O RAZGLASITVI ZAKONA O RATIFIKACIJI SPORAZUMA O MEDNARODNEM CESTNEM PREVOZU MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE ESTONIJE
Razglašam Zakon o ratifikaciji Sporazuma o mednarodnem cestnem prevozu med Vlado Republike Slovenije in Vlado Republike Estonije, ki ga je sprejel Državni zbor Republike Slovenije na seji dne 20. februarja 1995.

O RATIFIKACIJI SPORAZUMA O MEDNARODNEM CESTNEM PREVOZU MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE ESTONIJE
1. člen
Ratificira se Sporazum o mednarodnem cestnem prevozu med Vlado Republike Slovenije in Vlado Republike Estonije, podpisan 27. maja 1994 v Ljubljani.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:
S P O R A Z U M
O MEDNARODNEM CESTNEM PREVOZU MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE ESTONIJE
Vlada Republike Slovenije in Vlada Republike Estonije (v nadaljevanju: pogodbenici),
ki želita zaradi medsebojnih gospodarskih odnosov pospešiti razvoj cestnega prevoza blaga in potnikov v državi in iz njiju ter tranzitnega prometa preko njunih ozemelj,
sta se dogovorili, kot sledi:
1. člen
Prevoznik, ki ima v svoji lastni državi pravico do opravljanja mednarodnih cestnih prevozov, lahko na podlagi tega sporazuma in v skladu s pogoji, ki so v njem določeni, opravlja cestne prevoze na ozemlje druge pogodbenice oziroma z njega ali tranzitne preko tega ozemlja.
2. člen
Za namene tega sporazuma:
1. pomeni izraz “prevoznik” osebo (tudi pravno), ki ima sedež v eni od pogodbenic in ji v državi, kjer ima sedež, zakon omogoča dostop na mednarodni trg cestnega prevoza blaga in potnikov preko izposoje ali za plačilo ali na njen račun v skladu z ustrezno državno zakonodajo;
2. pomeni izraz “vozilo” motorno vozilo, ki je registrirano v eni od pogodbenic, ali sklop vozil, med katerimi je vsaj motorno vozilo registrirano v eni od pogodbenic in ki se uporablja in je opremljeno izključno za prevoz blaga ali prevoz potnikov z avtobusi, ki so konstruirani in se uporabljajo za prevoz najmanj devetih oseb skupaj z voznikom;
3. pomeni izraz “kabotaža” prevozne storitve na ozemlju pogodbenice, ki jih opravlja prevoznik, ki ni nastanjen v tej državi;
4. pomeni izraz “prevoz” prevažanje naloženih ali nenaloženih vozil po cesti, tudi če vozilo, priklopnik ali polpriklopnik na delu svoje poti uporablja železnico ali vodne poti.
3. člen
Med opravljanjem cestnih prevozov na ozemlju druge pogodbenice je treba spoštovati njene zakone in predpise.
4. člen
Redne avtobusne prevoze in redne tranzitne avtobusne prevoze med obema pogodbenicama je mogoče opravljati na podlagi posebne dovolilnice z veljavnostjo najmanj enega leta, ki jo izdajo pristojne oblasti ene pogodbenice vozilom, registriranim pri drugi pogodbenici, za del poti, ki poteka po ozemlju njene države.
Prevozi iz prvega odstavka tega člena veljajo za odobrene in jih je mogoče začeti opravljati, ko si pristojne oblasti obeh pogodbenic izmenjajo posebne dovolilnice z vsemi potrebnimi prilogami.
Med prevozom se mora original ali potrjen izvod te posebne dovolilnice nahajati v vozilu.
5. člen
Za občasne avtobusne prevoze dovolilnica ni potrebna.
6. člen
Prevozniki, ki se ukvarjajo s prevozom blaga, morajo imeti za prevoze med obema pogodbenicama, tranzitne prevoze in prevoze v tretje države ali iz njih dovolilnico.
Dovolilnice pa niso potrebne za naslednje prevoze blaga:
– prevoz pošte v okviru javnih storitev;
– prevoz poškodovanih vozil ali vozil v okvari;
– prevoz blaga v motornem vozilu, katerega dovoljena teža v naloženem stanju skupaj s prikolicami ne presega 6 ton ali katerega dovoljena koristna nosilnost skupaj s prikolicami ne presega 3,5 tone;
– prevoze medicinskih materialov in opreme ali drugega blaga, ki je potrebno v nujnih primerih, še posebej ko gre za naravne nesreče.
7. člen
Pogodbenici morata vsaka v svoji državi zagotoviti potrebne spodbude za uporabo kombiniranega prevoza in morskih pristanišč.
8. člen
Za kabotažo je potrebna posebna dovolilnica, ki jo izdajo pristojne oblasti.
9. člen
Teža in dimenzije vozil morajo ustrezati uradnim registracijskim podatkom in ne smejo presegati mejnih vrednosti, ki so v veljavi v državi gostiteljici.
Posebna dovolilnica je potrebna, če teža in/ali dimenzije naloženega ali nenaloženega vozila, ki opravlja prevoz po določbah tega sporazuma, presega največjo vrednost, ki je dovoljena na ozemlju države gostiteljice.
10. člen
Pri prevozu nevarnih tovorov je treba spoštovati določbe Evropskega sporazuma o mednarodnem cestnem prevozu nevarnih tovorov (ADR).
11. člen
Pristojne oblasti pogodbenic morajo druga drugo obveščati o kršenju tega sporazuma in o sankcijah proti prevoznikom. Prav tako morajo te oblasti druga drugo obveščati o sprejetih ukrepih.
12. člen
Vozila skupaj s pripadajočimi rezervnimi deli, ki opravljajo prevoze po tem sporazumu, so obojestransko oproščena plačila vseh davkov in dajatev na vožnjo z vozili ali posest vozil.
Oprostitev ne velja za davke in prispevke za viške motornega goriva nad kapaciteto običajnih rezervoarjev, za plačilo davka na dodatno vrednost za prevozne storitve in takse za avtoceste in ceste.
13. člen
Za reševanje problemov in zadev v zvezi z uporabo tega sporazuma, ki jih ni mogoče rešiti z neposrednim dogovorom med pogodbenicama, je treba ustanoviti mešano komisijo. Mešana komisija se sestane na zahtevo katerekoli od pogodbenic in jo sestavljajo predstavniki pristojnih oblasti obeh pogodbenic.
14. člen
Pogodbenici sta se dogovorili za določitev pravil o uporabi določenih določb tega sporazuma v Dodatnem protokolu. Dodatni protokol je sestavni del tega sporazuma.
15. člen
Ta sporazum se uporablja začasno od datuma njegovega podpisa. Pogodbenici morata druga drugo v pisni obliki obvestiti o izpolnitvi pogojev glede postopka za uveljavitev mednarodnih sporazumov.
Ta sporazum začne veljati prvi dan drugega meseca, ki sledi datumu zadnjega obvestila.
16. člen
Pogodbenici se morata dogovoriti o vsakršni morebitni dopolnitvi tega sporazuma in taka dopolnitev začne veljati v skladu s postopkom iz 15. člena.
17. člen
Ta sporazum velja, dokler ena od pogodbenih strank drugo pogodbeno stranko tri mesece pred koncem koledarskega leta pisno ne obvesti o svoji nameri, da sporazum prekine.
Ta sporazum sta podpisala ustrezno pooblaščena podpisnika.
Sklenjeno v Ljubljani dne 27. maja 1994 v dveh izvodih v slovenskem, estonskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. V primeru razlik v razlagi je odločilno besedilo v angleškem jeziku.

A G R E E M E N T
ON INTERNATIONAL ROAD TRANSPORT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE REPUBLIC OF ESTONIA
The Government of the Republic of Slovenia and the Government of the Republic of Estonia (hereinafter referred to as “the Contracting Parties”),
desirous of promoting in the interest of their economic relations, the development of transport of goods and passengers by road in, to and from their states and in transit across their territories,
have agreed as follows:
Article 1
On terms specified in this Agreement a carrier entitled in his home state to perform international road transport operations may by virtue of this Agreement perform road transport operations to, from or in transit through the territory of the other Contracting Party.
Article 2
For the purpose of this Agreement:
1. the term “carrier” means a person (including a legal person), who is established in one of the Contracting Parties and legally admitted in the state of establishment to the international transport market of goods or passengers by road for hire or reward or on his own account in accordance with the relevant national laws and regulations;
2. the term “vehicle” means a motor vehicle registered in one of the Contracting Parties or a combination of vehicles of which at least the motor vehicle is registered in one of the Contracting Party and which is used and equiped exclusively for the carriage of goods or the carriage of passengers by buses constructed and used for the carrying more than nine persons including the driver;
3. the term “cabotage” means the operation of transport services within the territory of a Contracting Party by a carrier not established in that state;
4. the term “transport” means the conveyance of laden or unladen vehicles by road, even if for a part of the journey the vehicle, trailer or semi-trailer is using rail or waterways.
Article 3
The laws and provisions of the other Contracting Party shall be complied with while performing road transport operations within its territory.
Article 4
Regular bus service and regular transit bus service between the Contracting Parties can be performed on the basic of a special permit, valid for a minimum period of one year, issued by competent authorities of each Contracting Party for the part of the line on the territory of their respective states, for the vehicle registered in the other Contracting Party.
Services stated in the first paragraph of this article shall be considered approved and can start operating once the competent authorities of both Contracting Parties have exchanged the special permits with all necessary enclosures.
During the journey the special permit must be present in the vehicle, either original or authorized copy.
Article 5
Occasional transport operations by buses do not require any permit.
Article 6
The carriers that operate transport of goods must have a permit when operating transport between the two states, in transit or to and from third states.
In any case no permits shall be required for the following transport of goods:
– carriage of mail as a public service;
– carriage of vehicle which have suffered damage or breakdown;
– the carriage of goods in motor vehicle, the permissible laden weight of which including that of trailers, does not exceed 6 tons or the permissible payload of which, including that of trailers, does not exceed 3,5 tons;
– carriage of medical goods and equipment or other goods necessary in case of emergency, in particular for natural disasters.
Article 7
Both Contracting Parties shall provide the necessary incentives to encourage the use of combined transport and sea ports in their respective states.
Article 8
A special permit issued by competent authorities is required for cabotage.
Article 9
Weight and dimensions of vehicles shall be in accordance with the official registration of the vehicle and may not exceed the limits in force in the host state.
A special permit is required if the weight and/or dimensions of a laden or unladen vehicle when engaged in transport under the provisions of this Agreement exceed the permissible maximum in the territory of the host state.
Article 10
Concerning the carriage of dangerous goods the provisions of the European Agreement concerning the international carriage of dangerous goods by road (ADR) have to be complied with.
Article 11
The competent authorities of the Contracting Parties shall inform each other about the infringements of the present Agreement and about the sanctions against the carriers. These authorities shall also notify each other of the measures taken.
Article 12
Vehicles, including their spare parts, carrying out transport in accordance with this Agreement shall be mutually exempted from all taxes and charges levied on the circulation or possession of the vehicle.
Taxes and charges on motor fuel over the normal tanks of the vehicle, value added taxes on transport services, highways and road taxes are not exempted.
Article 13
In order to solve the problems and issues connected with the application of this Agreement, which can not be solved by a direct agreement between the two Contract Parties a Mixed Commission will be established. The Mixed Commission shall meet at the request of either Contracting Party and shall comprise representative of the competent authorities of both Contracting Parties.
Article 14
The Contracting Parties have agreed to lay down rules for the application of certain provisions of this Agreement in an Additional Protocol. The Additional Protocol shall form an integral part of the Agreement.
Article 15
This Agreement shall be applied provisionally as from the date of its signature. The Contracting Parties will notify each other in writing that the conditions regarding the procedure of entering into force of international agreements have been fulfilled.
This Agreement shall enter into force on the first day of the second month following the date of last notification.
Article 16
Any kind of amendment to the present Agreement will be negotiated by the Contracting Parties and will enter into force according to the procedure mentioned under Article 15.
Article 17
This Agreement will remain in force until one of the Contracting Parties gives the other Contracting Party written notice three months before the end of a calendar year of its intention to terminate it.
In witness whereof the undersigned, being duly authorised thereto, have signed this Agreement.
Done in Ljubljana on 27 May 1994, in two copies, in the Slovenian, Estonian and English languages, all texts being equally authentic. In the case of divergency in interpretation, the text in the English language shall prevail.
