O RAZGLASITVI ZAKONA O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO HELENSKE REPUBLIKE O GOSPODARSKEM IN TEHNOLOŠKEM SODELOVANJU (BGRGTS)
Razglašam Zakon o ratifikaciji Sporazuma med Vlado Republike Slovenije in Vlado Helenske republike o gospodarskem in tehnološkem sodelovanju (BGRGTS), ki ga je sprejel Državni zbor Republike Slovenije na seji 28. februarja 2002.

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO HELENSKE REPUBLIKE O GOSPODARSKEM IN TEHNOLOŠKEM SODELOVANJU (BGRGTS)
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Helenske republike o gospodarskem in tehnološkem sodelovanju, podpisan v Ljubljani 30. novembra 2001.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi: *
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN VLADO HELENSKE REPUBLIKE O GOSPODARSKEM IN TEHNOLOŠKEM SODELOVANJU
Vlada Republike Slovenije in Vlada Helenske Republike (v nadaljevanju “pogodbenici“), ki
želita pospešiti razvoj medsebojnega gospodarskega in tehnološkega sodelovanja na področjih obojestranskega interesa na podlagi enakopravnosti, obojestranske koristi in vzajemnosti,
priznavata pomen dolgoročnih ukrepov za uspešen razvoj sodelovanja in krepitve medsebojnih vezi na različnih ravneh, še zlasti na ravni svojih gospodarskih subjektov,
sta se sporazumeli:
1. člen
1. Pogodbenici si v okviru svojih zakonov in predpisov in ob upoštevanju svojih mednarodnih obveznosti ter sporazumov med Evropsko skupnostjo in Republiko Slovenijo kar najbolj prizadevata za razvoj in krepitev gospodarskega in tehnološkega sodelovanja na čim širši podlagi in na vseh področjih, za katere menita, da so v njunem obojestranskem interesu in v njuno obojestransko korist.
Pri izvajanju tega sporazuma Helenska republika spoštuje obveznosti, ki izhajajo iz njenega članstva v Evropski uniji.
2. Takšno sodelovanje je še zlasti namenjeno:
– krepitvi in raznolikosti gospodarskih vezi med pogodbenicama,
– spodbujanju sodelovanja med gospodarskimi subjekti vključno z majhnimi in srednjevelikimi podjetji z namenom, da bi pospeševali naložbe, skupna vlaganja, licenčne pogodbe in druge oblike medsebojnega sodelovanja.
2. člen
1. Sodelovanje, predvideno v 1. členu, se razširi zlasti na naslednja področja:
– industrijo,
– ladjedelništvo,
– kmetijstvo, vključno z živilsko industrijo,
– gradbeništvo in stanovanjsko gradnjo,
– promet, vključno s pomorskim prometom,
– bančništvo, zavarovalništvo in druge finančne storitve,
– turizem,
– poklicno in poslovodsko usposabljanje,
– druge storitvene dejavnosti obojestranskega interesa.
2. Pogodbenici se posvetujeta, da bi opredelili prednostna področja pri svojem sodelovanju in nova področja gospodarskega in tehnološkega sodelovanja.
3. člen
1. Gospodarsko sodelovanje, predvideno v tem sporazumu, v glavnem poteka na podlagi sporazumov in pogodb med slovenskimi in grškimi podjetji, organizacijami in firmami v skladu z zakonodajo vsake pogodbenice.
2. Pogodbenici si kar najbolj prizadevata, da bi olajšali to dejavnost z ustvarjanjem ugodnih razmer za gospodarsko sodelovanje, zlasti s tem da:
– ustvarita ugodno ozračje za naložbe,
– omogočita lažjo izmenjavo poslovnih in gospodarskih informacij,
– olajšata izmenjavo in stike med svojimi gospodarskimi subjekti,
– omogočita lažjo organizacijo sejmov, razstav, simpozijev itd.,
– spodbudita dejavnosti za pospeševanje trgovine.
4. člen
1. Pogodbenici ustvarita ugodne razmere za razvoj tehnološkega sodelovanja med svojima državama in svojimi ustanovami, organizacijami ali podjetji glede na prednostne naloge vsake države in v skladu s svojima zakonodajama.
2. To sodelovanje lahko med drugim poteka v obliki:
– izdelave skupnih raziskovalnih programov,
– organizacije obiskov in študijskih potovanj za specializirane delegacije,
– organizacije programov usposabljanja na področjih skupnega interesa,
– zagotavljanja strokovnega znanja v tehniki in znanosti,
– sklicevanja simpozijev in zasedanj.
5. člen
1. S tem se ustanovi Skupni odbor, katerega cilj je zagotoviti izvajanje tega sporazuma.
2. Skupni odbor je sestavljen iz predstavnikov pogodbenic in se sestane na zahtevo ene ali druge pogodbenice, o kraju in času sestanka pa se medsebojno dogovorita po diplomatski poti.
3. Skupni odbor pregleda, kako poteka uresničevanje ciljev tega sporazuma in po potrebi oblikuje priporočila za njegovo izvajanje.
6. člen
1. Ta sporazum začne veljati trideset (30) dni po zadnjem obvestilu, s katerim se pogodbenici obvestita, da so postopki, ki jih v ta namen predpisujeta njuni zakonodaji, dokončani.
2. Sporazum velja nedoločen čas. Katera koli pogodbenica ga lahko pisno odpove s šestmesečnim odpovednim rokom.
3. Odpoved tega sporazuma ne vpliva na neizpolnjene obveznosti, ki izhajajo iz sporazumov in pogodb, sklenjenih med gospodarskimi subjekti pogodbenic ali v okviru tehnološkega sodelovanja v času trajanja njegove veljavnosti.
Sestavljeno v dveh izvodih v Ljubljani dne 30. novembra 2001 v slovenskem, grškem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Pri razlikah v razlagi prevlada angleško besedilo.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE HELLENIC REPUBLIC ON ECONOMIC AND TEHNOLOGICAL COOPERATION
The Government of the Republic of Slovenia and the Government of the Hellenic Republic (Hereinafter referred to as “the Contracting Parties”),
Desiring to promote the development of economic and technological cooperation between them, in areas of mutual interest, on the basis of equality, mutual benefit and reciprocity,
Recognizing the importance of long term measures for the successful development of the cooperation and the strengthening of ties between them at various levels and, in particular, at the level of their economic operators,
Have agreed as follows:
Article 1
1. The Contracting Parties shall, within the framework of their respective laws and regulations and taking into account their international obligations, as well as the Agreements between the European Community and the Republic of Slovenia, make every effort to develop and strengthen economic and tehnological cooperation, on as broad a basis as possible, in all fields deemed to be in their mutual interest and benefit.
In applying this Agreement, the Hellenic Republic shall respect the obligations arising from its membership to the European Union.
2. Such cooperation shall be aimed in particular at:
– strengthening and diversifying economic links between the Contracting Parties,
– encouraging cooperation between economic operators, including small and medium sized enterprises, with a view to promote investment, joint ventures, licensing agreements and other forms of cooperation between them.
Article 2
1. The cooperation provided for in Article 1, shall extend, in particular, in the following sectors:
– industry,
– ship-building and ship repairing,
– agriculture, including agro-industry,
– construction and housing,
– transport, including maritime transport,
– banking, insurance and other financial services,
– tourism,
– vocational training and management training,
– other service activities of mutual interest.
2. The Contracting Parties shall consult in order to identify the priority sectors in their cooperation as well as new sectors of economic and technological cooperation.
Article 3
1. The economic cooperation provided for in this Agreement shall be carried out, mainly, on the basis of agreements and contracts between Slovenian and Greek enterprises, organisations and firms, according to the legislation of each Contracting Party.
2. The Contracting Parties shall make every effort to facilitate this activity by creating favorable conditions for economic cooperation, in particular, by:
– developing a favorable climate for investment,
– facilitating the exchange of commercial and economic information,
– facilitating the exchanges and contacts between their economic operators,
– facilitating the organization of fairs, exhibitions, symposia etc.,
– encouraging trade promotion activities.
Article 4
1. The Contracting Parties shall create favorable conditions for the development of technological cooperation between them, as well as between their respective institutions, organizations or firms, according to their national priorities and in accordance with their legislation.
2. This cooperation may take the form of, among other:
– the elaboration of common research programs,
– the organization of visits and study tours for specialized delegations,
– the organization of training programs in fields of mutual interest,
– the provision of technical and scientific expertise,
– the convening of symposia and meetings.
Article 5
1. A Joint Committee is hereby established, with the aim of ensuring the implementation of this Agreement.
2. The Joint Committee shall be composed of representatives of the Contracting Parties and shall meet, at the request of either Party, at a place and time to be mutually agreed upon, through diplomatic channels.
3. The Joint Committee shall review the progress made towards achieving the objectives of this Agreement and, if necessary, formulate recommendations for its implementation.
Article 6
1. This Agreement shall enter into force thirty (30) days after the latest of notifications with which the Contracting Parties inform each other that the procedures required by their respective laws to this end, have been completed.
2. The Agreement shall remain in force for an indefinite period of time. Either Contracting Party may terminate this Agreement upon a six-month prior written notice.
3. The termination of this Agreement shall not affect any unfulfilled obligations arising from agreements and contracts concluded between economic operators of the Contracting Parties, or in the framework of technological cooperation, during its period of validity.
Done in duplicate, in Ljubljana on 30 November 2001 in the Slovene, Greek and English languages, all texts being equally authentic. In case of divergence the English text shall prevail.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za gospodarstvo.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije - Mednarodne pogodbe.
