Razglašam Zakon o ratifikaciji Sporazuma o vojaškem sodelovanju med Ministrstvom za obrambo Republike Slovenije in Ministrstvom za nacionalno obrambo Helenske republike (BGRVS), ki ga je sprejel Državni zbor Republike Slovenije na seji 16. septembra 1999.

O RATIFIKACIJI SPORAZUMA O VOJAŠKEM SODELOVANJU MED MINISTRSTVOM ZA OBRAMBO REPUBLIKE SLOVENIJE IN MINISTRSTVOM ZA NACIONALNO OBRAMBO HELENSKE REPUBLIKE (BGRVS)
1. člen
Ratificira se Sporazum o vojaškem sodelovanju med Ministrstvom za obrambo Republike Slovenije in Ministrstvom za nacionalno obrambo Helenske republike, podpisan 15. julija 1999 v Atenah.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:*
S P O R A Z U M
O VOJAŠKEM SODELOVANJU MED MINISTRSTVOM ZA OBRAMBO REPUBLIKE SLOVENIJE IN MINISTRSTVOM ZA NACIONALNO OBRAMBO HELENSKE REPUBLIKE
UVOD
Ministrstvo za obrambo Republike Slovenije in Ministrstvo za nacionalno obrambo Helenske republike, v nadaljevanju pogodbenika, sta se
ob upoštevanju ciljev in načel Listine Združenih narodov, zlasti načela prepovedi uporabe sile ali grožnje za uporabo sile v medsebojnih odnosih, zoper samostojnost, nedotakljivost meja, ozemeljsko celovitost, načel nevmešavanja v notranje zadeve in mirnega reševanja sporov,
ob izpolnjevanju določb “Okvirnih dokumentov Partnerstva za mir“, sprejetih leta 1994 na bruseljskem vrhu,
ob spoštovanju zavez, sprejetih v skladu s Sklepno listino Konference o varnosti in sodelovanju v Evropi, Pariško listino in Dunajskim dokumentom ter drugimi ustreznimi dokumenti Organizacije za varnost in sodelovanje v Evropi (OVSE),
ob upoštevanju Sporazuma med Vlado Republike Slovenije in Vlado Helenske republike o vzpostavitvi diplomatskih odnosov, podpisanega 21. julija 1992 v Ljubljani,
z željo, da bi razvili dvostransko vojaško sodelovanje,
s ciljem, da bi v okviru dvostranskih odnosov v skladu z Dunajsko listino o pogojih za urejanje medsebojnega zaupanja in varnosti, sprejeto na Dunaju leta 1994, izvedli še nadaljnje ukrepe graditve zaupanja in varnosti,
dogovorili naslednje:
1. člen
NAMEN SODELOVANJA
Namen tega sporazuma je vzpostaviti sodelovanje med Ministrstvom za obrambo Republike Slovenije in Ministrstvom za nacionalno obrambo Helenske republike na vojaškem področju v mejah njunih pristojnosti, ki jih zagotavljata njuni državni zakonodaji, in oboroženimi silami njunih držav.
2. člen
NAČELA SODELOVANJA
Pogodbenika vzpostavita vojaško sodelovanje, ki temelji na načelih enakopravnosti in obojestranske koristi.
Sodelovanje vključuje dejavnosti med ministrstvoma za obrambo, generalštaboma in oboroženimi silami obeh držav v okviru njihovih zmožnosti.
Ta sporazum ne vpliva na pravico pogodbenikov do podpisa podobnih sporazumov z drugimi državami.
3. člen
PODROČJA SODELOVANJA
Sodelovanje zajema naslednja temeljna vprašanja in usmeritve:
– vprašanja oborožitvenih programov – vprašanja obrambnih programov,
– vojaško izobraževanje in usmerjeno usposabljanje osebja,
– logistična podpora,
– dejavnosti v okviru Partnerstva za mir,
– vojaški področji nadzora nad orožjem in razorožitve,
– delovanje za podporo miru,
– obvladovanje kriznih razmer,
– vojaška medicina,
– posebne službe,
– vojaške znanstvene raziskave (teoretične in uporabne).
Omenjene dejavnosti se lahko razširijo ali omejijo z medsebojnim sporazumom med pogodbenikoma.
4. člen
DEJAVNOSTI SODELOVANJA
To sodelovanje lahko vključuje te dejavnosti:
– uradne obiske in redna srečanja na ravni obrambnih ministrov, njihovih namestnikov, načelnikov generalštabov ali drugih predstavnikov ministrstev in oboroženih sil,
– medsebojna povabila na predstavitve opreme in oborožitve ter na vojaške vaje kot tudi udeležbo na njih ali njihovo organizacijo,
– udeležbo na uradnih, kulturnih in drugih dejavnostih, ki jih organizirata ministrstvi za obrambo ali druge vojaške strukture.
5. člen
NAČRTOVANJE SODELOVANJA
Za spremljanje izvajanja tega sporazuma in obveznosti, ki iz njega izhajajo, pogodbenika ustanovita skupno delovno skupino, sestavljeno iz visokih častnikov in strokovnjakov.
Da bi izpolnila določbe tega sporazuma, pogodbenika vsako leto pripravita program sodelovanja za naslednje leto.
Za določitev programa si pogodbenika izmenjata predloga v obliki zahtev. Predloga se vsako leto do 15. oktobra pošljeta generalštabu oboroženih sil Republike Slovenije in generalštabu oboroženih sil Helenske republike.
Program sodelovanja vključuje:
– opis dejavnosti,
– število udeležencev,
– trajanje, kraj in čas omenjenih dejavnosti,
– druge potrebne informacije.
Program sodelovanja vsako leto do 1. decembra podpišeta načelnika generalštabov za obrambo ali pooblaščena predstavnika pogodbenikov.
6. člen
ZAVEZE POGODBENIKOV MED IZMENJAVO DELEGACIJ
Pogodbenika prevzameta odgovornost za stroške v zvezi z izvajanjem dejavnosti po programih vojaškega sodelovanja na podlagi načela vzajemnosti.
Gostujoči pogodbenik prevzame:
– stroške prevoza v zvezi s potovanjem delegacije od kraja odhoda do določenega namembnega kraja v državi sprejemnici in nazaj;
– stroške, povezane s sprejemom, parkiranjem, varnostjo, vzdrževanjem in oskrbo z gorivom vojaškega zračnega plovila, ki zagotavlja prevoz vojaške delegacije;
– stroške v zvezi s prevozom bolne/poškodovane osebe v njegovo/njeno državo.
Pogodbenik gostitelj prevzame:
– stroške v zvezi z lokalnimi prevozi delegacije od kraja prihoda do območja načrtovanih dejavnosti ter stroške nastanitve, hrane in organiziranih kulturnih dejavnosti;
– opravljanje popolnih zdravstvenih storitev, vključno s hospitalizacijo;
– stroške v zvezi z usposabljanjem v specializiranih dejavnostih po dvostranskih sporazumih.
7. člen
PRAVNA VPRAŠANJA
Določbe Sporazuma med državami pogodbenicami Severnoatlantskega pakta in drugimi državami, ki sodelujejo v Partnerstvu za mir, glede statusa njihovih sil in njegovega Dodatnega protokola, podpisanega v Bruslju 19. junija 1995, se ustrezno uporabljajo za ta sporazum.
8. člen
ODGOVORNOST IN NADOMESTILA
Pogodbenika se odpovedujeta kakršnim koli zahtevkom po nadomestilu v primeru smrti, poškodbe ali škode, povzročene osebju ali njegovi lastnini z dejanji ali opustitvami osebja drugega pogodbenika med opravljanjem storitev v skladu s tem sporazumom. Zahteve se vložijo samo, če je bilo dejanje ali opustitev storjeno namenoma ali iz hude malomarnosti. V takšnem primeru je treba zahteve rešiti z neposrednimi pogajanji med pogodbenikoma brez pritožbe v sodni pristojnosti tretje strani.
V primeru smrti, poškodbe ali škode, ki jo je osebje pogodbenikov povzročilo tretjim stranem, če je osebje ravnalo v skladu s tem sporazumom, se pogodbenika sporazumeta o plačilu nadomestila. Če soglasja ni možno doseči, se zadeva predloži pristojnim sodiščem države, kjer je prišlo do škodnega dogodka.
9. člen
VARSTVO ZAUPNIH PODATKOV
Pogodbenika ščitita varnost podatkov in informacij, pridobljenih z dvostranskimi stiki, vključno z zaupnimi podatki, ter se obvezujeta, da jih ne bosta uporabila brez predhodne pisne odobritve pogodbenika, ki je te podatke zagotovil, ter da teh podatkov ne bosta dala tretji strani.
Z ustnimi in pisnimi podatki in informacijami, pridobljenimi z dvostranskimi stiki, se ravna v skladu z veljavno državno zakonodajo vsakega pogodbenika in se ne smejo objaviti v javnih občilih.
10. člen
REŠEVANJE SPOROV
Vsak spor, ki nastane med izvajanjem tega sporazuma, pogodbenika rešita sama z medsebojnimi pogajanji.
11. člen
SPREMEMBE SPORAZUMA
Pogodbenika lahko pisno predlagata spremembe katere koli določbe tega sporazuma. Spremembe začnejo veljati, če jih pisno odobri drugi pogodbenik.
12. člen
ZAČETEK VELJAVNOSTI – TRAJANJE – PRENEHANJE VELJAVNOSTI
Ta sporazum začne veljati na dan izmenjave diplomatskih not o končanih notranjepravnih postopkih. Pogodbenika bosta ravnala v skladu z določbami tega sporazuma od dne podpisa.
Ta sporazum ostane v veljavi pet (5) let in se potem samodejno podaljšuje za dodatna petletna (5-letna) obdobja.
Vsak pogodbenik lahko ta sporazum odpove. Sporazum preneha veljati šestdeset dni potem, ko drug pogodbenik prejme uradno obvestilo o odpovedi.
13. člen
JEZIK – PODPISI
Sestavljeno v dveh izvirnikih, vsak je sestavljen v slovenskem, grškem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Pri različni razlagi prevlada besedilo v angleškem jeziku.

A G R E E M E N T
ON THE MILITARY COOPERATION BETWEEN THE MINISTRY OF DEFENCE OF THE REPUBLIC OF SLOVENIA AND THE MINISTRY OF NATIONAL DEFENCE OF THE HELLENIC REPUPLIC
PREFACE
The Ministry of Defence of the Republic of Slovenia and the Ministry of National Defence of the Hellenic Republic, hereinafter referred to as the Parties,
Taking into account the objectives and principles of the Charter of the United Nations, in particular the principle of prohibition of use of force or the threat of the use of force in mutual relations, against sovereignty, inviolability of frontiers, territorial integrity, non-interference in internal affairs and peaceful settlement of disputes,
Following the provisions of the 1994 “PfP Framework Documents“ adopted in Brussels Summit.
Respecting the commitments adopted in compliance with the Final Act of the Conference on Security and Co-operation in Europe, the Paris Charter and Vienna Document as well as the other appropriate OSCE Documents.
Bearing in mind the Agreement between the Government of the Republic of Slovenia and the Government of the Hellenic Republic concerning the establishment of the diplomatic relations, signed in Ljubljana on the 21st of July 1992.
Desiring to develop a bilateral military cooperation.
Aiming also at implementing within their bilateral relations further confidence and Security Building Measures, in accordance with the negotiations document on confidence and Security Building Measures, adopted in Vienna in 1994.
Have agreed as follows:
Article 1
PURPOSE OF THE CO-OPERATION
The purpose of this Agreement is to establish the co-operation between the Ministry of Defence of the Republic of Slovenia and the Ministry of National Defence of the Hellenic Republic in the military field within the limits of their competencies, provided by their national legislation, as well as the Armed Forces of their countries.
Article 2
PRINCIPLES OF CO-OPERATION
The Parties shall establish military co-operation based on the principles of equality and mutual benefit.
The co-operation shall include activities between the Ministries of Defence, the General Staffs and the Armed Forces of the two Countries, within the framework of their capabilities.
This Agreement shall not affect the right of the Parties to sign similar agreements with other countries.
Article 3
FIELDS OF CO-OPERATION
The co-operation shall cover the following basic issues and directions:
– Armament programs issues – Defense program issues
– Military Education and targeted personnel training
– Logistics support
– Activities in the PFP framework
– Military sectors of Arms control and disarmament
– Peace support operations
– Crises management
– Military medicine
– Special services
– Military scientific research (theoretical and applied)
The above mentioned activities can be extended or limited by a mutual Agreement between the Parties.
Article 4
ACTIVITIES OF CO-OPERATION
This co-operation may include the following activities:
– Official visits and regular meetings at the levels of Defence Ministers, their Deputies, Chiefs of General Staffs or other representatives of the Ministries and Armed Forces
– Mutual invitations to the equipment and armaments exhibitions and to military exercises, as well as participation or organization of them.
– Participation in official, cultural and other kind of activities, organized by the Defence Ministries or other military structures.
Article 5
CO-OPERATION PLANNING
For monitoring the implementing of this Agreement and the obligations which derive from it, the Parties shall form a Joint Work-Team which shall be comprised of high-level officers and experts.
In order to accomplish the provisions of this Agreement, the Parties shall develop on an annual basis, the Programme of Co-operation for the following year.
To determine the Programme, the Parties shall exchange proposals in the form of requests. The proposals shall be sent to the General Staff of the Armed Forces of Republic of Slovenia and to the General Staff of the Armed Forces of the Hellenic Republic by October 15, annually.
The Programme of Co-operation shall include:
– a description of the activities,
– number of participants,
– duration, place and time of said activities,
– other necessary information.
The Programme of Co-operation shall be signed by the Chiefs of Defence General Staffs or by the authorised Representatives of each Party, by December 1, annually.
Article 6
COMMITMENTS OF THE PARTIES DURING THE EXCHANGE OF DELEGATIONS
The two Parties shall take the responsibility for expenses incurred in implementing the activities provided by the Programmes of Military Co-operation on the basis of the principal of reciprocity.
The visiting Party shall undertake the following:
– Transportation costs of the delegation from the point of departure to the designated destination in the receiving country, and back.
– Expenditures connected with receiving, parking, security, maintenance and refuelling of military aircraft providing transportation of the military delegation.
– Expenditures related to the transportation of an ill/injured person to his/her country.
The hosting Party shall undertake the following:
– Costs of local transportation of delegations from the point of arrival to the area of the planned activities, as well as the expenses for accommodation, full-board, and cultural activities that shall be organised,
– The rendering of full medical services including hospitalisation,
– Expenditures relating to training in specialised activities, provided in bilateral agreements.
Article 7
LEGAL ISSUES
The provisions of PfP SOFA (Agreement Among the State Parties to the North Atlantic Treaty and the Other States Participating in the Partnership for Peace regarding the Status of their Forces) and its Additional Protocol, done in Brussels on June 19, 1995, shall be duly applicable, mutatis mutandis, to this Agreement.
Article 8
RESPONSIBILITY AND COMPENSATION
Each Party renounces any claim to compensation in the case of death, injury or damages that may occur to personnel or to his/her property from actions or omissions by the personnel of the other Party during the rendering of services, under the terms of this Agreement. Claims may only be made if the action or the omission took place deliberately or from a serious negligence. In such a case, claims should be settled with direct negotiations between the Parties without resort to the jurisdiction of a third party.
In the case of death, injury or damages caused to the third parties by personnel of the Parties, whether the specific personnel was acting under the terms of this Agreement, the parties shall agree on payment of compensation. If agreement cannot be reached, the case shall be submitted to the competent Courts of the country in which the damaging incident took place.
Article 9
PROTECTION OF CLASSIFIED INFORMATION
The Parties shall safeguard the security of information and data obtained from bilateral contacts including confidential data and undertake the obligation not to use such data without a prior written approval of the Party which provided that information, as well as not to transfer that information to a third party.
Oral and written information and data from the bilateral contacts shall be handled in conformity with the state legislation of each Party which is in effect and must not be published by the Media.
Article 10
SETTLEMENT OF DISPUTES
Any dispute arising during the implementation of this Agreement shall be directly solved by the Parties themselves through mutual negotiation.
Article 11
AMENDMENTS TO THE AGREEMENT
Either Party may propose written amendments to any provision of the present Agreement. The amendments will take effect provided they are approved in writing by the other Party.
Article 12
COMMENCEMENT – DURATION – TERMINATION
This Agreement shall enter into force on the date of the exchange of diplomatic notes on the completion of internal legal procedures and the Parties shall act according to the provisions of the Agreement from the date of its signature.
This Agreement shall remain in force for a period of five (5) years, and shall thereafter automatically be renewed for additional five (5) years periods.
Each Party may denounce this Agreement. The Agreement shall be terminated sixty days from the receipt of the notification to that effect by the other Party.
Article 13
LANGUAGE – SIGNATURES
The present Agreement is written in two original copies, each drawn up in the Slovenian, Greek and English languages, all texts being equally authentic and in case of different interpretation, the text in the English language shall prevail.

Za izvajanje sporazuma skrbi Ministrstvo za obrambo Republike Slovenije.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
