O RAZGLASITVI ZAKONA O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE POLJSKE O REDNEM ZRAČNEM PROMETU
Razglašam Zakon o ratifikaciji Sporazuma med Vlado Republike Slovenije in Vlado Republike Poljske o rednem zračnem prometu, ki ga je sprejel Državni zbor Republike Slovenije na seji dne 20. junija 1995.

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE POLJSKE O REDNEM ZRAČNEM PROMETU
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Republike Poljske o rednem zračnem prometu, podpisan 1. marca 1995 v Varšavi.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE POLJSKE O REDNEM ZRAČNEM PROMETU
Glede na to, da sta Republika Slovenija in Republika Poljska
pogodbenici Konvencije o mednarodnem civilnem letalstvu, ki je bila odprta za podpis v Chicagu 7. decembra 1944, v želji, da poglobita sodelovanje v zračnem prometu, in z namenom, da zagotovita možnosti za redni zračni promet na vzajemni podlagi, sta
Vlada Republike Slovenije in Vlada Republike Poljske primerno pooblastili vsaka svojega pooblaščenca, ki sta se dogovorila o naslednjem:
1. člen
DEFINICIJE
1. Posamezni izrazi v tem sporazumu in njegovi prilogi pomenijo:
a/ ”konvencija” pomeni Konvencijo o mednarodnem civilnem letalstvu, ki je bila odprta za podpis v Chicagu 7. decembra 1944, in vključuje vsako prilogo, sprejeto na podlagi 90. člena omenjene konvencije, ter vsako spremembo prilog ali konvencije v skladu z njenim 90. in 94. členom v tisti meri, v kateri te priloge in spremembe veljajo za pogodbenici;
b/ ”pristojna organa” pomeni za Republiko Slovenijo Ministrstvo za promet in zveze, Uprava Republike Slovenije za zračno plovbo, in za Republiko Poljsko Ministrstvo za promet in pomorsko gospodarstvo, Oddelek za civilno letalstvo, ali v obeh primerih katero koli drugo osebo ali organ, pooblaščen za opravljanje nalog, ki jih zdaj opravljata omenjena organa;
c/ ”določeni prevoznik” pomeni zračnega prevoznika, ki ga je v skladu s 3. členom tega sporazuma določila ena ali druga pogodbenica za opravljanje dogovorjenega prometa;
d/ ”tarifa” pomeni cene, ki jih je treba plačati za prevoz potnikov, prtljage in tovora, ter pogoje, na podlagi katerih se te cene uporabljajo, vključno s provizijo in drugimi dodatnimi plačili za agencijo ali za prodajo prevoznih listin, izvzeti pa so nadomestila in pogoji za prevoz pošte.
2. Priloga je sestavni del tega sporazuma. Vsako sklicevanje na sporazum zajema tudi prilogo, razen če je izrecno drugače določeno.
2. člen
PROMETNE PRAVICE
1. Vsaka pogodbenica prizna drugi pogodbenici v tem sporazumu določene pravice, da opravlja zračni promet na progah, določenih v prilogi. Ta promet in te proge se v nadaljnjem besedilu imenujejo “dogovorjeni promet”, oziroma “določene proge”.
2. V skladu z določili tega sporazuma imata določena prevoznika pogodbenic pri opravljanju mednarodnega zračnega prometa:
a/ pravico do preleta ozemlja druge pogodbenice brez pristanka;
b/ pravico do pristanka na ozemlju druge pogodbenice v nekomercialne namene;
c/ pravico na ozemlju druge pogodbenice v krajih, določenih v prilogi tega sporazuma, vkrcati in izkrcati potnike, prtljago, tovor in pošto, ki so namenjeni v kraje ali prihajajo iz krajev na ozemlju druge pogodbenice.
3. Nobenega določila tega člena ni možno razumeti tako, da ima določeni prevoznik ene pogodbenice na ozemlju druge pogodbenice pravico za plačilo ali najemnino vkrcati potnike, prtljago, tovor ali pošto, namenjene v kakšen drug kraj na njenem ozemlju.
4. Če določeni prevoznik ene pogodbenice zaradi oboroženih spopadov, političnih nemirov ali posebnih in neobičajnih okoliščin ne more opravljati prometa na običajnih progah, si druga pogodbenica prizadeva omogočiti nadaljevanje takega prometa z ustreznimi spremembami prog, vključno z dodelitvijo pravic, ki so nujne za opravljanje prometa v tem času.
3. člen
DOLOČITEV IN IZDAJA DOVOLJENJA
1. Vsaka pogodbenica ima pravico določiti enega prevoznika za opravljanje dogovorjenega prometa na določenih progah. Pristojna organa pogodbenic pisno obvestita drug drugega o določitvi prevoznikov.
2. Po prejemu obvestila o določitvi pristojni organ, če ni zadržkov iz 3. in 4. odstavka tega člena, nemudoma izda prevozniku, ki ga je določila druga pogodbenica, ustrezno dovoljenje za opravljanje prometa. Takšno dovoljenje ne more biti preneseno ali odstopljeno drugemu prevozniku brez soglasja pogodbenice, ki je izdala tako dovoljenje.
3. Pristojni organ ene pogodbenice lahko zahteva, da določeni prevoznik druge pogodbenice dokaže, da izpolnjuje pogoje, določene v zakonih in predpisih, ki jih ta organ v skladu z določili konvencije normalno uporablja za opravljanje mednarodnega zračnega prometa.
4. Vsaka pogodbenica ima pravico odkloniti izdajo dovoljenja za opravljanje prometa iz 2. odstavka tega člena ali postaviti take pogoje, ki so po njenem mnenju potrebni za uresničevanje pravic iz 2. člena tega sporazuma, če nima dokazov, da je druga pogodbenica ali njeni državljani odločujoči lastnik in ima dejanski nadzor nad določenim prevoznikom, ki ga je druga pogodbenica določila za opravljanje dogovorjenega prometa.
5. Ko določeni prevoznik v skladu z določili 2. odstavka tega člena dobi dovoljenje za opravljanje prometa, ga lahko kadar koli začne opravljati, če je tarifa, določena v skladu z 11. členom tega sporazuma, veljavna.
4. člen
PREKLIC IN ZAČASNA PREPOVED OPRAVLJANJA PROMETA
1. Vsaka pogodbenica ima pravico preklicati dovoljenje za opravljanje prometa ali začasno prepovedati določenemu prevozniku druge pogodbenice uresničevanje pravic, določenih v 2. členu tega sporazuma, ali določiti take pogoje, ki so po njenem mnenju potrebni za izvrševanje teh pravic, če:
a/ prevoznik ne more dokazati, da ima druga pogodbenica ali njeni državljani odločujoči lastninski delež in dejanski nadzor nad tem prevoznikom; ali
b/ prevoznik ne spoštuje zakonov in predpisov pogodbenice, ki daje te pravice, ali jih huje krši; ali
c/ prevoznik ne opravlja dogovorjenega prometa pod pogoji, predpisanimi v tem sporazumu.
2. Če takojšen preklic ali začasna prepoved uresničevanja ali uveljavitev pogojev, omenjenih v 1. odstavku tega člena, niso bistveni za preprečitev nadaljnjega kršenja zakonov in predpisov, se ta pravica uporabi le po posvetovanju z drugo pogodbenico.
5. člen
PRIZNAVANJE SPRIČEVAL IN DOVOLJENJ
1. Spričevala o plovnosti, spričevala o sposobnosti in dovoljenja, ki jih izda ali potrdi ena pogodbenica, priznava tudi druga pogodbenica, dokler so veljavna.
2. Vsaka pogodbenica si pridržuje pravico, da za preletanje nad svojim ozemljem ne prizna veljavnosti tistih spričeval o sposobnosti in dovoljenj, ki jih je njenim državljanom izdala ali potrdila druga pogodbenica ali katera koli druga država.
6. člen
URESNIČEVANJE PRAVIC
1. Določena prevoznika imata primerne in enake možnosti za opravljanje dogovorjenega prometa med ozemljema pogodbenic.
2. Prevoznika, ki sta ju določili pogodbenici za opravljanje dogovorjenega prometa, zagotavljata zmogljivosti, ki ustrezajo povpraševanju po mednarodnem prevozu na dogovorjenih progah.
3. Pravica vsakega določenega prevoznika do opravljanja prometa na dogovorjenih progah se uresničuje v skladu s splošnimi načeli normalnega razvoja, ki jih priznavata pogodbenici, in v tesnem sodelovanju med določenima prevoznikoma.
4. Če notranji predpisi pogodbenic to določajo, je treba sporazume, ki se zaradi opravljanja dogovorjenega prometa lahko sklenejo med določenima prevoznikoma, predložiti pristojnima organoma obeh pogodbenic v potrditev.
7. člen
OPROSTITEV CARIN IN TAKS
1. Letala, ki jih uporablja v mednarodnem zračnem prometu določeni prevoznik ene pogodbenice, kot tudi njihova običajna oprema, zaloge goriva in maziv ter zaloge (vključno s hrano, pijačami, tobakom), ki so na takem letalu, so po prihodu na ozemlje druge pogodbenice oproščeni vseh carin, inšpekcijskih taks in drugih davščin in taks, če ostanejo na letalih, dokler se ponovno ne izvozijo.
2. Omenjenih carin, davščin in taks, razen stroškov za opravljene storitve, so oproščeni tudi:
a/ zaloge, natovorjene na ozemlju ene pogodbenice, v količinah, ki jih določijo pristojni organi te pogodbenice in so namenjene za uporabo na odhajajočem letalu, ki ga v mednarodnem prometu uporablja določeni prevoznik druge pogodbenice;
b/ rezervni deli in običajna oprema letala, pripeljana na ozemlje ene pogodbenice, namenjena za vzdrževanje ali popravilo letal, ki jih v mednarodnem prometu uporablja druga pogodbenica;
c/ zaloge goriva in maziv za letala, ki jih v mednarodnem zračnem prometu uporablja določeni prevoznik druge pogodbenice, tudi kadar so porabljene na delu leta nad ozemljem pogodbenice, na katerem so bile natovorjene;
d/ propagandno gradivo brez komercialne vrednosti, ki ga določeni prevoznik uporablja na ozemlju druge pogodbenice.
3. Če zakoni in predpisi ene ali druge pogodbenice to zahtevajo, bodo predmeti, o katerih je govor v 1. in 2. odstavku tega člena, pod carinskim nadzorom te pogodbenice.
4. Običajna oprema v letalu kot tudi predmeti in zaloge, ki so v letalih določenega prevoznika vsake pogodbenice, so lahko raztovorjeni na ozemlju druge pogodbenice le z odobritvijo carinskih organov tega ozemlja. V takem primeru se jih lahko da pod nadzor omenjenih organov, dokler niso ponovno izvoženi ali drugače porabljeni v skladu s carinskimi predpisi.
8. člen
TAKSE ZA UPORABNIKE
1. Vsaka pogodbenica lahko uvede ali dovoli, da se uvedejo upravičene in primerne takse za določenega prevoznika druge pogodbenice. Te takse temeljijo na zdravih ekonomskih načelih.
2. Za uporabo letališč ter letalskih navigacijskih naprav in služb, ki jih da na razpolago ena pogodbenica, določeni prevoznik druge pogodbenice ne plača več, kot je treba plačati za domača letala, ki se uporabljajo v rednem mednarodnem zračnem prometu.
9. člen
DIREKTNI TRANZIT
Za potnike, prtljago in tovor v direktnem tranzitu čez ozemlje ene pogodbenice, ki ne zapuste območja, ki je na letališču rezervirano za ta namen, velja samo poenostavljeni nadzor. Prtljaga in tovor v direktnem tranzitu sta oproščena carine in drugih podobnih taks.
10. člen
UPORABA ZAKONOV IN PREDPISOV
1. Zakoni in predpisi vsake pogodbenice, s katerimi so urejeni prihod, muditev in odhod letal v mednarodnem prometu, kot tudi upravljanje in plovba teh letal v mejah njenega ozemlja, se uporabljajo tudi za letala določenega prevoznika druge pogodbenice.
2. Zakoni in predpisi vsake pogodbenice, ki urejajo prihod, muditev in odhod z njenega ozemlja potnikov, posadk, prtljage, tovora in pošte, pripeljanih na letalih, in še posebej zakoni, ki se nanašajo na potne liste, carino in sanitarni nadzor, se uporabljajo za potnike, posadke, tovor in pošto v letalih določenega prevoznika druge pogodbenice.
3. Nobena pogodbenica nima pravice svojemu prevozniku v primerjavi z določenim prevoznikom druge pogodbenice dajati kakršne koli prednosti pri uporabi zakonov in predpisov, omenjenih v tem členu.
11. člen
TARIFE
1. Tarife, ki jih določeni prevoznik ene pogodbenice zaračunava za prevoz na ozemlje ali z ozemlja druge pogodbenice, so določene na primerni ravni, pri čemer so primerno upoštevani vsi pomembni dejavniki, vključno s celotnimi stroški prevoza, primernim dobičkom in tarifami drugih prevoznikov.
2. O tarifah iz prvega odstavka tega člena se, če je mogoče, dogovorita določena prevoznika obeh pogodbenic in se posvetujeta z drugimi prevozniki, ki delujejo na celotni progi ali njenem delu. Tak dogovor je, kadar je to mogoče, dosežen po postopku za določanje tarif, uveljavljenem v mednarodnem telesu, ki oblikuje predloge na tem področju.
3. Tako določene tarife je treba predložiti v odobritev pristojnima organoma obeh pogodbenic najmanj šestdeset dni pred dnem, ki je predlagan za njihovo uveljavitev. V posebnih primerih je ta rok lahko krajši, če to odobrita pristojna organa. Če v tridesetih dneh po predložitvi teh tarif noben pristojni organ ne sporoči drugemu pristojnemu organu svojega nestrinjanja, se šteje, da so te tarife potrjene.
4. Če se določena prevoznika ne moreta dogovoriti o kateri koli od teh tarif ali če iz katerega koli razloga neka tarifa ne more biti določena v skladu z 2. odstavkom tega člena ali če je v prvih tridesetih dneh šestdesetdnevnega roka iz 3. odstavka tega člena pristojni organ ene pogodbenice sporočil pristojnemu organu druge pogodbenice svoje nestrinjanje s katero koli tarifo, dogovorjeno v skladu z določili 2. odstavka tega člena, bosta pristojna organa obeh pogodbenic skušala v medsebojnem dogovoru določiti to tarifo.
5. Nobena tarifa ne prične veljati, če je izrecno ne odobrita pristojna organa obeh pogodbenic ali če niso izpolnjeni pogoji v skladu s 3. odstavkom tega člena.
6. Tarife, določene v skladu z določili tega člena, veljajo, dokler niso določene nove tarife v skladu z določili tega člena.
7. Pristojna organa obeh pogodbenic si prizadevata zagotoviti, da določena prevoznika spoštujeta dogovorjene tarife, registrirane pri pristojnih organih obeh pogodbenic, in da noben prevoznik na noben način neposredno ali posredno protizakonito ne zmanjšuje nobenega deleža teh tarif.
12. člen
KONVERZIJA IN TRANSFER PRIHODKOV
Vsak določen prevoznik ima v skladu z veljavnimi deviznimi predpisi pravico po uradnem tečaju zamenjati in transferirati v svojo državo presežek prihodkov nad lokalnimi izdatki glede na opravljene prevoze potnikov, prtljage, tovora in pošte. Če so plačila med pogodbenicama urejena s posebnim sporazumom, velja tak sporazum.
13. člen
DVOJNA OBDAVČITEV
1. Vsaka pogodbenica izvzema prihodke, ki jih določeni prevoznik druge pogodbenice doseže pri opravljanju mednarodnega prometa, od plačila kakršnih koli taks in davščin na dobiček kot tudi vseh drugih finančnih dajatev.
2. Vsaka pogodbenica se zavezuje, da ne bo pobirala davkov od plač uslužbencev določenega prevoznika druge pogodbenice, ki so poslani iz druge pogodbenice na delo v predstavništva, omenjena v 14. členu tega sporazuma.
14. člen
KOMERCIALNE DEJAVNOSTI
1. Določena prevoznika imata pravico imeti na ozemlju druge pogodbenice svoja predstavništva z osebjem, potrebnim za opravljanje dogovorjenega prometa.
2. Pri komercialnih dejavnostih je spoštovano načelo vzajemnosti. Pristojne oblasti pogodbenic storijo vse, da predstavništva določenega prevoznika druge pogodbenice lahko nemoteno opravljajo svoje dejavnosti.
3. Vsaka pogodbenica še posebej dovoljuje določenemu prevozniku druge pogodbenice, da na njenem ozemlju prodaja svoje prevozne zmogljivosti neposredno in po lastni presoji po agentih. Vsak prevoznik ima pravico prodajati take prevozne zmogljivosti in vsak jih lahko prosto kupuje v lokalni valuti ali v prosto konvertibilni valuti drugih držav v skladu z veljavnimi deviznimi predpisi.
15. člen
PREDLOŽITEV REDOV LETENJA
1. Določeni prevoznik ene pogodbenice mora predložiti predvidene rede letenja v potrditev pristojnemu organu druge pogodbenice najmanj trideset dni, preden začne opravljati dogovorjeni promet. Enak postopek velja za kakršno koli spremembo.
2. Za dodatne lete, ki jih določeni prevoznik ene pogodbenice želi opravljati v dogovorjenem prometu zunaj potrjenega reda letenja, mora predhodno vložiti zahtevo pri pristojnem organu druge pogodbenice. Praviloma jo mora vložiti najmanj dva delovna dneva pred začetkom takih poletov.
16. člen
STATISTIČNI PODATKI
Pristojna organa pogodbenic na zahtevo dajeta drug drugemu periodične statistične podatke in druge podobne informacije, ki se nanašajo na prevoz, opravljen v dogovorjenem prometu.
17. člen
POSVETOVANJA
Vsaka pogodbenica lahko kadar koli zahteva posvetovanje glede uresničevanja, razlage, uporabe ali dopolnitve tega sporazuma. Taka posvetovanja se morajo med pristojnima organoma začeti v šestdesetih dneh po prejemu pisne zahteve druge pogodbenice, razen če se pogodbenici dogovorita drugače.
18. člen
REŠEVANJE SPOROV
1. Če bi nastal med pogodbenicama kakršen koli spor zaradi razlage ali uporabe tega sporazuma, si ga pogodbenici v prvi vrsti prizadevata rešiti s pogajanji.
2. Če pogodbenici spora ne moreta rešiti s pogajanji, se lahko dogovorita, da odločitev o sporu prepustita neki osebi ali organu, ali pa lahko katera koli pogodbenica spor predloži v odločanje arbitraži treh razsodnikov, od katerih vsaka pogodbenica določi po enega, ta dva skupaj pa določita tretjega. Vsaka pogodbenica bo imenovala svojega razsodnika v šestdesetih dneh od dneva, ko po diplomatski poti prejme zahtevo druge pogodbenice za razrešitev spora na arbitraži, in tretji razsodnik je imenovan v nadaljnjih šestdesetih dneh. Če katera koli pogodbenica ne imenuje razsodnika v predvidenem času ali če tretji razsodnik ni določen v predvidenem času, lahko predsednik Sveta Mednarodne organizacije civilnega letalstva na zahtevo katere koli pogodbenice imenuje razsodnika ali razsodnike, ki jih primer zahteva. V vsakem primeru je tretji razsodnik državljan tretje države in deluje kot predsednik arbitraže.
3. Pogodbenici se obvezujeta, da bosta sprejeli vsako odločitev, sprejeto v skladu z 2. odstavkom tega člena in se po njej ravnali.
4. Arbitraža določi svoj poslovnik. Vsaka pogodbenica plača stroške svojega razsodnika. Preostale stroške arbitraže pogodbenici krijeta enako.
19. člen
VARNOST ZRAČNE PLOVBE
1. Pogodbenici ponovno potrjujeta svoje pravice in obveznosti v skladu z mednarodnim pravom, vključno s Konvencijo o mednarodnem civilnem letalstvu, sprejeto v Chicagu 7. decembra 1944, in vključno s Konvencijo o kaznivih dejanjih in nekih drugih aktih, storjenih na letalih, sprejeto v Tokiu 14. septembra 1963, Konvencijo o zatiranju nezakonite ugrabitve zrakoplovov, sprejeto v Haagu 16. decembra 1970, Konvencijo o zatiranju nezakonitih dejanj zoper varnost civilnega letalstva, sprejeto v Montrealu 23. septembra 1971, in njenim dopolnilnim Protokolom o zatiranju nezakonitih nasilnih dejanj na letališčih za mednarodno civilno zrakoplovstvo, sprejetim v Montrealu 24. februarja 1988, ko ta protokol začne veljati za obe pogodbenici. Pogodbenici potrjujeta, da je njuna obveznost varovanja civilnega letalstva pred dejanji nezakonitega vmešavanja sestavni del njunih medsebojnih odnosov v skladu s tem sporazumom.
2. Pogodbenici na zahtevo druga drugi dajeta vso možno pomoč, da bi preprečili nezakonite ugrabitve letal in druga nezakonita dejanja proti varnosti potnikov, posadk, letal, letališč in letalskih navigacijskih naprav ter vsako drugo grožnjo varnosti zračne plovbe.
3. Pogodbenici v medsebojnih odnosih ravnata v skladu z določili Mednarodne organizacije civilnega letalstva o varnosti civilne zračne plovbe, ki so opredeljena v prilogah konvencije, v tisti meri, v kateri ta določila veljajo za obe pogodbenici; od letalskih družb, ki so vpisane v njunih registrih ali opravljajo pretežni del svojih dejavnosti ali imajo sedež na njunih ozemljih, ter od letaliških podjetij na svojih ozemljih zahtevata, da delujejo v skladu s takimi varnostnimi predpisi.
4. Pogodbenici soglašata, da se lahko od njunih letalskih družb zahteva spoštovanje letalskih varnostnih predpisov, navedenih v 3. odstavku, ki jih zahteva druga pogodbenica za vstop, odhod oziroma dokler so letala na ozemlju te druge pogodbenice. Vsaka pogodbenica zagotavlja, da se na njenem ozemlju učinkovito izvajajo primerni ukrepi za zavarovanje letal, za pregled potnikov in njihove ročne prtljage in da so posadke, tovor in zaloge pred in med vkrcavanjem ali natovarjanjem ustrezno pregledani. Vsaka pogodbenica z naklonjenostjo obravnava vsako zahtevo druge pogodbenice za uvedbo razumnih dodatnih varnostnih ukrepov zaradi določene grožnje.
5. Ob nezakoniti ugrabitvi ali grožnji z ugrabitvijo civilnega letala ali drugih nezakonitih dejanjih proti varnosti takega letala, njegovih potnikov in posadk, letališč ali letalskih navigacijskih naprav pogodbenici pomagata druga drugi, s tem da poskrbita za komunikacije in druge ustrezne ukrepe, da bi se čim hitreje in varneje končal tak incident ali grožnja.
20. člen
SPREMEMBE
1. Vsaka pogodbenica lahko kadar koli predlaga drugi pogodbenici kakršno koli dopolnitev, za katero meni, da bi jo bilo dobro vključiti v ta sporazum. Posvetovanja med pogodbenicama o predlagani dopolnitvi se začnejo v šestdesetih dneh po prejemu zahteve ene pogodbenice za taka posvetovanja.
2. Če ena pogodbenica meni, da bi bilo dobro dopolniti prilogo tega sporazuma, se lahko o taki dopolnitvi dogovorita pristojna organa pogodbenic.
3. Katera koli dopolnitev tega sporazuma v skladu s 1. odstavkom tega člena začne veljati, ko je potrjena z izmenjavo not med pogodbenicama.
4. Ob sklenitvi kakršne koli splošne večstranske konvencije, ki bi se nanašala na zračni promet in bi postala zavezujoča za pogodbenici, bo ta sporazum spremenjen, tako da bo ustrezal določilom take konvencije.
21. člen
PRENEHANJE
1. Ta sporazum je sklenjen za nedoločen čas.
2. Vsaka pogodbenica lahko kadar koli sporoči njegovo odpoved. Tako sporočilo je hkrati poslano Mednarodni organizaciji civilnega letalstva.
3. Sporazum preneha veljati ob koncu sezone letenja, v kateri preteče dvanajst mesecev od dneva prejema sporočila o odpovedi, razen če je sporočilo sporazumno umaknjeno pred iztekom tega roka.
4. Če druga pogodbenica ne potrdi prejema sporočila o odpovedi, se šteje, da ga je prejela štirinajst dni po dnevu, ko ga je prejela Mednarodna organizacija civilnega letalstva.
22. člen
REGISTRACIJA PRI MEDNARODNI ORGANIZACIJI CIVILNEGA LETALSTVA
Ta sporazum in vse spremembe bodo registrirane pri Mednarodni organizaciji civilnega letalstva.
23. člen
UVELJAVITEV
1. Ta sporazum bo odobren v skladu z notranjo zakonodajo vsake od držav in začne veljati na dan izmenjave not, s katerimi se potrjuje, da so izpolnjeni omenjeni zakonski pogoji.
2. Ta sporazum se začasno uporablja od dneva podpisa.
Da bi to potrdila, sta pooblaščenca pogodbenic, ki sta bila za to pravilno pooblaščena, podpisala ta sporazum.
Sestavljeno v Varšavi dne 1. marca 1995 dveh izvirnikih v slovenskem, poljskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Ob morebitnem neskladju pri uresničevanju, razlagi ali uporabi je odločilno besedilo v angleškem jeziku.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE REPUBLIC OF POLAND RELATING TO SCHEDULED AIR SERVICES
Considering that the Republic of Slovenia and the Republic of Poland
are Parties to the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December, 1944, desiring to develop co-operation in the field of air transport, and desiring to establish the necessary basis for the operation of scheduled air services on the basis of reciprocity,
the Government of the Republic of Slovenia and the Government of the Republic of Poland have appointed plenipotentiaries who, duly authorized to that effect, have agreed as follows:
Article 1
DEFINITIONS
1. For the purpose of the present Agreement and its Annex:
a/ The term “the Convention” means the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December, 1944, and includes any annex adopted under article 90 of that Convention and any amendment of the annexes or Convention under articles 90 and 94 thereof so far as those annexes and amendments are applicable for both Contracting Parties;
b/ The term “aeronautical authorities” means, in the case of the Republic of Slovenia, the Ministry of Transport and Communication, Civil Aviation Authority and in the case of the Republic of Poland, the Ministry of Transport and Maritime Economy, Department of Civil Aviation, or in both cases any person or body, authorized to exercise the functions presently assigned to the said authorities;
c/ The term “designated airline” means an airline which either Contracting Party has designated in accordance with Article 3 of the present Agreement, for the operation of the agreed air services;
d/ The term “tariff” means the prices to be paid for the carriage of passengers, baggage and cargo and the conditions under which these prices apply, including commission charges and other additional remuneration for agency or sale of transportation documents but excluding remuneration and conditions for the carriage of mail.
2. The Annex forms an integral part of the present Agreement. All references to the Agreement shall include the Annex unless explicitly agreed otherwise.
Article 2
GRANT OF RIGHTS
1. Each Contracting Party grants to the other Contracting Party the rights specified in the present Agreement for the purpose of operating air services on the routes specified in the schedules of the Annex. Such services and routes are hereinafter called “agreed services” and “specified routes” respectively.
2. Subject to the provisions of the present Agreement the airline designated by each Contracting Party shall enjoy, while operating international air services:
a/ the right to fly without landing across the territory of the other Contracting Party;
b/ the right to make stops in the said territory for non-traffic purposes;
c/ the right to embark and disembark in the said territory at the points specified in the Annex to the present Agreement passengers, baggage, cargo and mail destined for or coming from points in the territoriy of the other Contracting Party.
3. Nothing in this Article shall be deemed to confer on the designated airline of one Contracting Party the privilege or embarking, in the territory of the other Contracting Party, passengers, baggage, cargo and mail carried for remuneration or hire and destined for another point in the territory of that Contracting Party.
4. If because of armed conflict, political disturbances or developments, or special and unusual circumstances, the designated airline of one Contracting Party is unable to operate a service on its normal routing, the other Contracting Party shall use its best efforts to facilitate the continued operation of such service through appropriate rearrangements of such routes, including the grant of rights for such time as may be necessary to facilitate viable operations.
Article 3
DESIGNATION AND OPERATING AUTHORIZATION
1. Each Contracting Party shall have the right to designate an airline for the purpose of operating the agreed services on specified routes. Such designation shall be effected by virtue of a written notification between the aeronautical authorities of both Contracting Parties.
2. The aeronautical authorities having received the notification of designation shall, subject to the provisions of paragraphs 3 and 4 of this Article, without delay grant the appropriate operating authorization to the airline designated by the other Contracting Party. The granted operating authorization shall not be transferred or transmitted to another airline without consent of the Contracting Party which granted such authorization.
3. The aeronautical authority of each Contracting Party may require the designated airline of the other Contracting Party to prove that it is qualified to fulfil the conditions prescribed under the laws and regulation normally applied to the operation of international air services by this authority in conformity with the provisions of the Convention.
4. Each Contracting Party shall have the right to refuse to grant the operating authorization referred to in paragraph 2 of this Article, or to impose such conditions as it may deem necessary on the exercise by a designated airline of the rights specified in Article 2 of this Agreement, if the said Contracting Party has no proof that substantial ownership and effective control of that airline are vested in the Contracting Party designating the airline or its nationals.
5. When a designated airline has been so authorized under paragraph 2 of this Article, it may begin at any time to operate each agreed service provided that a tariff established in accordance with the provisions of Article 11 of this Agreement is in force.
Article 4
REVOCATION AND SUSPENSION OF OPERATING AUTHORIZATION
1. Each Contracting Party shall have the right to revoke an operating authorization or to suspend the exercise of the rights specified in Article 2 of this Agreement by an airline designated by the other Contracting Party or to impose such sonditions as it may deem necessary on the exercise of those rights, if:
a/ the said airline can not prove that a substantial ownership and effective control are vested in the Contracting Party designating the airline or in its nationals; or
b/ the said airline fails to comply with or has seriously infringed the laws or regulations of the Contracting Party granting these rights; or
c/ the said airline fails to operate the agreed services in accordance with the conditions prescribed under the present Agreement.
2. Unless immediate revocation, suspension or imposition of the conditions mentioned in paragraph 1 of this Article is essential to prevent further infringements of laws or regulations such right shall be exercised only after consultation with the other Contracting Party.
Article 5
RECOGNITION OF CERTIFICATES AND LICENCES
1. Certificates of airworthiness, certificates of competency and licences issued or rendered valid by one of the Contracting Parties shall, during the period of their validity, be recognized as valid by the other Contracting Party.
2. Each Contracting Party reserves the right, however, to refuse to recognize as valid, for the purpose of flights over its own territory, certificates of competency and licences granted to or rendered valid for its own nationals by the other Contracting Party or by any other State.
Article 6
EXERCISE OF RIGHTS
1. The designated airlines shall enjoy fair and equal opportunities to operate the agreed services between the territories of the Contracting Parties.
2. The airlines designated by the Contracting Parties for the purpose of operating the agreed services shall provide capacity adequate to meet the traffic demand for the international carriage on the agreed services.
3. The right of each of the designated airlines to carry traffic on the agreed services shall be exercised in conformity with the general principles of normal development to which both Contracting Parties subscribe and in close cooperation between the designated airlines.
4. If the national regulations of a Contracting Party so require the agreements, which may be concluded between the designated airlines for the purpose of operating the agreed services, shall be subject to the approval of the aeronautical authorities of the said Contracting Party.
Article 7
EXEMPTION OF DUTIES AND TAXES
1. Aircraft engaged in international air services by the designated airline of either Contracting Party, as well as their regular equipment, supplies of fuel and lubricants and aircraft stores (including food, beverages, tobacco) on board such aircraft shall be exempt from customs duties, inspection fees and other duties or taxes on arriving in the territory of the other Contracting Party, provided that such equipment, supplies and stores remain on board these aircraft up to such time as they are re-exported.
2. Exempt from the same duties, fees and taxes, with the exception of charges corresponding to the performed service shall also be:
a/ aircraft stores taken on board in the territory of either Contracting Party, within limits fixed by the competent authorities of the said Contracting Party and destined for use on board outbound aircraft operated on an international service by the designated airline of the other Contracting Party;
b/ spare parts and regular equipment entered into the territory of one of the Contracting Parties and destined for the maintenance or repair of aircraft engaged in international service by the designated airline of the other Contracting Party;
c/ fuel and lubricants destined to supply aircraft engaged in an international service by the designated airline of the other Contracting Party even when these supplies are to be used on the part of the flight performed over the territory of the Contracting Party in which they are taken on board;
d/ advertising materials having no commercial value used by designated airline on the territory of the other Contracting Party.
3. If national laws or regulations of either Contracting Party so require, materials referred to in paragraphs 1 and 2 of this Article shall be kept under customs control of that Contracting Party.
4. The regular airborne equipment, as well as materials and supplies retained on board of the aircraft operated by the designated airline of either Contracting Party may be unloaded in the territory of the other Contracting Party only with the approval of the customs authorities of such territory. In such case, they may be placed under the supervision of the said authorities up to such time as they are re-exported or otherwise disposed of with the consent of the same authorities.
Article 8
USER CHARGES
1. Each Contracting Party may impose or permit to be imposed just and reasonable user charges on the designated airline of the other Contracting Party. These charges shall be based on sound economic principles.
2. Charges for the use of airport and air navigation facilities and services offered by one Contracting Party to the designated airline of the other Contracting Party shall not be higher than those which have to be paid by national aircraft operating on scheduled international services.
Article 9
DIRECT TRANSIT
Passengers, baggage and cargo in direct transit across the territory of one Contracting Party and not leaving the area of the airport reserved for such purpose shall only be subject to a very simplified control. Baggage and cargo in direct transit shall be exempt from customs duties and other similar taxes.
Article 10
APPLICATION OF LAWS AND REGULATIONS
1. The laws and regulations of each Contracting Party governing the admission to, remaining in and departure from its territory of aircraft engaged in international navigation and the operation and navigation of aircraft while within the limits of its territory, shall also be applied to the aircraft of the designated airline of the other Contracting Party.
2. The laws and regulations of each Contracting Party governing the admission to, remaining in and departure from its territory of passengers, crews, baggage, cargo and mail transported on board of aircraft and in particular those regarding passports, customs and sanitary control shall be applied to passengers, crews, baggage, cargo and mail taken on board of the aircraft of the designated airline of the other Contracting Party.
3. Neither Contracting Party may grant any preference to its own airline with regard to the designated airline of the other Contracting Party in the application of the laws and regulations provided for in this Article.
Article 11
TARIFFS
1. The tariffs to be charged by the designated airline of one Contracting Party for carriage to or from the territory of the other Contracting Party shall be established at reasonable levels, due regard being paid to all relevant factors, including cost of operation, reasonable profit and the tariffs of other airlines.
2. The tariffs referred to in paragraph 1 of this Article shall, if possible, be agreed by the designated airlines of both Contracting Parties, in consultation with other airlines operating over whole or part of the route. Such agreement shall, where possible, be reached through the rate-fixing machinery established by the international body which formulates proposals in this matter.
3. The tariffs so agreed shall be submitted for the approval of the aeronautical authorities of the Contracting Parties at least sixty days before the proposed date of their introduction. In special cases, this time limit may be reduced, subject to the agreement of the said authorities. If within thirty days after the submission of these tariffs neither of the aeronautical authorities notifies to the other aeronautical authority its disapproval, these tariffs shall be considered approved.
4. If the designated airlines cannot agree on any of these tariffs, or if for some reason a tariff cannot be fixed in accordance with the provisions of paragraph 2 of this Article or, if during the first thirty days of the sixty days period referred to in paragraph 3 of this Article the aeronautical authorities of one Contracting Party give the aeronautical authorities of the other Contracting Party notice of their disapproval of any tariff agreed in accordance with the provisions of paragraph 2 of this Article, the aeronautical authorities of both Contracting Parties shall try to determine the tariff by agreement between themselves.
5. No tariff shall come into force if aeronautical authorities of the Contracting Parties have not approved it explicitly or according to paragraph 3 of this Article.
6. The tariffs established in accordance with the provisions of this Article shall remain in force until new tariffs have been established in accordance with the provisions of this Article.
7. The aeronautical authorities of each Contracting Party shall exercise their best efforts to ensure that the designated airlines conform to the agreed tariffs filed with the aeronautical authorities of the Contracting Parties, and that no airline illegally rebates any portion of such tariffs by any means, directly or indirectly.
Article 12
CONVERSION AND TRANSFER OF REVENUES
Each designated airline shall have the right to convert and remit to its country in accordance with the foreign exchange regulations in force, at the official rate of exchange, receipts in excess of sums locally disbursed in due proportion to the carriage of passengers, baggage, cargo and mail. If payments between the Contracting Parties are regulated by a special agreement, this special agreement shall apply.
Article 13
DOUBLE TAXATION
1. Each Contracting Party exempts receipts coming from the operation of aircraft in international traffic by the designated airline of the other Contracting Party from any taxes, charges from profits as well as from other financial charges.
2. Each Contracting Party undertakes not to collect taxes from salaries of employees of the designated airline of the other Contracting Party delegated from its country to work in the representations mentioned in Article 14 of this Agreement.
Article 14
COMMERCIAL ACTIVITIES
1. The designated airlines shall have the right to maintain on the territory of the other Contracting Party their representations with the necessary personnel to operate the agreed air services.
2. For the commercial activities the principle of reciprocity shall apply. The competent authorities of each Contracting Party will take all necessary steps to ensure that the representations of the airline designated by the other Contracting Party may exercise their activites in an orderly manner.
3. In particular, each Contracting Party grants to the designated airline of the other Contracting Party the right to engage in the sale of air transportation in its territory directly and, at the airline’s discretion, throught its agents. Each airline shall have the right to sell such transportation, and any person shall be free to purchase such transportation in the currency of that territory or in freely convertible currencies of other countries in accordance with the foreign exchange regulations in force.
Article 15
TIME-TABLE SUBMISSION
1. Not later than thirty days prior to the operation of the agreed services the designated airline of one Contracting Party shall submit the envisaged time-table for approval to the aeronautical authorities of the other Contracting Party. The same procedure shall apply to any modification thereof.
2. For supplementary flights which the designated airline of one Contracting Party wishes to operate on the agreed services outside the approved time-table it has to request prior permission from the aeronautical authorities of the other Contracting Party. Such request shall usually be submitted at least two working days before operating such flights.
Article 16
PROVISION OF STATISTICS
The aeronautical authorities of both Contracting Parties shall supply each other, on request, with periodic statistics or other similar information relating to the traffic carried on the agreed services.
Article 17
CONSULTATIONS
Either Contracting Party may at any time request consultations on the implementation, interpretation, application or amendment of the present Agreement. Such consultations, between the aeronautical authorities, shall begin within a period of sixty days from the date the other Contracting Party receives the written request, unless otherwise agreed by the Contracting Parties.
Article 18
SETTLEMENT OF DISPUTES
1. If any dispute arises between the Contracting Parties relating to the interpretation or application of this Agreement, the Contracting Parties shall in the first place endeavour to settle it by negotiation.
2. If the Contracting Parties fail to reach a settlement by negotiation, they may agree to refer the dispute for decision to some person or body, or the dispute may at the request of either Contracting Party be submitted for the decision to a tribunal of three arbitrators, one to be nominated by each Contracting Party and the third to be appointed by the two so nominated. Each of the Contracting Parties shall nominate an arbitrator within a period of sixty days from the date of receipt by either Contracting Party from the other of a notice through diplomatic channels requesting arbitration of the dispute and the third arbitrator shall be appointed within a further period of sixty days. If either of the Contracting Parties fails to nominate an arbitrator within the period specified, or if the third arbitrator is not appointed within the period specified, the President of the Council of the International Civil Aviation Organization may be requested by either Contracting Party to appoint an arbitrator or arbitrators as the case requires. In any case, the third arbitrator shall be a national of a third State and shall act as president of the arbitral body.
3. The Contracting Parties undertake to comply with any decision given under paragraph 2 of this Article.
4. The arbitral tribunal shall determine its own procedure. Each Contracting Party shall pay the expences of its arbitrator. The remaining expenses of the arbitral tribunal shall be shared equally by the Contracting Parties.
Article 19
AVIATION SECURITY
1. The Contracting Parties reaffirm their rights and obligations under international law, including the Convention on International Civil Aviation, signed at Chicago on 7 December 1944, and including the Convention on Offences and Certain Other Acts Committed on Board Aircraft, signed at Tokyo on 14 September 1963, and the Convention for the Suppression of Unlawful Seizure of Aircraft, signed at the Hague on 16 December 1970, and the Convention for the Suppression of Acts against the Safety of Civil Aviation, signed at Montreal on 23 September 1971 and its supplementary Protocol for the Suppression of Unlawful Acts of Violence at Airports Serving International Civil Aviation, signed at Montreal on 24 February 1988 when it becomes binding for both Contracting Parties. The Contracting Parties affirm that their obligations to protect the security of civil aviation against acts of unlawful interference form an integral part of their mutual relations under the present Agreement.
2. The Contracting Parties shall provide upon request all possible assistance to each other to prevent acts of unlawful seizure of aircraft and other unlawful acts against the safety of passengers, crews, aircraft, airports and air navigation facilities and any other threat to aviation security.
3. The Contracting Parties shall, in their mutual relations, act in conformity with the aviation security standards established by the International Civil Aviation Organization and designated as Annexes to the Convention to the extent that such security standards are applicable to the Contracting Parties; they shall require that operators of aircraft of their registry or operators who have their principal place of business or permanent residence in their territory, and the operators of airports in their territory, act in conformity with such aviation security standards.
4. Each Contracting Party agrees that its airline may be required to observe the aviation security standards referred to in paragraph 3 required by the other Contracting Party, for entrance into, departure from, or while within, the territory of that other Contracting Party. Each Contracting Party shall ensure that effective measures are taken within its territory to protect aircraft, to screen passengers and their carry-on items, and to carry out appropriate checks on crews, cargo and aircraft stores prior to and during boarding or loading. Each Contracting Party shall also act favourably upon any request from the other Contracting Party for reasonable special security measures to meet a particular threat.
5. When an incident or threat of an incident of unlawful seizure of civil aircraft or other unlawful acts against the safety of such aircraft, their passengers and crews, airports or air navigation facilities occurs, the Contracting Parties shall assist each other by facilitating communications and other appropriate measures intended to terminate rapidly and safely such incident or threat thereof.
Article 20
MODIFICATIONS
1. Either Contracting Party may at any time propose to the other Contracting Party any amendment which it considers desirable to bring to this Agreement. The consultation between the Contracting Parties concerning the proposed amendments shall begin within a period of sixty days from the date of the presentation of the request for such consultation by one Contracting Party.
2. If either Contracting Party considers it desirable to amend the Annex to this Agreement, the aeronautical authorities of both Contracting Parties may agree upon any such amendment.
3. Any amendments to this Agreement pursuant to paragraph 1 of this Article shall come into effect when confirmed by an exchange of notes between the Contracting Parties.
4. In the event of the conclusion of any general multilateral convention concerning air transport by which both Contracting Parties become bound, the present Agreement shall be modified so as to conform to the provisions of such convention.
Article 21
TERMINATION
1. This Agreement is concluded for indefinite time.
2. Either Contracting Party may at any time denounce it by notification. Such notice shall simultanously be communicated to the International Civil Aviation Organization.
3. The Agreement shall terminate at the end of a time-table period during which twelve months after the date of receipt of the notice will have elapsed, unless the notice is withdrawn by mutual agreement before the expiry of this period.
4. In default of acknowledgement of receipt by the other Contracting Party, the notice shall be deemed to have been received fourteen days after the date on which the International Civil Aviation Organization will have received communication thereof.
Article 22
REGISTRATION WITH INTERNATIONAL CIVIL AVIATION ORGANIZATION
This Agreement and all amendments shall be registered with International Civil Aviation Organization.
Article 23
ENTRY INTO FORCE
1. This Agreement shall be approved pursuant to the national legislation of each of two States and shall come into effect on the day of the exchange of notes stating that this legislation has been complied with.
2. This Agreement shall provisionally apply from the date of signature.
In witness whereof the plenipotentiaries of the Contracting Parties, being duly authorized to that effect, have signed the present Agreement.
Done in Warsaw at this 1st day of March, 1995 in two originals in the Slovenian, Polish and English languages, all the texts being equally authentic. In case of any divergence of implementation, interpretation or application, the English text shall prevail.
