits, y compris le droit de vote.
Article 9
1. Toute Partie contractante qui ratifie la présente Convention ou y adhère est liée par les amendements à la présente Convention, y compris l'Annexe générale, entrés en vigueur à la date du dépôt de son instrument de ratification ou d'adhésion.
2. Toute Partie contractante qui accepte une Annexe spécifique ou un Chapitre de celle-ci est liée par les amendements aux normes figurant dans cette Annexe spécifique ou dans ce Chapitre entrés en vigueur à la date à laquelle elle notifie son acceptation au dépositaire. Toute Partie contractante qui accepte une Annexe spécifique ou un Chapitre de celle-ci est liée par les amendements aux pratiques recommandées qui y figurent et qui sont entrés en vigueur à la date à laquelle la Partie contractante notifie son acceptation au dépositaire, sauf si elle formule des réserves conformément à l'article 12 de la présente Convention à l'égard d'une ou de plusieurs de ces pratiques recommandées.
Application de la Convention
Article 10
1. Toute Partie contractante peut, soit au moment de la signature sans réserve de ratification, de la ratification ou de l'adhésion, soit ultérieurement, notifier au dépositaire que la présente Convention s'étend à l'ensemble ou à certains des territoires dont les relations internationales sont placées sous sa responsabilité. Cette notification prend effet trois mois après la date à laquelle le dépositaire la reçoit. Toutefois, la Convention ne peut devenir applicable aux territoires désignés dans la notification avant qu'elle ne soit entrée en vigueur à l'égard de la Partie contractante intéressée.
2. Toute Partie contractante ayant, en application du paragraphe 1 du présent article, notifié que la présente Convention s'étend à un territoire dont les relations internationales sont placées sous sa responsabilité, peut notifier au dépositaire, dans les conditions prévues à l'article 19 de la présente Convention, que ce territoire cessera d'appliquer la Convention.
Article 11
Aux fins de l'application de la présente Convention, les Unions douanières ou économiques qui sont Parties contractantes notifient au Secrétaire général du Conseil les territoires qui constituent l'Union douanière ou économique, et ces territoires sont à considérer comme un seul territoire.
Acceptation des dispositions et formulation des réserves
Article 12
1. Chaque Partie contractante est liée par l'Annexe générale.
2. Une Partie contractante peut accepter une ou plusieurs Annexes spécifiques ou n'accepter qu'un ou plusieurs Chapitres d'une Annexe spécifique. Une Partie contractante qui accepte une Annexe spécifique ou un ou plusieurs Chapitres de celle-ci est liée par toutes les normes y figurant. Une Partie contractante qui accepte une Annexe spécifique ou un ou plusieurs Chapitres de celle-ci est liée par l'ensemble des pratiques recommandées figurant dans cette Annexe ou ce ou ces Chapitres, à moins qu'elle ne notifie au dépositaire, au moment de l'acceptation ou ultérieurement, la ou les pratiques recommandées pour laquelle ou lesquelles elle formule des réserves en indiquant les différences existant entre les dispositions de sa législation nationale et celles de la ou des pratiques recommandées en cause. Toute Partie contractante ayant formulé des réserves peut, à tout moment, les lever, en tout ou en partie, par notification au dépositaire en indiquant la date à laquelle ces réserves sont levées.
3. Chaque Partie contractante liée par une Annexe spécifique ou un ou des Chapitres de celle-ci examine la possibilité de renoncer aux réserves formulées à l'égard des pratiques recommandées aux termes du paragraphe 2, et notifie au Secrétaire général du Conseil les résultats de cet examen à l'issue de chaque période de trois ans commençant à partir de l'entrée en vigueur de cette Convention pour cette Partie contractante, en précisant quelles sont les dispositions de sa législation nationale qui s'opposent, selon elle, à la levée des réserves émises.
Mise en oeuvre des dispositions
Article 13
1. Chaque Partie contractante met en application les normes de l'Annexe générale ainsi que des Annexes spécifiques ou des Chapitres de celles-ci qu'elle a acceptés dans un délai de 36 mois après que ces Annexes ou Chapitres sont entrés en vigueur à son égard.
2. Chaque partie contractante met en application les normes transitoires de l'Annexe générale dans les 60 mois à partir du moment où l'Annexe générale est entrée en vigueur à son égard.
3. Chaque Partie contractante met en application les pratiques recommandées des Annexes spécifiques ou des Chapitres de celles-ci qu'elle a acceptés, dans un délai de 36 mois après que ces Annexes spécifiques ou Chapitres sont entrés en vigueur à son égard à moins que des réserves n'aient été émises à l'égard d'une ou plusieurs de ces pratiques recommandées.
4. a) Lorsque la période prévue au paragraphe 1 ou 2 du présent article pourrait, dans la pratique, se révéler insuffisante pour une Partie contractante souhaitant mettre en oeuvre les dispositions de l'Annexe générale, cette Partie contractante peut, avant la fin de la période visée au paragraphe 1 ou 2 du présent article, en demander la prolongation au Comité de gestion. Au moment d'introduire sa demande, la Partie contractante indique la ou les dispositions de l'Annexe générale pour lesquelles une prolongation du délai est demandée en précisant les motifs de cette demande.
b) Dans des circonstances exceptionnelles, le Comité de gestion peut décider d'accorder la prolongation demandée. Toute décision du Comité de gestion visant à accorder cette prolongation contiendra un énoncé des circonstances exceptionnelles qui ont motivé sa décision et ce délai ne dépassera en aucun cas une durée d'un an. À l'expiration du délai prorogé, la Partie contractante informe le dépositaire de l'entrée en vigueur des dispositions à l'égard desquelles la prolongation a été accordée.
Règlement des différends
Article 14
1. Tout différend entre deux ou plusieurs Parties contractantes en ce qui concerne l'interprétation ou l'application de la présente Convention est réglé, autant que possible, par voie de négociations directes entre lesdites Parties.
2. Tout différend qui n'est pas réglé par voie de négociations directes est porté par les Parties contractantes en cause devant le Comité de gestion qui l'examine et formule des recommandations en vue de son règlement.
3. Les Parties contractantes en cause peuvent convenir d'avance d'accepter les recommandations du Comité de gestion et de les considérer comme contraignantes.
Amendements à la Convention
Article 15
1. Le texte de tout amendement recommandé aux Parties contractantes par le Comité de gestion conformément au paragraphe 5 a) i) et ii) de l'article 6 est communiqué par le Secrétaire général du Conseil à toutes les Parties contractantes et aux Membres du Conseil qui ne sont pas Parties contractantes.
2. Les amendements apportés au Corps de la Convention entrent en vigueur à l'égard de toutes les Parties contractantes douze mois après le dépôt des instruments d'acceptation par les Parties contractantes présentes à la session du Comité de gestion pendant laquelle les amendements ont été recommandés, pour autant qu'aucune des Parties contractantes n'ait formulé d'objection dans un délai de douze mois à compter de la date de communication de ces amendements.
3. Tout amendement recommandé à l'Annexe générale, aux Annexes spécifiques et aux Chapitres de celles-ci est considéré comme ayant été accepté six mois après la date de communication de la recommandation d'amendement aux Parties contractantes, à moins:
a) qu'une objection n'ait été formulée par une Partie contractante ou, dans le cas d'une Annexe spécifique ou d'un Chapitre, par une Partie contractante liée par cette Annexe spécifique ou ce Chapitre, ou
b) qu'une Partie contractante informe le Secrétaire général du Conseil que, bien qu'elle ait l'intention d'accepter l'amendement recommandé, les conditions nécessaires à cette acceptation ne se trouvent pas encore remplies.
4. Aussi longtemps qu'une Partie contractante qui a adressé la communication prévue au paragraphe 3 b) du présent article n'a pas notifié son acceptation au Secrétaire général du Conseil, elle peut, pendant un délai de dix-huit mois à partir de l'expiration du délai de six mois prévu au paragraphe 3 du présent article, présenter une objection à l'amendement recommandé.
5. Si une objection à l'amendement recommandé est notifiée dans les conditions prévues aux paragraphes 3 a) ou 4 du présent article, l'amendement est considéré comme n'ayant pas été accepté et reste sans effet.
6. Lorsqu'une Partie contractante a adressé une communication en application du paragraphe 3 b) du présent article, l'amendement est réputé accepté à la plus rapprochée des deux dates suivantes:
a) la date à laquelle toutes les Parties contractantes ayant adressé une telle communication ont notifié au Secrétaire général du Conseil leur acceptation de l'amendement recommandé, cette date étant toutefois reportée à l'expiration du délai de six mois visé au paragraphe 3 du présent article si toutes les acceptations ont été notifiées antérieurement à cette expiration;
b) la date d'expiration du délai de dix-huit mois visé au paragraphe 4 du présent article.
7. Tout amendement réputé accepté concernant l'Annexe générale ou les Annexes spécifiques et Chapitres de celles-ci entre en vigueur soit six mois après la date à laquelle il a été réputé accepté, soit, lorsque l'amendement recommandé est assorti d'un délai d'entrée en vigueur différent, à l'expiration de ce délai suivant la date à laquelle il a été réputé accepté.
8. Le Secrétaire général du Conseil notifie, le plus tôt possible, aux Parties contractantes à la présente Convention toute objection à l'amendement recommandé formulée conformément au paragraphe 3 a) du présent article, ainsi que toute communication adressée conformément au paragraphe 3 b). Il fait savoir ultérieurement aux Parties contractantes si la ou les Parties contractantes qui ont adressé une telle communication élèvent une objection contre l'amendement recommandé ou l'acceptent.
Article 16
1. Indépendamment de la procédure d'amendement prévue à l'article 15 de la présente Convention, le Comité de gestion peut, conformément à l'article 6, décider d'amender toute pratique recommandée d'une Annexe spécifique ou d'un Chapitre de celle-ci ou d'y insérer de nouvelles pratiques recommandées. Chaque Partie contractante est invitée, par le Secrétaire général du Conseil, à prendre part aux délibérations du Comité de gestion. Le texte de tout amendement et de toute nouvelle pratique recommandée ainsi arrêté est communiqué par le Secrétaire général du Conseil aux Parties contractantes et aux Membres du Conseil qui ne sont pas Parties contractantes à la présente Convention.
2. Tout amendement ou adjonction de nouvelles pratiques recommandées qui a fait l'objet d'une décision en application du paragraphe 1 du présent article entre en vigueur six mois après que communication en a été faite par le Secrétaire général du Conseil. Chaque Partie contractante liée par une Annexe spécifique ou un Chapitre d'une Annexe spécifique faisant l'objet de tels amendements, adjonctions de nouvelles pratiques recommandées est réputée avoir accepté ces amendements ou ces nouvelles pratiques recommandées sauf si elle formule des réserves dans les conditions prévues à l'article 12 de la présente Convention.
Durée de l'adhésion
Article 17
1. La présente Convention est conclue pour une durée illimitée. Toutefois, toute Partie contractante peut la dénoncer à tout moment après la date de son entrée en vigueur telle qu'elle est fixée à l'article 18 de la présente Convention.
2. La dénonciation est notifiée par un instrument écrit déposé auprès du dépositaire.
3. La dénonciation prend effet six mois après la réception de l'instrument de dénonciation par le dépositaire.
4. Les dispositions des paragraphes 2 et 3 du présent article sont également applicables en ce qui concerne les Annexes spécifiques ou les Chapitres de celles-ci, à l'égard desquels toute Partie contractante peut retirer son acceptation à tout moment après la date de leur entrée en vigueur.
5. Toute Partie contractante qui retire son acceptation de l'Annexe générale, sera réputée avoir dénoncé la Convention. Dans ce cas, les dispositions des paragraphes 2 et 3 sont également applicables.
CHAPITRE V
DISPOSITIONS FINALES
Entrée en vigueur de la Convention
Article 18
1. La présente Convention entre en vigueur trois mois après que cinq des entités mentionnées aux paragraphes 1 et 5 de l'article 8 ci-dessus ont signé la présente Convention sans réserve de ratification ou ont déposé leur instrument de ratification ou d'adhésion.
2. La présente Convention entre en vigueur à l'égard de toute Partie contractante trois mois après que celle-ci est devenue Partie contractante conformément aux dispositions de l'article 8.
3. Les Annexes spécifiques de la présente Convention ou leurs Chapitres entrent en vigueur trois mois après que cinq Parties contractantes les ont acceptés.
4. Après l'entrée en vigueur d'une Annexe spécifique ou d'un Chapitre de celle-ci conformément au paragraphe 3 du présent article, cette Annexe spécifique ou ce Chapitre entre en vigueur à l'égard de toute Partie contractante trois mois après que celle-ci a notifié son acceptation. Toutefois, les Annexes spécifiques ou les chapitres n'entrent en vigueur à l'égard d'une Partie contractante que lorsque la Convention entre elle-même en vigueur à l'égard de cette Partie contractante.
Dépositaire de la Convention
Article 19
1. La présente Convention, toutes les signatures avec ou sans réserve de ratification et tous les instruments de ratification ou d'adhésion sont déposés auprès du Secrétaire général du Conseil.
2. Le dépositaire:
a) reçoit les textes originaux de la présente Convention et en assure la garde;
b) établit des copies certifiées conformes des textes originaux de la présente Convention et les communique aux Parties contractantes, aux Membres du Conseil qui ne sont pas Parties contractantes et au Secrétaire général de l'Organisation des Nations Unies;
c) reçoit toutes signatures avec ou sans réserve de ratification, ratifications ou adhésions à la présente Convention, reçoit et assure la garde de tous instruments, notifications et communications relatifs à la présente Convention;
d) examine si la signature ou tout instrument, notification ou communication se rapportant à la présente Convention est en bonne et due forme et, le cas échéant, porte la question à l'attention de la Partie contractante en cause;
e) notifie aux Parties contractantes, aux Membres du Conseil qui ne sont pas Parties contractantes et au Secrétaire général de l'Organisation des Nations Unies:
– les signatures, ratifications, adhésions et acceptations d'Annexes et de Chapitres visés à l'article 8 de la présente Convention,
– les nouveaux Chapitres de l'Annexe générale et les nouvelles Annexes spécifiques ou les nouveaux Chapitres de celles-ci que le Comité de gestion décide de recommander d'incorporer à la présente Convention,
– la date à laquelle la présente Convention, l'Annexe générale et chaque Annexe spécifique ou Chapitre de celle-ci entre en vigueur conformément à l'article 18 de la présente Convention,
– les notifications reçues conformément aux articles 8, 10, 11, 12 et 13 de la présente Convention,
– le retrait de l'acceptation des Annexes/Chapitres par les Parties contractantes,
– les dénonciations reçues conformément à l'article 17 de la présente Convention, et
– les amendements acceptés conformément à l'article 15 de la présente Convention ainsi que la date de leur entrée en vigueur.
3. Lorsqu'une divergence apparaît entre une Partie contractante et le dépositaire au sujet de l'accomplissement des fonctions de ce dernier, le dépositaire ou cette Partie contractante doit porter la question à l'attention des autres Parties contractantes et des signataires ou, selon le cas, du Comité de gestion ou du Conseil.
Enregistrement et textes faisant foi
Article 20
Conformément à l'article 102 de la Charte des Nations Unies, la présente Convention sera enregistrée au Secrétariat des Nations Unies à la requête du Secrétaire général du Conseil.
En foi de quoi les soussignés à ce dûment autorisés ont signé la présente Convention.
Fait à Kyoto, le dix-huit mai mil neuf cent soixante-treize, en langues française et anglaise, les deux textes faisant également foi, en un seul exemplaire qui sera déposé auprès du Secrétaire général du Conseil qui en transmettra des copies certifiées conformes à toutes les entités visées au paragraphe 1 de l'article 8 de la présente Convention.

CHAPITRE 1
PRINCIPES GENERAUX
1.1. Norme
Les définitions, normes et normes transitoires de la présente Annexe s'appliquent aux régimes douaniers et pratiques douanières couverts par celle-ci et, dans la mesure où ils s'appliquent, aux régimes et pratiques couverts par les Annexes spécifiques.
 
1.2. Norme
Les conditions à remplir et les formalités douanières à accomplir aux fins des régimes et pratiques couverts par la présente Annexe et par les Annexes spécifiques sont définies dans la législation nationale et sont aussi simples que possible.
 
1.3. Norme
La douane institue et entretient officiellement des relations d'ordre consultatif avec le commerce afin de renforcer la coopération et de faciliter la participation, en établissant, en fonction des dispositions nationales et des accords internationaux, les méthodes de travail les plus efficaces.
CHAPITRE 2
DEFINITIONS
    Pour l'application des Annexes de la présente Convention, on entend par:
F1./E21.  "assistance mutuelle administrative": les mesures prises par une
          administration douanière pour le compte d’une autre
          administration douanière ou en collaboration avec celle-ci, en
          vue de l’application correcte de la législation douanière et de
          la prévention, de la recherche et de la répression des
          infractions douanières;
F2./E11.  "bureau de douane": l’unité administrative compétente pour la
          réalisation des formalités douanières ainsi que les locaux et
          autres emplacements approuvés à cet effet par les autorités
          compétentes;
F3./E7.   "contrôle de la douane": l’ensemble des mesures prises par la
          douane en vue d’assurer l’application de la législation
          douanière;
F4./E3.   "contrôle par audit": les mesures grâce auxquelles la douane
          s’assure de l’exactitude et de l’authenticité des déclarations en
          examinant les livres, registres, systèmes comptables et données
          commerciales pertinents détenus par les personnes concernées;
F5./E15.  "date d’échéance": la date à laquelle le paiement des droits et
          taxes est exigible;
F6./E13.  "décision": l’acte particulier par lequel la douane règle une
          question relative à la législation douanière;
F7./E14.  "déclarant": toute personne qui fait une déclaration de
          marchandises ou au nom de laquelle cette déclaration est faite;
F8./E19.  "déclaration de marchandises": l’acte fait dans la forme
          prescrite par la douane, par lequel les intéressés indiquent le
          régime douanier à assigner aux marchandises et communique les

          résultant de plusieurs opérations;

          législatives et réglementaires concernant l’importation,
          l’exportation, l'acheminement ou le stockage des marchandises que
          la douane est expressément chargée d’appliquer et des
          réglementations éventuellement arrêtées par la douane en vertu
          des pouvoirs qui lui ont été attribués par la loi;
F19./E2.  "liquidation des droits et taxes": la détermination du montant
          des droits et taxes à percevoir;
F20./E24  "mainlevée": l’acte par lequel la douane permet aux intéressés de
          disposer des marchandises qui font l’objet d’un dédouanement;
F21./E22. "omission": le fait pour la douane de ne pas agir ou ne pas
          prendre dans un délai raisonnable les mesures que lui impose la
          législation douanière sur une question dont elle a été
          régulièrement saisie;
F22./E23. "personne": une personne physique aussi bien qu’une personne
          morale, à moins que le contexte n’en dispose autrement;
F23./E1.  "recours": l’acte par lequel une personne directement concernée
          qui s’estime lésée par une décision ou une omission de la douane
          se pourvoit devant une autorité compétente;
F24./E25. "remboursement": la restitution, totale ou partielle, des droits
          et taxes acquittés sur les marchandises et la remise, totale ou
          partielle, des droits et taxes dans le cas où ils n’auraient pas
          été acquittés;
F25./E12. "territoire douanier": le territoire dans lequel la législation
          douanière d’une Partie contractante s’applique;
F26./E27. "tiers": toute personne qui, agissant pour le compte d’une autre
          personne, traite directement avec la douane en ce qui concerne
          l’importation, l’exportation, l’acheminement ou le stockage des
          marchandises;
F27./E17. "vérification des marchandises": l’opération par laquelle la
          douane procède à l’examen physique des marchandises afin de
          s’assurer que leur nature, leur origine, leur état, leur quantité
          et leur valeur sont conformes aux données de la déclaration de
          marchandises.
CHAPITRE 3
FORMALITES DE DEDOUANEMENT ET AUTRES FORMALITES DOUANIERES
Bureaux de douane compétents
3.1. Norme
La douane désigne les bureaux de douane dans lesquels les marchandises peuvent être présentées ou dédouanées. Elle détermine la compétence et l'implantation de ces bureaux de douane et en fixe les jours et heures d'ouverture, en tenant compte, notamment, des nécessités du commerce.
 
3.2. Norme
Sur demande de l'intéressé pour des raisons jugées valables par la douane, cette dernière s'acquitte des fonctions qui lui incombent aux fins d'un régime douanier ou d'une pratique douanière en dehors des heures d'ouverture fixées par l'administration ou dans un lieu autre que le bureau de douane, dans la mesure des ressources disponibles. Les frais éventuels à percevoir par la douane sont limités au coût approximatif des services rendus.
 
3.3. Norme
Lorsque des bureaux de douane sont situés au même point de passage d'une frontière commune, les administrations des douanes concernées harmonisent les heures d'ouverture ainsi que la compétence de ces bureaux.
 
3.4. Norme transitoire
Aux points de passage des frontières communes, les administrations des douanes concernées effectuent, chaque fois que possible, les contrôles en commun.
 
3.5. Norme transitoire
Lorsque la douane souhaite établir un nouveau bureau de douane ou transformer un bureau existant à un point de passage commun, elle collabore, chaque fois que possible, avec la douane voisine en vue d'établir un bureau de douane juxtaposé permettant de faciliter les contrôles communs.
Le déclarant
a) Personnes pouvant agir en qualité de déclarant
 
3.6. Norme
La législation nationale stipule les conditions dans lesquelles une personne est autorisée à agir en qualité de déclarant.
 
3.7. Norme
Toute personne ayant le droit de disposer des marchandises peut agir en qualité de déclarant.
 
b) Responsabilité du déclarant
 
3.8. Norme
Le déclarant est tenu pour responsable envers la douane de l'exactitude des renseignements fournis dans la déclaration de marchandises et du paiement des droits et taxes.
 
c) Droits du déclarant
 
3.9. Norme
Avant le dépôt de la déclaration de marchandises et dans les conditions fixées par la douane, le déclarant est autorisé:
a) à examiner les marchandises, et
b) à prélever des échantillons.
 
3.10. Norme
La douane n'exige pas que les échantillons dont le prélèvement est autorisé sous son contrôle fassent l'objet d'une déclaration de marchandises distincte, à condition que lesdits échantillons soient repris dans la déclaration de marchandises relative au lot de marchandises dont ils proviennent.
La déclaration de marchandises
a) Formule et contenu de la déclaration de marchandises
 
3.11. Norme
Le contenu de la déclaration de marchandises est déterminé par la douane. Les déclarations de marchandises établies sur papier doivent être conformes à la formule-cadre des Nations Unies.
S'agissant de la procédure de dédouanement informatisée, la formule de déclaration de marchandises déposée par voie électronique doit être établie selon les normes internationales régissant la transmission électronique des données, comme indiqué dans les Recommandations du Conseil de coopération douanière relatives à la technologie de l'information.
 
3.12. Norme
La douane doit limiter ses exigences, en ce qui concerne les renseignements qui doivent être fournis dans la déclaration de marchandises, aux renseignements jugés indispensables pour permettre la liquidation et la perception des droits et taxes, l'établissement des statistiques et l'application de la législation douanière.
 
3.13. Norme
Le déclarant qui, pour des raisons jugées valables par la douane, ne dispose pas de tous les renseignements nécessaires pour établir la déclaration de marchandises, est autorisé à déposer une déclaration de marchandises provisoire ou incomplète, sous réserve qu'elle comporte les éléments jugés nécessaires par la douane et que le déclarant s'engage à compléter la déclaration de marchandises dans un délai déterminé.

L'enregistrement par la douane d'une déclaration de marchandises provisoire ou incomplète n'a pas pour effet d'accorder aux marchandises un traitement tarifaire différent de celui qui aurait été appliqué si une déclaration de marchandises établie de façon complète et exacte avait été déposée directement.
La mainlevée des marchandises n'est pas différée à condition que la garantie éventuellement exigée ait été fournie pour assurer le recouvrement des droits et taxes exigibles.

Pour les personnes agréées qui remplissent certains critères fixés par la douane, notamment du fait qu'elles ont des antécédents satisfaisants en matière douanière et utilisent un système efficace pour la gestion de leurs écritures commerciales, la douane prévoit:
– la mainlevée des marchandises sur la base du minimum de renseignements nécessaires pour identifier les marchandises et permettre l'établissement ultérieur de la déclaration de marchandises définitive,
– le dédouanement des marchandises dans les locaux du déclarant ou en tout autre lieu agréé par la douane, et, de plus, dans la mesure du possible, d'autres procédures spéciales telles que:
– le dépôt d'une seule déclaration de marchandises pour toutes les importations ou exportations effectuées pendant une période déterminée, lorsque ces opérations sont réalisées fréquemment par la même personne,
– la possibilité pour les personnes agréées de liquider elles-mêmes les droits et taxes en se référant à leurs propres écritures commerciales, sur lesquelles la douane s'appuie, le cas échéant, pour s'assurer de la conformité avec les autres prescriptions douanières,
– le dépôt de la déclaration de marchandises au moyen d'une mention dans les écritures de la personne agréée à compléter ultérieurement par une déclaration de marchandises complémentaire.
Vérification des marchandises
a) Délai pour la vérification des marchandises
 
3.33. Norme
Lorsque la douane décide de soumettre les marchandises déclarées à une vérification, celle-ci intervient le plus tôt possible après l'enregistrement de la déclaration de marchandises.
 
3.34. Norme
Lors de la planification des vérifications des marchandises, la priorité est accordée à la vérification des animaux vivants et des marchandises périssables et des autres marchandises dont le caractère urgent est accepté par la douane.
 
3.35. Norme transitoire
Lorsque les marchandises doivent être soumises à un contrôle par d'autres autorités compétentes et que la douane prévoit également une vérification, cette dernière prend les dispositions utiles pour une intervention coordonnée, et si possible simultanée, des contrôles.
 
b) Présence du déclarant lors de la vérification des marchandises
 
3.36. Norme
La douane prend en considération les demandes du déclarant qui souhaite être présent ou être représenté lors de la vérification des marchandises. Ces demandes sont acceptées, sauf circonstances exceptionnelles.
 
3.37. Norme
Lorsque la douane le juge utile, elle exige du déclarant qu'il assiste à la vérification des marchandises ou qu'il s'y fasse représenter, afin de fournir à la douane l'assistance nécessaire pour faciliter cette vérification.
 
c) Prélèvement d'échantillons par la douane
 
3.38. Norme
Les prélèvements d'échantillons sont limités aux cas où la douane estime que cette opération est nécessaire pour établir l'espèce tarifaire ou la valeur des marchandises déclarées ou pour assurer l'application des autres dispositions de la législation nationale. Les quantités de marchandises qui sont prélevées à titre d'échantillons doivent être réduites au minimum.
Erreurs
3.39. Norme
La douane n'inflige pas de lourdes pénalités en cas d'erreurs lorsqu'il est établi à sa satisfaction que ces erreurs ont été commises de bonne foi, sans intention délictueuse ni négligence grave. Lorsqu'elle juge nécessaire d'éviter toute récidive, elle peut infliger une pénalité qui ne devra cependant pas être trop lourde par rapport au but recherché.
Mainlevée des marchandises
 
3.40. Norme
La mainlevée est accordée pour les marchandises déclarées dès que la douane en a terminé la vérification ou a pris la décision de ne pas les soumettre à une vérification, sous réserve:
– qu'aucune infraction n'ait été relevée,
– que la licence d'importation ou d'exportation ou les autres documents nécessaires aient été communiqués,
– que toutes les autorisations relatives au régime considéré aient été communiquées, et
– que les droits et taxes aient été acquittés ou que les mesures nécessaires aient été prises en vue d'assurer leur recouvrement.
 
3.41. Norme
Lorsque la douane a l'assurance que toutes les formalités de dédouanement seront remplies ultérieurement par le déclarant, elle accorde la mainlevée, sous réserve que le déclarant produise un document commercial ou administratif acceptable par la douane et contenant les principales données relatives à l'envoi en cause, ainsi qu'une garantie, le cas échéant, en vue d'assurer le recouvrement des droits et taxes exigibles.
 
3.42. Norme
Lorsque la douane décide que les marchandises nécessitent une analyse d'échantillons en laboratoire, une documentation technique détaillée ou l'avis d'experts, elle accorde la mainlevée des marchandises avant de connaître les résultats de cette vérification, à condition que la garantie exigée le cas échéant ait été fournie et après s'être assurée que les marchandises ne font l'objet d'aucune prohibition ou restriction.
 
3.43. Norme
Lorsqu'une infraction a été constatée, la douane accorde la mainlevée sans attendre le règlement de l'action administrative ou judiciaire sous réserve que les marchandises ne soient pas passibles de confiscation ou susceptibles d'être présentées en tant que preuves matérielles à un stade ultérieur de la procédure et que le déclarant acquitte les droits et taxes et fournisse une garantie pour assurer le recouvrement de tous droits et taxes supplémentaires exigibles ainsi que de toute pénalité dont il pourrait être passible.
Abandon ou destruction des marchandises
3.44. Norme
Lorsque des marchandises n'ont pas encore obtenu la mainlevée pour la mise à la consommation ou qu'elles ont été placées sous un autre régime douanier et qu'aucune infraction n'a été relevée, la personne intéressée est dispensée du paiement des droits et taxes ou doit pouvoir en obtenir le remboursement:
– lorsqu'à sa demande et selon la décision de la douane, ces marchandises sont abandonnées au profit du Trésor public ou détruites ou traitées de manière à leur ôter toute valeur commerciale sous le contrôle de la douane. Tous frais y relatifs sont à la charge de la personne concernée,
– lorsque ces marchandises sont détruites ou irrémédiablement perdues par suite d'accident ou de force majeure, à condition que cette destruction ou cette perte soit dûment établie à la satisfaction de la douane,
– lorsqu'une partie des marchandises est manquante pour des raisons tenant à leur nature, à condition que ce manque soit dûment établi à la satisfaction de la douane.
Les déchets et débris résultant, le cas échéant, de la destruction, sont assujettis, en cas de mise à la consommation ou d'exportation, aux droits et taxes qui seraient applicables à ces déchets et débris s'ils étaient importés ou exportés dans cet état.
 
3.45. Norme transitoire
Lorsque la douane procède à la vente de marchandises qui n'ont pas été déclarées dans le délai prescrit ou pour lesquelles la mainlevée n'a pu être accordée bien qu'aucune infraction n'ait été relevée, le produit de la vente, déduction faite des droits et taxes applicables ainsi que de tous autres frais ou redevances encourus, est remis aux ayants droit ou, lorsque cela n'est pas possible, tenu à la disposition de ceux-ci pendant un délai déterminé.
CHAPITRE 4
DROITS ET TAXES
A. LIQUIDATION, RECOUVREMENT ET PAIEMENT DES DROITS ET TAXES
4.1. Norme
La législation nationale définit les conditions dans lesquelles les droits et taxes sont exigibles.
 
4.2. Norme
Le délai accordé pour la liquidation des droits et taxes exigibles est précisé dans la législation nationale. La liquidation est établie dès que possible après le dépôt de la déclaration de marchandises ou à partir du moment où les droits et taxes deviennent exigibles.
 
4.3. Norme
Les éléments qui servent de base pour la liquidation des droits et taxes et les conditions dans lesquelles ils doivent être déterminés sont énoncés dans la législation nationale.

La législation nationale fixe une valeur minimale ou un montant minimal de droits et taxes ou les deux à la fois, en deçà desquels aucun droit ni taxe n'est perçu.

Lorsque la douane constate que des erreurs commises lors de l'établissement de la déclaration de marchandises ou lors de la liquidation des droits et taxes occasionneront ou ont occasionné la perception ou le recouvrement d'un montant de droits et taxes inférieur à celui qui est légalement exigible, elle rectifie les erreurs et procède au recouvrement du montant impayé. Toutefois, lorsque le montant en cause est inférieur au montant minimal prescrit par la législation nationale, la douane ne procède pas à sa perception ou à son recouvrement.
B. PAIEMENT DIFFERE DES DROITS ET TAXES
4.15. Norme
Lorsque la législation nationale prévoit le paiement différé des droits et taxes, elle précise les conditions dans lesquelles cette facilité est accordée.
 
4.16. Norme
Le paiement différé est accordé, dans la mesure du possible, sans exiger des intérêts.
 
4.17. Norme
Le délai accordé pour le paiement différé des droits et taxes est d'au moins quatorze jours.
C. REMBOURSEMENT DES DROITS ET TAXES
4.18. Norme
Le remboursement est accordé lorsqu'il est établi que la prise en compte excédentaire des droits et taxes résulte d'une erreur commise lors de la liquidation.
 
4.19. Norme
Le remboursement est accordé pour les marchandises importées ou exportées dont il est reconnu, qu'au moment de l'importation ou de l'exportation, elles étaient défectueuses ou, pour toute autre cause, non conformes aux caractéristiques prévues et sont renvoyées au fournisseur ou à une autre personne désignée par ce dernier, à condition que:
– les marchandises soient réexportées dans un délai raisonnable, sans avoir fait l'objet d'aucune ouvraison ni réparation et sans avoir été utilisées dans le pays d'importation,
– les marchandises soient réimportées dans un délai raisonnable, sans avoir fait l'objet d'aucune ouvraison ni réparation et sans avoir été utilisées dans le pays vers lequel elles avaient été exportées.
Toutefois, l'utilisation des marchandises n'interdit pas le remboursement lorsqu'elle a été indispensable pour constater leurs défauts ou tout autre fait motivant leur réexportation ou réimportation.
Au lieu d'être réexportées ou réimportées, les marchandises peuvent être, selon la décision de la douane, abandonnées au profit du Trésor public, ou détruites ou traitées de manière à leur ôter toute valeur commerciale sous contrôle de la douane. Cet abandon ou cette destruction ne doit entraîner aucun frais pour le Trésor public.
 
4.20. Norme transitoire
Lorsque la douane autorise que les marchandises qui ont été initialement déclarées pour un régime douanier avec paiement de droits et taxes soient placées sous un autre régime douanier, le remboursement est accordé pour les droits et taxes qui constituent une prise en compte excédentaire par rapport au montant dû dans le cadre du nouveau régime.
 
4.21. Norme
La décision concernant la demande de remboursement intervient et est notifiée par écrit à la personne intéressée dans les meilleurs délais, et le remboursement de la prise en compte excédentaire est effectué le plus tôt possible après que les éléments de la demande ont été vérifiés.
 
4.22. Norme
Lorsqu'il est établi par la douane que la prise en compte excédentaire résulte d'une erreur commise par la douane lors de la liquidation des droits et taxes, le remboursement est effectué en priorité.
 
4.23. Norme
Lorsqu'il est fixé des délais au-delà desquels les demandes de remboursement ne sont plus acceptées, ces délais doivent être suffisants pour tenir compte des circonstances particulières aux différents cas dans lesquels le remboursement des droits et taxes est susceptible d'être accordé.

Le remboursement n'est pas accordé lorsque le montant en cause est inférieur au montant minimal fixé par la législation nationale.
CHAPITRE 5
GARANTIE
5.1. Norme
La législation nationale énumère les cas dans lesquels une garantie est exigée et détermine les formes dans lesquelles la garantie doit être constituée.

La douane détermine le montant de la garantie.

Toute personne tenue de constituer une garantie doit pouvoir choisir l'une des formes de garantie proposées, à condition qu'elle soit acceptable par la douane.

Lorsque la législation nationale le permet, la douane n'exige pas de garantie lorsqu'elle est convaincue que l'intéressé remplira toutes ses obligations envers elle.

Lorsqu'une garantie est exigée pour assurer l'exécution des obligations résultant d'un régime douanier, la douane accepte une garantie globale, notamment de la part de tout déclarant qui déclare régulièrement des marchandises dans différents bureaux du territoire douanier.

Lorsqu'une garantie est exigée, le montant de cette garantie est aussi faible que possible et, en ce qui concerne le paiement des droits et taxes, n'excède pas le montant éventuellement exigible.

Lorsqu'une garantie a été constituée, la décharge de cette garantie est accordée le plus rapidement possible après que la douane a estimé que les obligations qui ont nécessité la mise en place de la garantie ont été dûment remplies.

Lorsque la douane adopte des systèmes informatiques, elle utilise les normes pertinentes acceptées à l'échelon international.
 
7.3. Norme
La technologie de l'information est adoptée en concertation avec toutes les parties directement intéressées, dans la mesure du possible.

Toute législation nationale nouvelle ou révisée prévoit:
– des méthodes de commerce électronique comme solution alternative aux documents à établir sur papier,
– des méthodes d'authentification électronique ainsi que méthodes d'authentification sur support papier,
– le droit pour la douane de détenir des renseignements pour ses propres besoins et, le cas échéant, d'échanger ces renseignements avec d'autres administrations douanières et avec toute autre partie agréée dans les conditions prévues par la loi au moyen des techniques du commerce électronique.
CHAPITRE 8
RELATIONS ENTRE LA DOUANE ET LES TIERS
8.1. Norme
Les personnes intéressées ont la faculté de traiter avec la douane, soit directement, soit par l'intermédiaire d'un tiers qu'elles désignent pour agir en leur nom.
 
8.2. Norme
La législation nationale précise les conditions dans lesquelles une personne peut agir pour le compte d'une autre personne dans les relations de cette dernière avec la douane et énonce notamment les responsabilités des tiers vis-à-vis de la douane pour ce qui est des droits et taxes et des irrégularités éventuelles.

Les opérations douanières que la personne intéressée choisit d'effectuer pour son propre compte ne font pas l'objet d'un traitement moins favorable, et ne sont pas soumises à des conditions plus rigoureuses que les opérations qui sont effectuées par un tiers pour le compte de la personne intéressée.

Toute personne désignée en qualité de tiers a, pour ce qui est des opérations à traiter avec la douane, les mêmes droits que la personne qui l'a désignée.

La douane prévoit la participation des tiers aux consultations officielles qu'elle a avec le commerce.

La douane précise les circonstances dans lesquelles elle n'est pas disposée à traiter avec un tiers.

La douane fait en sorte que toute personne intéressée puisse se procurer sans difficulté tous renseignements utiles de portée générale concernant la législation douanière.
 
9.2. Norme
Lorsque des renseignements déjà diffusés doivent être modifiés en raison d'amendements apportés à la législation douanière ou aux dispositions ou prescriptions administratives, la douane porte les nouveaux renseignements à la connaissance du public dans un délai suffisant avant leur entrée en vigueur afin que les personnes intéressées puissent en tenir compte, sauf lorsque leur publication anticipée n'est pas autorisée.
 
9.3. Norme transitoire
La douane utilise la technologie de l'information afin d'améliorer la communication des renseignements.
B. RENSEIGNEMENTS SPECIFIQUES
 
9.4. Norme
À la demande de la personne intéressée, la douane fournit, de manière aussi rapide et aussi exacte que possible, des renseignements relatifs aux points particuliers soulevés par cette personne et concernant la législation douanière.
 
9.5. Norme
La douane fournit non seulement les renseignements expressément demandés, mais également tous autres renseignements pertinents qu'elle juge utile de porter à la connaissance de la personne intéressée.
 
9.6. Norme
Lorsque la douane fournit des renseignements, elle veille à ne divulguer aucun élément d'information de caractère privé ou confidentiel affectant la douane ou des tiers, à moins que cette divulgation ne soit exigée ou autorisée par la législation nationale.

Lorsque la douane n'est pas en mesure de fournir des renseignements gratuitement, la rémunération exigée est limitée au coût approximatif des services rendus.
C. DECISIONS

Lorsqu'un recours est introduit auprès de la douane, celle-ci n'exige pas d'office que les éléments de preuve éventuels soient déposés au moment de l'introduction du recours, mais elle accorde, lorsqu'il y a lieu, un délai raisonnable à cet effet.

La douane statue sur le recours et notifie sa décision au requérant par écrit, dès que possible.

O SPREMEMBI MEDNARODNE KONVENCIJE O POENOSTAVITVI IN USKLADITVI CARINSKIH POSTOPKOV
(sestavljeno v Bruslju 26. junija 1999)
Pogodbenice Mednarodne konvencije o poenostavitvi in uskladitvi carinskih postopkov (ki je bila sestavljena v Kjotu 18. maja 1973 in je začela veljati 25. septembra 1974), v nadaljevanju "konvencija", ustanovljene pod pokroviteljstvom Sveta za carinsko sodelovanje, v nadaljevanju "Svet", so
OB UPOŠTEVANJU, da je za uresničevanje ciljev:
– odprava razlik med carinskimi postopki in praksami pogodbenic, ki lahko ovirajo mednarodno trgovino in druge mednarodne izmenjave;
– zadovoljevanje potreb mednarodne trgovine in carine po olajšanju, poenostavitvi in uskladitvi carinskih postopkov in praks;
– zagotavljanje ustreznih standardov carinskega nadzora in
– omogočanje carini, da se prilagaja velikim spremembam na področju poslovnih in upravnih metod in tehnik,
treba spremeniti konvencijo,
ter OB UPOŠTEVANJU, da:
– mora spremenjena konvencija zagotoviti, da bodo temeljna načela takšne poenostavitve in uskladitve zavezujoča za pogodbenice spremenjene konvencije,
– mora spremenjena konvencija carini zagotoviti učinkovite postopke, podkrepljene z ustreznimi in učinkovitimi načini nadzora, ter
– bo spremenjena konvencija omogočila doseganje visoke stopnje poenostavitve in uskladitve carinskih postopkov in praks, kar je glavni cilj Sveta, ter tako bistveno prispevala k olajšanju mednarodne trgovine,
sklenile:
1. člen
Preambula in členi konvencije se spremenijo v skladu z besedilom v dodatku I k temu protokolu.
2. člen
Splošna priloga v dodatku II in posebne priloge v dodatku III k temu protokolu nadomestijo priloge h konvenciji.
3. člen
1. Vsaka pogodbenica konvencije lahko svoje soglasje, da jo zavezuje ta protokol, vključno z dodatkoma I in II, izrazi:
(a) s podpisom protokola brez pridržka ratifikacije,
(b) z deponiranjem listine o ratifikaciji po podpisu protokola s pridržkom ratifikacije ali
(c) s pristopom k protokolu.
2. Pogodbenice konvencije lahko ta protokol podpišejo do 30. junija 2000 na sedežu Sveta v Bruslju. Po tem datumu lahko k protokolu pristopijo.
3. Ta protokol, vključno z dodatkoma I in II, začne veljati tri mesece po tem, ko ga brez pridržka ratifikacije podpiše ali deponira listino o ratifikaciji ali pristopu štirideset pogodbenic.
4. Potem ko štirideset pogodbenic v skladu s prvim odstavkom tega člena izrazi svoje soglasje, da jih zavezuje ta protokol, lahko katera koli pogodbenica konvencije spremembe konvencije sprejme le tako, da postane pogodbenica tega protokola. Za takšno pogodbenico začne protokol veljati tri mesece po podpisu protokola brez pridržka ratifikacije ali po deponiranju listine o ratifikaciji ali pristopu.
4. člen
Vsaka pogodbenica konvencije lahko po tem, ko izrazi svoje soglasje, da jo zavezuje ta protokol, sprejme katero koli od posebnih prilog ali njihovih poglavij, ki jih vsebuje dodatek III k temu protokolu, ter o takšnem sprejetju in priporočenih praksah, glede katerih izrazi pridržke, uradno obvesti generalnega sekretarja Sveta.
5. člen
Po začetku veljavnosti tega protokola generalni sekretar Sveta ne sprejme nobenih listin o ratifikaciji konvencije ali pristopu k njej.
6. člen
V odnosih med pogodbenicami tega protokola ta protokol z dodatki nadomesti konvencijo.
7. člen
Generalni sekretar Sveta je depozitar tega protokola in opravlja naloge, določene v 19. členu dodatka I k temu protokolu.
8. člen
Ta protokol lahko pogodbenice konvencije podpišejo na sedežu Sveta v Bruslju od 26. junija 1999 naprej.
9. člen
V skladu s 102. členom Ustanovne listine Združenih narodov se ta protokol in njegovi dodatki na zaprosilo generalnega sekretarja Sveta registrirajo pri Sekretariatu Združenih narodov.
V potrditev tega so podpisani, ki so bili za to pravilno pooblaščeni, podpisali ta protokol.
Sestavljeno v Bruslju šestindvajsetega junija tisoč devetsto devetindevetdeset v angleškem in francoskem jeziku, pri čemer sta besedili enako verodostojni, v enem samem izvirniku, ki se deponira pri generalnem sekretarju Sveta, ki pošlje overjene kopije vsem entitetam iz prvega odstavka 8. člena dodatka I k temu protokolu.

Pogodbenice te konvencije, ustanovljene pod pokroviteljstvom Sveta za carinsko sodelovanje, so
V PRIZADEVANJU za odpravo razlik med carinskimi postopki in praksami pogodbenic, ki lahko ovirajo mednarodno trgovino in druge mednarodne izmenjave,
V ŽELJI, da bi učinkovito prispevale k razvoju tovrstne trgovine in izmenjav s poenostavitvijo in uskladitvijo carinskih postopkov in praks ter pospeševanjem mednarodnega sodelovanja,
OB UPOŠTEVANJU, da je pomembne koristi od lajšanja mednarodne trgovine mogoče doseči brez ogrožanja ustreznih standardov carinskega nadzora,
OB SPOZNANJU, da je tovrstno poenostavitev in uskladitev mogoče doseči z uporabo predvsem teh načel:
– uresničevanjem programov zaradi stalnega posodabljanja carinskih postopkov in praks ter s tem povečanjem učinkovitosti in uspešnosti,
– izvajanjem carinskih postopkov in praks na predvidljiv, dosleden in pregleden način,
– zagotavljanjem vseh potrebnih informacij v zvezi s carinskimi zakoni, predpisi, upravnimi navodili, postopki in praksami zainteresiranim strankam,
– sprejemom sodobnih tehnik, kot so obvladovanje tveganja in kontrola na podlagi revizij ter čim bolj praktična uporaba informacijske tehnologije,
– sodelovanjem z drugimi državnimi organi, drugimi carinskimi upravami in trgovinskimi združenji, kadar koli je to primerno,
– prevzemom ustreznih mednarodnih standardov,
– zagotovitvijo lahko dostopnih postopkov upravnega in sodnega preizkusa prizadetim strankam,
V PREPRIČANJU, da bo mednarodni instrument, ki bo vseboval navedene cilje in načela ter glede katerega se pogodbenice zavezujejo, da ga bodo izvajale, pripeljal do visoke stopnje poenostavitve in uskladitve carinskih postopkov in praks, kar je glavni cilj Sveta za carinsko sodelovanje, ter tako bistveno prispeval k olajšanju mednarodne trgovine,
sklenile:
I. POGLAVJE
Pomen izrazov
1. člen
V tej konvenciji:
(a) "standard" pomeni določbo, izvajanje katere se šteje za potrebno, da se dosežeta uskladitev in poenostavitev carinskih postopkov in praks;
(b) "prehodni standard" pomeni standard v splošni prilogi, pri katerem je dovoljeno daljše obdobje prevzemanja;
(c) "priporočena praksa" pomeni določbo v posebni prilogi, za katero se šteje, da prispeva k napredku pri uskladitvi in poenostavitvi carinskih postopkov in praks, ter katere čim širša uporaba velja za zaželeno;
(d) "notranja zakonodaja" pomeni zakone, predpise in druge ukrepe, ki jih sprejme pristojni organ pogodbenice in se uporabljajo na celotnem območju te pogodbenice, ali veljavne mednarodne pogodbe, ki zavezujejo pogodbenico;
(e) "splošna priloga" pomeni zbirko določb, ki se uporabljajo za vse carinske postopke in prakse, omenjene v tej konvenciji;
(f) "posebna priloga" pomeni zbirko določb, ki se uporabljajo za enega ali več carinskih postopkov ali praks, omenjenih v tej konvenciji;
(g) "smernice" pomenijo zbirko razlag določb splošne priloge, posebnih prilog in njihovih poglavij, ki navajajo možne smeri delovanja, ki jih je treba upoštevati pri uporabi standardov, prehodnih standardov in priporočenih praks, ter predvsem opisujejo najboljše prakse in priporočajo primere večjih olajšav;
(h) "Stalni tehnični odbor" pomeni Stalni tehnični odbor Sveta;
(i) "Svet" pomeni organizacijo, ustanovljeno s Konvencijo o ustanovitvi Sveta za carinsko sodelovanje, sestavljeno 15. decembra 1950 v Bruslju;
(j) "carinska ali gospodarska unija" pomeni unijo, ki so jo ustanovile in jo sestavljajo države ter je pristojna za sprejemanje lastnih predpisov, ki so zavezujoči za te države v zadevah, ki jih ureja ta konvencija, ter je v skladu s svojimi notranjimi postopki pristojna za odločanje o podpisu in ratifikaciji te konvencije ali pristopu k njej.
II. POGLAVJE
OBSEG IN SESTAVA
Obseg konvencije
2. člen
Vsaka pogodbenica se zavezuje, da bo spodbujala poenostavitev in uskladitev carinskih postopkov ter v tem smislu in v skladu z določbami te konvencije upoštevala standarde, prehodne standarde in priporočene prakse v prilogah k tej konvenciji. Nič pa pogodbenicam ne preprečuje odobravanja večjih olajšav, kot so predvidene s konvencijo, in vsaki pogodbenici se priporoča odobravanje takšnih večjih olajšav v čim širšem obsegu.
3. člen
Določbe te konvencije ne vplivajo na uporabo notranje zakonodaje, ki se nanaša na prepovedi ali omejitve v zvezi z blagom, za katero velja carinski nadzor.
Sestava konvencije
4. člen
1. Konvencija je sestavljena iz osnovnega besedila, splošne priloge in posebnih prilog.
2. Splošna priloga in vsaka posebna priloga k tej konvenciji sta načeloma sestavljeni iz poglavij, ki razčlenjujejo določeno prilogo in zajemajo:
(a) pomen izrazov in
(b) standarde, od katerih so nekateri v splošni prilogi prehodni standardi.
3. Vsaka posebna priloga prav tako zajema tudi priporočene prakse.
4. Vsako prilogo spremljajo smernice, katerih besedila za pogodbenice niso zavezujoča.
5. člen
Za vsako posebno prilogo ali priloge ali vsako njeno poglavje ali poglavja, ki zavezujejo določeno pogodbenico, se za namene te konvencije šteje, da so sestavni del konvencije, v zvezi s to pogodbenico pa se za vsako navajanje konvencije šteje, da konvencija vključuje navajanje posebne priloge ali prilog ali poglavja ali poglavij.
III. POGLAVJE
UPRAVLJANJE KONVENCIJE
Upravni odbor
6. člen
1. Za proučevanje izvajanja te konvencije, ukrepov za zagotavljanje enotnosti razlage in uporabe te konvencije ter njenih predlaganih sprememb se ustanovi Upravni odbor.
2. Pogodbenice so članice Upravnega odbora.
3. Pristojna uprava vsake entitete, ki lahko v skladu z določbami 8. člena postane pogodbenica te konvencije, ali katere koli članice Svetovne trgovinske organizacije ima pravico, da se lahko kot opazovalka udeleži sej Upravnega odbora. Status in pravice teh opazovalk se določijo s sklepom Sveta. Omenjenih pravic ni mogoče uresničiti pred začetkom veljavnosti sklepa.
4. Upravni odbor lahko na svoje seje kot opazovalce povabi predstavnike mednarodnih vladnih in nevladnih organizacij.
5. Upravni odbor:
(a) pogodbenicam priporoča:
(i) spremembe osnovnega besedila te konvencije;
(ii) spremembe splošne priloge, posebnih prilog in njihovih poglavij ter vključitev novih poglavij v splošno prilogo ter
(iii) vključitev novih posebnih prilog in novih poglavij v posebne priloge;
(b) lahko sklene spremeniti priporočene prakse ali vključiti nove priporočene prakse v posebne priloge ali njihova poglavja v skladu s 16. členom;
(c) obravnava prevzemanje določb te konvencije v skladu s četrtim odstavkom 13. člena;
(d) pregleduje in sproti dopolnjuje smernice;
(e) obravnava vse druge zadeve v zvezi s to konvencijo, ki so mu lahko predložene;
(f) obvešča Stalni tehnični odbor in Svet o svojih sklepih.
6. Pristojne uprave pogodbenic generalnemu sekretarju Sveta sporočijo predloge iz točk (a), (b), (c) ali (d) petega odstavka tega člena in razloge zanje skupaj z zahtevami za uvrstitev točk na dnevni red sej Upravnega odbora. Generalni sekretar Sveta s predlogi seznani pristojne uprave pogodbenic in opazovalce iz drugega, tretjega in četrtega odstavka tega člena.
7. Upravni odbor se sestaja najmanj enkrat letno. Vsako leto izvoli predsednika in podpredsednika. Generalni sekretar Sveta pristojnim upravam pogodbenic in opazovalcem iz drugega, tretjega in četrtega odstavka tega člena pošlje vabilo in osnutek dnevnega reda najpozneje šest tednov, preden se Upravni odbor sestane.
8. Če sklepa ni mogoče sprejeti soglasno, se o zadevah, ki jih obravnava Upravni odbor, odloča z glasovanjem prisotnih pogodbenic. Za odobritev predlogov iz točk (a), (b) ali (c) petega odstavka tega člena je potrebna dvotretjinska večina oddanih glasov. O vseh drugih zadevah Upravni odbor odloča z večino oddanih glasov.
9. Pri uporabi določb petega odstavka 8. člena te konvencije imajo carinske ali gospodarske unije, ki so pogodbenice, pri glasovanju le toliko glasov, kot je skupno število glasov, dodeljenih njihovim članicam, ki so pogodbenice.
10. Pred koncem seje Upravni odbor sprejme poročilo. Poročilo se pošlje Svetu in pogodbenicam ter opazovalcem iz drugega, tretjega in četrtega odstavka.
11. Če ta člen ne vsebuje ustreznih določb, se uporablja poslovnik Sveta, razen če Upravni odbor ne odloči drugače.
7. člen
Pri glasovanju v Upravnem odboru se o vsaki posebni prilogi in vsakem poglavju določene posebne priloge glasuje posebej.
(a) Vsaka pogodbenica ima pravico do glasovanja o zadevah v zvezi razlago, uporabo ali spremembo osnovnega besedila in splošne priloge konvencije.
(b) O zadevah, ki se nanašajo na posebno prilogo ali poglavje posebne priloge, ki že velja, imajo pravico do glasovanja le tiste pogodbenice, ki so sprejele to posebno prilogo ali njeno poglavje.
(c) Vsaka pogodbenica ima pravico do glasovanja o osnutkih novih posebnih prilog ali novih poglavij določene posebne priloge.
IV. POGLAVJE
POGODBENICA
Ratifikacija konvencije
8. člen
1. Vsaka članica Sveta in vsaka članica Združenih narodov ali njenih specializiranih agencij lahko postane pogodbenica te konvencije:
(a) s podpisom konvencije brez pridržka ratifikacije;
(b) z deponiranjem listine o ratifikaciji po podpisu s pridržkom ratifikacije ali
(c) s pristopom h konvenciji.
2. Članice iz prvega odstavka tega člena lahko to konvencijo podpišejo do 30. junija 1974 na sedežu Sveta v Bruslju. Po tem datumu lahko te članice h konvenciji pristopijo.
3. Vsaka pogodbenica ob podpisu ali ratifikaciji konvencije ali pristopu k njej navede, katero od posebnih prilog ali njihovih poglavij sprejema, če sploh katero. Naknadno lahko depozitarja uradno obvesti o sprejetju ene ali več posebnih prilog ali njihovih poglavij.
4. Pogodbenice, ki sprejemajo katero od novih posebnih prilog ali novih poglavij posebne priloge, o tem uradno obvestijo depozitarja v skladu s tretjim odstavkom tega člena.
5. (a) Vsaka carinska ali gospodarska unija lahko postane pogodbenica te konvencije v skladu s prvim, drugim in tretjim odstavkom tega člena. Takšna carinska ali gospodarska unija depozitarja obvesti o svoji pristojnosti za zadeve, ki jih ureja ta konvencija. Takšna carinska ali gospodarska unija depozitarja tudi obvesti o vsaki bistveni spremembi obsega svojih pristojnosti.
(b) Carinska ali gospodarska unija, ki je pogodbenica te konvencije, pri zadevah, ki so v njeni pristojnosti, v svojem imenu uveljavlja pravice in izpolnjuje dolžnosti, ki jih konvencija določa za članice takšne unije, ki so pogodbenice te konvencije. V tem primeru članice takšne unije nimajo pravice do individualnega uveljavljanja pravic, vključno s pravico do glasovanja.
9. člen
1. Vsako pogodbenico, ki ratificira to konvencijo ali k njej pristopi, zavezujejo vse spremembe te konvencije, vključno s splošno prilogo, ki začnejo veljati na dan deponiranja listine o ratifikaciji ali pristopu.
2. Vsako pogodbenico, ki sprejme katero od posebnih prilog ali njenih poglavij, zavezujejo vse spremembe standardov v taki posebni prilogi ali njenem poglavju, ki so veljavne na dan, ko pogodbenica uradno obvesti depozitarja, da jih je sprejela. Vsako pogodbenico, ki sprejme katero od posebnih prilog ali njihovih poglavij, zavezujejo vse spremembe priporočenih praks, ki jih ta vsebujejo, in so veljavne na dan, ko pogodbenica uradno obvesti depozitarja, da jih je sprejela, razen če pogodbenica na eno ali več priporočenih praks ne izrazi pridržka v skladu z 12. členom te konvencije.
Uporaba konvencije
10. člen
1. Vsaka pogodbenica lahko ob podpisu te konvencije brez pridržka ratifikacije ali ob deponiranju listine o ratifikaciji ali pristopu ali kadar koli pozneje z obvestilom depozitarju izjavi, da konvencijo širi na vsa ali katera koli območja, za mednarodne odnose katerih je pristojna. To uradno obvestilo začne učinkovati tri mesece po datumu, ko ga prejme depozitar. Vendar pa se na območjih, navedenih v uradnem obvestilu, ta konvencija ne more uporabljati, dokler ne začne veljati za samo pogodbenico.
2. Vsaka pogodbenica, ki je depozitarja po prvem odstavku tega člena uradno obvestila o razširitvi te konvencije na katero koli območje, za katerega mednarodne odnose je pristojna, lahko depozitarja po postopku iz 19. člena te konvencije uradno obvesti, da se za to območje ta konvencija ne bo več uporabljala.
11. člen
Carinska ali gospodarska unija, ki je pogodbenica, uradno obvesti generalnega sekretarja Sveta o območjih, ki sestavljajo carinsko ali gospodarsko unijo, pri čemer se za uporabo te konvencije ta območja štejejo za eno samo območje.
Sprejetje določb in pridržki
12. člen
1. Splošna priloga je zavezujoča za vse pogodbenice.
2. Pogodbenica lahko sprejme eno ali več posebnih prilog ali eno ali več njenih poglavij. Za pogodbenico, ki sprejme določeno posebno prilogo ali eno ali več njenih poglavij, so zavezujoči vsi standardi iz take priloge ali poglavja. Za pogodbenico, ki sprejme določeno posebno prilogo ali eno ali več njenih poglavij, so zavezujoče vse priporočene prakse iz take priloge ali poglavja, razen če ob sprejetju ali kadar koli pozneje depozitarja uradno ne obvesti o priporočeni praksi ali praksah, v zvezi s katerimi izraža pridržke, in ne navede obstoječih razlik med določbami svoje notranje zakonodaje in določbami take priporočene prakse ali praks. 3. Vsaka pogodbenica, ki jo zavezuje posebna priloga ali eno ali več njenih poglavij, prouči možnosti umika morebitnih pridržkov na priporočene prakse, ki jih je vložila v skladu z drugim odstavkom, ter uradno obvesti generalnega sekretarja Sveta o rezultatih takšnega pregleda ob koncu vsakega triletnega obdobja, ki se začne na dan začetka veljavnosti te konvencije zanjo, ter navede določbe svoje notranje zakonodaje, ki po njenem mnenju ne onemogočajo umika pridržkov.
Izvajanje določb
13. člen
1. Vsaka pogodbenica prevzame standarde, določene v splošni prilogi in posebni prilogi ali prilogah ali v enem ali več njenih poglavjih, ki jih je sprejela, v 36 mesecih od začetka veljavnosti take priloge ali prilog ali enega ali več njenih poglavij zanjo.
2. Vsaka pogodbenica prevzame prehodne standarde, določene v splošni prilogi, v 60 mesecih od dneva, ko je splošna priloga zanjo začela veljati.
3. 4. (a) Če je rok, določen v prvem ali drugem odstavku tega člena, za pogodbenico prekratek, da bi lahko v praksi izvajala določbe splošne priloge, lahko taka pogodbenica Upravni odbor pred potekom roka iz prvega ali drugega odstavka tega člena zaprosi za podaljšanje tega roka. (b) Upravni odbor lahko v izjemnih okoliščinah sklene, da odobri tako podaljšanje. V sklepu, s katerim odobri podaljšanje, Upravni odbor navede izjemne okoliščine, ki utemeljujejo njegov sklep, podaljšanje pa nikakor ne more biti daljše od enega leta. Ob izteku roka podaljšanja pogodbenica depozitarja uradno obvesti o izvajanju določb, v zvezi s katerimi ji je bilo dovoljeno podaljšanje.
Reševanje sporov
14. člen
1. Kakršni koli spori med dvema ali več pogodbenicami glede razlage ali uporabe te konvencije se, če je le mogoče, rešujejo s pogajanji.
2. Kakršen koli spor, ki ni rešen s pogajanji, pogodbenice v sporu predložijo Upravnemu odboru, ki nato spor obravnava in da priporočila za njegovo rešitev.
3. Pogodbenice v sporu se lahko vnaprej sporazumejo, da bodo sprejele priporočila Upravnega odbora kot zavezujoča.
Spremembe konvencije
15. člen
1. Generalni sekretar Sveta sporoči besedilo vsake spremembe, ki jo Upravni odbor priporoči pogodbenicam v skladu s točkama (i) in (ii) pododstavka (a) petega odstavka 6. člena, vsem pogodbenicam in tistim članicam Sveta, ki niso pogodbenice.
2. Spremembe osnovnega besedila konvencije začnejo veljati za vse pogodbenice dvanajst mesecev po tem, ko pogodbenice, navzoče na seji Upravnega odbora, na kateri so bile spremembe priporočene, deponirajo listine o sprejetju, če v dvanajstih mesecih po datumu sporočila o teh spremembah nobena pogodbenica ne vloži ugovora.
3. Za vsako priporočeno spremembo splošne priloge ali posebnih prilog ali njihovih poglavij se šteje, da je sprejeta šest mesecev po datumu sporočila o priporočeni spremembi pogodbenicam, razen če:
(a) katera od pogodbenic, ali če gre za posebno prilogo ali poglavja, katera od pogodbenic, za katero je ta posebna priloga ali poglavje zavezujoče, ne vloži ugovora ali
(b) katera od pogodbenic generalnega sekretarja Sveta ne obvesti, da sicer namerava sprejeti priporočeno spremembo, vendar pa pogoji, potrebni za takšno sprejetje, še niso izpolnjeni.
4. Če katera od pogodbenic generalnemu sekretarju Sveta pošlje sporočilo v skladu s pododstavkom (b) tretjega odstavka tega člena, lahko toliko časa, dokler generalnega sekretarja Sveta uradno ne obvesti o sprejetju priporočene spremembe, vloži ugovor zoper to spremembo v osemnajstih mesecih po izteku šestmesečnega roka iz tretjega odstavka tega člena.
5. Če se o ugovoru zoper priporočeno spremembo uradno ne obvesti v skladu s pododstavkom (a) tretjega odstavka ali v skladu s četrtim odstavkom tega člena, se šteje, da sprememba ni bila sprejeta in tako nima nobenega učinka.
6. Če katera od pogodbenic pošlje sporočilo v skladu s pododstavkom (b) tretjega odstavka tega člena, se šteje, da je bila sprememba sprejeta na tisti od naslednjih datumov, ki nastopi prej:
(a) datum, do katerega so vse pogodbenice, ki so poslale tako sporočilo, uradno obvestile generalnega sekretarja Sveta o svojem sprejetju priporočene spremembe, pod pogojem, da se ta datum, če so bila vsa sprejetja uradno sporočena pred iztekom šestmesečnega roka iz tretjega odstavka tega člena, šteje za datum izteka omenjenega šestmesečnega roka, ali
(b) datum izteka osemnajstmesečnega roka iz četrtega odstavka tega člena.
7. Vsaka sprememba splošne priloge ali posebnih prilog ali njihovih poglavij, za katero se šteje, da je sprejeta, začne veljati šest mesecev po datumu, s katerim se šteje za sprejeto, ali če je za priporočeno spremembo določen drugačen rok, z iztekom tega roka po datumu, s katerim se šteje, da je bila sprememba sprejeta.
8. Generalni sekretar Sveta pogodbenice te konvencije čim prej uradno obvesti o vsakem ugovoru zoper priporočeno spremembo, ki je bil vložen v skladu s pododstavkom (a) tretjega odstavka, ter o vsakem sporočilu, prejetem v skladu s pododstavkom (b) tretjega odstavka tega člena. Generalni sekretar Sveta pogodbenice naknadno obvesti o tem, ali pogodbenica ali pogodbenice, ki so poslale tako sporočilo, ugovarjajo zoper priporočeno spremembo ali jo sprejemajo.
16. člen
1. Ne glede na postopek spreminjanja, določen v 15. členu te konvencije, lahko Upravni odbor v skladu s 6. členom sklene, da spremeni katero koli priporočeno prakso ali vključi novo priporočeno prakso v katero koli posebno prilogo ali njeno poglavje. Generalni sekretar Sveta vsako pogodbenico povabi k sodelovanju pri posvetovanjih Upravnega odbora. Besedilo sprememb ali novih priporočenih praks, o katerih je bilo tako sklenjeno, generalni sekretar Sveta pošlje pogodbenicam in tistim članicam Sveta, ki niso pogodbenice te konvencije.
2. Vsaka sprememba ali vključitev novih priporočenih praks, o kateri je bilo sklenjeno v skladu s prvim odstavkom tega člena, začne veljati šest mesecev po tem, ko to sporoči generalni sekretar. Za vsako pogodbenico, ki jo zavezuje posebna priloga ali njeno poglavje, ki je predmet takih sprememb ali vključitve novih priporočenih praks, se šteje, da je sprejela te spremembe ali nove priporočene prakse, razen če ne izrazi pridržka po postopku iz 12. člena te konvencije.
Trajanje pristopa
17. člen
1. Konvencija je sklenjena za nedoločen čas, vendar jo lahko po datumu začetka veljavnosti v skladu z 18. členom vsaka pogodbenica kadar koli odpove.
2. O odpovedi se uradno obvesti z instrumentom v pisni obliki, ki se deponira pri depozitarju.
3. Odpoved začne učinkovati šest mesecev po tem, ko depozitar prejme instrument o odpovedi.
4. Določbe drugega in tretjega odstavka tega člena se uporabljajo tudi za posebne priloge ali njihova poglavja, za katera lahko pogodbenica kadar koli po datumu začetka veljavnosti prekliče svoje sprejetje.
5. Če neka pogodbenica prekliče sprejetje splošne priloge, se šteje, da je odpovedala konvencijo. Tudi v tem primeru se uporabljajo določbe drugega in tretjega odstavka tega člena.
V. POGLAVJE
KONČNE DOLOČBE
Začetek veljavnosti konvencije
18. člen
1. Ta konvencija začne veljati tri mesece po tem, ko jo brez pridržka ratifikacije podpiše ali deponira svoje listine o ratifikaciji ali pristopu pet entitet iz prvega in petega odstavka 8. člena.
2. Ta konvencija začne veljati za pogodbenico tri mesece po tem, ko je postala pogodbenica v skladu z določbami 8. člena.
3. Vsaka posebna priloga k tej konvenciji ali njeno poglavje začne veljati tri mesece po tem, ko jo je sprejelo pet pogodbenic.
4. Po začetku veljavnosti določene posebne priloge ali njenega poglavja v skladu s tretjim odstavkom tega člena začne ta posebna priloga ali njeno poglavje veljati za posamezno pogodbenico tri mesece po tem, ko ta pošlje uradno obvestilo o sprejetju. Vendar pa nobena posebna priloga ali njeno poglavje ne more začeti veljati za določeno pogodbenico, preden zanjo ne začne veljati ta konvencija.
Depozitar konvencije
19. člen
1. Ta konvencija, vsi podpisi s pridržkom ratifikacije ali brez njega in vse listine o ratifikaciji ali pristopu se deponirajo pri generalnem sekretarju Sveta.
2. Depozitar:
(a) prejme in hrani izvirnike te konvencije;
(b) pripravi overjene kopije izvirnikov te konvencije ter jih pošlje pogodbenicam in tistim članicam Sveta, ki niso pogodbenice, ter generalnemu sekretarju Združenih narodov;
(c) prejme vsak podpis s pridržkom ratifikacije ali brez njega, ratifikacijo ali pristop k tej konvenciji ter prejme in hrani vsak instrument, uradno obvestilo in sporočilo, ki se nanjo nanaša;
(d) preverja primernost in pravilnost podpisov ali instrumentov, uradnih obvestil ali sporočil, ki se nanašajo na to konvencijo, ter po potrebi s tem seznani zadevno pogodbenico;
(e) uradno obvešča pogodbenice, tiste članice Sveta, ki niso pogodbenice, in generalnega sekretarja Združenih narodov o:
– podpisih, ratifikacijah, pristopih in sprejetju prilog in poglavij iz 8. člena te konvencije;
– novih poglavjih splošne priloge in novih posebnih prilogah ali njihovih poglavjih, za katere Upravni odbor sklene, da jih priporoči za vključitev v to konvencijo;
– dnevu začetka veljavnosti te konvencije, splošne priloge in vsake posebne priloge ali njenega poglavja v skladu z 18. členom te konvencije;
– uradnih obvestilih, prejetih v skladu z 8., 10., 11., 12. in 13. členom te konvencije;
– preklicih sprejetja prilog/poglavij, ki jih pošljejo pogodbenice;
– odpovedih v skladu s 17. členom te konvencije in
– vsaki spremembi, sprejeti v skladu s 15. členom te konvencije, ter o dnevu začetka njene veljavnosti.
3. Ob razhajanjih med pogodbenico in depozitarjem glede opravljanja njegovih nalog depozitar ali ta pogodbenica z zadevo seznani druge pogodbenice in podpisnice ali odvisno od primera Upravni odbor ali Svet.
Registracija in izvirna besedila
20. člen
V skladu s 102. členom Ustanovne listine Združenih narodov se ta konvencija na zaprosilo generalnega sekretarja Sveta registrira pri Sekretariatu Združenih narodov.
V potrditev tega so podpisani, ki so bili za to pravilno pooblaščeni, podpisali to konvencijo.
Sestavljeno v Kjotu osemnajstega maja tisoč devetsto triinsedemdeset v angleškem in francoskem jeziku, pri čemer sta besedili enako verodostojni, v enem samem izvirniku, ki se deponira pri generalnem sekretarju Sveta, ki pošlje overjene kopije vsem entitetam iz prvega odstavka 8. člena te konvencije.

1. POGLAVJE
SPLOŠNA NAČELA
 
1.1 Standard
Pomen izrazov, standardi in prehodni standardi v tej prilogi se uporabljajo za carinske postopke in prakse, določene v tej prilogi, ter če je primerno, za postopke in prakse v posebnih prilogah.
 
1.2 Standard
Pogoji, ki jih je treba izpolniti, in carinske formalnosti, ki jih je treba opraviti za postopke in prakse v tej prilogi in posebnih prilogah, so določeni v notranji zakonodaji in so tako enostavni, kot je mogoče.
 
1.3 Standard
Carina vzpostavi in ohranja formalne posvetovalne odnose z gospodarstvom, da bi povečala sodelovanje in olajšala udeležbo pri vzpostavitvi najučinkovitejših metod dela v skladu z notranjimi določbami in mednarodnimi sporazumi.
2. POGLAVJE
POMEN IZRAZOV
    V prilogah k tej konvenciji:
E1/F23   "pritožba" pomeni dejanje, s katerim se oseba, na katero
         neposredno vpliva odločitev ali opustitev carine in se čuti pri
         tem oškodovano, za zadoščenje obrne na pristojni organ;
E2/F19   "obračun dajatev in davkov" pomeni določitev zneska dajatev in
         davkov, ki ga je treba plačati;
E3/F4    "kontrola na podlagi revizije" pomeni ukrepe, na podlagi katerih
         se carina s pregledom ustreznih knjig, evidenc, poslovnih
         sistemov in podatkov, ki jih imajo zadevne osebe, prepriča o
         točnosti in verodostojnosti deklaracij;
E4/F15   "preverjanje deklaracije blaga" pomeni dejanje carine, s katerim
         se prepriča, da je deklaracija blaga pravilno izdelana in da
         zahtevani priloženi dokumenti ustrezajo predpisanim pogojem;
E5/F9    "carinjenje" pomeni izvedbo carinskih formalnosti, ki jih je
         treba opraviti, da se lahko blago vnese v domačo porabo, se
         izvozi ali zanj uvede drug carinski postopek;
E6/F10   "carina" pomeni vladno službo, ki je pristojna za izvajanje
         carinske zakonodaje ter pobiranje dajatev in davkov ter prav tako
         za izvajanje drugih zakonov in predpisov, ki se nanašajo na uvoz,
         izvoz, gibanje ali hrambo blaga;
E7/F3    "carinska kontrola" pomeni ukrepe, ki jih izvaja carina, da se
         zagotovi skladnost s carinsko zakonodajo;
E8/F11   "carinske dajatve" pomenijo dajatve, ki so določene v carinski
         tarifi in jih je treba plačati za blago ob vnosu na carinsko
         območje ali iznosu z njega;
E9/F16   "carinske formalnosti" pomenijo vsa dejanja, ki jih morajo
         opraviti zadevne osebe in carina, da ravnajo v skladu s carinsko
         zakonodajo;
E10/F18  "carinska zakonodaja" pomeni zakonske in podzakonske določbe, ki
         se nanašajo na uvoz, izvoz, gibanje ali hrambo blaga ter katerih
         izvajanje in uveljavljanje sta posebej naloženi carini, ter
         katere koli predpise, ki jih izda carina v skladu s svojimi
         zakonskimi pooblastili;
E11/F2   "carinski urad" pomeni upravno enoto carine, ki je pristojna za
         opravljanje carinskih formalnosti, in prostore ali druga mesta,
         ki jih v ta namen odobrijo pristojni organi;
E12/F25  "carinsko območje" pomeni območje, na katerem se uporablja
         carinska zakonodaja pogodbenice;
E13/F6   "odločba" pomeni posamično dejanje, s katerim carina odloči o
         zadevi, ki se nanaša na carinsko zakonodajo;
E14/F7   "deklarant" pomeni katero koli osebo, ki odda deklaracijo blaga
         ali v imenu katere se taka deklaracija blaga odda;
E15/F5   "datum zapadlosti" pomeni datum, ko dajatve in davki zapadejo v
         plačilo;
E16/F12  "dajatve in davki" pomenijo uvozne dajatve in davke in/ali
         izvozne dajatve in davke;
E17/F27  "pregled blaga" pomeni fizični pregled blaga, ki ga opravi
         carina, s katerim se prepriča, da so narava, poreklo, stanje,
         količina in vrednost blaga skladni s podatki, navedenimi v
         deklaraciji blaga;
E18/F13  "izvozne dajatve in davki" pomenijo carinske dajatve in vse druge
         dajatve, davke ali takse, ki se pobirajo pri izvozu ali v zvezi z
         izvozom blaga, ne vključujejo pa taks, katerih znesek je omejen
         na višino približnih stroškov storitev, ki jih opravi carina, ali
         jih pobere v imenu drugega državnega organa;
E19/F8   "deklaracija blaga" pomeni izjavo, dano na način, ki ga predpiše
         carina, in v kateri zadevne osebe navedejo carinski postopek, ki
         naj se uporabi za blago, ter vse podatke, ki jih carina zahteva
         za njegovo izvedbo;
E20/F14  "uvozne dajatve in davki" pomenijo carinske dajatve in vse druge
         dajatve, davke ali takse, ki se pobirajo pri uvozu ali v zvezi z
         uvozom blaga, ne vključujejo pa taks, katerih znesek je omejen na
         višino približnih stroškov storitev, ki jih opravi carina, ali
         jih pobere v imenu drugega državnega organa;
E21/F1   "medsebojna upravna pomoč " pomeni dejanja, ki jih carinska
         uprava zaradi pravilne uporabe carinske zakonodaje ter zaradi
         preprečevanja, preiskave in zatiranja carinskih prekrškov opravi
         v imenu druge carinske uprave ali v sodelovanju z njo;
E22/F21  "opustitev" pomeni, da carina ne ravna ali ne ukrepa v razumnem
         roku v zadevi, ki ji je pravilno predložena, kot to od nje
         zahteva carinska zakonodaja;
E23/F22  "oseba" pomeni fizične in pravne osebe, razen če smisel besedila
         ne zahteva drugače;
E24/F20  "prepustitev blaga" pomeni dejanje carine, s katerim dovoli, da
         se blago, ki se carini, da na razpolago zadevnim osebam;
E25/F24  "povračilo" pomeni celotno ali delno povrnitev dajatev in davkov,
         ki so bili plačani za blago, ter celotno ali delno odpustitev
         dajatev in davkov, ki še niso bili plačani;
E26/F17  "zavarovanje" pomeni zadostno zagotovilo carini, da bo obveznost
         do nje izpolnjena. Zavarovanje je "splošno", če se z njim
         zagotavlja izpolnitev obveznosti, ki izhajajo iz več dejanj;
E27/E26  "tretja stran" pomeni katero koli osebo, ki za račun druge osebe
         neposredno nastopa pred carino v zvezi z uvozom, izvozom,
         gibanjem ali hrambo blaga.
3. POGLAVJE
CARINJENJE IN DRUGE CARINSKE FORMALNOSTI
Pristojni carinski uradi
3.1 Standard
Carina določi carinske urade, pri katerih je mogoče predložiti ali cariniti blago. Pri določanju pristojnosti in lokacije ter delovnega časa teh uradov je treba zlasti upoštevati potrebe gospodarstva.
 
3.2 Standard
Na zahtevo zadevne osebe in iz razlogov, ki jih carina šteje za utemeljene, carina glede na razpoložljiva sredstva opravlja naloge za namene določenega carinskega postopka in prakse zunaj določenega delovnega časa ali zunaj carinskega urada. Kakršni koli stroški, ki jih zaračuna carina, morajo biti v mejah približnih stroškov opravljenih storitev.
 
3.3 Standard
Če sta carinska urada na skupnem mejnem prehodu, zadevni carinski upravi uskladita delovni čas in pristojnosti teh uradov.
 
3.4 Prehodni standard
Zadevni carinski upravi na skupnih mejnih prehodih izvajata skupne kontrole, kadar koli je to mogoče.
 
3.5 Prehodni standard
Kadar namerava carina na skupnem mejnem prehodu ustanoviti nov carinski urad ali spremeniti obstoječega, če je le mogoče, sodeluje s sosednjo carino pri ustanovitvi carinskega urada ob carinskem uradu druge države za lažje izvajanje skupnih kontrol.
Deklarant
(a) Osebe, ki so upravičene nastopati kot deklaranti
 
3.6 Standard
Z notranjo zakonodajo se določijo pogoji, pod katerimi je neka oseba upravičena nastopati kot deklarant.
 
3.7 Standard
Vsaka oseba s pravico do razpolaganja z blagom je upravičena nastopati kot deklarant.
 
(b) Obveznosti deklaranta
 
3.8 Standard
Deklarant je carini odgovoren za točnost posameznih podatkov, navedenih v deklaraciji blaga, ter za plačilo dajatev in davkov.
 
(c) Pravice deklaranta
 
3.9 Standard
Pred vložitvijo deklaracije blaga se deklarantu pod pogoji, kot jih lahko določi carina, dovoli, da:
(a) pregleda blago in
(b) odvzame vzorce.
 
3.10 Standard
Carina ne zahteva posebne deklaracije blaga za vzorce, ki so bili odvzeti pod carinskim nadzorom, če so ti vzorci vključeni v deklaraciji blaga, ki se nanaša na zadevno pošiljko.
Deklaracija blaga
(a) Oblika in vsebina deklaracije blaga
 
3.11 Standard
Vsebino deklaracije blaga predpiše carina. Papirna oblika deklaracije blaga ustreza vzorcu obrazca Združenih narodov.
Oblika deklaracije blaga, vložene po elektronski poti v postopku elektronskega carinjenja, temelji na mednarodnih standardih za elektronsko izmenjavo informaciji, predpisanih v priporočilih Sveta za carinsko sodelovanje o informacijski tehnologiji.
 
3.12 Standard
Carina omeji podatke, ki jih mora vsebovati deklaracija blaga, samo na tiste podatke, ki jih šteje za potrebne za določitev in pobiranje dajatev in davkov, izdelavo statističnih poročil ter uporabo carinske zakonodaje.
 
3.13 Standard
Kadar deklarant iz razlogov, ki jih carina šteje za utemeljene, nima na voljo vseh informacij, potrebnih za izpolnitev deklaracije blaga, se dovoli vložitev začasne ali nepopolne deklaracije blaga, če ta vsebuje posamezne podatke, ki jih carina šteje za potrebne, in se deklarant zaveže, da bo deklaracijo dopolnil v določenem roku.
 
3.14 Standard
Če carina sprejme začasno ali nepopolno deklaracijo blaga, se tarifna obravnava, ki naj se uporabi za blago, ne sme razlikovati od tiste, do katere bi bilo blago upravičeno, če bi bila že na začetku vložena popolna in točna deklaracija blaga.
S prepustitvijo blaga se ne sme odlašati, če je bilo predloženo zahtevano zavarovanje za zagotovitev pobiranja predpisanih dajatev in davkov.
 
3.15 Standard
Carina zahteva vložitev izvirnika deklaracije blaga in le najmanjše potrebno število izvodov.
 
(b) Dokumenti, ki se priložijo deklaraciji blaga
 
3.16 Standard
Carina zahteva, da se priložijo le tisti dokumenti, ki so potrebni zato, da se omogoči nadzor nad dejanjem in zagotovi izpolnitev vseh zahtev v zvezi z uporabo carinske zakonodaje.
 
3.17 Standard
Kadar določenih dokumentov, ki se priložijo, iz razlogov, ki jih carina šteje za utemeljene, ni mogoče vložiti skupaj s deklaracijo blaga, se dovoli naknadna predložitev teh dokumentov v določenem roku.
 
3.18 Prehodni standard
Carina dovoli vložitev dokumentov, ki se priložijo, po elektronski poti.
 
3.19 Standard
Carina ne zahteva prevoda posameznih podatkov v dokumentih, ki se priložijo, razen če je to potrebno za obdelavo deklaracije blaga.
Vložitev, sprejem in preverjanje deklaracije blaga
3.20 Standard
Carina dovoli vložitev deklaracije blaga pri katerem koli za to določenem carinskem uradu.
 
3.21 Standard
Carina dovoli vložitev deklaracije blaga po elektronski poti.
 
3.22 Standard
Deklaracija blaga se vloži med urami, ki jih določi carina.
 
3.23 Standard
Kadar notranja zakonodaja določa rok za vložitev deklaracije blaga, mora biti dovoljeni rok zadosten, da deklarantu omogoči izpolnitev deklaracije blaga in pridobitev zahtevanih dokumentov, ki se priložijo.
 
3.24 Standard
Na zahtevo deklaranta in iz razlogov, ki jih carina šteje za utemeljene, carina podaljša predpisani rok za vložitev deklaracije blaga.
 
3.25 Standard
Z notranjo zakonodajo se predvidi vložitev in sprejem ali preverjanje deklaracije blaga in dokumentov, ki se priložijo, pred prispetjem blaga.
 
3.26 Standard
Če carina ne more sprejeti deklaracije blaga, deklarantu navede razloge.
 
3.27 Standard
Carina dovoli deklarantu, da spremeni že vloženo deklaracijo blaga, če ob prejemu zahteve za spremembo še ni začela preverjati deklaracije ali pregledovati blaga.
 
3.28 Prehodni standard
Če carina prejme zahtevo po tem, ko je že začela preverjati deklaracijo blaga, deklarantu dovoli, da jo spremeni, če razloge, ki jih navede deklarant, šteje za utemeljene.
 
3.29 Prehodni standard
Deklarantu se dovoli, da umakne deklaracijo blaga in zaprosi za drug carinski postopek, če tako zahtevo predloži carini pred prepustitvijo blaga in carina razloge za to šteje za utemeljene.
 
3.30 Standard
Preverjanje deklaracije blaga se opravi ob sprejemu deklaracije blaga ali po njem, takoj ko je mogoče.
 
3.31 Standard
Zaradi preverjanja deklaracije blaga carina opravi le tista dejanja, ki jih šteje za bistvena za zagotovitev skladnosti s carinsko zakonodajo.
Posebni postopki za pooblaščene osebe
3.32 Prehodni standard
Pooblaščenim osebam, ki izpolnjujejo pogoje, ki jih določi carina, vključno s tem, da so pri dosedanjem poslovanju ravnale v skladu s carinskimi zahtevami ter da imajo zadovoljive sisteme za vodenje evidenc o poslovanju, carina zagotovi:
– prepustitev blaga ob predložitvi najmanjšega števila informacij, potrebnih za prepoznavanje blaga, in dovoli naknadno vložitev dokončne deklaracije blaga,
– carinjenje blaga v poslovnih prostorih deklaranta ali na drugem mestu, ki ga določi carina,
in poleg tega v največji možni meri druge posebne postopke, kot so:
– možnost vložitve ene same deklaracije blaga za ves uvoz ali izvoz v določenem obdobju, kadar blago pogosto uvaža ali izvaža ista oseba,
– uporaba poslovnih evidenc pooblaščene osebe za lasten izračun dajatev in davkov, ki jih je treba plačati, in kadar je to primerno, za zagotovitev skladnosti z drugimi carinskimi zahtevami,
– možnost vložitve deklaracije blaga na podlagi vpisa v evidence pooblaščene osebe z naknadno vložitvijo dopolnilne deklaracije blaga.
Pregled blaga
(a) Čas, potreben za pregled blaga
 
3.33 Standard
Če se carina odloči za pregled deklariranega blaga, se pregled opravi v čim krajšem možnem času po sprejemu deklaracije blaga.
 
3.34 Standard
Pri določanju urnika pregledov carina daje prednost pregledu živih živali in hitro pokvarljivega blaga ter drugega blaga, katerega pregled je po mnenju carine nujno treba čim prej opraviti.
 
3.35 Prehodni standard
Če morajo blago pregledati drugi pristojni organi in tudi carina predvidi pregled, mora zagotoviti usklajenost pregledov in po možnosti sočasno izvedbo pregledov.
 
(b) Prisotnost deklaranta pri pregledu blaga
 
3.36 Standard
Carina obravnava zahteve deklaranta glede njegove prisotnosti ali prisotnosti njegovega zastopnika pri pregledu blaga. Razen v izjemnih okoliščinah carina takšnim zahtevam ugodi.
 
3.37 Standard
Carina lahko, če to šteje za koristno, zahteva od deklaranta, da je sam ali njegov zastopnik prisoten pri pregledu blaga, zato da ji zagotovi vso pomoč, potrebno za olajšanje pregleda.
 
(c) Odvzem vzorcev, ki ga opravi carina
 
3.38 Standard
Vzorci se odvzamejo samo, če to carina šteje za potrebno zaradi preverjanja tarifnega poimenovanja in/ali vrednosti deklariranega blaga ali zaradi zagotavljanja uporabe drugih določb notranje zakonodaje. Vzorci se odvzamejo v čim manjših količinah.
Napake
3.39 Standard
Carina napak ne kaznuje z občutnimi denarnimi kaznimi, če se prepriča, da gre za nenamerne napake in ne za goljufiv namen ali hudo malomarnost. Če to šteje za potrebno zaradi preprečevanja ponavljanja takšnih napak, lahko naloži denarno kazen, ki pa ne sme biti višja, kot je potrebno za ta namen.
Prepustitev blaga
3.40 Standard
Deklarirano blago se prepusti takoj, ko ga je carina pregledala ali ko se je odločila, da ga ne bo pregledala, če:
– ni odkrita nobena kršitev,
– so pridobljena vsa potrebna uvozna ali izvozna dovoljenja ali drugi dokumenti,
– so pridobljena vsa dovoljenja v zvezi z izvedbo zadevnega postopka in
– so plačane vse dajatve in davki ali če so izvedeni ustrezni ukrepi za zagotovitev plačila le-teh.
 
3.41 Standard
Carina prepusti blago, če se prepriča, da bo deklarant naknadno opravil vse formalnosti v zvezi s carinjenjem, pod pogojem, da deklarant predloži za carino sprejemljiv komercialni ali uradni dokument z osnovnimi podatki o zadevni pošiljki in če je bilo, kadar je to potrebno, predloženo zavarovanje za zagotovitev pobiranja predpisanih dajatev in davkov.
 
3.42 Standard
Kadar se carina odloči, da potrebuje laboratorijske analize vzorcev, natančne tehnične dokumente ali izvedenska mnenja, blago prepusti, preden so znani rezultati takšnih pregledov, če je bilo predloženo kakršno koli potrebno zavarovanje in če se prepriča, da za blago ne veljajo prepovedi ali omejitve.
 
3.43 Standard
Kadar se ugotovi kršitev, carina blago prepusti, preden je dokončano upravno ali pravno dejanje, pod pogojem, da za blago ni predpisan zaseg ali odvzem ali blago ni potrebno kot dokaz v nadaljnjem postopku in da deklarant plača dajatve in davke ter predloži zavarovanje za zagotovitev pobiranja kakršnih koli dodatnih dajatev in davkov ter denarnih kazni, ki so lahko naložene.
Odstop ali uničenje blaga
3.44 Standard
Če blago še ni bilo sproščeno v domačo porabo ali če je bil zanj uveden drug carinski postopek ter pod pogojem, da ni bil odkrit prekršek, se od zadevne osebe ne zahteva plačilo dajatev in davkov ali pa je upravičena do povračila le-teh:
– če se blago na njeno zahtevo odstopi v korist proračuna ali uniči ali razvrednoti za komercialne namene pod carinsko kontrolo, odvisno od odločitve carine. Vse s tem povezane stroške krije zadevna oseba,
– če se blago uniči ali nepovratno izgubi zaradi nesreče ali višje sile, pod pogojem, da se takšno uničenje ali izguba carini v zadostni meri pravilno utemelji,
– za primanjkljaje, ki so posledica narave blaga, pod pogojem, da se takšni primanjkljaji carini v zadostni meri pravilno utemeljijo.
Za odpadke ali ostanke, ki preostanejo po uničenju, je ob vnosu v domačo porabo ali izvozu treba plačati dajatve in davke, ki bi jih bilo treba plačati ob uvozu ali izvozu odpadkov ali ostankov v takem stanju.
 
3.45 Prehodni standard
Če carina blago, ki ni bilo deklarirano v predpisanem roku, ali blago, ki ga ni bilo mogoče prepustiti, čeprav ni bil odkrit noben prekršek, proda, se izkupiček od prodaje po odbitku dajatev in davkov ter vseh drugih taks in izdatkov, ki so nastali, izplača osebam, ki so do njega upravičene, ali če to ni mogoče, se ta izkupiček hrani določen čas, v katerem jim je na razpolago.
4. POGLAVJE
DAJATVE IN DAVKI
A. OBRAČUN, POBIRANJE IN PLAČILO DAJATEV IN DAVKOV
4.1 Standard
Z notranjo zakonodajo se določijo okoliščine, v katerih nastane obveznost plačila dajatev in davkov.
 
4.2 Standard
Z notranjo zakonodajo se določi rok za obračun predpisanih dajatev in davkov. Obračun se opravi čim prej po vložitvi deklaracije blaga ali po tem, ko je obveznost plačila nastala na drug način.
 
4.3 Standard
Z notranjo zakonodajo se opredelijo dejavniki, ki so podlaga za obračun dajatev in davkov ter pogoji za njihovo določanje.
 
4.4 Standard
Stopnje dajatev in davkov se objavijo v uradnih publikacijah.
 
4.5 Standard
Z notranjo zakonodajo se določi trenutek, ki ga je treba upoštevati pri določitvi stopenj dajatev in davkov.
 
4.6 Standard
Z notranjo zakonodajo se določijo možni načini plačila dajatev in davkov.
 
4.7 Standard
Z notranjo zakonodajo se določijo oseba oziroma osebe, ki so odgovorne za plačilo dajatev in davkov.
 
4.8 Standard
Z notranjo zakonodajo se določita datum zapadlosti in kraj plačila.
 
4.9 Standard
Če se z notranjo zakonodajo določi, da je lahko datum zapadlosti plačila po prepustitvi blaga, mora biti ta datum določen tako, da nastopi vsaj deset dni po prepustitvi. Za obdobje med datumom prepustitve blaga in datumom zapadlosti se obresti ne zaračunajo.
 
4.10 Standard
Z notranjo zakonodajo se določi rok, v katerem lahko carina sprejme z zakonom določene ukrepe za izterjavo dajatev in davkov, ki niso bili pobrani do datuma zapadlosti.
 
4.11 Standard
Z notranjo zakonodajo se določijo obrestna mera, po kateri se zaračunajo obresti na znesek dajatev in davkov, ki niso bili pobrani do datuma zapadlosti, ter pogoji za zaračunavanje teh obresti.
 
4.12 Standard
Ko so dajatve in davki plačani, se plačniku izda potrdilo kot dokazilo o plačilu, razen če ne obstaja drugačno dokazilo o plačilu.
 
4.13 Prehodni standard
Z notranjo zakonodajo se določita najmanjša vrednost in/ali najmanjši znesek dajatev in davkov, pod katerim se ti ne pobirajo.
 
4.14 Standard
Če carina odkrije napake v deklaraciji blaga ali obračunu dajatev in davkov, zaradi katerih bo ali je bil znesek pobranih ali izterjanih dajatev in davkov nižji od zakonsko predpisanega zneska, jih popravi in pobere neplačani znesek. Če pa je ta znesek nižji od najmanjšega zneska, določenega z notranjo zakonodajo, ga carina ne pobere ali izterja.
B. ODLOG PLAČILA DAJATEV IN DAVKOV
4.15 Standard
Če se z notranjo zakonodajo predvidi odlog plačila dajatev in davkov, se določijo pogoji, pod katerimi se takšna olajšava odobri.
 
4.16 Standard
Odlog plačila se v možnem obsegu odobri brez zaračunavanja obresti.
 
4.17 Standard
Rok odloga plačila dajatev in davkov ne sme biti krajši od štirinajst dni.
C. POVRAČILO DAJATEV IN DAVKOV
4.18. Standard
Povračilo se odobri, če se ugotovi, da so bili dajatve in davki preveč zaračunani zaradi napake pri obračunu.
 
4.19 Standard
Povračilo se odobri za uvoženo ali izvoženo blago, za katero se ugotovi, da je blago z napako ali drugače ne ustreza specifikacijam, dogovorjenim ob uvozu ali izvozu, ter se vrne dobavitelju ali drugi osebi, ki jo imenuje dobavitelj, ob naslednjih pogojih:
– da se blago v državi uvoza ni obdelovalo, popravljalo ali uporabljalo in da se ponovno izvozi v primernem roku,
– da se blago v državi, v katero je bilo izvoženo, ni obdelovalo, popravljalo ali uporabljalo in da se ponovno uvozi v primernem roku.
Uporaba blaga pa ne preprečuje povračila, če je bila takšna uporaba nujno potrebna za ugotovitev napak na blagu ali drugih okoliščin, zaradi česar je bilo blago ponovno izvoženo ali uvoženo.
Razen možnosti ponovnega izvoza ali ponovnega uvoza se blago lahko odstopi v korist proračuna ali uniči ali razvrednoti za komercialne namene pod carinsko kontolo, odvisno od odločitve carine. Tak odstop ali uničenje ne sme povzročiti nobenih stroškov za proračun.
 
4.20 Prehodni standard
Če carina za blago, za katero je bil prvotno začet carinski postopek s plačilom dajatev in davkov, dovoli začetek drugega carinskega postopka, se preveč zaračunane dajatve ali davki povrnejo do zneska, ki ga je treba plačati za nov carinski postopek.
 
4.21 Standard
Odločitve o zahtevkih za povračilo se sprejmejo in pisno sporočijo zadevnim osebam brez nepotrebnega odlašanja, preveč zaračunani zneski pa se povrnejo čim prej po odobritvi zahtevkov.
 
4.22 Standard
Če carina ugotovi, da je preveč zaračunani znesek posledica napake carine pri obračunu dajatev in davkov, se povračilo opravi prednostno.
 
4.23 Standard
Če se določijo roki, po preteku katerih se zahtevki za povračilo ne sprejemajo več, morajo biti ti roki dovolj dolgi glede na različne okoliščine posameznih vrst primerov, v katerih je mogoče odobriti povračilo.
 
4.24 Standard
Povračilo se ne odobri, če je obravnavani znesek nižji od najmanjšega zneska, določenega v notranji zakonodaji.
5. POGLAVJE
ZAVAROVANJE
5.1 Standard
Z notranjo zakonodajo se navedejo primeri, v katerih je potrebno zavarovanje, in opredelijo oblike, v katerih je treba zagotoviti zavarovanje.
 
5.2 Standard
Carina določi znesek zavarovanja.
 
5.3 Standard
Vsaka oseba, ki je dolžna zagotoviti zavarovanje, mora imeti možnost izbire katere koli oblike zavarovanja pod pogojem, da je sprejemljiva za carino.
 
5.4 Standard
Kadar se tako določi z notranjo zakonodajo, carina ne zahteva zavarovanja, če se prepriča, da bo obveznost do carine izpolnjena.
 
5.5 Standard
Če se zavarovanje zahteva zaradi zagotovitve izpolnitve obveznosti, ki izhajajo iz carinskega postopka, carina sprejme splošno zavarovanje, zlasti od deklarantov, ki redno prijavljajo blago pri različnih uradih na carinskem območju.
 
5.6 Standard
Če je zavarovanje potrebno, mora biti znesek zavarovanja tako nizek, kot je mogoče, in glede na plačilo dajatev in davkov ne sme presegati zneska, ki bi ga bilo mogoče zaračunati.
 
5.7 Standard
Če je bilo zavarovanje zagotovljeno, se sprosti v najkrajšem možnem času po tem, ko se carina prepriča, da so bile obveznosti, zaradi katerih je bilo zahtevano zavarovanje, pravilno izpolnjene.
6. POGLAVJE
CARINSKA KONTROLA
6.1 Standard
Vsako blago, vključno s prevoznimi sredstvi, ki se vnese na carinsko območje ali iznese z njega, je predmet carinske kontrole ne glede na to, ali je zavezano dajatvam in davkom.
 
6.2 Standard
Carinska kontrola se omeji na to, kar je potrebno za zagotovitev skladnosti s carinsko zakonodajo.
 
6.3 Standard
Pri izvajanju carinske kontrole carina uporablja obvladovanje tveganja.
 
6.4 Standard
Carina uporablja analizo tveganja, da določi osebe in blago, ki jih je treba pregledati, vključno s prevoznimi sredstvi, ter obseg pregleda.
 
6.5 Standard
Za podporo pri obvladovanju tveganja carina sprejme strategijo za merjenje skladnosti s predpisi.
 
6.6 Standard
Sistemi carinske kontrole vključujejo kontrole na podlagi revizije.
 
6.7 Standard
Zaradi izboljšanja carinske kontrole si carina prizadeva za sodelovanje z drugimi carinskimi upravami in za sklepanje sporazumov o medsebojni upravni pomoči.
 
6.8 Standard
Zaradi izboljšanja carinske kontrole si carina prizadeva za sodelovanje z gospodarstvom in za sklepanje memorandumov o soglasju.
 
6.9 Prehodni standard
Zaradi izboljšanja carinske kontrole carina v največji možni meri uporablja informacijsko tehnologijo in elektronsko poslovanje.
 
6.10 Standard
Zaradi zagotavljanja skladnosti z carinskimi zahtevami carina ocenjuje komercialne sisteme gospodarskih subjektov, če ti sistemi vplivajo na carinske postopke.
7. POGLAVJE
UPORABA INFORMACIJSKE TEHNOLOGIJE
7.1 Standard
Carina uporablja informacijsko tehnologijo za podporo pri carinskih postopkih, kadar je stroškovno ugodna in učinkovita za carino in gospodarstvo. Carina določi pogoje za njeno uporabo.
 
7.2 Standard
Pri uvajanju računalniških sistemov carina uporablja ustrezne mednarodno sprejete standarde.
 
7.3 Standard
Informacijska tehnologija se v največji možni meri uvaja ob posvetovanju z vsemi neposredno zainteresiranimi strankami.
 
7.4 Standard
Z novo ali spremenjeno notranjo zakonodajo se predvidijo:
– načini elektronskega poslovanja kot alternativa dokumentaciji na papirju,
– elektronski načini in načini dokazovanja pristnosti na papirju,
– pravica carine, da zadrži informacije za lastno uporabo ter jih, kadar je primerno, z uporabo tehnik elektronskega poslovanja izmenja z drugimi carinskimi upravami in vsemi drugimi strankami, ki so upravičene po predpisih.
8. POGLAVJE
RAZMERJE MED CARINO IN TRETJIMI STRANMI
8.1 Standard
Zadevne osebe lahko izberejo, da s carino poslujejo neposredno ali tako, da imenujejo tretjo stran, da deluje v njihovem imenu.
 
8.2 Standard
Z notranjo zakonodajo se določijo pogoji, pod katerimi lahko oseba pri poslovanju s carino deluje za drugo osebo in v njenem imenu, in odgovornost tretjih strani do carine glede dajatev in davkov ter v primeru nepravilnosti.
 
8.3 Standard
Carinska dejanja, pri katerih se zadevna oseba odloči poslovati za svoj račun, se ne smejo obravnavati manj ugodno in zanje ne smejo veljati strožje zahteve kot carinska dejanja, ki jih za zadevno osebo opravlja tretja stran.
 
8.4 Standard
Oseba, imenovana kot tretja stran, ima v zadevah, ki se nanašajo na poslovanje s carino, enake pravice kot oseba, ki jo je imenovala.
 
8.5 Standard
Carina tretjim stranem omogoči sodelovanje pri uradnih posvetovanjih z gospodarstvom.
 
8.6 Standard
Carina določi okoliščine, v katerih ni pripravljena poslovati s tretjo stranjo.
 
8.7 Standard
Carina v pisni obliki obvesti tretjo stran o svoji odločitvi, da z njo ne bo poslovala.
9. POGLAVJE
INFORMACIJE, ODLOČITVE IN ODLOČBE, KI JIH IZDAJA CARINA
A. SPLOŠNE INFORMACIJE
9.1 Standard
Carina vsem zainteresiranim osebam zagotovi enostaven dostop do vseh tistih splošnih informacij, ki se nanašajo na carinsko zakonodajo.
 
9.2 Standard
Kadar je treba razpoložljive informacije spremeniti zaradi sprememb carinske zakonodaje, upravnih dogovorov ali zahtev, carina spremenjene informacije zagotovi dovolj vnaprej pred začetkom veljavnosti sprememb, da jih lahko zainteresirane osebe upoštevajo, razen če ni vnaprejšnje obveščanje izključeno.
 
9.3 Prehodni standard
Zaradi izboljšanja zagotavljanja informacij carina uporablja informacijsko tehnologijo.
B. POSEBNE INFORMACIJE
9.4 Standard
Na zahtevo zainteresirane osebe carina tako hitro in točno, kot je mogoče, zagotovi informacije v zvezi s posebnimi vprašanji, ki jih postavi zainteresirana oseba in se nanašajo na carinsko zakonodajo.
 
9.5 Standard
Carina daje ne le posebej zahtevane informacije, temveč tudi vse druge zadevne informacije, o katerih meni, da bi morala z njimi seznaniti zainteresirano osebo.
 
9.6 Standard
Pri dajanju informacij mora carina zagotoviti, da ne razkrije podrobnosti zasebne ali zaupne narave, ki zadevajo carino ali tretje strani, razen če takšnega razkritja ne zahteva ali dovoljuje notranja zakonodaja.
 
9.7 Standard
Če carina ne more dati informacij brezplačno, znesek, ki ga zaračuna, ne sme presegati približnih stroškov opravljenih storitev.
C. ODLOČITVE IN ODLOČBE
9.8 Standard
Na pisno zahtevo zadevne osebe carina svojo odločitev sporoči v pisni obliki v roku, ki ga določa notranja zakonodaja. Kadar je odločitev za zadevno osebo neugodna, se navedejo razlogi in pouk o pravici do pritožbe.
 
9.9 Standard
Na zahtevo zainteresirane osebe carina izdaja zavezujoče odločbe pod pogojem, da carina razpolaga z vsemi informacijami, ki jih šteje za potrebne.
10. POGLAVJE
PRITOŽBE V CARINSKIH ZADEVAH
A. PRAVICA DO PRITOŽBE
10.1 Standard
Z notranjo zakonodajo se zagotovi pravica do pritožbe v carinskih zadevah.
 
10.2 Standard
Pravico do pritožbe ima vsaka oseba, ki jo odločitev ali opustitev carine neposredno zadeva.
 
10.3 Standard
Osebi, ki jo odločitev ali opustitev carine neposredno zadeva, se po tem, ko predloži zahtevo carini, navedejo razlogi za takšno odločitev ali opustitev v roku, ki ga določa notranja zakonodaja. To ima lahko za posledico pritožbo ali pa ne.
 
10.4 Standard
Z notranjo zakonodajo se zagotovi pravica, da se najprej pritoži pri carini.
 
10.5 Standard
Če carina zavrne pritožbo, ima pritožnik pravico do nadaljnje pritožbe pri organu, ki je neodvisen od carinske uprave.
 
10.6 Standard
Na zadnji stopnji ima pritožnik pravico do pritožbe pri sodnem organu.
B. OBLIKA PRITOŽBE IN RAZLOGI ZANJO
10.7 Standard
Pritožbo je treba vložiti pisno in navesti razloge, na podlagi katerih je bila vložena.
 
10.8 Standard
Za vložitev pritožbe zoper odločitev carine se določi rok, ta pa mora pritožniku omogočiti dovolj časa za preučitev izpodbijane odločitve in pripravo pritožbe.
 
10.9 Standard
Kadar se pritožba vloži pri carini, ta ne zahteva samoumevno, da se skupaj s pritožbo vložijo morebitni dodatni dokazi, vendar v primernih okoliščinah omogoči razumen rok za vložitev takšnih dokazov.
C. OBRAVNAVA PRITOŽBE
10.10 Standard
Carina odloči o pritožbi, kakor hitro je mogoče, in o tem pisno obvesti pritožnika.
 
10.11 Standard
Če carina zavrne pritožbo, pisno navede razloge za to in pritožnika pouči o njegovi pravici do vložitve kakršne koli nadaljnje pritožbe pri upravnem ali neodvisnem organu ter o kakršnem koli roku za vložitev takšne pritožbe.
 
10.12 Standard
Če se pritožbi ugodi, carina izvrši svojo odločitev ali odločbo neodvisnega ali sodnega organa, kakor hitro je mogoče, razen v primerih, ko se zoper odločbo pritoži carina.
3. člen
Za izvajanje protokola skrbi Ministrstvo za finance – Carinska uprava Republike Slovenije.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
